Erinevaid mõiste määratlusi summeerides võib öelda, et käibekohustus tähendab deliktiõiguses arusaamist, et isikul, kes loob ohu või kontrollib ohtlikku olukorda ja laseb ohul kesta, lasub kohustus võtta kasutusele kõik mõistlikult vajalikud ja sobilikud meetmed, et kaitsta teisi isikuid ja nende õigusi ohu realiseerumise eest. Käibekohustuste kontseptsioonil tuginev vastutus asub seaduse poolt kohtute reguleerida jäetud õiguskaitse alas ja seepärast sõltub see, kas käibekohustus esineb ja milline on käibekohustuse konkreetne sisu, eeskätt kohtute poolt oluliseks peetud eesmärgipüstitusest. Üldiste eeldustena ohtude vältimise püüdluste osas, mis kehtivad olenemata üksikjuhtumi spetsiifikast, on eriline tähtsus ähvardava kahju raskusastmel, kahju tekkimise tõenäosusel ning ressursi suurusel, mis on vajalik ohu vältimiseks või kõrvaldamiseks. Kuigi käibekohustuste rikkumisel põhinev vastutus on Eesti deliktiõiguse orgaaniline osa, on see kohtupraktika nappuse tõttu autori hinnangul täna ähmane ja varjatud. Eesti situatsiooni arvestades vääriks kaalumist mõte koondada käibekohustuste kehtestamisel arvestatavad üldised kriteeriumid õigusnormidesse, mis määratleks praegusest hea usu põhimõtte regulatsioonist veidi täpsemalt üldise käitumisstandardi ning selgesõnaliselt ka kohustuse kaitsta teatud juhtudel aktiivselt tegutsedes teisi isikuid kahju tekkimise eest. Eeskujuks selliste sätete sõnastamisel Eesti õiguses võiks olla PETL-i artiklites 4:102 ja 4:103 sätestatu. Lisaks objektiivse käitumisstandardi täpsustamise võimalustele vääriks käibekohustustel põhineva vastutuse seisukohast läbimõtlemist ka delikti üldkoosseisul põhineva vastutuse aluseid reguleerivad kehtivad seadusesätted. Käibekohustuse rikkumisel põhineva kaasuse lahendamisel tuleb erinevalt BGB eeskujul põhinevast meetodiõpetusest VÕS § 1050 lg-s 1 sätestatud üldreegli kohaselt käibekohustuste rikkumist kui välist hooletust eeldada. Sellise lähenemise peamisteks eelisteks on kannatanult negatiivse asjaolu tõendamise koormise äravõtmine, tõendamiskoormise panemine menetluspoolele, kelle sisesfääri tõendamist vajavad faktid kuuluvad, lihtsus kohtumenetluses, usaldusväärsemad tõendid ning preventiivne mõju käibekohustuste rikkumistele.

By summarising different definitions, the duty to maintain safety in tort law means the understanding that the person, who creates a danger or controls a dangerous situation and allows the danger to persist, is required to employ all reasonably necessary and appropriate measures in order to protect other persons and their rights against the realisation of danger. As regards the attempts to avoid risks the general assumptions, which apply irrespective of the specific facts of an individual case, three key criteria are especially relevant: the degree of severity of potential damage, likelihood of damage, and the resources needed to prevent or remove the risk. Although liability based on violations of the duties to maintain safety is an organic part of Estonian tort law, it is still quite vague and hidden due to scarcity of case law. It would therefore be worth considering of setting out legal provisions so as to better perceive the possibility of liability based on such a duties. Bunching together general citeria that compose the objective standard of conduct would help to provide such a ground and relevant regulation contained in Articles 4:102 and 4:103 of the PETL may serve as an example. In addition to the clarification of an objective standard of conduct, the current legal provisions constructing the bases of liability based on the general composition of delict should also be specified from the same perspective. Unlike the methodological teaching modelled in the BGB, in solving cases based on violation of the duty to maintain safety by Estonian law, a presumption of the violation the duty must be applied to keep in accordance with the general rule provided in §1050 (1) of the LOA. The main advantages of this approach are that the burden of proving a negative fact is removed from the injured party and the burden is placed on the party to the procedure in whose internal sphere the facts needing proof are found; simplicity of the court procedure; more reliable evidence; and preventive impact on the violation of the duties to maintain safety.

