▼ To understand the likely impact of federal policies on nonpoint agricultural water pollution, a robust measure of state-level
environmental regulation stringency is required. The objective of this paper is to derive and characterize state-level
environmental regulation stringency across states and over time. I compute a measure of
environmental regulation stringency for the agricultural sector from 1960-2004 by calculating the shadow price of polluting inputs. The estimation provides evidence suggesting an increase in
regulation stringency across all regions over the sample period, with the exception of the Corn Belt (Heartland) and the Northern Crescent regions, which have decreased in stringency. With few exceptions, regions of the U.S. with the highest proportion of farms see the lowest levels of
regulation stringency.

▼ In this dissertation, I explore how the incentives for firms to invest in green technology are affected by changes in market structure and
regulation. In the first chapter, I use an entry-deterrence model in which the incumbent decides whether or not to invest in green technology where an entrant can benefit from a technology spillover. I identify cases where entry is blockaded, the incumbent will under-invest in the technology to deter entry, and when the incumbent will accommodate entry.
In the second chapter, I analyze a duopoly market with investment in green technology under two types of
environmental regulation: a uniform fee where both firms face the same fee, and a type-dependent fee that is based on the firm's emissions. Firms can differ in their cost of investing in the technology. I find that social welfare is unambiguously higher under the type-dependent regime.
In the third chapter, I use a two-stage game of a duopoly decided to adopt a green technology under emission fees, quotas, and a tradeable permit scheme. I find that firm and regulator incentives are misaligned as firms achieve higher profits under a quota, but social welfare is higher under a fee.

▼ Societies have established various forms of governance to protect the natural
environment from the adverse effects of human activity. While direct “command
and control” regulation has achieved significant improvements in environmental
protection, concerns for its efficiency have led governments to seek alternative
approaches to achieve environmental policy objectives. Commentators describe
a shift from “government” to “governance” as policy makers and regulators seek
to harness wider social forces beyond government, while risk-based regulation
is pursued to target constrained regulatory resources for maximum effect.
However, robust evidence for the effectiveness of different forms of regulation is
lacking. This thesis addresses this gap, providing an evidence base for
instrument selection and a data-informed critique of regulatory reform practice.
Research followed a case study strategy, gathering qualitative data through 58
in-depth semi-structured interviews, analysed using the NVIVO™ Computer
Aided Qualitative Data Analysis System (CAQDAS), with senior policy makers
at the Department for Environment, Food and Rural Affairs, England (Defra)
and senior executives in businesses and trade associations in 5 UK sectors.
(1) A new typology of regulatory instruments has been compiled, validated with
sector experts, refined for policy end-users, and published as part of Defra’s
guidance on instrument selection.
(2) The critical case of instrument selection in practice at Defra has been
examined for the first time, revealing factors affecting choice, the use of coregulation
to develop evidence and the importance of retaining policy maker
skills for new forms of regulation.
(3) A multiple-case study of senior business representatives found five strongly
preferred voluntary regulation, seven expressed significant doubts about its
effectiveness, and 19 expressed no general preference. While voluntary
approaches were valued for flexibility and lower burdens, direct regulation
offered stability and a level playing field. They sought inter alia coherent,
evidence based regulatory frameworks, delivered through positive regulatory
relationships.
This research progresses the better and smarter regulation debate on the use
of alternatives to direct regulation and has already been used to inform policy
making in practice.

