▼ Tanrı’nın varlığı meselesi, genel felsefenin ve din felsefesinin en önemli problemlerinden biridir. Problemin önemine binaen, konuyla ilgili pek çok tartışma gündeme gelmiştir ve özellikle teistik gelenekler Tanrı’nın varlığını desteklemek üzere, teleolojik argüman gibi çok sayıda argüman ileri sürmüştür. Teleolojik argüman doğadaki düzene, amaçlılığa ve de insanla doğa arasındaki uyuma dayanmaktadır.Zamanla teleolojik argüman/tasarım argümanları bilimsel gelişmelere ve argümana yöneltilen eleştirilere bağlı olarak çeşitli değişikliklere uğramıştır. İnce-ayar argümanı, evrenin bir bütün olarak ince-ayarlanmış parametrelerine dikkat çeken, tasarım argümanının yeni versiyonlardan biridir.Bu çalışmada, ince-ayar argümanını destekleyen ve argümana muhalif olan filozof ve bilim adamlarının iddialarına yer verip, argümanın Tanrı’nın varlığı lehine güçlü bir argüman olup olmadığını göstermeye çalıştık.AbstaractThe existence of God is central to philosophy of religion if not to philosophy in general. Considering the importance of the problem, there has been significant dispute on it and especially theistic traditions have offered many arguments for the existence of God, such as the teleological argument. Teleological argument is based on order and purposefulness in nature or universe and harmony between human beings and nature.By time, teleological arguments/design arguments have undergone some changes related to the scientific developments and various criticisms have been directed to it. Fine-tuning argument is one of new versions of the family of teleological arguments as it taken the finely tuned parametres of the cosmos as a whole into consideration.In this work we’ve tried to examine the claims of supporters and opponents of fine-tuning argument and to demonstrate whether it is a good argument for the existence of God.

I. Bölümde dinlerde kurtarıcı fikri ve temelleri üzerinde durduk Bütün dinlerde farklı isimlendirmelerle de olsa bulunan kurtarıcı fikrini ayrı başlıklar alanda inceledik Klasik İslam Mezheple/indeki mehdi inananı açıkladık Bölüm sonunda kurtarıcı beklentisinin psiko-sosyal ve siyasi sebepleri üzerinde durduk II.Bölümde Müslümanlar arasındaki mehdilikle ilgili tezahürleri ortaya koymaya çalıştık Mehdi kelimesinin ilk defa kimler için kullanıldığım ve bunların kullanılma sebeplerini araştırdık Mehdi olarak nitelendirilen şahısların bu fikirlerle irtibatının olup olmadığını,mevcut kaynaklar ışığında tespit etmeye gayret gösterdik Müslümanlar arasında onları,içinde yaşadıkları dönemdeki sıkınalardan kurtaracak biri yada zamanla geleceği umulan kişi olarak değişik Mehdi anlayışları hakim olmuştur. Her gurup veya kişi tarafından bu kavrama farklı anlamlar yüklenmiştir. Bu durum her toplumun sosyolojik ve psikolojik yapısı ile bağlanan bir gelişme göstermiştir. Günümüzde de farklı coğrafyalarda Mehdi olduğunu iddia eden kişilere rastlamak mümkündür. Bu tür iddiaların dini yönden geçerli olup olmadığını ancak kaynakların incelenmesi sonucu tespit edebiliriz. Abstract Our study cone hides an introduction and two seperate chapters. We gave information concerning methods and bibliography to be used in our search, and explained the word "Mahdi" both lexically and terminologicaUy. In me first chapter, we emphasized on the idea of a rescuer in religions and its foundations. We examined the idea of rescuing, vhich axists in every religion though with a different name, under separated tides. We explained the Mahdi belief in the classical Muslim sects. We emphasized on psyco-social and political reasons for the expactation of rescuer. In the second chapter, we tried to state clearly the manifestations among Muslims comcerning the Mahdi belief. We searched for whom the word "Mahdi" was used for the first time, and the reasons of this. We also tried to determine whether there has been a relation between the persons who was given the name "Mahdi" with mis idea under the light of the existing bibliography. Among Muslims, some "Mahdi" related ideas have occured, which concorned a "coming man" to rescue Muslims from their existing problems, whether early or late. Each group or person have put a different development according to sociological and psychological settling of each society. Today it is still possible to see some some persons in different parts of the world claiming mat he is Mahdi. We may state whether or not this claims are true for religous concerns if only we examine the bibliography.

Economic Life), a conclusion and an additional.With the conquests, Muslims have become the administrator of theByzantine and Sassanian Empire’s territory. This situation has led to the spreadof Islam and Arab culture in the conquered lands. Egypt conquered during thecaliphate of Hz. Umar is one of the places where lived this experience first. Inthis thesis, From the Arab Conquest to the End of the Umayyad Period Egypt’ssociety, socio-culturel and economic life were analysed and attempted to identifyimportant changes.In the introduction, the historical process starting from Ancient Egyptuntil the end of Umayyad period is summarized. The first chapter surveys thesocial structure formed with the coming of the Arabs. In the second chapter,information are given about factors of the socio-cultural life such as home,clothing and finery, religious holidays and festivals. At last, in the third chapteris depicted in economic life.

