▼ Background: Innovation is an important aspect of business today. It is important for companies to be innovative in order to stay competitive with their competitors. During the last couple of decades, technology has become more and more common both in our daily life, as well as in businesses. This has lead to an increase in technology implementation, especially within the service industry, where customers now can use self-service technologies in order to receive the service on their own. However, a lack of self-service technologies was discovered within the fast food industry. Since these types of innovations increased the service efficiency and decreased the waiting-time for customers, the authors believed that this would be very interesting for local managers within the fast food industry. Therefore, the authors began to investigate how much power local management has over these types of new innovations. Purpose: The purpose of this thesis is to explore how local management affects the innovation process, within fast food restaurant chains. Method: By conducting a cross-case study with the two fast food companies Subway and Max, the authors interviewed local fast food managers in order to explore the effect local management have on the innovation process. These two cases were selected since Subway fully consists of franchisees, while Max is almost completely company owned. Therefore, the two most common organizational structures within the fast food industry are included which will provide a more fair view of the industry. Conclusion: The effect of the innovation process has a positive relationship with the amount of power distributed to the local management. However, these areas differ depending on the organizational structure, with franchisees achieving their highest amount of power within medium-sized innovations and managers in company-owned outlets maintain their highest amount of power within minor innovations. Even though the overall communication was perceived as satisfying and efficient, large opportunities for improvements occur. By implementing more horizontal communication within the local management, it is in the belief of the authors that the entire internal communication will benefit. Especially this would benefit the franchise system where an increased local communication and collaboration would lead to more efficient communication throughout the entire organization.

