▼ In the mid 1980s, national enterprises started to hire illegal foreign workers without the official introduction in Taiwan. Following with the soaring national economic growth, wage and income and the popular trend in stock, lottery and gambling games in 1985, workers were less willing to work. Industries, such as the 3K or 3D industry (dirty, dangerous and difficult), were less favored. In addition with the delaying participation of youth in job market due to the rising educational level, the supply for grassroots workers faced decreasing. Meanwhile, the national birth controlling policy also led to low birth rate, slow population growth and aging population, which triggered a serious labor shortage in Taiwan and enterprises also started calling for solving the labor shortage problem by introducing foreign workers. When Taiwanese government had first initiated the 14 major infrastructures project, the deadline of the project was kept postponing due to labor shortage. Therefore, the government set up a âmechanism of workers demanding for14 major infrastructures projectâ by executive order, allowing entities to introduce foreign workers for the project. 3 years had gone, a âmechanism for temporary labor shortageâ was enforced. This mechanism allowed domestic industries to introduce foreign workers officially, announcing it can be applied to 15 jobs in 6 major industries. Through legislative procedure, the Employment Service Act had been passed on 3rd reading in 1992. Thus, a formal source of law can be found for introducing foreign workers. A riot started by Thai workers at Kaohsiung MRT in August 2005 not only revealed problems, such as foreign workers management and human rights, but also affected Taiwanâs international reputation by large. Some foreign workers have received maltreatments, such as forced labor or involuntary labor. Moreover, the amount of foreign workers who are unaccounted for has kept increasing, too. In 2012, more than 30 thousand are missing. For researching the core problem, based on the 5 major frameworks of administration law, including the administrative principles, administrative organization, administrative authority, administrative remedy and administrative supervision, this study aims at examining the legal system of missing foreign workers prevention for national police to redress the deficiency of the legal system with researching by reference, historical analysis, comparative analysis and induction analysis. By comparing current management manners in Hong Kong, Singapore, Austria and Switzerland, I wish some valuable lessons can be learnt with more significant and concrete suggestions for related regulations to the missing foreign workers prevention and to protect human rights. Пре Другог светског рата Југославија је била аграрна, слабо индустријализована и немодерна земља. На лошу основу надовезале су се последице рата. Индустрија и саобраћај били су разорени, а људске жртве огромне. Победничка комунистичка идеологија као примарни циљ развоја друштва (и средства за очување власти), сагласно моделу опробаном раније у Совјетском Савезу, прокламује интензивну индустријализацију и електрификацију. Међутим, делатности на модернизацији привреде нису биле могуће без стручног кадра, кога није било довољно. Спас се очекивао од СССР, али иза великих обећања нису стајала адекватна дела, па је у југословенском развоју учествовао тек мали број (претерано плаћених) совјетских стручњака. Остала су два извора стране стручне радне снаге које ће моделатори југословенске привредне политике обилато користити. Први извор био је у земљи – бројни ратни заробљеници којима ће се у замену за уговор о раду понудити слобода, што су хиљаде њих прихватили. Други се налазио у суседним и оближњим земљама у којима је рат створио незапосленост – највише Немачкој, али и Аустрији, Чехословачкој, Мађарској, Италији и Бугарској. Ти стручњаци биће тражени, или ће сами нудити услуге, и хиљаде њих биће на више година ангажовано у предузећима Југославије. Резултати које су оставили у привреди, посебно електропривреди, хемијској, машинској, аутомобилској и радио-индустрији били су импресивни. Истраживање теме обављено је на обимној архивској грађи, првенствено фондова Архива Југославије, а оквир историјске појаве и епохе на основу бројне домаће и стране публиковане грађе, литературе и штампе. При обради теме коришћен је класичан историографски метод, допуњен техникама демографије, статистике, социологије, психологије, економске и друштвене историје, изучавања свакодневице и приватности.

