▼ Med den nya plan- och bygglagen (PBL) som trädde i kraft den 2 maj 2011, blev det möjligtatt redovisa fastighetsindelningsbestämmelser i en detaljplan på motsvarande sätt somgjordes genom fastighetsplan i 1987 års PBL. Den särskilda planformen fastighetsplan togsdärmed bort. Syftet med de nya bestämmelserna var att förenkla tillämpningen.Bestämmelserna möjliggör en mer detaljerad reglering i detaljplan, men medför också enskyldighet att göra en prövning redan i planarbetet enligt lagvillkor som finns utanför PBL.Syftet med detta arbete var att bidra med ny empiri avseende hur och i vilken utsträckningsvenska kommuner har tillämpat bestämmelser om fastighetsindelning i plan- ochbygglagstiftningen, samt vilken betydelse tillämparna haft för implementeringen avfastighetsindelningsbestämmelser i plan- och bygglagstiftningen. Genom att tillämpa ettimplementeringsperspektiv är avsikten att bidra med ett nytt perspektiv på tillämpningen avplan- och bygglagstiftningen.Målsättningen var att genom att undersöka och besvara min frågeställning vidareutveckladenna nyvunna kunskap i form av ett förslag till en metodbeskrivning för tillämpningen avlagstiftningen. Då examensarbetet utförts på Halmstads kommunsSamhällsbyggnadskontor var tanken att slutprodukten ska vara ett användarvänligt redskapför dem vid tillämpande av bestämmelser om fastighetsindelning. Metodbeskrivningenresulterade i ett flödesschema och en checklista.En fallstudiemetod tillämpades där implementering av fastighetsindelningsbestämmelservar det ”fall” som studerades och analysenheten bestod av Sveriges 290 kommuner.Datainsamling har skett genom en webbaserad enkät till landets alla kommuner.Det är endast drygt ett år sedan nya PBL trädde i kraft och det är fortfarande tidigt att dranågra slutsatser kring lagstiftningens genomslag. Mina slutsatser är att kommunerna inteanvänder sig av bestämmelserna i så stor utsträckning. Majoriteten av de bestämmelser sominförs avser fastighetsindelning och gemensamhetsanläggningar. Lantmäteriet spelar ennyckelroll vid tillämpandet av bestämmelserna, det är oftast lantmäteriet som prövar attbestämmelsen är förenlig med villkor i förrättningslagstiftningen. Och i de fåtal fall man tagit fram rutiner har man låtit lantmäteriet utarbeta dem. Tillämparna inverkar på implementeringen av lagstiftningen främst på två vis. För det första genom att tillämparna inte till fullo förstår lagparagraferna som reglerarfastighetsindelningsbestämmelser. Konsekvensen av det är att nödvändig villkorsprövninginte görs eller att kommunerna inte använder sig av fastighetsindelningsbestämmelser överhuvudtaget. För det andra genom att det är oklart vilka tillämparna av lagparagrafenfaktiskt är. Det innebär att implementeringsprocessen på lokal nivå kommer att tolkas iljuset av olika professionella perspektiv, exempelvis arkitekter, fysiska planerare, ingenjöreroch samhällsplanerare med en mängd olika utfall. I viss mån påverkas tillämparna av kulturoch tradition hur man tidigare arbetat med fastighetsplan i kommunen.

▼ The bulk of the matrimonial
property regimes operating in Botswana
were inherited from the country's colonial past. Since independence
there ha'> not been any realistic attempt to reform them. The thesis set
out to appraisal the legal regimes governing the determination of
matrimonial
property on divorce to ascertain their efficacy in realising
the legitimate aspiration of married couples. Comparisons were made
with similar countries to determine how these have tackled problems
relating to determination of matrimonial
property on divorce.
The study found that where there is a dispute about matrimonial
property in marriages out of community, the courts have no discretion
to readjust the rights of the parties. This situation adversely affect nonworking
wives who spent most of their time looking after their
husbands and children without being able to acquire capital assets.
Recognition is not given to such domestic contribution to the welfare
of the family. It was also found that the exercise of the marital power
by husbands of marriages in community of
property deprives wives of
those marriages the right to administer the joint estate. The patriarchal
nature of customary law, which governs the majority of disputes about
matrimonial
property, discriminates against women.
Consequently, the following, inter alia, are suggested as reform
measures.
(a) The courts should be g1ven a wide discretionary power,
circumscribed by statutory guidelines, to reallocate matrimonial
property on divorce irrespective of the matrimonial
property regime that
governs the marriage. TI1e underlying principle should be equality of
sharing but this may be departed from where the circumstances of the
particular case warrant it
(b) A spouse's domestic contribution towards the welfare of the family
should be recognised.
(c) The marital power of husbands should be abolished.
(d) The
provisions of the Matrimonial Causes Act should be made
applicable to customary marriages.

