Using socioeconomic and fiscal data during the period 1975-2002; this dissertation examines the adoption and budgetary effects of the LOST in Georgia counties. The adoption of the LOST is studies with a discrete-time event history analysis. The results suggest that the probability that an eligible county will adopt the LOST is determined by a set of motivations; obstacles; and resources. The motivations are related to the perceived property tax level; the existence of fiscal pressure; and the potential of sales tax exportation. The obstacles are related to existing sales tax rates and the level of tax competition. The resources for overcoming these obstacles are related to the tax mimicking behavior in the process of policy diffusion. Budgetary effects of the LOST are examined with pooled time-series regressions. The results suggest that (1) the rollback of property tax millage rates by the LOST is gradually offset by a faster growth of the rates in the post-LOST period; (2) the LOST proceeds are fungible; as they lead to higher levels of revenue and expenditure in the counties; and (3) the levels of fungibility vary across counties in accordance with their fiscal and socioeconomic conditions. Life history characteristics, diet, nursery habitat use and metabolic rates of brown stingrays, Dasyatis lata, were evaluated to determine their ecological impacts in Kāne'ohe Bay, Oahu, through a bioenergetics model. The maximum age based on analysis of vertebral samples (28 years) was among the oldest for any dasyatid aged to date. Edge and marginal increment analyses, as well as recapture of two stingrays previously marked with oxytetracycline, verified deposition of a single growth band per year. Growth characteristics varied between sexes, with females attaining larger sizes and exhibiting lower growth coefficients. Brown stingray life history characteristics are similar to other elasmobranchs in that they are long lived, grow slowly and mature at a late age. Stomach content, bulk and amino acid stable isotope analyses were used to assess the diet and habitat use of juvenile brown stingrays in Kāne'ohe Bay. A shift in stingray diet and an increase in relative trophic position were apparent with increasing size. Results indicate stingrays foraged within their Kāne'ohe Bay nursery for the majority of their juvenile lives before shifting to offshore habitats with the onset of sexual maturity. Underestimates of trophic position from amino acid analyses suggest that urea retention in elasmobranchs may have important implications for estimates of absolute trophic position determined using this method. Potential prey resources were portioned between stingrays and sympatric juvenile scalloped hammerhead sharks, Sphyrna lewini. Standard metabolic rates were estimated for juvenile brown stingrays through respirometry. Temperature and mass had significant effects on metabolic rates. The energy budget of juvenile stingrays was heavily weighted towards metabolism, which accounted for 68% of total consumed energy. A large metabolic demand coupled with very slow growth indicated potential limitation of food resources. Daily rations estimated from the bioenergetics model declined from a high of 2.72 %BW/d to 1.23 %BW/d with age. Results suggest the potential for strong top-down effects on prey populations due to stingray predation. Use of Kāne'ohe Bay as a nursery habitat for brown stingrays appears to be a trade-off between increased juvenile survival and a late age at first maturity due to slow growth rates.

