A Comissão do Livro Negro Sobre o Regime Fascista foi criada em Portugal, em 1977, para investigar os abusos cometidos durante a vigência do regime ditatorial inaugurado em maio de 1926 e derrubado pelo golpe militar de 25 de abril de 1974. Surgiu por proposta do então Primeiro-Ministro, o socialista Mário Soares, como forma de combate ao ressurgimento de ideologias fascistas. A literatura diz-nos que foi o mais próximo que existiu, em Portugal, das clássicas comissões de verdade, entre as quais a Comissão Nacional sobre Pessoas Desaparecidas (CONADEP), instaurada na Argentina em 1983, é tida como a pioneira. Não há, contudo, quem tenha aprofundado esta questão na literatura sobre o caso português. De igual forma, os estudos comparados sobre comissões de verdade não reconhecem a existência de uma comissão em Portugal. Esta dissertação parte da definição de Priscilla Hayner (2011), tida como referência nesta área, e analisa o caso português através da triangulação de três tipos de dados – documentos de arquivo, imprensa da época e entrevistas qualitativas –, demonstrando que a Comissão do Livro Negro pode, à luz daquela definição, ser considerada uma comissão de verdade.

The Commission of the Black Book on the Fascist Regime (Comissão do Livro Negro Sobre o Regime Fascista, in Portuguese) was established in Portugal, in 1977, to investigate the abuses that occurred during the dictatorship that started in May 1926 and ended with the military coup of April 25, 1974. It was created by proposal of Mário Soares, former socialist Prime Minister, as a way to fight the resurgence of fascist ideologies. Literature tells us that this commission was the closest that ever existed in Portugal of the classic truth commissions, such as the National Commission on the Disappeared (CONADEP), established in Argentina in 1983 and recognized as the first truth commission. However, no one studied this issue in the literature on the Portuguese case. Similarly, comparative studies of truth commissions do not recognize the existence of a commision in Portugal. This investigation is based on the definition created by Priscilla Hayner (2011), considered a reference in this area of study, and analyzes the Portuguese case by triangulating three sources – archives, the press and qualitative interviews – proving that the Commission of the Black Book can, according to Hayner, be considered a truth commission.

▼ Contemporary philosophical investigations of truth (especially in the analytical philosophical tradition) treat the concept as a “thin concept”, and so reduce truth discourses to conceptual analysis of intentional signs (concepts, propositions) or analysis of the truth predicate by considering its logical, semantic and anaphoric function in sentences (or propositions). This reductive conception of truth neglects the importance of the conscious and intentional act of the subject and thus results in an explosion of deflationary theories, and even the quest for the elimination of truth. Contrary to the views that consider truth as a “thin” concept, I argue that a robust substantive conception of truth as correspondence is essential if we are to account for the importance of truth in philosophy and daily human existence. To account for such an understanding of truth, a philosophical investigation of truth must be explored within a wider context of the human quest for knowledge and self-transcendence. Such examination requires an explicit articulation of the cognitional theory on which a conception of truth is founded. This is because a philosopher’s conception of truth is influenced by the cognitional theory that he or she subscribes to. In other words, a philosophical investigation of truth that aims at adequate exposition must account for the conscious and intentional acts of the human subject, since the importance of the role of the knowing subject in the quest for knowledge and truth cannot be underestimated. To account for the role of the subject and the importance of foundational cognitional theory, the conception of truth as correspondence that is defended in this thesis is based on a comprehensive tripartite (experiencing, understanding and judging) cognitional structure. Moreover, an explicit examination of the cognitional theory on which a theory of truth is based is vital to establish the relation between knowledge, truth, objectivity and being (reality). ▼ Este relatório foi desenvolvido, tendo por base um diagnóstico de situação relativo à Gestão do Regime Terapêutico, realizado numa Unidade de Internamento de Psiquiatria. O diagnóstico tinha como objectivos: - Conhecer a perspectiva do cuidador principal, relativamente à forma como o seu familiar com doença mental faz a gestão do regime terapêutico no domicílio; -Contribuir para a definição de estratégias direccionadas aos utentes e cuidadores principais, para a melhoria da Gestão do Regime Terapêutico. Foram entrevistados sete cuidadores principais, na Unidade de Internamento onde os seus familiares estavam internados, sendo possível inferir da informação obtida, que os mesmos não gerem o seu regime terapêutico de forma adequada. Emerge daqui a necessidade de implementar estratégias direccionadas, quer aos cuidadores principais quer aos seus familiares doentes. As estratégias a ser implementadas, deverão ser psicoterapêuticas e psicoeducativas, com o objectivo de fornecerem ferramentas e autonomia, diminuindo assim o impacto negativo da doença na qualidade de vida do doente e do seu cuidador; ABSTRACT: This report was developed having for base a diagnosis of the situation in relation to the management of the therapeutic regime, which took place in a unit of psychiatric internment. The diagnosis had the following objectives:  To know the perspective of the main caregiver in relation to the way their mentally ill family member manages the therapeutic regimen at home.  