▼ De tout temps et dans toutes les sociétés l’homme dès qu’il accède à un emploi, organise sa vie pour acquérir des biens mobiliers et immobiliers afin d’en jouir de son vivant et de pouvoir les transmettre ensuite à ses héritiers après sa mort. Au CONGO le droit de succéder au de cujus était d’abord réglé selon les coutumes ; dans la partie Nord l’héritage se transmettait en se fondant sur le patriarcat qui reconnaissait la qualité d’héritier aux enfants, tandis que dans le Sud du pays où l’on pratiquait le matriarcat, les enfants considérés comme étrangers à leur père étaient exclus de sa succession. Ces règles ont survécu à l’influence du colonisateur si bien qu’après l’indépendance les congolais avaient une option entre le droit coutumier et le droit moderne français. Mais cette dualité a été une source de difficultés. Dans un souci de cohésion nationale le législateur congolais a unifié le droit successoral dans la Loi n° 073/ du 17 Octobre 1984 portant Code de la Famille. Nous traiterons ce sujet en trois parties : la première partie examinera les dispositions relatives à la dévolution de la succession, la seconde partie analysera les règles qui régissent la transmission et la liquidation de la succession et enfin la troisième partie montrera les problèmes rencontrés dans l’application du Code de la Famille.
All the time and in all societies when man accesses a job, he organizes his life to acquire movable and immovable property. In order to enjoy his life and then to bequeath to his heirs after his death. In CONGO the law to succeed to the deceased is first governed according to the customs. In the northern part, inheritance was passed on the basis of patriarchy recognized children as heirs. Whereas in the south the matriarchy was practiced, children was considered as foreigner to their father, they were excluded from the succession. These rules have survived the influence of the colonizer, after independence Congolese had a choice between the customary law and modern law. But this duality has been a source of difficulties. With a view to social cohesion the Congolese legislator unified the law of succession in the public law 073 of October 17, 1984 concerning family code. We will treat this subject in three parts: the first part will examine the provisions for the devolution of the estate, the second part will analyze the rules that govern the transmission and liquidation of the estate. Finally the third part will show the problems encountered in the implementation of the Code of Family.

▼ This thesis seeks to respond to the on-going complaints from both African and western scholars that Africa is negatively represented in the western media. The findings showed that news stories, opinions and commentaries expressed throughout the coverage of the Congo, including editorials and letters and from pre-colonial to modern Congo, were written by western journalists and correspondents from the London Times and associated correspondents, while four other news agencies Agence France Press (AFP), Associated Press (AP), the Belgian news agency (Belga) and Reuters were the main sources for The Times newspaper. News makers in Pre-Colonial and Colonial periods were almost exclusively westerners and references to the Congolese people appeared in generic terms. In Post-Colonial and Modern periods, Congolese people did appear by name but only in a limited capacity. The thesis also identifies differences between the coverage in each period, for example highlighting the critical engagement with the Congo that characterised the reporting of 1908. The Congo was represented over the periods sampled with negative stereotypes such a 'primitive', 'backward', 'barbaric, 'dangerous destination,' 'place for business,' 'natives to be civilised, evangelised and educated.' Recurring themes such as forced labour, civil war, corruption, child exploitation, poverty, refugees, witchcraft, dependency and mismanagement prevail in the reporting. The research investigated the changing representations of the Democratic Republic of Congo in the western media by examining its coverage in the London Times from a historical context that included four key historic years in the Congo's development, namely 1885, 1908, 1960 and 2006, referred to as the Pre-Colonial, Colonial, Post-Colonial and Modern Congo periods. The London Times, which used to be one of the leading western newspapers and the British newspaper of record, was selected. Content and discourse analysis were used to evaluate and categorise the news items published in the sampled periods to distinguish the emerging themes, to identify the sources, and to interpret the language used in the coverage. The findings have shown that since its inception to the modern period, the reporting of the Congo in The Times has avowedly been through western eyes, and, as with much journalism, has not offered any real context to the stories. The poor benighted heathens thus continue in their war-torn arbours.