▼ This thesis examines questions in the areas of development economics, international trade and industrial organisation in both empirical and theoretical settings. It consists of an introduction, two empirical research chapters, one theoretical research chapter and a conclusion. Chapter one, the introduction, provides an overview of the research contained in this thesis. Chapter two addresses whether the provision of information regarding what foreign goods might be produced with child and forced labor affects imports to the United States. I investigate this using three different measures of information revelation: inclusion on the U.S. government's list of goods produced with child or forced labor, a media coverage index and an index composed from reports of the International Labor Organisation. This paper finds no evidence that information provision decreased imports of these goods to the United States. This implies that public information strategies without more concrete measures will not disincentive countries that export goods made with child and forced labor. Chapter three investigates whether foreign competition affects the reallocation of unpaid and family workers from household firms to working outside of the family firm. I examine this using a panel dataset of Vietnamese manufacturing enterprises that went through trade liberalisation. The finding is that import competition leads to the switching of family and unpaid employees from working at the household firm to working externally. The response to increased foreign competition is greater for less financially stable firms, and for households with less income generation jobs per family. This finding is consistent with income diversification on the part of households who own firms threatened by import competition. Chapter four is a work in the theory of consumer search. The marketing literature has found that consumers generally expect high quality sellers to post high prices. We model this effect in a consumer search market exhibiting vertically differentiated firms, heterogeneous consumers and endogenous consumer market entry. In this market, where quality is unknown to consumers, high and low quality firms make equal sales and profit. Conversely, when quality is known, search frictions induce an unravelling mechanism that leads to a unique refined equilibrium where only low quality firms are visited by consumers. Low quality firms dominate the market, and high quality firms make no sales or profit. Chapter five concludes this dissertation. Advisors/Committee Members: Newman, Carol.

▼ A model is been built where two countries compete for a multinational enterprise’s (MNE’s) foreign direct investment (FDI) provided that its arrival will increase the host country’s social welfare. Both potential host countries have unionised labour markets where monopoly labour unions determine the level of the wage setting to be either decentralised, intermediate level, or centralised. The governments may influence the unions’ decision by setting a lump-sum tax on them. Both countries have two sectors, a non-sheltered and sheltered sector. The MNE will enter in the non-sheltered sector and is assumed to be more productive than the incumbent firms there. Product market competition between the MNE and domestic incumbent firms is ruled out to isolate the effect of product market competition from the effect of pure wage compression. The game evolves in five stages: (1) the governments set taxes, (2) the monopoly unions choose the level of the wage setting, (3) the MNE chooses its investment location, (4) the monopoly unions set wages, and (5) the firms set output. The purpose of the model is to learn whether the degree of centralisation of wage setting can be used as a strategic choice to attract foreign direct investment. The main results of the paper are the following. It was found that the MNE’s (incumbent unions’) most preferred choice is always centralised (decentralised) wage setting. It was shown that the governments’ most preferred choice is either decentralised or centralised wage setting – depending on the relative sizes of the two sectors. If the social welfare in country 1 is the highest under decentralised wage setting, then the optimal policy of government 1 is to set zero income taxes. If the social welfare in country 2 is the highest under centralised wage setting, then the optimal policy of government 2 is to set positive taxes slightly over that required to make the domestic incumbent labour unions prefer centralised wage setting. Given this, the MNE will always invest in country 2. The exact expressions for the stage-contingent lump-sum taxes were derived. To my best knowledge, this is a novel contribution that cannot be found elsewhere.

▼ The ﬁrst chapter of my dissertation explores the roles “quants” or technically trained workers play at hedge funds. I quantify the impact of hiring “quants” on hedge fund strategy and risk taking by exploiting H-1B lottery results and a policy shock that signiﬁcantly reduced the future supply of foreign high-skilled labor in the U.S. I ﬁnd that the H-1B visa program allows hedge funds to pursue strategies that are more quantitative (e.g., hedging, systematic trading, etc.) as opposed to fundamentals-based (e.g., event driven). Although there is evidence of substitution between fund strategies, I also ﬁnd that hedge funds overall become more diversiﬁed, both in terms of regional focus and fund investment style.Traditional theories on corporate ﬁnancial policy mostly focus on ﬁrm-speciﬁc determinants and assume that capital structure choices are made independently of the actions of peer ﬁrms. The second chapter of my dissertation introduces a theoretical model that embodies the dynamic of how peer behavior aﬀects a ﬁrm’s optimal choice of debt level. Speciﬁcally, peer eﬀect is captured by a measure of how much the liquidation value of assets are adversely impacted if peer ﬁrms choose to liquidate simultaneously, the eﬀect of which is more prominent for industries with highly specialized assets – hence low asset redeployability. The theoretical model predicts that a ﬁrm’s optional debt level is lower when the liquidation prices of its assets are expected to be more severely impacted by the concurrent liquidation of peer ﬁrms. Moreover, in those situations where peer ﬁrms’ cash ﬂows are more closely correlated, the optional debt level will be higher. Individual ﬁrms’ attempts to maximize their own utility lead to an industry-wide over leverage, further exacerbating the risk of general crises in an already highly correlated industry.The third chapter of my dissertation explores the potential of using deep learning models to enhance equity trading strategies such as momentum and reversal trading. A deep feed forward neural network model (DFN) is fed with a training data set (1965-2000) that uses the rolling Z-scored cumulative returns of various horizons as predicative variables. With the model parameters generated by the training set, the model is applied to the validation set (2000-2016) to generate a signal for each stock predicting its likelihood of outperforming the cross-sectional medium. Based on this model-predicted signal, I have constructed an long-short investment portfolio out of the validation data set. The deep learning portfolios yield an annualized return of over 20 percent and generate signiﬁcantly large alphas over commonly used factor models.