▼ Magistrsko delo je v celoti osredotočeno na kaznivo dejanje zlorabe položaja ali zaupanja pri gospodarski dejavnosti (240. člen Kazenskega zakonika, v nadaljevanju KZ-1), ki je v Kazenskem zakoniku Republike Slovenije uvrščeno med kazniva dejanja zoper gospodarstvo. Kot čisto gospodarsko kaznivo dejanje ščiti na eni strani gospodarstvo in premoženje gospodarske družbe, hkrati pa inkriminira dejanja storilca, ki pri opravljanju gospodarske dejavnosti z namenom, da bi sebi ali komu drugemu pridobil protipravno premoženjsko korist ali povzročil premoženjsko škodo, zlorabi dano zaupanje. Pred osamosvojitvijo Republike Slovenije smo kaznivo dejanje poznali v nekoliko drugačni obliki. Uvrščeno je bilo med kazniva dejanja zoper uradno dolžnost, kar pomeni, da je bilo lahko storjeno le s strani uradnih (kasneje pa tudi odgovornih) oseb. Po trenutni ureditvi je to kaznivo dejanje prav tako delictum proprium, vendar pa storilci niso uradne osebe, temveč osebe, ki pri opravljanju gospodarske dejavnosti storijo katerega izmed možnih izvršitvenih načinov (zlorabijo položaj, dano zaupanje, prekoračijo pravice ali opustijo dolžnosti, ki jih imajo na podlagi zakona, drugega predpisa, akta pravne osebe ali pravnega posla). V teoriji se obravnavano kaznivo dejanje velikokrat omenja kot »menedžerski delikt,« saj njegovi storilci običajno izhajajo iz vrst direktorjev, poslovodij, članov uprave,.. gospodarskih družb. Podobno ureditev je sprejel tudi zakonodajalec Republike Hrvaške z novim kazenskim zakonikom, ki je začel veljati 2013 in kateri je (podobno kot slovenski) kaznivo dejanje zlorabe zaupanja povzel po nemškem kaznivem dejanju »Untreue.« Bistvena razlika med obema ureditvama je v tem, da pri storilcu kaznivega dejanja po hrvaškem KZ zadostuje, da je podan eventualni naklep (enako kot po nemškem Untreue), pri nas pa eventualni naklep ne zadošča. Za obsodilno sodbo je potrebno dokazati, da je storilec ravnal z direktnim naklepom. Druga pomembna razlika je v tretjem členu 240. člena KZ-1, ki inkriminira tudi namen pridobitve nepremoženjske koristi in ga nov hrvaški KZ ne pozna. Največje težave sodišču v praski povzročajo primeri, ko so storilci kot nosilci določenih pooblastil hkrati tudi družbeniki gospodarske družbe, katere obstoj je zaradi kaznivega dejanja ogrožen. Ker so gospodarske družbe samostojne nosilke pravic in obveznosti in imajo kot pravne osebe svoje premoženje ločeno od premoženja družbenikov, se z njenim premoženjem ne sme razpolagati kot z lastnim. Družbeniki niso lastniki družb, temveč so le imetniki njenih deležev (delnic ali poslovnih deležev). Vendar pa sodna praksa pri takšnih nedovoljenih razpolaganjih dopušča izjeme. Protipravnost je namreč izključena, če je storilec za storitev tega kaznivega dejanja imel jasno in vnaprej dano soglasje vseh preostalih družbenikov. Prav tako se kot storilec tega kaznivega dejanja po stališču slovenske (ne pa tudi hrvaške) sodne prakse ne bo mogel obravnavati družbenik enoosebne družbe z omejeno odgovornostjo. ▼ The Promotion of Government Affairs must rely on abundant and stable revenue sources. Hence, tax is one of the important Central government finances work, which not only affects the economy but also the most important policy of government revenue items. To meet the needs of government administration and support functions of national economic development,the government's tax reform and tax changes should be compatiblle with the change of environment and times with the new concepts & methods to adapt to environmental changes and actual needs, in order to maintain tax fairness. This empirical research based on literature review and the analysis of secondary data with direct &indirect objective evidence gathering , by collecting data and related case study, byy five cases and five appearance to analyze the real situation of small-scale business. Appearance1: Do not need to use unified invoices as long as Small Business Entities meet the special Regulations Governing. Appearance 2: Do not need to use unified invoices as long as Small Business Entities meet the requirements of related law of special Regulations Governing. Appearance 3: Small Business Entities will be approved to use uniform invoice as long as IRS investigation be adjusted after sales doubled. Appearance 4: The actual turnover and sales, if approved by the IRS are differences, there willbe underpaid mechanism. Appearance 5: Small Business Entities who approved by the IRS to use invoices can not use uniform invoice as long as they canceled the original firm with a new name on the site of another application for the establishment of a new firm. Appearance 1,4,5 does not hold, Appearance 2 was established & Appearance 3 part established. The research was supported by the case and Appearance summarized above, the IRS can be based on the relevant provisions of the approved Small Business Entities to use the uniform invoice as long as the monthly turnover is over than NTD 200,000 and has the ability to use a unified invoice. Cette thèse, fondée sur une enquête ethnographique, est consacrée aux employés de la SNCF qui travaillent en gare, « au contact de la clientèle ». Figures familières des voyageurs, les agents de vente, d‟accueil et d'escale ferroviaire voient leur activité professionnelle évoluer autour d'injonctions relatives à la « qualité de service » rendu, à la « satisfaction client » et au respect d‟objectifs comptables. Des dimensions qui sous-tendent notamment le renouvellement constant d‟un ensemble de normes encadrant leur travail et leur comportement. Cette thèse vise ainsi à mettre en évidence le fait que, bien qu'étant « une réalité ancienne » [Finez, 2013], la régulation marchande qui s'opère à la SNCF est une réalité multiforme, avec pour corolaire des réformes managériales qui redessinent progressivement les contours de l'activité des agents en gare, exigeant d'eux un « travail commercial ». Ces évolutions conduisent à interroger parallèlement le regard qu'ils portent sur ce rôle « commercial » et, plus généralement, la manière dont ces agents perçoivent leur condition professionnelle dans une entreprise publique en mutation.Ce travail s‟inscrit dans le sillage d'un ensemble d'études menées au sein d'entreprises et administrations publiques qui ont mis en exergue les transformations intervenues suite à l'introduction et à la généralisation de dispositifs d'organisation et de gestion appliqués dans le secteur privé. L'objectif est ainsi d'analyser les recompositions professionnelles mais aussi sociales que les exigences commerciales et gestionnaires de la SNCF entraînent.

