▼ In recent years, large numbers of people have embarked on high-risk sea journeys attempting to reach specific destinations, including Australia, Greece, Italy, Spain, Malaysia, Thailand and the United States. In 2015, for example, over 850,000 people crossed the Aegean Sea from Turkey to Greece, with many continuing their journeys to eventually reach other parts of Europe (mostly Germany, Sweden and Austria). Just over half were Syrian refugees who had been living in Turkey, with Afghans, Iraqis, Pakistanis, Iranians and a multitude of others making up the remainder. Thousands of people perish en route every year while undertaking irregular maritime migration, and many more are exploited and abused during their perilous journeys. Added to this are the long-distances some must cover, particularly those from the Middle East and South Asia travelling to Australia. This study examines the nature and extent of self-agency of irregular maritime asylum seekers. In doing so, it focuses on a population of maritime asylum seekers who, at face value, were able to exercise agency and realise the goal of seeking asylum in Australia. Using survey and statistical data on irregular maritime asylum seekers who arrived in Australia over five program years (June 2008 to July 2013), the analysis finds strong complementarities among migration patterns of asylum seekers from different countries and ethnic backgrounds. The migration patterns and processes of a subset are examined more deeply in a case study on Hazara asylum seekers who travelled to Australia from Afghanistan, Pakistan and Iran. Through the application of a multi-faceted model of asylum seeker agency, the study finds that a small but significant group of ‘proactive asylum seekers’ were far from passive, exercising considerable agency in determining when, how, where and with whom they migrated. However, considerable limitations on agency were evident—particularly for females and young Hazaras—resulting in highly skewed migration patterns and very specific and sometimes singular migration processes being manifested. The study also found indications that Hazaras had applied similar migration strategies that had been developed within the West Asia region during previous decades of displacement and migration.

▼ Migration is often viewed negatively in development policy terms, and much understandings of migration often portray it as a threat to social security in destination countries, however, the sustainable livelihood approach presents migration as a livelihoods strategy, suggesting that policy should, instead, support human mobility. In the current context where regular labour migration offers various consequences resulting in both positive and negative impacts, irregular labour migration, though complex because of its undocumented nature, has become the choice of many unskilled and low-skilled workers from Vietnam. This study employs a case-study qualitative approach to look at the case of irregular migrant workers from a central province of Vietnam migrating overseas for economic purposes. It applies the New Economics of Labour Migration theory and the Sustainable Livelihoods Approach and brings together their shared premise of viewing migration as a household calculated strategy to sustain rural livelihoods, to explore whether irregular migration can be a sustainable livelihood strategy for the rural people of Ha Tinh province. The study finds that irregular labour migration is a household calculated strategy and, similar to regular migration, it brings about social and economic benefits that affect the migrants, their families and home communities. Although such migration is complex and vulnerable, it is well thought through by migrants and fits in the context of rural Ha Tinh as a flexible, quick and convenient strategy to gain income for the rural poor. The research also finds that the local people have established their own supporting networks and found their own ways to mitigate the risks and ensure their irregular migration is successful in terms of economic gains. The combination of an economic migration theory and a livelihood approach offers this research an in-depth discussion on the complexity of irregular labour migration and its impacts on various aspects of social and economic development. ▼ Irregular migration has become a politically controversial issue in most immigrant-receiving countries. Academic research has shown that states and their immigration policies actively create the legal conditions for the existence and perpetuation of irregular migration. Much of this literature, however, focuses on the United States and thus cannot examine how variation in contexts of reception may produce different configurations of legal status. In addition, much research on immigration has neglected migration from sub-Saharan Africa despite this region's demonstrated migration potential. This dissertation uses a novel quantitative data source, the Migration between Africa and Europe (MAFE) study, to examine the production of irregular legal status among Senegalese migrants in France, Italy, and Spain and the consequences of configurations of irregularity. A historical chapter outlines the evolution of immigration policies in each country that set the parameters for irregular legal status. The first empirical chapter studies the pathways into irregular status for Senegalese migrants. Pathways early in a migrant's trip – no-visa entry and overstaying – are more sensitive to both contextual variables and access to forms of capital, indicating that both state control and migrant agency shape these pathways. In contrast, befallen irregularity is less related to contextual variation, perhaps because immigration policies and enforcement resources are not focused on migrant integration. The second empirical chapter examines how immigration policy creates gendered channels of access to labor markets. Senegalese women with configurations of legal status