▼ This dissertation encompasses three chapters. The first chapter examines the effect of information disclosure policy on triggering peer effects among firms that influence their compliance decisions. The second chapter examines how
environmental attitudes change with economic conditions and whether short-run changes in
environmental attitudes translate into policy changes. The third chapter examines the impact of electoral votes on the distribution of ad hoc agricultural farm disaster payments in the US.
There is growing policy-level interest in the use of information disclosure as a regulatory instrument to improve firms’ behavior. However, little has been done using micro-level data to investigate whether information provision may trigger peer influence among firms that that affects their compliance behavior. Using station-level inspection verification data from the Mexican gasoline market, the first chapter examines whether gas stations react to peers’ performance to adjust their own compliance decisions. The information disclosure policy assigned each inspected gas station with green, yellow, or red colors to indicate the status of compliance, minor violation, and severe violation, respectively. We find strong evidence of peer influence triggered by information spillover. The probability of being in compliance increases as the number of green peers increases. We use both municipalities and postal codes as geographic boundaries to define potential peers, and find similar results. Our findings also indicate that the magnitude of peer effects varies across municipalities: the effects appear to be greater in richer, more educated communities.
A unique feature of the environment is that the consequences of its use are often difficult or impossible to reverse. This implies that short-run changes in
environmental policies can result in long-run effects. In the second chapter, we estimate how
environmental attitudes change with economic conditions and whether short-run changes in
environmental attitudes translate into policy changes, as proxied by voting for Republicans and by changes in representatives’ voting behavior. We find that a 1% increase in a state’s unemployment rate decreases the probability of a respondent prioritizing
environmental protection over economic growth by 0.21-0.67%. A 1% decrease in the mean county income decreases that probability by 0.11-0.12%. However, there is no relationship between changes in citizens’ ideology and changes in their voting patterns or the voting patterns of their congressional representatives. Overall, we show that even though respondents’ attitudes toward the environment are influenced by economic conditions, they do not immediately translate into changes in real outcomes.
The third chapter examines the impact of electoral votes on the distribution of ad hoc agricultural farm disaster payments across counties from 1990 to 2008. ▼ Since the 1980's, New Zealand has undergone some large-scale economic changes – changes that have affected practically every aspect of our lives. The deregulation of the New Zealand economy was undertaken in order to allow market forces to have more control than was previously possible in a country that was well known to support very protectionist measures. Now all this has changed. Naturally this has affected New Zealand businesses, as subsidies and other measures of support have gradually been taken away.
New Zealand businesses are now more at the mercy of global market forces than ever before.
This economic pressure is something that New Zealand businesses of all sizes and in all industries have to contend with. The fourth Labour government imposed a free market ideology upon the country, which has been carried on by subsequent governments, both National and Labour. The high levels of support and protection are now gone. Therefore New Zealand businesses need to concentrate upon their economic well being very carefully, perhaps more so than in the past when businesses enjoyed higher levels of
protection.
However New Zealand is well known for its commitment to the environment, along with its commitment to the free market ideology. During the 1980's New Zealand was active at a global level in voicing its problems with French nuclear testing in the Pacific, US nuclear ships in New Zealand waters, and other environmentally based concerns. The New Zealand government had expressed a concern for environmental issues. In 1991 the Resource Management Act came into being. This act was seen by many as a revolutionary jump towards environmental protection and sustainable management of natural resources. New Zealand is also well known for its 'clean, green' image – an image that is used extensively by the tourism industry in order to entice tourists to visit New Zealand.
This focus on the environment and environmental protection has brought about another pressure for New Zealand businesses. The RMA has set out rules and guidelines for businesses to follow. Therefore New Zealand businesses have to follow environmental policies. This may be detrimental to the business from a short-term economic point of view. Given the current situation within New Zealand, it is easy to see why these two pressures could be very difficult to reconcile for many businesses.
The main purpose of this dissertation was to find out how both economic and environmental pressures could affect both the behaviour and the attitudes of
small firms in New Zealand about the environment and environmental protection within a business framework. ▼ The giant panda (Ailuropoda melanoleuca) is one of the most endangered vertebrates and an iconic symbol of conservation. While progress has been made in understanding its genome, landscape ecology and anthropogenic effects on its populations, many aspects of its biology are unknown. I measured resting metabolic rate of the giant panda and compared it to metabolic rates of other large mammals. The giant panda has a thermal neutral zone that ranges from at least 9 to 26 °C. Its metabolic rate is 6.0% to 44.3% below that predicted by regressions of mass vs. metabolic rate in the literature and that may be due to its strictly herbivorous bamboo diet. These results raise questions about the universal predictive power of physiological relationships such as the metabolic theory of ecology that attempt to predict ecological relationships based on metabolism and body size without considering other variables. For these predictions to be useful and truly reflective of the study animal, basic metabolic data are needed on more large mammals and animals with varied diets, before reliable predictive theories can be formulated. I also measured the field metabolic rate of giant panda. The results showed that FMR varied between individuals despite the active time for each individual being very similar. The water-loop of the giant panda is much faster than predicted. The mean daily energy expenditure (DEE) was 21,592 KJ, (SD = 13,323) per day. That means there is enough bamboo in 1 km2 of the Wolong Reserve to provide food for 81,726 panda days. I measured the resting metabolic rate of red panda as well. There was no difference in metabolic rate between male and female red pandas. The RMR of red panda was higher in the winter than in the summer. McNab measured 2 red pandas in 1987 and found a very low metabolic rate, 0.153 ml/g/h. In my 17 red panda experiments, 0.204 ml/g/h was the lowest value that I measured. The average in summer (0.290 ml/g/h) was twice as high as McNab's mean. The red panda has a higher metabolic rate than previously measured.

▼ In recent decades, in the backdrop of highly constrained government and public sector finances worldwide, private forms of
regulation in natural resource and
environmental policy have gained political and public salience: there is an increased interest in governance with government rather than governance by government. This dissertation, consisting of three essays, investigates the policy impact of bilateral voluntary agreements, one form of voluntary
environmental programs, and the compliance-related decision-making processes involving regulators, corporate actors, and NGO activists that have led to them. The first essay of the dissertation examines the effectiveness of a bilateral voluntary agreement negotiated between the U.S. EPA and the pressure-treated wood industry to ban the use of a poisonous arsenic compound. Unlike earlier studies on voluntary programs, results from dynamic panel estimation and advanced time series techniques show that the voluntary agreement has lowered arsenic use in the U.S. to levels not seen since the 1920s. Moreover, a government-driven information disclosure policy – namely the EPA's Toxic Release Inventory – was effective in decreasing arsenic use, albeit to a lesser magnitude than the industry voluntary ban. Prioritizing
environmental protection through financial resources, as measured by Congress-allocated dollars to the EPA, has also reaped
environmental benefits. Systematic surveys of key stakeholders provide institutional, political, and economic insights into the impact estimates of the bilateral voluntary agreement on arsenic use. Policy process tracing based on the survey data shows that the pressure-treated wood industry was compelled to engage in beyond-compliance action given the existence of a poison-free substitute, market competitive pressures, and the threat of future
regulation. The EPA regulators casted a shadow of public law with the credible threat of future
regulation by "steering" or encouraging voluntary action and sanctioning noncompliance once the voluntary beyond compliance action had occurred. Moreover, third-party stakeholders, such as NGO activists, played an important "accountability" role by pressuring for and certifying firms' beyond compliance
environmental stewardship. In the second essay, I develop a theoretical framework by building on the multiple streams framework (Kingdon, 1984) to explain the compliance-related decision-making processes and apply it to two cases of "successful" bilateral voluntary agreements in mercury and arsenic use, respectively. Specifically, to the problem, policy, and politics streams of the multiple streams framework I add an economy stream and delineate its key variables. I argue that the economy stream demarcates the roles that product substitutes, market competition, corporate social responsibility, the market changer, and the global economy play in creating incentives for businesses to partake in industry self-