▼ Les tensions ethno-politiques au Congo-Brazzaville de la période post conférence nationale souveraine sont un nouveau phénomène pour un pays antérieurement calme. Durant une décennie (1993-2002), le pays a vécu les années maudites de son histoire. Trois guerres civiles qui ont non seulement déstructuré son économie, mais également fragilisé la concorde et la cohésion nationale. Au sortir de cette conférence nationale, l'armée est restée neutre dans la prise de décision mais trois hommes politiques deviennent des figures emblématiques: Pascal Lissouba, Bernard Kolélas et Denis Sassou-Nguesso. Ces trois acteurs disposent chacun lors de ces conflits de milices qui combattent pour leur cause. Les cocoyes, zoulous et aubevillois sont celles du président Pascal Lissouba, les ninjas sont pour la cause du Maire de la ville de Brazzaville Bernard Kolélas, devenu chef de l'opposition après son accord avec l'Alliance URD-PCT et Apparentés. Tandis que Sassou-Nguesso, battu par le président Lissouba lors de l'élection présidentielle de 1992, va créer les Cobras. Lors du conflit de décembre 1998 opposant les Cobras et les Ninjas dans le Pool, une autre figure apparaît : le révérend pasteur Fréderic Bitsangou avec sa milice, les Nsilulus. La résistance opposée par cette milice à celle des cobras, conduit les nouvelles autorités de signer deux accords de cessation des hostilités. Ces deux accords sont à l'origine de la publication de la loi sur l'amnistie des faits de guerre et des opérations de désarmement, démobilisation et réinsertion des ex-combattants. Au plan politique, ce processus de paix est l’œuvre du dialogue national sans exclusive, socle de l'unité et de la réconciliation nationale entre les anciens ''ennemis''. Le gouvernement procédera tant à la réinsertion des ex-combattants qu’au ramassage des armes dans les zones de conflits. Le programme post-conflit initié par les institutions financières internationales d'annulation de la dette a mis le pays sur les bons rails. Le refus de l'opposition du changement de la constitution de janvier 2002 peut-il encore faire sombrer le pays dans la violence ? Le processus de référendum voulu par le PCT et la majorité présidentielle est-il une bonne initiative ? Le peuple est-il prêt a accepté le troisième mandat de l'actuel chef de l’État ? Autant de questions qui restent en suspens.
The ethno-political tensions in Congo - Brazzaville post sovereign national conference period are a new phenomenon for a previously peaceful countries. For a decade (1993-2002), the country has lived through the years of his cursed history. Three civil wars that not only deconstructed its economy, but also undermined the harmony and national cohesion. ▼ With this master’s thesis, I attempt to hone in on the notion of resource governance across scales
and through time. I use three complementary and interlinked frameworks in effort to address the
complexity of multi-functional forests in an era of heightened global connectivity, recognizing
that current interventions are intimately tied to myriad entities and socio-ecological processes as
well as historical contexts of these processes. In detailing how processes of governance draw
from and shape systems of forest and wildlife ecology, and how those systems in turn shape
governance strategies, I aim to begin to depict the interrelationship between humans and the
Congo Basin environment in the form of a natural history.
Part I depicts the schematic of hybrid resource governance that is designed to implement regionwide
ecosystem scale conservation. I focus on socio-ecological system of broadleaf evergreen
moist forests in Southeastern Cameroon. There, an influx of transnational actors including timber
companies, safari hunting operations, and conservationist NGOs has been shaping the landscape
over the past twenty years with resource-use zones and management plans that delimit the terms
of partnerships, especially user rights and responsibilities. Based on interviews with a range of
actors and analysis of management plans, I examine how local knowledge and decision making
power factors into forest management.
Part II focuses on how resource access for local-level forest users are shaped by schemes of
hybrid governance in multiple-use forests. It also identifies some potential drivers of agricultural
transition and discusses the implications of the current forest zoning and management schemes
on biodiversity. It begins with a literature review about land-use in the
Congo Basin and drivers
of agricultural conversion. Focus group and individual interviews with people in five villages
The ecological outcomes of resource-use zoning are discussed in terms of landscape ecology, on
which rests the tenets of the ecosystem-scale approach to conservation. This paper is thus an
attempt to begin to connect spatial analysis with ethnographic methods.
Part III focuses on the process of designing management plans, discussing the plans themselves
as ‘boundary objects’—focal points where multiple agendas and cultural conceptions come
together in order for people from multiple social worlds to attempt to cooperate. I discuss the
plans and their ensuing spatial organizations and delimitations of tasks as intimate spaces where
myriad knowledges converge. Using the case study of interactions between various actors at
various scales I examine how forests are becoming spaces of increasingly intimate linkages that
transform resource use patterns and governance strategies, which are themselves important
factors shaping the socio-ecological landscape. Drawing largely on frameworks of critical

Com este trabalho, pretendemos demonstrar o envolvimento que o governo português, na altura liderado por Oliveira Salazar, teve na atitude rebelde de Moisés Tchombé, quando este proclamou a independência do Catanga, contra o Governo Central do Congo e, também, para com a missão das Nações Unidas, a operar neste território africano. Apesar da frágil posição internacional de Portugal, que insistia na manutenção de uma política colonial contrária à dos movimentos independentistas que começavam a surgir nos territórios ultramarinos, teve uma grande influência no desenvolvimento da crise do Congo Belga, após a independência, desencadeada pelo movimento de secessão do Catanga liderado por Moisés Tchombé. Portugal teve sempre como orientação a necessidade de garantir o controle da fronteira norte e leste de Angola colocando, desta forma, o interesse nacional e a manutenção das suas colónias africanas, bem como do regime, como elementos centrais da sua política externa.

Congo (RDC), um país de enormes recursos, mas onde o conflito tem impedido o desenvolvimento. Para isso, integramos o tema nas referências teóricas relativas a
Conflito, Paz e Democracia, conferindo-lhe assim, o enquadramento necessário, ao mesmo tempo que fazemos a delimitação conceptual.
Depois de caracterizarmos o país, percorremos os marcos da sua História recente, que é marcada por conflitos sangrentos, fomentadores de pobreza e de uma situação humanitária dramática. Tais ocorrências, numa linha de relacionamento histórico entre a Europa e África, levaram a União Europeia (UE), na construção e afirmação da sua Política de Segurança e
Defesa, a privilegiar a parceria com o continente africano.

▼ Il s’agit d’une description grammaticale du ɓaka, une langue oubanguienne (Niger-Congo). L’analyse se fonde sur un corpus recueilli sur le terrain, dans la région de l’Est-Cameroun (département du Haut-Nyong). Le corpus représente 1h 36mn de paroles spontanées qui ont été traitées sous Toolbox, Elan et Praat puis analysées dans une perspective structurale fonctionnaliste. La thèse comprend trois parties. La première regroupe une introduction et l’analyse phonologique. La seconde partie est consacrée à l’établissement des catégories grammaticales. Le ɓaka étant une langue à faible morphologie, c’est à partir de critères syntaxiques que quinze catégories ont été identifiées : Verbe, Nom, Nom relationnel, Pronom personnel, Pronom, Adjectif, Adverbe, Numéral, Prédicatif, Préposition, Subordinatif, Coordinatif, Interjection, Onomatopée et Modalité. Je présente, pour chaque catégorie définie, une étude des formes et de son fonctionnement. La troisième partie qui porte sur la syntaxe présente le syntagme nominal, le syntagme verbal et la prédication non verbale qui sont les éléments fondamentaux de la structuration de cette langue. La prédication non verbale combine le recours à des prédicatifs non verbaux et à la construction d’énoncé sans prédicatif dédié fondée sur la juxtaposition de deux éléments dont j’analyse les caractéristiques. J’aborde ensuite l’énoncé complexe, et traite en particulier des connecteurs entre propositions que sont les coordinatifs et les subordinatifs, puis des procédés de topicalisation et de focalisation qui manifestent la hiérarchie dans l’énoncé. Une bibliographie et une annexe présentant la transcription de trois textes du corpus terminent ce travail.
Ɓaka is an Ubangian language of the Niger-Congo language family. The grammatical description is based on a text corpus that was collected during fieldwork in the department of Haut Nyong in the East Province of Cameroon. The corpus consists of recordings (1h and 36 min) of spontaneous speech, which were annotated in Toolbox, Elan and Praat and then analyzed from a structuralist-functionalist perspective. The thesis is divided into three parts. Part 1 contains the introduction and the phonological analysis. Part 2 is dedicated to defining the word classes. As Ɓaka is a language with little morphology, the following 15 word classes were identified through syntactic criteria: verb, noun, relational noun, personal pronoun, pronoun, adjective, adverb, numeral, predicator, preposition, subordinator, coordinator, interjection, onomatopoeia and modal. For each of these defined word classes, a study of their forms and functions is presented. Part 3 deals with the syntax of Ɓaka, more precisely with the noun phrase, the verb phrase and non-verbal predication, which are the fundamental structuring units of this language. Non-verbal predication encompasses both the use of non-verbal predicators as well as constructions that contain no dedicated predicators and are based on two juxtaposed elements, whose characteristic features are analyzed in detail.…