▼ This thesis is focused on the New Zealand Recognised Seasonal Employer (RSE) scheme which enables low-skilled seasonal migrant workers, primarily from the Pacific Islands, to work temporarily in New Zealand’s horticulture and viticulture industries. This study examines how seasonal work schemes contribute to the social development of participating workers and their families, and therefore links to previous research that tended to focus on the positive economic development outcomes for workers, their families and communities. The primary focus of this study is on the experiences of ni-Vanuatu migrant workers. Fieldwork, utilising qualitative research methods, was conducted in two field sites – vineyards of Blenheim, New Zealand, and Tanna Island, Vanuatu. Findings suggest that the scheme is delivering social and economic benefits to participating ni-Vanuatu migrants and their families. Furthermore, migrants gain skills and knowledge, particularly in relation to their management of time and money. Although not always directly transferable to Vanuatu, the skills and knowledge gained by migrants enable their success during repeat RSE contracts in New Zealand, reflecting migrants’ cultural adaptability; the ability to move and adjust successfully to the cultural settings of both Vanuatu and New Zealand. Alongside these positive development outcomes, there are power issues at play within the RSE scheme which result in the ni-Vanuatu migrants becoming dependent on pastoral care support, and involved in a submissive relationship with their RSE employers. Positively, with the increasing independence of experienced migrants, this situation is beginning to change. Nevertheless, with the success of experienced migrants comes a caution: if a group of experienced circulating migrants come to dominate participation in the RSE scheme, opportunities for first-time migrants to participate will be reduced, and inequitable development outcomes at the grassroots level in Vanuatu may result. It would seem then, that with equitable consideration of future recruitment, the RSE scheme may continue to deliver benefits to participating migrants and their families, as well as to Vanuatu and New Zealand.

▼ The role of foreign capital as a job creator is becoming increasingly important in the context of globalization. Although the purpose and scale of their business activities may vary, foreign investors’ entry into a host country often creates a large number of jobs for local populations. In this process, the government usually plays an intermediary role to maximize the benefits generated by foreign firms. This dissertation describes the labor market effects of multinational enterprises (MNEs) in relation to the ways in which government policies and the sources of foreign capital come into play in this process. This study is based on both quantitative and qualitative data. I have drawn data from the U.S. Census Bureau’s County Business Patterns (CBP) database, the Bureau of Economic Analysis’s (BEA) Foreign Direct Investment in the United States (FDIUS) database, and American Community Survey for quantitative analysis. In addition, I have supplemented the statistical results with in-depth interviews with corporate executives, managers, government officials, and staffing agencies’ managers and archival data from both the firms and the local government. The findings focus on labor market changes driven by foreign capital along with institutional shifts. First, I describe the ways in which foreign businesses change their patterns of manufacturing activities and create employment at the state level in response to domestic institutions. Next, I analyze how foreign manufacturing investments originating from different sources result in different labor market outcomes at the local level in response to international institutions. Lastly, I corroborate that state-level institutions, or state governments’ economic policies play important intermediary roles in influencing the relationship between foreign investors and the host labor market. I discuss the implications of these findings for research on organizations and the labor market in the global context and for understanding the importance of governmental policies in promoting economic development.

