Le Français Patrick Modiano (1945-), l’Allemand W.G. Sebald (1944-2001) et l’Autrichien Fred Wander (1917-2006) : trois écrivains de l’errance, affectés par l’absence des témoins, la disparition des traces et les lacunes du passé au sortir de la Seconde Guerre mondiale. Leurs oeuvres sont hantées par les blancs de la mémoire et les brisures identitaires : exilés contraints de quitter leur Heimat afin d’êtres sauvés du nazisme, ou bien exilés volontaires lorsqu’ils entreprennent des voyages identitaires, les personnages des trois auteurs sont construits de ruines, de pièces manquantes. Les trous de mémoire, les failles de l’être, les incertitudes et les dialogues avec le hors-texte (l’espace extérieur, l’Histoire passée, la mémoire de chacun, le lecteur, les oeuvres antérieures) constituent la matière même de l’écriture. Errant entre fiction et réalité, oscillant entre roman, (auto)biographie, roman de formation, rapport d’enquête et mémoires, Voyage de noces et Dora Bruder de Modiano, Les Émigrants et Austerlitz de Sebald, Hôtel Baalbek et Das gute Leben de Wander sont des récits hybrides qui entremêlent les voix, brouillent les pistes, rassemblent mémoire collective, individuelle et culturelle et semblent laisser le sens des textes (en termes de direction, voire de fin, et de signification) et leur transmission en suspens. L’errance investit dès lors l’identité et la mémoire des textes eux-mêmes et renouvelle la question de la tâche dulecteur après 1945.

The French writer Patrick Modiano (1945-), the German writer W.G. Sebald (1944-2001) and the Austrian writer Fred Wander (1917-2006) consider the relationship between errance and literature after 1945: They are moved by the absence of the witnesses and the disparition of the past after World War II. Their books are haunted by memory lapses and identity disorder and they present a lot of trips accross worlds ; the characters of Modiano, Sebald and Wander are in exile or in transit, far away from their Heimat, and there are searching for missing peaces of their identity. The memory gaps and errors, the difficulty of being, the uncertainties and the dialogues with the out of text world (the space outside the text, the past History, the recall, the reader, the intertextuality and intermediality) compose the matter of writing. The books by the three writers, Honeymoon and Dora Bruder by Modiano, The Emigrants and Austerlitz by Sebald, Hôtel Baalbek and Das gute Leben by Wander, are wandering between fiction and reality and not corresponding the literary norms: are they novels,Bildungsromane, investigation reports, memoirs, or (auto)biographies? These hybrid and multi-level narratives combine voices, confuse the issue, collect the individual, collective and cultural memory and keep the meaning and the direction of the texts, so the narrative transmission, in suspense. The trope of errance leads also to the exploration of the identity and the memory of the texts themselves and the (re)consideration of the role of the reader after 1945.

This study is linked to the CNPq Research Group ‘Law, Trade and Transnationality’ which comes under the Line of Research of the same name, within the Area of Concentration Foundations of Positive Law, of the Master’s Degree Program in Legal Science of the University of Vale Itajaí (UNIVALI). The study entitled Transnacionalização e Segurança do Comércio Mundial: a Importância do Poder Econômico na Difusão das Normas Anti-Terroristas Pós- Onze de Setembro e sua Implementação no Direito Brasileiro (Transnationalization and Security of World Trade: the Importance of Economic Power in the Dissemination of Anti-Terrorism Regulations Post September Eleventh, and their implementation in Brazilian Law) aims to identify the importance of economic power in the dissemination of anti-terrorism regulations after September eleventh, and their implementation in Brazilian law, particularly through the study of the International Ship and Port Facility Security Code (ISPS Code). The study also deals with issues like globalization and transnationality, and the ways in which these two phenomena have changed the lives of people around the world, e.g. transnational terrorism and the effects of the attacks of September 11th 2001, and the establishment of rules to regulate, improve and safeguard the rules of international security. The economy is given special emphasis in this study, considering that its own transnationality and globalization disseminate the sense of the importance of capital in trade relations. This study therefore addresses the transnational nature of foreign trade, international trade, global trade, the evolution of terrorism and Transnational Terrorism (including security issues), the INCOTERMS and finally, the ISPS Code. In terms of the methodology used, the inductive method was used in the Research Stage, the Cartesian method was used to process the data, and inductive logic was used in the Report of the Results expressed in this essay. ▼ This dissertation studies modern Chinese, Korean, and Japanese literature written in and about Manchuria from the 1920s through the 1970s. Manchuria, now the northeastern part of China, was once an open