▼ The eastern Democratic Republic of
Congo has experienced constant instability and conflict since 1996. With the collapse of the state of Zaire and the renaming of the country by the late Laurent Desire Kabila in late 1996, there were high expectations from the Congolese population that the country was going to move forward. However, in less than two years, the central government in Kinshasa was facing a new rebellion from the east of the country, followed by widespread violence and criminal activities by armed and militia groups. Although military intervention from Zimbabwe, Namibia and Angola halted the rebellion march to Kinshasa, the capital city of DRC, and allowed the DRC government to sign peace agreement with its opponents in 2002; since then, the prospect of peace in the eastern DRC, especially the North and South Kivus seems bleak. Since 2002, that region has been the theatre of armed and militia groups (both local and foreign), owing to, in the views of various experts, the presence of mineral resources to support their criminal activities, as well as the economic interests of regional actors to create proxy militia and armed groups in the absence of central government in much of eastern DRC. The purpose and rationale of this study is to critically identify actors in the postconflict reconstruction process, and examine the role of mineral resources among other perpetuating factors of the protracted conflict in eastern DRC, in order to arrive at a comprehensive analysis of the reasons for the failure of peace building and post-conflict reconstruction processes that have been undertaken. This study aims to fill a gap in available literature, by pointing to some conflict drivers and factors which have previously been overlooked in post-conflict reconstruction, and in existing research on the topic, especially the role of mineral resources in sustaining conflict. A thorough conceptualization of relevant conflict theory and a historical overview of the conflict in DRC were provided as a point of departure in order to understand other factors that contribute to the intractability of conflict in eastern DRC, this study found that those factors were rooted in the legacy of colonialism; the bad leadership under both the colonial powers and subsequent government of Joseph Mobutu, manipulation and politicization of ethnic identities especially in the South and North Kivu and the geopolitical location of the eastern DRC. This study further established that the presence of mineral resources in eastern DRC indeed contributes to the continued insecurity in that region by providing succour to armed groups, thus undermining peace agreements especially the Pretoria agreement that formally ended hostilities in 2002. Congo pudo reconstruir en buena medida su estatidad. Luego de dos guerras internacionalizadas (1996-1997 y 1998-2003) y las tensiones secesionistas en las provincias del Este (1999-2006), en la actualidad las autoridades de Kinshasa controlan el enorme territorio congoleño como nunca desde la independencia, más de 50 años atrás. Para explicar esta realidad, la presente propuesta analiza una variable poco abordada a la hora de estudiar los factores que han favorecido a la estatidad: la religión. El trabajo presenta al comienzo una breve exposición acerca de los principales debates teóricos en torno a la globalización y la estatidad; y los fenómenos religiosos en esta interacción. Luego se realiza un recorrido histórico de religión y política en la República Democrática del
Congo, para llegar a comprender cómo las autoridades e instituciones religiosas constituyen una fuerza transnacional que opera a través de las fronteras porosas africanas y configura relaciones de autoridad y pertenencia. Tanto en las zonas urbanas como en la periferia rural, las distintas afiliaciones religiosas y sus instituciones han contribuido a restablecer el orden, desmovilizar grupos armados, reactivar la economía y promover la unión nacional luego de décadas de conflicto interno y regional.

Elle révèle les divers mécanismes à travers lesquels, l'élite féminine congolaise a contribué à résoudre les conflits sociopolitiques dans le pays. Ainsi elle souligne le rôle social des femmes Congolaises dans les luttes d'émancipation nationale. En étudiant successivement la socio-genèse du conflit et les réseaux des différents protagonistes, puis l'implication de cette élite en contournant les acteurs politiques à travers les associations, appuyées par les ONG et enfin l'occupation de l'espace public; cette thèse rend compte des logiques sociales, de la transformation sociétale et de la domination masculine dans ses états: institutionnalisé, objectivé et incorporé. Par conséquent, elle appréhende simultanément la dimension étatique et l'influence religieuse généralement séparées par la spécialisation des objets d'étude et des méthodes d'investigation; histoire sociopolitique et sociographique du pays, approche statistique et anthropologie sociale et politique.
This thesis deals with the involvement of women in conflict resolution in Congo brazzaville. It revaeals the various mechanisms through which the Congolese elite Women helped solne socio-politcal conflicts in the country. And it emphasizes the social role of Congolese Women in the struggle for national emancipation. Successively studing sociogenesis conflict and networks of different political actors through associations supported by Ong and finaly the occupation of public space. This theis reports on the social logic of societal transformation and male domination in its forms institutionalized and objectified and incorporated. Therefore it simultaneously captures the state dimension and religious influence generally separated by specialization objects of study and investigation methods socio-political and socio-graphic history statistical approach and social and political anthropology.