indicative of family reunification are more likely than women with other legal statuses to be economically inactive upon arrival, while there is little association between Senegalese men's legal status and their participation. I find, however, that family reunification does not preclude labor-market participation, as women with family-reunification profiles eventually transition into economic activity. The third empirical chapter looks at the link between legal status and transnational activities. It finds that Senegalese migrants with irregular status are effectively confined to the destination territory, making them unable to visit the homeland. This confinement short circuits the entire social infrastructure underlying remitting and investing: the affective ties that underlie long-distance cross-border activities wither when migrants are unable to circulate. ▼ As migrações assumem-se como um dos fenómenos na história da humanidade que mais consequências têm tido a diversos níveis, tanto social, cultural, económico ou político. Até meados do século XXI a população nos países da África Subsariana irá duplicar. Falamos de potenciais migrantes, dadas as diferenças em termos de desenvolvimento humano face a locais de destino, como a União Europeia. Quando um grande número de pessoas migra aumenta o risco da migração irregular. Com este trabalho de investigação pretende-se responder à Pergunta de Partida “Quais as implicações sociais para a União Europeia, dos fluxos migratórios irregulares oriundos dos países da África Subsariana expectáveis até 2050? A metodologia utilizada na presente investigação alicerça-se no raciocínio hipotético-dedutivo e utiliza uma estratégia de pesquisa qualitativa. Os elementos recolhidos serão sistematizados, analisados e interpretados, através de uma análise SWOT (“Strengths, Weakeness, Opportunities and Threats”), que permitirá retirar conclusões sobre a problemática da investigação e, bem assim, propor algumas medidas, em resposta à Pergunta de Partida. Pretendemos contribuir para identificar os fatores que poderão contribuir para a ideia, hoje crescentemente veiculada, de que existe uma associação entre migrações e instabilidade social na União Europeia e apontar possíveis soluções, que permitam mitigar esta instabilidade, real ou percecionada. Abstract: The Migrations are one of the phenomena in the history of mankind that have had more consequences at different levels, social, cultural, economic or political. Until the middle of the 21st century, the population in sub-Saharan Africa will double. We are talking about potential migrants, given the differences in terms of human development compared to places of destination, such as the European Union. When there are a large numbers of migrates, the risk of irregular migration increases. With this research, we intend to answer the Question of Departure "What are the social implications for the European Union of the irregular migratory flows from the Sub-Saharan African countries expected by 2050?” The methodology used in the present research is based on hypothetical-deductive reasoning and uses a qualitative research strategy. The elements collected will be systematized, analyzed and interpreted through a SWOT (Strengths, Weaknesses, Opportunities and Threats) analysis, which will allow conclusions to be drawn on the research problem and also propose some measures in response to the Question of Departure. We intend to contribute to identify the factors that may contribute to the idea that there is an association between migration and social instability in the European Union and point out possible solutions that can mitigate this instability, real or perceived. ▼ This dissertation contributes to the study of transnational migration and human mobility by ethnographically documenting the lives of 60, male, Tunisian, irregular migrants—part of a mass migration of 30,000 people—who fled the 2011 Tunisian uprising by crossing the Mediterranean Sea and landing in Italy where they created, according to Italian authorities, an “emergency situation.” Although most of these migrants intended to use Italy as a gateway to other countries, such as France and Germany where they already had established social networks, many found themselves stuck in Italy where they were considered “illegals” under Italian law. A number of them faced human rights abuses such as deportation back to Tunisia, suffered violence and oppression at the hands of the Italian police and Italian society at large, and were stigmatized as “potential criminals” and “hidden terrorists” by both state and non-state actors, i.e., employers, media and the larger public. Using narratives and oral histories from the study population, this research explores 1) the processes of criminalizing and dehumanizing the migrant “Other” such that violence perpetrated against him is permitted and rationalized; 2) the irregular migrants’ experience, discussion, negotiation of, and resistance to, their socially constructed “illegality” and “criminality”; and 3) the trends in anti-migrant violence and oppression and their consequences for the migrants’ identities, survival strategies, and daily struggles. Transnational migration scholarship and its idea of the “permeability” of national “borders” as shifting political spaces provided a theoretical foundation for this multi-sited research. The project transcends geographical boundaries to reach a macro-level understanding of the study population and to demonstrate the processes through which transnational movements are produced, forged, and maintained. The relevance of this research cannot be overstated as political turmoil in the Middle East continues, and irregular migrants and refugees pour into Europe. Thus, although the number of Tunisian migrants to Italy has significantly dropped since the 2011 uprising, hundreds of thousands of Syrians have been landing on Italian southern shores since 2015 when Syria entered into a civil war.

