Research Doctorate - Doctor of Philosophy (PhD)

Environmental Impact Assessment (EIA) is an environmental management tool used widely in more than 100 countries and, by multilateral and bilateral agencies. Like many other jurisdictions, the EIA has been practiced in Bangladesh as an environmental management tool for projects with the aim of protecting the environment from impacts. While in developed countries a good number of studies are available, the evaluation of EIA systems in developing countries is a neglected area. The evaluation of an EIA system helps to understand how an EIA system is working, the strengths and weaknesses of the system and areas for further improvement. In Bangladesh, the EIA system has been formally in place since 1995 but no comprehensive study has been conducted to understand how the system is working including its strengths and weaknesses. Therefore, a comprehensive investigation is warranted to identify any shortcomings, leading to suggestions for improvement of the EIA system in Bangladesh. The study of an EIA system should focus not only on the practice of the EIA, but also on the necessary legal and administrative arrangements that support its practice and subsequent outcomes. With this in mind, this research used an integrated-holistic framework to understand the effectiveness of the EIA system in Bangladesh. This framework facilitated a comprehensive investigation of the EIA system covering institutional arrangements, the practice of EIA (i.e. the quality of EISs), and subsequent outcomes (i.e. the implementation of mitigation measures and monitoring). The first area of investigation is the institutional arrangements of the EIA in Bangladesh. The study shows that, in Bangladesh, there is legislation for EIA practice and designated agencies to administer EIA implementation. These make a good foundation for EIA practice. However, there is a lack of comprehensive EIA legislation that clearly outlines the requirements of key stages of EIA process. The current legislation does not clearly define the key stages of EIA process (i.e. scoping, community involvement, mitigation and monitoring) and other procedural requirements, such as the contents and review of Environmental Impact Statements (EISs). A comprehensive provision of EIA requirements detailed in legislation is necessary in Bangladesh. Furthermore, the administrative capacity of the DOE is weak due to the shortage of trained staff, inadequate budget and lack of stable leadership. These weaknesses keep the DOE’s efforts to implement EIA at a minimum. The second area of investigation is the quality of EISs that is the product of an EIA process. This area examines to what extent the tasks of the EIA process (stages of EIA and other procedural requirements) are addressed in practice. Reviewing thirty (30) EISs, this study shows that the quality of EISs in Bangladesh is generally satisfactory. However, a significant proportion (34%) of EISs is still poor. ▼ Leather sector in Ethiopia is the most focused area as a development reinforcing component. The sector is also known for its intensive environment polluting practices. The intensity of wastewater management problems calls for immediate solution in a tanning industry to maintain community wellbeing and sustain development. Tanning process of Batu tannery employs large amount of water and toxic chemicals generating large volume of wastewater mismanaged and discharged in to little Akaki River nearby. Improving tannery wastewater management and consequently reduce adverse environmental impacts thus identifying the pollution alleviating techniques employed in tanneries and showing environmental policy compliance gaps is the core essence of this study. Linkage and integration of the individual production process management and respective wastewater management is also evaluated. To answer the research questions concerning wastewater management efficiency, pollution load reduction techniques used and individual production process linkage with wastewater management practices of Batu tannery questionnaires were distributed in the factory on the bases of stratified sampling among four groups of workers and analyzed. Environmental adverse impact and policy compliance gaps related to tannery wastewater management is shown from information extracted through key informant response analysis and focus group discussion made among tannery wastewater recipient community for further evidence conformation. The study result revealed that, BTPLC tannery wastewater management lacks efficiency though there is a planned ambition and vision to respond to the modern environment and quality management systems. The result also indicated that individual production process management lacks systematized, consistent and integrated linkage with the wastewater management. Pollution reduction strategies involve very limited preventive waste management approach. Tannery process water and chemical consumption is inadequately controlled and wastewater treatment plant operational efficiency is inadequate. The study indicated that stakeholder intervention is needed in Batu tannery in areas of EMS installment, monitoring and evaluation, training, awareness