▼ A transferência de rendimentos é um instrumento de planeamento fiscal, utilizado pelas entidades multinacionais, com o principal objetivo de se obter poupança fiscal. A sua ocorrência pode acontecer devido a diferentes incentivos e podem ser utilizados vários métodos. A presente dissertação analisa se o diferencial entre as taxas de imposto a que a filial e a empresa-mãe estão sujeitas constitui um incentivo à ocorrência de transferência de rendimentos e também averigua se esse diferencial influencia para onde os rendimentos são transferidos. Por último, estuda se a existência de prejuízos fiscais reportados no ano anterior por uma determinada filial diminui a influência que a diferença entre as taxas de imposto exerce sobre a ocorrência de transferência de rendimentos. De modo a estudar o que foi proposto, adotou-se uma metodologia de investigação quantitativa na qual se utilizam dados históricos no período temporal de 2012 a 2016. O modelo econométrico utilizado considera as empresas filiais como unidades de observação e é semelhante aos modelos já desenvolvidos por outros autores (e.g. Huizinga e Laeven, 2008; Simone et al., 2017). O modelo considera apenas multinacionais cuja empresa-mãe está sediada em Portugal e com pelo menos uma filial localizada noutro país da União Europeia. A evidência obtida sugere que o diferencial entre as taxas de imposto a que a filial e a empresa-mãe estão sujeitas constitui, efetivamente, um incentivo à ocorrência de transferência de rendimentos. Comprovou-se que, quando as filiais estão sujeitas a uma taxa de imposto maior relativamente à taxa portuguesa, estas reportam resultados menores, o que sugere a existência de transferência de rendimentos para a empresa-mãe. Na última parte do estudo empírico, obtiveram-se resultados que permitem confirmar a expectativa de que a existência de prejuízos fiscais tem um efeito atenuador sobre o impacto que a diferença entre as taxas de imposto exerce sobre a transferência de rendimentos. Os principais contributos da presente investigação são estender o estudo sobre a transferência de rendimentos para a realidade empresarial portuguesa. Tendo em conta o estudo de Huizinga e Laeven (2008), também, pretendeu-se aclarar em que medida Portugal continua a sair prejudicado no que diz respeito à arrecadação de receitas, devido à transferência internacional de rendimentos. The present dissertation turns on punitive damages, the nature that they assume in the Brazilian legal system and the problematic around the quantum that must be awarded to the victim. This work intends to demonstrate the importance assumed by the study of the punitive damages in the national and world-wide scene, once the practice of this illegal conduct confronts the constitutional principle that guarantees the respect of the dignity of the human being, by violating the rights of the personality. Still, it tries to detach the difficulties to find an ideal way to award the victim the fairest relief, which is generally pecuniary, without compromising the legal relationship balance. In order to make some considerations about the subject proposed, it was necessary to make a previous study about the civil liability, by dealing with its evolution and principles and focusing on the different aspects around the punitive damages, such as the concept, indemnity, doctrines, trajectory of the former court decisions and the recognition of the man as the centre of the legal system, relegating the patrimony to a second plan. The compilation method was used during the development of this study, also the research of jurisprudence and comparative legislation. Laws and projects of law which are in transaction process had been mentioned as well. From this study, we can infer that instead of applying tax rates, the legal arbitration continues to be the best way to award the damage, since the magistrates observe the real necessity of basing their decisions and discriminating, in a individualized way, each of the judgments already consecrated by the doctrine and the jurisprudence, and mainly, the reasons that took them into that conclusion

A presente dissertação de mestrado versa sobre o dano moral, voltada à natureza que assume no sistema jurídico brasileiro e à problemática em torno dos critérios utilizados para a fixação do quantum indenizatório. Objetiva demonstrar a sua importância no cenário nacional e mundial, por se caracterizar prática que afronta o princípio constitucional do respeito à dignidade da pessoa humana, além de violar os direitos da personalidade. Analizuojama kaip ir kodėl kito Telšių (1999- 2007 metais) ir Mažeikių (2003 - 2006 metais) rajonų vandentvarkos įmonių finansiniai rodikliai, aptariami juos lemiantys veiksniai. Pirmoje darbo dalyje remiantis moksline literatūra, LR įstatymais bei kita spauda, nagrinėjami vandentvarkos įmonių pelną ir veiklos rezultatus iliustruojantys rodikliai ir metodai bei juos lemiantys veiksniai. Antroje dalyje pateikta iliustruota Telšių ir Mažeikių rajonų vandentvarkos įmonių veiklos ir finansinių rodiklių analizė, leidžianti įvertinti šių įmonių veiklos rezultatus nagrinėjamu laikotarpiu. Trečioje dalyje remiantis išnagrinėta medžiaga pateikiama įmonių veiklos rodiklių prognozė 2008-2010 metams. Pateikiama autorės siūloma vandentvarkos įmonių pelną (nuostolį) lemiančių veiksnių vertinimo schema.