▼ There is hardly any doubt that climate plays a significant role in shaping the face of the earth and in determining the type of economic activities that man may practice. The realization of the man climate relationship has led to growing interest in the science of climatology especially in the tropical areas where the controls exerted by the various climate factors, such as the annual rainfall and temperature, are really vital and effective. The agriculture was considering the dominant sector in GDP of Sudan because by 1956 it accounted about 60% of the total GDP while whole the other sectors contributed about 40% of gross domestic production (Work Bank, 2003). Approximately 80% of the labor force of Sudan‟s population is employed in agriculture and related activities. Rain fed agriculture in Sudan is affected by drought and variation in seasonal rainfall amounts during the last decade and climate change impacts have been reported in many areas of the country. Gadaref area is considered one of the most important rain-fed agricultural areas in Sudan, and it contributes more than 40% of the rain-fed cereals produced in the country. The objective of this study is to assess the impact of climate variability and change on sorghum yield over Gadaref area in Sudan using AquaCrop model. The trend analysis results show the maximum temperature and minimum temperature have significant trend (increasing trend) over the study area, implying that the temperature was been increasing over study area during the last decade. While the rainfall has an insignificant trend (decreasing trend) over the study area, indicating there was no significant change in rainfall during the last decade over the study area. Maximum and minimum temperature showed a negative relationship with correlation coefficients of -0.34 and -0.31 with sorghum respectively. This implies that an increase in temperature beyond the optimum level (high temperature of about 26-30°C and low temperature of about 10-15°C) results in a decline in sorghum production and vice versa. On the other hand Correlation analysis showed a positive relationship between sorghum and rainfall (0.59) and sorghum and evapotranspiration (0.25). This means that an increase in rainfall enhances sorghum production; while its decrease results in poor sorghum yield. Monthly results of coefficient of variation values indicated an increase in climate variability, which was shown by larger season to season fluctuations, with a higher coefficient of variation implying less predictability in the climate. The result of analysis of multiple regressions showed a significant (30%) relationship between sorghum and the set of climatic factors used in study. It was observed that 30% of the variability in sorghum yield could be explained by these climatic factors (rainfall, maximum temperature, minimum temperature and evapotranspiration) and was significant at (p=0.02). ▼ Heteronormativity is Kenya’s culture and it permeates all social institutions. Due to this heteronormative culture, lesbian, gay, bisexual and transgender (LGBT) people or sexual minorities in Kenya suffer injustices arising out of discrimination, oppression and marginalisation. These injustices are perpetrated by both State and non-state actors alike, consequences of which are LGBT deprivation of social, economic, cultural, political rights. The Constitution of Kenya 2010 is endowed with normative and institutional provisions that could help alleviate the suffering of sexual minorities. Through the Bill of Rights and other countermajoritarian provisions throughout the Constitution, it has the potential to provide a framework for the protection and promotion of the human rights of sexual minorities. Specifically, the Constitution embraces the international human rights principles of equality, equity, nondiscrimination and affirmative action which are vital for promotion of equality, equity and nondiscrimination of all people regardless of their sexual orientation or gender identity. Further, the institutions of parliament and judiciary under the Constitution have the express mandate to legislate and interpret the law in a manner that is in consonance with these principles. However, so far, the legislature is yet to put in place a law that promotes the constitutional principles of equality and neither has it repealed laws that discriminate against sexual minorities. The judiciary has so far demonstrated a danger of dual interpretation of the law on matters concerning sexual minorities, with some judges adopting critical and transformative approach to decicion making, while the majority still take the conservative, textual and dogmatic approach to interpretation of the Constitutional principles, thus posing danger to the right to enjoy protection by sexual minorities. This jeopardises the protection of sexual minorities from injustices of discrimination, oppression and marginalisation that they have endured for many years. For the equality and nondiscrimination to be enjoyed by sexual minorities, the legislature and the judiciary need to move away, and have the constitutional duty to move away from the traditional conservative approach to decision-making and embrace a more fluid, critical and transformative approach in their actions. The study responds to fundamental questions about the nature and impact of heteronormativity on the human rights of sexual minorities and how do they navigate through heterosexism; how international human rights principles and standards have been applied through legislative and judicial bodies in other jurisdictions to protect and promote the human rights of sexual minorities; how the legislature and the judiciary in Kenya can adopt more critical approaches to law making and law interpretation in order to protect and promote the human rights of sexual minorities in line with the Constitutional principles of equality and nondiscrimination; and in view of the…

L’objectif est de déterminer chez le porc l’impact d’une supplémentation périnatale en fructo-oligosaccharides à courte chaîne (scFOS) sur le développement des fonctions immunitaires et endocrines intestinales et les conséquences sur la santé métabolique de l’adulte en situation de déséquilibre nutritionnel.La supplémentation maternelle en scFOS, en modifiant le microbiote de la mère et de la descendance et la qualité du lait, accélère la maturation du système immunitaire intestinal des porcelets allaités.La fenêtre d’exposition (maternelle vs post-sevrage) conditionne la nature des modifications immunes induites par les scFOS. La supplémentation périnatale en scFOS modifie la réponse métabolique de l’adulte à un régime déséquilibré en stimulant la fonction endocrine intestinale et la sensibilité du pancréas au glucose, en réduisant les risques d’inflammation, et en modifiant l’homéostasie métabolique, associé à des modulations du microbiote.En résumé, la consommation périnatale de prébiotiques programme le phénotype métabolique et immunitaire de l’adulte via des modulations persistantes du microbiote. L'approche intégrée des données a permis d’identifier des acteurs moléculaires impliqués dans l’adaptation différentielle des individus à un régime déséquilibré en fonction de leur alimentation périnatale.

