federal policy regarding home mortgage finance, specifically the Home Affordable Refinance Program (HARP), the main tool of the Making Home Affordable Program (MHA), which is aimed at helping the United States recover from the housing crisis it has been experiencing ever since the mid-late 2000s. A modern history of
federal policy on home mortgage finance will help to set the stage for the reader for what has been one of the most difficult housing disasters that America has ever seen. After outlining HARP’s background, the background of the housing crisis, the roles of Government-sponsored entities, and the effectiveness of the most current
federal responses to the crisis, this report will detail
policy recommendations and changes to the current programs that may help to further alleviate the problems discussed in this report, and more effectively achieve the stated goals of the MHA and HARP.

▼ Over the years, prison populations have varied extensively. For the first time in over 30 years, national prison populations began to decrease in 2010. While there are a number of factors influencing this trend, part of such decrease has been the result of changing parole practices. In attempts to respond to the growing parole population and reduce recidivism among parolees, the U.S. court system has begun implementing reentry courts. The current study sought to evaluate the implementation well as pro-active application of evidence-based practices among three reentry court program sites. Three
federal reentry courts in a southern district of
federal probation in a southern state were selected for the purposes of this study.
A total of 22 semi-structured interviews were conducted on graduates of the reentry court programs (n = 13) and contextual stakeholders (n = 9) in the reentry court process. Additionally, a review of each program site materials as well as on-site observations was conducted for data analysis. By comparing and contrasting the perceptions of graduates as well as stakeholders, conducting on-site observations, and reviewing program materials, the current study provided insight into
what works in these programs. Particular attention was also given to assessing the effectiveness of such practices as well as challenges faced by both practitioners and policymakers in implementing what has been deemed an effective evidence-based practice— reentry court.

▼ This dissertation attempts to make two contributions. First, it is a historical investigation of pivotal points of inflection in the history of the U.S.
Federal Reserve System, from the long nineteenth century through 1955. Second, it attempts to give content to the ill-defined sub-discipline of institutional history beyond organizational biography, historical institutionalism, and new institutional economics. Instead, by taking up the history of the U.S.
Federal Reserve System, the dissertation seeks to bridge a divide between different versions of the concept of “institution” that permeate both common language and academic discourse, namely, institutions as “rules, laws, and norms,” institutions as organizations, and institutionalization as a historical process. The dissertation argues that institutions are both rules and organizations, and that the historical process of “institutionalization” is both more fragile and more random than most previous accounts suggest. I call this kind of institutional history “narrative institutional history” to distinguish it from the study of institutions associated with quantitative economic history.
In service of both substance and theory, I tell the Fed’s story through multiple “foundings,” a pluralization meant to invoke periods of intense institutional change. We cannot understand the Fed’s creation as the legislative compromises of the Progressive Era, as the story usually goes. Instead, the Fed is a moving target, an institution that goes through fallow periods of institutional inertia and sudden bursts of institutional change. This early history of the Fed tells us not only about how U.S. society grappled with the perennially thorny problem of defining the national and international basis for money, functionally and structurally, but also how laws, norms, rules, and organizations struggled to solve those problems—and how actors well after the fact sought to reinterpret past history to justify and legitimize their own preferred policies. In the process, the dissertation asserts the independence of institutional history as a viable subdiscipline, distinct from, if related to, cognate subdisciplines such as political, economic, intellectual, legal, social, and cultural history.

▼ Abstract This multi-case study explores how local policy actors – teachers and administrators – interpret new state teacher evaluation policies developed in response to federal pressures. In the study’s first phase, local policy actors from six small school districts in two U.S. states were interviewed about their efforts to develop teacher evaluation systems to address new state policies. In the second phase of the study, interviews with state-level policy actors in the two states expanded on themes from the first phase. The study’s conceptual framework recognizes policy interpretation as a distinct phase in the policy process, and it addresses the context, influences, and multiple actors involved in policy interpretation. Using an open coding approach consistent with grounded theory, interviews were analyzed, and supporting documents were used to triangulate the data. The study finds that local actors embrace teacher evaluation as a means of professional growth, yet they hold serious concerns about including measures of student growth in teacher ratings. In addition, the study reveals that the density of collaboration at the local level influences the scope of policy interpretation; that local policy actors rely on state-level stakeholders – who are shown to serve as policy intermediaries – to aid in policy interpretation; that the messages of policy intermediaries influence local actors’ understanding of policy goals and attitudes toward implementation; that collaboration among policy intermediaries benefits local policy actors; and that state political culture influences policy activity at both the state and local levels. Since this case study was conducted in only two states and only a small number of local and state-level policy actors were interviewed within each state, a total of 35 participants across both phases of the study, the research is limited and findings cannot be generalized.

▼ Abstract: The goal of this thesis is to analyze the "non-conventional" monetary
policy actions taken by the
Federal Reserve from 2007 onwards, as a direct result of both the new role assumed by big banks in the financial system, with their revamped modus operandi, and the emergence of the shadow banking system. Therefore, this thesis starts by discussing banks as essential institutions in the monetary production economy, which create liquidity endogenously by increasing their liabilities when acquiring an asset, thus advancing purchasing power. At the same time, banks are institutions that generate financial instability. Afterwards, the regulatory changes that took place in the United States in the 1980s and 1990s will be analyzed, as well as the increased importance, depth, and complexity of financial markets, which resulted in great changes in banking activity by making capital markets highly leveraged, and featuring joint operations of traditional banks and deregulated institutions in the so-called shadow banking system. Such system, made up by the interaction of banks and non-banks in markets with little or no regulation, also creates liquidity endogenously. However, this liquidity is "shadow": while banks create liquidity based on their ability to access the Central Bank, shadow banks¿ creation of liquidity depends on their ability to constantly refinance themselves in the market. Shadow banks¿ liabilities are considered "near money" during booms, but crises make their inferior qualities emerge and liquidity simply vanishes. Finally, there is a discussion on how the subprime crisis, which started when the main markets inside the shadow system collapsed, led the
Federal Reserve to act in a non-conventional way by creating government-sponsored liquidity, rescuing markets, and creating an extensive program of public and private asset purchases in the so-called Quantitative Easing program. Such actions by the
Federal Reserve indicate the need of an immediate discussion about the new roles of monetary
policy in modern financial systems