In this masters research work is being analysed the factors that impact the profit (loss) of Lithuanian water-supply companies and their influence to the prospects of the companies activity. It is being examined how and why the financial rates of Telšiai (1999-2007) and Mažeikiai (2003-2006) regions water-supply companies have changed and also the determinants are being discussed. In the first part of the research the methods and indicators that illustrate the activitys results and profit of the water-supply companies are researched on the basis of scientific sources, laws of LR and other media. The determinants of the methods and indicators are considered as well. In the second part there is presented an illustrated analysis of the activity and financial rates of Teliai and Maeikiai regions water-supply companies that lets us evaluate the results of the companies activity during the period of the research. In the third part the activity rates prognosis of the companies are introduced for the period from 2008 to 2010 on the basis of the analyzed material. There is also presented a scheme of evaluation factors that determine the profit (loss) of the water-supply companies which is proposed by the author. At the end of the research work on the basis of theory and practice the conclusions considering the profitability rates of Telšiai and Mažeikiai region water-supply companies are drawn. The current quantitative and qualitative study investigates the role of schools’ exogenous and endogenous characteristics on the manifestation of bullying and victimization phenomena between students. The exogenous school characteristics investigated are the following: (i) school size, (ii) socioeconomic level of the community, and (iii) crime rates of the community where the school is located. The endogenous school characteristics investigated are the following: (i) the quality of the school climate, and (ii) the students and teachers responses to bullying.In the quantitative study, 667 eighth grade students (322 boys and 345 girls) participated, drawn from sixteen Greek public middle schools located in four municipalities of the prefecture of Attica with important differences regarding the socioeconomic level and the crime rates. In the qualitative study, 25 students participated, drawn from the sample above, all involved systematically in bullying incidents as bullies, victims or bully-victims. A self-report questionnaire was used for the quantitative study, while the qualitative study was carried out through a semi-structured interview.According to the results of the statistical analysis, none of the investigated exogenous school characteristics is associated with bullying or victimization. On the contrary, all the investigated endogenous school characteristics are significantly associated with bullying and/or victimization. Furthermore, the frequency of bullying is predicted by the following endogenous school characteristics: students’ involvement in school activities, discipline, students’ feeling of insecurity, students’ intervention and adults’ awareness of bullying incidents. The frequency of students’ exposure to victimization is predicted by the following endogenous school characteristics: students’ feeling of insecurity, students’ social integration, teachers’ democratic/supportive practices, students’ involvement in school activities and students’ intervention. These findings, as well as the significant differences between schools regarding the levels of students’ victimization, show that the school’s operating methods and the quality of the interpersonal relations among students and between students and teachers are likely to contribute to the exacerbation or the reduction of the phenomenon of school bullying. The findings of our quantitative study are interpreted in combination with the testimony of students engaged in bullying incidents and on the basis of prior research. Finally, guidelines for teachers and principals are proposed in order to prevent bullying problems among students.

▼ Only recently, the well-documented shortage of secondary mathematics teachers is being attributed to retention. Wenger’s Communities of Practice (CoPs) and the provision of same subject mentors have been shown to provide teachers with support, opportunities to collaborate, and a reduction in their feelings of isolation – all factors known to impact retention positively. The rapid advancement and prevalence of online social media provide easily accessible, cost effective means to connect teachers with each other and with same subject mentors. This study investigated the primary question: What, if any, is the relationship between the retention of first-year secondary school mathematics teachers and their participation in an Online Support Group (OSG) that employs strategies for successful CoPs proposed by Wenger and includes a mentor who is trained in secondary mathematics education? To answer this question the following sub-questions were studied: How do members of a CoP negotiate and finalize the selection of a social media platform to serve as the means of providing online support and communication? What are the characteristics of this OSG of induction-year secondary mathematics teachers and an online same subject mentor? To what degree, if any, does the OSG function as a CoP with the structural characteristics defined by Wenger? To what degree, if any, does participation in the OSG CoP mitigate factors found in the literature known to impact teacher retention negatively? To what degree, if any, does an off-site, online mentor who is trained in mathematics education impact retention? This study documents how a same subject mentor and a cohort of teachers negotiated the selection of an online-communications platform and formed an OSG in an effort to impact teacher retention positively. This OSG consisted of ten induction-year secondary mathematics teachers – who were part of the Robert Noyce Teacher Scholarship Program and recently graduated from a large southeastern university – and one same subject mentor – an adjunct faculty member (the researcher) – at the same university – using the educational social media platform, Edmodo. Using a qualitative, netnographic approach, data sources included four months of participant observation, transcripts and fieldnotes from the Edmodo private group, individual and focus group interviews with community members, and surveys of community members. Findings suggest that the Edmodo OSG was able to function as a CoP, with the structural characteristics defined by Wenger, to provide support and opportunities for collaboration as well reduce participants’ feelings of isolation – all factors associated with increased teacher retention. The key impact of the same subject mentor was her creation and implementation of a pay-for-participation plan which served as a catalyst for meaningful, frequent, and sustained participation of community members. Detta är en undersökning som är gjord för att jämföra prissättningen av fastigheter som är till salu i Sverige och Spanien. För att avgränsa oss har vi valt att jämföra Stockholms innerstads prissättning med prissättningen i Palma på Mallorca i Spanien. Lockpris fenomenet har fått hård kritik under den senaste tiden i media. På grund av denna kritik så har många mäklare, speciellt i Stockholms innerstad, gått ihop och arbetar mot att undvika lockpriser och har infört begreppet accepterat pris. Dock kan accepterat pris uppfattas som ett nytt ersättningsnamn på lockpriser. Trots att Mäklarsamfundet tar bestämt avstånd från användning av lockpriser så har vi genom intervjuer med mäklare i Stockholms innerstad fått fram att detta används fortfarande vid prissättning av bostäder. Vi har genom våra intervjuer med fastighetsägare i Stockholm och Palma, mött flera fastighetsägare som har känt sig lurade då de har köpt en fastighet till ett avsevärt mycket högre slutpris än utgångspris. Samtidigt har vi mött flera fastighetsägare som är nöjda med Sveriges budgivningssystem. De flesta föredrar dock att köpa eller sälja en fastighet till verkligt accepterat pris. Det spanska budgivningssystemet där budgivningen går nedåt har, trots att de flesta fastighetsköpare som vi intervjuat lyckats förhandla ned slutpriset, mötts med en del kritik. Största delen av kritiken bygger på att priset inte sätts relaterat till marknadspriset, vilket det trots lockpriser, görs i Sverige.

This is a survey where we compare the pricing of properties that are for sale in Sweden and Spain. To make delimitation, we have chosen to compare the pricing in the inner city of Stockholm of Sweden with the pricing in Palma in Mallorca, Spain. The cap rates phenomenon has been very criticized in the Swedish media in the latest couple of years. Because of this criticism, many real estate agents in the inner city of Stockholm are working to avoid cap rates and introduced the concept of using acceptable prices. However, acceptable price rates are perceived as a replacement name for the cap prices. Although the Mäklarsamfundet, of Sweden, disagrees with the use of cap rates, we have trough our interviews with real estate agents in the inner city of Stockholm received that this concept is still used in the pricing of properties. We have, through our interviews with property owners in Stockholm and Palma, met several property owners who have felt cheated when they bought a property at a significantly higher final price than the asking price. We have as well met several property owners who are satisfied with the Swedish pricing. But most people prefer to buy or sell a property at fair agreed price, using acceptable pricing. Many of the Spanish property buyers who we have interviewed are critical to the Spanish pricing, where the bidding goes down. This despite that most of them, managed to negotiate down the final price. Most of the criticism is based on that the prices are not related to market price, which, despite the cap rates, is in Sweden.