To contribute to the definition of strategies directed at patients and their main caregivers for the improvement of the management of the therapeutic regime. Seven main caregivers were interviewed in the internment unit where their family members were interned. From the information obtained in the interviews it is possible to infer that these family members don’t manage their therapeutic regime adequately, making it necessary to implement strategies directed at the main caregivers and their mentally ill family members. The strategies to be implemented should be psychotherapeutic and psycho-educational in order to provide the right tools and the autonomy needed and, therefore, reduce the negative impact of the illness in the lives of the patient and caregiver. ▼ This study is a work of constructive theology that retrieves the ancient Christian understanding of God as truth for contemporary theological discourse and points to its relevance to biblical studies and philosophy of religion. The contribution is threefold: first, the thesis introduces a novel method for constructive theology, consisting of developing conceptual parameters from source material which are then combined into a theological proposal. Second, applying this method to selective texts of Augustine of Hippos’ corpus and the Christian Old Testament does original work to excavate their accounts of truth and divinity. Third, this harvest is re-interpreted and developed into a constructive theological proposal, that understanding God as truth can robustly contribute to accounts of truth in general. The first chapter positions my study within the fields of theological and philosophical debate and presents its methodology. This clarifies its relationship with historical theology, and delineates a productive engagement with biblical studies and cognitive linguistics, which accomplishes theological retrieval and resolves interdisciplinary tension. The second chapter examines Augustine’s writings On Free Will (De Libero Arbitrio), Confessions (Confessiones), and On the Trinity (De Trinitate). This engagement produces conceptual parameters that cover mathematical truth, Trinitarian logic, and human epistemic limitations. The thirst chapter examines the Old Testament. Judicious engagement with biblical scholarship and cognitive linguistics illuminates the Hebrew text’s complex articulation of senses and concepts associated with truth. From this, I extrapolate conceptual parameters that address truth-bearers and the relevance of divine truth to God’s love, being, law, word, and wisdom. The fourth chapter synthesises and augments the conceptual parameters developed in chapters two and three. The resulting constructive theology establishes the consequences of approaching ‘God as truth itself’ for truth in general. O presente trabalho investiga a relação entre informação, documento e verdade no âmbito das Comissões da Verdade, que são mecanismos estabelecidos por países que passaram por regimes ditatoriais e com histórico de violações de Direitos Humanos. Estas Comissões são instauradas com o propósito de reestabelecer ou consolidar a democracia nesses países. Desta forma, faz-se uma análise descritiva do processo de reconstrução histórica e validação da informação no domínio das Comissões criadas na Argentina e no Chile. O estudo sobre as Comissões serve como referência para uma análise da recém-instaurada Comissão Nacional da Verdade do Brasil. Enfoca-se as Comissões como locais propícios aos processos de aprendizagem. Nesse processo procura-se identificar o que valida à informação nas Comissões. Aborda-se a teoria discursiva da verdade de Jürgen Habermas, incluindo sua revisão com fins de sanar o problema da ineficácia da teoria da verdade por correspondência. Configura-se uma teoria processual, na qual compara-se a verdade a uma assertividade ideal. Nesta abordagem a verdade é atributo dos enunciados. A teoria pragmática da verdade de Habermas contribui para evidenciar que a informação, em atos de fala e na sua materialização documental, atua como uma verdade provisória. Nos casos estudados ela se valida no discurso público