▼ To create a safe environment and ensure the well-being of its population, governments apply structured supervision to ensure that the environmental regulations are adhered to. The purpose of this study is to take a deeper look at the efficiency of how supervision in Sweden is carried out, and to compare it to a neighbour country, Norway, by comparing a Swedish municipality with a Norwegian municipality. The study was carried out by studying literature and performing interviews with a representative environmental inspector in each municipality. The results show that there are differences between the countries, both with regards to the regulatory framework and the organisation of its supervision. In Sweden the environmental regulations are concentrated in one Environmental Code, whereas in Norway there are 17 different mostly sector-specific laws that deal with the environment and its protection. Many of the tasks that are carried out by municipalities in Sweden are instead handled by sector-specific departments and/or by private firms in Norway. Inspectors in both countries wanted more guidance and assistance from central agencies. The study also found that it is difficult to compare statistics in both countries because of large differences in how those statistics are presented in the municipalities. The differences between the countries are hard to explain, and both approaches seem to work, but they want to have a more uniform environmental supervision in the future. Norway is also writing more and more environmental rules that apply across all sectors

▼ This dissertation broadly explores the use of panel data methods for identifying the effects of regulation. Chapter 1 applies dynamic panel models to control for potential feedback effects when examining the relationship between environmental regulations and firm performance. Specifically, this chapter uses data from the U.S. manufacturing industry to explore the effects of the Clean Air Act (CAA) on firm performance outcomes related to profitability, employment, and capital expenditures. The evidence suggests that feedback effects are present in the data and, more critically, appropriately modeling these effects can alter conclusions regarding the effects of environmental regulation.
Chapter 2 uses panel data logit-class models to analyze whether the stringency of environmental regulation motivates mergers among regulated firms. Using comprehensive data set that capture both environmental and financial behaviors from a variety of data sources, results in this chapter provide new evidence on the impact of environmental regulation on manufacturing firm M&A activities, suggesting that more stringent environmental regulation (CAA) will motive manufacturing firms conduct more M&As, and market value of M&A firms will increase.
In Chapter 3, my coauthor and I use Monte Carlo experiments to provide insight on how power is influenced by data analysis methods, such as the choice of econometric estimator or whether all or a subset of data is used. Surprisingly, except in very few extreme cases, we find that power does not vary much if one relies on simple difference-of-means tests or instead on robust or structured (i.e. assumption-laden) panel data estimation. However, the simulations provide strong evidence of power loss when uses a subset of the collected data, and power gains through the inclusion of non-experimental control variables (e.g. demographic variables).

▼ Three papers have been included in this dissertation. They are focused on examining a key issue in the domain of sustainable operations and supply chain management: the impact of regulatory pressure on a firm’s heterogeneous adoption of sustainable practices. In the first paper, we review the role of regulations in sustainable operations and supply chain management research. The second paper empirically tests the influence of various characteristics of environmental violations on a U.S. manufacturing firm’s adoption of environmental practices by using the econometric analysis of different data sources, including COMPUSTAT, KLD, and RepRisk. The last paper investigates how regulatory pressure, along with other types of institutional pressure, influences a firm’s adoption of environmental innovation ambidexterity based on survey data from manufacturing firms in China.

▼ Environmental Assessment Practitioners (EAPs) are at the centre of the
Environmental Impact Assessment (EIA) process. Their competence and ethics, therefore, are crucial in facilitating the EIA process. This research aims to analyse the extent to which the current South African (SA) EIA regulations ensure EAP independence. The key findings from other professions that place emphasis on independence reveal that factors such as financial interest, prior relations and managerial advisory services, competency, contractual arrangements, close personal relations and government and political influence interfere with independence. In the SA context, the independence of EAPs continues to be debated even after vigorous changes in the EIA regulations.
The recent
regulation of the EAP profession in SA marks a much-needed intervention. However, it does not guarantee EAP independence while they are still being appointed by the project proponent. Results from Kenya and Botswana do not expressly state in their EIA regulations that they have EAP independence. It appears that international practice places more emphasis on the views and opinions of the affected communities during the public participation process rather than EAP independence. In parallel, Intervenor Funding is adopted to provide financial assistance to the affected communities to encourage their participation during the EIA process in order for the process to be objective. Thus, there is still potential to strengthen EAP independence in SA. In order to achieve the desired outcome of independence, the Competent Authority (CA) must appoint EAPs on behalf of the project proponents rather than allowing EAP-client relationships. Moreover, adoption of the Intervenor Fund concept, where EAPs will be compensated for their services, is a concept that SA should consider.