frontier. In the first half of the twentieth century, it became a site of contestation and conflict among multiple countries. Along with the political and military rivalries that unfolded there, I argue that literature played an important role in the frontier contestation. At a time when legal territoriality defined by state sovereignty experienced frequent and radical turnovers, literary writers sought to engage with the process of a cultural territory-making through literature. In their writing in Chinese, Japanese, or Korean, the writers developed various thematic and stylistic strategies that suited their circumstances and personal preferences. These strategies allowed them to claim the frontier space for the particular group of people with whom they identified. I call the writers’ literary engagement “literary territorialization,” a process in which frontier writers aimed to territorialize the frontier in ways that were more fluid and flexible but also more fragile than the establishment of legal territory. Through an investigation of a multilingual body of Manchurian literature, my work explores how frontier literature demarcates the nation in a web of translational connectivity. In the four chapters of my dissertation I discuss frontier writers who have had varying relationships to Manchuria. They include Manchuria-born Chinese writers who were exiled to China Proper after the Japanese takeover in 1932 and sought to reclaim the land through literature; a Manchuria-born Chinese writer who stayed during the Japanese Manchukuo regime (1932-1945) and engaged in transnational linguistic experiments as his form of literary territorialization; diasporic Korean writers in Manchuria who were constantly anxious about the issue of translation; and postwar Japanese repatriation literature by women survivors that deals with their traumatic withdrawal from Manchuria. In individual works, writers may choose to exclude or include characters, languages, and other cultural elements belonging to different groups. Ultimately, however, their textual choices are all different ways to embody their territorial consciousness regarding the frontier in literature. In a time when the frontier was still open to multinational rivalries, literary territorialization functioned to prepare or justify political and military competition for legal territorial rights, or else to compensate for their loss in Manchuria and elsewhere. And when the frontier was closed, former frontier writers used literature to represent and work through the traumatic experience caused by the process of deterritorialization. Methodologically, my work designates a common space as the ground for comparing literatures of different languages within the same region of East Asia. A presente Dissertação está inserida na linha de pesquisa HERMENÊUTICA E PRINCIPIOLOGIA CONSTITUCIONAL. Versa sobre os movimentos de Lei e Ordem que assolam todo o mundo e que, inevitavelmente, acarretam no recrudescimento e expansão do Direito Penal e Processual Penal. Partindo da análise do novo cenário mundial, vislumbra-se que os Estados-nação têm sua soberania relativizada para ceder lugar a uma nova ordem mundial globalizada, em atendimento a ideologia neoliberal. Com a globalização, o discurso neoliberal economicista se fortalece e, sob o pálio da implementação da ação eficiente estatal, com o real fim de eliminar as barreiras para o bom funcionamento do Mercado, surgem os movimentos de mitigação das garantias e direitos constitucionais. Como a busca insaciável do neoliberalismo pelo bom funcionamento econômico estatal relação custo/beneficio diminui-se o Estado social e, paradoxalmente, pretende-se o aumento do Estado repressivo, com a hipertrofia legislativa penal e processual penal para funcionar como instrumento regulador da liberdade do Mercado. Assim, com este panorama, conclui-se que o neoliberalismo impõe de forma latente o discurso economicista da ação eficiente estatal para, em nome da maximização de riquezas, diminuir as garantias e direitos fundamentais elementares ao Estado Democrático de Direito

This thesis is inserted into the line of research CONSTITUTIONAL HERMENEUTICS AND SET OF PRINCIPLES. Deals with the movements of the Law and Order plaguing the world and, inevitably, result in recrudescence and expansion of the Criminal Law and Criminal Procedure. Based on the analysis of the new world scenario, envisions that the nation states have sovereignty relativized to make way for a new world order in response to the neoliberal ideology. With globalization, the neo-liberal economistic discourse is strengthened, and under the canopy of the implementation of effective state action, with the actual order to eliminate barriers to the smooth functioning of the market, there are movements of mitigating safeguards and constitutional rights. As the insatiable quest for the proper functioning of the neoliberal state economic - cost / benefit ratio - decreases the welfare state and, paradoxically, it is intended to increase the repressive state, with the hypertrophy of criminal procedure and criminal law to act as a regulatory tool of freedom of the market. So with this background, we conclude that neoliberalism imposes latently economistic discourse of the state for effective action on behalf of the maximization of wealth, reduce the guarantees and fundamental rights to basic democratic state