The present work investigates the relationship between information, document and truth in the context of Truth Commissions, which are established mechanisms for countries which passed by dictatorial regimes and with a history of Human Rights violations. These Committees are instituted in order to reestablish or consolidate democracy in these countries. In this way, a comparative analysis of the process of historical reconstruction and validation of the information in the field of Commissions created in Argentina and Chile is done. The study on the Committees serves as a reference for an analysis of the newly established Brazilian National Truth Commission. Focuses the Commissions as conducive to learning processes. In this process seeks to identify what validates the information in Committees. Discusses the Jurgen Habermas Discursive Theory of Truth, including their review with the purpose of remedying the problem of inefficiency of the theory of truth by correspondence

Este trabalho investiga a possível relação entre uma vontade da verdade, a informação e os arquivos observando seus desdobramentos por meio da ação de documentar em sua gênese. Apresenta a discussão tendo como base o dispositivo filosófico de Michel Foucault sobre a questão da verdade e o significado do Arquivo. Localiza o problema com a discussão atual sobre a abertura dos arquivos do período do Regime Militar Brasileiro, em que se observa o confronto entre a vontade de verdade e as fontes documentais sob custódia dos Arquivos. Inclui no debate as diferentes perspectivas sobre a relação entre a verdade e a informação ao utilizar a Ciência da Informação, Arquivologia e História, disciplinas comumente ligadas à lida com as fontes documentais, apresentando as divergências de tais áreas do conhecimento sobre a validação da informação. Esta dissertação, por fim, conclui que os recentes estudos sobre uma Filosofia da Informação baseada nas práticas documentárias, iniciados por Bernd Frohmann no âmbito da Ciência da Informação, abrem um caminho possível de investigação para o enriquecimento do debate sobre o tema

This work investigates a possible relationship between a will of truth, the information and the archives observing its development through action to document in its genesis. Presents a discussion based on the philosophy of Michel Foucault on the question of truth and meaning of the Archive. Locates the problem with the current discussion on the opening of the archives of the period of the Brazilian Military Regime, where there is a conflict between truth and will of the documentary sources in the custody of the Archives. Includes discussion on the different perspectives on the relationship between truth and use the information to the Information Science, Archival Science and History, disciplines commonly linked to deals with the documentary sources, presenting differences in such areas of knowledge on the validation of information. This dissertation finally concludes that recent studies on a Philosophy of Information based on documentary practices, started by Bernd Frohmann in Information Science, open a possible path of research to enrich the debate on the subject

A noção pátria de serviço público é concebida a partir dos conceitos de serviço público e de serviço de utilidade pública oriundos, respectivamente, da França e dos Estados Unidos da América. Esses conceitos foram introduzidos no Brasil por ação doutrinária à luz da Constituição de 1891. Parte do resultado dessas discussões foi positivada no texto constitucional de 1934. A partir daí o tema figurou em todas as Constituições subsequentes. A Constituição de 1988, assim como as que a precederam, não veicula um conceito material de serviço público expresso em uma fórmula. A estrutura constitucional do conceito de serviço público é bastante complexa. O atual texto constitucional trata de serviço público em variados sentidos, os quais são dimensionados de formas diversas de acordo com as atividades abarcadas. Esses sentidos e dimensionamentos foram construídos ao longo da história constitucional, razão pela qual sua compreensão exige a análise dos textos das Constituições precedentes. Em linhas gerais, serviço público aparece no texto constitucional em três sentidos, quais sejam: o material, o orgânico e o formal. O sentido material é dimensionado nas acepções ampla e restrita. É no interior desse sentido, no qual a expressão serviço público significa atividade, que estão situados os critérios orgânico, formal e material, oriundos da tradição francesa. No âmbito do sentido material situam-se as maiores dificuldades e divergências sobre o tema. No sentido orgânico, serviço público se refere aos órgãos e entidades do Estado. No sentido formal, serviço público é um regime jurídico atribuível às competências materiais de cunho prestacional e natureza econômica do Estado. É no âmbito desse sentido que se encontra a função do conceito de serviço público. Alternativamente ao regime jurídico dos serviços públicos, a Constituição de 1988 prevê o regime jurídico de direito privado. Nesse regime jurídico a potencialização da concorrência é o elemento central, o que exige o desenvolvimento de mecanismos que facilitem o acesso pelos particulares ao setor. Tal acesso é facilitado pelo uso da autorização. A competência pública exercida pelos particulares por meio de autorização configura-se como serviço de utilidade pública à brasileira. A partir dessa estrutura conceitual é possível melhor compreender a noção de serviço público no âmbito dos Estados-membros e municípios e os modos de ação desses entes federados no domínio econômico.