This thesis, based on an ethnographic survey, focus on SNCF employees working at therailway station, “in contact with customers”. Sales, reception and railways stopover agents,who are the familiar figures of the travelers, see their professional activity evolving accordingto injunctions towards the quality of service returned to the customers, customer satisfactionand respect of sales target. Consequently, the norms around their work tasks and behaviorsare constantly changing due to those types of injunctions. This thesis aims at highlightingthat, despite being “an ancient reality” [Finez, 2013], the trade policy of the state-ownedcompany SNCF is an ongoing reality. It leading to managerial reforms that reshape theactivity of those previously mentioned agents with an important “commercial” dimension. Asa consequence, it is also important to question agents about their option regarding their“commercial” role, and, more generally, about the way they perceive their professionalcondition in a public company undergoing changes. This work falls in with a group of studies conducted in state companies and administrations which underline the changes occurred after the insertion and spread of organizational and managerial measures applied in the private sector. The purpose of this work is therefore to study the professional and social reconfigurations caused by the SNCF commercial and managerial demands.

The aim behind this work was to investigate whether the Police Authority's reorganization in 2015 had any impact on local policing. In order to get an answer to this, 8 local police officers were interviewed in different regions around the country. Due to the current situation with Covid-19, and geographical distances, these semi- structured interviews were conducted over the phone. This was because the interview participants were not willing to meet and also on the recommendation not to travel around Sweden.The results of the interviews showed that the majority of participants were dissatisfied with the reorganization. The implementation of the reorganization led to disappointment and dismissal among police employees, partly due to dissatisfaction with changes that led to the disappearance of important skills. The positive thing, on the other hand, was that communication and flexibility among different police regions had improved.The participants in the interview were the common conclusion that the Police Authority should listen to those who work in the field in order to create as good a authority as possible.

Syftet bakom detta arbete var att undersöka om Polismyndighetens omorganisation år 2015 haft någon påverkan på det lokala polisarbetet. För att få svar på detta intervjuades 8 lokalpoliser i olika regioner runtom i landet. På grund av den rådande situationen med Covid-19, samt geografiska avstånd, genomfördes semistrukturerade intervjuer på telefon. Detta berodde på att intervjudeltagarna inte var villiga att träffas och även på rekommendationen att inte resa runt i Sverige.Resultatet av intervjuerna visade på att majoriteten av deltagarna var missnöjda med omorganisationen. Genomförandet av omorganisationen ledde till besvikelse och uppsägningar bland de polisanställda, bland annat på grund av missnöje kring förändringar som gjorde att viktig kompetens försvann. Det positiva, å andra sidan, var att kommunikationen och flexibiliteten bland olika polisregioner blivit bättre. Intervjudeltagarnas gemensamma slutsats var att Polismyndigheten bör lyssna på de som arbetar ute på fält för att kunna skapa en sån bra myndighet som möjligt.

La loi de 1905 intègre la notion de séparation stricte entre les cultes et l'État, mais aussi, permet l'émergence de la notion de neutralité religieuse de l'État, constituant une forme de privatisation de la religion désormais marginalisée. En un siècle, la situation a notablement changée puisqu'il a été envisagé de considérer l'aboutissement éventuel à un troisième seuil de la laïcité. Les religions sont nécessaires à la société civile, à son épanouissement et son équilibre, et en conséquence elles doivent pouvoir œuvrer librement avec l'appuie et la protection de l'État. Désormais, ni l'État ni les communes ne peuvent s'immiscer dans la religion sauf pour préserver l'ordre public, C'est pour cela que les ministres du cultes se sont vus revêtir de la mission d'organisation et de gestion des cultes. Cependant, certaines religions n'intègrent pas d'organisation hiérarchique, ce qui empêche la mise en place d'un ministre du culte (par exemple l'Islam). A l'époque contemporaine, plusieurs problèmes se posent car le paysage religieux a changé. Les questions de subventions des cultes, les inhumations, plus en profondeur la relation des communes avec les cultes présents sur leurs territoire et l'immixtion de l'État dans les affaires de locales, sont des questions récurrentes qui méritent réflexion.

The 1905 law incorporates the concept of strict separation between religions and the state, but also allows the emergence of the concept of religious neutrality of the state, constituting a form of privatization of religion now marginalized. Within a century, the situation has changed significantly since it was proposed to consider the possible outcome to a third threshold of secularism. Religions are necessary for civil society to flourish and balance, and consequently they must be able to work freely with the support and protection of the state. Now, neither the state nor local authorities can not interfere in religion except to preserve public order, This is why ministers cults are seen to take the organization and management tasks of Worship. However, some religions do not include hierarchical organization, which prevents the establishment of a minister of religion (eg Islam). In modern times, several problems arise because the religious landscape has changed. Issues grants of worship, burials, deeper relationship with the common religions present on their territory and the interference of the state in the affairs of local, are recurring issues that deserve consideration.

