Este estudo tem como objetivo, avaliar e perceber qual a extensão do impacto dos impostos no investimento direto estrangeiro (IDE) em Portugal, desde 1996 até 2013. Outras variáveis consideradas relevantes pela literatura existente, nomeadamente de natureza económica e legal, foram também testadas para perceber qual o seu efeito no IDE. Utilizando dois conjuntos de dados, sendo eu o primeiro contém apenas informação sobre o valor total de IDE, sem discriminar os países de origem desses fluxos financeiros. O segundo conjunto de dados, contém informação sobre os fluxos de IDE, informação essa, que está desagregada por ano e país de origem. Foram corridas duas regressões OLS, para ambos os conjuntos de dados. A primeira, que testa os efeitos das variáveis fiscais, ficou provado que a taxa de imposto nominal e os encargos com a Segurança Social, estão negativamente correlacionados com o IDE. Na segunda regressão, que testa o efeito das variáveis económicas e legais, verifica-se que o investimento público tem correlação positiva com o IDE. Os resultados das regressões são iguais para ambos os conjuntos de dados.

The objective of this study is to understand and evaluate the extent to which taxes impact foreign direct investment (FDI) flows in Portugal, from 1996 to 2013. Other variables that previous literature considered important, were also tested for economic and legal effects. This work has a cross section data and a panel data, the first uses the total amounts of FDI flows, disregarding the country of origin. The second, contains data that discriminates those flows by country of origin. Two regressions were tested to both data sets, one testing for fiscal effects and other for economic and legal effects. The regression for fiscal effects, show that nominal tax rates and social security as a percentage of gross domestic product (GDP) are negatively correlated with FDI. The regression looking for economic and legal effects, shows that Public investment as a percentage of GDP has a positive correlation with FDI. The results hold for both data sets.

▼ This thesis consists of three independent essays which focus on agency conflicts and the role of governance in mitigating such conflicts. The first essay exploits a quasi-natural experiment that imposes stricter restrictions on the executive’s mobility and uses a unique hand-collected dataset to examine the net effect of such restrictions on corporate policies. Firms managed by professional chief executive officers (CEOs) who depend more on outside employment options to diversify their career risks adopt suboptimal corporate policies after such stricter restrictions on mobility. The study uses an additional quasi-natural experiment where professional CEOs replace founder CEOs in exogenous turnovers. The study finds casual evidence that professional CEOs’ exacerbated career concerns aggravate risk-related agency conflicts and thus, influence corporate decisions systematically. This estimation has implications for public policy prescriptions regarding firm-level governance and the design of a flexible labor market that ensures allocational efficiency. The second essay uses a quasi-exogenous regulatory shock to analyze whether forced changes in board composition help to reign in powerful CEOs. The study finds that post-regulation, firms led by powerful CEOs initiate a strategic shift in resource allocation. Firms managed by powerful CEOs increase innovation inputs (R&D expenditures) and produce more innovation outputs (patents) that are scientifically more important and economically more valuable. Investment quality also improves, manifesting in better takeover performance. Such evidence suggests that firms with an independent board can balance executive power, force powerful CEOs to consider other opinions, and reign in value destruction. The third essay uses a unique hand-collected dataset on family ownership and family management of S&P500 firms and shows that firm performance is sensitive to the measurement of family ownership and founder CEO status. The study also documents that variation in the definition of a family-firm may modify the impact of family-firms on strategic investment decisions (Mergers & Acquisitions) and financing decisions. Overall, the findings highlight that the relationship between family-firms and corporate policy documented so far in the literature should be evaluated with caution, as such associations are sensitive to the measurement of family ownership and whether the CEO is the founder of the firm. ▼ This dissertation consists of three chapters on consumer choice and public policy. The first chapter re-evaluates the realized efficacy of increasing block pricing (IBP). IBP is expected to give a positive social benefit, this assumes that consumers are attentive to the marginal price, which is questioned by recent literature. This paper measures the welfare loss from inattentiveness to the marginal price, which is defined as the misperception effect. By comparing IBP’s efficacy and the misperception effect, the net benefit of using an IBP schedule is revealed. This study starts by identifying consumers’ perceived marginal price. Using this perceived price, the demand curve can be estimated. After that, each consumer’s and firm’s surplus change are calculated. The second chapter studies the impact of snowfall on airport operation and suggests a comprehensive benefit and cost analysis on airport investment. Using two advanced econometric method, the Triple Difference model and the Nearest Neighbor Matching, this study first develops a Delay Analysis model to evaluate the exact effect of snowfall delay and secondly conducts the Net Present Value analysis on the Heated Pavement System (HPS). Delays by snows estimated up to about 9 minutes for airports in the Boston area, and HPS is feasible for airports with a great number of flights and passengers, such as Boston Logan airport. The third chapter explores the expected result of investment in runway, which could, in turn, reduce snow-related delays and cancellations. Three airports in the Boston area are selected since the geographical proximity would lead to intense competition once they are privatized. Each airport’s arrival and departure itinerary data is used for assessment and identification of cost and benefit conditions to achieve this investment. For the analysis, this study constructs a two-stage game model of airports and airlines and follows the subgame perfect equilibrium. Backward induction and simulation for the different scenario are used for analysis. The equilibrium conditions show that private competition between profit maximization airports can stimulate large investment in a heated runway. Advisors/Committee Members: Yan, Jia (advisor).

