▼ El presente trabajo realiza un análisis sobre los diferentes fundamentos que ante la falta de regulación legal, nuestra jurisprudencia ha invocado para atribuirle efectos retroactivos –ex tunc- o efectos a futuro –ex nunc- a las sentencias de nulidad de los actos administrativos, los cuales van desde la asimilación de éste con el acto jurídico civil, hasta la pretendida identidad del acto administrativo general con la ley, todo enmarcado dentro de lo que se ha entendido por situaciones jurídicas consolidadas.
Este estudio demuestra que la retroactividad o no retroactividad, no es una condición necesaria o automática de las sentencias de nulidad de los actos administrativos, porque tal idea anula reflexiones importantes que tienen que ver con la ponderación de principios básicos como la garantía de eficacia de los derechos fundamentales, la seguridad jurídica, la justicia material, la confianza legítima y la igualdad.
Se impone así entender que los efectos temporales de las sentencias no se derivan de alguna formalidad del proceso, ni de la naturaleza del acto administrativo, ni del tipo de sentencia; estos son más bien una de las herramientas para que el juez a través de la modulación en cada caso, pueda darle eficacia a su sentencia y cumplir con las obligaciones que le impone la Constitución y la ley, que no son otras que garantizar la protección de derechos fundamentales y preservar el orden jurídico.
This paper analyzes the arguments that in the absence of legal regulation, our case law has invoked to assign retroactive effects – ex tunc or future effects – ex nunc – to the sentences of annulment of administrative acts, ranging from assimilation of the latter with civil legal acts to the alleged identity of the general administrative act with the law, all framed within what has been understood by consolidated legal situations.
This study demonstrates that retroactive or non-retroactive activity is not a necessary and automatic condition of the sentence of annulment of the administrative act because this idea cancels important reflections that deal with weighting basic principles such as the guarantee of efficiency, legal certainty, substantive justice, legitimate expectations and equality.
In order to understand that the temporary effects of sentences do not derive from any formality of the process or of the administrative act nature or the type of sentence; these are rather one of the tools so the judge can- through modulation in each case- give efficiency to its sentence and meet the obligations that are imposed by the constitution and the law which has its only purpose in guaranteeing the protection of fundamental rights and preserving the legal order.

▼ ENGLISH ABSTRACT: In the field of
administrative law, the judiciary has traditionally exercised control over the
administrative actions of the executive through judicial review. However, judicial review is neither the most effective nor the most efficient primary control mechanism for systemic
administrative improvement. In a country faced with a task of =transformative constitutionalism‘, and hindered with scarce resources, there is good cause to limit judicial intervention as the first response to
administrative disputes. The major theme of this thesis is to investigate the feasibility of
administrative tribunal reform in South Africa, using two other commonwealth countries, Australia and England, as a basis for comparison.
Australia and England have been chosen for comparison because they share similar
administrative law traditions and they can provide working models of coherent tribunal structures. The Australian tribunal system is well-established and consists of tribunals which fall under the control of the executive, while tribunals in England have recently undergone a significant transformation, and are now part of the independent judiciary.
The South African government currently spends, indeed wastes, a significant amount of money on
administrative law litigation. Due to the limitations of judicial review, even after the high costs of litigation and the long duration of court proceedings, the results achieved may still be unsatisfactory. Furthermore, judicial review is unsuited to giving effect to systemic
administrative change and the improvement of initial decision-making.
Australia and England have begun to move away from the traditional court model for the resolution of
administrative disputes. Both have indicated a preference for the important role of tribunals in the administration of disputes. Tribunals have been shown to offer the advantage of being speedier, cheaper, more efficient, more participatory and more accessible than traditional courts, which contributes to tribunals being a more available resource for lay people or people without sophisticated legal knowledge, and provides wider access to remedies than courts.
The English and Australian models indicate a few important trends which need to be applied universally to ensure a sustained tribunal reform and a system which provides a higher level of
administrative redress than the over-burdened and institutionally inept courts currently do. These include co-operation among government departments and tribunals; open and accountable systemic change; the need for supervision and evaluation of the whole of
administrative law by an independent and competent body; and ultimately a focus on the needs of users of state services.