Perinatal scFOS supplementation modifies metabolic response to an unbalanced diet in adults by stimulating intestinal endocrine function and pancreas sensitivity to glucose, by reducing risks of inflammation, and in fine by changing metabolic homeostasis in association with modifications of microbiota.In summary, prebiotic consumption during perinatal life programs the immune and metabolic phenotype of adults through persistent modulations of intestinal microbiota. The integrated approach of data enables us to identify molecular actors involved in the differential adaptation of individuals to an unbalanced diet according to their perinatal nutrition.

▼ The health and safety of today‟s workforce is a vital part of every business‟s strategy. There is probably no industry where effective worker engagement with health and safety is more crucial than flower farming industry. Workers in flower farms are always exposed to dangers mainly from chemical poisoning and injuries caused by machinery. There is increasing evidence that workplace conditions may be eroding levels of job satisfaction and directly damaging the physical and mental health as well as the safety of employees. The objective of this study was to determine the influence of perceived health and safety standards on employees‟ job satisfaction at Oserian Development Company, Kenya.The research design was a case study and a a semi structured questionnaire was used to collect data which was analysed using descriptive statistics including including frequencies, percentages, mean scores, standard deviations. Correlation and simple linear regression analysis was also used to determine the influence of health and safety standards on job satisfaction. Out of the targeted 300 respondents, only 206 completed the questionnaires representing a response rate of 69%. The research established that perceived quality of health standards has a strong effect on employee‟s job satisfaction. The adjusted R2 is the coefficient of determination which designates the variation in dependent variable due to changes in independent variable. The adjusted R2 was 0.696 showing that there was 69.6% of the variation in job satisfaction which is accounted for by the combined effects of regular safety training and education, accident prevention measures and health practices. Most respondents agreed that there are wellness programmes in place, adequate accident prevention measures, provision of health care and safety training. They were satisfied with the wellness programmes, accident prevention measures and the health services provided to employees at the health facility. The respondents were dissatisfied with protective gear, lack of initiative to reduce stress and employee benefits. It was recommended that safety training should be customized to meet the needs and requirements of different jobs in different workstations of the organization to enable employees apply the new skills and knowledge acquired. The government should also enforce the safety laws as stipulated in Occupational Health and Safety Act (2007) by taking legal action against all employers who do not abide by the safety laws and standards.

▼ The Hague Convention on the Civil Aspects of International Child Abduction (1980) (‘The Abduction Convention’) is the international convention that creates a procedure to return children, who have been wrongfully removed or retained by a parent, to their country of habitual residence. A number of assumptions historically underpinned the rote and mechanical procedure of Convention hearings in Australia. However, The Abduction Convention in Australia has had to deal with a number of pressures given the current environment is child-centric, is one where there is an appreciation of the insidious nature of domestic violence and where signatories diverge socially, economically and legally. This thesis argues that the procedural application of The Abduction Convention in Australia has evolved to deal with these pressures. Convention proceedings now often use cross-examination, judicial communication, and expert evidence to bolster the record upon which determinations are made. Furthermore, the Family Court of Australia will analyse the situation of return to determine whether any mechanism, such as undertakings or mirror orders, can be used to diffuse the risk of harm to the child. The Abduction Convention matters of State Central Authority & Young and Harris are analyzed as they epitomize many of the challenges that must be dealt with by the Family Court of Australia as well as demonstrating the changes to the procedural application of The Abduction Convention that has occurred in the last two decades since the cases of Murray in 1993 and Emmett in 1995. This thesis asks and answers the question: with all of these procedural changes to the application of The Abduction Convention in Australia, what, if any, utility remains in having the Convention? The procedural changes may, to some extent, increase the complexity of Abduction Convention proceedings; but, importantly, they balance the safety concerns of a particular child with the need to continue to return children to their country of habitual residence as a means to deter future abductions. It is argued that the Convention not only retains its usefulness but that the changes in Abduction Convention determinations have allowed the Convention to remain pertinent in the context in which it applies today.

A presente dissertação aborda a temática do condomínio edilício, examinando questões importantes e elementares deste especial instituto jurídico, e do condômino com reiterado comportamento antissocial. Para tanto, exige-se uma robusta análise do direito de propriedade e da função social, como seu elemento transformador, na medida em que esta, ao lado da peculiar estrutura jurídica do condomínio edilício, que conjuga áreas de propriedade exclusiva com áreas de propriedade comum, somada ao próprio ordenamento jurídico pátrio, impõe ao titular de unidade autônoma o cumprimento de deveres de observância obrigatória, não só para com os demais condôminos, mas principalmente em favor de toda coletividade. Tais deveres, uma vez descumpridos, ensejam a aplicação de medidas jurídicas sancionatórias gradativas em face do infrator, a iniciar por penas pecuniárias, até final expulsão da seara condominial, que poderá ocorrer na medida em que sejam reiteradas as atividades nocivas por ele desempenhadas, gerando incompatibilidade de convivência com os demais condôminos, e na hipótese de as multas aplicadas mostrarem-se inócuas como meio de interrompê-las. A expulsão do condômino antissocial do condomínio edilício pode afigurar-se, a princípio, uma radical sanção, contudo extremamente necessária como último recurso não só para a manutenção do equilíbrio psíquico, econômico e social na copropriedade, mas para assegurar a função social que o ordenamento jurídico brasileiro impõe ao direito proprietário, no qual também está inserida a propriedade em unidade autônoma condominial.