Madagascar, indépendant en 1960, est une République à qui manquent cruellement des moyens financiers et humains. Cette situation l’a rendue dépendant des contextes géopolitiques mondiaux et des alliances qui en ont découlés. L’évolution de la Grande île reflète les grands bouleversements qui se sont déroulés dans le monde : la période néocoloniale, la période de la guerre froide, celle des ajustements structurels dans les années 1980 et enfin le monde multipolaire qui a débuté dans les années 1990. Un des grands défis échecs des modèles de coopération successifs fut le développement local, régional au bénéfice et avec l’implication des sociétés. Pour comprendre cette situation, la recherche d’une part restitue les divers environnements internationaux et nationaux et leurs responsabilités, d’autre part retrace les actions de la coopération au niveau des différentes collectivités territoriales malgaches entre 1993 et 2005. S’il en résulte une répartition assez homogène des activités de la coopération multi et bilatérale sur le territoire national avec des champs et des zones d’intervention spécifiques pour chaque coopération, la recherche de cet équilibre spatial est difficile malgré les efforts favorisant les démarches participatives impliquant la population, compte tenu de l’instabilité politique depuis l’avènement de la Troisième République. Cette situation met en évidence de nouveaux acteurs, une coopération transnationale, ONG et coopération décentralisée, qui concerne surtout le niveau local avec des actions traitant prioritairement des questions sociales et de l’urgence humanitaire, à travers des programmes à court terme. Actuellement, c’est la seule coopération qui est vraiment effective à cause des évènements politiques qui secouent Madagascar. Restent les inconnus au sujet des nouvelles formes de coopération sous-régionale, commerciales avec les Pays émergents qui ne sont aujourd’hui que des acteurs secondaires mais dont les perspectives de développement sont immenses.

Since 1960, Madagascar has been a Republic which was sorely lacking in financial and human resources. This made him dependent on global geopolitical context and alliances that resulted. Its evolution reflects the great changes that took place in the world: the neo-colonial period, the period of the Cold War, the structural adjustments in the 1980’s and finally the multipolar world that began in the 1990’s. A major challenge and a failure of successive models of cooperation was, the local, regional benefit and with the involvement of the population. To understand this situation, the study returns from the various international and national environments and responsibilities, on the other hand, traces the actions of cooperation in the various Malagasy local authorities between 1993 and 2005. ▼ The dissertation discusses selected contemporary Spanish Peninsular novels and films in light of the diminishing role of the nation-state in the formulation and dissemination of national-identity narratives. Chapters 1 and 2 define national subjectivity as a fractal notion that reconciles the persistence of national allegiances in subject-formation with the multiple factors (economic, political, technological, and demographic) that disrupt the unity of the nation state from within and from without. The following chapters analyze diverse models of subjectivity enacted in chosen narrative and cinematic works and the relation of these models to narratives of the Spanish nation-state. The artistic specificity of each one of these texts is emphasized, and, at the same time, they are located in a larger context of contemporary Spanish reality. The authors discussed in this work are: Ray Loriga, Alejandro Amenabar, Julio Medem, Suso de Toro, Juan Bonilla, Jose Luis Guerin, Jose Juan Bigas Luna, and Fernando Leon de Aranoa. The textual analyses are organized in three parts that center, respectively, on globalizing movements, peripheral identities, and reconfigurations of the Spanish nation. Within this classification, each text offers a unique vision of the fractal dynamics of subjectivity. Chapter 3 focuses on the role of transnational information and communication technologies in the production of subjectivity as it is represented in texts such as Caidos del cielo, Tokio ya no nos quiere, Abre los ojos, and Lucia y et sexo. These texts redescribe the meaning of Spanishness in the context of technologically informed flows of information. Chapters 4 and 5 present less radically dispersed subjects, and they seek to redescribe Spanishness as a nexus of transnational flows and local allegiances. The discussion of Nadie conoce a nadie , Trece campanadas, En construccion , and Tierra focuses on constructions of subjectivity that reformulate the importance of subjective spatiotemporal allegiance within the logics of global dispersion and the nation-state's fragmentation. The discussion of Los principes nubios, Barrio, La teta i la lluna, and Calzados Lola