This dissertation consists of three studies in international trade and monetary economics. The first and third chapters study the impact of labor market rigidities on multinational firms' choice between FDI and outsourcing. The second chapter proposes a model that explores one of the motivations for using Bitcoin.In the first chapter, I propose a two-country, two-sector model, where a firm's decision on offshoring depends on labor market rigidities, due to which firms need to bear not only wages, but also additional costs from the labor market. In this model, firms endogenously choose their organizational form, considering their productivity level and fixed organizational costs. The labor market cost generated by search frictions plays a key role in changing the variable benefits of each choice, and thus works as a key determinant in the process of selecting the organizational form for offshoring. The model has four different types of equilibria, depending on relative levels of two labor market costs (domestic and foreign) and the price of the intermediate input. In all equilibria, a relative rise in the domestic labor market cost increases the share of offshoring firms, while decreasing domestic integration. Furthermore, an economy with offshoring has a higher welfare level and a lower unemployment rate than autarky. The second chapter offers an explanation for how Bitcoin gained its success, by focusing on the anonymity of the Bitcoin transactions based on the Bitcoin system's peer-to-peer nature, among several other features that distinguish it from previous digital currency systems. In the model that I propose, there exist two currency markets, Bitcoin and Debit, and agents are heterogeneous in their anonymity concerns. This heterogeneity drives some agents to choose the Bitcoin market and others to choose the Debit market in the benchmark model. When I introduce the intermediaries, which accept Bitcoin for legal goods, the number of agents who choose the Bitcoin market increases, while the share of Bitcoin users engaged in illegal activities decreases.Finally, in the third chapter, I examine the key prediction that I make in the first chapter: the difference in labor market flexibility across countries can be a key determinant in a firm's offshoring decision. I use the data set for 2006 through 2012 from U.S. related-party trade data of 453 6-digit North American Industry Classification System (NAICS6) level goods from 137 countries. For the labor market flexibility index, I use the Global Competitiveness Report (GCR) by the World Economic Forum. The data yields supporting results for the first chapter: the U.S. intrafirm imports share is positively correlated with the industry productivity dispersion only in countries that have the most flexible labor market. The supporting results stand out more with the data on developing countries only, which are mostly host countries trading with U.S. multinationals.

▼ Media reporting on Pacific people in New Zealand has frequently been criticised for being sensationalised, biased and narrow. Yet, there have been few broad and systematic analyses of the nature of reporting specifically concerning Pacific Island seasonal workers in New Zealand. My thesis explores how the New Zealand print media portrayed Pacific Island seasonal workers travelling under the Recognised Seasonal Employer (RSE) scheme from 2007 to 2012. That period represented the first five years of the scheme and a time when it was in the news by virtue of its novelty in New Zealand, thereby providing a rich vein of media representations to study. My research focusses on the media themes occurring in the communities where RSE workers were living, while they were living there, so as to understand the discourse circulating in their immediate community. This provides understanding of the philosophical and cultural assumptions that underpin mainstream regional media reporting in New Zealand with regards to the particular representation of Pacific RSE workers, and how this compares with representations of Pacific people as a whole. Although the goal of my thesis is to trace the nature of the portrayal of Pacific Island workers under the RSE scheme, I have contextualised this with a review of the depiction of Pacific people dating back to their arrival in the 1950s and ‘60s. I look at how Pacific people were racialised in the early 1970s and compare that with coverage of the influx of Pacific Island seasonal workers in 2007, exploring underlying assumptions prevalent in the 1970s that Pacific Island workers were disruptive to New Zealand, such as by taking employment from New Zealanders or posing a threat to health, law or order. A sample of 115 articles drawn from the five regional newspapers – Bay of Plenty Times, Hawkes Bay Today, Nelson Mail, Marlborough Express and The Southland Times – was chosen for media analysis. Additionally, five selected case studies extracted from the NZ Herald, a metropolitan newspaper, for each calendar year from 2007-2012, were explored and compared to the regional sample, to help identify themes about Pacific seasonal workers that were portrayed in the wider