Сматрамо да се основано може поставити питање: да ли је парламент још увек носилац законодавне власти, или парафразирајући Хобса: претпоставља се ко је законодавац, али да ли се и зна? Предмет ове дисертације су ограничења са којима се парламент данас суочава приликом вршења своје нормативне улоге. Та ограничења су унутрашње и спољашње природе, класична и нова. У модерном времену, у којем су ефикасност и брзина кључна очекивања, чини се да парламент као законодавац губи дах и суочава се са бројним ограничењима у извршавању своје – како се вековима сматрало – „основне функције”: законодавне надлежности. Теза да тежиште власти све више прелази на егзекутиву и у земљама са парламентарним системом државне власти није више новина. Парламент се, међутим, не суочава само са лимитима које пред њега стављају надлежности владе у законодавном поступку. Кључна улога политичких партија, релативизација класичног појма суверености и други, до сада недовољно истражени лимитирајући фактори законодавне улоге парламента доводе до модификације његове функције у савременој држави. Циљ дисертације је да кроз пажљиву селекцију неопходних стручних извора и ослањајући се на деценијско искуство у својству народног посланика у Народној скупштини Републике Србије прецизно утврдимо и рационално истражимо сазнања и изразимо научни став о улози савременог парламента у светлости ограничења његове законодавне функције. Пошли смо од хипотезе да је законодавна функција парламента сужена због устава као бедема, због активности владе као све значајнијег актера законодавства, политичких странака, односно нових учесника у законодавном поступку с једне стране, као и због релативизације суверености у условима међународних интеграција и утицаја глобалних економских токова с друге стране, што све доводи до модификације улоге савременог парламента.

Subjects/Keywords: The following question can be raised: Are parliaments still the true bearers of the legislative power; or paraphrasing Hobbes: it is assumed who the legislator is; but is it also known? The subject of this thesis are the limits that parliaments are facing today while exercising their normative roles. These limitations are both internal and external; and may be traditional or of new origin. Today efficiency and speed are key expectations; it seems that parliaments as legislators are losing their breath and are facing many limitations in their role that has for centuries been their ”basic one”: their legislative role. The fact that the focus of power is increasingly shifting towards the executive branch of power even in countries with parliamentary systems of governance is not a novelty anymore. Parliaments; however; do not only face the limits placed before them by the governments throughout the legislative process. The key role of political parties; the relativization of the classical concept of sovereignty; and other limiting factors of the legislative role of parliaments; which need further examination; may lead to the modification of their functions in modern states. The aim of the dissertation is to through thoroughly selected scientific sources and relying on a decade-long experience as Member of the National Assembly of the Republic of Serbia precisely determine and rationally examine and draft an academic position about the role of parliaments today with regard to the limitations in their legislative function. We started off from the hypothesis that the legislative function of parliaments is set by the constitution; and narrowed by the ever increasing role of the governments in the legislative process; by political parties and other participants in the legislative procedure; as well as by the relativization of national sovereignty in the framework of international integration and also by the impact of global economic flows.

▼ Today, technology is a key component in resolving a range of strategic issues; organisations are becoming increasingly dependent on Information Technology (IT) to improve their performance. In order to make the most out of the available technology, the continuing need to integrate IT strategies with business strategies remains evident. As illustrated from the extant literature, strategic planning and IT appear to present positive correlations with improved performance of organisations. Whilst there has been a range of research that has attempted to apply concepts such as strategic alignment, it remains that there are very few empirical findings centred on the overall effectiveness and usefulness of this approach. The aim of this study is to examine the impact of strategic alignment between business and IT on organisational performance of public organisations and depicts factors affecting this alignment. The development of the conceptual model, which guided this study, was based on prior research conducted in the field of strategic alignment, organisational performance, Information Systems (IS) success and IT acceptance. The rationale here is that previous research on strategic alignment has mainly focused on the development of models and frameworks and examines them in a suitable context or explores the relationships between the variables of the models. Research has shown the need for further investigation on the impact of strategic alignment on organisational performance. Hence, This study expands the knowledge in this field by examining the impact of the strategic alignment of business and IT on the performance of public organisations using quantitative method approach. Following to the development of the conceptual model, a web survey examines this relationship was sent to 413 executives of Bahrain public organisations. Data was collected using a web-based questionnaire from a sample of 163 participants, i.e. some of whom were IT executives, business executives or both. The results of this study imply a positive impact of strategic alignment on organisational performance of public organisations. It also suggest that IT acceptance and prior IS success significantly influence the strategic alignment in public organisations of Bahrain.