En medlemsstat inom Europeiska Unionen (EU) ska anpassa de nationella bestämmelserna för att möta de EU-rättsliga bestämmelserna. Ett exempel på en sådan reglering är mervärdesskatten. Syftet med regleringen av mervärdesskatten har varit att skapa och stimulera en inre marknad inom EU, utan skillnader mellan medlemsländerna. Mervärdesskatten har harmoniserats genom mervärdesskattedirektivet som medlemsstaternas är förpliktigade att implementera. Implementering av ett direktiv ger medlemsstaterna möjligheten att själva tolka och avgöra tillvägagångssättet, så länge direktivets syfte uppnås. Dock har flertalet talan om fördragsbrott uppkommit i Europeiska Unionens domstol, grundat på kommissionens åsikt om att medlemsstater har underlåtit att uppfylla sina skyldigheter enligt mervärdesskattedirektivet. Därav uppkommer frågan hur den konstitutionella grunden för EU ger medlemsstaterna eget handlingsutrymme att tolka och implementera bestämmelserna i mervärdesskattedirektivet utifrån EU:s fördrag, rättspraxis och principerna om neutralitet, legalitet, likabehandling och lojalitet. Rättspraxis behandlar områdena för mervärdesskattegrupper och reducerade skattesatser. Det kan konstateras att medlemsstaterna har ett begränsat handlingsutrymme för implementering av mervärdesskattedirektivets bestämmelser. EU:s fördrag, principer och praxis ger inte medlemsstaterna något större utrymme att själva tolka och implementera bestämmelserna. Vidare framgår att det finns en osäkerhet kring tillämpningsområdet och vidden av neutralitetsprincipen, vilket gör att medlemsstaterna inte kan försäkra sig ett större skydd mot fördragsbrott i frågan om implementering av mervärdesskattedirektivet. Därmed finns en rättsosäkerhet i frågan om medlemsstaternas handlingsutrymme gällande implementeringen av mervärdesskattedirektivet bestämmelser vilket även påverkar varje enskild medborgare inom EU.

As a member of the European Union (EU), nations commit to accommodate its national legislation to EU law. An example of this is the regulation of value added tax (VAT). The purpose with the regulation of VAT is to create and stimulate the internal market within EU, without differences between the member states. The VAT is harmonized through the VAT Directive, which every member state is obligated to comply with. The implementation of a directive imposes an opportunity for the member states to make their own interpretations and determine how the implementation shall be handled, as long as the result of the directive is fulfilled. However, several claims have been raised in the Court of Justice of the European Union, claiming failure to fulfil an obligation under the Directive on the common system of VAT. This is based on the Commission’s view that member states do not comply with its obligations within the VAT Directive. Thereby arises the question of; how the constitutional rights of EU actually gives the member states an opportunity to interpret the implementation of the VAT Directive into national legislation. ▼ Education is an important life process that plays a vital role in forming the foundation for a student's future better being, as it equips the learner with basic knowledge, skills and altitudes that will enable her/him to cope well in life. In Igembe North most students who attend secondary schools do not complete secondary level of education. Despite Kenya Government's commitment to subsidize students‟ education, their completion rate at secondary school level is not a hundred percent. The purpose of this study was to investigate the factors influencing high dropout rates in Kenyan secondary schools: a case study of secondary schools in Igembe North; Meru County. The specific objectives were to determine how school based factors influence the school dropout rate in secondary schools in Igembe North; Meru County, to examine the extent to which economic factors influence the school dropout rate in secondary schools in Igembe North; Meru County, to establish how family based factors influence the school dropout rate in secondary schools in Igembe North; Meru County. A descriptive survey research design was used for this study because it was useful in describing the characteristics even when analyzing multiple variables. The target population consisted of 8 Secondary Schools in Igembe north. The study population was therefore 8 principals, 64 teachers, 480 form four students. Simple random sampling was used to identify the students to participate in the study. The researcher used 30% of the teachers. The sample size for the teachers was therefore 19 teachers. Data was collected using questionnaires and interview schedules. Questionnaires were preferred because of their ability to ensure confidentiality of responses from respondents. Data was analyzed by use of statistical package for social sciences (SPSS) programmes. The raw data from the field was summarized, coded, edited and computerized through synthesizing information from the questionnaires by SPSS. majority of the respondents (students 83.3% and class teacher 86.7%) indicated that the Teachers Attitude influences whether students drop out of school or not. The study also established that households with little income are not able to retain their children in school and they prefer their children involvement in income generating activities. The study further established that Most of the teachers and the students indicated that more educated parents are more concerned of their children education and their children have high chance of being retained in school unlike less educated parents. The study concluded that Income does influence dropout among students in secondary schools. The attachment to low income is compounded by involvement in income generating activities, inability to afford basic needs, looking after young siblings and inability to pay fees. The study recommended that Poverty alleviation measures should be strengthened in the society to enable all families get higher income so as to maintain their children in school till completion.