Este estudo analisa as percepções do BC sobre o quadro peculiar que se desenvolveu, a partir de 2001. A recuperação econômica foi pautada no consumo e no mercado imobiliário, inclusive na extração de renda derivada da valorização dos imóveis, seguida do risco de deflação que, posteriormente, deu lugar a receios crescentes em relação ao que ocorria nos mercados. O instrumento utilizado para isso é a análise minuciosa das atas do FOMC e os pronunciamentos dos dois presidentes do Fed, de 2001 a 2007, Greenspan e Bernanke, além das concepções teóricas e problemas conjunturais do período. A metodologia de análise justifica-se porque a comunicação com o mercado tornou-se instrumento relevante na ação do Fed, desde os anos 1990. A análise dos documentos mostrou que, no rescaldo das crises, de 2001-2002, o Fed reconhecia no consumo e no mercado imobiliário forças importantes na recuperação econômica. A partir de 2003-2004, membros do FOMC demonstravam preocupação quanto ao comportamento especulativo no mercado imobiliário e os efeitos que a reversão da política monetária expansionista teria sobre os preços dos imóveis e sobre o consumo. A ação do Fed para combater esses riscos foi contida pela crença na resistência do sistema financeiro desregulamentado, pela confiança na condução pragmática da política monetária orientada pelo risk management approach e pela convicção de que BC não deve agir frente à formação de bolhas
In the analysis of the origins of the severe financial crisis, which began in 2007 in the US, remains an open debate about the reasons that led the Fed to underestimate the severity of the crisis. This study analyzes the perceptions of Central Bank on the peculiar context that has developed from 2001. The economic recovery was based on consumption and housing market, including the income extraction derived from valued housing, and followed by the risk of deflation, which subsequently led to growing fears about what was happening in the markets. The instrument used for this is the thorough analysis of the minutes of the FOMC and the pronouncements of the two presidents of the Fed, from 2001 to 2007, Greenspan and Bernanke, in addition to theoretical concepts and economic problems of that period. The methodology is justified because the communication with the market has become a relevant instrument in the Fed s action since the 1990s. The analysis of documents showed that in the aftermath of the crises of 2001-2002, the Fed used to acknowledge consumption and housing market to be important forces in the economic recovery. From 2003-2004, the FOMC members showed concern about the speculative behavior in housing and the effects of the reversal of the expansionary monetary policy would have on property prices and on consumption. ▼ For any public educational policy, which has a critical influence on how K-12 education is reformed, there should be some framework for public deliberation and debate that allows all stakeholders to have a voice. Race to The Top (RT3) is a
federal educational policy that has had, and continues to have, major influences on the US educational system and on our children’s experiences at school. Georgia’s successful proposal for federal RT3 grants, and hence the adoption of these federal
policies, originated at the state education department level, primarily from the governor’s office and only involved some local school boards. This inquiry utilizes a case study methodology to examine the educational policy implementation process from
the federal level, through state and district levels, down to the local community, as it relates to RT3 Georgia, and to identify the voice of local communities in that process. In particular, it focuses on how RT3 is translated into a locally implemented
educational reform policy, the stages of that process, the policy actors at each stage, the decision making process, and the opportunities and level of involvement of local communities. Data collection included interviews with Georgia state education
officials participating in the reform initiative, in addition to document analysis and employed three theoretical lenses – implementation regime framework, advocacy coalition framework, and policy cycles and institutional trends. This examination of the
implementation of RT3 in Georgia has resulted in four primary findings: 1) Race to the Top in Georgia presents as a very clear example of the top-down model of policy implementation. 2) The framework and characteristics of this particular reform
initiative have, currently, produced high levels of fidelity between policy design and policy implementation in Georgia. 3) Significant barriers to public participation and debate included key aspects such as time constraints, major political activities,
the existing state education organizational structure, the established norms within existing state educational agencies, and the absence of motivational factors that may have encouraged greater public debate. 4) Three of the four areas of reform are
currently impacting instruction at the classroom level and are likely to develop into institutional trends.

▼ This research documents how three winning states responded to Race to the Top (RTTT), a federal competitive grant program, and explores how they aligned state strategies with federal expectations. Focusing on the specific policy of principal
pay-for-performance, also known as “merit pay,” the study traces the evolution of that policy in the politically diverse states of Delaware, Massachusetts and Tennessee. The research documents how the policy was developed and how it plans to be
implemented both at state and district levels. This study utilizes a case study methodology to understand the complexities of the policy process and the alignment between state and district practices within a specific state policy context. The
development of state policies in the context of a federal grant program is explored using a cross-case analysis of multiple state cases. Data collection included interviews with 34 state and national informants, in addition to document analysis and field
notes. The data analysis is both within-case and cross-case, based on frameworks from new federalism and policy instrumentation, and uses the interpretive lenses of sense-making and motivational theory. This examination of policymakers’ understanding of
pay-for-performance policy in the context of RTTT resulted in four primary findings: 1) the competitive grant process creates a shared understanding among local policymakers; 2) local strategies prioritized teachers over leaders, despite a balance in the
grant requirements; 3) the role of the federal government is to encourage local adaption while steering toward larger policy objectives; 4) policymakers understand pay-for-performance to be a component of a larger human capital strategy and not a
stand-alone strategy. These findings underscore the importance of policy adaption to local context and the staging of policy implementation. Implications for policymakers and suggestions for further research are also presented.