La thèse s'intéresse à la politique d'investissement public en Tunisie par la voie d'emprunts.L'objectif recherché est l'étude de la question de l'endettement public sous sa triple natureéconomique, institutionnelle et financière dans le cas d'une économie coloniale.La démarche suivie repose sur un plan en trois parties chronologiques mais qui reflètel'évolution de la stratégie d'investissement public en Tunisie. La première partie, qui couvreles années 1920, est marquée par l'émission d'un emprunt émis par tanches. Les priorités del'investissement public consistent à financer la construction d'une infrastructure économiquemoderne. Les fonds destinés aux investissements sociaux demeurent largement insuffisant.Les capitaux privés engagés en Tunisie connaissent une certaine stagnation.La deuxième partie concerne les années 1930 qui coïncident avec la grande dépressionéconomique. Les autorités coloniales décident de simplifier les modalités d'endettementce qui profite principalement aux institutions publiques de la Tunisie. Une décennie difficilesur la plan économique ce qui affecte le volume des investissements publics par la voied'emprunt. The thesis focuses on public investment policy in Tunisia through borrowing. The objective isto study the question of public debt under its triple economic, institutional and financial naturein the case of a colonial economy. The approach followed is based on a three-partchronological plan that reflects the evolution of Tunisia's public investment strategy. The firstpart, which covers the 1920s, is marked by the issuance of a loan issued by tench. Thepriorities of public investment are to finance the construction of a modern economicinfrastructure. Funding for social investment remains largely insufficient. Private capital inTunisia is experiencing some stagnation.The second part concerns the 1930s coinciding with the great economic depression. Thecolonial authorities decided to simplify the methods of indebtedness, which mainly benefitedthe public institutions of Tunisia. A difficult economic decade which affects the volume ofpublic investment by way of borrowing. Private capital is experiencing a sharp decline, hencethe intervention of public credit institutions.The third part runs from 1945 to 1956; A period marked by the adoption of a new economicstrategy based on planning. Colonial authorities in Tunis choose to diversify sources offunding. Due to its construction, this thesis draws up a diagram of the Tunisian economyunder the French protectorate between 1920 and 1956.

Dissertação de Mestrado em Finanças.