analyzes how these texts redefine the meaning of the Spanish nation-state in the context of transnational movements of objects, people, and ideas. ▼ This research study aims to establish a transnational model of education and art education. Through interpreting and analyzing the artworks by two transnational artists, namely, Wenda Gu’s united nations and the forest of stone steles projects and Trinh T. Minh-ha’s film A Tale of Love, I explore how to read art for educational and pedagogical implications. Objecting to the superficiality of defining transnational people on the basis of their act of physical border-crossing, I identify three qualities inherent to transnationality and transnationalism: multiplicity (heterogeneity), hybridity, and liminality. I argue that at root, transnationalism represents a different approach towards difference, an approach that negates binary thinking and promotes permeable subjectivity. Positioning myself simultaneously as an art critic and an art educator, I interpret the art by Gu and by Trinh from a transnational perspective, and analyze their common features, which include nomadism, dialogism, liminality, and border-crossing. Guided by three principles to approach artworks pedagogically, I propose that the pedagogy in a transnational model of education and art education needs to demonstrate these qualities: dialogism, hybridity, nomadism, reflectivity and reflexivity, fluid subjectivity, the view of difference as surmountable, and a goal to cultivate world citizens. This study not only offers an alternative in defining transnational individuals and transnationalism and transnationality, it also introduces the transnational artists and their artworks into the art classroom and identifies the characteristics of a transnational pedagogy. Further, it exemplifies a way to approach artworks for educational and pedagogical implications and in the meantime greatly enriches art teachers’ understanding of the art of the two contemporary artists on whom this study focuses. ▼ Tracing the Last Mile studies the annual migratory journey home during China’s Lunar New Year Golden Week through the convergence of traditional Chinese art and auto-ethnographic research. This thesis highlights individual journeys within this migration to foreground differential human experience and cultural logics within the larger processes of urbanization and globalization in contemporary China. The research of Aihwa Ong, a Malaysian anthropology scholar investigating topics of transnationality and graduated sovereignty, are explored for insight into the mass migration of Golden Week and the greater phenomenon of rural to urban migration in China. This thesis posits a new term—graduated mobility that examines a focused aspect of graduated sovereignty and classifies a set of differential Golden Week journeys in order to investigate the tenuous ritual of returning home. The thesis utilizes the scroll’s abilities of illustrating journeys interwoven with social history to dissect a present-day Golden Week migration. Hand scroll paintings dating back to the Ming dynasty are studied on the three criteria of content, technique, and format. First, the sense of hierarchy used to portray content in the scrolls, is discussed in relation to how we can deploy democratic ways of depicting levels of class within China’s evolving social ladder. Secondly, the techniques of scale and perspectival distortion are analyzed to learn how space and time of the journey can be represented within a static drawing. Thirdly, the handheld format of rolled scrolls is challenged in order to rethink the performative potential of hand scroll paintings. The culmination of the research results in the making of a contemporary scroll drawing that depicts the journey of a transnational citizen—myself, as it intersects with travellers that represent varying degrees of graduated mobility. By revisiting this artform with current themes related to urbanization and the effects of globalization, Tracing the Last Mile positions the Golden Week journey as an entry point into the rippling, far-reaching effects of globalization.

En modifiant le rapport à l’espace, la mondialisation l’a rendue omniprésente, elle l’a banalisée, mais dans le même temps elle annonce aussi peut-être son dépassement dans un monde globalisé. Saisir ce qui fait l’internationalité d’une situation est une opération délicate. Le droit de l’arbitrage la rend pourtant inéluctable en raison du régime propre qu’il dédie à l’arbitrage international. L’internationalité factuelle peut tenir à des considérations diverses. Mais l’internationalité en droit est une affaire de choix, de politique. Entre une approche formelle de l’internationalité, axée sur la procédure elle-même, et une approche matérielle centrée sur la matière du litige, les enjeux sont importants. C’est la place concédée à la volonté des parties qui est en cause, et, par-delà, la propension que peut avoir l’État à ne pas abandonner toute prérogative dans le fonctionnement ou les suites de cette justice qui entend se placer hors de son emprise… Mais l’internationalité ne peut-elle pas elle-même s’affranchir du regard de l’État ?