At the same time, there are arguments against
administrative tribunal reform. These include the costs of reform; the ways to establish tribunals; and the level of independence shown by the tribunals. These arguments are especially relevant in the South African context, where the government faces huge social problems and a…

▼ Since the incorporation of the separation of powers doctrine into the South African Constitution, the problem has arisen that, each of the three tiers of government, the Executive, the Judiciary and the Legislature, has sought to protect exclusive jurisdiction over matters that fall within what constitutes that tier's own realm of authority. The effects of this are especially apparent in the field of dispute resolution in
administrative law. The administration is predominantly the province of the Executive, and to a lesser extent, the Legislature. Thus, the acceptability of judicial review in dispute resolution and generally, the intrusion by the Judiciary in matters of the administration is perennially questioned and challenged by both the Executive and the Legislature. In this context, the duty to exhaust internal remedies assumes a pivotal role. It offers a compromise, by prescribing qualified exclusion of judicial review as a first port of call for dispute resolution while simultaneously entrusting initial dispute resolution to the administration. Often, this approach yields tangible results, but from a constitutional and fundamental rights perspective, the duty to exhaust internal
remedies is problematic. Its exclusion of judicial review goes against, not only the right of access to court in section 34 of the Constitution, but also the rule of law, to the extent that the rule of law allows for the challenging, in court, of illegal
administrative action as soon as it is taken. This thesis analyses the constitutionality of the duty to
exhaust internal remedies in section 7(2) of the Promotion of
Administrative Justice Act by assessing the consistency of section 7(2) of the Promotion of
Administrative Justice Act with the right of access to court in section 34 of the Constitution. The thesis initially examines the origins and historical development of the duty to exhaust internal remedies in the English law, and the subsequent adoption of the duty to exhaust internal remedies into the South African common law for the purpose of interpreting and comprehending the duty to exhaust internal remedies as it is appears in section 7(2) of the Promotion of
Administrative Justice Act. Ultimately, the study focuses on and identifies the deficiencies in the current approach to the question of the constitutionality of section 7(2) of the Promotion of
Administrative Justice Act, and offers suggestions on how the law might be developed.

▼ For most of its existence South African
administrative law has been shaped by the doctrine of parliamentary sovereignty – the heart of the constitutional order from 1910 to 1994 – and a racist political system that favoured the white minority at the expense of the black majority. In these circumstances, the rules of
administrative law were of limited use in protecting the individual from exercises of
administrative power that infringed fundamental human rights, often on a grand scale. On 27 April 1994, however, a new political and constitutional order came into existence that swept away the very foundations of the old order: parliamentary sovereignty was replaced by constitutional supremacy and the racial exclusivity of the old order was replaced by a commitment to equality, freedom and dignity in a democratic state. A justiciable Bill of Rights was at centre stage in this new order. That Bill of Rights includes a fundamental right to just
administrative action. It is both the new constitutional order and this rather unusual fundamental right that have changed the nature of South African
administrative law. This thesis examines the effect of the fundamental right to just
administrative action on the law and practice of the judicial review of
administrative action. It does so principally by examining the legal position before and after 27 April 1994 with particular reference to: what is meant by
administrative action; the exercise of
administrative power by private bodies regulated by the rules of
administrative law, on the one hand, and exercises of private power regulated by rules of private law, on the other; the rules of standing, the notion of justiciability and the constitutionality of rules that seek to limit the right of the individual to approach a court to review
administrative action; the meaning and scope of the right to lawful, reasonable and procedurally fair
administrative action, in terms of the common law, the Constitution and the Promotion of
Administrative Justice Act 3 of 2000; the meaning, scope and efficacy of the rights to reasons for
administrative actions and of access to information; the procedure of judicial review and remedies that may be granted for the infringement of a person’s right to just
administrative action; and conclusions and recommendations with regard to progress made in the construction of South Africa’s new, democratically based,
administrative law.