Giriş bölümünde, kötülüğün, antiteistler tarafından iyicil ve kadir-i mutlak bir Tanrının varlığıyla onun varlığı arasında çelişki bulunduğu varsayımıyla, metafizik! açıdan ciddi bir problem olarak görülmesinin kelamcılar açısından önemine işaret ettik. Birinci Bölüm'de, kötülüğü genel olarak değerlendirdik. Burada, antiteistlerin tezlerinin en kısa ve genel anlamıyla, kötülüğün varlığıyla iyicil ve kadir-i mutlak bir Tanrının varlığı arasında çelişki bulunduğu iddiasına dayandığını, testlerin ise, buna, kötülüğün ontolojik bir gerçekliğinin bulunmadığı, kötülüğün sadece iyiliğin eksikliğinden ibaret olduğu, Tanrının, mümkün olan dünyaların en iyisini yarattığı ve nihayet, kötülüğün özgürce yaşanan bir dünyada kaçınılmaz olduğu gibi antitezlerle karşılık verdiğini gördük. İkinci Bölüm'de "Metafizikî (Tabiî) Kötülük" problemini İslam Kelamı açısından değerlendirdik. Bu konuyu incelerken, İslam kelamcılarının, Allah'ın hikmetli ve adil olup olmadığını değil, kötülüklerin ilahî irade ve kudretle ilintilendirilmesinin ilahî adalet ve hikmete zarar verip ermediğini tartışlıklarına ve onlar arasındaki bütün ihtilafların. bunun izahına ilişkin bakış açılarının farklılığından kaynaklandığına şahit olduk. Üçüncü Bölüm'de ise, "Ahlakî Kötülük Problemi"ni ele aldık ve bu esnada Mu 't ezile ve Zeydiyye hariç insan fiillerinin sürekli olarak ilahî ilim, irade ve kudretle ilintilendirildiğini, dolayısıyla insanın özgürlüğü ve sorumluluğu sorununun çıkmaza sokulduğunu gözlemledik. Abstract My dissertation consists of third chapters excluding the introduction. In the introduction I've pointed to the importance for the theologians that the evil is a big problem, because of the evil is being accepted as a metaphysical problem by anti-theists, with the hypothesis that there is a contradiction between the existence of God and the existence of evil. In the first chapter, I've studied the evil generally. Here, I've realised that the thesis of anti-theists, shortly and in a general meaning, had based on the assertion that there is a contradiction between the existence of a benevolent and almighty God and the existence of evil, on the other hand, the theists had opposed it with like these antithesis; there isn't a ontological reality of evil and the evil is the deficiency of good and God had created the most perfect world from among the worlds which is possible and finally, the evil is unavoidable in the world where is lived freely. In the second chapter, I've tackled the Problem of the Metaphysical (natural) Evil in the Islamic Theology. While I was analysing the metaphysical evil, I've realised that the Islamic theologians hadn't dealed with whether God had had wisdom and just, but whether the connection of evils with the divine will and power is damaging the divine just and wisdom or not and all differences among them had arisen from the different point of view about the explanation of it. ▼ Şeyh Nazım-ı Kıbrısî, 23 Nisan 1340/1922’de Larnaka, Kıbrıs’ta dünyaya gelmiştir. Baba tarafı, Şeyh Abdülkadir Geylanî’ye, dolayısıyla Hz. Peygamber(sav)’e dayanan Kıbrısî’nin, anne tarafı Mevlana Celalettin Rumî’ye dayanmaktadır.Nazım-ı Kıbrısî ilkokula 1928 yılında başlamış, 1359/1940 senesinde liseyi bitirerek İstanbul Üniversitesi Kimya Fakültesi’ne kayıt olmuştur. Üniversite eğitimi esnasında, manevî ilimlerle meşgul olmuş ve Şeyh Süleyman Erzurumî’den (v.1368/1948) tasavvuf terbiyesi almıştır. Bu dönemde yaşadığı bir manevi tecrübe üzerine, maddi ilimlerdeki eğitim hayatını bırakıp, manevi ilimlerdeki terbiyesi için Suriye, Şam’a gitmiş ve orada Şeyh Abdullah-ı Dağıstanî’ye intisab etmiştir. Kıbrısî, şeyhiyle buluştuğu ilk günün sonunda, Kıbrıs’taki irşad vazifesiyle görevlendirilmiştir. Şeyh Nazım-ı Kıbrısî 1952’de, Şeyh Abdullah-ı Dağıstanî’nin mürîdlerinden Hacı Âmine Hanımefendi ile evlenmiştir. Şeyh Nazım’ın bu evlilikten iki oğlu ve iki kızı dünyaya gelmiştir.Tasavvuf Sohbetleri, Hak Dost Sohbetleri, Ebediyete Davet, Cuma Hutbeleri, Şeyh Nazım’ın sohbet ve hutbelerinden derlenmiş eserlerdir. “Câmiu’l-irşâduş-şerîf”, Lübnan’da yaptığı sohbetlerden derlenmiş, “Mürîdin El Kitabı (Hand Book of Mureed)”, mürîdler için telkin edilen zikir ve tesbihatın derlendiği eserlerdir. Bunların haricinde, “Mercy Ocean (Rahmet Deryası)”, Şeyh Abdullah’ın sohbetlerinden, derlenmiştir.Şeyh Nazım, 1974’ten itibaren Avrupa’yı, 1978’den beri Türkiye’yi, 1986’dan beri Uzak Doğuyu, 1991’den itibaren ABD’yi ziyaret ederek iman nurunu her çeşit insana yaymaya gayret etmiştir. Hâlidiyye-i Hakkâniyye’nin Avrupa, Amerika, Asya ve Afrika kıtalarına yayılması, Şeyh Nazım’ın irşad vazifesini Şeyh Abdullah-ı Dağıstanî’den almasından sonra başlamıştır.Şeyh Nazım’a göre bu hizmetin başarısı, kendisinin yaptığı işlerden dolayı değil, Şeyhinin kendisine verdiği manevi destekden dolayıdır. Zira bu vazife, şeyhi Abdullah-ı Dağıstanî dünyaya geldiğinde, Şeyh Şerafeddin tarafından bildirilmiştir. Bu rivayet, Şeyh Nazım’ın tasavvuf anlayışının bir cüz’ünü teşkil etmektedir. Çünkü bu tür vazifeler, Peygamber varisleri olan evliyaya, yevmu’l-ezelde tevdi edilmiştir. Söz konusu vazife, Allah’ın Nûrunun tamamlanacağı güne kadar devam edecektir. Kıbrısî’nin velayet ilmi olarak tanımladığı söz konusu malumaltları, irşad ehli bilir ve ehline aktarır. Bu manada Kıbrısî’nin Mehdi anlayışı, Mehdi’nin beklelenen en son irşad ehli addedilmesi hasebiyle, Kıbrısî’nin tasavvuf anlayışında belirleyici bir mevzu olmuştur. Kıbrısî’nin Mehdi anlayışı, İslamî metinlerde verilen haberlerin yanısıra, şeyhinden tevarüs eden ve bireysel olarak yaşanan manevi tecrübelerden müterakibtir. Başlıca üç bölüme ayrılan çalışmanın giriş kısmında konunun önemi, amacı, yöntemi ve planının izahı yanında, konuya hazırlık amacıyla çeşitli bilim dalları ve kültür çevrelerinde şimdiye kadar yapılan din tanımlarının genel bir değerlendirmesini yaptık. Ayrıca Kur'an'ın indiği dönemde Arap yarımadasındaki din anlayışı ve dini gruplar hakkında kısa izahlarda bulunduk. Semantik ağırlıklı olan birinci bölümde önce din kelimesinin Arapçadaki anlamları üzerinde durup, ardından bu kelimenin Kur'an'da lügat anlamı ve kavramsal kullanımlarını ele aldık. Dilsel açıdan iki obje arasında karşılıklı ilişki düzleminde ele alman dinin kavramsal olarak vahye dayanan ve dayanmayan bütün dini oluşumları içeren geniş bir çerçeveyi kapsadığı ortaya çıkmıştır. İkinci bölümde, Kur'an'da din kavramının anlam alanına giren millet, ümmet, hanif, şeriat ve islam kavramlarını ve bunların din ile ilişkilerini inceledik. Üçüncü bölümde ise, dinin kaynağı, başlangıcı, tamamlanması ve gayesi gibi bazı konuları açıkladıktan sonra, Kur'an'ın ortaya koyduğu din anlayışını teorik ve pratik açıdan etraflıca inceledik. Ayrıca her üç bölümde konların daha iyi anlaşılması için ortaya çıkan sonuçları tablolar halinde gösterdik. Tez, kendimize ait din tanımı dahil ulaştığımız genel sonuçların özeti ile sonuçlanmaktadır. Abstract In the work entitled "The Concept of Religion in the Quran", we have attempted to find an answer to the question of what the religion is from the view-point of the Quran. In the said work, composed of three chapters, we have underlined the importance, purpose, method and plan of the subject - matter at the outset and made a general valuation of the definitions of RELIGION made in different cultural milieus and in various fields of science as a preparatory work. We have also added brief remarks concerning the understanding of religion reigning in the Arap peninsula at the / time of the revelation of the Quran as well as concerning religious groups. In the first chapter, in which semantics has been given priority, we have dwelt upon the various meanings of the term of RELIGION in Arabic, then dealt with the literal meaning of the word in the Quran and with conceptual employments of it. It has been found out that the RELIGION, treated on the plane of reciprocal relations of two objects in respect of language, encompasses all religious phenomena based on revelation or not. In the second chapter, MILLAH, UMMAH KAHANIF (seeker of true religion) SHARIAH and ISLAM have been discussed with a view to relations to the religion. ▼ Cette thèse s’attache à comprendre les attentes
façonnant les perceptions de la vie de couple en Égypte et des
normes la régissant. Le rapport à la parole sur l’amour et le sexe
offre le fil rouge de cette recherche. L’étude du champ de la
psychologie et de la sexologie dans le pays révèle en effet une
rhétorique du bris de silence omniprésente, renvoyant à la quête
d’un monopole sur le discours légitime sur la sexualité. Or, des
répertoires discursifs concurrents à cette expertise sont présents,
notamment ceux se référant à l’
islam, mais aussi ceux s’exprimant
entre amis au sein de conversations quotidiennes prenant l’amour et
le sexe comme objets. L’application alternativement du qualificatif
de « traditionnel » ou non à certaines unions et la corrélation
entre progrès et l’expression de l’intimité par la parole au sein
du couple qui s’établit offre une clé de compréhension importante
des catégorisations à l’œuvre. La réception de la St Valentin au
Caire et sa mise en perspective avec la lutte contre le harcèlement
sexuel met en lumière la pluralité des vecteurs de celles-ci :
l’une articule en effet vie de couple et commerce d’objets de
consommation, tandis que la seconde aboutit à l’exigence militante
de droits. L’ethnographie d’un centre de conseil psychologique
permet enfin de mieux saisir la complexité des reformulations de
l’expression de soi au sein du couple et les négociations
nécessaires pour parvenir à en faire circuler les modèles. Amour et
sexe s’articulent en effet autour différents ordres de vérité,
référés à la religion, à la science ou à la notion de progrès
(taqaddum) et ouvrent le champ de multiples possibles par les
combinaisons qu’ils permettent.