▼ To stave off the collapse of the feeble and bankrupt
U.S. railroad industry in the 1970s, federal policymakers enacted
major regulatory reforms. The creation of Amtrak and Conrail,
significant rehabilitation projects, and an overhaul of
transportation laws enabled the railroads to pare down their lines
and retool their businesses. Each of these rapid developments in
economic and business policy also reshaped natural and built
landscapes. Using congressional and executive documents and
secondary materials, this thesis shows how
environmental
regulations, historical preservation, and public awareness of
ecology and resource scarcity informed the process of railroad
reform. The
environmental impact statement redefined how federal
bureaucrats approached railroad infrastructure projects and line
abandonment, while new pollution rules and energy-efficiency
programs affected the rails’ biggest customers, like coal and
manufacturing. Two important trends in postwar domestic policy—new
social
regulation and economic deregulation—intersected to
jumpstart U.S. railroading in the 1970s.

▼ Managers are coming under increasing pressure from a wide array of stakeholders to improve the
environmental performance of their firms while still achieving financial performance objectives. One of the most researched questions in the business and the natural environment (B&NE) literature is whether it pays to be green. Despite more than three decades of research, scholars have been unable to clearly answer this question. The purpose of this dissertation was to attempt to identify the antecedents that lead to increased, firm-level
environmental performance and the conditions in which firms are then able to profit from enhanced
environmental performance. First, I assessed three intra-organizational factors of top management teams (i.e. female representation, concern for non-financial stakeholders, and risk-seeking propensity) that theory indicated are associated with increased corporate
environmental performance (CEP). Theory also leads us to believe that top management teams with these attributes should perform better in dynamic settings, so I tested to see if industry dynamism moderates these relationships. Second, I then examined industry-level forces that theory indicates would moderate the relationship between CEP and corporate financial performance (CFP). These moderating forces include industry profitability, industry dynamism, and the degree of industry
environmental regulation. Hypotheses were tested using panel data obtained from the KLD, Compustat, and
Environmental Protection Agency databases for the years 2000 to 2011. The sample consists of firms comprising the Standard and Poor’s 500 and was analyzed using fixed-effect regression and moderating variables were analyzed using the Johnson-Neyman technique.

Such treatment reflects a recurrent political challenge facing makers of environmental policy: whether and how to mitigate regulatory burdens when policy change upsets settled expectations and investment commitments. This dissertation first presents a survey of transition policies in various areas of environmental regulation, and then explores whether and how these policies might be explained by existing theories of regulation. The next four chapters present detailed case studies drawn from the trucking and pesticide industries, describing both the emergence of transition relief and the later efforts of policymakers to address problems arising out of this relief. These case studies demonstrate that although numerous variables affect transition policy, the degree of transition relief in a regulatory program is substantially influenced by the cost impacts of that program on incumbents, a factor which in turn is shaped by the composition and competitive dynamics of the regulated industry.