▼ ENGLISH ABSTRACT: South African administrative law has undergone drastic changes since the inception of
the interim Constitution, which elevated 'administrative justice' to a constitutionally
entrenched fundamental right in section 24. Although the successor of this section, the
'must administrative action' clause in section 33 FC, did not enter into force on 5
February 1996 with the rest of the Constitution, it required more changes to
administrative law in the form of legislation, when read together with item 23 Schedule 6
FC. The two most significant factors that brought about change were the passage of the
Promotion of Administrative Justice Act 3 of 2000 in terms of section 33 FC read with
item 23 Schedule 6, and the ruling of the Constitutional Court in the Pharmaceutical
Manufacturers case.
This study shows that in order to give effect to the requirements of the Constitution, the
Promotion of Administrative Justice Act and the ruling of the Constitutional Court,
administrative law must be reorganised. When this happens, section 33 FC, which gives
force to the common law that informs administrative law, becomes the starting point in
administrative law matters. Although the Act exists under the Constitution and parallel to
the common law, Parliament foresees that the Act and the common law will in time
become one system of law. It further provides for the direct application of the
Constitution by those who cannot find a remedy in the Act.
The study further shows that, as not all the common law constitutional principles that
previously provided the common law grounds for review of administrative action have
been taken up by the Constitution, the possibility exists that some of the common law
grounds do not continue to be relevant to the review of administrative action. The Act,
which articulates the right to 'just administrative action' as viewed by government,
contains most of the common law grounds for review. It is therefore argued that, after
the Act has entered into force, the continued relevance of those that have been omitted
from the Act, needs to be determined before they can be used through the direct
application of section 33 FC. To test for relevance, the requirements in section 33(1) Fe, 'lawfulness', reasonableness'
and 'procedural fairness', are therefore interpreted in the study in order to determine
which statutory grounds relate to each and which common law grounds have been
omitted from the Act. The conclusion reached is that grounds available for the review of
administrative action consist of the statutory grounds for review together with the omitted
common law grounds that continue to be relevant to the judicial review of administrative
action.

▼ In the twentieth century, a dynamic expansion of its activities and powers has made government a major supplier of information on an enormous range of topics of concern to citizens. Unfortunately, the information which it provides is not always completely reliable: sometimes it is inaccurate, and government is powerless to protect the citizen from the consequences; at others, it proves misleading because government chooses later to disown it. The purpose of this thesis is to analyse the legal remedies available to citizens misled by government information.
The analysis has two principal areas of investigation. First, consideration is given to the means whereby the citizen may be able to hold government bound by information which it has provided to him. Separate treatment is given to the situations in which the misleading information deprives the citizen of a benefit or inflicts on him a loss, and in which it subjects him to the risk of criminal liability. Secondly, consideration is given to the possibility of holding government responsible in damages for the consequences of its information being misleading.
Of central importance in this wide-ranging analysis is the issue of the proper role of the courts. This stems from the fact that complaints about misleading government information frequently involve challenges to government decisions. Thus the majority of attempts by citizens to hold government bound by its information are generated by the making by government itself of a decision inconsistent with that information. Again, attempts to hold government responsible in damages for the consequences of providing misleading information commonly involve an allegation that a particular government decision relating to the provision of that information was negligent. It is emphasized throughout this thesis that the courts should refuse assistance to a citizen whose complaint of misleading government information is directed essentially towards a government decision, where that decision involves a determination of the priority of competing interests and values represented in society. The provision of a remedy in such a case would enable the courts effectively to review the choices embodied in value-laden government decisions, and as such would facilitate an unwarranted extension of their constitutional role.