This dissertation examines the Khalwatiah Sammān Sufi brotherhood (tarekat) in South Sulawesi, Indonesia, and attempts to explain the reason for its continuing success since its origins in the first half of the nineteenth century. A major reason, I contend, is the very close relationship that is maintained between its leaders (Shaikh, Murshīd, Khalīfah) and its followers (sanakmangaji) through the legitimization of the authority of the former via Islamic spiritual ideas (taṣawwuf). The emergence of this tarekat was the result of the confluence in the nineteenth century of two important developments: the expansion of European colonialism in Muslim lands around the world, and the rise of the puritanical Wahabi movement centered in the heartland of Islam.
The links between the Islamic heartland and the Malay-Indonesian archipelago grew stronger in this period, as religious discourses, particularly Sufism, became increasingly influential in the ummah, or community of believers, "below the winds." The Khalwatiah Sammān tarekat in South Sulawesi appealed far more to the commoners than the elite. Its eclectic religious perspective, though opposed by the orthodox modernist and traditional streams of Islam, was in fact a reason for its attraction among the ordinary people. One of its appeals is the practice of reciting the zikir (dzikr al-Jahri) as a congregation, rather than performing a private silent zikir as is done by other tarekats. Challenged by the two Islamic mainstreams – global Wahabism and local orthodoxy – the Khalawatiah Sammān responded by creating a tarekat that succeeded in demonstrating its legitimacy and orthodoxy through its scholarly leaders and their links to important Islamic teachers in Mecca and Medina, the Ḥaramayn. One of the major conclusions of this study is that Islam is not monolithic, and that groups such as the Khalwatiah Sammān demonstrate the dynamism of Islam in all its different cultural manifestations.