▼ This is a study of nature protection in an era of markets, and more broadly, a study of the historically and contextually constrained ways that people try to resolve perennial tensions between economic growth and ecological protection in modern, capitalist political-economies. The substantive focus of the study is somewhat peculiar: it is a comparative and historical analysis of the development of market-oriented ecological offsetting schemes in both the United States and in Germany. These are exchange-based systems of creating, restoring, buying, and selling units of nature used by land developers who are required to ``offset'' ecological harm caused by their building projects. In essence, ecological offsetting is a market-oriented regulatory means of ``improving'' and protecting nature in one location in order to help ``make up'' for harm to nature someplace else nearby.If ecological offsetting itself is esoteric, however, its features allow for a careful examination of contemporary efforts to transcend basic conflicts between economic development and ecological sustainability. Empirically, the case offers an opportunity to study how nature protection develops and evolves at a time when strengthening environmental regulation is politically fraught, when market-oriented policy is ascendent, and when regulatory expansions are frequently opposed by business interests and their political allies. Methodologically, it turns out that ecological offsetting itself developed in almost perfect historical parallel in the United States and in Germany and yet did so quasi-independently, that is, without substantial evidence of direct diffusion across the cases. This means that these two country cases provide an unusual opportunity to pinpoint the social-historical and political-ecological dynamics that drove the emergence of market-oriented forms of environmental protection in both countries, and that may be linked to the development of comparable institutions in a wide variety of other political and organizational contexts. At a lower-level of analysis, this comparative design also makes it possible to identify the ways that nationally distinctive contexts shaped the development of case-specific institutional features – for example, the ways that broad-based conceptions of ``nature'' in Germany lead to the development of exchanges in highly fungible units of ecology, whereas in the U.S. a focus on ``wild'' and ``sacred'' forms of nature led to exchanges in less highly fungible and more ``ecological'' units. Finally, the comparison of the two national cases also offers leverage for understanding how bureaucrats and policymakers can weave market-like exchanges directly into the administrative and regulatory fabric of modern states. Il s’agira de démontrer que les réglementations environnementales et les normes environnementales volontaires auxquelles tentent de se conformer les entreprises et les États, peuvent améliorer à la fois leur protection de l’environnement, leur compétitivité, et dans une certaine mesure leur performance sociale. Cette conformité environnementale a pris un essor particulier depuis les grands phénomènes économiques induits par la mondialisation. La mondialisation se caractérise depuis les années 1970 par l’avènement d’une économie de marché ouverte dans laquelle les entreprises circulent librement d’un pays à un autre. Cette économie repose notamment sur le libre-échange des biens, des services, des technologies, des capitaux, ainsi que sur libre circulation des entreprises elles-mêmes. La mondialisation se caractérise également, du fait de l’ouverture de cette économie, par la mise en concurrence des États et des entreprises à l’échelle internationale. Ce phénomène économique de la mondialisation a toutefois entraîné une dégradation majeure de l’environnement au fil des années. Afin de répondre à ces différents enjeux, les États ont mis en place des mécanismes réglementaires ainsi que des mécanismes volontaires de protection de l’environnement destinés à encadrer les activités des entreprises, qui forment le socle de la politique juridique de conformité environnementale menée par ces entreprises. Les entreprises tentent alors de s’adapter à ces mécanismes juridiques afin de mieux protéger l’environnement, mais aussi afin de devenir plus compétitives.
The aim of the thesis consists of wondering how companies lead their legal politics to get a global performance. In other words, it will be advisable to demonstrate that environmental regulations and voluntary environmental standards which companies and States try to conform, can improve at the same time their environmental protection, their competitiveness, and to a lesser extent their social performance. This environmental compliance has taken a particular development since the big economic phenomena led by the globalization. The globalization is characterized since the 1970s by the advent of an opened market economy in which companies circulate freely from a country to another. This economy is particularly based on free trade of properties, services, technologies, capital, as well as on free circulation of companies themselves. But globalization had led to a serious environmental degradation. In order to meet these challenges as operationally as possible, countries have put regulations and voluntary standards with a view to regulating firms’ activities, that form the basis of a environmental compliance legal policy undertaken by these companies. These companies are trying to adapt to those legal mechanisms in order to better protect the environment, but also to become more competitive.

environmental assessment and strategic
environmental assessment processes play in the commercial development of oil in the Newfoundland and Labrador (NL) offshore. It draws on the
Regulation Approach as a way of examining the geographical and cultural specificity of the oil industry and
environmental regulation in NL and how this ties to broader questions of development and capitalism, specifically the development and perpetuation of petro-capitalism in NL. Through document analysis, meeting observation, and interviews, this work examines
environmental assessment processes in two locations. First, in offshore eastern NL, where all commercial offshore oil development and a significant amount of exploration has taken place. Dozens of
environmental assessments have been done in the region but there has been little public contention or opposition to oil. The second location, the west coast of the island of Newfoundland, has far less experience with
environmental assessment processes and oil activities. However, overlapping assessments for offshore drilling and fracking, as well as a strategic
environmental assessment, led to the mobilization of communities in five provinces around the Gulf of St. Lawrence. Examining the history, current experiences, and outcomes of
environmental assessments and oil industry activities in these locations illustrates the somewhat contradictory role that
environmental assessments play in both supporting and challenging oil development in the province. The overarching emphasis on oil as a source of jobs and revenue in NL, especially since the cod fishery moratorium in 1992, has meant that
environmental assessments often support and facilitate oil development and thus help to maintain provincial petro-capitalism. They help to contain and diffuse contention that could, if not addressed, lead to disruptions in oil-based accumulation. Yet at the same time,
environmental assessments are also a space of contention where there are opportunities to challenge development projects and potentially question the province’s dependence on oil.

▼ O objetivo do presente estudo é verificar como o MERCOSUL vem tratando sua política ambiental, empreendendo uma análise a partir de três modelos estratégicos de regulação aplicáveis a zonas de integração econômica: concorrência regulatória, harmonização e cooperação, que é, em verdade, uma fórmula híbrida com algumas vantagens em relação aos outros dois. Ressalte-se, desde logo, que são poucos os estudos sobre regulação ambiental no MERCOSUL, o que confere importância à pesquisa, mormente se considerada sua abordagem original a partir de modelos estratégicos de regulação ambiental. O método de abordagem utilizado é o dedutivo, partindo-se de modelos abstratos com o escopo de verificar a adequação do MERCOSUL a eles. A pesquisa apontou que o bloco em apreço possui um Acordo-Quadro em matéria ambiental com traços bem característicos de um modelo cooperativo. Todavia, o contexto fático que se seguiu ao acordo não permitiu identificar maiores características dessa estratégia de regulação, o que levou a concluir que, de fato, há no MERCOSUL uma concorrência regulatória em matéria ambiental. Assim, devido às críticas empreendidas à concorrência regulatória, conclui-se que o modelo não é totalmente eficaz para a promoção de uma política ambiental efetiva, bem como para o avanço do processo integracionista. Ao final, são expostas algumas contribuições visando ao aperfeiçoamento da política ambiental mercosulina.
The aim of this study is to analyze how the MERCOSUR deals with its environmental policy, based on three regulatory models applicable to economic integration areas: regulatory competition, harmonization and cooperation, which is, in fact, a hybrid formula with some advantages if compared with the two others. There are few studies on environmental regulation in MERCOSUR, a fact that shows the importance of this research, especially when taking into account its original approach based on regulatory models for the environmental. The research relies on the deductive method, starting from the abstract models with the scope of verifying the adequacy of MERCOSUR to them. The study showed that the trade bloc in question has adopted an Environmental Agreement, which has characteristics of a cooperative model. However, in the factual context that followed the agreement, it was not possible to identify major features of this regulatory model. Therefore, it can be concluded that, in fact, there is a regulatory competition in the MERCOSUR’s environmental policy. Thus, considering regulatory competition critiques, this study concludes that the model adopted by MERCOSUR is not fully effective for the promotion of an efficient environmental policy, as well as to advance in the integration process. Finally, some propositions are made focusing on the optimization of MERCOSUR’s environmental policy.