▼ This thesis charts, and investigates the role of Trade-Related Aspects of Intellectual Property Rights (TRIPS)-Plus provisions to protect intellectual property rights in the European Union (EU) international agreements. It critically discusses the extent to which the EU is seeking higher levels of intellectual property (IP) protection in the global sphere and analyses whether and to what extent the use of TRIPS-Plus provisions potentially clashes with the objective of the promotion and protection of human rights in the EU external action. This analysis is conducted across two intertwined axis: a chronological one and a conceptual one, in order to understand the evolution of the balance between IP and human rights protection. The main and overarching research question to which this thesis aims to answer is the following:
To what extent and how has the EU reconciled high levels of IP protection with the promotion of human rights in its own international agreements?
In answering this question, this thesis also purports broader considerations on the overall coherence of EU international agreements with the objectives laid down in Articles 3 and 21 of the Treaty on the European Union (TEU). The theoretical framework of this research is that of the EU’s ‘constitutional regime governing foreign affairs’, and, in line with it, the approach adopted is normative, and the methodology used is doctrinal.
This PhD dissertation is divided into three parts. The first part discusses the evolution of IP protection at the international level. The second part examines the position of IP rights within the EU, the competence of the EU to act in the IP field both internally and externally. The third and final part of this thesis systematically examines IP provisions in EU agreements and discusses the extent to which IP protection might conflict with the promotion of human rights

▼ I maj 2011 infördes nya plan- och bygglagen som gör reglering av fastighetsindelningen möjlig i detaljplaner genom så kallade fastighetsindelningsbestämmelser. Enligt äldre lagstiftning bildades tomtindelningar och fastighetsplaner som i dag räknas som fastighetsindelningsbestämmelser. Eftersom majoriteten av dessa antingen är genomförda eller inaktuella i dag skapar det problem vid fastighetsbildning och måste därför upphävas.
Syftet med rapporten är att beskriva och analysera hur äldre tomtindelningar och fastighetsplaner hanteras i samband med fastighetsbildningsärenden. Rapporten ska undersöka vilka olika handläggnings- och beslutsordningar som används för upphävande av äldre tomtindelningar och fastighetsplaner. Ett bisyfte är att ge förslag på hur handläggnings- och beslutsordningen kan förbättras med fokus på nya plan- och bygglagen.
Metoderna som använts har varit litteraturstudie, fallstudier och enkätundersökning. Litteraturen som studerats har varit vetenskapliga artiklar, lagtext, lagkommentarer, propositioner och annan juridisk facklitteratur. Fallstudierna har genomförts för att beskriva och analysera upphävandeärenden från Leksand, Falun, Sandviken och Gävle. Enkätundersökningen skickades till verksamma förrättningslantmätare inom Dalarnas och Gävleborgs län för att få fördjupad kunskap och deras åsikter om tomtindelningar och fastighetsplaner.
Litteraturstudien visar att behovet av att reglera markanvändningen har funnits länge och finns än i dag. Genom att bestämma hur marken delas in i fastigheter förhindras en okontrollerad utbyggnad av staden. Lagstiftningen har under åren förändrats och flera nyheter har tillkommit efter införande av PBL, bland annat planbesked. Av fallstudierna och enkätundersökningen framgår det att lantmäterimyndigheterna hanterar handläggnings- och beslutordningen olika i samband med upphävande av tomtindelningar och fastighetsplaner. Det finns skillnader mellan statliga och kommunala lantmäterimyndigheter avseende kommunikation och upprättande av handlingar. Det statliga Lantmäteriet har till skillnad mot de kommunala lantmäterimyndigheterna i Gävle och Sandviken inte delegationsbeslut om upphävande av tomtindelningar och fastighetsplaner. Skillnader finns även i hur myndigheterna upprättar handlingar, där statliga Lantmäteriet saknar en enhetlig utformning medan kommunala lantmäterimyndigheten i Gävle kommun har upprättat mallar.
Slutsatsen är att handläggnings- och beslutsordningen kan förenklas genom att upprätta enhetliga ärendehandlingar. Det statliga Lantmäteriet bör även i fortsättningen få upprätta planförslag till upphävande av fastighetsplaner. En lagändring kan göras för att ge SLM tillfällig rätt att besluta om upphävande av fastighetsplaner. Vidare föreslås planbeskedet bör undantas från upphävandeprocessen, eftersom det riskerar förlänga processen upp till fyra månader.

▼ Solastnina, kot ena izmed osnovnih oblik lastninskega razmerja več oseb na isti nerazdeljeni stvari, v sebi pogosto skriva nasprotujoče si interese solastnikov ter predstavlja izvor nesoglasij in sporov (communio est mater rixarum), ne glede na to, ali je nastala na podlagi zakona ali po volji solastnikov. V primerih kadar v solastninski skupnosti ni več mogoče doseči učinkovitega upravljanja stvari, solastniki pa zaradi medsebojnih nesporazumov ne morejo uresničevati svojih interesov ali ustvariti koristi, ki bi jo sicer lahko ali jo pričakujejo od svoje lastnine, ima vsak solastnik zakonsko neodtujljivo in nezastarljivo pravico zahtevati delitev solastnine in s tem prenehanje solastniške skupnosti. Kljub dejstvu, da gre za institut, ki je v našem pravnem prostoru že vrsto let, se sodišča v sodnem delitvenem postopku pogosto soočajo z vprašanji brez enoznačnih in jasnih odgovorov, ki pa privedejo do različnih rešitev. Kompleksnost postopka razdružitve solastninske skupnosti pa se kaže tudi v realizaciji delitve oziroma sklepa o delitvi, kjer se največ težav pojavi prav pri izvršitvi sklepa o civilni delitvi nepremičnine v solastnini, saj sta postopka prostovoljne in prisilne sodne prodaje pomanjkljivo in nekonsistentno pravno urejena ter kot taka neučinkovita za vse udeležence postopka.
Joint property, as one of the basic forms of ownership of several persons on the same undivided thing, often hides the conflicting interests of co-owners and represents the source of disagreements and disputes (communio est mater rixarum), regardless of whether it was created on the basis of the law or at co-owners will. In cases where it is no longer posible to achieve effective management of thing in a joint property, and co-owners due to mutual misunderstandings can not realize their interests or create benefits that they could or expect from their property, each co-owner has a legal inalienable right to demand the devidion od jonit property and achieve termination of joint proprety. Despite the fact that this is an institute that has been in our legal space for many years now, the courts in ithe judicial separation process often face issues without distinct and clear answers, which lead to different solutions. The comlexity of the process of separation of joint property is evident in the realization part of the division of things, where most problems occur precisely in the execution of the decision on the civil division of the joint property, since judical procedures for the voluntary and forced sale are insufficiently and inconsistently regulated and as such ineffective for all participants in the procedure.

