▼ Library is a government institution and a public place people frequently take advantage of. It is related to every aspect of peopleâs life. Due to the changes of social environment, stable development of economy and the enhancement of knowledge level of people, people start to ask for a more perfect and multi-variant library administration legal system. At the authoritarian time, the legal system was not completed yet and the concept of the principle of clarity and definiteness of law and of legal reservation was not mature until Library Law was implemented on January in 2001. The Library business has taken off these years, while the quality of service has decreased due to the decline of service function, budget, and budgeted posts. Therefore, this paper aims to discuss how public and private departments form a new structure, and effectively increase social animation and peopleâs living quality by giving some examples in Kaohsiung Public Library on reader-service, management and the aspect of law systems on combining folk force to utilize the social resources, analyzing how Library Law influent the management of the public libraries. With the trends in democracy and human right, this research aims to give some suggestions on reformation of Library Law through the main research methods based on five administrative frameworks – administrative principles, administrative organizations, administrative authority, administrative helps and administrative supervision, as well as the literary reviews , historical induction and lots of theory and principles of administrative laws combining the spirit of contributing efforts to the people, the concept of turning library into a life-long learning place and the idea of protecting readerâs rights and interests. This research suggests a reformation of library law of our country, hoping to improve the function of library, accomplishing the goal to collect, organize and restore the library database and local documents and making use of function of library to provide book information, promote social education and hold civilization activity. ▼ Local police station is a Government organ that the public contacts directly the most, involving in the daily life of people. Following with the social transformation amid stable economic development and rising educational standard, people started to ask for a higher quality of the administrative legal system of police station, expecting it to be more various and perfect. The legal system wasnât comprehensive enough under the time of authoritarianism, and the enforcement adhering to law, such as legal principle of priority, reservation and clarity, wasnât mature enough, either. Until June, 2003, police station finally can enforce the administrative legal system with a clearer rule due to the promulgation of the Police Duties Enforcement Act. In terms of the administrative legal system of local police stations, except for maintaining public order and the traffic, the range of the enforcement includes various and diverse kinds of services for people, such as school bullies, social well-fare, high risk population caring, community service providing and environmental hygiene maintaining. The wide range of these services is too heavy for local police station to bear under the current system. In order to go in line with the democratic rule of law and to safeguard human right aggressively, the five major frameworks of administrative law, including the basic principle, the administrative organization, administrative authority, administrative remedy and administrative supervision are adopted as the main research method. Moreover, related research methods, such as reference, comparative analysis and induction analysis is also included in this paper to provide suggestions for the current administrative legal system of police station and to fulfill the task that police officers should do by analyzing many important theories and principles of administrative law with the spirit to serve the public, so that the public order and peopleâs rights can be safeguarded and the functions of police station can also be implemented comprehensively. ▼ "Lobbying", a common democracy operational practice, has a positive meaning to promote a political participation amount the public. However, an improper lobbying, which brings no benefit to the public, will destroy this mechanism and may imply an improper transfer of benefits. Therefore, to restrain improper lobbying, to process public policies in an open and transparent procedure, to fairly, efficiently, and reasonably distribute government resources, and to reflect the core value of democracy are all highly expected by the public. Today lobbying becomes a global trend. The Act aims to regulate elected legislators and government officials to open the lobbying they encountered. As we all know, Lobbying Act is highly politically sensitive, that makes the legislation technically difficult. The studies we found that The Taiwan Lobbying Act has its weakness link. Such as if both of government chief and deputy are being lobbied, has the obligation to make a report to the organization where they serve. In the mean time, they are also supervising and managing the personnel in charging the monitoring improper lobbying activities. Such conflict, just like what we often heard, âThe players are also the refereesâ. Thus, authorities should re-exam the objectives of making the Lobbying Act, raise the monitoring level to a higher authority that also entitled