O recrutamento e a seleção de magistrados é um dos pontos cruciais na configuração da dinâmica judicial brasileira e na consolidação do Judiciário como instituição democrática e, assim, adquirem destaque em vários países preocupados com o aprimoramento da Justiça, mas não se trata apenas de escolher juízes de maneira competitiva e isonômica, e sim definir o tipo de juiz que o país deseja. O objetivo desta tese é avaliar a adequação do modelo de recrutamento e seleção de juízes brasileiros em comparação ao modelo francês. Buscou-se investigar os debates a respeito das políticas de justiça no Brasil e na França, associados à importância das sociedades democráticas contemporâneas ao Judiciário, às mudanças socioeconômicas e ao novo contexto social e de exercício das funções judiciais em ambos os países comparados. A pesquisa realizada foi qualitativa, e os dados coletados foram organizados a partir de pesquisa bibliográfica e documental e analisados por meio do método comparativo. A análise comparativa desenvolvida evidenciou que o Judiciário brasileiro não superará desafios impostos pelo atual contexto se não rever, para melhorar, seu modelo de recrutamento e seleção de juízes. Evidenciou-se a necessidade de adequá-lo a partir da centralização em um único órgão responsável pela construção do perfil de juiz, da construção de matrizes de competências para mapear os saberes, habilidades e atitudes que devem compor o ethos da magistratura, além do método mais adequado para selecionar magistrados. Portanto, a experiência da França poderá influenciar a política nacional de recrutamento e seleção de juízes no Brasil desde que seja adaptada à realidade brasileira, aprimorando-se o sistema de maneira que possa ser capaz de responder ao redimensionamento do papel do Poder Judiciário contemporâneo.

The recruitment and selection of magistrates is one of the crucial points in the configuration of Brazilian judicial dynamics and in the consolidation of the Judiciary as a democratic institution and, thus, gain prominence in several countries concerned with the improvement of Justice, but it is not just about choosing judges in a competitive and isonomic way, but to define the type of judge the country wants. The purpose of this thesis is to evaluate the adequacy of the Brazilian judges’ recruitment and selection model in comparison to the French model. It was intended to investigate the debates regarding justice policies in Brazil and France, associated with the importance of contemporary democratic societies to the Judiciary, socioeconomic changes and the new social and practical context of judicial functions in both countries. The research carried out was qualitative, and the data collected were organized based on bibliographic and documentary research, and analyzed using the comparative method. O presente artigo tem como objeto as dinâmicas geradas pelos modelos de recrutamento empregados nas Supremas Cortes da Argentina e do Chile. Sendo tais modelos antagônicos, visto que na Argentina o recrutamento se dá por indicação presidencial, enquanto no Chile se configura uma cooptação indireta, busca-se compreender qual é o papel que assumem na institucionalização, hierarquização e independência dos poderes judiciais em questão. Parte-se da hipótese que o recrutamento por indicação presidencial estabeleceu na Argentina uma elite judicial integrada ao desenvolvimento sociopolítico do país, apesar de ter facilitado o cerceamento à independência do Judiciário pelo Executivo. Já a cooptação chilena, ainda que tenha assegurado a independência judicial, incentivou a formação de uma elite com traços aristocráticos, autocentrada e que dificulta a renovação da interpretação judicial, deixando o Judiciário anacrônico. A hipótese do presente artigo será sustentada através da apresentação de um panorama histórico-estrutural da institucionalização dos judiciários em questão, observando o efeito dos modelos de recrutamento adotados, e das disputas para defini-los, em sua hierarquização e independência. Também se recorrerá ao método prosopográfico para aprofundar a apreensão da relação entre os padrões de recrutamento das Corte Suprema e a evolução do poder judicial.

This article has as object the dynamics generated by the models of recruitment employed by Supreme Courts in Argentina and Chile. Once these models are antagonistic, since in Argentina's recruitment happens through presidential appointment, while in Chile, it is a result from indirect cooptation, this paper is sought to understand the role they play in the institutionalization, hierarchization and independence of the referred judicial powers. The main hypothesis points out the recruitment by presidential appointment, established in Argentina, has generated an attentive and integrated judicial elite, concerned to the socio-political development of the country, despite having facilitated the retrenchment of the Judiciary independence by the Executive. On the other hand, Chilean cooptation, although it has ensured judicial independence, encouraged the formation of an elite with aristocratic traits, self-centered and reluctant in renewing judicial interpretation, leaving the Judiciary anachronistic. The hypothesis of this article will be sustained by the presentation of a historical-structural overview of the institutionalization of the both judiciaries, observing the effect of the recruitment models adopted, and the disputes to define them, in their hierarchization and independence. The prosopographic method will also be used to deepen the understanding of the relationship between the Supreme Court's recruitment patterns and the evolution of the judiciary.

The selection of judges is a well researched area of judicial politics. However, there is a gap in the literature when it comes to explaining why some lawyers decide to seek judgeships and others do not. Some lawyers are born to be judges; they are arbitrators by nature and inclination or they have specific ideas about justice and how best to achieve it. Others may never have considered a career on the bench if not for the urging of friends, family, and party members. In contrast, there are lawyers who would love to be judges, who have the drive and ambition, but who, for whatever reason, never pursue the matter. However, not all lawyers who have an interest in serving choose to make the effort to achieve their ambitions. I would like to learn what encourages them and what deters them when they are deciding whether or not to make a run for office. The data for this study were gathered using a mail survey sent out to 1500 members of the Ohio legal community in June, 2002. The respondents were selected by random computer draw from the Ohio State Supreme Court’s lawyer registry, which lists all lawyers practicing in Ohio. The survey consisted of a single mailing with no follow-ups or reminders. Of the 1500 respondents, 655 individuals completed and returned the surveys and sixty two (about 4%) were returned as undeliverable. This gave a response rate of 43.67%. I have developed several hypotheses concerning the ways in which lawyers weigh the costs and benefits of running for judicial office. These hypotheses are divided into two basic categories dealing with internal motivations and politics. Variables of internal motivation are those that relate to career choices, job satisfaction, family life, age, and a lawyer’s current position. Political variables deal with the influence of politics on the lawyer’s choices, whether it is the political identification of the members of the lawyer’s community, the degree to which each person is politically active, or the degree to which his family was involved in politics.