O objetivo deste trabalho foi construir conhecimento sobre os desafios das finanças públicas em Angola, com maior realce a Província do Kwanza Sul, privilegiando as últimas evidências numéricas. Foram trazidos vários aspetos da evolução das receitas e despesas e seus impactos na economia da Província. De uma forma geral foi constatado que o Estado sempre gastou mais do que arrecadou, o que consolidou uma situação de défice orçamental permanente e que certamente impactou as decisões do gestor público. Foi concluído que uma receita fraca e incapacitada de acompanhar o crescimento da economia resultou na diminuição da qualidade da prestação do serviço público, atestada pelo facto da diminuição dos investimentos públicos e da quantidade de servidores, justamente em áreas fundamentais do Estado (saúde, educação e segurança). Nesse sentido, essa monografia contribui para tornar evidente essa situação de crise nas contas públicas e apresentar os principais desafios, sugerindo mais esforços por parte dos pesquisadores, privilegiando mais estudos na área de finanças públicas.

The aim of this work was to construct knowledge about the challenges of public finance in Angola, with greater emphasis on the coastal Kwanza Sul Province, privileging the latest numerical evidence. Various aspects of the evolution of revenues and expenditures and their impact on its economy were brought. In general it was found that the state spent more than ever raised, which consolidated a budgetary deficit permanently and will certainly impact the decisions of public managers. It was concluded that a weak and unable to follow the growth of the economy resulted in a revenue decline in the quality of public service provision , attested by the fact that the decline in public investment and the amount of servers, just in key areas of the state (health, education and security). Accordingly, this monograph helps to make clear this crisis in public accounts and present the main challenges, suggesting more effort on the part of researchers, focusing more studies in the area of public finance.

▼ The overall objective of Government of the Republic of Kenya’s debt management policy is to meet the central government’s financing needs at the lowest possible long term borrowing cost with prudent degree of risk. All major development projects targeted by government require huge financing much in excess of what it can raise directly through taxation hence it must look for the excess from outside its normal taxation. Over the years, Kenya has neither enjoyed a balanced nor a surplus budget. The budgeting process has always been based on a deficit to be filled through borrowings, locally and abroad. It is at this point that the financial system that includes international sources facilitates Government to bridge the deficit (GoK annual public debt management report, 2010). Economists maintain that social/national wealth increases only if the benefits from specific projects/investments exceed the costs of those projects. Project costs are varied depending on the type and the sector of the project. However all borrowings for investments have one type of cost, the financing cost. It is therefore prudent to borrow for investments only if it is cost effective, that is, when the costs associated with debt financing and likely effects on the economy as a whole is beneficial. It should be recognized at the outset that the cost of capital is one of the most difficult and disputed topics in the foreign loan theory. Financial experts express conflicting opinions as to the way in which the cost of capital can be measured. It should be noted that it is a concept of vital importance in the financial decision making especially in evaluating investment decisions, designing a firm’s debt policy and appraising the performance of the firms’ top management, (Pandey.I.M 2004). This study went ahead to establish factors determining cost of external borrowing for investment financing in Kenya by analyzing data collected from both primary (key participants in investment financing like Debt Officers, Finance Officers, Accountants, Economists among others from both GoK and DPs) and secondary data from various sources. In summary the study established that factors determining the cost of external borrowing towards investment financing in GoK, can be concluded to be: Legal and policy framework factors; Interest and transaction cost factors; Donor condition factors; Commitment fee; Economic factors; Political factors, management factors among others. The study also recommended putting in place proper legislative and policy framework to safeguard against the lenders taking advantage of the loopholes in the financial system, developing capacity building plans to strengthen skills and knowledge of the officers participating in investment financing among others.