a proactive investigation right, clearly define difference between lobbying and intimation (or petition, clarification, and illustration), logging all lobbying, "custodial in discreet" all uncertain legal definitions, restrict elected officials in a revolving-door act to restrict them lobbying for their own benefits, as well as administrative and criminal coexistence of accountability mechanism, such as an amended Act . But, any government policy needs public support, the main key to success lies in the Government's determination. Thus, the structure of this study is base on the basic principles, the administrative organization, the administrative authority, the administrative relief and the administrative supervision to research. Discussing the topic from documentary support and historical accumulations, from people's "right to express opinions" angle, we comprehensive review current Lobbying Act. And, thus, we hope that we could make useful suggestions to amend the act and to make the act operates better. The setting of video surveillance is hoping to give citizens the feeling ofâjusticeâandâhappinessâ. With rapid changes of the politics, society and economic structures, the public security situation is increasingly complex, modus operandi and the level of victimization compare to the past have a dramatic change, and magnifies report by the media and far-reaching transmission of network, violent crime and other security problems. It is just like citizensânightmare. Government units also recognize that the setting of video surveillance is conducive to investigate and prevent crime and save the cost of public security. It generally sets video surveillances at important intersections in major cities and blind spots of public security and expects to create a safe living environment for citizens. Kaohsiung City is in no way conceding, after the merger between county and city, it has both urban and rural development pattern. Explore and evaluate from the angle of the real pulsation of society, geographical environment and social control, has been completed 17,862 video surveillance cameras and are adding continually. However, it has no related supporting measures in response. Therefore, this research found that there are many substandard existing social conditions for the governance of video surveillance in our country and current Kaohsiung City, as well as expectations of the citizens, there are necessary to review and improve. Therefore, in this research, basic principles, administrative organization, limit of administrative rights, administrative relief and administrative surveillance of five structures of the Administrative Law are main research methods; it adopts literature review and historical induction, views the currently legal system and social status of video surveillance governance in our country, and then view the problems of video surveillance governance in current Kaohsiung City and makes recommendations. ▼ Abstract Administrative division contains a string of complex questions. It does not only contain the simple concept of the division of regions, but the formation of the ideology of residence towards regions and the fairness of national resource distributions. However, followed by administrative division, the original administrative district still may not develop well as expected due to the change of time and space. By the analysis of the 5 major frameworks of administrative law, I found out that since the merger of Kaohsiung city and county in 2010, the transition of the environment has diluted and allocated the resources inappropriately. It leads to an unbalanced regional development because the people can not be satisfied with inadequate resources. However, the problem is that the current administrative division can not tackle the problems. Itâs a great loss that a reasonable and appropriate plan has not even been conducted for the administrative division of Kaohsiung. Moreover, the scale that administrative division covers in local districts is so comprehensive that it de facto influences the right and obligations of people. Therefore, the legal system of administrative division should be improved and adjusted. By this study I found out that Kaohsiung City should consider the overall development and related factors to assess the whole situation with a profounder perspective. By the expansion that brought by the merger of administrative districts, the resources will be more adequate so as to meet the need of people. With the local features of each administrative district, transport communication can be extended, as well as the space greening and beautification. As a goal-oriented activist, the district governors should dedicated to increasing the service quality and efficiency of district offices for people. Followed by the balanced development, local features and the enhancement of overall development, Kaohsiung City can become the leading city in Taiwan with easy access to administration, balanced resources and limitless development. ▼ Under the idea of âLand ownership means wealth ownershipâ, people believe that owning land is the ultimate symbol of wealth. Area of Taiwanâs state-owned land goes up to 3.6 million hectares. Government agencies at all levels that require official or public use of land must apply for appropriation of the public land, which creates fewer disputes. This is not within the scope of this study. The rest of the non-public land would be treated in accordance with the provisions of Article 53 of the State-Owned Property Law, whereby âThe vacant house and land belonging to non-public use property shall be sold by tendering, if no predeterminated purpose.