creation, technology transfer and sounding regulatory system enrichment. Most of the policy issues related to tannery wastewater management problems are unclear and their compliance is limited. The finding showed that there is a gap in implementing environment policy related to wastewater management in Batu tannery. Government bodies responsible to enforce environmental policies are institutionally inadequate in this respect .The study also indicated that efforts to assess adverse environment impacts of the tannery waste management practices lack clarity and stakeholder commitment. ▼ Environmental Impact Assessment (EIA) is a process that seeks to reduce the negative environmental consequences of listed development activities, which could have a detrimental effect on the environment, in the advance of their implementation, and a requirement of legislation in South Africa. An important element of the systematic EIA process is the submission of an environmental impact or scoping report or an environmental impact report (EIR) to the relevant governmental department, interested and affected parties and/or specialist for review to determine the report's adequacy before a project can be authorised or if further information is required. The information made available in reports to decision-makers with regard to developments with the potential of affecting explosive projects, plays a significant role in the authorisation of the project after the authority review process, which is dependent on the quality of the report. In order to contribute more effectively to sustainable development, more attention must be placed on assessing the quality of ElA's as part of determining how effectively EIA has been functioning in South Africa; hence this study is aimed at assessing the quality of EIA assessment reports of four projects with the potential of impacting on explosive industry projects. The objectives of the study included the review by independent reviewers of the quality of four-selected impact reports using a checklist, analysis of the review process results and provision of recommendations to improve the quality of environmental impact reports for-explosive projects. Based on the review results it is concluded that the quality of the four reports for-explosive projects. Based on the review results it is concluded that the quality of the four reports were of an acceptable standard, although certain areas were found poorly performed i.e. improvement with regard to identification of key impacts and considerations of alternatives and mitigation as well as the control and treatment of waste. Otherwise the review method is fairly robust and consistent and therefore can be seen as a reliable indication of EIR quality. The following was recommended to improve the quality of the reports for explosive projects: The use of a quality review checklist for explosive projects by EIA practitioners and authorities to be used as an additional tool to the EIA regulations (DEAT 2002) and the Integrated Environmental Management series (DEAT 2002) can further improve the quality of the El reports for explosive projects. • The use by EIA practitioners of an explosive review checklist will assist in ensuring that all key aspects are addressed before submission to relevant authorities, i.e. the report contains all pertinent information and is technically sound, the report is set-up clearly and coherently organized and presented so that it can be understood and that it has addressed all the key issues to make a decision about the proposed development. ▼ All development has the potential to cause adverse effects to the environment. Worldwide, environmental concern regarding these effects has significantly increased over the past forty years. This has led to the implementation of environmental legislation and associated requirements for Impact Assessment (IA). The effectiveness of this legislation and other aspects of the effects management framework in protecting the environment have, however, been questioned. The current research firstly examined IA, to identify whether this process was capable of achieving desired environmental outcomes. It found that a primary factor in determining if IA could be an environmental management tool depends on whether follow-up is included in this process. Namely, this includes the use of monitoring, auditing, management and communication of the actual effects of a development. This research highlighted that the IA process can achieve desired environmental outcomes but that it relies on legislation, policy and political support to be effective. In New Zealand, the environmental effects of development are managed, primarily through the Resource Management Act 1991 (RMA). This process was examined and it was identified that while the RMA provides requirements for environmental management, through the use of monitoring and management provisions, these are seldom used by local authorities. Therefore, the environmental effects of development are not currently being effectively managed. This conclusion was supported by key informants’ comments. However, the literature on planning documents and the effectiveness of Assessments of Effects on the Environment (AEEs) indicated