▼ This dissertation addresses issues in the economics of the environment and natural resources. The first chapter pertains to the inclusion of
environmental objectives into contracts between the government and private firms. In particular, it considers the possibility that conservation restrictions may undermine the goal of fostering competition among private logging firms in timber auctions. Empirically, the policy is costly but is found to be borne primarily by the state without substantial competitive distortions. Importantly, that state can reduce the impact of the policy on revenues by setting reserve prices optimally.
The second chapter is joint work with Professor Erich Muehlegger. We use data on Google search activity related to climate change and shocks to local weather to demonstrate that unusual weather increases the salience of climate change as an issue. Further, we find that recent weather shocks have a significant effect on Congressional votes pertaining to
environmental regulation.
The third chapter makes a methodological contribution to the analysis of auction data. Many auctions have a reserve price, below which the seller simply keeps the object of interest. However, it is typically taken for granted that the object will not be re-auctioned later. Empirical researchers should account for the fact that bidders may respond to this possibility. I present a simple model of repeat auctions, discuss what information can be identified from bidding data, and provide a Monte Carlo simulation of an estimator that addresses this issue. Finally, I examine data on repeat auctions of logging contracts to see whether bidding behavior is consistent with the model. These data could provide a context in which to estimate the model and analyze counterfactual auction policies.

▼ Advances in horizontal drilling and high-volume hydraulic fracturing have allowed operators to profit from oil and gas extracted from the extensive shale formations found in the United States. The resulting boom in shale development has exposed many areas, including heavily populated and environmentally sensitive areas, to the common as well as to the uncertain risks associated with drilling activities. This dissertation empirically analyzes responses to perceived risks of shale development as revealed through property transactions in a Pennsylvania county and through legislative decisions by New York towns. In general, I find that perceived risks to water feature prominently in both contexts. In Chapter I, I find that an additional nearby horizontal well increases property values on average, but that this positive effect is diminished for properties that rely on private wells for drinking water. Chapter II then considers when towns adopt a ban on shale development. In particular, I find that greater reliance on private water wells is associated with a higher probability of adopting a ban. Finally, in Chapter III, I discuss how governments could use regulations, tort liability, and insurance mandates to better manage risks to water, thereby possibly preventing property-value losses and outright bans.

▼ Le 1er Juin 2007 l’union européenne met en place REACH (Registration, Evaluation, Authorisation of Chemicals), un des règlements les plus ambitieux jamais mis en place au niveau européen. Cette réglementation introduit une nouvelle philosophie dans la manière de concevoir la protection environnementale et sanitaire. Selon le préambule du règlement, l’objectif de REACH consiste « à assurer un niveau élevé de protection de la santé humaine et de l’environnement, tout en améliorant la compétitivité et l’innovation ». Aussi, le règlement vise à concilier des enjeux à priori antagonistes, grâce aux innovations environnementales qu’il induirait. En ce sens, REACH apparaît comme un objet d’étude privilégié pour analyser les effets d’une réglementation environnementale sur les stratégies d’innovations des entreprises. Dans cette perspective, nous étudierons les mécanismes du règlement REACH qui sont susceptibles de favoriser le développement des innovations environnementales. A travers une étude empirique originale réalisée auprès des entreprises en région PACA, nous déterminerons, d’une part, les mécanismes qui favorisent de nouvelles opportunités technologiques et commerciales dans le domaine de l’environnement et de la santé, et, d’autre part, ceux qui stimulent une demande de qualité environnementale. Enfin nous analyserons l’influence des attributs de la réglementation REACH sur la dynamique technologique et industrielle à partir d’un modèle multi-Agent. Ce cadre de modélisation s’avère particulièrement pertinent pour tenir compte du caractère stochastique et complexe des processus qui gouvernent les stratégies d’innovations des agents soumis à la pression de la réglementation REACH.
On 1 June 2007 the European Union set up REACH (Registration, Evaluation, Authorisation of Chemicals), one of the most ambitious regulations. This regulation establishes a new philosophy of how to design environmental protection and health. According to the preamble to the Regulation, the objective of REACH is "to ensure a high level of protection of human health and the environment while enhancing competitiveness and innovation." REACH has been designed to balance environmental objectives with competitiveness aims, and has the scope to induce the adoption of eco-Innovation as a side effect of the regulation itself. For this reasons, REACH appears as a privileged object of study to analyse the effects of environmental regulation on the innovation. In this regard, we analyse the innovation-Friendly mechanisms of REACH to promote the development of environmental innovations. From an unique original survey on REACH regulation, we study, one the hand, mechanisms to promote new opportunities in the field of environment and health, and, the other hand, those that stimulate demand for environmental quality. ištirti Europos Sąjungos ir Lietuvos aplinkos apsaugos reguliavimo
politikos harmonizavimą, remiantis Europos aplinkos agentūros
poveikio analize. Tikslui pasiekti buvo atsižvelgiama į Europos
Sąjungos reguliavimo agentūrų veiklos funkcionavimo ypatumus,