▼ Chez les Pende du sud-ouest du Congo Kinshasa (RDC), Mbangu, masque porté par les hommes, a la particularité d’être asymétrique, « hémiplégique », surnommé l’« épileptique », victime du sort d’un sorcier. Il présente des similitudes avec d’autres masques asymétriques dans le monde avec lesquels il est mis en perspective dans une approche comparative. Où, quand, comment intervient Mbangu, quel est son rôle ? Il représente, sur un mode visuel, la marginalité et le désordre de la société. Sa sortie sur l’aire de danse est censée réaffirmer l’ordre social dans une ambiance qui mêle dérision, burlesque et compassion. L’hypothèse soutenue est que ce type de masque asymétrique répond à un trauma et exprime douloureusement une « perte de monde » et, corollairement, appelle à la construction d’un ordre social nouveau. Sont ici analysées les conditions historiques, politiques, socio-économiques et culturelles par lesquelles l’expression de la dissymétrie a pu émerger chez les Pende. Par ailleurs, cette société – « société du regard » – a élaboré une morphologie symbolique complexe du visage où le regard est conçu comme un régulateur social auquel le « regard des masques » participe. Le chef qui réunit les caractéristiques du « roi sacré » – et auquel Mbangu renvoie – est la figure emblématique de ce regard par l’action de ses masques et de ceux de la palissade de sa case. Le « regard des masques » semble donc s’instaurer en dispositif politique qui agit en lieu et place de la présence effective du chef. Le masque Mbangu révèle aussi l’importance de la relation scopique dans la représentation de l’altérité et dans la construction de la conscience individuelle et collective pende.
In southwestern Congo Kinshasa (DRC), Mbangu mask of the Pende people, worn by men, has the distinction of being asymmetrical, « hemiplegic », nicknamed the « epileptic », victim of a spell cast by a sorcerer. This mask has some similarities with other asymmetric masks in the world, whith whose is put into perspective in a comparative approach. Where, when and how does Mbangu operate, what is his role ? On a visual mode, it would represent marginality and disorder in society. Its emergence on the dance ground is supposed to reaffirm the social order in a popular uproar that combines burlesque derision and compassion. The hypothesis supported here is that this type of asymmetric mask is the result of a « trauma » and the expression of a « lost world » but, at the same time, it calls for the construction of a new social order. We analyzed the historical, political, socio-economic and cultural conditions in which the expression of the asymmetry could emerge in Pende mascarade. The Pende society – « society of the view » – has developed a complex symbolic morphology of the face where the sight is conceived as a social regulator; and the eyes of masks are part of. ▼ Interest in the domain of Entrepreneurship is growing considerably. Nevertheless, the
plan of this study is to discover the distinctiveness of entrepreneurship in the Democratic
Republic of Congo (DRC). The cutting-edge hostile environment for business
developments of underdeveloped countries. In the case of the DRC, entrepreneurship is
developed under life-threatening conditions, rarely seen elsewhere. These extreme
conditions for entrepreneurship are present as the result of transitional particularities and
the marginalised context deriving from political circumstances surrounding the DRC.
Apart from the barriers and particularities of a business environment derived mainly from
a transitional phase, the political situation has heavily influenced entrepreneurial
developments in the country.

▼ This thesis, through the lenses of technology acceptance theory, and considering the lack of online interactivity in service delivery, aimed at proposing a model of online business registration adoption for re-branding the government Department of Trade and Industry (DTI)
Congo-Brazzaville. Task-Technology Fit (TTF) and Technology Acceptance Model (TAM) were the underpinning theories with which the study described the social phenomenon: online business registration adoption at DTI
Congo-Brazzaville as branding tool. Arguably, in doctoral level, without underpinning theories, research conclusions look speculative. The use of theory to underpin this study was further motivated by its interpretative nature and the interplay between technical and non-technical factors which are involved in the process of technology adoption in service organisation.
To come up with new engagement, and informed from successful implementation of DTI South Africa’s e-governance model, DTI
Congo was used as case study; hence the country is known for being at the bottom of the pile when it comes to the ease of doing business ratings. Despite resultant benefits namely increased efficiency, effectiveness and improved service delivery that offer e-governance in making services nearer to citizens and easing the strenuous processes involved in manual operations, not all managers at the DTI
Congo advocate the adoption of online business system. The problem is that insufficient advocacy of online business registration enforces the void of re-positioning the organisation vis-à-vis its internal customers (employees) as lean and innovative. The overall research question is: “how does the DTI
Congo-Brazzaville intend to improve business registration using online business registration service as a branding tool”? The main objective therefore was to propose online service adoption re-branding and re-positioning DTI
Congo-Brazzaville.

urbaines congolaises (RDC) dans leurs rapports à la vie
quotidienne, à l'histoire et à l'identité de sa capitale Kinshasa.
Partant d'une intuition fondamentale de Claude Lévi-Strauss (la
musique serait, comme le mythe, une machine à supprimer le temps),
c'est autour de la problématique de la musique comme rapports aux
temps (social et symbolique; historique et mémoriel; musical;
performatif) que l'auteur cherche à en renouveler la portée en lui
donnant une emprise analytique nouvelle. La thèse débute par une
étude générale de l'évolution des musiques urbaines congolaises à
l'aune des catégories endogènes contemporaines (« moderne », «
religieuse », « traditionnelle » et « internationale »). Combinant
l'histoire et l'anthropologie culturelle, l'ethnomusicologie et
l'écriture audiovisuelle, différents plans de la vie quotidienne et
de la pratique musicale sont ensuite observés, analysés, confrontés
: celui d'une commune de la capitale (Bandai); celui d'un certain
nombre d'acteurs individuels, principalement des musiciens et des
mélomanes; celui de la ville entière comme espace imaginaire et
identitaire. À la fois théorique, comme interrogation générale sur
les relations entre la musique et la vie sociale, et empirique,
comme ethnographie des conduites et des savoir-faire qui lui sont
associées à Kinshasa, la thèse cherche ainsi à dépasser les écueils
du culturalisme en interrogeant la manière dont la « globalisation
» met en mouvement les notions « d'universalité » (la musique, le
temps, l'humain) et de « particularité » (l'appartenance, le
quotidien, l'organisation sociale) tels que définis par le projet
de modernité.

▼ Girl child education has been a challenge for many African countries due to the patriarchal gender order of communities. This is not different in the Democratic Republic of Congo where son preference is still rife. This study sought to explore how girls in rural Lubaland in DRC experience their schooling in relation to the traditional gendered practices. A qualitative approach to research was employed within an interpretive paradigm. Young school going girls were purposively selected from two rural schools in Malemba and Mwanza. A total of 18 girls became participants to the study. Data were generated through the use of drawings and focus group discussions to explore how the girls saw themselves as girls and students at home, on the way to school and at school. This was done in order to understand how they experience their schooling lives. The findings revealed several gendered challenges that the rural girls experience daily in terms of gaining access to and succeeding in schools. The challenge of son preference and gender role stereotyping created challenges for girls at home, while lack of facilities for girls’ sexual health and long distances to school created challenges for girls on the way to school. At school the girls experienced challenge of being unable to afford school fees and corporal punishment. If these challenges are to be eradicated, there is need for all stakeholders in education, including traditional leaders and communities to deconstruct the gendered dynamics that position women and girls as subordinate and not deserving of an education. This study has implications for educational planning in the Democratic Republic of Congo for girl children to get better access and success in their education. The findings also highlight the need for more concerted efforts to understand the experiences of schooling girls across DRC in order to influence teacher training and educational provisioning that is girl friendly.