This dissertation examines the localization of Islam in the late nineteenth and twentieth centuries in the northern coastal areas of Java, Indonesia. It focuses on a unique type of Islamic texts, Kitab Pegon, which are books on Islam in the Javanese language using Arabic script. Written by local ulama (religious scholars), Pegon books discuss various branches of Islamic knowledge. Their intended audience is commoners, and therefore they were composed in the vernacular language employing the lower stratified Javanese, ngoko. An assessment on this type of sources reveals that despite their adoption of local cultures and ideas, their contents conformed to Sunni orthodox teachings.
Muhammad Salih Darat (1820-1903 CE) paved the way for the popularity of Pegon Islamic texts in Java. Differentiating between the universality of Islam and locality of Arabic, Salih defended the authority of Pegon books and argued that they provided no less significant role than Arabic ones in advancing Islamic knowledge among Muslims. Based on this argument, Salih employed Javanese terms and concepts for explaining Islamic tenets in order to make them more intelligible among commoners. This practice has been followed by many Javanese ulama in the twentieth century.
The introduction of Pegon Islamic texts and their availability in great quantity due to the adoption of print technology have contributed significantly to the increasing Islamic orthodoxy among the Javanese people. Having learned to read the Qur'an at an early age, the Javanese were usually familiar with the Arabic script, which greatly facilitated their ability to read Pegon texts. The Pegon texts also proved useful for local ulama who continue to teach Islamic knowledge to ordinary adults at prayer houses and mosques.
Contrary to the widely-held belief that Javanese Islam was syncretic and heavily influenced by pre-Islamic ideas, this dissertation argues that orthodox ideas had been present since the sixteenth century and became increasingly prominent since the nineteenth century as a result of the publication of Islamic texts in Pegon. This dissertation hopefully contributes to debates on the localization of world religions, by providing a case study in which orthodoxy was clearly maintained within a process of localization.

▼ Yol gösteren, doğru yola ve doğru sonuca ulaştıran, kendisiyle kanıtlamanın gerçekleştiği şey anlamlarına gelen delil düşünce dünyamızın önemli kavramlardan bir tanesidir. Hak ile batılı, doğru ile yanlışı ayıran delil anlamında kullanılan burhan ise hem bir Kur’an terimidir hem de kesin bilgi veren akli bir delildir. İlk bölümde delil kavramı felsefe, kelâm, usûl-ü fıkıh ve pozitif hukuk alanlarında ele alınmıştır. Felsefede şüphecilik, akılcılık ve deneycilik açısından delilin neliği konusu incelenmiştir. Mantıkta bir argümanın gücü ile delil arasındaki ilişki irdelenmiştir. Fıkıh usulünde başta Kitap, Sünnet, icma, kıyas sonra diğer tali delillerin konumu ele alınmıştır. Pozitif hukuk alanında ise delilin tanımı ve türleri incelenmiştir. İkinci bölümde burhan kavramı, Kur’an’daki yeri itibariyle incelemeye alınmıştır. Burhan ile anlam ilişkisi bulunan “beyyine”, “sultan” ve “ayet” kavramları ayetlerdeki çerçeveleri itibariyle tahlil edilmiştir. Sonrasında burhan, mantık ve kelâm içindeki konumu dolayısıyla ele alınmıştır. Burhanın üzerine inşa edildiği mantık ilkeleri açıklanmıştır. Allah’ın birliği, hudus delili ve teselsülün iptali konularını destekleyen burhanlar tetkik edilmiştir. AbstractProof is something which shows that something else is true or correct and has a place in kalam, ushul fiqh, philosophy and law. In the first chapter, the issue of proof is dealt with in philosophy, ushul fiqh, law and kalam. The epistemological framework such as the definition of proof, its nature and kinds, is examined in these fields. Finally the concept of burhan in the Qur’an, kalam and logic is discussed in Chapter II. Related concepts with burhan such as “beyyine” the clear evidence and “sultan” the clear authority and “ayet” the verse are analysed. Laws of logic which burhan based upon are explaned. Burhans supporting the uniqueness of God, “hudus” the proof of created later and “teselsül” cancellation of succession are dealt with.