Property management industry is the human resource-oriented industries, We must use appropriate management techniques in order to break through the bottleneck for industry to develop , of which the greatest impact on this industry is the management organization , because the
property management industry must employ a lot of manpower, employees need to manage by the management organizations, and also management organization is the main costs, in addition ,the management organization also affected the development speed and the market response time, For such characteristics of this industry, How to find the optimal organizational structure for this industry is the goals of this study.
The result of this study is that, the most suitable organization for
property management industry in Taiwan is amoeba organization, and it also explains the development phenomena in Taiwan
property management industry. By the way it could provide the direction for the existing industry to reform their organization.

▼ Le droit transitoire est une discipline dont la vocation est universelle. Cet ensemble de règles a pour finalité de permettre la découverte de la loi applicable à un fait ou un acte donné. Tout comportement a une traduction juridique, même neutre, selon une norme unique. À ce titre, peu importe le domaine du Droit concerné. De nombreuses règles, forgées par la doctrine et la jurisprudence à partir de l’article 2 du Code civil, permettent à l’interprète de la loi nouvelle de décliner le principe de non rétroactivité selon les spécificités d’une espèce. Par exception, le législateur peut proposer lui-même des dispositions transitoires, qui s’avèrent pour la plupart, en droit de la propriété intellectuelle, conformes au principe de sécurité juridique. D’une manière générale, l’opération de qualification nécessaire porte sur l’acte ou le fait étudié ou bien sur la norme nouvelle elle-même. L’étude menée a pour objet la transposition de cette opération de qualification au sein du domaine précis de la propriété intellectuelle. Dans cette optique, les notions de « droit acquis » et de « situation juridique » sont confrontées aux spécificités de la discipline, dont la filiation apparente avec le droit des biens est parfois source d’erreurs. En plus de ces qualifications qui se rapportent aux éléments saillants d’une espèce donnée, sont également recherchées en droit de la propriété intellectuelle les illustrations des qualifications classiques de « loi interprétative », de « loi pénale plus douce », de « loi d’ordre public » et de « loi de procédure ». Leur signification transitoire est appréciée au regard de l’exigence de sécurité juridique, fil conducteur de toute discussion relative à la résolution d’un conflit de lois dans le temps. Au cours de cette étude, les systèmes de protection très disparates qu’offre le droit de la propriété intellectuelle à tout créateur ou « découvreur », apparaissent comme autant de facteurs d’une diversité jurisprudentielle gênante. À l’inverse, le mécanisme de réservation d’une chose intellectuelle semble constituer un dénominateur commun intéressant. Celui-ci trouve une traduction efficace avec la notion de « situation juridique » écrite de cette manière : « titularité d’un droit de propriété intellectuelle ». Par suite, l’indépendance de la matière se confirme et ses disparités internes sont gommées. Seulement, si l’exigence de sécurité juridique commande de retenir la notion de « situation juridique », il convient, au contraire, de se méfier de la notion de « droit acquis ». De plus, il est constaté que l’utilisation de la notion de «loi d’ordre public » n’est pas conforme à l’exigence de sécurité juridique, quand le maniement de la qualification de « loi de procédure » se révèle souvent délicate. Enfin, la notion de « loi interprétative » semble implicitement justifier de nombreux choix jurisprudentiels, orientés par l’absence de nouveauté manifeste de la norme nouvelle. ▼ Onyttiga vägsamfälligheter är ett problem som uppstått under äldre tiders fastighetsbildning och är idag en olägenhet för lantmätare och fastighetsägare i många förrättningsärenden. Detta arbete har syftat till att studera de metoder för utplåning av onyttiga vägsamfälligheter för att slutligen ge förslag på möjliga lösningar. Studier har gjorts av en utredning, en proposition, förrättningsakter och rättsfall med fokus på städning av fastighetsindelningen. De förrättningsakter som studerats innehåller fastighetsregleringsåtgärder som verkar för utplåning av onyttiga samfälligheter och sanering av fastighetsindelningen. Förrättningarna innefattade ett eller flera större områden med ett stort antal fastigheter. Rättsfallen som inkluderades i arbetet rörde samfälligheter och handlade om överklagan på saneringsåtgärder med ersättning och äganderätt i fokus. Utöver detta har ett exempel från Finland studerats, där utplåning av vägsamfälligheter utfördes 1977 genom lagstiftning. Den finska lagstiftningen för utplåning av vägsamfälligheter blev till stor del inte en förbättring utan försköt problemet genom att en stor mängd servitut bildades utan kontroll. I längden blev det svårt att hantera de uppkomna rättigheterna och en städningsåtgärd infördes i finsk lag för att rätta till problemen. Det svenska lagförslaget för utplåning av samfälligheter i Sverige från 1983 liknar lagen i Finland men antogs senare inte då det hade inneburit liknande problem. Ett antal ändringar i svenska fastighetsbildningslagen, som Proposition 1988/89:77 tar upp, infördes dock. Exempelvis medförde en ändring att någon ersättning ej behövde fastställas för föreningsförvaltade samfälligheter med lågt värde. Effekterna detta har haft på reglerandet av onyttiga samfälligheter är okänt men eftersom problemet kvarstår efter 20 år får det förmodas att nya åtgärder måste göras. Våra slutsatser visar att onyttiga vägsamfälligheter kan åtgärdas delvis genom större inflytande från sakägare. Någon lösning på problemet är dem däremot inte. Slutsatserna innehåller även förslag på vad en ny lag bör innehålla, med tidigare förslag som förebild. Framtida kostnader ett sådant lagförslag ger upphov till är troligtvis höga men vi hoppas att vissa ändringar från tidigare förslag kan reducera dessa.