that the quality of both have improved since the implementation of the RMA. In New Zealand, the primary means of identifying ways to mitigate environmental effects is through an AEEs, which provide IA in New Zealand. As noted above, follow-up is a key element of an effective IA process. The only component of follow-up that is commonly used in New Zealand is monitoring, which is not used to assess the actual effects of the development but rather, to ensure compliance with consent conditions. A number of key informants identified that currently, the environmental effects of development are not effectively managed and many considered that the application of follow-up would assist in improving such management. Questions on how and in what contexts follow-up should be implemented elicited a broad range of responses from key informants, and these responses appeared to link to their areas of work. Those involved in urban development stated that the overall effects (i.e. plan effectiveness, and general detractions from environmental quality) were key areas to be followed-up. However, key informants involved in large scale developments considered that follow-up should occur as part of the project development/implementation process thus allowing ongoing management. ▼ Environmental Impact Assessment (EIA) is subject to challenges that undermine this process as an effective safeguard to biodiversity. Internationally, effective EIA is hindered by the following issues: a low priority assigned to the consideration of biodiversity and a limited capacity to carry out assessments; a lack of formalised procedures and inconsistent methodologies to address biodiversity within the EIA framework; and a lack of formal requirements for post-project monitoring of biodiversity aspects. Traditionally effectiveness studies in this regard have focused on evaluating the procedural aspects of EIA, and have focused less on the substantive outcomes of the post-authorisation phase of a proposed project. While South Africa has a considerable body of literature pertaining to the procedural aspects of EIA, there remain two substantial gaps in the literature. Firstly, there is an evident absence of effectiveness studies in South Africa that focus primarily on biodiversity-specific procedure. Secondly, almost no research has been conducted in South Africa which investigates the outcomes of mitigation measures, mandatory monitoring, reporting and compliance with biodiversity aspects of EIA. This research therefore aims to fill these gaps by investigating the quality of information generated in five EIAs in the Western Cape. It also examines the implementation success of mitigation measures aimed at managing unavoidable impacts in the post-authorisation phase of these projects. This research has adopted a case study methodological approach. Five EIAs were selected from a sample of 9. In no order of significance, the variables considered most important in the sampling protocol were: the presence of a biodiversity-related specialist report; availability of environmental assessment documentation; overall cases to represent at least two different local jurisdictions; and the uniqueness of adopted biodiversity-related mitigation measures. The primary method used to evaluate the quality of biodiversity-related information is a Key Performance Indicator analysis, whereby the performance of cases is measured against legal and best-practice reporting principles. The substantive outcomes of EIA have been investigated by means of site inspections and interviews with key stakeholders. This research has found that the five cases performed well with complying with best-practice EIA procedure, indicating a 53% full compliance, 29% partial compliance and 18% of best-practice principles were not complied with at all. This research has shown that direct impacts on biodiversity (such as the physical removal of indigenous vegetation) are adequately identified, and indirect impacts (typically those impacting off-site and on ecological processes) are poorly identified in EIA. Therefore, the information required to avoid impacts on biodiversity is available, but this research has found that it is underutilized in this regard. ▼ Environmental impact assessment (EIA) practices can render learning effects on both the project level –being the physical undertaking like the construction of an oil platform or the reclamation of land– and the system level –being the EIA’ rules, regulations and capacities of the key actors (i.e. the proponent, authorities, civil society agencies and knowledge communities). These learning effects can affect the project proceedings or the organisation at the system level. In low and middle-income countries (LMCs), where EIA systems are rather fragile, donor agencies can stimulate the learning effects directly via focused assistance at the project level or via capacity development programmes aimed at the EIA system. But what about the indirect learning effects leading from EIA projects towards the system? Do donor contributions at the project-level evoke system-level changes. For an effective development of the EIA system all affecting influences should be clear, including the effects of donor