THE POETICS OF EMBODIMENT IN
ISLAMIC MYSTICAL PHILOSOPHY

Thesis under the direction of Professor William Franke
What modes of reading can be provoked by reading different kinds of texts and textual practices? How might these alternative modes enable us to rethink our conception of the relationship between discourses and embodiment, and the functioning of discourse upon bodies that is identified by the notion of discursive mediation? This thesis considers texts and practices that emerged from traditions of Islamic mysticism, and that demand a transformation in the reader as a result of the way in which embodiment and discourse interact. The analyses that follow thus bring literary, religious and cultural dimensions of sufism to questions of reading. What we stand to gain from this engagement with Islamic mysticism is thus a reorientation toward texts and toward textually-mediated practices with regard to embodiment and its relationship to text.

Yetimlerin şah-siyetlerinin korunması yanında mallarının da korunması, hatta sadece korunmakla yetinilmeyip kendilerinin yararının gözetilip bununla birlikte servetlerinin de artırıl-ması için gerekli çabanın gösterilmesinin hükme bağlanmış olması İslam’ın yetimler konusunda göstermiş olduğu hassasiyetin önemini anlamamıza yardımcı olmaktadır. Çalışmamız iki bölümden oluşmaktadır. Birinci bölümde İslam Hukuku bakımın-dan yetim, mal ve hukuki himaye kavramları ele alınmıştır. Bu bağlamda öncelikle yetim, mal ve hukuki himaye kelimelerinin sözlük ve terim anlamları üzerinde durul-muş; mal çeşitleri ve mal üzerinde yapılan tasarruflar (akitler) hakkında konunun an-laşılmasına yönelik bilgiler verilmiş, ayrıca hukuki himaye hususu da hem şahsın hi-mayesi hem yetim malının himayesi konuları dikkate alınarak işlenmiştir. İkinci bölümde yetimin hukuki tasarruflarının sınırlandırılması ve korunması hu-susu işlenmiştir. Konu iki kısımda ele alınmıştır. İlk kısımda Kur’an ve Sünnet’te ye-timler ile ilgili emir ve tavsiyelere yer verilmiştir. İkinci kısımda ise velinin ve vasinin yetim ile ilgili hukuki tasarrufları işlenmiştir. Bu konu da yetimlerin şahısları ve kişi-likleri ile ilgili tasarruflar ve mal varlıkları ile ilgili tasarruflar detaylandırılarak ortaya konulmuştur.Abstract The protection of the individual assets and the assets of the orphans by Muslims appears to be an essential obligation. The fact that Islam gives great importance to the protection of the assets of the orphans besides the protection of their individuality and not just even protecting them but also protecting their interests as well as showing the necessary effort in order to increase their wealth and that these facts are decreed help us to understand the sensitivity that Islam has demonstrated for the orphans. Our study (research) consists of two sections. In the first section, the concept of being an orphan and the concept of the safeguard of assets and legal guardianship have been discussed. In this context, primarily the dictionary meaning and the termi-nological meaning of the words orphan, property and legal guardianship has been focused on; information has been provided in order to make the subject understanda-ble regarding the types of property and the covenants that have been made on the property, furthermore the subject on legal guardianship has been handled both consid-ering the issues of the protection of the individual as well as the protection of the property of the orphan. In the second section, the topic of the delimitation and protection of the legal dis-position of the orphan has been discussed. The topic has been discussed in two parts. In the first part the recommendations and orders of the Qur'an and the Sunnah regard-ing the orphans are given. ▼ This thesis argues that Christian dispensationalist theology has played a major role in promoting and sustaining the anti-Islam discourse, often referred to as Islamophobia, in the media and among the mainstream American populace. Islamophobia is best understood as an othering discourse which creates a stark "us/them" dichotomy in which Muslims represent "them." Othering is also a major component of Christian dispensationalism since it too produces an extreme dualistic worldview. Dispensationalists typically read current geo-political events into the Bible aiming to identify a group of people or region from which the Antichrist and his allies will emerge, thus providing the primary "other." The attacks of 9/11 have served as a catalyst in shifting the focus from the Soviet Union and communism to Islam and the Middle East. Since 9/11, dispensationalists have established themselves as credible "experts" and "insiders" in the media and have subsequently been instrumental in promoting anti-Islam ideology. This study examines the ways in which this has been accomplished.

▼ This project questions western hegemonic discourse about the non-western Other, specifically the Muslim woman subject, through a post-colonial critical point of view. It takes the debate on Islamic feminism, especially in North American academy as a departure point of a discussion relating that discourse to the western feminist arguments over the usefulness and nature of Islamic feminism. The project has two phases: One summarizes and discusses the Islamic feminism debate in North American academia while second takes secular feminism in contemporary Turkey as a field of study where the debates on Islamic feminism in North America resonate and are reproduced at the discursive level. The project analyzes the special volume of secular feminist journal Pazartesi on religion in order to ask whether a colonialist/orientalist discourse underpins the refusal to acknowledge Islamic feminism as a feminist endeavour for gender equality from within Islam for both the western academic community and secular feminist circles in Turkey.