▼ National Security and Human Security are two concepts of the larger field of Security that have been and currently remain at odds with each other. On one hand, National Security seeks to uphold the sovereignty of this synthetic idea of the ‘State’, while, on the other hand, Human Security seeks the recognition of the internationally accepted rights of the individual, in any situation, whether the State recognizes them or not. As one can imagine, based on this ongoing division within the field of security, such as issue as migration is subject to just as heated as debate. National Security would state that the protection of the sovereign nation from the effects from the movement of unknown persons is paramount over the rights of the individual. Human Security rejects this notion, arguing that the well-being of the human person should be the primary focus in all matters, whether the action be a legal matter or one of state sovereignty. While the division between these views of security usually results in one taking precedence over the other, the case of Cuban irregular migration to the United States is a unique case. The shared history between the island and the US, be it the Cuban War for Independence or the Bay of Pigs Invasion and subsequent Missile Crisis after, is one wrought with security issues stemming from the field of National Security. The migration crisis, however, spurred on by these events, resulted in a shift in focus from the protection of the state, to the care of the individual. US policy towards Cuba would come to develop a unique focus on Human Security out of a setting that was highly reliant upon the ideals of National Security. This dissertation hopes to use the case of US and Cuban policy development with between National Defense and Cuban Migration to the US to effectively demonstrate that both the principles of National Security and Human Security have a place in policy and can be used effectively without jeopardizing the ideals of either field. ▼ In a context of deportability and bordering practices, this thesis asks questions regarding possibilities and limitations of resistance through community theatre. It sets out from a participatory ethnographic exploration of the working process and performance of the No Border Musical. The No Border Musical was created in 2011–2013 in the city of Malmö in southern Sweden. It was initiated by people linked to the local migrant rights movement in the city. About half the participants had applied for asylum in Sweden as unaccompanied minors. When faced with an expulsion order, they had come into contact with the local migrant rights movement and, at a later stage, the musical initiative. A majority of the rest of the ensemble was politically involved in changing the overall system of migration control and in giving support to undocumented individuals. The approximately two-year period of working and performing together was permeated by consequences and experiences of borders, deportability, asylum processes, while also aiming to practice and stage visions of a world where a passport would not determine one’s status in the world.Through a participatory ethnographic study, the contingency and ambivalence of resistance through community theatre in a context marked by bordering practices and deportability is analysed. Some of the actors performed publicly on stage, despite residing as undocumented and an everyday life permeated by fear of being detected by the police and subsequently deported from Sweden. Simultaneously, although aiming to contest borders, the border also cut through the musical group, not least in relation to differences in regard to risks inherent in participating in and performing with the musical. Precarious living conditions due to deportability had consequences in terms of the conditions for participating in the musical. The tension between wanting to dismantle categorisations put into force by the state and international institutions such as the EU, but also experiencing a need to adjust to the consequences of these (for example, practices to avoid police controls) was present in both the working process and visible in the performance of the musical. Categorisations, such as citizen/non-citizen, white/non-white, adult/youngster and documented/undocumented were simultaneously reproduced and contested. The musical performance staged consequences and experiences of migration control, while also performing possibilities of a world without borders. The staging of migration control had a realist strand to it and could be understood as feeding into narratives of deservingness as well as reproducing a victimisation of refugeeness. At the same time, privileges of mobility were made visible and criticised in the performance, and undocumented characters displayed rebellious