This dissertation addresses the theme of condominium building, examining important issues and this legal institute special elementary, and condominium member with repeated antisocial behavior. Therefore, it requires a robust analysis of property rights and social function, as its transforming element, insofar as the social function, along with the peculiar legal structure of the condominium building, which combines exclusive proprietary areas with common property areas, in addition to its own legal system, imposes on the holder of the autonomous unit compliance with mandatory observance duties, not only with the other joint owners, but mostly in favor of the whole collectivity. Once breached such duties, it inspires the application of piecemeal legal sanctions measures in face of the offender, that starts from monetary penalties until the final expulsion of the harvest condominium, which may occur as the harmful activities are repeated by him performed, generating coexistence incompatibility with the other condominium members, and assuming that the fines shows up innocuous as a way to stop them. ▼ Project management (PM) plays a significant role in achieving the company’s goal and objectives. Due to its significant role, it is essential that the project managers use processes which remain focussed on the company’s business strategy. However, some implementations of the company’s business strategy have led to failures as a result of misalignment between project management and the company’s business strategy. Such misalignment has an impact on both the project management and business strategy and may lead to problems in the overall functioning of the business, including the implementation of the company’s business strategy through the projects. This research was undertaken to investigate the problem of aligning project management process with the company’s business strategy which has not been fully investigated to-date. This investigation aims to provide a deeper understanding and more holistic analysis of the key factors, such as stakeholders and contextual factors (AF), which enable or inhibit this alignment in order to develop a conceptual framework that addresses this research gap. This study examines and analyses the alignment process, by considering the key factors at the early planning phase of project management. To address the research gap, the study employs a qualitative, multiple case study approach in the interpretive paradigm. Data was collected via interviews of senior personnel (executives and project managers), mainly from three managerial levels of the organisation, including corporate, business, and functional levels in four telecommunication companies of the private sector in Saudi Arabia. The investigation was carried out by collecting data through semi-structured interviews to critically explore collectively the perspectives of the executives and the project managers on their experience of managing and executing the company’s business strategy and the projects. Written and electronic documentations as well as non-participant observations also served as important triangulation and complementary sources in understanding the phenomenon being studied and as a means of gaining additional perspectives and further insights on key issues. This study provides a novel contribution to the alignment process of project management to business strategy. The original contribution and findings of this study contribute to the growing body of knowledge of project management by developing a practical framework to benefit both academics and practitioners and to increase awareness of the alignment process. This holistic conceptual framework includes two sets of factors that impact the alignment process. Additionally, it provides a unique prescriptive standard and a code of practice for practitioners seeking to realise efficient and effective alignment.

▼ Post-1994 and following the adoption of the Constitution of the Republic of South Africa on 8 May 1996, the Constitution has since become the supreme law of the country and any conduct or law that is in conflict with its provisions is invalid. The constitution is founded upon particular values, namely, human dignity, equality and the advancement of human rights and freedoms. Amongst others, the 1996 Constitution governs the establishment and administration of prisons with the inclusion of the rights of the prisoners. This dissertation discusses how the rights of prisoners are protected including the perceived violations. Due to the high number of violations of prisoner’s rights, this dissertation will also discuss the various court decisions relating to the previously mentioned violations. The purpose of this dissertation is, to do an in-depth analysis on the protection and violation of prisoner’s ‘right of access to healthcare’ as provided in terms of section 27 of the Constitution of the Republic of South Africa. The dissertation will endeavour to expose the violations, provide an in-depth view of the extent of the violations through case studies. The implementation of the provisions of section 27 will be evaluated to determine if the prisons have been adequately protecting prisoners. In addition to the latter analysis, the prison’s shortfalls will be highlighted with the inclusion of a brief legal position in other countries. The dissertation acknowledges the existence of the prisoners’ rights, although the implementation thereof by prisons remains questionable and a source of controversy in the medico-legal sphere. The dissertation ultimately concludes that the ‘right of prisoners to access healthcare’ should be monitored on a regular basis to ensure those prisoners' rights are not constantly violated. The dissertation further concludes that the continued oversight will reduce the number of court cases and ultimately the State's resources on cases that involve the violation of prisoner's rights and thus uphold the spirit and purpose of the Constitution of the Republic of South Africa. In rural areas there is continued lack of financial services in Kenya in a sustainable basis which has been attributed to various deficiencies that characterize the operating environment. To examine the effect of asset micro-leasing on access to capital and income by Small and Medium Enterprises in Kenya (SMEs) a study was carried out. the study more specifically was sought to determine the effect of loan size on access to capital and income by Small and Medium Enterprises in Kenya; also the study was to look on the security in matters of accessing the capital and income by Small and Medium Enterprises in Kenya ,the effect of interest charged was also on the study findings on access to capital and income by Small and Medium Enterprises in Kenya the last thing on the study was to examine the outcome of SME product and service range on access to capital and income by Small and Medium Enterprises in Kenya SMEs. The Nairobi County government has all the scheduled SMEs in Nairobi. A semi-structured questionnaire was used at the grounds of the participant SMEs, using an administered questionnaire. Central tendencies were shown by the Descriptive statistics for example the mean and measures of dispersion such as the standard deviation. It was established that loan size also influences the Access to capital and income to a large extent. It can also be gathered that collateral requirement affects the choice of Access to capital and income by SMEs in Nairobi County. It is notable that the Interest charged on loan and service influences the Access to capital and income most remarkably due to the interest charges, the prepayment charges, the service tax and the loan processing charges. Moreover, the product and service range of SMEs in Nairobi County can be deliberated to be significant in the choice of Access to capital and income, among the key aspects of which include ; Enhance in profitability, increase in stock levels ,increase in sales and increase in retained earnings.