Internationality is an invasive concept. In changing our relationship with space, globalisation has rendered internationality omnipresent, it has trivialised it, and at the same time it has perhaps announced the overtaking of internationality in a globalised world as well. To grasp what makes the internationality of a situation is a delicate matter. However, arbitration law makes it unavoidable because of the specific regulations it applies to international arbitration. The fact of internationality can depend on a variety of considerations. But internationality in law is a matter of choice and politics. There are important issues at stake between a formal approach to internationality – based on the procedure itself, and a practical approach – based on the subject under litigation. It is the importance given to the free will of the parties that is in question, and beyond that, the propensity of the State not to abandon all prerogatives in the operation of this justice which extends beyond its sphere of influence… But can’t internationality itself be liberated from the control of the State ?

▼ (in)Equality. centers around my experiences as a transnational person and those around me who have affected my current concept of equality and cultural histories. My visual methodologies cover digital photography and editing, inkjet printing, and laser engraving: multimedia in a process of new discovery, translation between analog and digital, and rearticulation. The exhibition includes portraits peering down from above, illuminated by projected patterns and manipulated messages from Nike’s “Equality.” (2017). The purpose of this thesis paper is to describe the elements of identity, marginalization, and personal reaction to advertising, as well as the and theories which have shaped this project. The exhibition features various portraits of underrepresented populations due to their sociocultural identities, such as age, class, (dis)ability, ethnicity, gender, race, and sexual orientation in the gallery area, as a parody of the Nike’s problematic Equality. campaign and to hold a conversation about power dynamics since the most recent presidential election in the United States of America. The exhibition seeks to showcase the voice of people who are undervalued or misrepresented. I am influenced by artists/designers Virgil Abloh’s ethos of street wear, Do Ho Suh’s sense of no home, and CJ Hendry’s hyper-realistic reproductions and ownership. Furthermore, I draw inspiration from theoretical writings of Walter Benjamin about mechanical reproduction, Byung-Chul Han’s discussion of digital communication and destruction of political engagement, Laura U. Marks’ rearticulation of history, K. W. Crenshaw’s idea of intersectionality, and colonial wounds by Walter D. Mignolo. By acknowledging how the concept of equality is narrated, the show questions the re-presentation of equality in mass media, Western history, and the stereotypes in the U.S. society, in the age of mechanical-digital technology and reproduction. The “Equality.” campaign, capitalizes on the idea of equality as a marketing strategy and a consumer tool by using public figures of color and LGBTQIA+ professional athletes. From the perspective of a transnational artist, this exhibition retranslates and parodies advertisements and media by Nike’s promotional campaign. (in)Equality is about repetition: utilizing and borrowing the corporate media and products throughout the campaign direction into another form of presentation and representation of the people—the idea of equality suggested as hopeful interpretation versus multiple experiences of marginalization that speak to otherwise. Through a conscientious parody, the project calls out the discomfort or complacency of the viewer in an uncanny reality: unveiling intersected systems of oppression. ▼ In this dissertation, I investigate the characteristics and quality of liminality among the Tibetan exile community in Dharamsala, India, and the United States. I argue that the quality of their liminality defines this exile community’s ability to maneuver and voice their influence to geo-political community of states that surround them, all while within their liminal condition. The Tibetan exile people live as stateless foreigners in India but have a better standard of living and better opportunities to acquire transnational resources than their surrounding host community. In the U.S., Tibetan diaspora people live as asylum-seekers and naturalized Tibetan-Americans but have established a popular political campaign (which enjoys the support of considerably many Americans) addressing the plight of Tibetans imposed by China. I argue that the Tibetan diaspora have achieved this unique social and political success as a marginalized community by adopting a cultural practice that I call “flexible liminality.” Flexible liminality is a Tibetan cultural practice that helps transient people adjust to any situation, people, and geo-politics circumstance. Flexible liminality relies on two factors: first, political interest from various