Esta dissertação tem como objetivo apresentar um caso específico de Interpolação da Estrutura a Termo da Taxa de Juros (ETTJ) com base no processo estocástico que de- termina a taxa de juros, o qual é aqui denominado por interpolação estrutural. Este método estrutural permite a calibração das curvas de desconto e de rendimento, por meio do ajuste dos parâmetros do modelo generalizado Black-Karasinski sob a hipótese de não arbitragem. São apresentados três métodos distintos de calibragem. O primeiro deles é constituído pela solução numérica do sistema de equações que satisfaz a hipótese de não arbitragem. O segundo método remete-se a inversão dos parâmetros do modelo de forma exata, a partir da definição da curva de rendimento. O terceiro e último método apresenta uma solução aproximada a partir de um problema reduzido. Mostramos que os métodos são equivalentes quando se utiliza a mesma definição para a curva de rendimentos. A importância deste resultado reside no desenvolvimento de algoritmos de fácil implemen- tação computacional e na possibilidade de usar esse método de interpolação com base em um modelo de determinação da taxa de juros em trabalhos empíricos de previsão e determinação da estrutura a termo da taxa de juros.

This paper aims to present a special case of interpolation of the Term Structure of In- terest Rates based on the stochastic process that determines the interest rate, which is here called by structural interpolation. This structural method allows the calibration discounts and yields curves adjusted through the parameters of the generalized Black-Karasinski model under the assumption of no arbitrage. Three distinct methods of calibration are presented. The first consists of the numerical solution of the system of equations that satisfes the hypothesis of no arbitrage. The second method refers to the inversion of the parameters model, from the definition of the yield curve. The third and last method presents an approximate solution from a smaller problem. We show that the three meth- ods are equivalent when using the same definition for the yield curve. The importance of this result lies in the development of algorithms for easy computational implementation and the possibility of using this interpolation method based on a model for determining the rate of interest for empirical prediction and determination of the term structure of interest rates.

▼ Background: Neonatal morbidity and mortality continues to significantly contribute towards under-5 morbidity and mortality despite significant improvement seen worldwide within this population. Studies at Kenyatta National Hospital have revealed that well-appearing neonates are potentially being discharged with their mothers only to be readmitted with significant illness. This study aimed to define the re-hospitalization rates of neonates delivered at KNH after postnatal discharge, while comparing the effect of two different modes of management. Objectives: To determine the effect of structured newborn clinical evaluation by paediatric registrars at Kenyatta National Hospital on re-hospitalization rates within the first month of life. Methods: Randomized Controlled Study. 600 neonates were recruited from the Kenyatta National Hospital‟s maternity unit. Following consideration of the inclusion and exclusion criteria, an informed consent was obtained followed by simple randomization of neonates. A questionnaire was then administered to the study participants and neonates in the intervention group underwent structured clinical evaluation. The control group on the other hand was managed and discharged as per the current standard modes employed within the maternity unit. Upon discharge, the two groups were followed up via mobile phone, at 7, 14 and 30 days. 246 and 273 neonates completed follow-up in the control and intervention groups respectively. Re-hospitalization, age at re-hospitalization and outcome of re-hospitalization were recorded during follow-up. Univariate analysis was used for categorical variables and descriptive statistics used for continuous variables. Bivariate analysis was used to investigate associations between the two modes of management and the outcomes in terms of re-hospitalization and vital status. Results: Of the neonates who completed the 30-day follow-up period, 19.5% of the control group and 11% of the intervention group were re-hospitalized within the first month of life following birth hospitalization. The calculated Odd‟s Ratio was 0.5093 (p=0.0073, 95% Confidence Interval 0.3110-0.8340) indicating a risk reduction for re-hospitalization of up to 50% within the intervention group. Conclusion: Structured evaluation of neonates following delivery resulted in a reduction of re-hospitalization of these neonates.