Policies being formed by the European Union
have had a significant positive influence in developing an
effective role of the state and forming economical policy of the
country. However, there are cases when institutions of the European
Union dictate certain decisions to the member and candidate states,
and those decisions do not necessarily serve best interests of the
states. Aim of this paper - is to analyze impact of the European
Union and Lithuanian state environmental sector regulatory policy
harmonization, using a case study of The European Environment
Agency analysis. To reach the goal has been taken account European
Union regulatory agencies' functioning characteristics, the main
environmental priorities of the European Union and those of the
Republic of Lithuania, and analyzing European Environment Agency's
role in harmonizing Lithuanian environmental policy. Summarizing
the results of the paper, it can be asserted that regulatory
agencies are very important and useful for the efficient
functioning of the European Union. National differences of member
states can be eliminated by invoking the most proper method of
regulatory policy. Environmental policy of the European Union is
based on attitude that high environmental standards promote
innovations, open business opportunities and further economical

▼ A network of 53 Irish raised bogs were designated as Special Areas of Conservation (SAC) under the European Union (EU) Habitats Directive in the 1990s. Whilst the purpose of the designation is to protect unique habitats, another effect has been to prohibit the traditional right to cut turf. Protected area
regulation has been highly contested by the Turf Cutters and Contractors Association (TCCA). Under threat of sanction for non-compliance, the Irish State established a collaborative process for implementation in 2011. This research has adopted a political ecological approach to examine power-knowledge relations between stakeholders in the construction of legitimacy through the collaborative process.
Foucauldian governmentality underpinned the methodological approach. In the first article, critical discourse analysis was adopted to deconstruct the tensions between participatory and scientific legitimacy in policies and governance structures, and in their contestation by the TCCA. In the second and third articles, Q Methodology was adopted to analyse turf cutters and expert legitimacy discourses respectively. The quantitative results revealed the convergence and divergence of legitimacy discourses on
regulation which were interpreted with the support of the interview data.
The exclusion of local knowledge fuelled contestation and resistance. The articulation of counterclaims reflects previous research and were based not simply in rhetoric, but also on place-based knowledge (e.g. Robbins et al., 2006). The empirical analysis revealed how the TCCA disrupted the regulatory authority of the State and how the technocratic approach undermined scientific legitimacy for implementation. The findings indicate the power of the State in determining power-knowledge and structural relations. This was evident in the discursive alliance reflecting the technocratic approach, cost-effectiveness and agricultural priorities, over a more equitable site-specific approach to conservation and compensation. Overall the findings indicate the need to transition to a more adaptive site-specific approach.

▼ The Washington shellfish aquaculture regulatory framework is a complex instrument with numerous permits and high agency involvement. Shellfish business owners, industry officials and policy-makers look to simplify the overall process by reducing paperwork and permit redundancies. In the past, the Washington aquaculture sector held a close relationship with the Washington Department of Agriculture, and policy-makers are again assessing a closer future relationship, aiding in regulatory efficiency. The purpose of this study is to locate sources of inefficiency within the shellfish aquaculture regulatory framework and supply new ideas for future policy-making based on an aquaculture regulatory framework proposed by Takoukam and Erikstein (2013). There are four main objectives to this study. The first is to identify barriers within the regulatory framework from the federal scale to the county level restricting the Washington shellfish industry. Through scientific and governmental literature reviews, and information from conference attendance, these barriers are identified. The second objective is to showcase current programs addressing regulatory barriers in aquaculture. Current programs are the Shellfish Interagency Permitting Team, the Pacific Aquaculture Caucus, and the Pacific Coast Shellfish Growers Association. The third objective is to compare the regulatory framework for aquaculture based on the Washington agriculture framework. I used the Washington agriculture program as a template to assess how aquaculture can meet the regulatory goals set forth by Takoukam and Erikstein (2013). The Florida Aquaculture program, which is a combined Aquaculture-Agriculture regulatory department, is used to illustrate a closer relationship between the two divisions. The final objective is to assess the future of Washington aquaculture based on information provided through the first three objectives. Preliminary recommendations for the Washington regulatory framework are to shift regulatory work to county level officials, limit the number of government agencies involved, reduce review periods, and increase regulatory transparency on county and state levels.