administrative law was restricted by the doctrine of Parliamentary Sovereignty. Even in that comparatively 'hostile' environment, review for unreasonableness developed as an aspect of judicial review, and was applied as a check on the exercise of
administrative power in certain circumstances. The principle of proportionality as an aspect of review for unreasonableness also developed during this period. With the advent of the new Constitutional dispensation, the framework within which
administrative law in South Africa operates became one governed by Constitutional Supremacy. The Rights to Just
Administrative Action, including a right to reasonable
administrative action, were entrenched in the Constitution. Review for unreasonableness is an important aspect of
administrative law in the present Constitutional dispensation as the mechanism for protecting the Constitutional right to reasonable
administrative action. Proportionality is an important principle underlying the Bill of Rights as a whole, and it is an important aspect of the right to reasonable
administrative action, and of review for unreasonableness. In early 2000, the Promotion of
Administrative Justice Act No. 3 of 2000 ("the PAJA"), was passed by Parliament in fulfillment of the Constitutional requirement to pass legislation to give effect to the constitutional rights to Just
Administrative Action. This thesis examines whether or not review for unreasonableness, and proportionality as an aspect of review for unreasonableness, have been meaningfully incorporated in the PAJA, and if they have not been, what potential remedies there might be. This is done by examining the basis of judicial review both before and under the current constitutional dispensation; defining unreasonableness, and proportionality; examining the content of the right to
administrative action which is "justifiable in relation to the reasons given" in section 24(d) of the Interim Constitution and the right to reasonable
administrative action in terms of section 33(1) of the Final Constitution; examining the application of review for unreasonableness and proportionality by the Courts both before and under the current constitutional dispensation; examining the content of judicial review incorporated in the PAJA and the drafting history of section 6(2) of the PAJA which relates to review for unreasonableness; drawing conclusions regarding whether or not review for unreasonableness and proportionality were meaningfully incorporated in the PAJA; and finally making recommendations with regard to review for unreasonableness and proportionality in light of the provisions of the PAJA.

▼ Le contentieux administratif de la séparation des Eglises et de l’Etat sous la IIIe République est un objet ancien de curiosité doctrinale. Un renouvellement de l’approche traditionnelle était cependant possible. Alors que les études classiques insistent sur l’apport du Conseil d’Etat à la réussite de la Séparation et à la protection des libertés de conscience et des cultes, il est envisageable d’étudier la jurisprudence sous l’angle des interactions entre les institutions républicaines et le contrôle juridictionnel de l’administration. Soumise à cette problématique, l’oeuvre du Conseil d’Etat permet une approche monografique de l’histoire de la juridiction administrative républicaine révélant les influences réciproques entre le juge administratif et les institutions républicaines. Dans le cas du contentieux de la Séparation, la jurisprudence administrative a ainsi joué un rôle décisif dans la mise en oeuvre et l’approfondissement des grands principes de la loi du 9 décembre 1905, contribuant à donner une consistance à la notion juridique de laïcité de l’Etat. Dans le même temps, et spécialement dans le cadre du contentieux de la police des cultes, le contexte politique et juridique de la Séparation a contribué à la construction du recours pour excès de pouvoir républicain. Cet apport s’est manisfesté par la modernisation des techniques de contrôle juridictionnel et par un encadrement plus étroit du pouvoir discrétionnaire de l’autorité de police. En abordant ces deux aspects du contentieux de la Séparation, cette étude voudrait éclairer la transformation d’une justice administrative d’inspiration impériale en une justice administrative démocratique et républicaine.
Law scolars are traditionnally interested in the implementation of the separation of church and state by the administrative courts during the Third Republic. However, a renewal of the classic understanding was possible. While classic studies focus on the contribution of the Conseil d’Etat to the success of the Séparation and the protection of freedom of thought and religion, it is conceivable to study administrative case law from the angle of interactions between republican institutions and judicial review of administration. This methodological framework allows to underline mutual influences between the judiciary and republican institutions in the history of the administrative jurisdiction. Thus, as the Séparation is concerned, case law has played a strategic part in the implementation and enrichment of the principles established by the 9 december 1905 Act, therefore contributing to provide substance to the legal concept of laïcité de l’Etat. ▼ En la tramitación de los procedimientos administrativos sancionadores, los funcionarios afrontan dificultades para notificar los actos administrativos, las cuales no solo se limitan a la determinación del domicilio correcto del administrado en el cual se harán llegar los actos, sino además en el hecho de que, una vez determinado dicho domicilio, se presentan supuestos de diligencias de notificación infructuosas, ya sea porque la dirección resulta inexistente o porque el administrado ya no reside en dicho lugar, ello debido a que el domicilio declarado por el administrado ante el Registro Nacional de Identificación y Estado Civil es incorrecto o no se encuentra actualizado, siendo que dicha situación, sumado a una legislación que pretende ser muy garantista, ha llevado a que las entidades de la Administración Pública destinen recursos significativos en la notificación de actos a través de la publicación de edictos.