▼ Nigeria is rich country in terms of natural resources, It has one of Africa's largest economy, having being endowed with massive natural, human, renewable and non-renewable resources. With a population of about 160 million people which creates a large market for goods and services, rich soil suitable for commercial agriculture, deposits of natural resources including crude-oil, natural-gas, tin, and rock-salt, and cash crops including cocoa, kola-nut, cotton, groundnut and timber, Nigeria has the potential of being one of the largest economy globally and the political hegemony in Africa.1 However, the country has not been able to achieve sustainable development as a result of the deplorable state of infrastructure. Nigeria is confronted with the problem of immense infrastructure deficit which adversely affect national income, cost of production and distribution of goods and services, reduces Foreign Direct Investment(FDI), and result in poverty, unemployment, frequent youth unrest and fall in the general living standards.2 The poor state of infrastructure assets in the country is traceable primarily to the neglect by government and poor maintenance during the transition period from military rule to civilian administration. In an attempt to recover from the infrastructure decay, privatization was commenced in the late 90s through to the 21st century. Yet, there was no commendable improvements as the quality of public services dropped continuously and most of the enterprises were eventually wounded up as a result of corruption, poor maintenance and lack of skilled expertise.3 Furthermore, as a result of budget deficit caused by contraction in fiscal space, and continuous increase in demand for public services which correlates with population growth and rural-urban migration, public financing cannot facilitate bridging of the infrastructure gap. Also, having realized the success of Public Private Partnership (PPP) in other climes, government adopted PPP in 2005 to aid transition of the state of national infrastructure through private involvement in infrastructure financing. Unfortunately, for well over one decade of adopting PPP, Nigeria has not witnessed any commendable changes in her infrastructure assets. The poor performance of PPP in country has been traced to several factors including corruption, lack of transparency, and undue political interference. Central to the factors is the problem of regulatory deficit.4 Consequently, this study will examine the Nigerian PPP legal and regulatory framework to ascertain the problems responsible for the inability of the infrastructure financing technique to facilitate sustainable development through successful infrastructure projects. ▼ Since the 1980s, there has been growing recognition among developing countries that an essential foundation for sustainable growth is capital investment, both public and private. While Iraq is an oil-rich country, with substantial oil revenue, only a small proportion of it has been allocated to importing the capital that is most needed, while the rest has mainly been used for consumption purposes. The effects of the oil-driven state development, conflicts, sanctions, high unemployment and delayed reforms have significantly shaped Iraq’s economy and limited the potential for private-sector-led growth over the past 40 years. This conclusion is worrying for a country like Iraq, which has shown some downward trends in private and public investment, both in the total amounts and relative to GDP. This study, the first of its kind, empirically assesses the pattern of domestic private investment in Iraq and its key determinants over the past four decades. It also examines the issue of the complementarity (crowd-in effect) or substitutability (crowd-out effect) between public capital and private investment in the trend in economic growth. Finally, it evaluates the determinants of public investment, to reveal the indirect impacts oil revenue has on private investment through the increasing of public investment. The thesis employs time-series data and annual datasets covering 1970-2010. Both the ADF and the PP unit root tests are employed to test for the stationarity of the data. Johansen’s cointegration is used to establish the long-run equilibrium relationship among the variables in the models. The VECM is also utilized to examine the short-run dynamics between the variables. The main empirical results support the accelerator principle hypothesis of a positive relationship between GDP and private investment. The McKinnon-Shaw hypothesis is, however, not verified in the case of Iraq but there is some evidence that private investment is crowded in by public investment, and that oil revenue has an indirect effect on private investment.

▼ What determines whether leaders in oil-dependent autocracies will invest in economic diversification? The existing literature finds that oil-dependent regimes tend to block diversification from happening. However, various autocracies around the globe have repeatedly attempted–and mostly failed–to diversify their economy through massive investment programs. This dissertation proposes and empirically tests a new theory of regime survival and strategic resource allocation to explain the observed variation in diversification strategies. The theory argues that incumbents use diversification programs as yet another tool for regime survival geared towards Politically Influential (PI) groups that lie outside the decision-making circle, yet have sufficient political influence to credibly threaten the incumbent's hold on power. It proposes that, in addition to the findings of the existing literature, two additional scenarios are taking place: (1) diversification programs can bring political benefits while creating economic costs–as a rent-distribution mechanism; (2) they can also simultaneously generate political and economic benefits–as a rent-generation mechanism. Based on an original dataset of public investments in diversification programs and PI groups in twenty-five oil-dependent autocracies over forty-six years, the empirical analysis shows that the size of PI groups and the generational composition of the incumbent's PI group of origin influence (1) the incumbent's incentive to invest in diversification programs, and (2) the extent to which those investments will become profitable. Through the combination of large-N analysis and in-depth case studies, this dissertation finds that those programs are used as a way for incumbents to diversify their survival politics, through the implementation of both productive and unproductive programs tailored to the needs and interests of specific PI groups. By analyzing political drivers of diversification strategies, this dissertation uncovers a powerful mechanism by which oil can affect the political stability of rentier regimes through spending patterns. It contributes to the growing literature on the conditional effects of natural resources on both economic and political outcomes. Advisors/Committee Members: Boix, Carles (advisor).