▼ The United States, Department of Justice (DOJ) has provided over 1.3 billion dollars of grant funding to law enforcement agencies nationally through the Office of Community Oriented Policing Services (COPS), Making Officer Redeployment Effective (MORE) program since 1995. In 2002, select agencies received grant awards funding up to 75% of equipment and technology for law enforcement agencies' projects. Automated records management systems (RMS), was one of the primary technologies funded by the DOJ. An overarching objective of the program was to increase the efficiency and effectiveness of law enforcement agencies. Automated RMS was expected to increase criminal case clearance rates. The current research evaluated the relationship between grant-funded technology and criminal case clearance rates as measured by the Uniform Crime Reporting data system maintained by the Federal Bureau of Investigation (FBI). Uniform Crime Reporting (UCR) data was analyzed for 4 years before and after the grant period using statistical methods including: 1) Unconditional means models; and, 2) Fixed and random effects models. The results indicate that there was no significant association between agencies who received DOJ funding and change in crime case clearance rates. Simply put, these law enforcement agencies did not solve more crimes after the implementation of grant-funded RMS. This was the case for each of the seven, Part 1 UCR categories analyzed including: 1) Homicide; 2) Robbery; 3) Rape; 4) Aggravated Assault; 5) Burglary; 6) Motor Vehicle Theft; and 7) Larceny. The American public is demanding accountability from government. Given the significant amount of grant money the DOJ has provided law enforcement agencies, efforts should be made to ensure that this funding helps such law enforcement agencies solve crimes. The DOJ should require that future RMS grant recipients implement criminal case clearance performance measurement, reporting, and improvement processes. Policymakers should support additional research to determine if and how RMS technology could be used to increase criminal case clearance rates with the ultimate goals of reducing crime and increasing community safety. Research to determine how technology can effectively be coupled with policy, training, and usage should be planned, managed, and evaluated to support essential law enforcement technology projects. Seeking to keep at the competitive contention and increasing profitability rates, leaders of the company should perfectly understand the structure of actions which determine profitability and influence because these evaluated factors help to find appropriate reasons determining the alternation of profitability. The influence analysis of factors has been done by the chain change method with reference to the method of Lithuania and foreign countries authors in this paper and seeking to determine factors of the primal level which determined rates changes of the property profitability in the primal its stages, the analysis of property profitability has been done. This analysis has been done with reference to models of Du Ponto, L. Bernstein, R. Schattke and H. Jensen and the capital profitability with reference to Du Ponto and L. Bernstein. No primeiro capítulo deste trabalho nós estendemos os resultados obtidos por Maldonado e Svaiter (2007) para o caso de funções agregadoras. Sob as hipóteses de concavidade forte da função agregadora e de concavidade do operador estocástico, que definem a função objetivo do Problema Estocástico de Programação Dinâmica, nós provamos que a aproximação da função política do problema é Hölder- contínua em relação à aproximação da função valor. Desta forma, é possível calcular uma forma explícita para controle de erros nessa classe de problemas. Uma aplicação numérica é feita para uma classe de funções agregadoras para ilustrar como o erro de aproximação da função política pode ser controlado. No segundo capítulo deste trabalho testamos a capacidade da inclinação a curva de rendimentos spread de juros para prever recessões. A metodologia segue o proposto por Estrella e Trubin (2006), mas substitui as séries de tempo por dados em painel não balanceado, incluindo 32 países da OCDE de 1990 a 2011. Essa modificação permite aplicar o modelo proposto a países com séries de tempo curtas. Ainda, incluímos defasagens do PIB para garantir que o spread de juros é útil na previsão de recessões, mesmo quando se controla para os efeitos de mudanças no PIB. Os modelos são estimados utilizando painel Probit, Logit e MLE. Os resultados indicam que com um nível de erros Tipo-1 (modelo prevê recessão mas a mesma não ocorre) de 25%, os modelos possuem poder de aproximadamente 63% e confirmam que esta metodologia pode ser utilizada como um instrumento efetivo para prever recessões com um ano de antecedência.