The Brazilian concept of public service is created from the French notion of public service and the American notion of public utility. ▼ The Labor Standards Act is the major statute protecting the rights of workers. In 1996, the Article 84-1 of the Labor Standards Act was added to provide the employers with the right to flexibly adjust working hours because of the impossibility to apply the standard working hour requirement to certain professions with special working conditions, in which has caused excessive exploitation of workers ensued. The state then intervened in response to the rising demands for workersâ rights.This paper explores the mediating role of the state in the face of the conflicts between employersâ demanding on lowering labor cost and those of the workersâ protecting for their legal rights. With interviews and field researches between employers, workers and government officials, the major issues were clarified on what ânecessity of flexible working hoursâ meant for employers. It also described the exploitation of workers in the labor market and examined the stateâs intervention between the workers and the employers. The findings of this research revealed that the stateâs intervention in form of adding the Article 84-1 was related to the trend of liberalization from the 1990s.The labor regime in Taiwan is becoming more in line with the idea of free market economy with relaxed regulations because of globalization and liberalization. This research concludes that the Article 84-1 of the Labor Standards Act is the result of commercialization in the labor regime, market orientation and liberalization. With its enforcement, the state embarked on a course of liberalizing the market as the mode of governance. This liberalization caused the management and supervision of the labor conditions to become relaxed. Such relaxations can be observed from the following aspects: legislation with vague definitions, substantial room for interpretation, the passive attitude of the bureaucrats towards regulation, excessive parochialism of government officials, labor inspectors are insufficient ,the market-oriented approach in the stateâs intervention, and the facilitation of negotiation between the employers and the workers under the principle of free market bargaining. The government gradually resorted to the principles of capitalism and the free development of market economy to conduct its regulatory role in formulating policy, implementing such policy, and inspecting labor conditions. As a result, the pursuit of profits by the employers through relaxation of regulations compromised the autonomy of the workers in regard to working conditions. The tendency towards market economy and capital accumulation resulted in a more flexible labor regime. O estudo analisa as normas ambientais e de restrição ao crédito rural relativas ao regime jurídico da Reserva Legal (RL), obrigatório para todas as propriedades rurais no Brasil, e discorre sobre as particularidades que permeiam a evolução conceitual desse regime jurídico, os aspectos e fatores que influenciam a sua aplicação, a transitoriedade de sua regulação e as alternativas que se apresentam para a regularização dos passivos de RL. A regulação desse regime demanda uma investigação sobre a origem histórica do direito de propriedade e a construção jurídica da função social da propriedade no sistema normativo interno e projeta diferentes dimensões e limites a serem considerados na aplicabilidade das normas de RL pertinentes à concessão de crédito rural, na ordem constitucional e infraconstitucional. O método aplicado consistiu na revisão bibliográfica do regime jurídico da RL, da função social da propriedade, da efetividade das normas referentes à RL e das diretivas socioambientais e econômicas observadas na concessão de crédito rural; e pelo estudo de caso da prática de regularização de áreas de RL implementada em Lucas do Rio Verde - MT. As conclusões obtidas desta análise apontam que as normas expressas pela Política Nacional do Meio Ambiente, pelos Decretos 6.321/07 e 6.514/08, e pela Resolução do Conselho Monetário Nacional n 3.545/08 constituem vetores que contribuem para a aplicabilidade desse regime e para a absorção dessa dinâmica pelas instituições financeiras. O exame da prática escolhida possibilitou identificar elementos passíveis de fomentar a egularização de áreas de RL: a construção de alianças institucionais e financeiras para o atendimento às exigências estabelecidas pelo Código Florestal, a utilização de mecanismos de compensação de RL coletivos e a pressão exercida pelo mercado econômico e financeiro mediante a imposição de restrições ao crédito rural e de embargos comerciais.