▼ The number of girls that are being exploited for prostitution in Nepal has increased in recent years, and girls suffer a high risk of being exposed when they come from already poorly conditions. Previously, uneducated girls could be found in the adult entertainment sector, but nowadays even educated girls are being exploited. This thesis aims to gain further understanding to why girls are being exposed and why it is difficult to protect them. By conducting qualitive interviews with employees from several NGOs working to protect girls from being exploited for prostitution, insights has been given about socio-structural factors that influences the situation for girls. By examining these factors with support from theoretical approaches that highlights social injustice, gender discrimination and structural oppression this thesis presents how different factors affect the work of protecting girls, and how the same factors also are contributing to why girls get exposed. The state of Nepal shows several efforts in trying to eradicate the problem and have ratified both the Convention on the Rights of the Child and the Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography. The state has also made changes in national law that shall promote and strengthen children's rights. Although the laws are strong, the protection for girls is insufficient and girls are vulnerable to being exploited by traffickers. The Government of Nepal, NGOs and several other authorities are working together to eradicate the problem, but the work needs be strengthened, coordinated and responsive to influencing factors simultaneously in order to achieve a long-term solution. This thesis suggest that cultural norms need to be challenged more and that the Government of Nepal needs to oversee how structural injustices affect opportunities for girls to take part of social benefits. In addition, knowledge about legal and moral rights needs to be increased among girls and in society as a whole, moreover the knowledge about trafficking and prostitution needs to be spread.

▼ Currently, the main focus in a chemical process design is cost reduction and profitability. This approach results in high expenditure due to the generation of huge amounts of wastes, which in turn requires waste control stations such as wastewater treatment facility, incinerator and so on. In other words, in conventional design the waste reduction is carried out at the late stage of process design, sometimes referred to as the end of pipe treatment, which causes impacts on environment, inventory of hazardous chemicals, energy consumption as well as cost impacts on the process. Due to all the above aspects, the impact of decision making is highest at the conceptual phase of a process design. However, this impact can be minimized by shifting the waste reduction from the late step of the process design to its early stage. There are several barriers for such shifting; the most important of which is the lacking of a methodology to be used as a screening tool at the conceptual design phase in order to select the inherently safer and the environmentally friendlier design. The objective of this thesis is to develop simple and quantitative indices that can be employed in minimizing the adverse effects of material and energy emissions from chemical industries. Several improvements to existing methodologies for pollution minimization are given. These are based on waste reduction concepts and are applicable from the initial step of a process design to revamping of existing processes. A simple risk index for the evaluation of risks to the safety of chemical processes is also developed. The work provides indices for evaluation of potential environmental impacts as well as safety risks of a chemical process in order to reduce the hazardous wastes generation and energy consumptions as well as safety risks reduction while maintaining the process throughput and profitability. This research offers new methodologies, which have significant contributions in sustainability development by providing new and simple indices to be employed at initial step of a chemical process design with minimum available process data for the evaluation of energy impacts of the process on the environment and at the same time for the assessment of the risks to the chemical process. These new indices are combined with the well-known WAR algorithm to offer a composite index to help investors, regulators and also process designers to select the sustainable design from other process design array. The new methodology uses Key Process Index (KPI) for ranking purposes merely from technical point of view. Even when two or more sustainable processes are concerned, the composite index can find the inherently safest, environmentally friendliest process without trade off with process economy and profitability. So, the new indices can be renamed as “Must Know Composite Indices” for chemical process designers. ▼ Across the globe, injuries sustained from traffic accidents are the eighth leading cause of mortality, and with the number of annual deaths steadily rising to over 1.25 million, now account for 2.5 % of total worldwide fatalities. This growing issue is not limited to the low and middle-income regions of the world, as the frequency and severity of traffic accidents has also been increasing in developed countries over the last decades. For example, between 2014 and 2015 the amount of traffic fatalities in the United States rose sharply by 7.2 %. Through analysing the patterns and locations of traffic accidents, road authorities can identify dangerous sections of the road network and prioritise these locations for infrastructure improvement, helping to prevent these tragic events from occurring. However, traffic accident analysis is traditionally based on historic crash data and is restrictive in many ways, typically suffering from issues including small sample sizes, underreporting of traffic accidents, and data scarcity. Furthermore, in the limited number of countries where it is available, historical accident data is often only provided on a deferred basis and analyses can be severely out-of-date. Naturalistic driving data, available from the advanced sensors and technology em- bedded in connected, semi-, and fully-autonomous vehicles, potentially offers both road safety researchers and practitioners a new and dynamic source of variables for analysis. The technology in these vehicles can be leveraged to detect accidents and ‘near miss incidents’, or critical driving events, such as heavy braking and evasive manoeuvres, and reliably predict locations with a high likelihood of traffic accidents. Both researchers and industry players alike see the promise of this data to combat the existing challenges of accident analyses. For example, real-time assessment of the locations of these events could aid road authorities in monitoring existing accident hotspots, as well as identifying new and developing areas of high accident exposure, offering various possibilities to intervene before incidents occur there. Yet, despite the great potential in identifying the locations of traffic accident hotspots with insights from these vehicles, to date, there is limited empirical evidence on whether the perilousness of locations can be accurately predicted through naturalistic driving data. Furthermore, with these insights and the rise of increasingly connected and intelligent vehicles, as well as the emergence of smartphone turn-by-turn navigation applications, various safety-focused innovations become a possibility, such as providing safe-routing services and in-vehicle warnings of potential accident hotspots. Whereas safe-routing will attempt to avoid an accident hotspot entirely, encounter- ing these dangerous locations will always remain a possibility. Consequently, identifying ways of effectively reducing the frequency and severity of traffic accidents at these known locations remains of the utmost importance. O neoliberalismo como a versão atual do capitalismo tem produzido uma série de problemas, o agravamento da tendência capitalista a mercantilização universal onde tudo é transformado em mercadoria, inclusive a educação, saúde, cultura e desporto. Valendo neste sistema o interesse individual onde os direitos sociais e econômicos são minimizados. Os princípios básicos do neoliberalismo são: Mínima participação estatal na economia de um país, pouquíssima intervenção do governo no mercado de trabalho, privatização das estatais, livre circulação de capitais internacionais, destaque na globalização, abertura da economia para a entrada de multinacionais, adoção de medidas contra o protecionismo econômico e desburocratização do estado. Considerando que, a educação é mais que uma forma de investimento do capital, a concepção neoliberal da educação que transformou-se em mais um elemento de fortalecimento do modelo da política econômica capitalista implantada nos e pelos países em desenvolvimento sócio econômico. No discurso neoliberal a educação passa a ingressar no mercado capitalista funcionando logo a sua semelhança, deixando-se assim de ser parte do campo social e político, os conteúdos políticos da cidadania, foi substituído pelos direitos do consumidor. Daí a visão neoliberal de que os pais e alunos são consumidores. De modo geral, percebemos que nos últimos anos através dos documentos oficiais evidenciam a presença das estratégias neoliberais sendo implementadas no Brasil. De igual modo a educação tem sido voltada para os interesses dos donos do capital. Sendo assim com essa pesquisa pretendo analisar as influencias que essa nova vertente capitalista tem causado na educação básica brasileira.