L'idée de la décentralisation administrative n'est pas nouvelle dans les Etats du Moyen Orient mais sa consécration, tout au long des années, est restée modeste.L'étude comparative de l'organisation administrative en Jordanie, au Liban et en Syrie se place à un double niveau, structurel (déconcentralisation et décentralisation) et fonctionnel. Elle se fondera donc sur un plan d'observations organisées à trois dimensions qui offre la possibilité d'une évaluation des trois expériences en recourant aux mêmes critères.Dans la structuration actuelle de l'organisation administrative territoriale, force a été de constater que le pouvoir exécutif occupe une place très prééminente dans le système politico-administratif. L'extension des circonscriptions administratives déconcentrées sur lesquelles le pouvoir central exerce le contrôle hiérarchique au détriment des collectivités locales est, à ce titre, significative. Les recherches menées sur l'organisation des structures administratives déconcentrées au Moyen Orient, ont confirmé que l'unité du modèle ottoman hérité de l'histoire a, pour l'essentiel, éclaté.S'agissant des échelons des unités décentralisées dans les trois Etats étudiés, la municipalité est le seul dénominateur commun entre les collectivités locales depuis l'époque ottomane. Mais, facteur de différenciation, elle est la seule strate décentralisée au Liban et en Jordanie. En Syrie, outre la municipalité, trois autres niveaux de collectivités locales décentralisées se superposent ou se juxtaposent : la Mohafaza à la fois une circonscription administrative de l'Etat et collectivité locale, la ville et la Balda. Pour autant, il n'est pas certain que le nombre d'échelons décentralisés (soit unité soit pluralité) soit facteur de réussite ou vecteur d'efficacité dans la réalisation attendue des missions dévolues.Le poids de l'autorité centrale dans la création et le fonctionnement des collectivités locales influe sur la relation entre la structure locale et ses habitants. Tout changement brusque des structures administratives locales, sans prendre en compte la volonté des citoyens locaux, aboutit à une rupture ou à un déséquilibre entre la structure locale établie et les besoins réels des habitants.L'analyse du degré d'efficacité dans le fonctionnement des collectivités locales révèle que la présence des éléments nécessaires à l'identification d'un régime décentralisateur est insuffisante. Ce régime dans les Etats du Moyen Orient peut donc être qualifié de « semi-décentralisation » ou d'une décentralisation inaboutie entre autonomie et contrôle.

Nos dias de hoje, com a crise económica à escala europeia, fala-se muito das empresas, que pertencem ao Sector Empresarial do Estado, devido aos prejuízos que têm apresentado. Por esta razão, é efectuado em primeiro lugar, na presente investigação uma avaliação do Sector Empresarial do Estado, centrado no sector dos transportes, pois são as empresas deste sector, as que mais encargos representam para o Estado Português. Numa segunda fase, é finalidade deste trabalho, efectuar uma comparação entre a CP-Comboios de Portugal, E.P.E (CP) e a Fertagus – Travessia do Tejo, Transportes, SA (Fertagus), analisando um conjunto de indicadores, de forma a confrontar os resultados de uma empresa pública com uma empresa privada, evidenciando as implicações das diferentes práticas de gestão. Essencialmente espera-se no final desta investigação poder responder à questão: Porquê que a CP apresenta consecutivos indicadores negativos e a sua congénere Fertagus tem apresentado indicadores positivos nos últimos anos de exploração? Chegando-se à conclusão que, a CP, apresenta uma situação de total falência técnica, devido ao défice operacional e aos elevados encargos financeiros. Já quanto à Fertagus tem mostrado nos últimos anos capacidade de gerar valor para os accionistas, coadjuvada pelo modelo de concessão acordado com o Estado. Embora seja uma empresa privada, a concessão permite-lhe obter benefícios, que num negócio normal não aconteceriam, viabilizando desta forma a empresa. Impõe-se por isso, a definição de um modelo viável para a CP, que permita à empresa sair da situação caótica em que se encontra.

