Subjects/Keywords: The following question can be raised: Are parliaments still the true bearers of the legislative power; or paraphrasing Hobbes: it is assumed who the legislator is; but is it also known? The subject of this thesis are the limits that parliaments are facing today while exercising their normative roles. These limitations are both internal and external; and may be traditional or of new origin. Today efficiency and speed are key expectations; it seems that parliaments as legislators are losing their breath and are facing many limitations in their role that has for centuries been their ”basic one”: their legislative role. The fact that the focus of power is increasingly shifting towards the executive branch of power even in countries with parliamentary systems of governance is not a novelty anymore. Parliaments; however; do not only face the limits placed before them by the governments throughout the legislative process. The key role of political parties; the relativization of the classical concept of sovereignty; and other limiting factors of the legislative role of parliaments; which need further examination; may lead to the modification of their functions in modern states. The aim of the dissertation is to through thoroughly selected scientific sources and relying on a decade-long experience as Member of the National Assembly of the Republic of Serbia precisely determine and rationally examine and draft an academic position about the role of parliaments today with regard to the limitations in their legislative function. We started off from the hypothesis that the legislative function of parliaments is set by the constitution; and narrowed by the ever increasing role of the governments in the legislative process; by political parties and other participants in the legislative procedure; as well as by the relativization of national sovereignty in the framework of international integration and also by the impact of global economic flows.

Subjects/Keywords: ABSTRACT Since the 1970s; local governments in Georgia have been authorized; upon voter approval; to levy a one-percent general-purpose Local Option Sales Tax (LOST); which is earmarked for property tax relief. Using socioeconomic and fiscal data during the period 1975-2002; this dissertation examines the adoption and budgetary effects of the LOST in Georgia counties. The adoption of the LOST is studies with a discrete-time event history analysis. The results suggest that the probability that an eligible county will adopt the LOST is determined by a set of motivations; obstacles; and resources. The motivations are related to the perceived property tax level; the existence of fiscal pressure; and the potential of sales tax exportation. The obstacles are related to existing sales tax rates and the level of tax competition. The resources for overcoming these obstacles are related to the tax mimicking behavior in the process of policy diffusion. Budgetary effects of the LOST are examined with pooled time-series regressions. The results suggest that (1) the rollback of property tax millage rates by the LOST is gradually offset by a faster growth of the rates in the post-LOST period; (2) the LOST proceeds are fungible; as they lead to higher levels of revenue and expenditure in the counties; and (3) the levels of fungibility vary across counties in accordance with their fiscal and socioeconomic conditions. Negotiations that were once focused on one or two isolated issues now encompass multiple sectors and an increasing number of parties. Negotiators must constantly make decisions based on uncertain and changing information – decisions that often have irreversible impacts on relationships and deal outcomes. Training policymakers; business leaders; and nonprofits to negotiate in an evolving 21st century has never been more important or challenging. Dragonfly Negotiations & Consulting is a client-based company that works with organizations in order to impart negotiation and leadership skills. Dragonfly provides training for clients that are focused on advancing social change within their respective fields – organizations that are often operating on the cutting edge of complicated social policies. Dragonfly; along with the vast majority of other negotiation consulting firms and academic negotiation courses; primarily relies on simulations to teach negotiation skills and lessons. Simulations; a form of experiential learning; are particularly prevalent in negotiation training given the important role that soft skills and social processes play in mastering the field. Yet despite the increase in complexity found in today’s realworld negotiations; simulations have failed to similarly evolve. This report seeks to answer how Dragonfly can best design and implement simulations that teach its clients to negotiate in an exceedingly complicated world. In order to do so; a gap-analysis of presently available simulations was performed; derived by creating a framework that isolated the architectural components found in different types of negotiation simulations. These findings indicate that though a substantial number of simulations involve multiple parties and nonscorable interests; very few simulations contain the dynamic complexity of real-world negotiations. To form recommendations for how Dragonfly can design future complex simulations; the unique features of real-world negotiations were identified and combined with pedagogical theories deconstructed from existing simulations. Supplementing these recommendations; this report provides a proposed simulation example that incorporates a new; complex design; as well as potential criteria to evaluate the success of future simulations. To assist Dragonfly in implementing these recommendations; a barriers analysis was conducted to help overcome potential issues.