▼ The purpose of this study is to identify and explore teacher perceptions of the merit-pay plan after six years of implementation in the Innovative School District (ISD). This qualitative case study will add to the knowledge base and provide interested school leaders with information as they consider alternatives to traditional teacher compensation. This study will provide similar districts, administrators, and scholars with insight into teacher perceptions developed after a merit-pay system has first been put into place and then remained in place for six years. As other school district leadership teams work with their teachers and boards of education to consider and develop a merit-pay system, they may be able to avoid pitfalls in the process of implementation by knowing the perceptions teachers have about this approach. This knowledge can also be incorporated into the curriculum of applicable higher education programs. This study employed a single case study approach to gain an understanding of the perceptions held by elementary teachers in grades Pre-K, one through six through semi-structured interviews. This researcher recognizes that knowledge gained from this study is relative and not absolute, but it will use empirical evidence to generate plausible claims (Patton, 2002). This approach is aligned with Merriam’s purpose for qualitative research, which is to achieve a deep understanding of how people perceive what they experience (Merriam, 2009). There were four major themes that emerged from this study. These included: A significant number of teachers in ISD do not have a solid understanding of the structure of the merit-pay program. Second, trust between the teachers and the principal are vital to the success of the merit-pay program. Third, ISD’s merit-pay program has been successful with a majority of teachers stating that if they had the chance to return to a traditional salary schedule, they would remain on the merit-pay plan. The final and most surprising theme revealed that teachers are concerned about the amount of time the merit-pay plan requires of the school principal. Teachers were concerned that the principal was now viewed as the “evaluator” instead of the symbolic leader of the building. Advisors/Committee Members: Dolph, David (Committee Chair).

