Cette thèse porte sur les conditions de passage clandestin des migrants africains à la frontière sud espagnole ainsi que sur leurs logiques d’insertion dans la province andalouse d’Almeria et au-delà, dans l’espace européen. Interrogeant le rapport de force entre migrants et État, cette thèse insiste sur les capacités des migrants à la mobilité et met en lumière l’ambivalence des institutions gouvernementales, en partie liée à la fonction économique des migrants clandestins. Les articulations entre les stratégies des migrants clandestins et les logiques des institutions et des acteurs locaux y sont analysées à partir de la description des interactions, des transactions et des conflits, entre les migrants nouveaux venus, ceux anciennement installés, les ONG, les patrons, les forces de police, etc. L’approche compréhensive de l’expérience des migrants avant et après le passage de la frontière a révélé l’importance des réseaux sociaux dans l’entrée en Europe et dans la recherche d’un logement, d’un emploi et de papiers ; tout en soulignant la fonction du milieu associatif espagnol pour les migrants les plus vulnérables. D’un côté, les institutions gouvernementales oscillent entre contrôle et tolérance ; de l’autre, les migrants évoluent entre contraintes et stratégies, régularités et irrégularités. Leur migration, construite par étape, constitue alors un véritable « jeu de l’oie ». Almeria représente ainsi une étape où chercher des papiers. Cette province spécialisée dans l’agriculture possède une économie souterraine « à découvert » : elle est connue de tous et bénéficie de la complicité des autorités. Almeria centralise ainsi les migrants africains en situation précaire récemment arrivés ou déjà présents en Europe. Cette thèse propose donc de qualifier les mobilités de ces migrants clandestins « d’errance maîtrisée », maîtrise qui se fait essentiellement à travers les relations sociales et la constitution de réseaux sociaux. L’attention portée aux modalités de construction du projet migratoire après le passage de la frontière a également permis de faire émerger la notion d’ « instance zéro ». Il s’agit d’un espace-temps « autre », d’une instance intermédiaire entre le passage de la frontière et l’insertion dans l’espace européen ; un temps plus ou moins long caractérisé par la répétition de situations élémentaires de survie qui autorisent l’exploitation maximale du migrant, lequel cherche alors les moyens d’éviter cette répétition ou d’en sortir.

This PhD thesis deals with the conditions of illegal border crossing of the African migrants in the south of Spain and with their logics of insertion in the Andalusian province of Almeria and beyond, in the European space. By questioning the power struggle between migrants and State, this thesis insists on the migrants’ capacity to move and it highlights the ambivalence of governmental institutions, partly linked with the economical function of undocumented migrants. Abstract The purpose of this essay is to study how undocumented migrants situation is constructed inSwedish massmedia discourse. The purpose has also been to study how the compromisedhuman rights of undocumented migrants in Sweden are legitimated in massmedia discourseand how resistance is constructed. The following main questions have been processed in this essay: - How are undocumented migrants and their situation constructed in Swedish massmediadiscourse?- How is society’s part in the situation constructed? Following questions are related to the main questions:- How is the situation that undocumented migrants face in Sweden legitimated in discourse?-What social consequences do the constructions have for undocumented migrants and for theSwedish society? The questions have been answered through a discourse analysis on empirical materialconsisting of ten news clips from Swedish public service television SVT and ten articles fromthe online editions of the main national newspapers Dagens Nyheter, Svenska Dagbladet, Aftonbladet and Expressen. The analysis was done with analytic methods from discursivepsychology and with the sociological theories at hand in this essay. The conclusions drawn from the analysis are that the situation is constructed according todifferent interpretative repertoires drawing on humanitarian discourses and economicdiscourses, which lead to separate social consequences and ideological categorisations of ”usand them”. The rethoric constructions of the situation in massmedia contributes to thelegitimation of the marginalisation of undocumented migrants in Sweden through the focus onpolitical and financial aspects and the legal status of the migrant before human rights.