This study analyzes the environmental and rural credit restriction norms relating to the juridical regime of the Legal Reserve, which is compulsory for all rural properties in Brazil, and deals with the particularities of the conceptual evolution of this juridical regime, the aspects and factors that influence its application, the transitoriness of its regulation, and alternatives that arise for the regularization of the Legal Reserve liabilities. Les références au christianisme sont constantes dans l’oeuvre de Michel Foucault. Cette constance s’inscrit dans un questionnement philosophique plus large sur notre actualité : comprendre ce qui, aujourd’hui, nous constitue sujets de nous-mêmes, dans des rapports de savoir et de pouvoir, demande en effet de s’interroger sur la spécificité du rapport à soi que l’Occident a défini depuis les premiers siècles chrétiens. Notre thèse propose une étude critique de l’ensemble de ces références chrétiennes, mettant en lumière leurs règles de lecture et d’interprétation, avec une attention particulière portée au cours inédit Du gouvernement des vivants (1979-1980). Trois temps scandent un parcours qui ne se veut pas chronologique : 1) objets, 2) lectures, 3) interprétations. La première partie de notre travail montre comment le christianisme est devenu, à partir de 1978, un objet d’étude à part entière pour Foucault, malgré la dissolution des grandes entités historiques initialement provoquée par l’archéologie et la généalogie. Deux notions nouvelles ont permis une analyse du phénomène chrétien sur une longue durée, sans présupposer une quelconque essence du christianisme : la « gouvernementalité » (cours Sécurité, territoire, population en 1977-1978) et les « régimes de vérité » (cours Du gouvernement des vivants en 1979-1980). Cette dernière notion découpe dans les pratiques chrétiennes un certain type d’actes réfléchis : ceux par lesquels un sujet manifeste la vérité de ce qu’il est. La deuxième partie s’attache à la manière dont le philosophe lit les écrits chrétiens, avec des déplacements méthodologiques importants dans la manière de recevoir ces textes. Le corpus patristique, objet de plusieurs leçons au Collège de France en 1978 et 1980, permet non seulement une étude synthétique des sources utilisées par Foucault (sources primaires et secondaires), mais également une compréhension fine de ses pratiques de traduction, au plus près du lexique original des textes. Dans la troisième partie, nous nous efforçons de ressaisir l’interprétation générale que le philosophe donne du christianisme, des études sur la folie et la littérature des années 1960 à celles consacrées aux « techniques de vie » à partir de 1980. Cette interprétation ne se construit pas d’elle-même, mais toujours en regard de l’Antiquité gréco-romaine. Cette thèse de doctorat a le but de suggérer une interprétation des dernières oeuvres de Michel Foucault à travers la notion de bios. En analysant ses cours au Collège de France depuis 1980 au 1984 et les autres écrits et interventions de ces ans, elle examine le rôle joué par cette notion à partir de son introduction, au début des ans quatre-vingts, dans le cadre du problème du rapport entre subjectivité et vérité et en opposition au sujet chrétien et moderne. Autour de l’idée de bios semble prendre forme non seulment la reconceptualisation foucauldienne de l’idée de résistance, mais aussi la réflexion sur la dimension de la subjectivité, de la subjectivation. À travers l’examen des régimes de vérité que Foucault esquisse (alèthurgie chrétienne, ephistrophê platonicienne, souci de soi stoïcien, parrêsia socratique et vraie vie cynique), ce travail se propose de mettre en évidence comme la notion de bios acquiert une importance croissante à travers les notions de « techniques de soi », de « pratique de subjectivation » et de « vraie vie ». Foucault semble situer le principal enjeu éthico-politique actuel dans le problème de la manière de vivre et du corp, qui constituent l’essentiel terrain de la lutte politique à l’intérieur duquel il est peut-être possible, aujourd’hui, créer une résistance praticable et efficace à la gouvernamentalité contemporaine.