Veiklos valdymo informacinės sistemos yra vienas iš strateginių instrumentų, kuris leidžia ženkliai padidinti veiklos našumą bei produktyvumą, apjungiant veiklos procesus ir optimizuojant išteklių panaudojimą. Deja, apie 70 proc. pokyčių, susijusių su VVS diegimu organizacijose, būna nesėkmingi, t.y nepasiekia užsibrėžtų tikslų. Viena pagrindinių priežasčių – netinkamas VVS diegimo proceso valdymas. Šio magistratūros baigiamojo darbo tikslas nustatyti veiklos valdymo sistemų diegimo sėkmės prielaidas remiantis literatūros analize ir Lietuvos viešojo sektoriaus įmonių pavyzdžiu. Pateikti rekomendacijas Lietuvos viešojo sektoriaus įmonių vadovams dėl VVS diegimo proceso valdymo tobulinimo. Baigiamajame darbe apžvelgiamas informacinių technologijų ir pokyčių projektų ryšys VVS diegime. Nustatyta, kad siekiant VVS diegimo sėkmės būtina atsižvelgti į abiejų projektų tipų valdymo ypatumus ir įvertinti abiejų projektų valdymo sėkmės prielaidas. Nagrinėjamos mokslinėje literatūroje pateikiamos projektų valdymo sėkmės prielaidos, atliekama pokyčių projektų valdymo modelių apžvalga. Literatūros analizės metu nustatyta, kad VVS diegimo sukeltų organizacinių pokyčių valdymui geriausiai tinka J.P.Kotter 8 pokyčio valdymo etapų modelis. Atsižvelgiant į viešojo sektoriaus savitumą bei J.P.Kotter modelį, suformuluojamos galimos VVS diegimo sėkmės prielaidos ir jų pagrindu sudaromas instrumentas empirinio tyrimo atlikimui. Enterprise Resource Planning (further – ERP) system is the strategic tools, which helps organisations to increase effectiveness and productivity by integrating all business processes and optimising the resources available. However, 70% of ERP implementations fail or fail to deliver promised (expected) results. The overwhelming number of failures are mostly caused by lack of proper ERP implementation process management. The purpose of this master thesis is to investigate critical success factors affecting ERP implementation, based on relevant literature and case studies of Lithuanian public sector organizations’. Make recommendations to executives regarding improvement of ERP implementation process. In the final thesis theoretical aspects of information technologies (IT) and change type projects’ are addressed, reviewed their relation in regards of ERP implementation. Findings show that striving for ERP implementation success we need to take into account characteristics and peculiarities of both IT and change projects’ and assess success factors of both project types. ▼ Acceptance of information technology (IT) has remained a topic of interest for a last few decades. Several theories, specifically over the conceptualisation of the technology acceptance model (TAM) have emerged and they have been applied in different contexts to investigate new insights into the acceptance behaviour at individual and organisational levels. However, despite TAM’s maturity and validity in different contexts, very little published literature strives to extend its capability to predict individuals’ acceptance behaviour about an online banking information system (OBIS). A possible rational for this gap may be conceptualisation of the TAM under which individuals’ acceptance behaviour can only be predicted with two beliefs: perceived ease of use (PEOU) and perceived usefulness (PU). The evidence in literature shows that PU and PEOU beliefs are not sufficient; hence, they may not explain individuals’ acceptance behaviour in emerging contexts, such as online banking information systems, especially in developing economies such as Pakistan. There is therefore a need for inclusion of any additional factor that can enhance prediction of acceptance of online banking information system by potential users. Extending research on the TAM, this study developed and tested a model of OBIS acceptance. The proposed model integrated key constructs from the information systems acceptance research stream into the theoretical frame of the TAM and other theories from social psychology, such as the theory of reasoned action (TRA), theory of planned behaviour (TPB) and the TAM2. According to the proposed conceptual model, OBIS acceptance was determined by eight main factors, which included perceived usefulness, perceived ease of use, trust, technological self-efficacy, response time, output quality, accessibility, and terminology clarity. In this model, PU was hypothesised to be affected by PEOU, trust, technological self-efficacy (TSE), output quality (OQ) and response time (RT). In addition, PEOU was hypothesised to be determined by three external factors: TSE, accessibility and terminology clarity (TC). The model was tested on a sample of 353 Internet banking users in Pakistan. Using structural equation modelling with Analysis of Moment Structures (AMOS) software, data analysis showed considerable support for the extended hypothesised model. The result indicated that, in order of importance, PU, PEOU and trust explained 45.7 % of the variance in the acceptance behaviour. The trust and the TSE predicted 28.1 % of the variance in the PU. However, the hypothesised relationships between the PU and the PEOU, OQ and RT were found to be not significant. While in the PEOU, 21.8 % of the variance was predicted by the TSE, accessibility and TC. TSE was found to be a more influential determinant of the PEOU than the PU. ▼ This thesis explores antecedents of Strategic Information Systems Planning (SISP), successful outcomes of SISP and the organisational impact of successful SISP in the South Korean context. Since information systems (IS) and information technology (IT) are now an essential requirement supporting all aspects of business operations, the need for SISP is important for achieving success with IT investments and implementation. SISP helps identify organisational resources as well as considers the environmental, economic and organisational requirements for successful IT investment and implementation. SISP was introduced by Lederer and Sethi (1988), Lederer and Salmela (1996) and Salmela et al. (2000) as planning for the selection and implemention of IT in organisations, with the aim of achieving alignment of IS objectives with business objectives to sustain a competitive advantage from IT investments. Earlier studies on SISP have individually explored management issues, participation and communication of business and IT stakeholders, impact of environmental factors and SISP resources in relation to SISP success. However, to date, there has been a dearth of research that has explored SISP success factors for improving successful outcomes and the impact of SISP success in organisations. Further, earlier studies on SISP are generally from the United States of America, the United Kingdom, Australia, Singapore and Taiwan. Although the penetration of IT in South Korean organisations is high, to date there is no study on SISP in the South Korean context. Therefore, the primary objective of this study is to investigate the relationship between SISP success factors for successful outcomes and the impact of SISP success in South Korean organisations. Since none of the earlier studies on SISP were undertaken in the context of South Korea, a qualitative research via interviews, with four business managers and four IT managers in South Korean organisations, was undertaken to establish if success factors of SISP identified from literature, were applicable in the South Korean context prior to the development of hypotheses and the conceptual model. The research model was constructed based on a literature analysis, interview findings and resulting hypotheses. A survey of 317 large organisations in South Korea that used SISP for IT investment and implementation was undertaken to understand SISP success factors, outcomes and the organisational impact of SISP in this context. The survey data was analysed utilising a Structural Equation Modelling (SEM) technique, and the analysis of data confirmed 15 of 19 hypotheses. Research findings suggest that SISP success factors in the South Korean context include top management participation and support, effective communication and knowledge sharing between business and IT stakeholders, the impact of internal and external environment, adequate resources for SISP and inclusion of IS vendors in the SISP process. ▼ Käibekohustused on inimeste kooseksisteerimise ohutuse tagamiseks kohtupraktika kaudu loodud käitumisreeglid. Erinevaid mõiste määratlusi summeerides võib öelda, et käibekohustus tähendab deliktiõiguses arusaamist, et isikul, kes loob ohu või kontrollib ohtlikku olukorda ja laseb ohul kesta, lasub kohustus võtta kasutusele kõik mõistlikult vajalikud ja sobilikud meetmed, et kaitsta teisi isikuid ja nende õigusi ohu realiseerumise eest. Käibekohustuste kontseptsioonil tuginev vastutus asub seaduse poolt kohtute reguleerida jäetud õiguskaitse alas ja seepärast sõltub see, kas käibekohustus esineb ja milline on käibekohustuse konkreetne sisu, eeskätt kohtute poolt oluliseks peetud eesmärgipüstitusest. Üldiste eeldustena ohtude vältimise püüdluste osas, mis kehtivad olenemata üksikjuhtumi spetsiifikast, on eriline tähtsus ähvardava kahju raskusastmel, kahju tekkimise tõenäosusel ning ressursi suurusel, mis on vajalik ohu vältimiseks või kõrvaldamiseks. Kuigi käibekohustuste rikkumisel põhinev vastutus on Eesti deliktiõiguse orgaaniline osa, on see kohtupraktika nappuse tõttu autori hinnangul täna ähmane ja varjatud. Eesti situatsiooni arvestades vääriks kaalumist mõte koondada käibekohustuste kehtestamisel arvestatavad üldised kriteeriumid õigusnormidesse, mis määratleks praegusest hea usu põhimõtte regulatsioonist veidi täpsemalt üldise käitumisstandardi ning selgesõnaliselt ka kohustuse kaitsta teatud juhtudel aktiivselt tegutsedes teisi isikuid kahju tekkimise eest. Eeskujuks selliste sätete sõnastamisel Eesti õiguses võiks olla PETL-i artiklites 4:102 ja 4:103 sätestatu. Lisaks objektiivse käitumisstandardi täpsustamise võimalustele vääriks käibekohustustel põhineva vastutuse seisukohast läbimõtlemist ka delikti üldkoosseisul põhineva vastutuse aluseid reguleerivad kehtivad seadusesätted. Käibekohustuse rikkumisel põhineva kaasuse lahendamisel tuleb erinevalt BGB eeskujul põhinevast meetodiõpetusest VÕS § 1050 lg-s 1 sätestatud üldreegli kohaselt käibekohustuste rikkumist kui välist hooletust eeldada. Sellise lähenemise peamisteks eelisteks on kannatanult negatiivse asjaolu tõendamise koormise äravõtmine, tõendamiskoormise panemine menetluspoolele, kelle sisesfääri tõendamist vajavad faktid kuuluvad, lihtsus kohtumenetluses, usaldusväärsemad tõendid ning preventiivne mõju käibekohustuste rikkumistele.