▼ The current thesis is concerned with proving the theory of the inconsistency of constitutionalism and democracy with Islam, which is mainly accomplished through the analysis of the ideas of two Iranian Qajarid thinkers; i.e. Mirza Fath-Ali Akhondzadeh 1229-1295 AH /1812-1879 CE and Sheykh Fadhl-allah Kojouri Nouri 1259-1327 AH /1843-1909 CE. Despite that at the beginning, the ideas of these two appear diametrically opposed since the former was a secularist, while the latter was an Islamist; both of them finally arrived at the same conclusion that is the title of this thesis. The reason of choosing these two thinkers, who could properly be viewed as representative of both the secular and Islamic wings, was their extraordinary frankness in advancing their opinions. In order to prove my theory, through critical study of the manuscripts, lectures, documents, primary and secondary sources, I have sought to analyse: 1- the ideas of Akhondzadeh, who by imitating the West and ancient Iran, tried to present constitutionalism and democracy as the only remedy for saving the people from despotism and backwardness and also as Iran's definitive fate, while making the recommendation for retaining constitutionalism and democracy and abandoning Islam; 2- the ideas of Sheykh Fadhl-allah Nouri, who as a member of the 'ulamii demonstrated the incompatibility of constitutionalism and democracy with Islam from the viewpoint of Islamic laws, whilst believing in the necessity of preserving Islam and abandoning constitutionalism.

▼ This thesis traces the theological change in the concept of ʿisma, (the infallibility of the Prophet Muhammad in regards to receiving and communicating divine revelation) from the medieval to modern period of
Islam. In order to trace this change, this study analyzes the exegetical commentaries of Sunni and Shiʿi theologians regarding two case studies found in the Qur’an that call into question Prophetic ʿisma: the so-called Satanic Verses of Qur’an 22:52, and the so-called wife-beating verse of Qur’an 4:34. In doing so, it demonstrates the differences between Sunni and Shiʿi theological perspectives of ʿisma, and the fact that by the modern era, both Sunni and Shiʿi theologians professed ʿisma as an aspect of the Prophetic persona that must be defended. Only within the modern era do Sunni theologians begin to think of ʿisma as conceptually in line with the Shi'a, with whom the theological understanding of the concept originated, as it initially pertained to the infallibility of the Imams, and by extension, the Prophet. For the Sunnis, while in the early period it was deemed acceptable and even necessary at times to assert the fallibility of the Prophet, they could no longer do this in the modern period in light of the fact that the Shiʿi theological understanding of ʿisma had been doctrinally established and defended for some time. Posited as another potential explanation that contributed to this shift in the minds of modern Sunni Muslim scholars regarding the concept of ʿisma, the conclusion of this thesis provides a brief series of examples of how 18th-century scholars of Enlightenment Europe, such as George Sale, regularly depicted the Prophet Muhammad as an imposter, accusing him of intentionally creating a false religion. In effect, modern Muslim theologians such as Sayyid Qutb may have been both informed by, or responding to this Western/Orientalist idea of “Muhammad the Imposter,” since this notion of “Imposture” continues to be recycled and utilized within contemporary Western scholarship.

Bir insan davranışı olarak salih amel kavramı araştırmada bu bakış açısı ile çalışılmıştır. Giriş bölümünde kavram, düşünce ve dilin birbirleri ve Din Eğitimi alanı ile ilişkisi çerçevesinde araştırmanın problemi, amacı ve önemi ortaya konulmuştur. Birinci bölümde salih amelin oluşmasını sağlayan onu besleyen nedenler ve gerekçeler olarak hakikat-iman-islam-hidayet kavramları teolojik arkaplan olarak ele alınmış,ayrıca salih amel kavramının dini kavramlar içindeki yeri gösterilmiştir. İkinci bölüm salih amel kavramına ayrılmıştır. Bu bölümde salih kavramı, ilk dönemden günümüze salih amel kavramın tanımı ve anlam içeriği üzerinde durulmuştur. Salih amel kavramının kavramsal çerçevesi ise Allah-insan ve çevre ilişkileri bağlamında tasnif edilmiştir. Yine bu bölümde salih amel kavramı bilgi, içtenlik, denge,tevekkül, dua, sabır, kalıcılık, uygunluk, temizlik, yararlılık ve estetik gibi nitelikleri ile ele alınmıştır. Üçüncü ve son bölümde ise salih amel kavramı kapsam, çeşitlilikve süreklilik özellikleri ile yaşam boyu öğrenme felsefesi ile öğrenme ortamına taşınmıştır. Din eğitiminde öğrenmenin niteliği, yaşam boyu öğrenme ilkeleri ve öğrenme düzeyleri malumat-bilme anlama-duygusal-değer üretme-uygulama ve yansıtma başlıkları altında ele alınmıştır. ▼ Araştırmamızda Seyfeddin Âmidî’nin Kelâm Sisteminde Usûlü'd-dîn ve Usûlü'l-fıkh İlişkisi incelenmiştir. Tez, giriş, iki bölüm ve sonuçtan meydana gelmektedir. Girişte Usûlü'd-dîn ve Usûlü'l-fıkh ilişkisi ele alınarak, Seyfeddin Âmidî’nin bu ilimlerin neresinde durduğu ve bu ilimlere nasıl bir katkıda bulunduğu tespit edilmeye çalışılmıştır. Birinci bölümde, Usûlü'd-dîn ve Usûlü'l-fıkh ilişkisinde en önemli ortak konu olan delîl konusu incelenmiştir. Delîl konusunun Seyfeddin Âmidî’nin kelâm sisteminde nasıl bir değerlendirmeye tabi tutulduğu araştırılmıştır. İkinci bölümde, Usûlü'd-dîn ve Usûlü'l-fıkh ilişkisinde önemli bir yere sahip olan delîl ile ulaşılmak istenen hüküm konusu irdelenmiştir. Ardından delîl ve hüküm arasında yer alan yorum metodolojisi iki usûl açısından ele alınmıştır. Sonuç bölümünde, tez bölümlerindeki ana fikirler özetlenmiştir. Araştırma sonucunda ulaşılan neticeler ve kanaatler ortaya konulmuştur.Abstract In this thesis, relationship between Usul al-Din and Usul al-Fiqh in kalam system of Sayf al-Din al-’Amidi have been studied. Thesis, consists of introduction, two chapters and a conclusion. In the introduction, the relation between Usul al-Din and Usul al-Fiqh discussed based on al-’Amidi’s position and how and what Sayf al-’Amidi contributed to the Usul al-Din and Usul al-Fiqh sciences. In the first chapter, evidence (dalel) matter which is the most important common issue in the relation between Usul al-Din and Usul al-Fiqh has examined. And how evidence (dalel) matter has been considered in the system of al-’Amidi's kalam. In the second chapter,the provision which ıs intended achieve by evidence (dalel), the most important issue relation to Usul al-Din and Usul al-Fiqh, is discussed. Then, exegesis methodology which is placed among Usul al-Din and Usul al-Fiqh discussed in terms of both of procedure. In the conclusion, the main ideas which are in sections are summarized. The main ideas and thoughts which are reached have been manifested.