▼ The enactment of civil asset forfeiture legislation by Alberta and Ontario in the
fall of 2001, followed by the passage of similar legislation in five other provinces,
has signalled a dramatic change in the way Canadian constitutional law ought to
be understood. This thesis builds on American legal scholarship by highlighting
how deficiencies in Canada’s constitutional law could create space for more invasive
civil forfeiture statutes. Following a historical overview of forfeiture law in
Canada, the thesis (i) examines how the Supreme Court of Canada mischaracterized
this legislation as a matter of property and civil rights; (ii) considers whether
the doctrine of federal paramountcy should have rendered the legislation inoperable
and the consequences of the failure by the Court to do so; and (iii) evaluates iiithe
impact of the absence of an entrenched property right in the constitution, in
regard to this matter.

▼ La nature du droit du copropriétaire immobilier et du droit du propriétaire d’un volume immobilier est généralement présentée en termes d’opposition. L’opposition entre ces deux droits est la résultante de la définition classique de la propriété comme une somme d’attributs sur la chose. La nature de droit réel de la propriété a pareillement exclu une lecture commune de ces droits. Pourtant, en présence d’une copropriété des immeubles bâtis comme d’un volume immobilier, une chose complexe identique existe : une chose-lot, laquelle est dotée d’un statut juridique. Seule une lecture nouvelle de la propriété permet de mettre en lumière cette identité de nature juridique. S’en suit une évolution possible des régimes de la copropriété des immeubles bâtis et de la division en volumes. Parce que la nature de ces droits est semblable, les domaines d’application respectifs de ces structures de division de l’immeuble peuvent être repensés. Des concepts communs aux divisions de l’immeuble peuvent être dessinés. Une nouvelle catégorie juridique pourra alors être proposée : celle d’une propriété insérée dans une division de l’immeuble.
The legal nature of the co-ownership of built property and division by volumes is generally presented in terms of opposition. The opposition between these two rights is the result of the traditional definition of property as a sum of attributes over the property. The right in rem nature of ownership has similarly excluded a reading of these two rights as complex properties. However, in the presence of co-ownership of built property or a volume within a property, an identical complex property exists : a lot property, which is endowed with legal status. Only a new reading of ownership can shed light on the legal nature of this identity. This entails a possible change to their legal systems. Because the nature of these rights is similar, a fresh look can be taken at their respective scope. Concepts common to the divisions in the building can be sketched out. A new legal category could then be proposed : that of a property inserted into a division in the building.