▼ This dissertation uses historical analysis to understand the political and social conditions that allowed for the creation of a cabinet-level Department of Education when many congressional representatives, state governments, and citizens of the United States were ideologically against
federal involvement in education. A cabinet-level Department of Education posed problems for the United States because nowhere in the nation’s Constitution is education mentioned, thus leaving education to be a function of the states according to the 10th Amendment. This dissertation looks at calls for a department of education leading up to and including the one initiated by Jimmy Carter. Conducting a historical analysis of the creation of a cabinet-level Department of Education allows for the analysis not only of educational policies but also of culture and society both outside of and within the political sphere. This study relies on documents from the Carter presidency, the National Education Association, the American Federation of Teachers, Congressional records, education polls, and the New York Times and Washington Post, as well as secondary sources related to the various calls for a creation of a cabinet-level Department of Education and
policy pieces associated with the creation. The study concludes that while the legislation for the creation of a cabinet-level Department of Education was politically motivated, it would have been difficult to pass if the
groundwork for
federal involvement in education had not already been put in place through previous congressional legislation and court decisions. By easing public sentiment and creating a need for managerial and administrative reform these prior acts of Congress and the courts paved the way for a cabinet-level Department of Education.

This research introduces a new model for understanding how narratives around poverty and federalism interact. This PovFed model uses a principal-agent structure to identify the federalism orientation of individual states and a deservingness model to identify orientation toward poverty. Putting these two together provides a tool for understanding how these two narrative frameworks interact. The PovFed model enables social workers in policy and public administration conserve advocacy resources in the short term by framing policy options in line with prevailing narratives, and provides a structure for building toward long-term narrative change.The way we talk about policy issues conveys important evidence of the stories we form around social problems. These shared stories are more deeply held than political or ideological orientations. Narrative policy analysis provides a framework for identifying linkages between these explanatory stories and policy initiatives; creating a powerful tool for social workers and public administrators to increase the productivity of their efforts toward social justice goals. This paper tests the utility of this approach focusing on state poverty reduction initiatives and the intersectionality of causal stories related to poverty and the state-federal partnership.The debate over whether and how to intervene to reduce poverty and/or alleviate can be described not as one coherent narrative but as several narrative frames that each remain relevant today. Similarly, narrative frames regarding the parameters that bound state-level and federal-level intervention in poverty, the boundaries of federalism, remain both contested and enduring. Analyzing state poverty initiatives in the wake of the economic crisis of 2008-2009 reveals that states who took up these initiatives generally aligned with theories related to devolution rather than hollow state theories, as these states assign significant levels of agency to their level of government. These states also were aligned more strongly with causal stories or narrative themes related to poverty that locate cause in societal and economic spheres rather than on individual behaviors. A typology of states is proposed that may future efforts to reduce poverty within states by focusing on causal stories. While further research is required to validate this typology with larger sets of states and comparative data using a poverty measure that accounts for state actions, this theoretical typology of states may inform future state-federal partnerships that leverage the complexity of poverty-related narratives to reduce poverty.

▼ Throughout the nation, grocery retailers are reentering underserved communities amidst growing public awareness of food deserts and the rise of federal, state, and local programs incentivizing urban grocery stores. And yet, even with expanding research on food deserts and their public health impacts, there is still a lack of consensus on whether grocery stores truly offer the best solution. Furthermore, scholars and policymakers alike have limited understandings of the broader neighborhood implications of grocery stores newly introduced into underserved urban communities.This dissertation analyzes how local organizations and agencies pursue grocery development in order to understand the conditions for success implementation. To do this, I examine the historical drivers, planning processes, and outcomes of two extreme cases of urban grocery development: a Fresh and Easy Neighborhood Market (a chain value store) in San Francisco's Bayview Hunters Point and the Mandela Foods Cooperative (a worker-owned cooperative) in Oakland's West Oakland districts. Through a comparative institutional analysis, I find that both Fresh and Easy and Mandela Foods reflect distinctive neighborhood revitalization legacies, critical moments of institutional capacity building, localized versions of national policy narratives, and the role of charismatic leaders in grocery store implementation. While national narratives shape the rhetoric of urban grocery development, ultimately local context dictates how food access issues are defined, who addresses them, and how. These findings suggest that federal grocery incentive programs should: 1) maintain a broad framework that enables local communities to define food access problems and their solutions on a case-by-case basis, 2) encourage diverse solutions not limited to grocery stores and supermarkets, and 3) emphasize community reinvestment goals.