New Zealand news media but missing from the regional coverage. I analysed the articles using interpretive thematic analysis. In this method, I looked at newspaper coverage in depth to make sense of the patterns of meaning. I identified themes used by print media to portray Island workers in regions that constitute a high number of Pacific seasonal workers during the scheme’s first five years of operation in New Zealand, and mapped these over time to investigate whether there was a shift in the discourse of stories as the scheme matured. With 115 articles assessed from 2007 to 2012, concentrating on November to March in each season when most RSE workers are in New Zealand, key themes were identified. ▼ Over the past decade there has been a changing policy landscape in Ontario that aimed at assisting foreign-trained immigrants to integrate into their intended professions. However, many foreign-trained immigrants continuously face barriers in the labour market such that their employment experiences are often contrary to their expectations. This study explores and examines the factors influencing the employment trajectory of Internationally Educated Professionals (IEPs) in Canada. In particular, the study focuses on selected Filipino immigrants and IEPs from other cultures, and examines their employment trajectories and shifts in professional status. Recent literature indicates that there is a widening gap between the policies of immigrant inclusion and equity in many Western countries and the social realities of immigrants in the workforce. This study is an interpretive qualitative research with a critical orientation using Bourdieu’s theory of social reproduction as a lens. A total of 30 participants were divided into three categories according to their year of arrival in Canada. Interview data were analyzed using critical discourse analysis and grounded theory. Findings reveal four broad sets of factors (socio-demographic, individual, sociolinguistic and contextual) influencing the employment trajectories of IEPs and their resulting shifts in professional status. Government immigration policies and economic conditions at the time of participants’ arrival were found to be important influences on IEPs employment success. The contented IEPs and struggling IEPs who had both different years of arrival experienced frequent changes in employment. High achieving IEPs who arrived in Canada between 1988-1994 and 2002-2008, had successfully navigated the employment trajectory with frequent job changes. However, low achieving IEPs, were also found among immigrants arriving between 2002-2008 who experienced less and/or no movement in their occupations. Findings are discussed in relation to relevant policy implications for the economy, educational practice, curriculum, theory-building and new knowledge construction for socioeconomic equity. ▼ The purpose of the study was to investigate the ways in which the practice of the Flexible Firm Model (FFM) disempowered the non-citizen professional nurses at Gaborone Private Hospital (GPH) in Gaborone, Botswana. GPH is a member of the Life Healthcare group of private hospitals based in South Africa. This study sought to probe the manner in which the practice of FFM influenced the employment relationship for non-citizen professional nurses. It also sought to examine the impact of the nature of the employment relationship on career development and representation and participation. Both qualitative and quantitative research methodologies were applied. Questionnaires were used to collect quantitative data. Thirty-five questionnaires were issued out to professional nursing staff and thirty-three responses were received. The response rate was ninety-four per cent. The qualitative research data consisted of twelve in-depth interviews with professional nurses, the human resources manager, a professional nurse agency owner and a private clinic coowner. Document analysis in the form of labour legislation, employee guides and employment contracts was used to validate data collected from the in-depth interviews. The results from the questionnaire revealed that an overwhelming majority of the professional nurses were Non-Citizens' dependent contractors. Although just under half of the participants held two or more previous contracts with GPH, an overwhelming majority had never been promoted. In addition, none of the participants were affiliated to the Botswana Nurses Association (BNA), the local equivalency of a professional nursing trade union. The in-depth interviews disclosed a sense of helplessness at their perceived disempowerment within the employment relationship, a poor career development and weak representation and participation. This study concluded that disempowerment at GPH was manifested through worker representation and participation and ineffective skill upgrade. These forms of disempowerment were made worse by the global professional nurse shortage and maladministration of available human resources. Effective use of human resources and continued education could be employed to circumvent the adverse results of disempowerment. Advisors/Committee Members: Klerck, Gilton.