Currently, in the context of the European economic crisis, one hears a lot about the companies that are part of the State-owned Company Sector, due to the losses they have been presenting. For this reason this work begins with an evaluation of the State-owned Company Sector, focused in the transport sector, because the companies of this sector are the ones that represent a larger burden for the Portuguese State. In a second stage, it is the goal of this work to carry out a comparison between the companies CP-Comboios de Portugal, E.P.E. (CP) and Fertagus – Travessia do Tejo, Transportes, SA (Fertagus), by analysing a series of indicators, so as to confront the results of a State-owned company with the results of a private company, showing the implications of the different management practices. Ultimately, after this research work, one expects to be able to answer the question: Why does CP present consecutive negative indicators and Fertagus, a similar company, has been presenting positive indicators in the last few years of exploration? One concludes that CP presents a situation of technical bankruptcy, due to the operating deficit and to the high financial burden. On the other hand, Fertagus in the last few years has shown the ability to generate value to its shareholders, assisted by the concession model settled with the State. Analisando as percepções sobre aspectos da cultura da organização, esta investigação académica propôs-se averiguar, numa amostra representativa do ramo hoteleiro, a presença de sintomas de Burnout e procurar evidências da sua relação significativa com a algumas variáveis sócio-demográficas, contratuais e com algumas percepções dos colaboradores sobre cultura organizacional. Este estudo foi desenvolvido em duas unidades hoteleiras de uma mesma organização, situadas nas proximidades de Viseu e Coimbra. A amostra é constituída por 45 participantes aos quais foram aplicados a adaptação à população portuguesa de dois questionários, o Maslach Burnout Inventory - General Survery e um questionário de aspectos de cultura organizacional de Sousa (2007), precedido por um breve questionário sócio-demográfico. Os principais resultados observados indicam que esta amostra não revela sintomas de Burnout, mas evidencia que os colaboradores que percepcionam a sua organização como coesa e se identificam com o seu papel estratégico tendem a não apresentar sintomas de exaustão emocional e física na resposta a agentes de stress. Também foi evidenciado que colaboradores que percepcionam a remuneração e benefícios sociais recebidos, com equidade e competitividade, tendem a não manifestar despersonalização na interacção com os clientes. Estas conclusões pretendem sustentar a importância da promoção de um clima social relativamente coeso e justo na minimização do impacto de sintomas de Burnout nos colaboradores e ainda considerar-se como futuras premissas que orientem a definição de estratégias de gestão de recursos humanos.

Analyzing the perceptions about aspects of organizational culture, particularly its role of power and legitimacy in promoting social interaction, growth and development, welfare of the individual and collective, that academic research proposed to examine a sample representative of the hotel industry, the presence of symptoms of Burnout and look for evidence of its significant relationship with some socio-demographic and some contractual employee perceptions about organizational culture. The empirical study was conducted in two hotels of the same organization, located near Viseu and Coimbra. The sample consists of 45 participants were applied in the adaptation to the Portuguese population of two questionnaires, the Maslach Burnout Inventory - General survey and a questionnaire on aspects of organizational culture de Sousa (2007), preceded by a brief socio-demographic questionnaire. The main results indicate that this sample shows no symptoms of Burnout, but shows that employees perceive their organization as a cohesive, with pride of ownership, information sharing and identify with its strategic role tend to not exhibit symptoms of emotional and physical exhaustion in response to stressors. ▼ After the Vietnam War, and particularly since 1986, Vietnam has been internationally recognised as one of the few communist countries to successfully implement a socially-oriented market economy. In the internet age, Vietnam has become one of the most active locations in Asia for the use of information technology. This progress, however, has not been enough to improve the international image of the country’s press, which remains stained by heavy censorship and the tight control of the Communist Party of Vietnam. This study investigates the impact of the internet on the Vietnamese news media and journalists, presenting evidence to show that the internet has brought more than economic benefits to Vietnam. Through the thematic analysis of rich natural data, semi-structured interviews and selected cases, the study shows that the virtual community made possible through the internet provides a mirror that reflects Vietnam’s social crises, gives voice to public feeling and tests the limits of the Communist Party of Vietnam’s leadership and authority. After discussing the failures of the economic reforms on mainstream media, the study highlights the internet’s role in transforming the state-owned press and the online social sphere. The study identifies electronic newspapers as the most progressive media sector and links their rise to the rapid growth of the Vietnamese audience, citizen journalists and the expansion of social networks. Drawing on recent case studies the thesis discusses the cracks that the internet has provoked in Vietnam’s propaganda system. This study offers a picture of the current situation of the Vietnamese news media as it struggles to survive, continually pushing unsuccessfully against the boundaries set by the authorities. The analysis also identifies broader social and political contradictions and divisions in Vietnamese society, illustrating the risks and opportunities facing Vietnam’s contemporary news media and propaganda journalists. This study’s findings provide a timely critique of the roles of the Vietnamese authorities and the news media at a time when the internet is on the way to becoming the ‘Fifth Estate’. The study suggests that both the state news media of Vietnam and the Communist Party of Vietnam’s authorities will need to respond to citizens’ demands for change or face the growing power of information networks. In addition, this thesis reminds readers of the vital role the internet can play in Vietnam because the technology provides the most direct way to give Vietnamese citizens the basic values of freedom and democracy despite the control of the authorities.