interventions. Where effectiveness studies usually aim at the direct outcome and impacts, this research explores the existence of indirect outcomes in terms of system-level feedback loops. The Netherlands Commission for Environmental Assessment (NCEA) is the expert body central in this study. EIA projects in both Ghana and the Maldives were selected: these are all large-scale projects that were rather new to the local EIA authorities and subject to international attention, which scaffolded learning opportunities. The main research objective was to discover and analyse the cognitive and behavioural changes of key actors that stem from NCEA advisory assistance in these projects. The leading research question is: To what extent does the NCEA contribute to system-level learning via their project-level EIA assistance in LMCs? A case-study design was chosen to allow for a qualitative analysis which seemed necessary at this explorative stage, where little is actually known about the link between project interventions and system-level developments. A time-series reflective control design together with a treatment-control design further aided to open the black box veiling the changes at the system level and their relation with the specific contributions of the NCEA. Methods include field observations, semi-structured interviews, group discussions and document analyses. The research approach is cognitive, meaning that only interpretative data is gathered. Conclusions, consequently, are mainly based on perceptions of key actors that were interviewed or joined discussions during fieldwork. In general, research results indicate that the relation between NCEA individual project advisory services and the development of the EIA systems in LMCs is fragile, and depends to a great extent on the institutional context which either hampered or enabled the learning loops in practice. ▼ Environmental assessments began in the 1960s in the United States of America, to increase environmental awareness. Currently, environmental assessments have gained legislative backing in most countries of the world. They are guided by regulations that stipulate administrative procedures with respect to the participation of the public, and records that document the decision-making process, and may be subjected to review by the judiciary. In this light, two major environmental assessment frameworks are usually employed. They are the Strategic Environmental Assessment (SEA) and the Environment Impact Assessment (EIA). EIA is employed when assessing projects whilst SEA is carried out for policies, plans and programmes (PPPs). The Ghana SEA approach uses a set of user-friendly tools and it is carried out based on a number of steps. This approach was initiated by the experience of using SEA for the Ghana Poverty Reduction Strategy (GPRS) I, which set a benchmark for subsequent SEAs conducted under the guidance of the Environmental Protection Agency (EPA) and National Development Planning Commission (NDPC) at sectoral and district levels. A major development in the Ghana SEA approach has been the expansion of the usual three (3) pillars of sustainability as set out by the Brundtland Commission’s Agenda 21 to four (4) pillars. The “social” pillar has also been broadened to incorporate cultural diversity. Thus, sustainability pillars in Ghana include; the natural resources, socio-cultural, economic, and the institutions. The institutional pillar has been added as the fourth pillar of sustainability. In Ghana, these four pillars define and constitute the term environment. Thus, to ensure that sustainability is effectively mainstreamed into the development planning system all four pillars should be at par in any policy, plan or programme. University of Ghana http://ugspace.ug.edu.gh iv The application and use of SEA has been central to the development planning process of the Metropolitan, Municipal and District Assemblies (MMDAs) in Ghana since the year 2002. However, in 2012 the government of Ghana created forty-six (46) new districts bringing the total number of districts in the country to two hundred and sixteen (216). These forty-six (46) new districts (untreated) were carved out of the old (treated) one hundred and seventy (170) districts. Although these new districts (untreated) had knowledge of the SEA tool, they were not applying it because they had not been trained on its use and application with respect to the preparation of their Medium-Term Development Plans. The study examines the impact of using the SEA as a tool for mainstreaming environmental sustainability considerations and dimensions in Ghana especially because of the absence of empirical studies on the effectiveness of using SEA as a sustainability mainstreaming tool. ▼ Health Impact Assessment (HIA) is a combination of procedures, methods and tools used to evaluate potential health outcomes associated with proposed projects, programs and policies. An HIA differs from other types of assessments in its consideration of both positive and negative health outcomes, and inclusion of social and economic determinants of health. Although HIA has evolved over the past two decades, it remains underutilized. There are several reasons for this, including