▼ This thesis examines the artisanal mining-combatant-recruitment nexus in war torn zones. With a case study of the Kivus in the Democratic Republic of Congo (DRC), which has experienced one of the world’s worst blood-shedding over the last two decades, the study uses a constructivist Grounded Theory approach to research in terms of both data collection and analysis. It focuses on the existing body of knowledge on conflict analyses with a particular reference to the absurdity of abundance theory, which singles out the endowment of natural resources and weak governance as the main fuelling-factors of the conflict in the DRC. Data collection was carried out using diverse methods including literature reviews, interviews and focus groups. In particular, the study aims to explore how the demilitarisation of the mining zones could contribute to enhancement of the Disarmament, Demobilisation and Reintegration (DDR) of ex-combatants and promote social cohesion, sustainable peace and security in the eastern DRC. The analysis of the conflicts in the DRC and the acquaintance of belligerents with artisanal mining revealed the convoluted multi-layered nature of the conflicts in the country and their intricate causalities. The examination of the demilitarisation of the mining zones pertinent to the nexus between artisanal mining and the recruitment, reintegration and re-recruitment of combatants in the Kivus identified a few prerequisites in order to sever the artisanal mining-combatant-recruitment relationship that largely swivel around “bottom-up solutions”. The research contributes to knowledge in three broad areas; firstly, it contributes to ongoing academic debates on conflict analyses, the political economy of armed conflicts vis-à-vis mining sector as well as the mining sector and DDR of combatants in the DRC. Secondly, it offers empirical analysis and data on the combatants’ recruitment and DDR process and the artisanal mining sector with regards to state failure and protracted armed conflict in the DRC. Finally, it underlines the need to re-evaluate “the concept of community-based approach”, a key approach to improving peacebuilding and post-conflict recovery in the eastern DRC.

The criminal consequences of the many imperialistic, hegemonic and barbarous wars in that century were immeasurable in terms of violations of human rights.
Notwithstanding the emergence of international criminal justice through the experience of the International Criminal Military Tribunal of Nuremberg and Tokyo and later the ad hoc International Criminal Tribunal for former Yugoslavia and Rwanda, globally, impunity for egregious crimes continues.

While previous tribunals were ad hoc, the ICC is permanent and has large territorial jurisdiction. This raises hope among the many Congolese victims of the first African World War, who view the ICC as a paradigm change that will put a stop to impunity for crimes against humanity and the crimes of genocide and war.
In the Democratic Republic of the
Congo (DRC), the past decades have been marked by instability and horrible armed conflicts (1996-97 and 1998-2003) which left several million people dead, and which were marked by gross war crimes. The negative consequences of those atrocities persist until today. While the ICC initiated the prosecution of some war criminals in 2004, most crimes committed before 2002 remain unpunished, because the ICC's jurisdiction is limited to after that time.
It is therefore imperative to examine other mechanisms to deal with impunity for various grave crimes, including war crimes, perpetrated between 1996 and 2002. Thus the aim of this research is to contribute to the fight against impunity for crimes in the DRC by examining how other modes of jurisdiction such as the principle of universality can be applied, and to assess the need for the establishment of a specific tribunal for the DRC.
Considering the inability and incapacity of the Congolese judicial apparatus, this study concludes by recommending the establishment of a Special Criminal Tribunal which can put an end to impunity for serious crimes committed in the DRC.

in the Democratic Republic of Congo. Yet no significant centre of power or opinion is
calling for a "humanitarian intervention" in Congo
In his special report on the event in Ituri, (January 2002 - December 2003)
presented to the Security Counsel on the 16th July 2004 the General Secretary Of the
United Nations Koffi Annan, reported that the situation of human rights in the Ituri
district, situated in the Oriental Province of the Democratic Republic of Congo is
today one of the most disastrous of the world after it has staid unknown. According to
the investigations done by the MONUC and other association of human rights
defenders between January 2002 and December 2003, some 8 000 civilians -
probably more, in fact - have been victims of murder or the blind use of force. It is
impossible for the moment to give an estimation of the number of women who have
been raped or put to sexual slavery. More than 600 000 civilians have been forced to
run away from their places, Thousands of children aged from 7 to 17 years old have
been unwillingly recruited by armed groups.
The RIPADHU has reported that since end of May the South Kivu is victim of
an unjustified war which has opposed the 10th Military Region to insurgents. This war
has left behind it a lot of damage. Systematic pillage, woman and children have been
raped, imprisonment in inhuman conditions, houses have been bunt, killing of people
One asks then why is it that any intervention is being setting up for the
Democratic Republic of Congo is it because what is going on has not reached the
level of becoming matter of international concern? The following question being what
then is that level? Can there be set in advance some criteria of intervention? The heart
of the matter is to try to find out if the humanitarian intervention is legal, if so what is
its legal basis, one may ask that if human rights are being reported all over the world
who then will intervene where in other world what is the level of human rights
violation which warranty the intervention, who has to intervene, or what are the
criteria of the intervention? The researcher will particularly focus on the situation of
the Democratic Republic of Congo and analyse whether the situation has or has not
reached the level required to the setting up of a humanitarian intervention. It is
ambitious to pretend to provide answers to the controversial question who has the
duty to intervene, when he shall do it, and how is he supposed to intervene though this
will be the focus of the study.
After an introductory chapter the researcher will analyse in a second chapter
the legality and the criteria of a humanitarian intervention, the third chapter will be
focused on the particular case of the Democratic Republic of Congo, in the last
chapter he will come up with some recommendations and…