In the first chapter of this work we extend the results of Maldonado and Svaiter (2007) for the case of aggregator functions. Namely, under hypotheses of strong-concavity of the aggregator function and concavity of the stochastic operator, which define the objective function of the Stochastic Dynamic Programming Problem, we prove that the policy function approximation of the problem is Hölder continuous with respect to the value function approximation. From this, explicit control errors in computation of the solution of that kind of problems can be provided. The result is applied to a class of aggregator functions to illustrate how the approximation error of the policy function is bounded. In the second chapter of this study we test empirically whether the slope of he yield curve - yield spread - is a good predictor of recessions. We follow Estrella and Trubin (2006) although instead of time series, we adopt an unbalanced panel data framework for 32 OECD countries from 1990 to 2011. This modification allows one to apply this model for countries with short time series. Furthermore, we include four quarter lagged GDP in the model to assure that yield spread is a good predictor of recessions, even when controlling for GDP changes. Our models are estimated using panel Probit, Logit and MLE. ▼ This mixed-methods case study investigated factors that may contribute to the outperforming status of an urban high school. Urban high schools are possibly more challenged than ever before in preparing students for a 21st century economy (Orfield et al, 2006). In this context, success for California urban high schools is measured, in conjunction with other factors, by ranking 3 to 4 deciles above other similar public comprehensive high schools. However, other questions remain regarding the extent to which students‘ own involvement in their learning influences an outperforming high school‘s success.; Even with diminished resources the case study school has outperformed similar schools due to existing factors contributing to the rise its academic performance index (API), a measure largely prompted by the federal No Child Left Behind legislation and an important effectiveness indicator. Five years ago the urban high school in this case study was ranked by the California Department of Education (CDE) as a 5 on a statewide rubric where 10 is considered the highest score. On another similar but different state measure, one comparing similar schools‘ indicators where one school is compared to 100 other institutions sharing key characteristics, the case study school scored higher.; In 2007 the school raised its statewide rank to a 6 and its similar schools rank to a 9. This case study researched factors possibly explaining this case study school‘s outperformance, including:• Quickly identifying students scoring at levels below proficient;• Utilizing innovative curricular strategies by reworking the school day and implementing a strong scientifically-proven intervention curriculum and support technology; and,• A culture composed of caring stakeholders (i.e., highly qualified teachers, visionary leader, involved parents and support staff) who hold students accountable. La relation entre la monnaie et le commerce, et l’impact que le taux de change peut avoir sur le droit du commerce international suscitent de vives discussions. la charte de la havane préconisait la non-utilisation de la dévaluation du taux de change comme une arme commerciale. le gatt contient des articles qui s’adressent aux questions de change. cependant, la thématique suscite des polémiques concernant notamment l’applicabilité des accords de l’omc comme un remède commercial contre la dévaluation anti-compétitive de la monnaie. d’un autre côté, le fmi, institution créée dans le cadre de l’accord de bretton woods, est l’organe compétent pour traiter les questions internationales d’ordre financier, et l’article iv de son statut concerne en particulier son devoir de surveillance des politiques de change de ses états-membres, afin d’éviter l’obtention d’avantages anti-compétitifs par des moyens de change. les deux organisations sont censées travailler de manière conjointe pour accomplir les objectifs de la croissance économique globale, et c’est dans cette conception que l’harmonisation entre le droit de l’omc et les directives du fmi doit être mise en place, pour que l’objectif primordial d’atteindre la gouvernance globale pour le bien de tous devienne une réalité.

The relation between currency and trade, and the impact that the exchange rate can have on International Trade Law enables heated arguments. The Havana Charter calls for the non-use of the devaluation of the exchange rate as commercial weapon. GATT has, among its articles, those addressing issues regarding exchange rates. However, this topic raises controversies, especially concerning the applicability of the WTO agreements as a commercial remedy against currencies’ anticompetitive devaluation. On the other hand, the IMF, an institution created under the Bretton Woods Agreement, is the competent body to deal with international financial issues and its article IV rules on its duty to monitor its Member States exchange rate policies, in order to avoid obtaining anti-competitive advantages among their means of trade. The two organizations working jointly in an orderly manner to accomplish their objectives of an overall world economic growth and it is from this perception that harmonization between WTO’s legal guidance and IMF’s directives must be implemented. And as such, the prime goal for global governance for the benefit of all shall become a reality.