This work aims to suggest an interpretation of Michel Foucault’s last works through the concept of bios. It analyzes his courses at the Collège de France (1980/1984) and other works and speeches from that period, investigating the role played by this concept since its appearance in the problem of the relationship between subjectivity and truth and in opposition to the Christian and modern subject. Around the idea of bios, not only the Foucault reconceptualization of the idea of resistance, but also the linked reflection on the dimension of the subjectivity, of the subjectivation, comes true. Through the examination of the different regimes of truth that Foucault outlines (Christian aleturgie, Platonic epistrophe, Stoic care of the self, Socratic parrhesia and Cynic vraie vie), this work points out that the notion of bios acquires more and more relevance with the notion of “techniques of self”, the practices of subjectification and the “true life”. Foucault go as far as to place the ethical-political real issue at stakes in the matter of the bios, of the way of life, and of the body, that seem to constitute the essential political battleground where it could be possible today, to create a truly practicable and effective resistance to the contemporary governamentality.

O Regime Disciplinar Diferenciado (RDD) e o Centro de Readaptação Penitenciária de Presidente Bernardes (CRP) são práticas punitivas que alteraram a configuração da disciplina carcerária no Brasil. Tais práticas apontam não mais para uma preponderância dos aspectos disciplinares dos encarceramentos, mas para um problema de gerenciamento eficiente destes, que já não se restringem às penas privativas de liberdade em meio fechado. Trata-se de uma estratégia de controle que incide menos sobre cada pessoa e mais sobre os meios em que estas vivem e pelos quais se relacionam. O que está em jogo é a ampliação da superfície de contato entre governos e governados. Esta dissertação pretende mostrar como RDD e o CRP foram gestados a partir de um progressivo fortalecimento da administração penitenciária institucional, relacionado ao compartilhamento de suas funções com outros gestores de legalismos e ilegalismos. Entende-se que o governo compartilhado das prisões é hoje indissociável da continuidade e expansão destas, seja na forma de presídios de segurança máxima, seja pela proliferação de controles a céu aberto. Afirma-se que o redimensionamento da disciplina carcerária nestes termos torna cada vez menos discerníveis os limites entre o dentro e o fora da prisão. Destaca-se que a noção de segurança máxima foi redimensionada pelos dispositivos de controle eletrônicos, ao mesmo tempo em que estes também passaram a ser utilizados para a reiterada aplicação das chamadas penas alternativas. Assim, interessa-se pelo abolicionismo penal e suas estratégias como possibilidades singulares de interceptar e arruinar aprisionamentos mais ou menos sutis. The Differentiated Disciplinary Regime (RDD) and the Prison Rehabilitation Center of President Bernardes (CRP) are punitive practices that have altered the configuration of prison discipline in Brazil. Such practices do not indicate the preponderance of the disciplinary aspects of incarceration as it used to be, but the problem of their efficient management, which no longer is restricted to custodial sentences in enclosed spaces. It is a strategy of control focused less on each person and more on the ways in which they live and by how they relate to it. At stake is the expansion of the surface of contact between governments and the governed. This dissertation intends to show how the RDD and the CRP were gestated from a progressive strengthening of the institutional prison administration, related to the sharing of duties with other managers of legalisms and illegalisms. Nowadays, we understand that the shared government of prisons is inseparable from the continuity and their expansion, either as maximum-security prisons or by the proliferation of open-air controls. ▼ Title: Values, Desirability and Ideology in CNN Travel – a Discourse Analysis on Travel Stories Author: Emmi Laine Course: Journalistikvetenskap, Kandidatkurs, H13 J Kand (Bachelor of Journalism, Fall 2013), JMK, Stockholm University, Sweden Aim: The aim is to examine which values and ideologies CNN Travel fulfills in their stories. Method: Qualitative discourse analysis. Summary: This Bachelor ́s thesis asks what is desirable, which are the values of CNN