Usando el método de investigación descriptiva con enfoque cualitativo, en la presente investigación se demostrará que la aplicación del régimen de notificación establecido en la Ley del Procedimiento Administrativo General, Ley N° 27444, viene siendo ineficiente, generando costos innecesarios a la Administración.
Ante dicha situación, se concluye que se deben ejecutar una serie de acciones, que no solo implican la modificación de la citada Ley, y de la Ley Orgánica del Registro Nacional de Identificación y Estado Civil, Ley N° 26497, sino que además implican dotar al procedimiento de expedición del Documento Nacional de Identidad y al procedimiento del cambio del dato domiciliario, del uso del Sistema Georeferenciado para mejorar la confiabilidad de los datos declarados por los ciudadanos, desarrollar una campaña de concientización respecto de la importancia de actualizar el domicilio en el Documento Nacional de Identidad, y optimizar las acciones de fiscalización del RENIEC respecto del cumplimiento de la obligación de actualizar el domicilio.

Considerando, destarte, que o Estado atua não apenas por intermédio de atos administrativos isolados, mas também por via de processos, cada dia mais complexos, demandando um particular debruçar por parte dos analistas, pareceu-nos oportuno o estudo da incidência da teoria das nulidades em sede de processos administrativos. A perspectiva deste estudo, sem abandonar a teoria da invalidez dos atos administrativos, busca o aprofundamento no domínio da ocorrência de fatores que possam conduzir à nulidade e invalidade do processo administrativo tanto geral, como disciplinar perquirindo as condições necessárias para assegurar aos processos trâmites regulares, afastando os vícios e mantendo-os sempre no campo da legalidade. A perspectiva do trabalho, destarte, busca recolocar tema tão polêmico em debate e, sob a lente da investigação científica, apresentar, de modo sistematizado, as doutrinas, as teses desenvolvidas e a jurisprudência construída de modo a assegurar a evolução do tratamento jurídico oferecido ao processo administrativo para o efetivo atingimento de suas finalidades públicas. For the first time, the 1988 Brazilian Federal Constitution expressly provides for the application of the principles of fair hearing and due process of law to administrative procedures, thereby enshrining the tangible presence of the rule of law approach, whose purpose is to frame and limit the activities performed by the Government. Therefore, considering that the Government does not operate only through isolated administrative acts, but also through increasingly complex processes that require particular examination by analysts, it seems fitting to study the application of the theory of nullities in administrative procedures. Although it does not depart from the theory of invalidity of administrative acts, the focus of this study is to inquire into facts that may result in the nullity and invalidity of administrative procedures both of a general and disciplinary nature and establish the necessary conditions to ensure the regular course of procedure, thereby avoiding errors and preserving its legal integrity. In the administrative-legal theory there is no such comparative study of practices in the two neighbouring countries associated with the regime and the implementation of regulatory administrative acts, a fact which motivates me to work on the chosen topic.