â However, after the land value skyrocketed due to cases of land auction, the public gradually became concerned with whether the state-owned land auctions are driving up the land prices. According to the principle of public land management and process, it expressly states that state-owned land is âfor rent only and not for saleâ. However, there are many exceptions, causing the current state-owned land policy to be still primarily auction-based. Therefore, there is still room for discussion regarding the impact of the âfor rent only and not for saleâ policy on the development of the state-owned land. ãã However, we are currently faced with limited resources and infinite demands, while the government regards land tendering as one of the optimal operating methods. Strengthened management for issues such as illegal occupation and idleness of state-owned land should thus be simultaneously implemented considering the rare and irreplaceable nature of state-owned land resources. As a result, in conforming to the principles of making reasonable and optimal adjustments in the utilization of land resources, this study explored the domestic state-owned land management system within the administrative law frameworks and examined whether any amendment is required. The ultimate aim of this paper is to examine the problems one by one under the five major frameworks: basic principles of the administrative law, administrative organization, administrative authority, administrative relief, and administrative supervision, while providing a discourse and analysis of the existing system. Concrete suggestions were then given to correct the existing state-owned land management system in Taiwan, in an attempt to provide a standard for policy makers or for administrative agencies when setting administrative rules. ▼ Numerous studies have shown dramatic variations in the rates that immigration judges grant asylum. What these studies have failed to adequately explain as of yet is why? In attempting to understand the behavior of immigration judges in asylum cases, scholars have generally taken one of two approaches, either examining immigration judge behavior through top-down bureaucratic models or with models developed through the study of the judiciary. From these studies we have learned that similarly situated asylum applicants have different chances of success based merely on the ideological leanings of the judge who decides their case. We also have learned that judges respond to top down extraneous pressures by granting more or fewer asylum petitions. What we don’t know is how the individual preferences of immigration judges are affected by extraneous factors. I believe that the primary reason previous studies have been deficient is their failure to adequately consider how immigration judges’ decisions are influenced by their status as administrative law judges who are tasked with making hundreds of verdicts a year. As administrative law judges, immigration judges sit within a web of oversight that is unlike any other judiciary. They have a caseload that is more akin to a street-level bureaucrat than most members of the judiciary. However, as members of the judiciary they are different from the type of agents who are the subject of most top-down studies of bureaucracies. I hypothesize that in order to fully understand the behavior of immigration judges in asylum cases, any model must contain a combination of attitudinal, institutional, legal and exogenous variables which influence immigration judges in their decisions to grant or deny asylum. Recognizing that immigration judges sit within a rather unique context, a multi-institutional approach examining immigration judges as both administrative law judges as well as street level bureaucrats working within a legal context provides the best explanation for why these judges behave so differently. The results confirm a number of previous findings. Immigration judge ideology does influence the rate that they grant asylum. Political, economic and social factors also influence whether immigration judges grant asylum. The results also point to a number of new conclusions that can be drawn about the behavior of immigration judges in particular as well as administrative law judges in general. Like street level bureaucrats, as caseload increases, the influence of individual ideology in the decision process also increases. Moreover, the results reveal that judges with different ideological leanings respond to the same variables differently. Factors that might increase the likelihood that a liberal judge will grant asylum, actually decrease the likelihood that a conservative judge would grant asylum. ▼ The Act to Implement the International Covenant on Civil and Political Rights (CCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR) has been promulgated on April 22th, 2009. Having domestic legal status, the Act reveals the provisions of protecting human rights from CCPR and ICESCR and makes the obligations of our country to protect immigrantsâ human rights and meet the minimum standards request to be known as civilized country. The administrative system for detaining illegal immigrants in our country can be divided into two categories: One is for foreigners (including common foreigners and guess workers) and the other is for citizens of Mainland China. The