▼ Izvršba na premoženje zakoncev je zaradi, še vedno veljavnega, zakonitega premoženjskega režima, ki določa obvezen nastanek skupnega premoženja, lahko v praksi precej problematična in zahtevna. Magistrsko delo zato obravnava za nas povsem nov institut, in sicer pogodbo o ureditvi premoženjskopravnih razmerij, ki jo lahko skleneta zakonca že pred samo sklenitvijo zakonske zveze, ali kadarkoli čutita potrebo po ureditvi premoženjskega stanja, ki se bo razlikoval od zakonitega. Pogodba o ureditvi premoženjskopravnih razmerij bo tako lahko, če bosta zakonca ob njeni sklenitvi upoštevala vse zakonske določbe in se držala predvidene vsebine, bistveno olajšala sam postopek izvršbe na skupnem premoženju zakoncev. V magistrskem delu so zato izčrpno predstavljene tudi vse značilnosti tega pravnega instituta.
Toda kljub temu, bo vedno, ko bo v zemljiški knjigi pravilno vpisana skupna lastnina zakoncev, izvršba na tako premoženje zakoncev nedopustna. Upniki pa bodo morali, če bodo želeli priti do poplačila svoje terjatve, vložiti tožbo za določitev dolžnikovega deleža in s tem zahtevati razdelitev skupnega premoženja zakoncev. Pri tem pa bo lahko posledično prišlo tudi do posega v pravice drugega zakonca, zato je v magistrskem delu veliko pozornosti namenjeno tudi opisu samega postopka razdelitve premoženja in vprašanju varstva dolžnikovega zakonca.
V praksi se problemi najpogosteje pojavijo pri izvršbi na nepremičnine. Do njih pride v primeru nepravilnih vpisov, in sicer predvsem, kadar je v zemljiško knjigo namesto skupne lastnine zakoncev, vpisana izključna lastnina le enega od zakoncev. Magistrsko delo zato rešuje vprašanje komu od obeh, torej ali upniku ali nevpisanemu zakoncu, je v takih primerih potrebno dati prednost. Pri tem pa so razčlenjene tudi možnosti in pravni instituti, ki jih ima na voljo dolžnikov zakonec, ko mu zakon priznava položaj tretjega. V magistrskem delu so na kratko predstavljene tudi prednosti in slabosti ter sam razvoj relevantnih institutov. Delo pa se dotika tudi vprašanja morebitnega izigravanja upnika s strani dolžnika in njegovega zakonca.
Poudarek magistrskega dela pa je predvsem na varstvu upnikov in obsežni analizi vseh možnosti, ki jih imajo, da bi lahko uspešno izterjali svojo terjatev. Pri tem so obravnavani tako instituti izvršilnega postopka kot tudi instituti obligacijskega prava. Na kratko pa je predstavljen tudi njihov razvoj in argumentiran vpliv, ki ga imajo na sam postopek izvršbe.

Intellectual
Property Rights has almost universal application due
to the large number of signatories from the World Trade
Organization member states. 149 countries signed the TRIPS by 1994.
Therefore, the TRIPS Agreement has also become a valuable tool for
the protection of special intellectual
property rights under the
term geographical indications. GIs have current relevance in the
world market to consumers who are healthy and quality conscious.
The legal protection of GIs is due to their economic value to many
countries where the producers are in rural areas. This is because
most GIs are based on traditional methods of production which have
earned goodwill. The TRIPS came in to prevent fee riding of such
rights by producers who do not conform to the standards and rules
of production. The TRIPS Agreement requires member states to
harmonise their legal systems to provide legal means of protecting
GIs to the standard stipulated therein. Malawi joined the WTO on 31
May 1995 which means that the obligation above mentioned is
applicable from then on. Therefore, this study is an investigation
of whether Malawi has complied with the obligations in article 1.1
of the TRIPS especially in so far as geographical indications
rights are concerned.

▼ Conventional valuation of parks and open space is typically limited to the social, cultural, and aesthetic values associated with these amenities. Perhaps because the primary motivations for building a park or preserving open space have not
historically been financial, these spaces are often not evaluated in economic terms. This thesis uses a qualitative meta-analysis to examine and interpret the existing empirical evidence on the impact of parks and open space on residential property
values. Specifically, data relating to park attributes, neighborhood characteristics, and surrounding demographics are gleaned and interpreted from hedonic pricing studies to offer designers and planners a comprehensive set of design and development
considerations when attempting to maximize the return of investment of parks and open space.

On parle, dans ce cas, de « cotitularité » entre les différents titulaires d’un permis unique. Ce critère, qui, par principe, se matérialise au regard d’une pluralité de personnes, s’étend également à la pluralité d’unités foncières, support du permis de construire sollicité. Jusqu’à la réforme des autorisations d’urbanisme, issue de l’ordonnance du 8 décembre 2005, le droit de l’urbanisme ne connaissait qu’un terrain, un permis et un demandeur. Toutefois, l’évolution jurisprudentielle a amené le législateur à consacrer la possibilité, pour plusieurs pétitionnaires, d’obtenir un unique permis de construire, sur une ou plusieurs unités foncières. For several years, we’re attending, by necessity or by willingness, an increase of the number of town-plannings approvals jointly obtained. We are talking, in this case, of « joint holders » between the different holders of an unique permit. This criteria, which on principle, materializes regarding a plurality of people, also extends to the land’s units plurality, support for the requested building permit. Until the reform of urban planning authorizations stem from the order of the 8th of December 2005, the planning law only included a building land, a building permit and an applicant. However, case-law development has led the legislator to devote the possibility for several petitioners to obtain an unique building permit, on one or on plenty of land units. ▼ ENGLISH ABSTRACT: This study aims to determine and assess the relationship between open space and residential property value in the Cape Town Metropolitan area, based on access to open space. The relationships between different open space types and residential property are respectively determined. This is determined at global level using Ordinary Least Squares regression analysis and (more importantly) at local level using Geographically Weighted Regression. Analysis is performed with data aggregated to small area layer level. The main empirical findings indicate that the increase in percentage of recreational areas results in a minor negative effect on property value for the global model (although this is not statically significant). The increase in percentage of parks also results in a minor negative effect on property value. Finally, proximity to protected areas has a positive impact on property value in the global model. For the local model, substantial local variations are revealed, in terms of distribution of local coefficients, and how the distribution can be compared to other socio-economic factors.
AFRIKAANSE OPSOMMING: Die doel van hierdie studie is om die verwantskap tussen toegang tot oopruimte en residensiële eiendomswaarde in die Kaapstad Metropolitaanse gebied te bepaal en te evalueer. Die verhoudings tussen verskillende tipes oop ruimte en residensiële eiendomme word onderskeidelik bepaal. Dit word op globale vlak bepaal deur ‘Ordinary Least Squares’ regressieanalise asook op plaaslike vlak deur middel van ‘Geographically Weighted’ regressie. Die ruimtelike eenheid vir die analise is ‘Smaal Area Layer’ van die sensusdata. Die belangrikste empiriese bevindings dui daarop dat die toename in persentasie ontspanningsgebiede 'n geringe negatiewe invloed op eiendomswaarde vir die globale model tot gevolg het (alhoewel dit nie staties betekenisvol is nie). Die toename in persentasie parke lei ook tot 'n geringe negatiewe uitwerking op eiendomswaarde. Ten slotte het die nabyheid van beskermde gebiede 'n positiewe impak op eiendomswaarde in die globale model. Vir die plaaslike model word aansienlike plaaslike variasies geopenbaar, in terme van die verspreiding van plaaslike koëffisiënte, en hoe die verspreiding vergelyk kan word met ander sosio-ekonomiese faktore.