By summarising different definitions, the duty to maintain safety in tort law means the understanding that the person, who creates a danger or controls a dangerous situation and allows the danger to persist, is required to employ all reasonably necessary and appropriate measures in order to protect other persons and their rights against the realisation of danger. As regards the attempts to avoid risks the general assumptions, which apply irrespective of the specific facts of an individual case, three key criteria are especially relevant: the degree of severity of potential damage, likelihood of damage, and the resources needed to prevent or remove the risk. Although liability based on violations of the duties to maintain safety is an organic part of Estonian tort law, it is still quite vague and hidden due to scarcity of case law. It would therefore be worth considering of setting out legal provisions so as to better perceive the possibility of liability based on such a duties. Bunching together general citeria that compose the objective standard of conduct would help to provide such a ground and relevant regulation contained in Articles 4:102 and 4:103 of the PETL may serve as an example. In addition to the clarification of an objective standard of conduct, the current legal provisions constructing the bases of liability based on the general composition of delict should also be specified from the same perspective. Unlike the methodological teaching modelled in the BGB, in solving cases based on violation of the duty to maintain safety by Estonian law, a presumption of the violation the duty must be applied to keep in accordance with the general rule provided in §1050 (1) of the LOA. The main advantages of this approach are that the burden of proving a negative fact is removed from the injured party and the burden is placed on the party to the procedure in whose internal sphere the facts needing proof are found; simplicity of the court procedure; more reliable evidence; and preventive impact on the violation of the duties to maintain safety.