nation-states; second, a group’s ability to adjust their cultural practices to match external influences. In the case of the Tibetan exile community, it is important to note that they are excluded by multiple nation-states (China, India, the Western countries) in different ways simultaneously. Therefore, the world collective of Tibetan refugees are not fixed in one state of liminality but experience a variety of liminalities in relation to different nation-states. Second, the Tibetan exile community has adjusted their cultural practices to assimilate with host communities in whichever countries their exile-hood has landed them. Since Tibetans cannot acquire Indian citizenship, the Tibetan exile community uses India as a space to promote their political activism against China, and form better relationship with Western foreigners. In Dharamsala, the Tibetan community has organized institutions that guides Tibetan individuals to form relationships with foreign tourists, and acquire skills (i.e. language, behavior, education, philosophy) that would help them assimilate better when resettling in Western host countries. In both, Dharamsala and the U.S., the Tibetan diaspora have a cultivated cultural practice to advocate Tibetan political plight against China, and to communicate Tibetan religio-socio traditions with the foreign host community. As a result, Tibetans are able to achieve political popularity, and to socially draw empathy from foreign communities that aids in producing a space for Tibetan cultural preservation in exile. The case study on Tibetan exile community sheds a new light on the study of marginality/liminality. ▼ Die vorliegende Dissertation leistet einen Beitrag zur Klärung des Wesens transnationaler Verwaltungsakte und stellt die Merkmale dieses von der Wissenschaft entwickelten eigenständigen Rechtsinstitutes heraus. Es weicht vom Grundsatz ab, dass der Wirkungsbereich eines von nationalen Behörden erlassenen Verwaltungsaktes auf das Hoheitsgebiet jenes Staates beschränkt ist, dessen Behörde ihn erlassen hat. Die Liste mehr oder weniger prominenter Beispiele reicht von der Berechtigung mit einem österreichischen Führerschein auch in Italien ein Fahrzeug zu lenken, über die Genehmigung einer französischen Behörde, mittels derer ein natürliches Mineralwasser in Österreich als solches verkauft werden darf, bis zur auch in Deutschland rechtserheblichen Zulassung eines Schienenfahrzeuges durch eine österreichische Behörde und ließe sich ad infinitum fortsetzen. So alltäglich transnationale Verwaltungsakte prima facie erscheinen, so unklar zeigt sich allerdings bislang ihre Gestalt. Ausgehend vom europäischen Richtlinienrecht hat die Rechtswissenschaft ein Meinungs- und Begriffslabyrinth auf einem dogmatisch unsicheren sowie kontroversen Terrain hervorgebracht. Termini wie anerkennungsbedingte, behördenbezogene, echte und vermittelte Transnationalität tragen zu einem diffusen Erscheinungsbild der Rechtsfigur bei. Die Grenzen zu verwandten Begriffen bleiben oftmals unklar. Der transnationale Verwaltungsakt wird in der wissenschaftlichen Diskussion überwiegend als ein Ausfluss der Europäisierung des Rechts verstanden. Vereinzelt wird wiederum die Eigenständigkeit der Rechtsfigur in Frage gestellt. Beide Thesen verdienen Widerspruch. Transnationale Verwaltungsakte sind weder eine Invention des Europarechts noch werden traditionelle Terminologien den Besonderheiten dieser Form des Verwaltungshandelns gerecht. Die Arbeit widmet sich der Explikation des transnationalen Verwaltungsaktes und versucht durch eine Konturierung sowie Simplifizierung die Aussagekraft der Rechtsfigur zu stärken. Die Falsifikation bestehender Systematisierungsleistungen im Sinne eines deduktiven Verfahrens sowie die Terminologisierung stützen sich auf ein tertium comparationis unter einem Rückgriff auf verschiedene Referenzgebiete. Da bislang weder ein internationales noch ein europäisches allgemeines Verwaltungsrecht kodifiziert wurde, sind grenzüberschreitende Wirkungen von Verwaltungsakten in den einzelnen materiellen Rechtsvorschriften enthalten. Dies reicht weit über die Historie des Europarechts hinaus. Bereits in der zweiten Hälfte des 19. Jahrhunderts wurde die Entgrenzung von Verwaltungsakten zur Bewältigung der Interdependenzen im internationalen Post- und Eisenbahnverkehr herangezogen. Am Beispiel der Zulassung von Schienenfahrzeugen wird nicht nur die historische Dimension des grenzüberschreitenden Verwaltungshandelns ersichtlich, sondern auch seine Vorteile und seine Grenzen. Die Materienanalyse reicht vom Schengen-Visum, als typischer Repräsentant transnationaler Verwaltungsakte, bis zum Inverkehrbringen gentechnisch veränderter Organismen. …