▼ This thesis advances the understanding of the impact of stigma on property values. A case study in Wellington, New Zealand, enabled hedonic modelling and an empirical analysis to determine the impact of the stigma from the high voltage transmission line structure and how long the stigma remained after removal.
The results reveal a substantial difference between the discount applied to individual properties while the structure is in place, as compared to the overall increase in neighbourhood value once the structure, which created the stigma, is removed.

The honeybee Apis mellifera is the most important economic insect on the planet. It is also one the most important invertebrate models in neuroscience and social animal behaviour. A large part of honeybee research this past decade has been devoted to understanding the new sources of threats that bees are facing in the industrialised world in order to prevent the collapse of native and domesticated bee populations. More than ever we need to protect them and understand them better. This research project entitled "Physiological and behavioural stress responses in the social honeybee, Apis mellifera" explores specific responses to physical stressors but also considers stress responses in the social context of the bee hive that is vital for the individual honeybee to survive.
In Chapter 1, the thesis is introduced by a broad literature review to define the terms and concept of stress in honeybees. This first part develops the following questions:what is "stress"? what can we call a "stress response"? How could we measure a response to stress in the honeybee? What are the areas of stress research in bees that need focus in the following years? This review helps to define the key research questions addressed in the thesis, especially concerning the measures of behavioural and physiological responses to stressors but also the eventual roles of stress sensitivity in the organisation of honeybee society.
Chapter 2 reports the investigation of physiological responses (biogenic amines) and behavioural response (sting reflex) to physical stressors applied to bees for various durations. I found that dopamine and serotonin were increased after a long-term (three hours) stressor, but not after a short-term (up to twenty minutes) stressor. The nature of the stressor also affected differently the increase of octopamine and serotonin in the brain. These results were discussed in regard to the previously existing stress responses theories and mechanisms.
Chapter 3 explored the role that stress sensitivity could have in the organisation of division of labour. We found that the first bees to react to a threat, the guards, were more sensitive to a stressor than the bees later recruited to a threat, the soldiers. Stress responsiveness also varied with age, and the distinctions in stress responsiveness between soldiers and guards were less pronounced in young bees. ▼ Despite the prevalent use of anti-takeover provisions (ATPs) based indices as measures of corporate governance quality, the role of ATPs (efficiency vs. entrenchment hypotheses), and their relationship to firm performance are not fully understood. Corporate spin-offs offer a unique opportunity to disentangle entrenchment motives from efficiency motives behind the adoption of ATPs. This setting also provides relatively clean inferences on the relation between ATPs and firm performance. This paper studies the design of ATPs in spun-off firms relative to their parents, the determinants of ATPs, and their relationship to subsequent firm performance. We show that spun-off firms typically are endowed with a higher number of ATPs than their parents, and the additional provisions are mostly delay provisions. Our results on the determinants of ATPs suggest they are more likely to be motivated by efficiency than by entrenchment. Further, in sharp contrast to the negative relationship between ATP indices and equity returns as documented in Gompers, Ishii and Metrick’s (2003) and Bebchuk, Cohen, Ferrell (2004), we find a strong positive relationship between ATP indexes and subsequent stock returns for our sample spun-off firms.

▼ When considering the valuation techniques of
income-producing
property, various types of information should be
obtained from the market in order to apply them to the valuation of
the
property under consideration. This includes the comparison with
other properties sold in the market. However, due to the illiquid
nature of
property, especially those typically owned by
institutional investors, such transactions do not take place every
day. Therefore the necessary information is not always readily
available, and also not of the required quality. In order to try
and eliminate this problem, the study considers the possibility of
using alternative information to indicate market activities.
Various studies have considered the similarities of direct real
estate and indirect real estate. Most of these studies compare the
investment returns of the two markets. This study extends the
research by specifically looking at the unique
property loan stock
structure of South Africa, and comparing the value of shares to the
value of assets. It therefore offers a more comprehensive
explanation of the factors over and above the return received on
the investment. It furthermore considers the composition of the
property portfolio and the possibility to measure individual
property values within such a portfolio.
The outcome of the study
is a model that allows
property valuation and market interpretation
from fundamental principles, with supporting evidence from the
listed-
property investment market.