▼ This dissertation discusses fiscal decentralization and service delivery with particular attention to Lusaka City Council (LCC), one of the local authorities in Zambia. Zambia’s local government system encompasses an ideology of fiscal decentralization. In addition, the Local Government Act of 1991 provides for the funding of local councils by central government, and councils have been empowered by the law since 1980 (Local Administration Act) to engage in whatever business ventures, without restrictions from central authorities. Consequently, it is thought and expected that councils should have enough money to finance their projects and programs adequately. However, in spite of the existence of measures aimed at fostering decentralization in general and fiscal decentralization in particular, councils countrywide do not have sufficient financial resources to facilitate the effective performance of their functions, a situation which results into dismal service delivery and underdeveloped localities. This was the research problem. The general objective of the study was to assess the effectiveness of fiscal decentralization on service delivery by LCC. Specific objectives were: to determine the extent to which LCC collects revenue in relation to the services to be provided; to establish the extent to which LCC possesses autonomy over council expenditure; to examine the extent to which financial administration in LCC is transparent and accountable; to determine the adequacy of central government grants to LCC; to examine the usefulness of the legal and institutional frameworks regarding fiscal decentralization; and to find out the satisfaction levels of the local residents with regard to the services received from LCC. The study was both descriptive and explanatory in terms of its design. Both primary and secondary data were collected. Interviews, focus group discussions and questionnaires were used to collect both qualitative and quantitative data. Purposive sampling was used to select individuals who hold key positions regarding council operations, while simple random sampling was used to select local residents from all the seven constituencies in Lusaka City. Data were analyzed using both Excel (quantitative data) and the Manual or Narrative Method (qualitative data). The study found out that LCC collects less revenue than the cost of services to be provided; Central government transfers to LCC are inadequate; and the majority (86 percent) of the people of Lusaka City are either unsatisfied or very unsatisfied with the services received from the council. The researcher recommends that LCC should ensure that all the properties/buildings developed and developing within the city are captured on the council Valuation Roll by up-dating it regularly, and central government should permit local authorities to use Road Tax and VAT to broaden their revenue base.