▼ L’identité professionnelle des enseignant-e-s des deux Congo. Les enseignant-e-s du primaire et du secondaire des deux pays, le Congo-Brazzaville et le Congo-Kinshasa, ont traversé, ces quarante (40) dernières années, des difficultés socio- économiques et politiques qui ont affecté leur éthique professionnelle, les obligeant à remettre en cause leur identité professionnelle. Des analyses sur les contextes éducatifs, les actions professionnelles, les aspects socio-relationnels, organisationnels, institutionnels et non formels nous permettront : d’étudier le rôle joué par la formation initiale des enseignants, de situer les questions relatives aux financements des structures éducatives ainsi que l’efficacité desdits financements, de comprendre la désaffection généralisée et l’affaiblissement du statut social et économique de la fonction d’enseignant-e. Tout ceci permettra de mieux expliquer le caractère de vulnérabilité des enseignants actuels, et de justifier ce qu’est « le revêtement identitaire idéalisé » selon (Dubar, 2000 :165). L’analyse des résultats de 103 interviews biographiques avec des enseignant-e-s formé-e-s pendant 4 périodes différentes sont présentées et analysées. Les résultats indiquent qu’a chaque période correspond une identité professionnelle de base. Sur le plan social, les enseignants, qui se considèrent comme Sisyphe du 21ème siècle et kamikazes des temps modernes, disent vivre une « tempête, une panique et une débandade identitaires » . Une étude comparative montrera le degré d’intervention dans les deux capitales proches géographiquement, mais ayant des systèmes éducatifs divergents : le Congo-Brazzaville ayant hérité du système français, le Congo-Kinshasa ayant hérité du système Belge. La comparaison sera intra-pays et inter-pays, et concernera les formations initiale et professionnelle des deux pays afin d’interroger leurs systèmes nationaux et les éventuelles similarités ou différences identitaires.

▼ Massaverkrachting als oorlogswapen is een harde realiteit in Congo en vormt de kern van de strijd van Dr. Denis Mukwege voor de verdediging van de rechten van de Congolese vrouwen. In deze scriptie bestudeer ik de representatie van massaverkrachting in Congo in twee toneelstukken, met name Missie (2007) van David van Reybrouck en Ruined (2008) van Lynn Nottage. Het doel van deze scriptie is een vergelijkende analyse te maken om te kunnen vaststellen of de onderzochte teksten en de relazen van de verkrachte vrouwen die ze bevatten als memorial narratives gelden, d.w.z. narratives die referentiekaders bieden voor het accurate herdenken van een (traumatische) gebeurtenis. Met het oog hierop vergelijk ik de literaire strategieën en narratieve patronen die in de teksten aan bod komen en de literaire verwerking van de getuigenissen van missionarissen en Congolese verkrachte vrouwen waarop deze stukken berusten. Tot slot ga ik dieper in de factoren die het ontstaan van memorial narratives over verkrachtingen in Congo bevorderen of verhinderen. Mijn onderzoeksvraag wordt bevestigd - Missie en Ruined zijn katalysatoren van memorial narratives.

▼ The Congo Basin features among the oldest, largest and biologically richest on earth
after the Amazon and before the Mekong. Sadly enough it is the least known. It offers
opportunities to study evolution given its treasure of global biodiversity and high
aquaculture potential (large hydrographic network and suitable climate). It is within
this framework that phylogeographical research has been initiated to understand the
origin of the ichthyological fauna and to identify potential strains for the development
of aquaculture. The model chosen is the catfish Clarias gariepinus (Burchell, 1822), a
species with great aquaculture potential. This fish lives in the Congo River from
source to mouth, as well over a large part of the African continent. The results show
the presence of four clades and several groups which represent a large genetic
differentiation. Evolution is ancestral in the south and north of the Congo Basin (relict
population) and represents a Pleistocene colonisation in the Central Basin. Even in a
contemporary context, evolution seems to follow these two models. Two hypotheses
have been retained to support the causes for the accumulation of diversity: the
hypothesis of long-distance dispersal in the Central Basin and the refuge hypothesis in
the peripheral zones of the Central Basin. Moreover, the four major clades have been
identified to match with four major ichthyological provinces of Africa: Nilo-Sudan,
Zambezi, East Coast and Congo. This confirms an ancient connection between the
various basins. Hence, the evolution of C. gariepinus in the Congo basin corresponds
with that of the fishes and mammals with a high dispersal capacity, which is found in
several African basins. Ideally the evolution of the endemic fauna of the Congo basin
should be studied in order to compare it with the higher mentioned high dispersal
group. It would facilitate our understanding of the evolution of the fish fauna of this
large African basin for sustainable management.
Le bassin du Congo est l’un des plus vieux, vastes et biologiquement riches au monde
après celui de l’Amazone et avant celui du Mekong. Malheureusement ce bassin est le
moins connu. En tant que réserve de la biodiversité mondiale et ayant un potentiel
aquacole élevé (grand réseau hydrographique et bon climat), ce bassin offre des
opportunités d’études d’évolution. C’est dans ce cadre que des études phylogéographiques
ont été initiées afin de connaître l’origine de la faune ichthyologique.
Le modèle retenu était celui du poisson chat Clarias gariepinus (Burchell, 1822). Ce
poisson est signalé dans le fleuve Congo de la source à l’embouchure, ainsi que dans la
plus grande partie du continent africain. Les résultats obtenus ont révélé l’existence de
cinq clades (groupements historiques de populations) dont quatre rencontré dans le

▼ La mise en oeuvre de l’aménagement durable des
forêts (ADF) est marquée en République Démocratique du
Congo (RDC)
par des enjeux importants. Le but de notre thèse était d’explorer,
d’une manière holistique, les défis et les opportunités associées à
la mise en oeuvre de l’ADF dans le contexte socio-écologique de la
RDC. Elle se focalise sur le cas du territoire d’Oshwe dans la
province de Maï-Ndombe en RDC. C’est une étude de nature
interdisciplinaire qui englobe trois volets distincts de l’ADF. Le
premier chapitre porte sur les perceptions des acteurs locaux,
nationaux et internationaux sur les enjeux de l’ADF en RDC. Nous
avons appliqué l’analyse qualitative du discours des différents
acteurs. Après cette analyse, la liste des enjeux de l’ADF en RDC a
été établie. Cette liste a orienté la détermination des critères
d’ADF qui répondent aux attentes des différents acteurs consultés.
Cette étude révèle que les acteurs locaux sont surtout préoccupés
par les enjeux sociaux; les acteurs nationaux par les enjeux de la
gouvernance forestière et les acteurs internationaux par les enjeux
écologiques de la conservation de la biodiversité. Les deux autres
chapitres portent respectivement sur les défis et les opportunités
relatives à un enjeu social et à un enjeu écologique, enjeux
reconnus critiques par les acteurs consultés. Ainsi, le deuxième
chapitre concerne les défis de la mise en oeuvre des Cahiers des
Charges Sociales (CCS) au territoire d’Oshwe. Nous avons appliqué
l’analyse qualitative des discours des différents acteurs locaux et
nationaux. Cette démarche nous a permis d’établir des convergences
dans le contenu de leurs différents discours sur le CCS. Nous avons
observé l’enthousiasme des différents acteurs sur la structure
organisationnelle de la mise en oeuvre du CCS lors des
négociations. En plus, le CCS est reconnu comme un mécanisme formel
et horizontal de partage des bénéfices tirés de l’exploitation
forestière. Il contribue à réduire les conflits entre les
communautés locales et les concessionnaires forestiers en faisant
office d’un « arbre à palabre ». Toutefois, la lenteur dans
l’exécution des chronogrammes retenus dans les clauses des CCS
constitue un germe de conflit. Le troisième chapitre porte sur
l’enjeu du maintien de la composition forestière après les coupes
d’Abattage Contrôlé et Directionnel (ACD). Ainsi, nous avons
comparé les effets des coupes d’ACD et des effets des chablis sur
la régénération des espèces forestières commerciales. Nous avons
recouru à l’analyse de redondance canonique afin de déterminer les
espèces qui sont influencées significativement par un type de
trouée tout en considérant la taille des trouées. Guarea cedrata se
penche vers les trouées naturelles et Canarium schweinfurthii
s’attache aux trouées d’ACD. Ces informations sont fondamentales
pour mettre en oeuvre l’aménagement écosystémique basé sur
l’émulation d’une perturbation naturelle telle que le chablis.
Cette thèse de doctorat atteste que l’ADF est peu facile mais pas
impossible en RDC en associant les différents acteurs…