Sammanfattning Syftet med studien är att undersöka hur irreguljära migranter, eller ”papperslösa” flyktingars situation konstrueras diskursivt i svensk massmedia. Syftet är även att studera hur ”papperslösa” flyktingars villkorade mänskliga rättigheter i Sverige legitimeras diskursivt i massmedia och hur konstruktioner av motmakt görs. Följande frågeställningar behandlas i uppsatsen: - Hur konstrueras ”papperslösa” flyktingar och deras situation diskursivt i svensk massmedia?- Hur konstrueras samhällets roll i situationen? Följande underfrågor är relaterade till frågeställningarna:- Hur legitimeras situationen som ”papperslösa” ställs inför i Sverige diskursivt?- Vilka sociala konsekvenser kan konstruktionerna ha för ”papperslösa” och för samhället? Frågeställningarna besvaras genom en diskursanalys av ett empiriskt urval bestående av tio nyhetsinslag som sänts i Sverige Television och tio nyhetsartiklar från Dagens Nyheter, Svenska Dagbladet, Aftonbladet och Expressens Internetupplagor. L’article 1er de la Déclaration Universelle des Droits de l’Homme, ne déclare-t-il pas que « Tous les hommes naissent et demeurent libres et égaux en droits »? La non-discrimination ainsi que l’égalité de traitement des sujets de droits devant les juridictions ne constituent-ils pas le socle des principes cardinaux relatifs à la protection des droits de l’homme ? Le droit et les pratiques ont tendance à ne pas considérer les personnes dites « sans-papiers » comme des usagers du service public reniant ainsi leur personnalité juridique. Pourtant, le respect du droit des étrangers est un marqueur essentiel du degré de protection et d’effectivité des droits et libertés dans un pays. Au courant des dernières années, les associations et organisations œuvrant pour le respect des droits de l’homme n’ont cessé de souligner le fossé existant entre les droits officiellement proclamés et les droits réellement exercés par les étrangers sur le territoire européen. Dès lors, s’est posé le problème d’une harmonisation et d’une communautarisation réelles des politiques migratoires européennes. Cette thèse propose alors dans l’immédiat, une contribution à une analyse circonstanciée et comparée du traitement public des sans-papiers en France et en Suède. Elle est motivée par mon expérience personnelle sur la problématique du droit des étrangers en Europe et insiste sur la mutation de l’action collective par le biais de la juridification et de l’européanisation. Les nombreuses difficultés rencontrées par les pouvoirs publics à faire émerger une politique publique singulière propre aux sans-papiers dessine un faisceau d’hypothèses qui nous aideront à mieux comprendre et cerner le problème.

Does Article 1 of the Universal Declaration of Human Rights not state that "All women and men are born and remain free and equal in rights"? Do non-discrimination as well as equal treatment of subject of law in court not constitute the core principles relating to the protection of human rights? Law and practices tend to not consider the so-called "undocumented migrants" as public service users, thus denying their legal personality. However, the respect of foreigners’ rights is an essential sign of the degree of protection and effectiveness of rights and freedoms in a country. In recent years, associations and organizations working for the respect of human rights have constantly emphasized the gap between the officially proclaimed rights and the rights actually exercised by foreigners on the European Union territory. Consequently, the problem of real harmonization and communitisation of European migration policies has arisen. This thesis put forward a contribution to a detailed and comparative analysis of the public treatment of undocumented migrants in France and Sweden. Bakgrund: Papperslösa och asylsökande räknas till samhällets mest utsatta och tillhör de grupper vilka FNs mänskliga rättigheter syftar till att skydda. Svensk lagstiftning är inte förenlig med dessa rättigheter. Papperslösa och asylsökande lider ofta av fysiska och psykiska problem och vägen till hälso- och sjukvård är kantad av hinder. Den svenska yrkesetiska koden för sjuksköterskor beskriver en professionell plikt att vårda alla på samma villkor. Omständigheter som hindrar sjuksköterskor att ge jämlik vård ställer dem inför problem och dilemman. Syfte: Syftet med studien är att beskriva sjuksköterskors erfarenheter av papperslösa och asylsökande i hälso- och sjukvården. Metod: Litteraturstudie med kvalitativ ansats. Tio vetenskapliga artiklar granskades och låg till grund för denna studie. Resultat: Studien fann fyra huvudteman, Att famla i blindo, Frustration, Kulturell kompetens och En känslomässig utmaning med åtta tillhörande subteman. Slutsats: Brist på/okunskap om riktlinjer var tydlig. Det är därför av stor vikt att författa och implementera riktlinjer i verksamheterna. Background: Undocumented migrants and asylum seekers are part of society’s most vulnerable groups which the UN Human Rights seeks to protect. Swedish legislation does not comply with these rights. Undocumented migrants and asylum seekers often suffer physical and psychological problems and the road to health care is paved with obstacles. The Swedish Ethical Code for nurses describes a professional