resistance towards the system of migration control. ▼ The Dublin Regulation determines the Member State responsible for accepting and making a decision on asylum claims lodged in the European Union (‘EU’), Norway and Iceland. It aims to ensure that each asylum claim is examined by one and only one Member State, to put an end to the practice of ‘asylum shopping’ and to prevent repeated applications, both of which have been costly for the receiving Member States and caused severe inefficiencies in the determination processes in the EU in the past. With the first Member State of entry being the major determinant for the allocation of asylum responsibility under the Dublin Regulation, there has been growing discontent among Member States at the external borders of the EU, particularly the southern Member States in the Mediterranean, over what they see as a system that has unjustly placed disproportionate burdens on them regarding the admission of seaborne asylum seekers and the costs associated with it. As a result of changes in migration rules and consequent adjustments in the entry strategy employed by irregular migrants and people smugglers, the Member States at the EU’s ‘southern frontline’ have unwillingly played the role of reluctant hosts to boatloads of unwelcome asylum seekers. This thesis aims to examine how the EU has attempted to tackle the challenging situation of the unauthorised migration of asylum seekers into its territory by sea, and in particular, how it has responded to demands from affected Member States for a more equitable system of asylum responsibility allocation in spite of and outside the Dublin framework. It would argue that the ‘small’ EU Member States in the Mediterranean themselves have, over the last five years at least, become the unexpected drivers of the EU’s declared commitment to the principles of ‘solidarity’, ‘fair sharing of responsibility’ and ‘effective multilateralism’. ‘ Small’ as they may be in terms of resources, size or influence vis-à-vis the larger Member States, the former have been able to create their own mark in a global regime that has traditionally been resistant to the idea of burden-sharing. The measures taken by the EU’s ‘southern frontline’ have collectively changed the landscape of a global protection regime where not only is asylum ‘burden sharing’ highly elusive – its terms and conditions are also dictated by the more powerful sovereign states. While the theoretical point of departure in this study is the influence wielded by the ‘small’ EU Member States in the burden-sharing debate, the degree or level of ‘influence’ small Mediterranean Member States can exercise in pushing for cooperative arrangements is itself determined by a system that is biased towards large states, increasingly securitised, and is therefore limited in both nature and scope. Cette thèse est consacrée aux « brûleurs » de frontières – les harraga – qui tentent de quitter l’Algérie sans passeport, ni visa sur des embarcations de fortune, au péril de leur vie. Elle s’appuie et discute le modèle « exit, voice et loyalty » développé par Albert Hirschman afin de stimuler la réflexion et explorer la relation entre émigration et contestation. À partir de sources très diverses – des entretiens semi-directifs avec des harraga et des membres de leur famille, l’observation de procès de harraga, des articles de presse, des productions culturelles, des discours politiques, des textes de lois et des documents d’orientation politique – cette thèse documente les facteurs et les modalités de départ des harraga. Elle s’intéresse également au processus de publicisation et politisation de ce phénomène migratoire en Algérie et analyse les politiques mises en œuvre par les autorités algériennes afin de lutter contre la harga. Les harraga estiment qu’ils appartiennent aux marges d’un système socio-économique corrompu et inégalitaire dans lequel ils n’ont aucune perspective d’amélioration. Confrontés aux politiques migratoires restrictives, ils ne peuvent quitter le pays en respectant les lois imposées par les États. En raison des profils des harraga et de la dangerosité des itinéraires migratoires empruntés, la harga nourrit un discours critique qui porte à la fois sur la responsabilité des autorités dans la perpétuation d’un ordre socio-économique et politique qui pousse de jeunes algériens à quitter le pays, et sur la politique répressive mise en œuvre en réponse à la harga. En réponse à ce phénomène migratoire, les autorités algériennes mettent en œuvre une politique répressive qui s’inscrit dans des dynamiques de politique intérieure et extérieure. Le durcissement des lois sur l’émigration-immigration « irrégulière » en Algérie s’inscrit dans un contexte régional et dans le cadre de l’externalisation des frontières extérieures de l’Union européenne.