▼ The main goal of this study is to describe the morphological properties of C’lela; a
Niger-
Congo, Western Kainji language spoken in the eastern part of Kebbi State,
Nigeria. The study mainly adopted the classic descriptive model of linguistics in
particular to explore and highlight the morphological processes and properties of
C’lela. The relevant data for the study were sourced mainly from the extant literature on
C’lela as well as the field data. By and large, the primary data were corroborated with
the secondary sources.
The study established that C’lela has distinctive morphological properties akin to other
languages across West Africa. C’lela uses prefixes and suffixes on nominal and verbal
categories to provide information about number and tense, and equally undergoes the
major morphological processes such as compounding, derivation, affixation, and
reduplication. In terms of derivation it was revealed that though derivational processes
in C’lela are analyzable mainly on the principles of concatenative morphology where
prefixes and suffixes are in concatenative relationship with their host stems, the
language also lends itself to non-concatenative morphology, where the internal stem-
vowel, instead of affixes, contains the syntactic and semantic information in the
derivation. This suggests that C’lela has a derivational system that exploits affixation,
as well as internal modification. With regard to compounding, it emerged that C’lela is
an endocentric but a left-headed language. It was also realized that the language
exhibits both partial and complete reduplications, which in most cases are lexical and
semantic in function. It was particularly noted that the complete reduplication of verbs
that contain heavy-initial disyllabic stems in C’lela are accompanied by phonological
operations such as syllable truncation and imbrication.
The study while illustrating the chief morphological processes inherent in C’lela,
endeavored to examine and highlight the various phonological processes that are often
triggered when stems come into contact with affixes or when compounding and/or
reduplication take place. These morphophonological processes include but are not
limited to; vowel copying, vowel lengthening, vowel deletion, metathesis, vowel
lowering, complementary distribution, syllable truncation, and imbrication.

ENGLISH ABSTRACT: The climate of the Great Lakes Region fostered desperate sources of insecurity which fed
each other in a conflict-system which was also largely fuelled by the surrounding war
economy. Consequently, the focus of this study was narrowed to providing only a descriptive
analysis of the Democratic Republic of the Congo’s peace processes of 1998-2002.
Subsequently, the surrounding climate served to aggravate the DRC’s ethnic cleavages and
the conflict grew so complex that the issues could no longer be clearly divided. The
motivation for conducting a study of this nature was that amidst the twenty-three failed
attempts for peace, the conflict persisted with no signs of abating, which suggests that a
historical and discourse analysis of the peace processes is justified.
This study found that during these peace processes, far greater prominence was given to
Track I diplomacy than to the unofficial Track II diplomacy. This was due to various
limitations that existed. This distinction is fundamental because even though unofficial
diplomacy has a different function to official diplomacy, their values are equal and more
effective in a peace process when there is a collaborative effort between the two. This is
called a Multi-Track approach (Diamond and McDonald, 1996). Thus this study proposes
that by giving Track II diplomacy a greater prominence in a peace process, the Multi-Track
approach would be fully utilized. It suggests that governmental, informal, and unofficial
contact in civil society is fundamental in trust-building between parties in negotiation.
Overall, there is value in providing a critical descriptive analysis of both Track I and Track II
diplomatic initiatives that were undertaken during the 1998-2002 peace process, in order to
expose the shortcomings. In doing so, this study presents the Multi-Track approach in order
to emphasize its potential efficacy in addressing similar future cases of intractable conflict.
AFRIKAANSE OPSOMMING: Die omstandighede in die Groot Merestreek het onsekerheid gekweek, wat mekaar versterk
het in die konteks van ’n konflik-sisteem wat ook deur die omliggende oorlog-ekonomie
aangevuur was. Gevolglik is hierdie studie se fokus beperk tot ‘n beskrywende analise van
die vredesprosesse wat tydens 1998-2002 op die tweede rebellie in die Demokratiese
Republiek van die Kongo gevolg het. Die omstandighede in die omliggende omgewing het
die DRK se etniese splitsings vererger, en die konflik het so kompleks geword dat daar nie
meer duidelik tussen die verskillende geskilpunte onderskei kon word nie. Die motivering vir
hierdie studie is dat daar te midde van die drie-en-twintig mislukte vredespogings geen teken
was dat die konflik aan die afneem was nie, wat suggereer dat ’n historiese diskoers analise
van die vredesproses geregverdig is.