duty to provide care for all under the same conditions. Factors that prevent nurses from providing equitable care, cause problems and dilemmas. Aim: The aim of this study is to describe nurses' experiences of undocumented migrants and asylum seekers in the health care system. Method: Literature review with qualitative approach. ▼ The overarching purpose of this study is to put the experiences of clandestine asylum seekers (rejected asylum seekers who, avoiding deportation, continue to stay in Sweden) at the centre of a critical re-reading of Swedish migration and gender regimes. Further, the study – in dialogue with feminist and postcolonial perspectives – aims to analyse the gendered experiences of migration and clandestinity in the context of a Nordic welfare model in transition towards a model more closely identified with neoliberal discourses and migration and welfare policies. The research is based upon a long-term ethnographic study with clandestine asylum seekers and asylum rights activists. The central focus is upon ten in-depth interviews with asylum seekers and nine interviews with activists and ‘experts’. Other forms of material (from the media, public events, websites of NGOs, etc.) are used to illustrate the context of the interview material and to analyse aspects of clandestinity in media and public debates. A series of research questions have guided the process. These circulate around the experiences of clandestine asylum seekers, and how their position can be understood in relation to a gendered migration regime and to notions and practices of citizenship and belonging. The main research question is: How, through public representations, institutional practices and subjective experiences, is clandestinity constructed within the frames of the Swedish welfare state, and in relation to citizenship and migration policies? The thesis offers a background analysis, a discussion of the theoretical framework and an outline of the methodological considerations. Thereafter follow three analytical chapters focussing on the ethnographic material. These chapters explore the experiences of the informants from the labour market, from the asylum process, and from an everyday life characterised by a lack of social rights and limited access to welfare entitlements. The final chapter summarises the thesis as well as offers some final reflections on the research questions and aims. The study illuminates the racialised and gendered processes through which everyday lives in the family, in relation to civil society and to state institutions, shape – and are shaped by – clandestinity and deportability. Further, it illuminates the centrality of the position of clandestine asylum seekers in relation to the construction of citizenship and belonging, and shows how these processes are gendered at the level of symbols, institutions and identities. I also explore how different fields of social policies are interconnected and define the position of clandestinity. Clandestinity is shown to be a location characterised by exclusion and fragmentation on some levels, but also by limited kinds of collectivity and inclusion on other levels.

▼ Globalisation of the economy, as well as movement of people and increasing securitisation of borders, have challenged and to different degrees destabilised forms of national belonging and solidarity. Such developments produce new borders and boundaries, separate citizens from non-citizens and create hierarchies of “deservingness”. This dissertation contributes to the analysis of these developments by investigating the role of social work in relation to undocumented migrants in Sweden. The dissertation rests upon two case studies where social work is performed in support of undocumented migrants, a group most often excluded from the social services. The first case focuses on the guidelines on social assistance in Malmö municipality and the second case focuses on social workers working with unaccompanied minors in different parts of Sweden. The analysis rests on interviews, document analysis, news media material and previous experiences of the researcher. Critical citizenship theory is used to analyse if and how social work practice contributes to destabilisations as well as reinforcements of the present citizenship regime.The cases are analysed in terms of actions (within the present order) and acts (that go beyond or against the status quo). In the Malmö case, three forms of actions are identified: codification of the law, confirmation of existing practices and disregard of the issue of undocumented migrants in political debates. In the second case, three forms of acts are identified: acts of ”professionalism”, acts of ”compassion” and acts of ”activism”. The acts analysed are not described as straight forward forms of change, but rather as destabilisations. The presence of undocumented migrants at a local level in Malmö and in front of the social workers (face to face) in the case of unaccompanied minors sometimes could lead to that social workers experienced a responsibility, albeit conditioned, beyond what was formally expected of them. In the analysis it is also highlighted that the understanding of the support practices studied changes with context and time perspective.