provisions are under article 38 of the Immigration Act, article 18 of the Regulations Governing the Relations between the People of the Taiwan Area and the People of the Mainland China Area and article 68, section 4 of the Employment Service Act. For the reason of our unique national condition, the immigrants are not like other countries only divided their immigrants into âforeignersâ or âstatelessnessâ, but also included âcitizens without household registration,ââMainland China citizens,â âHong Kong residentsâ and âMacau residentsâ etc. According to the investigation, âforeignersâ and âMainland China citizensâ are the majority illegal immigrants among all in our country. Therefore, this research is going to focus on the two kinds of people above. Besides, this research limits the alien detentions to those illegal immigrations who had already entered our country and broken the immigration rules, and defines the âadministrative detentionâ as an âadministrative measureâ that temporarily detain illegal immigrants in detention centers before the institution in charge executes the repatriation immigrantsâ. Thus, the legal character of detaining illegal immigrants is an âadministrative disciplinary actionâ, which means it is just a temporarily preservation measure and therefore not included in Administrative Penalty Act; furthermore, as it is also not a criminal action, it must have to distinguish from âcustodyâ. This research is based on five principals of Administrative Law, which are administrative principal, administrative organization, administrative authority, administrative remedy and administrative relief. The research will use different dimensions and angles to inspect the legal system of our country toward the administrative immigration detention system. Utilizing literature review, history statement, comparative analysis, and inductive analysis as the main methods of this research to discuss the âthe detention system for alien immigrants constructed upon CCPR and ICESCR in our countryâ based on the five principles of Administrative Law and to see if there is any improvements to make and further come forward some advices for the future acts or provisions of detention of immigrants and finally to guarantee immigrationsâ human rights to meet the minimum standards of CCPR and ICESCR and elaborate in a more effective way. ▼ The pillar of functioning democratic countries is street-level bureaucrats, and the discretionary authority of which will be closely related to public interaction. Whether to make discretion is related to the street level bureaucratsâ recognition of political participation or governmentâs responses to their needs. The original six district offices of Tainan City prior to merger are selected as objects for this study. By using questionnaire, this study will try to discuss the relationship between the street-level bureaucratsâ administrative discretionary power and political efficacy, understand the use of administrative discretionary power by the street-level bureaucrats and their feelings of political efficacy and organizational environment, and establish the research model of administrative discretionary power and political efficacy of the street-level public servants in district offices. Main findings are as follows: First, on the relationship between personal characteristics and administrative discretion, the study shows that as the street-level bureaucratsâ ages, years, and official levels grow longer and higher, their discretion tend to be more conservative and passive. Also, on the relationship between personal characteristics and political efficacy, the study shows that the longer the years, the higher the political efficacy, while the bureaucrats who assume the position of supervisor has higher political efficacy than non-supervisor. Second, organizational environment has significant influence on the making of street-level bureaucratsâ discretion. The study shows that when under the explicit leadership and the operation of the organization is felt to be stable and predictable, the public servants can make discretion more effectively and actively. Third, on the relationship between political efficacy and administrative discretion, the study shows the degree of political efficacy recognition does affect on the street-level bureaucratsâ administrative discretion.Under the control of effective leadership of the chief, due to the impact of bureaucratic experience, high political efficacy does interfere discretionary decisions ,and make negative act. ▼ This dissertation is mainly anchored in police administrative neutrality. First of all, according to political literature, it analyzes the role of the police when they execute the governance power in a state. Secondly, from police science literature, it explores the reasons the police involve with politics. Thirdly, based on legislative procedure, it analyzes the different opinions a government and legislature have regarding to âcivil service administrative neutrality.â This dissertation also, according to the study of administrative neutrality from foreign administrative law and professors, seeks the criterion of police administrative neutrality. Finally, throughout the previous media reports, it sorts out the police administrative bias and turns it into study material and judgmental source for this thesis. The author discovers three steps to examine police administrative neutrality, and delivers a case study: mass media expose police administrative bias during the police enforcement tasks of the 11th presidential election. 