▼ Research for this dissertation focused on a close reading of Aaron McGaffey Beedeâs journals, letters, and publications. Contemporary sources were used to compare or explain ideas and actions. Rather than an exhaustive treatment of secondary sources, the dissertation uses a broad sampling of topics and sources in an attempt to pull together many of the disparate threads that provide the context for Beedeâs thoughts and actions.
This dissertation began as a study and explanation of the work and legacy of the Episcopal missionary Aaron McGaffey Beede, particularly his work in preserving Indian customs, traditions, and stories. Understanding Beede and his work proved to be complex, however, in that it brought together many aspects of his time and it required a deep probing into the concepts of identity formation.
In many ways, Beede was similar to other early twentieth-century missionaries in his willingness to stand up for better treatment of Indians and his attempts to convert them to Christianity, as well as his efforts to push âcivilization.â He did not, however, see his duty in the same way that other missionaries did. Beede blended his Christian faith and religious studies with his training in and study of social sciences. Together, these perspectives formed the lens through which he viewed mission work. This meant that not only did he attempt to instill Christian values in those under his care, but he also sought to assist people in âworking out the possibilities of their existence,â whether religious or secular.
Though mission work took much of his time and effort, Beede also worked to preserve the history and culture of the Indians with whom he worked. He believed that history and culture helped to form the identity of individuals, and groups both in the past and in the present. Peoplesâ understanding of who they are also directs their future. Because of this, Beede believed that it was important to record and share Indian history and culture, both to provide a foundation for Indian identity and also as a corrective to the misconceptions that many had of Indians. More than this, he also hoped that finding links between Indian and white cultures could help to create a shared identity and, through this, expand the opportunities available to Indians.
His efforts to increase possibilities for Indians also drew Beede into politics. The starvation he witnessed on Standing Rock Reservation in 1913 led him to call for a reevaluation of
federal policy. His central concern was not merely reforming policies and eliminating corruption, but freeing Indians from the restrictions of these policies by securing for them, through full American citizenship, rights and protections. His approach to, and involvement with politics led some, even some in his own church, to ask whether his conduct was unbecoming of a missionary. ▼ Title I of ESEA was and continues to be the largest single funding source to support our nation’s most struggling students (Davis, 1999). The purpose of this study was to draw on policy and language analysis perspectives to examine changes in ESEA, specifically in Title I Part A, through its reauthorizations as the No Child Left Behind Act (NCLB) and the Every Student Succeeds Act (ESSA). A language analysis of the texts of these acts found changes in key specific language between each reauthorization, affecting the intent and scope of the original ESEA (1965) legislation. Four dimensions of a conceptual framework for understanding policymaking in education developed by Cooper, Fusarelli, and Randall (2004) were used to further analyze the texts of ESEA and its reauthorizations.
Findings of the study showed that for many policymakers Title I was a first step toward general federal aid. The means of calculating, allocating and distributing funds were clear; however, the means for determining the effect of funded programs on the cycle of poverty were not clear. Supporters of NCLB favored increased accountability for student achievement and failing schools, along with financial flexibility. However, implementing NCLB was costly and cumbersome. ▼ The dominance of motor vehicle use throughout America reflects a massive government intervention on behalf of automobiles. Congress directs billions of dollars into America's highway system annually, assuming that building new roadways is the best option to move people and goods from one place to another. These policies stand in direct contradiction to today's travel patterns.
This research examines ways to improve
federal law to achieve a more sustainable transportation future. First, it identifies the specific provisions in
federal transportation law that inhibit the development of "low-build" transportation projects. Second, it describes challenges to halting roadway construction through litigation in
federal court.
Understanding the problems of
federal transportation law and litigation sheds light on the ways to make positive change in the next
federal surface transportation reauthorization. This research culminates in recommendations for how Congress can implement policies that require a comprehensive approach to transportation planning.

▼ The Homelessness Prevention and Rapid Re-Housing Program (HPRP) is a 1.5 billion stimulus program that came out of the 2009 American Recovery and Reinvestment Act. Funds are administered by the U.S. Department of Housing and Urban Development and were distributed to qualifying communities to provide Housing First and housing stabilization services to individuals and families in need. Lane County, Oregon received a total of 1,490,050 to coordinate HPRP services for the Lane County community. This research explores the following question: Has the HPRP model effectively built long-term, sustainable solutions to homelessness in Lane County, Oregon? It assesses the highlights and challenges of the program’s implementation and how these relate to the program’s influence on future policy and long-term solutions to the homelessness epidemic both locally and nationally.

▼ While it is generally agreed that First Nations in Canada are facing a housing crisis in their communities, the Canadian public has largely misunderstood what the crisis of housing is, thus frustrating efforts to improve the situation. A re-conceptualization of the problem of on-reserve housing as a crisis of governance with roots in processes of colonialism (both historical and ongoing) offers the possibility of addressing the crisis and moving forward. This research seeks to situate housing as an important site of engagement for First Nations and settler society (as important in decolonization efforts as it was in colonization) and points to the importance of relationships both within Indigenous communities and with settler society in restoring governance and improving housing. Housing has been a contested site throughout the history of First Nations-settler relations, with colonial policies focusing on reshaping how First Nations lived. These policies have been consistently resisted by First Nations. This history of struggle provides the crucial context for understanding how and why housing has reached an impasse. This impasse is illustrated by examining
federal housing
policy, which appears to offer increased community control over housing but does so without addressing underlying governance and capacity issues. First Nations are becoming increasingly responsible for on-reserve housing without corresponding supports or redress for the history of colonialism that has created the crisis. Current approaches to solving housing problems on-reserve are then critically assessed, focusing on
policy and legislative moves toward homeownership and privatization on-reserve. I argue that this approach circumscribes self-determination for First Nations in particular ways, reducing these claims to a set of market based options. Finally, several innovative community housing initiatives are examined, moving beyond the debate to privatize. Priorities identified are consistent across the examples: housing is at the service of the community, is affordable, builds local capacity, is self-sustaining, is culturally and environmentally appropriate, and the locus of authority remains in the community. The initiatives were achieved by cultivating relationships, both within First Nation communities and with settler society. In this thesis, I suggest the importance of housing for decolonization efforts for First Nation and settler alike.