the fact that HIA methodology is lacking in clarity, consistency and transparency. This doctoral thesis tackles this issue through development of novel HIA tools that address specific research gaps associated with different steps of the HIA process. The first step is screening, which determines whether or not an HIA should be conducted. A unique screening tool that considers the practicality of conducting an HIA by comparing the value of the process versus the required investment was developed and tested by HIA practitioners around the world. Scoping is the next step, which outlines the details and boundaries of the assessment. A scoping tool was developed to systematically identify and prioritize health determinants to be included in HIA. The assessment step is where the health outcomes scoped into the HIA are evaluated for potential positive and negative effects. A new assessment framework was created to provide a transparent method of evaluation in order to characterize impacts and reach a clear, well-justified conclusion. This framework was tested on an actual oil drilling project, allowing for identification of strengths and weaknesses of the tool. The framework was then revised to addresses issues, and was redeveloped so that it could be applied within the Environmental Assessment process. Each of these tools addresses a specific research need in the field of HIA, and promotes the inclusion of health in assessing impacts of projects and policies. ▼ The growth of interest in the environment and sustainable development has resulted in the introduction of much new legislation to steer development in a more environmental friendly way. Environmental Assessment (EA) and Appropriate Assessment (AA) are important tools in this respect. EAs aim to integrate the environment and its concerns into decision-making by providing information for Dutch Environmental Act (DEA) decision-making. AAs on the other hand are important instruments to integrate nature and its concerns into decision-making by supporting Dutch Nature Conservation Act (NCA) decision-making. EAs and AAs can be combined in the Netherlands. This can have some advantages like decreasing costs, avoiding double work and having all information on nature available in one report. However, since EAs and AAs are rather different instruments, also some difficulties can be expected, such as for instance problems in aligning the different instruments. In this research the impact of EAs, AAs and EA/AA combinations on decision-making in the Netherlands has been researched and explained in order to provide better insights in the implications of combining the two instruments. The impact of the three different instruments on decision-making in the Netherlands was determined by analyzing existing empirical researches and by doing helicopter interviews with experts in the EA/AA field. The results are explained according to six impact influencing factors: the flexibility of the instrument to fit into the decision-making context, stakeholder participation, transparency of the instrumental process and documents, the binding character of the instrument, the quality of the assessment and the openness of decision-makers to environment/nature. Overall, in practice AA-parts of EA/AA combinations are of added value for (and have an impact on) DEA decision-making. While EA-parts of EA/AA combinations hardly have an impact on NCA decision-making and are not of substantial added value for these decision-making procedures. ▼ Chemical (gaseous) emissions from wastewater treatment plants (WWTP) are perceived as odour and can generate undesirable health reactions. These could affect the quality of life to those regularly albeit intermittently exposed, although regular exposure may result in tolerance and loss of recognition of the odour. Consequently, research is necessary to establish the role of Environmental Impact Assessment (EIA) in ensuring that facilities such as WWTP do not pose a threat to local communities, particularly in relation to housing developments for poor communities. The aim of this study was to investigate if the EIA regulations were effectively implemented before building of the Residential Development Proiect (RDP) houses at KwaMathukuza, in Newcastle South Africa. Furthermore, the study intended to determine the impact the (WWTP) has on the health of people who reside close to the site and to establish if the families staying close to the WWTP have any common ailments such as handicapped babies, early deaths within families. Findings would also indicate if RDP houses should be built in close proximity to such sites. Data was collected through a survey of 85 residents living within five kilometers and ten residing beyond five kilometers from the WWTP. The participants were selected randomly. Municipality employees who worked with the WWTP were also sampled together with healthcare givers. Data included information about health of the community, their perception of the gases released from the WWTP as well as EIA meetings and processes related to the construction of the RDP houses. The outcome of this study revealed that EIA regulations were not adequately implemented and that this residential site was unsuitable