▼ A preliminary survey of youth in Kenya indicated that harsh labour market had pushed youths into business and that business environment directly affected the growth of their enterprises causing stunted growth. The external conditions surrounding the youth were therefore critical in mobilizing entrepreneurial initiatives and converting them from vicarious entrepreneurs to actual business people. This model proposed the entrepreneurial environment as the independent variable whose various aspects such as management of youth enterprises, entrepreneurship education and training, accessibility to finance, as well as government and private sector policies, among others affected the dependent variable- growth of small scale enterprises, measured by annual turnover (profit level), capital investment (volume of assets), and the number of employees working for the business as well as formation of new enterprises. This study sought to investigate the factors that influenced the growth of small and medium scale enterprises, owned and managed by youth entrepreneurs in Kenya generally and in Rachuonyo South District in particular. The specific objectives were:- To establish the influence of management on growth of youth owned enterprises; to determine the role of education and training on growth of youth owned enterprises in Rachuonyo South District; to investigate the contribution of accessibility to finance on the growth of youth owned enterprises in Rachuonyo South District and to explore administrative strategies that would stimulate growth of youth owned enterprises in Kenya. The study would be useful to the youths in business, to the government and other Policy Institutions and for further research on Youth Entrepreneurship. A descriptive research design was used for the study where the target population was 540 youths, whose businesses were registered by department of social services as at January 2010. Stratified random sampling was used followed by simple random sampling of 30% on each stratum - commercial, manufacturing and service sectors — to get a sample size of 162 youth participants. The study used questionnaire as the data collection tool. A pilot study was conducted to pre - test the strengths and weaknesses of the questionnaire. Data was analyzed using measurers of central tendencies and of dispersions using statistical package for social scientists (SPSS).Frequency tables and percentages were used to present data. The study revealed that the youth engaged in entrepreneurship because they wanted to secure employment. A large proportion was engaged in the service sector 46.9%. Others (11.1%) engaged in business for continuation of family interests. The study also showed that most youth entrepreneurs (32.2%) with SME’s were KCSE drop outs and that a low proportion of youth with SMEs (5.5%) were university graduates. The study further showed that management, education and training, accessibility to finance and entrepreneurial policies had influence on growth of youth SMEs. ▼ The aim of this study was to establish factors influencing business performance of female owned enterprises in Kenya. Women being the backbone of economies in developing countries and specifically in Kenya, play a significant role to ensure their families‟ wellbeing. The study sought to determine how social networks, entrepreneurial orientation, training and development and financial resources influence the performance of women owned enterprises in Kenya. The design of this research was a descriptive survey research. The population of interest was 523 registered female entrepreneurs in Central Business District (CBD). Stratified random sampling technique was used to select 221 respondents. Primary data was obtained using self-administered questionnaires that will be administered using a drop and pick later method. The quantitative data in this research was analyzed by descriptive statistics such as frequencies, percentages, mean scores and standard deviations using statistical package for social sciences SPSS (V. 22.0). The qualitative data took an conceptual content analysis process. Pearson correlation analysis was used to establish the relationship between the identified independent and dependent variables. The data was then be presented using frequency tables. The study established that membership in women groups is very important for success of female owned enterprises since it helps women to access market information, capital for their business, market through the group‟s membership. The study also deduced that innovation in the businesses is key for the better performance of the enterprise. Majority of the businesses competes to be first in introducing new products and services and processes. It was found that female entrepreneurs in Nairobi Central Business District (CBD) often encourage incremental improvements in products and services. The study established that female entrepreneurs in Nairobi Central Business District (CBD) lead in associating with aggressive posturing relative to the competitors, strives to be a first mover to capture the benefits of pioneering, continually scans the market to predict future trends, generates first-mover advantages and that shape market direction through anticipating change. However, female entrepreneurs have not been trained in human resource management, planning, record management and marketing. The study concludes that entrepreneurial orientation had the greatest effect on performance of female owned enterprises in Kenya followed by social network, then access to financial resources while training and development had the least effect on the performance of female owned enterprises in Kenya. ▼ Urban land readjustment implementation by the private sector is a kind of land-developing method in order to execute the land policies and to implement the urban planning. After the Government established this system in 1979, landowners may apply for permits to the Government as per the regulations. However, it has incurred many problems for the past years after the implementation. It has resulted in differences between laws and practices. Besides, disputes among landowners were aroused endlessly. The uncertainty for the Government to acquire land for public facility use makes the function of urban land readjustment implementation by the private sector unable to be developed effectively. The purpose of this research is to help the Government timely reviews the defects of this system in order to ensure the landownersâ legal rights of acquisition of properties by impartial, reasonable and legal ways to solve the disputes resulting from the transaction of urban land readjustment implementation by the private sector on the basis of equal rights. This dissertation mainly applies the review of literature and refers to the related literature analyses. Firstly, it is to clarify the fundamental legal principles of the execution processes of urban land readjustment implementation by the public authority and by the private sector. It is also to clarify the sources of law for the urban land readjustment implementation by the private sector in Taiwan. In addition, the differences between the execution results of urban land readjustment implementation by the public authority and by the private sector during the same period shall be compared and verified by cases. Furthermore, the related legal problems are clarified by evaluating the execution processes of urban land readjustment implementation by the private sector. The practical examples of juridical judgments are also taken to verify the disputed legal claims, which were often found in the practical cases when executing the urban land readjustment implementation by the private sector. By the application of legal methods, it is anticipated to make up the ways of claims in order to fairly protect the landownersâ rights when executing the urban land readjustment implementation by the private sector. This research finds out problems and provides several suggestions to the policy-making authorities for reference: In the aspect of legislation: 1. The âRegulations for Encouraging Land Owners to Implement Urban Land Readjustmentâ shall be upgraded to the legislative level. Alternatively, it may combine with the âRegulations for the Urban Land Readjustmentâ into the complete âLaws of Urban Land Readjustmentâ. 2. O Imposto Sobre o Valor Acrescentado (IVA) é caracterizado por ser um imposto sobre o consumo, de matriz comunitária. A sua importância no contexto do sistema fiscal vigente é cada vez maior, na medida em que é um imposto transversal a todos os contribuintes, estando presente na sua vida ao longo do dia (água, luz, gás, telefone, café, pão, etc.). No entanto, a sua aplicação tem vindo ao longo dos anos a suscitar algumas dúvidas, com especial incidência nas entidades públicas, pela especificidade das atividades desenvolvidas, na medida em que as mesmas podem configurar operações: sujeitas, isentas, sujeitas mas beneficiando de delimitação negativa de incidência ou não sujeitas. De entre as entidades públicas optou-se por enfocar este trabalho nas autarquias locais por motivos profissionais, na tentativa de obtenção de respostas, que possam suportar as dúvidas que têm surgido em vários Municípios relativamente à correta aplicação do imposto. Essa correta aplicação do imposto é igualmente pertinente relativamente às diversas Empresas Municipais, em especial nas situações em que desenvolvem atividades delegadas pelas autarquias, existindo por isso algumas questões de enquadramento que não se encontram devidamente clarificadas e que tentaremos de alguma forma esclarecer. Esta abordagem terá especial incidência na problemática do enquadramento da gestão dos Parques de Estacionamento Municipais. O presente trabalho fará igualmente uma referência à reforma do IVA que se encontra a decorrer na União Europeia (UE), tentando perceber-se quais as implicações que daí poderão advir para as entidades públicas.