Notre thèse porte sur le rôle de la libéralisation des échanges extérieurs dans les mutations qui ont eu lieu sur le marché du travail dans les pays en développement, cas de la Tunisie. Notre analyse se décompose en deux parties, la première étudie les fondements théoriques et leurs validations empiriques de la relation entre l’ouverture commerciale et le marché de l’emploi. La deuxième étudie les effets de l’ouverture commerciale sur le marché du travail tunisien. Nous présentons le degré d’intégration de la Tunisie dans l’économie mondiale ainsi que les différentes réformes du marché du travail qui ont eu lieu après l’adoption du programme d’ajustement structurel et la mise en œuvre des accords de libre-échange. Dans notre étude nous estimons un modèle à deux équations portant sur l’emploi et le salaire. Notre estimation se base sur deux approches, l’une à deux dimensions, temps et secteurs, et l’autre portant seulement sur le temps. Les principaux résultats sont:- Les importations et les exportations sont les variables les moins signifiantes car elles ont un effet marginal sur la demande de travail. À l’inverse, la production et l’emploi retardé sont les variables les plus explicatives et cela sans spécificité sectorielle. - La détermination du salaire réel dépend des importations et des exportations qui ont des effets différents à court ou à long terme selon le type de secteur (exportable, importable et non échangeable). Par ailleurs, l’emploi ainsi que la productivité des travailleurs qualifiés et non qualifiés sont des variables explicatives qui peuvent avoir une spécification sectorielle. Quant à la production, elle intervient différemment selon les secteurs.

Our thesis focuses on the role of liberalization of foreign trade in the changes that have taken place in the labor market in developing countries, notably the case of Tunisia. Our analysis is divided into two parts, the first looks at the theoretical foundations of the link between trade liberalization and labor market and their empirical validation, and the second looks at the effects of trade opening on the Tunisian labor market. We present the degree of integration of Tunisia in the global economy and the various reforms of the labor market that occurred after the adoption of the structural adjustment program and the implementation of free trade agreements, particularly with the European Union. In our study we estimate a two-equation model on employment and salary. Our estimate is based on two approaches, one in two dimensions, time and sectors, and the other only looking at the time dimension. The main results may be summarized as follows:- Imports and exports are the least meaningful variables because they have a marginal effect on labor demand. Conversely, production and employment with a time lag are the more explanatory variables without sectoral specificity.- The determination of the salary level adjusted for inflation depends on imports and exports which have different effects in the short or long term depending on the sector (exportable,…

▼ As a developing country with a vast population and an abundance of natural resources, Indonesia is keen to foster international business connections and foreign investment in the country. One approach to improving Indonesia’s economy is to nurture its arbitration system, because arbitration is the preferred method by which international business people settle disputes arising out of cross-border transactions. Having ratified relevant United Nations (UN) conventions as a dualist country, Indonesia has transformed various provisions into its domestic law. However, there is a gap between Indonesia’s international obligations and its domestic legal enforcement whereby the Indonesian judiciary does not operate harmoniously with both Indonesian arbitration law and the international conventions to promote enforcement of foreign arbitral awards (FAAs); in other words, the Indonesian judiciary has insufficient discretion in deciding FAA cases. The practice of Indonesia’s arbitration shows that the country has been struggling to enforce FAAs. In the 12 years prior to February 2012, only 41 FAAs were registered in Indonesia, and the number of successful FAAs has been small. This thesis explores the practice of arbitration and the enforcement of FAAs using Indonesia as a case study. Ten court decisions focusing on FAAs are analysed using the case study analysis approach to consider how decisions are made. In five of these cases, FAAs were unsuccessful, whereas five FAAs were successful—findings that confirm the hypothesis that Indonesia’s arbitration system has been hampered by obstacles that prevent FAAs being enforced in the country. FAAs in England and Australia provide comparisons to explore whether these countries suffer similar problems to Indonesia. Various obstacles were identified, including (a) the inconsistency of the Indonesian judiciary in making decisions regarding FAAs; (b) domestic law (i.e. Act No. 30/1999 regarding Arbitration and Alternative Dispute Resolution) that operates unharmoniously with international law (i.e. arbitration laws and conventions); (c) misunderstandings by the Indonesian judiciary in interpreting issues of absolute competence (i.e. jurisdictional issues), the separability doctrine and public policy issues used as grounds to set aside FAAs in arbitration cases; and (d) the dualism adopted in the system in Indonesia may not be the best to promote the growth of international arbitration in Indonesia. The measures needed to improve Indonesia’s arbitration system include: (a) Short-term goals: providing up-to-date and further education and professional training for Indonesian judges in international law and international arbitration as well as stronger enforcement of Indonesia’s international obligations; ensuring frequent interactions between domestic judges, lawyers, international jurists and international organisations; and ensuring the quality of the judicial interpretation of law (i.e. discretion of judges).