In the 21st century, the enterprise take Information Technology deeply to embed in each process (the Process Step), with the Internet technique that has become the indispensable kernel of competition in the business operations. After a number of semiconductor manufacturers participating in âRosettaNet For Semiconductor Contract Manufacturing B2B Integration Projectâ, it has been a necessary condition whether semiconductor manufacturers can provide customers with B2B information services now. However,the semiconductor manufacturers should be thinking how to meet the customers changing needs of B2B information service, how to integrate information, and how to synchronize induction environmental change. This research is based on âthe Impact of the QM practices on MC the capability modeâ. The B2B team members provide all of the ad hoc group for B2B project members' empirical perception to do the quality of B2B information services empirical analysis during implementation project. The objective aims to understand the impact of service quality for customer satisfaction. The result clearly indicates that the five dimensions will be a significant impact in B2B service quality for the enterprise information services, namely, small group problem solving, top management leadership for quality, information and feedback, supplier involvement and Process management. But if each dimension is to be analyzed individually, customer focus would impact on B2B information service quality. Generally speaking, the B2B team wants to enhance service quality, and then they should start with these five dimensions to proceed, and thereby to raise customer satisfaction. From the investing funds scale, they want to pursue efficiency, and almost each of semiconductor company has set up a similar B2B team to dominate the B2B project for customer service. Furthermore, this research used variables in the different conditions of demographic variables to summarize the diversity of satisfactions, and these analyses acquire the managerial implications that will be managers an important basis for improving the quality of B2B information services. Сматрамо да се основано може поставити питање: да ли је парламент још увек носилац законодавне власти, или парафразирајући Хобса: претпоставља се ко је законодавац, али да ли се и зна? Предмет ове дисертације су ограничења са којима се парламент данас суочава приликом вршења своје нормативне улоге. Та ограничења су унутрашње и спољашње природе, класична и нова. У модерном времену, у којем су ефикасност и брзина кључна очекивања, чини се да парламент као законодавац губи дах и суочава се са бројним ограничењима у извршавању своје – како се вековима сматрало – „основне функције”: законодавне надлежности. Теза да тежиште власти све више прелази на егзекутиву и у земљама са парламентарним системом државне власти није више новина. Парламент се, међутим, не суочава само са лимитима које пред њега стављају надлежности владе у законодавном поступку. Кључна улога политичких партија, релативизација класичног појма суверености и други, до сада недовољно истражени лимитирајући фактори законодавне улоге парламента доводе до модификације његове функције у савременој држави. Циљ дисертације је да кроз пажљиву селекцију неопходних стручних извора и ослањајући се на деценијско искуство у својству народног посланика у Народној скупштини Републике Србије прецизно утврдимо и рационално истражимо сазнања и изразимо научни став о улози савременог парламента у светлости ограничења његове законодавне функције. Пошли смо од хипотезе да је законодавна функција парламента сужена због устава као бедема, због активности владе као све значајнијег актера законодавства, политичких странака, односно нових учесника у законодавном поступку с једне стране, као и због релативизације суверености у условима међународних интеграција и утицаја глобалних економских токова с друге стране, што све доводи до модификације улоге савременог парламента.

Subjects/Keywords: The following question can be raised: Are parliaments still the true bearers of the legislative power; or paraphrasing Hobbes: it is assumed who the legislator is; but is it also known? The subject of this thesis are the limits that parliaments are facing today while exercising their normative roles. These limitations are both internal and external; and may be traditional or of new origin. Today efficiency and speed are key expectations; it seems that parliaments as legislators are losing their breath and are facing many limitations in their role that has for centuries been their ”basic one”: their legislative role. The fact that the focus of power is increasingly shifting towards the executive branch of power even in countries with parliamentary systems of governance is not a novelty anymore. Parliaments; however; do not only face the limits placed before them by the governments throughout the legislative process. The key role of political parties; the relativization of the classical concept of sovereignty; and other limiting factors of the legislative role of parliaments; which need further examination; may lead to the modification of their functions in modern states. The aim of the dissertation is to through thoroughly selected scientific sources and relying on a decade-long experience as Member of the National Assembly of the Republic of Serbia precisely determine and rationally examine and draft an academic position about the role of parliaments today with regard to the limitations in their legislative function. We started off from the hypothesis that the legislative function of parliaments is set by the constitution; and narrowed by the ever increasing role of the governments in the legislative process; by political parties and other participants in the legislative procedure; as well as by the relativization of national sovereignty in the framework of international integration and also by the impact of global economic flows.