Travel, the major U.S. news corporation CNN ́s online travel site. The question has been answered through a qualitative discourse analysis on 20 chosen travel stories, picked by their relevancy, diversity, and their expressive tone. Due to the limited space and the specific textual method, the analysis was restricted to the editorial texts of these stories. The chosen method was discourse analyst Norman Fairclough ́s model of evaluation, which revealed the explicit and implicit ways the media texts suggest desired characteristics. These linguistic devices took the readers ́ agreement for granted, as they imposed a shared cultural ground with common values, which is a base for a mutual understanding. After identifying the explicit and implicit evaluations, they were organized according to some major discursive themes found in the texts, and finally analyzed in order to expose their underlying values. The results showed how these certain values brought forth certain ideologies, to some extent in keeping with recent research of tourism and travel journalism. As the study has been put into a larger context of related research, the following pages will first explain some larger concepts of discourse analysis, such as representation, cultural stereotypes, ideology and power. A cross-section from older to more contemporary theories in culture studies has been utilized; moving from Edward Said ́s postcolonial classic Orientalism, an example of cultural stereotyping, to the more recent topics of ‘promotion culture’ and consumerism, and tourism researcher John Urry ́s ideas about the consumption of places and the ‘tourist gaze.’ In the end, the study considers what kind of power does travel journalism possess over the represented tourism destinations. Finally, when questioning the travel journalists ́ legitimacy and power to represent the travel destinations, poststructuralist Michel Foucault ́s theory about the ‘regime of truth,’ as well as Antonio Gramsci ́s ideas of ‘hegemony,’ theory of dominance through consent, were discussed and confirmed.

O presente estudo objetiva analisar o novo regime de insolvência empresarial (Lei n 11.101, de 9 de fevereiro de 2005). Pretende demonstrar sua relação com o neoliberalismo, ideologia que influenciou o Fundo Monetário Internacional - FMI. O FMI adotou então diretrizes neoliberais e passou a exigir dos Estados solicitantes de empréstimos, reformas estruturais. Alterações legislativas surgiram em função disso. O trabalho apresenta a evolução histórica do pensamento econômico, a partir do liberalismo clássico. A doutrina neoliberal, baseada na intervenção estatal mínima nas relações econômicas, pode ser, dessa forma, melhor compreendida. Estabelecidas essas premissas teóricas, prossegue-se com o exame da origem, estrutura, funcionamento do FMI e seus acordos stand-by. São chamadas assim, uma das formas de concessão de empréstimo que vinculam a liberação do crédito ao cumprimento de condições impostas pelo organismo, assumidas pelos países requerentes por meio das cartas de intenções. Deve-se assinalar que apesar de atender aos interesses do FMI, o novo regime de insolvência empresarial brasileiro buscou também desenvolver a função social da empresa, conferindo ênfase à sua preservação, medida inexistente na lei anterior.

This study aims to analyze the new corporate insolvency regime (Law No. 11101 of February 9, 2005). It intends to demonstrate its relationship to neoliberalism, an ideology that influenced the International Monetary Fund IMF. The IMF then adopted neoliberal policies and began requiring the loan applicant States to do structural reforms. Legislative amendments have arisen as a result. The work traces the history of economic thought, from classical liberalism. The neoliberal doctrine, based on the minimal state intervention in economic relations, can be thus better understood. Given these theoretical premises, the research continues with an examination of the origin, structure, operation of the IMF and its stand-by arrangements. Stand-by arrangements is the name of one of the forms of money lending. They link the release of credit to the conditions imposed by IMF, accepted by the requesting countries by means of letters of intent. It should be noted that while serving the interests of the IMF, the new Brazilian corporate insolvency regime also sought to develop the social function of the company, with an emphasis on preservation, so far missing in the previous law.