teisių teismo, Lietuvos Respublikos Konstitucinio teismo, Lietuvos
Respublikos Aukščiausiojo teismo ir Vyriausiojo administracinio
teismo praktiką. Siekiant išsiaiškinti nuosavybės teisės garantijų
efektyvumą, apžvelgtos laimėtos bylos prieš Lietuvos Respubliką dėl
nuosavybės teisės pažeidimų Europos žmogaus teisių

This thesis deals with the system of
guarantees of property right and their significance. The topic is
one of the most relevant issues nowadays because the legal
institute of property is affected by progressive changes in
economical and social life. Thus property reveals not only
universally perceptible feature of personal freedom but it is
considered to be as a duty as well. Due to this the state has more
reasons to put some restrictions upon property rights and regulate
the uses of ownership. The aim of the author is to provide analysis
of guarantees embodied in international, regional and national
legal acts. The substance of the guarantees is disclosed by
analyzing legal acts such as Universal Declaration of Human Rights,
The First Protocol of European Convention for the Protection of
Human Rights and Fundamental Freedoms, The EU Charter of
Fundamental Rights, The Constitution of The Republic of Lithuania
and relevant statutes of Lithuanian legal system. The jurisprudence
of the Supreme Court of Lithuania and relevant cases of the Supreme
Administrative Court of Lithuania are also taken into account. The
efficiency of the guarantees system of property rights is analyzed
via cases that where succeeded against Republic of Lithuania in
European Court of Human Rights under The Article No.1 of The First
Protocol of European Convention of Human
Rights.

▼ In 2001 the Declaration on the TRIPS Agreement and Public Health (‘Doha Declaration’), affirmed the right of member states of the World Trade Organisation (‘WTO’) to interpret and implement the TRIPS Agreement as supportive of the protection of public health and, in particular, access to medicines. While initially well-received, consternation soon arose over the interpretation of a specific paragraph in the Doha Declaration dealing with compulsory licensing. After a further two years of deliberation, the WTO Decision on the Interpretation of Paragraph 6 (‘Paragraph-6 Decision’) was announced in August 2003 specifying when countries can import drugs produced elsewhere under compulsory licence.
With one third of the world's population is still denied access to essential medicines - a figure which rises to over 50 per cent in Asia and Africa - the problems facing the public health community are two-fold. The first is the capacity of developing countries (‘DCs’) actually to use the flexibilities afforded under the TRIPS Agreement, the Doha Declaration, and the Paragraph- 6 Decision amid stark inequalities in health resources and the world trading system as a whole. These include
provisions for compulsory licensing, parallel importation, and addressing imbalances in research and development (‘R&D’). The pending ratification of the Paragraph-6 Decision, from an interim solution to a permanent amendment, is accompanied by considerable uncertainty: will the protections be accessible under the system currently proposed?
The second problem concerns the undermining of the above hard-won flexibilities by
provisions adopted under various bilateral and regional trade agreements. Known as ‘TRIPS-plus’- or ‘WTO-plus’- measures, the level of intellectual
property rights (‘IPRs’) rights protection being negotiated and even adopted under other trade agreements are more restrictive as regards public health protection. These two sources of concern have led to an increase in rather than a lessening of tensions between the public health and trade policy communities.
The thesis opens with a brief analysis of the interplay between patents and medicines. This includes an overview of the human rights framework and the right of access to medicines as a manifestation of human rights. The historical development of the TRIPS Agreement, its legitimacy, and the effect of the introduction of patents for pharmaceuticals are critically analysed. The terms of the Doha Declaration as it relates to public health, the Paragraph-6 Decision and its system, the December 2005 Amendment, and the progress made to date on the public health protections available under the TRIPS Agreement are reviewed and discussed in detail. The thesis describes how, despite these important clarifications, concerns as to the capacity of DCs to implement specific measures persist.