▼ Née dans des pays musulmans dans les années 1950 et 1960, l’industrie de la finance islamique devient un fait social européen à partir de la fin des années 1970. Principalement orientée vers les marchés financiers et la gestion de patrimoine de personnes fortunées, elle s’ouvre aux particuliers à partir des années 1990 et tout au long des années 2000 au Royaume-Uni, puis en France et en Allemagne pour offrir une offre de proximité aux musulmans et aux non musulmans. La finance islamique se distingue de la finance conventionnelle par l’observation dans ses pratiques contractuelles de prescriptions issues de la sharîa (Coran et Sunna). Ces prescriptions sont définies par des obligations, le versement de la zakât, aumône légale, le partage des profits et des pertes, mais aussi par des interdictions telle que la pratique de l’intérêt, ribâ’, du gharar, l’aléa et du mayssir, la spéculation, ou encore celle de la thésaurisation qui contreviennent aux monopoles d’usages européens du capitalisme financier.La volonté d’instituer les pratiques de finance islamique à l’échelle nationale amène des acteurs musulmans et séculiers, des professionnels financiers, des juristes et jurisconsultes, des universitaires, des représentants des autorités publiques à coopérer pour traduire et créer une offre de finance islamique à l’échelle locale. Cette offre est relayée par de nouvelles figures de professionnels financiers – banquiers, courtiers, assureurs, consultants, jurisconsultes – à la fois islamique et européen qui instituent la finance islamique à travers leurs pratiques professionnelles quotidiennes. Cette thèse observe la plasticité de la norme islamique et nationale, les arrangements et les compromis nécessaires aux dépassements des conflits de normes et de pratiques qui permettent de créer un répertoire européen de finance islamique inédit dans le monde. L’institution de ce répertoire tient compte des contraintes islamiques mais aussi légales et du marché : des contraintes de lieu et de temps. La visibilité du stigmate islamique peut par exemple être ostentatoire ou discrète voire tue en raison de la charge symbolique à laquelle l’islam renvoie. Ces conflits montrent une double tendance qui peut paraître paradoxale : alors que le référentiel islamique pénètre et s’enracine dans ces lieux – qu’ils soient physiques ou symboliques –, il sert aussi à dessiner et délimiter les frontières morales, historiques, de valeurs ou juridiques de la communauté nationale.

Kanaatimizce ihtilaflı olan böyle bir konuda temel kaynaklara ne kadar inilirse çözüme yaklaşma imkanı o oranda artacaktır. Neshin gerçekleşme alanının fıkhın konusunu teşkil eden ?amelî şer'î hükümler? olması sebebiyle, klasik fıkıh usûlü eserleri de bu kaynakların başında gelmektedir. Bu bağlamda tezimizin amacı, Hanefî usûlünün köşe taşlarından biri olan h. 4. yy. âlimlerinden Cessâs özelinde klasik fıkıh usûlünde neshin teorik ve pratik bağlamda nasıl anlaşıldığının ortaya konulması olmaktadır. Tezimizde öncelikle Cessâs ve nesih konusuyla ilgili genel bilgileri içeren bir giriş yaptık. Daha sonra Cessâs'ın neshi nasıl anlayıp tanımladığı, neshin imkânı, aklî temelleri ve gerçekleşmesi konusundaki düşünceleri üzerinde durarak onun nesih anlayışının teorik çerçevesini ortaya koymaya çalıştık. Bunların yanı sıra, Cessâs'ın neshin gerçekleşmesi için belirlediği şartlara ve çatışma durumunda (teârudu'l-edille) nassların nasıl uzlaştırılacağı hususuyla yakından alakalı olarak, neshin nasıl tespit edileceğine dair sunduğu kurallara geniş ölçüde yer verdik. Daha sonra ise Cessâs'a göre nesih çeşitlerinden bahsederek, daha önce teorisi ortaya konan nesih meselesini pratik örneklerle destekleyerek anlatmaya çalıştık. Bu şekilde nesih konusunu, Hanefî usûlünde elimize ulaşan ilk eser olan Cessâs'ın el-Fusûl fi'l-Usûl adlı eseri ve yine aynı müellifin Ahkâmu'l-Kur'ân adlı eserleri temelinde ele alarak onun bu konudaki görüşlerini gün yüzüne çıkarmakta ve klasik usûl âlimlerinin nesih anlayışından bir kesit sunmuş olmaktayız. Abstract Naskh (abrogation) is a contentious issue that has been discussed by Muslim learned scholars for centuries. It is one of the most contested topics even today. We believe that the more we look at the early Islamic sources the more we are able to resolve such a contested issue. Since naskh occurs in the texts from which Islamic law (fiqh) draws its ?practical and religious rulings?, classical Islamic legal theory books become vital sources for our topic. Therefore, the purpose of our thesis is to point out how naskh was practiced and theorized in the classical legal theory by looking at the works of Al-Jassas, a leading Hanafite Muslim learned scholar who lived in the 4th century AH. We started our thesis with an introduction that includes general information about Al-Jassas and naskh. Then we attempted to point out Al-Jassas?s theoretical understanding of naskh by analyzing how he conceived and defined naskh, the possibility of naskh for him, and the rational basis for naskh in his thought. In addition, we presented views of Al-Jassas in length on how to determine whether naskh accrued; conditions that are required for naskh to occur; and in case of contradiction how religious rulings should be reconciled. ▼ In the early ninth century Muslim renunciants developed the metaphor of devotion to God is a path to teach their disciples how to cultivate virtues that would enable them to escape attachment to the world. Alongside these virtues were ascetic practices, sometimes extreme, that demonstrated their commitment to God. The earliest example of this renunciant path is the ascetic manual Adab al-'ibadat attributed to Shaqiq al-Balkhi (d. 198/809-10). Al-Harith al-Muhasibi (d. 243/857-8) took exception to exaggerated practices of Shaqiq's path and insisted that religious devotion must adhere to the commands God gave in the Quran and in the Sunna. Unique in the ninth century, Muhasibi also insisted that God's commands were not limited to exterior actions, but included specific expectations of the interior dimension of religious devotion. Abu Sa'id al-Kharraz (d. 277/890-91 or 286/899) expanded the renunciant path of Saqiq's followers, but also responded to Muhasibi's censure and softened the more extreme practices of the renunciant path. He was firmly committed to the interior dimension of religious devotion, but gave no indication that he accepted Muhasibi's insistence that these virtues were incumbent. Rather, he argues that the noblest expression of these virtues exists only among God's friends, whose religious devotion has its origin in the excellence of their primordial condition. This thesis will introduce a conceptual hierarchy of religious devotion that facilitates the analysis and comparison of each of these authors. Current discussions of ninth-century Islamic piety are limited by inadequate definitions of asceticism and mysticism. A holistic approach to their religious devotion will provide tangible indicators of the ascetic or mystical orientation of their piety. This provides better parameters for discussing the relationship between asceticism and mysticism in the ninth century.