The value added tax (VAT) is characterized for being a tax on the consumption of community matrix. Its importance in the context of the current tax system, increasing to the extent that a tax across all contributors, being present in your life throughout the day (water, electricity, gas, telephone, coffee, bread, etc.). However, its application has been over the years to raise some doubts, with a special focus on public entities, the specificity of the activities developed, to the extent that these may set up operations: subject, subject but benefiting from exemption or not subject. Among public authorities chose to focus on this work more specifically on local authorities for professional reasons in an attempt to obtain answers that can withstand the doubts that have arisen in several municipalities regarding the correct application of the tax. Also in relation to various municipal companies framing issues exist that are not properly clarified and that we will try to somehow clarify. This approach will have a special focus on problems of the framework of management of the Municipal car parks. This work will also a reference to the VAT reform which is taking place in the European Union (EU), trying to understand what the implications which may arise for public authorities.

This work has as its primary aim to verify the possibility of studying the family owned company concept from the logic of the gift. To this effect, this work is based on two central ideas. The first one is the verification of the effective circulation of the gift among the entrepreneurial familys members, taking as a premise the fact that the family is considered the original source of the gift. It also aims to ascertain whether this circulation reaches other organizational relationships inside and outside the business entity. The second idea is the possible existence of a co-relation between the gift and the process of profissionalization of the family business entity. This study considered one single case as a methodological strategy to approach the subject. In view of that the present work contains the analysis of a family business entity from Salvador operating in the citys public transport system, and undergoing the transition from first to second generation. In order to reach a closer view of the object to be examined, the research focused on Salvadors public transport system taking into account its historical and social context. This process encompassed the analysis of the evolution of the sectors competition dynamics originated from family business entities, including the verification of some patterns typical of family business entities from the State of Bahia.

O presente trabalho teve como proposição primária, a verificação da aderência de um estudo da empresa familiar a partir da lógica da dádiva. Para tanto, este se pautou em dois eixos centrais. O primeiro, na verificação da existência de circulação da dádiva entre os integrantes da família empresária, tomando-se como pressuposto o fato da família ser considerada como o locus original da dádiva, e se esta circulação alcançava outras relações organizacionais nos ambientes interno e externo da empresa. O segundo, na possível existência de uma relação entre dádiva e o processo de profissionalização da empresa familiar. O estudo de caso único foi adotado como a estratégia metodológica para abordagem do tema, definindo como objeto de estudo uma empresa familiar do setor de transporte coletivo do município de Salvador, que se encontrava na fase de transição da primeira para a segunda geração. A fim de estabelecer uma maior aproximação do objeto, fez-se necessária uma contextualização sócio-histórica do transporte urbano no município. Neste processo examinou-se a evolução da dinâmica competitiva no setor, nascido a partir de empresas familiares, ao passo que se verificaram alguns padrões típicos de empresas familiares situadas na Bahia.