▼ Première étude systématique de l?histoire théâtrale en République Démocratique du Congo, ce travail se situe sur le quadruple plan historique, littéraire, théâtral et ecclésiastique. Il est structuré en trois grandes parties encadrées par une introduction et une conclusion. En annexe se trouvent des notices biographiques concernant quelques acteurs et une liste des pièces de théâtre mentionnées. La première partie consiste en un inventaire organisé sur une base topologique. Les représentations théâtrales y sont recensées par localités situées dans huit subdivisions administratives du pays qui, comme ces dernières, sont classées alphabétiquement. A la fin de chaque section, un tableau statistique visualisé par un histogramme et assorti d'une note explicative en donne une vue synthétique. Cet inventaire est précédé d'une description des sources d'information essentiellement écrites que sont les journaux de l'époque. La deuxième partie fait la chronologie des actes théâtraux ayant eu lieu sur le sol congolais du 25 décembre 1905 au 30 juin 1960. Systématique et logique, la troisième partie tire quelques leçons. Elle traite successivement de la constitution du répertoire, d'un théâtre intellectuel divertissant la masse, de ses aspects religieux, éducatifs et sociaux, et enfin de son caractère formateur
First systematic study of the history of theatre in the Democratic Republic of Congo, this work positions itself within the quadruple historic, literary, theatrical and ecclesiastical plan. It is structured in three large parties framed my an introduction and a conclusion. Annexed are the biographical notes concerning some actors and a list of the mentioned theatrical pieces. With regard to its content, the first part consists of an inventory which is organized on a topological basis. The theatrical representations are reviewed by locality in the country's eight administrative sub-divisions, which are classified in alphabetical order. At the end of each section, a statistical matrix visualized by an histogram and accompanied by an explanatory note provides a synthetic view of the whole work. This inventory is preceded by a description of information written sources, i.e. the newspapers of the time. The second part presents a chronology of theatrical acts in Congo between 25 December 1905 and 30 June 1960. In a systematic and logical fashion, the third part deals successively with the constitution of the directory, an intellectual theatre aimed at entertaining the masses, its religious, educational and social aspects, and finally its formative character

▼ Le propos de cette thèse est d’étudier le rift de l’Atlantique sud au
Congo, en se focalisant sur (1) la dynamique des reliefs amont du rift (les épaulements de rift), (2) l’architecture stratigraphique du remplissage sédimentaire et (3) le routage sédimentaire ante- à syn-rift. L’etude de terrain a permis de reconstituer la géométrie des paléovallées, le cadre sédimentaire et stratigraphique du remplissage sédimentaire et de discuter des implications géodynamiques de ces paleovalleys en termes de dynamique du rift et de contrôle des systèmes sédimentaires. Ces paléovallées ont été incisées dans le substratum précambrien du Mayombe par des rivières alluviales pendant la phase d'étirement du rifting et remplies par des sédiments d’âge Aptien moyen de la Formation de Chéla. Le remplissage sédimentaire de ces paléovallées consiste en des faciès gravitaires sousaquatiques interdigités dans les argiles lacustres riches en matière organique, recouvrant en discordante le socle Précambrien du Mayombe. Ces depôts s'organisent en une séquence transgressive, caractérisée par l’empilement des séquences élémentaires de type finning-up . L’analyse sédimentologique de carottes a permis de caractériser les environnements de dépôts des Formations de Pointe-Noire, Pointe-indienne et de Chéla, correspondant à la phase d’hyperextension (sag) de l’evolution du rift. La Formation de Pointe-Noire d’âge Barrémien moyen est constituée des faciès gravitaires de cônes sous-lacustres profonds à dominance argileux et riches en matière organique dans lesquels s’intercalent localement des faciès carbonatés de plate-forme peu profonde et gravitaires resédimentés du membre de Toca, accumulés au cours d'une importante transgression associée à un évènement anoxique général. La Formation de Pointe-indienne d’âge Barrémien supérieur à Aptien inferieur est caracterisée par variations latérales et verticales de faciès. Elle comprend des faciès gravitaires gréso-argileux (membre Mengo) de cônes sous-lacustres profonds, surmontés par des faciès mixtes silicoclastiques et carbonatés de rampe interne à moyenne dominée par des vagues de tempêtes (Membre des Argiles vertes) passant progressivement vers le haut à des faciès deltaïques de Tchibota. La formation de Chéla d’âge Aptien moyen se caractérise par des variations latérales et verticales de faciès. Elle comprend des faciès sous-aquatiques de delta alluvionnaire passant latéralement aux faciès gravitaires sous-lacustres, suivi par des faciès de baies mixtes lacustres -marine, surmontés par des faciès de sabkha (membre Vembo) recourvets par les evaorites de Loémé. Les facies de sebkha au sommet de la Formation de Chéla témoignent d’une incursion marine avant la mise en place des évaporites. ▼ The development of a truly globalized world system has meant that understanding the complex political structures of disparate countries worldwide has become increasingly important. The security concerns of countries now have global relevance and global impact, making their study all the more important. This hyper-globalized system has brought with it, as a result, shifting conceptions of sovereignty, legitimacy and the role of transnational institutions, where the question of the role of the international community becomes all the more important. How will it approach, for example, notions of aid, military intervention and economic development in countries with troubled histories? Should it? To what degree does international problem solving become a breach of sovereignty? The Democratic Republic of the
Congo is one such country, with brutal colonization, repressive authoritarian military rule and corrupt democratic governance all elements of the its controversial past. The goal of this thesis is to evaluate the Congo’s role in the globalized world, particularly in light of the far-from-optimistic outlook emerging from the data and from the established voices in the field of International Affairs, who begin to question the Democratic Republic of the Congo’s very existence as a country and sovereign state. By analyzing the Congo’s history and its current state of affairs, this study will first seek to clarify the convoluted legacy of its past, understanding in what way the
Congo, as a sovereign state, in being questioned and challenged, and what lessons one can gleam from the its evolution as a failed state. My findings show that the
Congo is, in a word, a unique historical and political construct, formed by colonial interests and cold war politics and held together by the sheer force of will of the international community. One could even claim that the
Congo can be defined as “a state that never was”, existing in the collective psyche of aid workers, foreign dignitaries and mapmakers. While I see many of the points of such a view, I challenge it, claiming that while the
Congo suffers from a great deal of endemic issues, the reality of the
Congo is quite different: governmental control is poor-but- within-parameters in the western areas of the country and utterly non-existent in the east. The
Congo, as a failed state, is not a single immutable object, but rather a massive collective that requires a more nuanced interpretation than simply labeling it a non- existent state, or a failed state. Given the uniqueness of the situation, I am led to the conclusion that the Eastern
Congo has become what I define as a “Non-Governed Region”, a region falling under the purview of the national sovereignty of a nation that is incapable of providing basic services and security to its citizens, which must then be provided by the international community in the form of development assistance and peacekeeping.