▼ Background: In Berlin, health care for people without papers and migrants with legal residency status, but without health insurance (mainly EU citizens) is often provided by non-governmental organizations. Within these structures, especially treatment of chronic illnesses is frequently insufficient. Objective: We aimed to characterize the medical care situation of chronically ill migrants without health insurance from the treating physician’s perspective, to outline factors influencing the quality of care and to describe possible differences in care for EU citizens and people without papers. Methods: Qualitative semi-structured interviews were conducted with 14 physicians working long term and regularly in the health care for uninsured migrants (free clinics for uninsured migrants, and/ or homeless, public health services). Interviews were transcribed verbatim and analysed using qualitative content analysis based on Mayring and Steigleder. Results: Possibilities of health care for chronically ill uninsured migrants varied widely between different free clinics and medical practices. Technical diagnostic examinations (like CT, MRI, endoscopic examinations), referrals to specialist care, provision of assistive equipment and long-term medication were restricted to variable extent. Emergency procedures were easier to organize than elective surgeries. Continuous care for chronically ill patients was limited. Factors influencing extent and quality of care were: the existence of networks and contacts for patient referrals, (missing) financial resources, complicated organizational procedures, poor information flow between treating physicians and language barriers. Additional variation in care resulted from different scopes for decision-making and the respective physician’s willingness to make use of such, e.g. by greater personal efforts to achieve individual care solutions for patients. Uninsured EU-citizens were patients of all free clinics and medical practices, albeit in various quantity. Compared to people without papers, there was no difference in the care they received there. Discussion: Restrictions already described for uninsured migrants’ medical care in general have even more impact on chronically ill patients. Diagnostic and therapeutic measures that cannot be provided directly within the volunteer structures are often not realized due to lack of funds and require additional efforts and improvisation on the part of the physicians. Therefore, patients depend on their physicians’ sense of responsibility. In the last years, some German states have introduced an “anonymous health insurance voucher” in order to secure access to limited health care for people without papers. Syftet med denna studie var att undersöka kunskap och uppfattningar om papperslösas tillgång och rätt till vård hos personal inom öppen hälso- och sjukvård i Landstinget i Uppsala län. Ett ytterligare syfte var att undersöka om information kring handhavandet av papperslösa finns på arbetsplatserna, vad personal i så fall anser om detta, samt vad de önskar för information. Studien är av en deskriptiv design med kvantitativ ansats. 86 anställda vid vårdcentraler i Uppsala län besvarade enkäter med frågor angående kunskap och uppfattningar om lagstiftning samt tillgång till och önskan om information gällande papperslösa. Insamlad data har sammanställts i Microsoft Excel och presenterats i tabeller och diagram. Resultatet av studien tyder på att det finns en kunskapsbrist bland personal inom öppen hälso- och sjukvård angående lagstiftningen om papperslösas tillgång till sjukvård. Enligt de medverkandes vetskap finns ingen information tillgänglig på arbetsplatsen gällande papperslösa, och så gott som alla önskar information av något slag. Majoriteten av de tillfrågade anser att papperslösa ska ha samma rätt till vård som svenska medborgare. Slutsatsen av denna studie är att det finns ett behov av information och riktlinjer gällande handläggning av papperslösa i Landstinget i Uppsala län.

The aim of this study was to investigate knowledge and opinions concerning undocumented migrants’ access and right to health care among employees within the primary health care sector in the county council of Uppsala. An additional aim was to investigate whether there is information available about management of undocumented migrants at the workplaces, and if so what the employees think about it and what kind of information they wish to receive. The study is quantitative with a descriptive design. 86 employees at primary health care centres within the county of Uppsala answered questionnaires concerning knowledge and opinions about legislation as well as access to and demand for information concerning undocumented migrants. Collected data was compiled using Microsoft Excel and was then presented in tables and diagrams. The result of the study indicates that there is a lack of knowledge among employees within the primary health care sector concerning legislation on undocumented migrants’ access to health care. According to the employees’ knowledge there is no information available at the workplace concerning undocumented migrants, and nearly everyone requested information of some kind. The majority of the employees are of the opinion that undocumented migrants should have the same right to health care as Swedish citizens. The conclusion of this study is that there is a need for information and guidelines concerning management of undocumented migrants in the county council of Uppsala.