▼ Borders and border barriers can be breached and boundaries and political agendas can change. The Great Walls of China, Hadrian's Wall, and the Iron Curtain have lost their strategic value. Walls are contested presently in the Middle East. And the unpopulated DMZ in Korea, while still of strategic value, is being recognized for its biodiversity and resurgence of endangered flora and fauna. Presently, the United States is building a defensive wall along the U.S.-Mexico border in the name of national security and to stem the tide of drug and human trafficking. In the process it has waived numerous environmental laws thereby putting transboundary ecosystems in danger of irreparable harm. Why should there be interest? For the reason, as put forth by Mumme and Ibáñez, that while much attention has been paid to adverse environmental effects within the United States, "little attention has been given to the potentially complicated effects of the international boundary, water, and environmental agreements to which [the United States and Mexico] are party should Mexico choose to press its rights at the level of international law. . . . As international treaties and protocols, these agreements enjoy a legal standing that may supersede the authority of most domestic legislation." The implications are far reaching. Mexico has sent diplomatic notes to the U.S. embassy in Mexico and to the U.S. Department of State, and the Secretaría de Medio Ambiente y Recursos Naturales (SEMARNAT), Mexico's environment secretariat, has held informal talks with the Department of the Interior (DOI) and with the Secretary of Homeland Security – all apparently of no avail. Canada's notes have been similarly ignored by the Department of Homeland Security. What then for the U.S-Mexico border fence? Will it eventually become a relic of past political
policy? Is the United States to ignore the lessons of the past and void its environmental treaties and agreements with Mexico? Should we not be concentrating on comprehensive immigration reform and the causes of drug abuse in the United States rather than a short-term solution to long-term problems?

▼ This research project examines the degree of transparency of the Canadian Federal Government’s decision-making processes and institutions with respect to the human consumption of animals produced through modern biotechnology (biotechnology-produced animals). It provides a timely study of the Federal Government’s decision-making process; as of January 2013 the government has yet to determine whether, and how, biotechnology-produced animals are to be approved for human consumption. Foods that contain genetically modified organisms (GMOs) are already commercially widely available in Canada. Research is well underway to see if biotechnology-produced animals may also be developed and introduced into the food system.
Government decisions regarding the human consumption of biotechnology-produced animals have the potential to revolutionize food systems globally and nationally. This thesis offers an analysis of primary and secondary data focusing on the degree of federal transparency with respect to regulating GMO foods generally and, more specifically, the emerging policy issues around biotechnology-produced animals. This exploration sets the stage for the following investigation of barriers as well as opportunities to fostering federal transparency with respect to policy and regulatory decisions regarding GMO foods. Findings are directed towards members of the communities of interest who are interested in questions relating to the degree of federal transparency and government approaches to foods that contain material produced through modern biotechnology.

▼ The objective of this dissertation is to document how white property owners in Cobb County, Georgia achieved political, economic, and social influence over local and state affairs by the mid-twentieth century through processes of racial privileging and
policy-making. Prior to World War Two, the county’s white property owners were historically divided into two competing political factions of equal demographic size with one faction residing in rural unincorporated parts of the county, and the other in urban centers. For much of their history, these two factions waged political battles against one another over the distribution of real and personal property taxes. In 1937, the two factions joined forces to push for a statewide homestead exemption to lower property taxes collected at the state and county level. The sudden loss of revenue financially devastated local governments across the state. In Cobb, city and county politicians and civic leaders began to search for new ways of raising revenue, including home-building campaigns, expansion of municipal utilities, and the courtship of
federal investment. Through a combination of local planning and
federal intervention, Cobb County’s quest to raise revenue shaped a racialized built environment that privileged the interests of white homeowners and ultimately influenced how white property owners saw themselves and the world around them through the
policy-making process.
The primary vehicle for this study will be tax
policy, a largely understudied yet critical component of the built environment. The trajectory of the white property owner in Cobb County is complicated, as it ties the effects of local, state, and
federal policy-making to sets of identity politics influenced by white supremacy and formed over the course of several decades. It is a study long overdue for investigation as it lays the groundwork for understanding how property and financial self-interest would inform the political and social positions of white homeowners in the second half of the twentieth century. Within this convergence of racial and economic issues, one question is paramount: How did the interconnected political and social formations of white supremacy and property ownership change over time within the context of state and local tax
policy debates?

▼ Much has been made of the student loan crisis in recent years. Policymakers, families, and the media alike have blamed student debt for a number of the United States’ less desirable macroeconomic trends. Though the perceptions of student
loan debt are dire, rigorous examinations of the effects of student loan debt on post-graduation outcomes are few and far between. This study provides quasi-experimental evidence on the effects of student loan debt on a number of early adult outcomes. In
short, the findings suggest that debt has little to no impact on post-collegiate outcomes for college graduates.

▼ This study examines the conflicts, contradictions, and assumptions of policy-makers who tried to reconcile the transformation of U.S. communications policy from a theoretical paradigm that included public service idealism and social aspiration to a regulatory regime that came to be dominated by market forces pragmatism. Although there has never been a universally accepted articulation of broadcasters’ obligations to the public that has remained consistent over time, the struggle over this contested terrain came to dominate the controversy over media ownership regulations during Federal Communications Commission (FCC) Chairman Michael Powell’s tenure from 2001-2004. Powell’s emphasis on economic competition as a means to serve the public interest in broadcasting did not resonate with the interpretive communities whose support was needed to forward his agenda. This study investigates the gulf between Powell’s interpretation of the public interest and that of other stakeholders groups in the policy-making process. The data examined for this project include several types of primary sources: official FCC policy memoranda and orders, statements, research reports, the text; of speeches made by FCC commissioners, as well as transcripts of public hearings conducted throughout the period of study. Additional data were gathered from Congressional hearings and testimony, legal documents and decisions, and research reports conducted by public service organizations. Secondary sources were used to provide context;. Trade journals, academic journals, newspapers, other periodicals produced by interested parties are included in this category. This study grouped policy stakeholders into relatively discrete interpretive communities so that the perspectives of each could be examined. Although the FCC, Congress, the courts, industry groups, and the public have varying degrees of influence over policy decisions, each of these groups had unique perspectives that contributed to policy-making process during the FCC’s Third Biennial Review procedures. This study finds that despite the comprehensive reappraisal of communications policy that was ushered in after the enactment of the Telecommunication Act of 1996, the focus of the FCC on pragmatic market considerations did not diminish the desire of some stakeholders to perpetuate communications policy that includes a measure of social aspiration and public service.