▼ Competing demands for scarce water resources have led to conflict in semi-arid and arid regions. Such conflicts often involve the need to restrict the use of groundwater pumping in irrigated agriculture in order to leave adequate quantities of water for fish species in nearby streams. Groundwater pumping can lead to a reduction in instream flows of nearby streams in a process known as stream depletion. From an economic standpoint, policies intended to leave adequate quantities of water instream for any purpose should aim to minimize the welfare losses accrued by irrigated agriculture due to reduced pumping. To this effect, prior studies have utilized spatial characterization of the hydrologic systems in question to spatially target water allocation between groundwater irrigators and instream demands (Young et al. 1986, Keplinger et al. 1998, McCarl et al. 1999, Kuwayama and Brozovic 2011). However, the policies developed or analyzed in these studies usually focus on meeting aggregate instream flow goals on a seasonal or yearly basis rather than meeting them on a continuous basis. In this thesis, I present a dynamic optimization framework that solves for optimal groundwater pumping allocations in a stream-aquifer system with instream flow goals that need to be met on a daily basis. An analytical hydrology model is integrated into the framework to constrain stream depletion impacts on a daily basis to ensure that minimum instream flow requirements for ecological needs are met on a daily basis. I apply this framework to the Scott River Basin in northern California, which is a region where extensive irrigation by farmers has harmed the local coho salmon species by reducing the natural flows of stream habitats. The coho salmon have been listed as Threatened under the state and federal Endangered Species Acts, and therefore must be protected. The results indicate that wells located farther from the stream should generally be allocated more water in most hydrologic scenarios. A counterintuitive exception to this general finding is that wells located closer to the stream should be allocated more water when there is a period of extreme scarcity in the instream water supply during the year. This result is driven by the fact that there is a time lag associated with the stream depletion externality following pumping, and this time lag varies with location relative to the stream. Thus, any period of time during the year with extreme water scarcity requires a cessation of pumping in advance of that period so that stream depletion impacts can adequately dissipate before the start of the period. Wells that are farther away from the stream cause higher stream depletion impacts following the cessation of pumping, so they would need to cease pumping earlier in advance of the period of

▼ As human population and consumption have risen, waste generation and air pollution have also increased leading to steady environmental degradation. To stem overflowing landfills and combat air pollution, policies and social norms have often been used as tools to bring about change. My dissertation analyzes the impact of these tools to achieve pro-environment behavior. The first chapter tries to understand two such behaviors, i.e., how to increase recycling and reduce waste. They are key to protecting natural resources, but households probably do not derive any benefit from recycling other than social approval. Based on a theoretical model I built for households, I show that when the social norm of recycling increases, the recycling rate of the household rises and waste per capita falls. My paper is one of the first to test these propositions empirically for Minnesota data using an instrumental variable setup. I show that while waste per capita declines significantly with an increase in social capital, recycling rate does not seem to be influenced by social capital. My second chapter studies the impact of environmental regulations in India on mortality that includes all causes and all ages (or mortality). We know that chronic exposure to air pollution is more harmful to adults than babies and hence focus on mortality as the outcome, for the first time for India. Using a difference-in-differences framework, in the first part of the paper, I show that environmental regulations in India have led to a significant drop in mortality. The second part analyzes the effect of different pollution types on mortality, where I show that PM2:5 exposure is more harmful to mortality (but not infant mortality) than TSP. This further strengthens the claim that policies should focus on adults and shift its focus from TSP to PM2:5 to get greater gains in health. The last chapter studies the functional form of the relationship between PM2:5 concentrations and mortality for the first time for India. The shape of this concentration-response curve will determine if the air in India affects public health at a different or the same rate as the U.S. baseline rate. My paper is one of the first studies to analyze this relationship using panel data for India, without simply extrapolating coefficients from U.S. or European data, following a rigorous identification strategy. I then arrive at the relative risk of mortality estimates at higher pollution concentrations as well as the estimated lives saved due to the reduction in pollution exposure.

▼ Although the literature on carbon emissions, from fields such as environmental economics, public policy, and industrial ecology among others, is quite extensive, the literature in supply chain management is relatively limited. Moreover, in addressing concerns about carbon emissions, much of the focus has been on technological fixes (e.g., more carbon-efficient technologies and alternative sources of energy). Much less attention has been paid to the potential of reducing carbon emissions via adjustments in supply chain design and operation. This research, utilizing optimization, game theory, deterministic and stochastic modeling, and mechanism design, aims to bridge this gap. The first part of the study, using the economic order quantity (EOQ) model framework, suggests that it is possible to reduce emissions by modifying order quantities, and provides conditions under which the relative reduction in emissions is greater than the relative increase in cost. The second part examines the extent to which penalizing the emission of harmful pollutants can successfully reduce overall emissions in decentralized supply chains, and shows that requiring each firm to pay for the emissions for which it is directly responsible can paradoxically lead to higher overall supply chain emissions and for this emission to increase in the price of emissions. The third part includes preliminary results including the impact of price variability as well as consumers' preferences for low emission products on the ways firms manage their inventory and the corresponding emissions.