Le financement des contrats de la commande publique est une question relevant dans une large mesure de la pratique contractuelle. L’impécuniosité des personnes publiques conduit cependant les acteurs de la commande publique à lui porter un intérêt grandissant. Cette étude se propose de rendre compte du mouvement de financiarisation affectant le droit des contrats de la commande publique et, en particulier, le droit des contrats immobiliers conclus par les personnes publiques. Elle met en évidence la flexibilité de la matière qui ne cesse de s’adapter à l’impératif de financement des opérations d’intérêt général. Cette préoccupation contribue à lui conférer certains caractères. Elle est par ailleurs susceptible d’expliquer les choix du législateur. Cette tendance à l’adaptation est largement confirmée par les récents textes européens et nationaux portant réforme des contrats de la commande publique. Elle révèle toutefois certaines incohérences du droit positif qu’il est utile de mettre en évidence dans un contexte de codification du droit de la commande publique.

The funding for public procurement contracts is a pertinent question in the practice of contract law. Impecuniosity of public entities is driving a growing interest in public procurement law legislation.This study aims to report and account for the trend of financialisation how it affects public procurement law and, in particular, real estate law concluded by the public sector. Furthermore, this study highlights the flexible nature of the aforementioned legislations, which continuously adapt to the financial needs of the common good. This adaptation is an occurrence which implies certain traits regarding the process of financialisation. Moreover, this study may help to explain choices made by legislators.The phenomenon of economic adaptation is widely confirmed by recent European and national texts proposing reform of public procurement contract law.Nevertheless this report reveals certain inconsistencies in positive law, which is valuable to emphasize in the context of codification of public procurement legislation.

Investing in urban transit is necessary to fuel urban growth and sustainable mobility. Decision making for public transport projects usually involves long term forecasts of travel demand. Future development of factors that influence those forecasts and hence the expected net societal benefits of the investments are uncertain. Decision makers may want to account for uncertainty by incorporating flexibility in project designs, which makes it possible to adapt the project to developments of uncertain factors. Real options theory offers a method to assess the flexibility. While real options analysis is proven to be useful in many sectors involving irreversible, high investments, it has not been applied to the development of urban public transport networks. In this study, the usefulness of real options analysis in the design and evaluation of tram and BRT systems in combination with bike sharing systems is investigated. One of the options to include flexibility is decision tree analysis. This approach, in combination with societal cost benefit analysis, is used in a case study. It was found that flexible investment strategies perform better compared to inflexible ones in every tested scenario, resulting in improved net present values of up to 70 million euros. Nevertheless, both flexible and inflexible investment strategies were economically inefficient in the case studies. The clear difference in outcomes for flexible and non-flexible options that the case showed still indicate that the real options approach results in useful information for decision-making. Recommendations for further research to include flexibility even better are to test the method for cases in which the quality of the current public transport system is lower, include other real options such as delay, include cheaper direct investment options, include more welfare effects, and include other uncertain factors, such as shared mobility and technological development.