▼ This series of papers investigates money as a criminal sanction using a variety of approaches. Paper 1, "Money As A Criminal Penalty: Its Uses and Meanings," explores the theoretical underpinnings and empirical use of monetary penalties, providing a thorough assessment of the complexities entailed in the fair and efficient use of these sanctions. Paper 2, "Substitute & Supplement: The Multiple Functions of Monetary Penalties in Federal Sentencing," uses an innovative approach of focusing on severity and likelihood for both sanctions. The results of hierarchical linear modeling suggest that monetary penalties are used as both a substitute and supplement to incarceration. The main contribution is a more accurate characterization of the relationship between prison and monetary penalties. Paper 3, "Assessing the Effect of Booker on Monetary Penalties and Prison," explores the effect of the Supreme Court ruling in United States v. Booker (2005) on the use of monetary penalties and incarceration in federal sentencing. This analysis uses a matching algorithm to create comparison groups with more balanced observable characteristics. The result is consistent evidence that race and gender continue to be quite influential in sentencing outcomes and that greater post-Booker judicial discretion is associated with more volatility in the use of monetary penalties than prison. By providing a thorough, multi-faceted, and methodologically rigorous account of monetary penalties, these papers significantly advance our understanding of a ubiquitous and complex criminal sanction.

▼ Each year about 5,000 fatal, 50,000 injury and 100,000 property-damage crashes involve large trucks resulting in social costs exceeding 32 billion. Social costs for fatal crashes are large (6 to 8 million per crash) yet rare (two to three occurrences per 100 million miles traveled). Federally-mandated liability insurance requirements established in 1983 intend to motivate safety and ensure adequate compensation for damages; hence scrutiny of the 750,000 minimum insurance requirement is warranted and timely.; Commercial motor vehicle safety policy is designed to reduce losses – particularly the loss of life – while addressing issues of equity and efficiency. Each year more than 1,000 federal employees and 550 million are dedicated to implementing policy ensuring large truck safety. Regulations combined with post-crash liability impact safety decision-making.; My hypothesis is that firms that boost their financial commitments to reduce crash risk will experience fewer crashes. I use a unique panel data set to test this hypothesis. The data follow 2,100 firms from 1998-2004 and include operational and financial information, crash information and government safety measures for individual motor carriers. Using well-defined motor carrier behavioral models, multivariate econometric analysis provides explanation of variability in crashes using financial and operating characteristics.; Strong evidence supports clear recommendations for federal motor carrier safety policy. These recommendations are: 1) raise the minimum insurance requirement; and, 2) improve the measurement of management safety practices. For the largest portion of the trucking industry, the general freight truckload sector, I found that increases in insurance premiums and claims paid yield decreased fatal crash rates in the future. This evidence suggests that an increase in the minimum insurance requirement will improve safety and reduce the gap between the cost of crashes borne by injured parties and the motor carrier. Safety scores for drivers and vehicles are closely related to crashes, yet an effective management safety score is absent. An accurate and widely-available management safety score would also improve safety, equity and efficiency.

▼ Information Technology (IT) provides public sector organizations the capability to provide real increases in organizational effectiveness by aiding in the efficient exchange of information. Adoption of advanced IT such as service oriented environments, Web 2.0, and bespoke systems such as Enterprise Resource Planning (ERP) promises to markedly improve that capability via presumed gains in efficiency. However, this presumed associated gain in organizational effectiveness may be stymied/enhanced by constraints or incentives, particularly as they may relate to information sharing. This thesis reports on research in this area framed within a case study environment. The dissertation addresses data collected and findings associated with a survey of public sector organizations. It provides, in some detail, the analytical steps involved in the method and reports findings.

▼ As análises recentes sobre a participação do Poder Legislativo na definição da política externa nacional criticam o entendimento de que os parlamentares brasileiros seriam desinteressados nas questões externas. Assume-se que o comportamento parlamentar apareceria circunscrito por limitantes político-institucionais, os quais definiriam a forma como ocorre a participação. A presente pesquisa parte desse pressuposto para avaliar os trabalhos legislativos no âmbito da Comissão de Relações Exteriores e Defesa Nacional do Senado Federal. Os achados permitem afirmar que os membros da Comissão assumiram não somente uma postura interessada, mas também exerceram controle e influenciaram a política externa colocada em vigor pelo Executivo.
Recent analyses about the participation of the Legislative Power on the definition of the national foreign policy review the judgment that the Brazilian members of parliament are disinterested in external issues. It is assumed that the parliamentary behavior appears circumscribed by political and institutional restrains, which are defining the manner on which participation occurs. The present research parts from this presumption to evaluate the legislative work in the Foreign Policy and National Defense Committee of the Federal Senate. The findings allow us to affirm that the Committee members not only assumed an interested posture, but also exerted control and influenced the foreign policy carried out by the Executive Power.