▼ The relationship between the Netherlands’ state policy and migrants in an irregular situation is mediated by international and EU conventions, agreements and Directives. This study will suggest that victims’ protection safeguards are not fully in place, especially for undocumented migrants. This research provides an overview of the provisions for the protection of the basic human rights of undocumented migrants in particular, as the most vulnerable group of migrants. The study suggests that the effectiveness of legal protection provisions depends on how these provisions are formulated and also on their practical application in specific cases. Recognition of undocumented people’s rights includes the important issue, which is focused on in this study, of the undocumented as victims of criminal forms of labor exploitation. Therefore this research focuses on the implementation of these safeguards through the study of three cases of three undocumented Indonesian migrants in the Netherlands in attaining their rights and protection as victims of labor exploitation. Being undocumented has put them in a precarious situation when it comes to reporting crime to the police, and then accessing justice for prosecution and reparations. A related study has been conducted by the EU Agency for Fundamental Rights on labor exploitation in EU member states more generally. However, this study seeks to fill a gap in empirical studies by interviewing and reporting on, and analyzing the accounts of Indonesian undocumented migrants in particular, about their experiences in relation to crimes of labor exploitation in the case of the Netherlands. This is the knowledge gap this research seeks to address. The study’s findings tend to confirm the view that irregular migrants can be understood both as victims of labor exploitation crimes, and as agents seeking justice within the provisions of what is possible, given the priority of the Dutch authorities with protection of the national territory and labor market from ‘unauthorized migrants’. ▼ Bordering occurs beyond ports of entry. It operates in spaces where immigration status is examined in order to participate or access a public good. In Ontario, schools serve as borders and often exclude undocumented migrant on the basis of status. At the same time, community activists work to erode border-zones and redefine "membership." This project tracks and analyzes one such initiative. It historicizes constructions of membership in relation to the Toronto District School Board and its "Students Without Legal Immigration Status Policy." This policy, discursively known as a "Don't Ask, Don't Tell" (DADT) policy stipulates that the Board would protect students by barring employees from asking, reporting, or sharing information regarding a family's immigration-status. However, the policy remains to be fully implemented, the Board has constructed procedures that make enrolment more difficult, and undocumented students continue to experience exclusion. . Thus, this project addresses the gaps in implementation as well as differing understandings of what constitutes "access."The project combines Anti-racist theory, LatCrit, border rhetoricity, and concepts developed by Frantz Fanon, and Antonio Gramsci. This framework facilitates the examination of the construction of internal borders along hegemonic understandings of membership, how these processes are facilitated by the dehumanization of undocumented migrants, and the resistance practices of migrants and their allies. Data stems from interviews, experiential knowledge, and grey literature. Interviews were conducted with fourteen differently located social actors including TDSB administrators and grassroots organizers. Grey literature from the TDSB, the Don't Ask, Don't Tell Coalition, and No One Is Illegal- Toronto was also examinedKey findings include the ways bureaucratic processes at the TDSB invisibilize undocumented migrants and the resultant hegemonic reproduction of bordering in spite of "access" policies. Additionally, this project highlights the strategies employed by community organizers to make Toronto a space of "non-compliance" to immigration authorities and how access to schooling is framed as a key component. Finally, different framings of "access" are examined. While Board practices equated access to the ability to enroll, local activists demanded broader understandings of this concept including recognition of the ways interrelated factors, including safety and access to other services affected schooling. ▼ Introduction: Vulnerable European Union citizens (vulnerable EU citizens) are those who come to Sweden from EU member states. In Sweden the term “vulnerable EU citizens” is associated with the word “beggars”, which in turn is associated with Roma people. By November 2015 the number of vulnerable EU citizens in Sweden was estimated to be 4 700. The majority of these were from Romania. Roma as citizens of an EU member state have the right to reside in EU countries in accordance with the EU’s freedom of movement rights concept for up to but no longer than three months. However, to obtain the right for residence after three months, proof of financial resources and health insurance are required. Lacking these resources, vulnerable EU citizens have subsequently lost their right for residence and therefore became undocumented. They often find themselves in the same situation as undocumented migrants from outside the EU, having poor health outcomes and limited access to health care. In my study I aim to explore access to health care for vulnerable EU citizens in Umeå, a city in eastern Sweden. Methods: A qualitative design methodology has been applied in this thesis. Those contacted for this study were; Doctors of the World, Health on Equal Terms, Staff for planning and control Västerbotten Region, University Hospital of Umeå and representatives of vulnerable EU citizens’ community from Romania in Umeå. Seven in-depth interviews were collected with professionals and volunteers from these organisation/institutions and members of vulnerable EU citizens’ community. Questions were asked about their experience and knowledge regarding access to health care for vulnerable EU citizens. Data was analyzed using qualitative content analysis. Results: Three main categories and one final theme were developed during data analysis. The first category “Difficult to access health care for vulnerable EU citizens in Sweden without European Health Insurance” elaborates the dependence of vulnerable EU citizens’ access to health care on having health insurance, specifically European Health Insurance and National Health Insurance. It also describes what kind of access to health care vulnerable EU citizens have in Sweden. The second category “Decision about how much access to health care provide for vulnerable EU citizens lies on medical personnel” discusses the situation of health care personnel when they treat vulnerable EU citizens in hospitals. The third category “Organisations, Doctors of the World and Health on Equal Terms, mediate connection between vulnerable EU citizens and hospitals, so they can have their right to health fulfilled” elaborates about the role the organisation plays when vulnerable EU citizens are in need of health care.