The rise of the JDP has ignited fears both domestically and in the international arena that Turkey, the once secular stronghold against Islamic fundamentalism in the Middle East, is gradually being overrun by creeping Islamisation.
The governing JDP, in power since 2002, has a recognised affinity to religion. Its alleged Islamist background has alarmed Turkey’s Kemalist elite, who suspects the government is harbouring a secret agenda to Islamise the Turkish state and society. Contrary to such concerns, this study has found that the JDP, although culturally conservative, is committed to liberal democratic principles and revising the undemocratic practices of the Kemalist regime. The governing JDP, whilst generally supportive of the status quo, poses a challenge to the Kemalist state by seeking to redefine the Kemalists’ understanding of secularism. Paradoxically, the JDP has emerged as the champion of political reformism, which is in contrast to the authoritarian, statist ideology enforced by the Kemalist establishment. The JDP’s espousal of the principle of secularism and its refusal to employ Islamist rhetoric establishes its secular democratic credentials. Further, the thesis has also examined how the JDP’s commitment to the European Union accession negotiations and its efforts to reduce the political role of the Turkish military is indicative of its liberal democratic outlook.
Analysis of the JDP’s policies, the party programme and ideology reveals that the government’s attachment to liberal democratic principles, ironically, furthers its culturally conservative agenda by undermining the Kemalist monopolisation of the concepts of modernity, progress, democracy, and secularism. The study has found that the JDP is attempting to resolve the decades-old conflict between secularism and political Islam in Turkey by reinterpreting Kemalism and implementing policies based on its ‘conservative democracy’ ideology, which is a blend of reformism and conservatism.
The JDP experience has broader ramifications for international relations in a post 9-11 world by dispelling the widely-circulated belief that a pro-Islam party cannot operate within clearly-defined secular parameters, or be a proponent for genuine democratic reform. The study has found that far from working towards the establishment of an Islamic state, the JDP’s policy initiatives have led to the consolidation of democracy in Turkey and the enhancement of civil liberties and basic freedoms long suppressed by the Kemalist regime. Çalışmamız giriş ve iki bölümden oluşmaktadır. Giriş bölümünde araştırmanın konusu, amacı, önemi ve yöntemi üzerinde durulmuştur. Araştırmamızın birinci bölümünde, Kazan bölgesinin konu çerçevesinde kısaca tarihçesi, sosyal-dini ve ilmi durumu açıklanmıştır. Müfessirlerimizin hayatları kısaca anlatılmış, hocaları ve eserleri hakkında bilgi sunulmuştur. Araştırmamızın ikinci bölümünde ise, tefsîrin kaynakları, rivayet ve yönlerinden tefsirin özelliği araştırılmıştır. Yapılan bu araştırmanın kısa bir değerlendirilmesi sonuç bölümünde verilmiştir.Abstract Nu’man as-Samani and Abdunnasır el-Kursavi, who were prominent figures of their region. The Nu’mani tawsir, which is the co-product of these two scholars, is the core of the this study. This researc is composed of an introductory part and two sections. İn the introduction the topic, purpose, inportance and methodology of this researc have been dwelt upon. In the first part of the research, life of the researc, life of mufassırs, the interpreters, have been examined from different perspectives and informatıon about their lecturers and Works has been given. In the second part of the research, the sources of the tawsir has been focused on and the transmission line, “riwayet”, and commentaries “dirayet” have also been dealt with. A sort evalution of this researc has been given in the conclusion part.