Mestrado em Sistemas Integrados de Apoio à Decisão

O objectivo principal deste trabalho é propor um modelo de gestão de benefícios que possa ser utilizado na organização em estudo. Neste estudo foi feito um levantamento das principais metodologias de gestão de benefícios e analisadas as suas características. Do conjunto de metodologias foram seleccionadas duas para serem analisadas em maior detalhe e posteriormente comparadas. Este comparativo teve como principal finalidade resumir um conjunto de factores seleccionados por uma organização como preponderantes para a adopção da metodologia. Posteriormente foram atribuídas importâncias a estes factores e elaborada uma avaliação para apurar qual destas abordagens seria mais adequada para a organização. A abordagem mais bem classificada neste sistema de avaliação foi aplicada no estudo de caso, e concluiu-se que é possível identificar, medir e gerir os reais benefícios no referido projecto, e ainda que a abordagem de gestão de benefícios seleccionada, se enquadra no contexto da organização em estudo.

The main goal of this study is to propose a benefits management model that can be used in the studied organization. In this study some benefits managements approaches were identified and analysed. From the group of methodologies identified, two were selected to be thoroughly analysed and compared. The main goal of this comparison is to gather a group of factors used by an organization, to help chose the correct approach. Later, some importance has been attributed to the factors previously mentioned, and elaborated an evaluation to select which of these approaches would be adjusted for the organization. The approach that got the higher mark in this evaluation system was used in this case study, and concluded that it is possible to measure and to manage the real benefits in related project, and the selected benefits management approach, fits in the context of the organization in study.

O resultado dos investimentos em SI/TI é normalmente aferido com base nos factores de sucesso associados à conclusão do projeto. Contrariamente ao que seria de esperar, o sucesso não é medido pelo valor acrescentado gerado pelo negócio em consequência das mudanças introduzidas pelo projeto de SI/TI. Estes factos levam a que os investimentos efectuados na área de SI/TI não sejam muitas das vezes percebidos e esta área seja vista como um simples centro de custo. A Gestão de Benefícios surge como resposta à necessidade de compreender e gerir o retorno de investimentos em SI/TI, assegurando que estes são governados pelas necessidades dos stakeholders e que estes investimentos estão alinhados com a estratégia da organização. Este trabalho faz uma avaliação quanto ao grau de aplicação do processo de gestão de benefícios na realização de investimentos em SI/TI. O estudo realizado a diversas organizações em Portugal, tem por base um questionário efectuado a indivíduos com responsabilidade na definição, gestão e realização de investimentos em SI/TI.