▼ Esta dissertação busca contribuir para a reflexão a cerca da produção habitacional autogestionária voltada para a população de baixa renda. Para desenvolver essa discussão, primeiro construímos uma abordagem histórica da trajetória do movimento de moradia em torno da apropriação do princípio da autogestão, a partir da política habitacional do Regime Militar ao Governo Lula. Partimos do pressuposto de que o desenho das políticas públicas, particularmente a habitacional, é resultado da disputa de interesses e da interação entre Estado, mercado e sociedade civil. E que a partir dessa interação o movimento popular se formou, amadureceu e passou a interferir na formulação das políticas habitacionais. Assim, o processo de criação do Programa Crédito Solidário, parte integrante da atual Política Nacional de Habitação, não é uma simples reivindicação pontual, mas um passo na trajetória decorrente dessa interação. Ao analisarmos os processos de pleito, elaboração, operacionalização e implementação do Programa Crédito Solidário, definido como o instrumento de análise para compreender qual a importância da autogestão na política habitacional do Governo Lula, foi possível verificar os limites e potencialidades para a efetivação do princípio da autogestão na atual ação pública habitacional.
The present dissertation is a reflection about the selfmanagement housing production directed towards the low income population in Brazil. To achieve our objective, we first devoted our research to a historical reconstruction of the popular housing movement trajectory and its relation to the selfmanagement principle, inside the national housing policies, from the Military Regime until the President Lulas Government. In this context, we assume that the construction of any public policy, and especially the housing one, is a result of the natural dispute of interests between the Government, the market, and the civil society. Furthermore, we believe that the popular housing movement is a result of this interaction, where it grew, matured, and started to interfere in the housing policies formulation. Therefore, the creation of the Program of Support Credit, as part of the National Housing Policy, is not a simple punctual claim, but another step in the trajectory resulted from this interaction. In the process of analysis of the of election, elaboration, operation, and implementation of the Program of Support Credit defined as our instrument of analysis to understand the importance of selfmanagement in the Housing Policy of Lulas Government we verified the limits and potentialities for an effective use of the selfmanagement principle in the current public housing action.

▼ O presente estudo tem como objetivo analisar a percepção dos profissionais da saúde ocupacional da Universidade Federal de Ouro Preto sobre o processo de institucionalização da política de atenção à saúde e segurança do trabalho do servidor público federal. A pesquisa pode ser classificada como um estudo de caso, do tipo descritivo. Os meios de investigação utilizados foram: pesquisa documental e de levantamento. Os sujeitos sociais foram oito profissionais que estão participando da implementação da política. Os dados foram coletados por meio da realização de entrevistas semi-estruturadas junto aos sujeitos sociais e por meio de análise documental. Os dados foram analisados por meio da técnica de Análise de Conteúdo. Os resultados indicaram que a política tem atingido seu propósito de inserir os parâmetros para a consecução das ações de saúde e que o Acordo de Cooperação Técnica firmado entre UFOP e IFMG tem sido importante nesse processo. Também, indicaram que o Subsistema Integrado de Atenção à Saúde do Servidor - SIASS tem sido favorável para subsidiar a implementação da política. Verificou-se ainda como facilitadores, o treinamento e o apoio do Ministério do Planejamento, Orçamento e Gestão, que auxiliou na instalação da unidade SIASS Inconfidentes. Dentre as dificuldades, os resultados evidenciaram problemas no processo de comunicação da política e na atuação conjunta da equipe multiprofissional. Ainda, apontaram a PASS como uma mudança de cultura em termos de saúde ocupacional e por isso torna-se imprescindível o controle e o cumprimento de todas as normas propostas pela política. Assim, diante do exposto, ressalta-se que este estudo contribui no sentido de analisar uma política a partir de sua implementação. Acredita-se ainda que, para que a UFOP atinja o nível de total institucionalização da política, além da necessidade de propagar a estrutura para todos os servidores, deve-se internalizar todas as normas para que estas sejam parte da cultura e se perpetuem ao longo do tempo na Instituição. Também acredita-se que os resultados encontrados possam permitir um diagnóstico preliminar da política de atenção à saúde e segurança do trabalho do servidor público federal, demodo a subsidiar decisões futuras sobre as ações a serem desenvolvidas a curto e longo prazo para a continuidade da mesma, que ainda encontra-se em fase de implementação.
The present study aims to analyze the perception of occupational health professionals at Federal University of Ouro Preto on the process of institutionalization of care policy to health and work safety of federal public servants. The research can be classified as a descriptive case study. The means of investigation used were: desk research and data collection. The social subjects were eight professionals who are participating in the implementation of the policy. ▼ Ao longo do século XX, o Direito do Trabalho esteve associado a um arranjo político e social cujos sentidos estavam vinculados, entre outros aspectos, à civilização das relações de classe e à reprodução do capitalismo com democracia, no âmbito dos Estados nacionais. O propósito desta pesquisa é investigar como ocorreu o processo de deslocamento e reinterpretação desses sentidos (equivalente à codificação da razão do mais forte), no contexto da forte
hegemonia política da coalizão de centro-direita que governou o país entre 1995 e 2002. Nesse período, o Poder Executivo Federal, as principais organizações patronais, setores importantes da mídia impressa e a Força Sindical estiveram empenhados na promoção de profunda alteração dos traços centrais do modelo brasileiro de relações de trabalho, no qual a lei é mais importante na definição dos direitos substantivos do trabalho do que os contratos coletivos.
Para justificar politicamente essas alterações, o Poder Executivo e seus apoiadores apontaram a responsabilidade do modelo legislado pelos elevados custos do emprego formal, a
perda de competitividade da indústria, o aumento da informalidade e do desemprego durante o governo FHC. Por meio da leitura das justificativas dos projetos encaminhados ao Congresso Nacional pelo Poder Executivo, das manifestações de suas principais lideranças e dos apoiadores
na mídia e no meio sindical, a pesquisa busca interpretar o sentido político dessa leitura, apresentada como se fosse solução técnica e modernizante para uma legislação que estaria ultrapassada. Consideramos que a reforma trabalhista tinha claros propósitos políticos pois, além de repassar aos trabalhadores os custos do ajuste econômico nos anos 90, permitiu justificar na cena pública a retração do papel do Estado, bem como fortalecer o apoio de setores
importantes do patronato a esse projeto político.
Throughout the twentieth century, labor law has been associated with a political and social arrangement that, within the national states, reproduced capitalism and civilized class
relations. The research aims to analyze the shift in the interpretation and meaning of labor law, in the context of strong political hegemony of the center-right coalition that governed Brazil from 1995 to 2002. Throughout this period, the Federal Executive branch, the main employer organizations, important sectors of press and unions had been engaged in a battle to change the Brazilian model of work relations, in which labor law is more important than collective contracts, with regard to the definition of labor rights.
In order to justify those changes, the Federal Executive branch and its supporters have considered the burden of the Brazilian model for the formal employment high costs, the