for the construction of RDP houses. It emerged that the residence regularly experience unpleasant odours released from the WWTP. These could be associated with ill-health of the residents as well as v degradation the environment in general. The study also found that the effect of the WWTP affects even those communities who reside beyond five kilometers from the WWTP. The researcher argues for more stringent mechanisms to ensure that EIA regulations are properly implemented to prevent adverse effects on the communities. Advisors/Committee Members: Moja, S. ▼ Carbon export from the land to the ocean are an important part of the global carbon cycle, linking terrestrial watersheds and the global carbon cycle. Burial of terrestrial organic carbon represents a long term sink for atmospheric CO2. Approximately 0.4 Pg Cy-1 is delivered to the global ocean from rivers, equally divided between POC and DOC. However, the amount of carbon entering the ocean is a small portion of the total amount entering rivers from the terrestrial environment, suggesting a large amount of processing in inland waters and estuaries. Most monitoring efforts have focused the processing of organic matter on baseflow conditions. However, recent studies have shown that POC and DOC exported during storm events, a small time period during a hydrologic year, can account for the majority of the annual carbon exported from small watersheds. This dissertation identifies the impact different magnitudes of storm events have on the source, composition and reactivity of organic carbon released to downstream waters from the terrestrial environment at Taskinas Creek, Virginia. The proximity of the Creek to the York River estuary, the changes in water table at the site, along with the small size of the watershed allowing opportunity to examine the connectivity between the watershed processes and delivery of organic matter made the site ideal for identifying how hydrology and environment alter POM and DOM export and reactivity. The sources, composition and flux of DOM and POM were measured during four storm events of different magnitudes to determine how events impacted the sources and fluxes of organic matter and the % reactive DOC exported. Events of different magnitudes with varying sources of DOC and POC had similar % reactive DOC that was not predicted using excitation emission spectroscopy. The events resulted in DOC fluxes 1.5-490 fold higher than baseflow. POC fluxes for storm were 6.7-55 times higher than DOC fluxes. Although the % reactive DOC did not increase during storm event conditions, coupled with the overall flux, storm events represent a considerable pulse of % reactive DOC to downstream waters, well above baseflow levels. When considered with increases in storm intensity due to climate change, storm event fluxes of reactive OM may have broad impacts on estuaries and the global carbon cycle through changes in carbon storage.

A análise dos sistemas de Avaliação de Impacto Ambiental (AIA) é um processo que aponta a sua efetividade e qualidade. Este trabalho desenvolveu esta análise para o Brasil, utilizando o modelo desenvolvido por Christopher Wood e amplamente aplicado e difundido em outros países. Os critérios de avaliação utilizados neste modelo baseiamse em princípios de “Boas Práticas em Avaliação do Impacto Ambiental” e foram validados por Ortolano et al ao considerar cinco dimensões para a efetividade de AIA: i)observância dos procedimentos, ii)plenitude de documentos exigidos em AIA, iii)métodos para avaliar os impactos, vi)influência em tomadas de decisão e v)peso dado a fatores ambientais. Os resultados indicaram que a legislação ambiental no Brasil tem um alcance limitado, devido às falhas administrativas existentes desde o início da condução de AIA, motivadas pela deficiência nos mecanismos de controle e acompanhamento, além da insuficiente participação pública durante todo o processo. Esta análise resultou em uma série de recomendações sobre o desenvolvimento do sistema de AIA no Brasil, com objetivo de colaborar na melhoria de sua qualidade e efetividade.

The analysis of the Environmental Impact Assessment systems (EIA) is a process pointing to its effectiveness and quality. This work developed this analysis for Brazil, using the model developed by Christopher Wood and widely applied and spread to other countries. The evaluation criteria used in this model are based on principles of "Good Practices in Environmental Impact Assessment" and were validated by Ortolano et al who consider five dimensions to the effectiveness of EIA: i) comply with the procedures, ii) document fullness required in EIA, iii) methods to assess the impacts, vi) influence on decision-making and v) weight given to environmental factors. The results indicated that environmental legislation in Brazil is limited in scope due to the existing administrative failures since the start of EIA driving, caused by a deficiency in the control and monitoring mechanisms, in addition to insufficient public participation throughout the process. This analysis resulted in a number of recommendations on the development of the EIA system in Brazil, in order to collaborate in improving their quality and effectiveness.