IS/IT investment results are usually measured based on the factors associated with successful project completion. Contrary to what we would expect, success is not measured by the value generated by the business as a result of changes introduced by IS/IT project. As a consequence, investments made in IS/IT are not perceived and the area is frequently seen as a simple cost center. Benefits Management was created in order to understand and manage the return on IS/IT investments, ensuring that they are governed by the needs of stakeholders and that investments are aligned with the organization strategy. This work assesses the current state of practice in managing benefits from IS/TI investments. The study performed to several organization in Portugal, is based on a survey conducted to individuals with responsibility in the definition and management of investments in IS/IT.

▼ African medical professionals' migration constitutes one of the greatest economic, social and political issues that affect the African continent today. This issue of African medical professionals' migration always creates debate among political leaders, migration specialists, and other specialists regarding economic development in Africa.This study addresses the brain drain of African medical professionals' migration to Western countries. To understand and to address this issue, the push/pull factors, including economic, political, social and administrative from both the sending African and the receiving Western migrant countries are examnied. Through a secondary data analysis, we are able to analyze data regarding the number of medical professionals who are leaving Africa and the number of those who are staying in the continent. The number of medical schools that train medical professionals is also examined. With a population of more than 900 million people, Africa has only 159 medical schools that are not able to train maximum number of people to face Africa's health needs. Though the numbers of medical professionals who migrate vary from one African country to another, a general desire to get jobs, access to education, housing and opportunity of promotion are among the common motivations for these medical professionals to migrate. African countries' migration policies or the absence of any policy and the Western receiving countries' migration policies have also demonstrated the importance of the mass exodus from Africa. These two policies create more motivations to migrate from Africa, Though this analysis encounters many obstacles including a great paucity of data from Africa and low publications regarding data including the number of medical students in each African medical school. Lastly, topics for future research are suggested as well as the collection of reliable data from Africa on this issue. The brain drain of African medical professionals continues to impact African health and its development. There are both economic and health considerations which can still operate against Africa's interest for any further economic, social and political development in the near future. Despite the monetary benefit from migration, Africa is still facing many hurdles regarding its healthcare system and its delivery. Advisors/Committee Members: Cox, Raymond III (Advisor).

Detta projekt har haft som syfte att producera och grafiskt formge det kommande numret av tidskriftsapplikationen Scandinavian Architectural Review för förlaget It Is Media Svenska AB i Stockholm. Skapandet har utgått från applikationens tidigare grafiska profil och har ämnat att följa tidigare utseende och funktioner utan nya tillägg. Hela produktionen har skapats genom Adobe InDesigns tilläggstjänst Adobe Digital Publishing Suite. Efter att produktionen färdigställts har en analys gjorts av den färdiga applikationen enligt en heuristisk utvärdering ur ett människa-datorinteraktionsperspektiv, till vilken David Benyons tolv designprinciper har tillämpats. Till stöd i analysarbetet har ett aktivitetsdiagram skapats för att ge en god överblick över hela tidskriftens disposition. Analysen har slutligen resulterat i en åtgärdslista med förslag på förbättringar av applikationen för att öka dess användarvänlighet, vilket framför allt har lyft fram behovet av tydligare grafisk design av interaktiva element, ett förbättrat system för att ge användaren återkoppling samt ökad konsekvens och flexibilitet.

This project has aimed to produce and design the upcoming edition of the magazine application Scandinavian Architectural Review for the publisher It Is Media Svenska AB in Stockholm. The production has been based on the application’s prior graphic profile and has intended to follow previous appearance and functions without new additions. The entire production has been created using the Adobe InDesign plugin Adobe Digital Publishing Suite. After the production was finished an analysis of the completed application was performed according to a heuristic evaluation, which was based on the twelve design principles of David Benyon in a perspective of human-computer interaction. To support the analytical work an activity diagram was created to get a comprehensive view of the entire disposition of the application. The analysis has resulted in a list of actions and suggestions to improve the application and its usability, which particularly emphasize the need of a clearer design of the interactive elements, an improved system to give the user feedback as well as an increased consistency and flexibility.