▼ Children and young persons who have been removed from their families and who will not be returned to their families of birth following intervention by the State are amongst the most damaged and vulnerable children in society. They often present with a myriad of physical and especially psychological and emotional problems that originate from their biological history, in the reasons that led them to be taken into care, and, regrettably, also from their experiences while being parented when in the care of the State. This thesis explores the parameters of the ‘responsibility’ that the Chief Executive of the Ministry of Social Development assumes on behalf of the State in relation to those children who have been taken into its care and who will not be returned to their parents. What is meant by both ‘state,’ and ‘responsibility’ and what constitutes ‘permanency’ in this specific context, is explored. The history of state involvement in children’s lives is outlined, together with discrete themes that run through that history, including the development of the parens patriae and wardship jurisdictions from the 15th century to the present day. The statutory initiatives of the 19th and early 20th centuries that have their direct antecedents in the reaction of the enlightened state to the rigours of industrialisation, and of colonisation are also explored. Two hypothetical case studies of children in care are presented to illuminate the common issues and themes that permeate permanency cases. The experiences of these children are discussed in several chapters to illustrate and highlight matters pertinent to the welfare and best interests, not only of the permanently placed child, but also for his or her new ‘forever’ family. Particular attention is given to Māori children who are removed from their families and permanently placed because of the status Māori have in New Zealand society and the value they attribute to families and children. In one sense, the issues Māori children who must be permanently placed are precisely the same as those for non- Māori children – of securing the child in the new placement. However, this can be a more profound dynamic for Māori children because of the need to ensure that the necessary connections are made to the child’s culture and language. A comprehensive analysis of the applicable statutory framework is undertaken. This identifies that the effect of a custody order under s 101 of the Children, Young Persons and Their Families Act 1989 is, by virtue of the operation of s 104 of that Act, the same as if a parenting order had been made under the Care of Children Act 2004 in respect of the child. The consequence is that the Chief Executive has, as a matter of law, precisely the same responsibilities to that child as does any parent of their own child. However, the context has some significant differences in that the child who is removed from their birth family is likely to have been profoundly abused. Slovenski delodajalec mora zagotavljati pogoje za varnost in zdravje delavcev v skladu s posebnimi predpisi o varnosti in zdravju pri delu. Lex specialis navedenega področja je Zakon o varnosti in zdravju pri delu /ZVZD-1/ (Ur.l. RS, št. 43/2011), ki v poglavju Temeljna načela neposredno za načelom preventive, opredeljuje novo načelo, tj. promocija zdravja na delovnem mestu. Institut dopolnjuje obstoječe dolžnosti delodajalca s področja preventivne in celovite skrbi za zdravje zaposlenih. To pomeni, da se obveznost delodajalca ne konča pri skrbi za telesno zdravje, temveč se njegova dolžnost razširja tudi na duševno zdravje zaposlenih. Zaradi raznolikosti dolžnosti, ki delodajalcem nalaga načrtovanje in izvajanje sistematičnih ciljanih aktivnosti in ukrepov, se v praksi pojavljajo novi problemi. Za celotno razumevanje instituta je v magistrski nalogi, na podlagi analize mednarodne zakonodaje, zakonodaje Evropske unije ter slovenske zakonodaje, celovito predstavljena zakonska dolžnost delodajalca in vse njene faze (načrtovanje, izvajanje, spremljanje ter finančno vrednotenje). Teoretična predstavitev dolžnosti je dopolnjena s predlogi ukrepov, katerih izhodišče je slovenska delovno pravna zakonodaja. Posamezen predlog aktivnosti je utemeljen s predvidenim učinkom, ki izkazuje koristi preventivnega prizadevanja delodajalca.

A Slovenian employer must provide safety and health conditions for workers in accordance with special safety and health regulations at work. Lex specialis in that area is the Occupational Health and Safety Act (Official Gazette of RS, No. 43/2011), which in chapter Basic principles, second to the principle of prevention, defines a new principle, ie. Workplace health promotion. The Institute complements the existing obligations of the employer in the field of safety and health at work in that the employer is obliged to comprehensive preventive care for employees health. This means that the employer's obligation does not end with caring for physical health, but his duty also extends to the mental health of the employees. Diversity of responsibilities, which requires from the employer systematic planning and implementation of targeted activities and measures, generates new problems in the execution. For a complete understanding of the institution, based on an analysis of the international law, European Union law and Slovenian legislation, this paper comprehensively presents the legal employer's duty and all of its phases (planning, implementation, monitoring and financial evaluation). Theoretical presentation of responsibilities is complemented by proposals for measures, whose starting point is the Slovenian labor legislation. Each proposed activity is justified by the anticipated effect, which shows the benefits of preventive efforts of the employer.

▼ The ability of reading is an important part of teaching literacy and language acquisition. Reading improves the thinking ability by giving new concepts and ideas and enhances vocabulary and language which is essential in verbal communication. Because of the importance of reading, children and adolescents are encouraged to read by their parents, teachers and sometimes by national reading campaigns as an educational policy. Turkey launched a nationwide reading campaign targeting high school students in 2004, and another one aimed at primary school students in 2005 which is called the 100 Basic Literary Works reading campaign. This study investigated the reading habits of Turkish high school students. It also explored how students are influenced by family, teacher and peer group. Moreover, the study investigated the association between the students reading habits and their gender, school type and region. In addition, the study examined current efforts to encourage students to read. The study was conducted in 8 provinces and 8 districts of Turkey in 2012. The data was gathered thorough questionnaires with 2425 students from 86 high schools of 5 different types and interviews with 31 students, 15 teachers and 4 local education managers. The study found that 82.0% of young people in general read at least once or twice a week outside school for at least 30 minutes and 40.6% read every day or almost every day for leisure. It was found that females were more frequent and enthusiastic readers than males. The students from science high schools and Southern East Anatolia Region read more frequently. It was indicated that the majority of the students reported that they were aware of the 100 Basic Literary Works reading campaign but, in fact, they knew of the campaign in upper-primary school. The qualitative findings indicated that there was little awareness of the campaign in high schools. Libraries are important places to assist inculcate children s and young people s love of reading and provide free access to reading materials and sources but Turkish young people were not frequent users of libraries. Both teachers and students had concerns about lack of reading materials and poor facilities and services in public and school libraries in Turkey.