1. Rule of law: to analyze if the police achieves tasks based on law, and due process of law or standard operating procedures. 2. Execution Neutrality: to analyze if administrative discretion is proper and impartial according to administrative principles. 3. Administration Neutrality: to analyze if politics interferes with police duties. If this occurs, it may result in a partial administration. The police symbolize the governance power of a state, and play different roles as government changes. In an authoritarian state, the police are a tool to suppress people against the ruler; in a democratic state, police authority is restricted to a certain level. Lately, political environment and political party change has become normal. The police ought to acknowledge a truth; governments change but administrations remain. To strengthen democratic functions as the police performs duties, they should prioritize public interest, follow rule of law, adopt political policies, assure legality of human rights, maintain equality of political parties, and present the appropriate assistance to people in the specialization area of public order maintenance. ▼ After Taiwan underwent city-county consolidation and thus entered a new era of five Special Municipalities, the original counties, townships, and cities of elected representation have now been transformed into districts with official appointed leaders. By comparing the models and practices of these two local governance systems brought by the institutional reform, which has led our attention to the differences of behavior and reaction the two systems have while put in the same environment and under the same government affairs, this present study evaluates the two systems with special focus on their administrative performance and check-and-balance capability of the public sector. The ultimate purpose of this study is to analyze the merits and limits of elected representation and official appointment and through observing one real case, pinpoint and review the problems the two systems encounter in local governance, and finally propose advices to improve the current system. Methodologies adopted in this study include: 1. Case study: Liouguei District of Kaohsiung City (the original Liouguei Township of Kaohsiung County) is chosen to observe the impact of institutional reform. 2. Literature analysis: Relevant documents and data are collected and analyzed for the comparison of elected representation and official appointment in their organizational and functional differences. 3. In-depth interview: Administrative officials and township representatives who have experienced the transition are interviewed about their duty change and practical exercise of governance, in hope to investigate behavioral and consequential influences the new system has caused, and collect feedback and evaluation from local government. This research comes to the following conclusions: (1) Elected representation has its advantages in terms of administrative leadership, flexibility, and ability to react to public opinions. (2) Official appointment has a more professional and rigidly-regulated manner in administration. (3) Liouguei, when under elected representation, is found to lack in finance and administrative discipline, which leads to ineffective policy implementation. (4) Liouguei, when under official appointment, is found to have insufficient governance power so that it is not able to fully control local circumstances. (5) To meet the needs of peripheral areas, current regional governance system indeed has space for improvement. It is suggested to re-evaluate the clarification and adjustment of regional governance on a short, medium, and long term basis. ▼ Article 14 of the Constitution of the Republic of China provides that people have the freedom of assembly and association. It is also the fundamental human right. Although the Assembly and Parade Act was promulgated in 1988 and has been amended twice, its constitutionality has been challenged continuously. After the Council of Grand Justices made the interpretation of Shih-Zih No. 445, the legal system of assembly and parade still has not been changed and exercising assembly right still represent the practice of democracy and national sovereignty, which mainly protects the right of disadvantaged groups to express opinion and political ideas. In the multicultural and democratic society, if exercising the right positively can be highly valued, it will enhance the social harmony significantly. The respect towards exercising the freedom of assembly and the well addressing of it have become an important index to inspect a legal and democratic state. Article 35 of the Constitution of PRC provides that the people of the People's Republic of China shall have the freedom of speech, publication, assembly, association, parade and demonstration. Since the opening up and reformation of China, the social structure faced a huge transformation and the appeals of people tended to be more various, which provoked more riots and affected the stability of social economy and politics. Adopting a prevention mechanism for the collective power has become an issue for China. Following the rapid economic growth in cross-straits, Taiwan has also involved in the legal field of assembly and parade. Some enterprises have transferred asset and investment to China. Therefore, unemployed people will protest on the street and the social structure