▼ Spätestens seit dem Jahr 2002, in dem die EU in ihrer IAS-Verordnung alle kapitalmarktorientierten Unternehmen zur Anwendung der IFRS verpflichtet hat, ist die Bedeutung der internationalen Rechnungslegungsstandards klar ersichtlich. In den letzten Jahren ging der Trend eindeutig in Richtung IFRS. Der IASB ist sich dieser wachsenden Anteilnahme bewusst und versucht, nicht zuletzt mit Hilfe eines Konvergenzprojekts mit dem amerikanischen Standardsetter, einheitliche internationale Rechnungslegungsvorschriften zu schaffen.
Die steigende Bedeutung der IFRS ist auch im deutschen Sprachraum spürbar. Das zeigt sich zum Beispiel in einem neuen Bilanzrechtsmodernisierungsgesetz in Deutschland, welches die Unterschiede zwischen HGB und IFRS weiter reduziert. Geht der Trend in Zukunft so weiter, kann kein Unternehmen die Augen vor einer IFRS-Bilanzierung verschließen.
Diese Ausarbeitung reagiert auf den derzeitigen Trend zu den IFRS und versucht eine erstmalige Anwendung der IFRS und ihre Auswirkungen auf einige Bilanzierungsbereiche zu zeigen. Anhand eines mittelständischen Unternehmens, welches Teil eines deutschen, nicht kapitalmarktorientierten Konzerns ist, wird eine IFRS-Erstanwendung beschrieben.
Neben den möglichen Vor- und Nachteilen einer IFRS-Bilanzierung wird der Standard zur erstmaligen Anwendung der IFRS genau erläutert. Die Arbeit erklärt alle Wahlrechte und Ausnahmeregelungen für mittelständische Unternehmen und beschreibt die Vorgehensweise bei der Erstellung eines ersten IFRS-Abschlusses.
In den letzten Abschnitten werden die Hauptauswirkungen der IFRS-Erstanwendung auf das mittelständische Unternehmen im Vergleich mit dem UGB dargestellt.
Die Ausarbeitung zeigt, dass eine Anwendung der internationalen Rechnungslegungsstandards zu wesentlichen Veränderungen im Bilanzbild der Unternehmungen führen kann. Die Unterschiede zwischen IFRS und UGB erstrecken sich auf nahezu alle Bilanzierungsbereiche und können, abhängig vom bilanzierenden Unternehmen, große Auswirkungen haben. Zusätzlich gilt es den erhöhten Kosten- und Zeitaufwand zu berücksichtigen.
Nach den aktuellen Entwicklungen zu schließen, werden sich in Zukunft viele Unternehmungen mit den IFRS auseinandersetzen müssen. Dabei sind eine gute Vorbereitung und eine detaillierte Planung der Schlüssel zum Erfolg. Kein Unternehmen sollte die erstmalige Anwendung der IFRS unterschätzen.

▼ Because of the importance of computing on data with privacy protections, the cryptographic community has developed both theoretical and practical solutions to compute on encrypted data. On the one hand, theoretical schemes, such as fully homomorphic encryption and functional encryption, are secure but extremely inefficient. On the other hand, practical schemes, such as
property-preserving encryption, gain efficiency by accepting significant reductions in security. In this thesis, we first study the security of popular
property-preserving encryption schemes that are being used by companies such as Microsoft and Google. We show that such schemes are unacceptably insecure for key target applications such as electronic medical records. Second, we propose new models to compute on encrypted data and develop efficient constructions and systems. We propose a new cryptographic primitive called Blind Storage and show how it can be used to realize symmetric searchable encryption, which is much more secure than
property-preserving encryption. Finally, we propose a new cryptographic model called Controlled Functional Encryption and develop two efficient schemes in this model.

▼ In recent years, with the explosive increase of the
wireless communication and consumer electronics products, the
advanced system solutions which have powerful computation
capability and multi-functions are in great demand in the market.
Among the various solutions, System on Chip (SoC) is being widely
exploited due to the fact that it has the highest level of
integration of a large quantity of reusable intellectual
property
(IP) blocks such as microprocessor, memory block, interface block,
RF block, and power management blocks. The success of a SoC design
mainly relies on the available reusable IP blocks provided by the
IP vendors. Given the trusted reusable IP blocks, a SoC system can
be delivered to the market in a very timely way. Therefore, both
powerful computation capability with multi functions and great
productivity can be implemented at the same time by using SoC.
However, the quality assurance of the reusable IP blocks is vital
to the successful SoC design. In this dissertation, we analyzed and
developed trusted Low Dropout Regulator (LDO) models for
intellectual
property (IP) reuse aiming at system verification. The
LDOs were designed with TI (Texas Instrument) Analog System Lab Kit
(ASLK) Pro kit and verified by using TI TINA simulation tools.
Based on the performance of the LDOs, high level models of the LDOs
in MATLAB are given for initial system validation. In addition, the
Verilog-AMS behavior models are presented to cover the full
functions of the LDOs. The correctness and effectiveness of the
models are verified under Cadence design environment. The proposed
models not only satisfy the reusable IPs quality assurance for SoC
application but also indicate the practical issues with the use of
building component ICs from ASLK Pro kit. Therefore, they can be
used as trusted reusable IP blocks for design and verification of
SoC.

▼ Foreign nationals regularly finds themselves seeking refuge in a host country such as South
Africa. One would expect that due to comprehensive legislation ranging from national to
international level, foreign nationals would be received in conditions appropriate to their
circumstances. However, whether that is in fact the case remains to be a matter of great
controversy. The main purpose of this study is to determine whether or not the South African
refugee status determination process is legally compliant with its obligations under domestic,
regional and international human rights law. By focusing on the refugee status determination
process it could best be determined whether the process is legally compliant with the applicable
legislative
provisions by focusing on what occurs during the application for refugee status in
practice. The research question will be answered by focusing on domestic, regional and
international legislative
provisions, case law, journal articles and academic textbooks amongst
other sources. The primary legislative obligation that South Africa has towards asylum seekers is
to provide protection to those in genuine need thereof, which requires that the country must
refrain from violating their human rights. However the study has revealed that even though
South Africa portrays a strong will to protect the rights of asylum seekers, the country still has a
long way to go before it is actually achieved. Numerous of asylum seekers still finds it
challenging to apply for asylum and to simultaneously enjoy constitutionally guaranteed human
rights within the territory of South Africa. Research has established that although South Africa
aims to ensure that its asylum system complies with its obligations towards asylum seekers under
domestic, regional and international human rights law, there however remains multiple of
instances where the country is still in violation of multiple human rights of asylum seekers.