» »Silly Caucasian girl likes to play with samurai swords« - Dekonstruktivistische Elemente in Quentin Tarantinos Kill Bill« ist eine Untersuchung des Films Kill Bill unter dem Aspekt der Dekonstruktion nach Jacques Derrida. Dabei wird sich zu Beginn dem Begriff der Dekonstruktion erst einmal angenähert, eine Definition ist nicht nur unmöglich, sondern widerspräche auch der Dekonstruktion selbst. Im Folgenden befasst sich der Hauptteil dieser Masterarbeit mit den dekonstruktivistischen Elementen in Quentin Tarantinos Kill Bill. Wobei sich auf drei wesentliche Aspekte konzentriert wird: Die Narration, die nicht-linear in Kapiteln eingeteilt ist; das Genre, welches sich in diesem Fall nicht kategorisieren lässt, da Kill Bill ein starker Genre-Eklektizismus kennzeichnet; und die Figuren, die sich einerseits Stereotypen bedienen und andererseits in ihrem Stereotyp-Sein immerzu versagen, die unberechenbar agieren und manchmal geschlechtslos, aber immerzu transnational und transkulturell geprägt sind. Kill Bill ist vieles aber eins sicher nicht: authentisch. Das was viele Filme oftmals anstreben, insbesondere im Mainstream-Kino, soll hier keineswegs erzielt werden. Denn exzessive Materialität wird hier nicht nur ausgestellt und bekommt seine eigene Hauptrolle im Film, sondern führt dazu, dass sich der Film immerzu selbst reflektiert und parodiert. Die Masse an Verweisen und Zitaten auf andere Filme, Serien, Figuren und Inhalte führen dazu, dass Kill Bill seine eigene Illusion fortan ironisch bricht. Hier findet gleichwohl eine dreifache Dekonstruktion statt, die der Narration, die des Genres und die der Figuren.

» »Silly Caucasian girl likes to play with samurai swords« - Deconstructivist elements in Quentin Tarantino's Kill Bill« is a study of the film Kill Bill in terms of the deconstruction theory put forth by Jacques Derrida. Starting with an approach of the main thoughts of the theory of deconstruction – a definition is not only impossible but also contradictory to its nature. The thesis of this paper examines the deconstructivist elements in Quentin Tarantino’s Kill Bill focusing on three major aspects: Narration, genre, and characters. The narration is divided into non-linear chapters, while the film cannot be categorized as it cuts across genres. Lastly, the characters are seemingly stereotypes on the one hand, but end up defying their stereotypical existences – acting incalculable, sometimes genderless, and are often transnational and transcultural. Kill Bill consists of a vast amount of references and citations of other films, series, characters and contents which equals in one of its main characteristic: Its lack of authenticity. Many movies – especially within mainstream-cinema – particularly aim for authenticity, but not Kill Bill. Its excessive materialism plays its own dominant role and therefore leads to a continuous break in its own (film) illusion. The paper examines the deconstructionivist theory from three angles: the deconstruction of narration, genre and characters.

▼ This dissertation intervenes in the more than four decades-long debate on the decline or persistence of American economic power. It argues that we cannot move forward without reconceptualizing the nature of economic power in global capitalism, especially by moving beyond national accounts (such as GDP). Too many commentators from across the diversity of perspectives assume that the relative rise and decline of national accounts approximates the relative rise and decline of national economic power. In contrast, this dissertation argues that in the era of globalization, national accounts are an inadequate measure of national economic power. Rather, we must investigate the transnational corporations themselves in order to encompass their transnational operations, and analyze the matrix of inter-linkages now characteristic of global capitalism in general, and American power in particular. Therefore, this dissertation draws upon extensive original empirical research, including the following: 1) the first aggregation of the national sales-shares of the world’s top 200 corporations from 1957 to 2013; 2) the first aggregation of the national profit-shares of the world’s top 2,000 corporations across 25 broad sectors from 2006 to 2013; 3) the first aggregation of the top 50 national acquirers and targets of all cross-border mergers and acquisitions worth $1 million or more from 1980 to 2012; and 4) the first national aggregation of the ownership structures of the world’s top 500 corporations. The results from this empirical research, among others, will illuminate a number of facets concerning contemporary global capitalism. First, the nationality of capital remains very relevant despite several decades of intensifying globalization at the turn of the twentieth century. Following from this, the persistence of American economic power from the 1960s into the twenty-first century is astounding, particularly at the technological frontier. Indeed, in advanced technology and even Wall Street, American dominance has actually increased since the 2008-2009 global financial crisis. There are no foreseeable contenders, including China. Therefore, this dissertation will demonstrate that far from relative American decline, in certain respects American economic power has never been stronger — and will conclude with a number of important implications from this analysis concerning the future of world order.
