By summarising different definitions, the duty to maintain safety in tort law means the understanding that the person, who creates a danger or controls a dangerous situation and allows the danger to persist, is required to employ all reasonably necessary and appropriate measures in order to protect other persons and their rights against the realisation of danger. As regards the attempts to avoid risks the general assumptions, which apply irrespective of the specific facts of an individual case, three key criteria are especially relevant: the degree of severity of potential damage, likelihood of damage, and the resources needed to prevent or remove the risk. Although liability based on violations of the duties to maintain safety is an organic part of Estonian tort law, it is still quite vague and hidden due to scarcity of case law. It would therefore be worth considering of setting out legal provisions so as to better perceive the possibility of liability based on such a duties. Bunching together general citeria that compose the objective standard of conduct would help to provide such a ground and relevant regulation contained in Articles 4:102 and 4:103 of the PETL may serve as an example. In addition to the clarification of an objective standard of conduct, the current legal provisions constructing the bases of liability based on the general composition of delict should also be specified from the same perspective. Unlike the methodological teaching modelled in the BGB, in solving cases based on violation of the duty to maintain safety by Estonian law, a presumption of the violation the duty must be applied to keep in accordance with the general rule provided in §1050 (1) of the LOA. The main advantages of this approach are that the burden of proving a negative fact is removed from the injured party and the burden is placed on the party to the procedure in whose internal sphere the facts needing proof are found; simplicity of the court procedure; more reliable evidence; and preventive impact on the violation of the duties to maintain safety.

This demands the assurance of proper road safety and traffic flow in jammed areas. Traffic jams are mostly the consequence of roadblocks; which assure road maintenance and securing of spots after traffic accidents. At the same time they enable safety for workers and users of the road infrastructure. The thesis presents the comparison of different types of entering before the roadblock on two-lane parts of the highway and suggests measures to increase the level of road safety and improve the traffic flow in areas with roadblocks.; info:eu-repo/classification/udc/656.11.053.8(043.2)

Subjects/Keywords: Neoliberalism as the current version of capitalism has produced a number of problems, the worsening capitalist tendency to universal commodification where everything is commodified, including education, health, culture and sports. Availing this system the individual interest where social and economic rights are minimized. The basic principles of neoliberalism are: Minimum state participation in the economy of a country, very little government intervention in the labor market, privatization of state, free movement of international capital, emphasis on globalization, opening the economy to the entry of multinationals, adoption measures against economic protectionism and bureaucracy of the state. Whereas education is more than a form of capital investment, neoliberal conception of education that became another of capitalist economic policy model strengthening element implemented in and by countries in socio economic development. In the neoliberal discourse education passes to enter the capitalist market soon working their similarity, leaving just to be part of the social and political sphere, the political content of citizenship has been replaced by consumer rights. Hence the neoliberal view that parents and students are consumers. In general, we see that in recent years through official documents show the presence of neoliberal strategies being implemented in Brazil. Similarly education has been focused on the interests of capital owners. Subjects/Keywords: The following question can be raised: Are parliaments still the true bearers of the legislative power; or paraphrasing Hobbes: it is assumed who the legislator is; but is it also known? The subject of this thesis are the limits that parliaments are facing today while exercising their normative roles. These limitations are both internal and external; and may be traditional or of new origin. Today efficiency and speed are key expectations; it seems that parliaments as legislators are losing their breath and are facing many limitations in their role that has for centuries been their ”basic one”: their legislative role. The fact that the focus of power is increasingly shifting towards the executive branch of power even in countries with parliamentary systems of governance is not a novelty anymore. Parliaments; however; do not only face the limits placed before them by the governments throughout the legislative process. The key role of political parties; the relativization of the classical concept of sovereignty; and other limiting factors of the legislative role of parliaments; which need further examination; may lead to the modification of their functions in modern states. The aim of the dissertation is to through thoroughly selected scientific sources and relying on a decade-long experience as Member of the National Assembly of the Republic of Serbia precisely determine and rationally examine and draft an academic position about the role of parliaments today with regard to the limitations in their legislative function. We started off from the hypothesis that the legislative function of parliaments is set by the constitution; and narrowed by the ever increasing role of the governments in the legislative process; by political parties and other participants in the legislative procedure; as well as by the relativization of national sovereignty in the framework of international integration and also by the impact of global economic flows.