O presente trabalho tem como objeto a comparação entre a arbitragem comercial brasileira envolvendo a administração pública e a arbitragem de investimento no âmbito do International Centre for Settlement of Investment Disputes (ICSID, sigla em inglês) - fórum mundialmente mais utilizado para resolver controvérsias entre investidor estrangeiro e Estado hospedeiro. Para cumprir este objetivo contextualiza-se o investimento estrangeiro no cenário global e como ele vem sendo tratado pela legislação brasileira, verifica-se a forma de operacionalização das arbitragens no âmbito do ICSID. Ainda, discute-se a arbitrabilidade, o direito aplicável e a forma de execução de sentenças pela referida Instituição, tanto de forma teórica como por meio de análise de casos. Foram selecionados casos paradigmas decididos no ICSID. Apresenta-se a legislação brasileira, no que tange a arbitragem envolvendo a administração pública e comparam-se as seguintes características com as da arbitragem ICSID: arbitrabilidade, direito aplicável; consentimento; procedimento arbitral, execução de sentença. Com a análise resultante deste estudo, revela-se que em termos de procedimento, consentimento e execução de sentença não há relevantes diferenças entre ambas as arbitragens. As características com as maiores diferenças de aplicação em ambos os sistemas são o direito aplicável e a arbitrabilidade. E, demonstrou-se que o sistema ICSID e os tratados ou acordos internacionais oferecem maior proteção ao investidor estrangeiro, enquanto a arbitragem com a administração pública brasileira, oferece mais instrumento de proteção ao Estado, como obrigatoriedade de utilização da lei local.

The object of this study is the comparison between the Brazilian commercial arbitration involving the public administration and the investment arbitration under the International Centre for Settlement of Investment Disputes (ICSID), which is the most utilized forum to resolve disputes among foreign investor and the host State. In order to fulfill this objective the foreign investment is placed in context within the global scenario and how it has been treated in Brazilian legal framework, identifying the arbitration operationalization under the ICSID. Also is discussed the arbitrability, the applicable law and the form of award enforcement by the said institution, both theoretically and through case laws. Model cases decided by the ICSID were selected. Brazilian legislation regarding arbitration involving the public administration is presented. and following features was compared with the ICSID arbitration characteristics: arbitrability, applicable law; consent; arbitral proceeding, award enforcement. The resulting analysis of this study reveal that there are no relevant differences in terms of proceeding, consent and award enforcement between both arbitrations models. The features that presented larger application differences on both systems are the applicable law and arbitrability. A relevância do Investimento Público no Crescimento Económico dos países, tem sido um tema que tem recebido bastante atenção ao longo dos últimos tempos. Este estudo, através de uma abordagem de Modelos de Vetores Autorregressivos (VAR), tem como objetivo a estimação dos efeitos dinâmicos do Investimento Público sobre a economia, para oito países europeus. Os resultados empíricos obtidos através das funções impulso resposta do Investimento Público indicam existir indícios de este, no curto prazo, provocar uma resposta positiva no Produto na maioria dos países. As elasticidades de longo prazo do Investimento Público apresentam resultados significativamente diferentes de país para país. Outra questão abordada é se o Investimento Privado contribuí para o aumento do investimento no setor privado (efeito crowding in) ou se por outro lado o seu financiamento através de impostos pode provocar um efeito negativo no Investimento Privado (efeito crowding out). Enquanto que em alguns países parece prevalecer o efeito crowding in sobre o Investimento Privado, noutros o efeito dominante é o crowding out.

The impact of the Public Investment on a country's growth is a topic that has attracted attention over the last years. This study has the objective of estimating dynamic effects of Public Investment on the economy for 8 countries, by using the vector autoregressive (VAR) model. The empyrical results obtained through impulse response functions indicate that on the short term there will be a positive response to the Product in most countries. Another question is whether Public Investment contributes to private economic activity or on the other hand, the way public investment is financed (taxes) may entail negative effects for the private sector. The long term elasticities of the Public Investment show very different results for each country. While some countries present the crowding in effect on Private Investment, others have the crowding out effect.