This dissertation examines the political implications of harga in Algeria. Literally translated, harga means “burn”. In the Maghreb dialects, the term has come to describe a specific form of migration. Harragas (literally “those who burn”) are those who try to leave their home country without a passport or visa, on small boats, risking their lives. This dissertation uses Albert Hirschman’s model of “Exit, Voice and Loyalty” in order to stimulate reflection and explore the link between exit (emigration) and voice (protest). Drawing from a wide variety of sources – semi-structured interviews with harraga and their family members, observations of trials, newspaper articles, cultural products (movies, novels, paintings, etc.), political speeches, legal texts and policy papers – this dissertation documents the causes of migration and the emigration patterns from Algeria of harraga. In 2005, Frontex, the EU border control agency, started its operational function at the EU external borders. Since then, it has become a central component of the EU border control regime leading EU and national actions for the management of irregular migration. With continuous presence at the EU external borders and substantial mandate enhancements especially amidst the 2015 migration crisis that have rendered it the European Border and Coast Guard, Frontex constitutes one of the most controversial EU agencies. But, Frontex is not just an EU agency, as the academic literature often contends. Rather, it constitutes a key border control actor that shapes borders and border control in Europe. Zooming in Frontex as a border control actor, this thesis explores Frontex’s role in EU border control and at the EU external borders bringing culture in the analysis. Drawing on a social constructivist perspective, this thesis employs Ruben Zaiotti’s analytical framework of ‘cultures of border control’ focusing on border control assumptions and practices. This offers a new prism for Frontex’s scrutiny, because it allows the incorporation of ideational and inter-subjective elements in the analysis. Remedying a gap in the literature, which refers to the neglect of the existence and function of a border control community, this thesis examines Frontex as a border control actor embedded in a policy community. The central research question is ‘how does Frontex impact on the culture of EU border control?. To answer this question, this research follows a qualitative methodology comprising document analysis, institutional discourse analysis, semi-structured interviews with national border guards and Frontex officers, process-tracing, comparative case study analysis of the Greek land border Evros and the Italian sea border Lampedusa and in-situ analysis with fieldwork in these two borders. This thesis argues that Frontex shapes the EU border control by pursuing a new border control culture, which has contested the Schengen regime and now constitutes the dominant culture of border control in Europe. This culture consists of a new border control community, which promotes assumptions and practices for border control encountered not only in Frontex but also at the borders. Thus, there has been an evolution from the Schengen regime of border control to a new model. Through the conduct of primary research and analysis, this thesis reveals a new reality at the borders and a different function of Frontex that transcends the agency’s technical and managerial role set by its original mandate. Hence, this thesis contributes to the discussion on the EU-level response to irregular migration and the nature of border control especially in today’s highly polarised environment dominated by irregular migration concerns.

▼ Before the crisis Catalonia and the rest of Spain received high volumes of immigration - of which much was 'illegal'. This was despite formally strict controls - EU policy - and different governments in Madrid claiming to operate a legal model of migration - leading to identification of a 'policy paradox'. In the same period immigration became problematized, which in Catalonia allowed xenophobic politics to gain popular support - despite being a territory proactive at integrating newcomers. This research aimed to identify the undercurrents of these contradictions and respond to questions on the relative impact of business, state, national and electoral factors. It surveys literature on migration paradoxes and theories, develops an original conceptual framework by critically assessing a range of radical writing, performs quantitative and secondary study of the Catalan, Spanish and European economic and policy contexts (in general and regarding immigration), and analyses findings from interviews with privileged 'insiders' and observers (employers, union leaders, migrant activists and policy advisors). Policy contradictions and the problematization of immigration were identified as rooted firstly in the inherent contradictions of the capitalist state. States must ensure availability of new reserves of labour to guarantee accumulation and make savings by not having to 'socially reproduce' 'imported' labour power. Yet their abstract national and bounded character propels constant nationcraft - a process best performed invisibly and negatively by symbolically and practically excluding migrants from territory, rights and citizenship. Dynamics are further driven by the desire to be seen to preserve the 'rule of law' and guarantee the exclusivity of national 'social contracts'. Nation-building in policymaking was detected by uncovering the national-linguistic considerations behind the controversial drive to devolve immigration powers to Catalonia. Mushrooming irregularity was a result of migrant agency and the restrictive tendencies of the Aznar administration and EU. Despite the Popular Party (and EU) being notably pro-business, tensions emerged with employers who lobbied alongside unions to bring about the liberalisations introduced by the Zapatero government (2004-2011). Employers benefit from the (continued) institutional conditioning of migrant labour and irregular hiring has been tolerated - aided by a relatively informal and insecure labour market. Yet it is a mistake to see high levels irregularity simply as labour policy. The unequal and instrumental nature of European integration meant the Spanish State played a border policing role that threatened its labour needs before the crisis. This led to political 'fudge' based on varying models of irregularity-amnesty-irregularity, and reinforced pro-European and Hispanist migrant recruitment tendencies.