crianças por uma chaga social que responde pelo extenso nome de Exploração Sexual
Comercial de Crianças e Adolescentes (ESCCA), gênero que possui como espécies a
"prostituição", o turismo sexual, a pornografia e o tráfico de pessoas para fins sexuais. Dentre
tais modalidades, demos enfoque à exploração infanto-juvenil que ocorre nas rodovias
federais brasileiras, as BRs, com ênfase no enfrentamento dado a esse tipo de crime pela
Polícia Rodoviária
Federal (PRF). Objetivamos demonstrar a necessidade de estudar, analisar
e compreender as ações de enfrentamento ao fenômeno, no intuito de verificar a eficiência
ou não dessa ação repressiva frente à Exploração Sexual Comercial de Crianças e
Adolescentes. No decorrer dessa pesquisa verificamos a legislação que ampara as crianças
dentro do substrato dos Direitos Humanos, traçamos um breve histórico dessa infância tão
vitimada, identificamos as políticas públicas voltadas para o enfrentamento dessa prática
violadora dos direitos humanos dos impúberes e analisamos as ações da PRF contra a
exploração sexual de crianças. O tema Políticas Públicas foi introduzido na pesquisa com o
intuito de subsidiar o entendimento de um dos instrumentos de trabalho utilizado pelos
servidores policiais na aferição do problema: o projeto Mapear (Mapeamento dos Pontos
Vulneráveis à Exploração Sexual de Crianças e Adolescentes), programa esse que tem o
condão de contribuir com o fomento de Políticas Públicas voltadas para a proteção das
crianças em situação de risco. Quanto aos aspectos metodológicos utilizados para se alcançar
os objetivos, essa pesquisa tem método indutivo e o delineamento da pesquisa desenvolveuse
a partir de uma abordagem predominantemente qualitativa. Além do levantamento
bibliográfico e documental, foi executada uma pesquisa de campo com aplicação de
questionários e entrevistas a dezesseis servidores da Superintendência Regional da Polícia
Rodoviária em Pernambuco. O referencial teórico desse estudo foi baseado em autores como:
ARIÈS (2006), BARDIN (2004), PIOVESAN (2012, 2013) e SOUZA (2006). Assim,
podemos concluir que, apesar de alguns avanços significativos nos últimos anos, a ESCCA
é uma realidade cruel que tende a permanecer presente por muito tempo em nossa sociedade.

demonstração do caráter antidemocrático da judicialização da
política. Para tanto, parte-se de uma análise crítico-descritiva
dos principais teóricos que se posicionam contra – reunidos no
denominado eixo analítico procedimentalista – e a favor –
representantes do chamado eixo explicativo substancialista – da
judicialização da política, definindo-se, também, o conceito de
democracia que servirá de parâmetro fundamentador dos juízos de
valor a serem emitidos, a saber, o da democracia deliberativa,
identificado como aquele que melhor se adéqua ao perfil das
sociedades pluralistas contemporâneas. Para comprovar a constatação
de que o Judiciário brasileiro tem operado a judicialização da
política, citam-se alguns julgados do Supremo Tribunal Federal,
como órgão representante da cúpula desse Poder, responsável pela
última decisão em matéria constitucional, explicitando-se onde,
como e por que essa atividade caminha de encontro aos ditames da
democracia deliberativa. A título de conclusão, a participação
popular no processo deliberativo democrático de formação da opinião
e da vontade políticas, bem como a deferência a esse consenso
discursivo pelas decisões judiciais são apontadas como a via
democrática a ser trilhada.
[en] This work has as its primary focus the
demonstration of the undemocratic character of judicialization of
politics. Therefore, it starts up with a critical-descriptive
analysis of the main theorists who are against – together termed as
the proceduralist analytical axis – and in favor – representatives
of the so-called substantialist explanatory axis – of the
judicialization of politics, defining also the concept of democracy
that will serve as the basic parameter for value judgments to be
issued, namely, the deliberative democracy, identified as the one
that best fits the profile of the contemporary pluralist societies.
To prove the fact that the Brazilian judiciary has operated in
judicialization of politics, it cites some Supremo Tribunal
Federal’s (Brazilian’s Supreme Court) decisions, as the responsible
for the final decision on constitutional matters, explaining where,
how and why this activity goes against deliberative democracy. In
conclusion, popular participation in deliberative democratic
process of opinion formation and political will, and the deference
to this discursive consensus by the judicial decisions are pointed
as the democratic path to be trodden.