has also changed. Both of the governments in Taiwan and China need to established a mechanism and a well-structured system of administrative remedy and supervision to tackle demonstrations for a better harmonized society. Based on the 5 major frameworks of administration law, including administrative principles, administrative organization, administrative authority, administrative remedy and administrative supervision, this study aims at examining the legal system of assembly and parade in cross-straits to redress deficiency with researching by reference, historical analysis, comparative analysis and induction analysis in different aspects. Through the study, a lot of problems have been found, including the deficiency and vague definition of related law, unclear discretion standard, the need for shifting the system from permit to pre-notice, overbroad scale of restricted area, excessive harshness of criminal penalty, inadequacy of related mechanism and the systems of remedy and supers ion, political intervention and absurdity of the law. ▼ One slight mistake or misuse of police firearms could infringe humanâs right; thus, when it comes to the controlling of police firearms, legal state will usually adhere to the principles of legal reservation strictly. Police officers need to deal with all sorts of various and strange situation in the society. However, the legal provisions can not regulate and list all kinds of police firearms, which will bring doubts to police officers if it is necessary for them to use firearms and news related to the misuse of firearms has been heard all the time. Since the controlling of police firearms is part of national administration, the purpose of using police firearms and protecting the right of human should be considered with the same aspect and extent under this democratic and legal state. Furthermore, stipulating a comprehensive act for controlling and managing the police firearms should not be limited with the interpretation of the law, but should be established with suitable rules for Taiwan to control and manage police firearms in terms of different aspects and comprehensive considerations. Based on the 5 major frameworks of administration law, including the principles, organization, authority, remedy and supervision, this study aims at examining the legal system of national controlling of police firearms, in terms of legal and practice aspect, to clarify the problems that using police firearms might bring with researching by reference, historical analysis, comparative analysis and induction analysis. Through the study, a âlegal system of controlling and managing the national police firearmsâ should be set up comprehensively, so that the suggestions of adjusting the deficiency of current law can be made. The current legal system of controlling and managing the national police firearms forms a basic shape; however, by this study, the deficiency of it has been found, such as the unspecific timing of firing, the scarcity of authority for assessing the liability of using firearms, the insufficiency of administrative authority system including administrative investigation,, the deficiency of national remedy and state compensation, vacancy of the mechanism of interior self-supervision and so on, which means that the 5 elements , including the principles, organization, authority, remedy and supervision, are left to be redressed. Fortunately, the problems may be corrected by the suggestions below. A, learn to enhance the firearms regulations from imitating how the on-duty police officers in Japan work. B, the National Police Agency of Ministry of the Interior can establish an authority to assess the liability of using firearms. It allows local governments to establish âcommittee of compulsory school attendanceâ to manage the dropouts from elementary and junior high schools, targeting âzero dropout.â However, the good faith of the regulations can not be implemented well for every citizen in terms of âthe right and duty to receive education,â especially for the students who drop out of school. It is affected by complicated factors, such as personal value, society, economy, peers, indigenous people and new immigrants. Dropping out has concerned the field of education the most, and it has also brought related problems to the society and public order. Therefore, it is necessary to research and to discuss how to organize an effective legal system of dropout counseling management. Based on the 5 major frameworks of administration law, including administrative principles, administrative organization, administrative authority, administrative remedy and administrative supervision, this study aims at examining the legal system of junior high dropout counseling management to redress the deficiency of current law with researching by reference, historical analysis, comparative analysis and induction analysis in different aspects. Meanwhile, by learning from advanced countries, such as the U.S., Japan and Korea, some specific manners and suggestions, such as establishing dedicated organizations or offices, paying attention to secondary education and reinforcing the function of halfway schools, are expected to be provided for the government, schools, private organizations and future researchers. Through the above-mentioned manners, the situation of dropouts can be redressed and corrected. Moreover, the spirit of the Constitution, namely, the right and duty to receive national education for all citizens, can be fulfilled.