▼ Les directives européennes ont toujours été considérées comme un instrument juridique à la disposition des particuliers face à un État membre défaillant. L’invocabilité et l’application des directives sont analysées sous l’unique prisme des droits des justiciables. Contrairement à cette perspective, la présente étude vise à démontrer que la directive devient un moyen juridique d’intervention dans l’ordre juridique interne, dans la mesure où les autorités nationales l’invoquent et l’appliquent dans leurs rapports avec les administrés et les autres autorités nationales ou européennes. L’apparition du droit dérivé a bouleversé la hiérarchie des normes, ainsi que les obligations pesant sur les autorités administratives. Grâce à la primauté du droit de l’Union européenne et à l’impératif d’efficacité dans tous les États membres, la directive est devenue un paramètre de légalité des normes nationales: elle revendique sa place parmi les paramètres traditionnels de légalité, mais parfois elle se trouve en conflit avec eux ou elle se substitue à toute règle nationale contraire. Toutefois, la directive est, entre les mains de l’administration, non seulement une source de droit supranationale à appliquer de manière passive, mais également une norme utilisée pour servir ses propres causes, ainsi que les buts poursuivis par l’Union européenne. En effet, l’évolution de la jurisprudence européenne et administrative a abouti non seulement à un renforcement des obligations de l’administration, mais aussi à l’amplification des formes d’invocabilité au profit de l’administration et à la reconnaissance d’une autonomie du pouvoir réglementaire à l’égard du pouvoir législatif dans le respect des directives. Ces éléments révèlent le rôle particulièrement dynamique de toutes les autorités administratives agissant dans le champ d’application des directives, dans leur transposition, et exécution dans les ordres juridiques nationaux.
European Union directives have always been considered as a legal instrument relied upon by individuals vis-à-vis a defaulting Member State. The right to rely on directives as well as their application are examined under the sole lens of the rights of the litigants. Contrary to this perspective, the present study aims to demonstrate that directives become a legal means of intervention in the domestic legal order, insofar as national authorities rely on and apply them in their relations with citizens and other national or European authorities. The emergence of secondary legislation has disrupted the hierarchy of norms, as well as reshaped the obligations imposed on the administrative authorities. On the basis of the primacy of European Union law and the imperative of efficiency in all Member States, the legality of national rules requires compliance with directives. ▼ This thesis analyses, explores, and evaluates the reasons why particular processes are used to promulgate
Acts of Parliament in New Zealand. The strengths and weakness of these various processes are evaluated and the advantages and disadvantages of this system of promulgation, as a whole, are demonstrated.
Chapter One of this thesis defines the concept of promulgation and demonstrates its significance as a legislative and
administrative process. Chapters Two, Three and Four identify limitations on how promulgation of
Acts of Parliament can occur and evaluate to what extent these limitations shape how promulgation occurs.
Chapters Five, Six, Seven and Eight of this thesis identify justifications for promulgating
Acts of Parliament and evaluate how these justifications have altered over time. These Chapters analyse to what extent the justifications impact on how promulgation occurs.
Chapters Nine, Ten and Eleven analyse the requirements to promulgate
Acts of Parliament in New Zealand. Chapter Nine identifies the current requirements––and the possibility of further requirements— under Statute Law, Common Law, and Constitutional Conventions. Chapter Ten analyses how the statutory requirements to promulgate have developed. Chapter Eleven examines proposed legislative changes to the statutory requirements to promulgate.
Chapter Twelve identifies the current processes that see
Acts of Parliament promulgated. Chapter Thirteen analyses how these processes have changed over time. This Chapter demonstrates that identifiable trends in promulgation are a direct result of changes in the various justifications and limitations identified in Chapters Two to Eight of this thesis.

▼ La régularisation des actes administratifs s’inscrit dans un mouvement global de recherche de stabilité juridique, mettant à l’épreuve la dialectique bien connue de la sécurité juridique et de la légalité administrative. Elle implique en effet que l’acte puisse subsister dans l’ordonnancement juridique, en dépit d’une illégalité originelle. Mais, l’état actuel du droit français de la régularisation des actes administratifs interpelle par le décalage existant entre la présence croissante de ses mentions en droit positif et l’indétermination de son emploi. À l’inverse, le législateur brésilien a consacré depuis vingt ans la régularisation des actes administratifs comme un pouvoir aux mains de l’administration, et fournit l’exemple d’une expérience mature de son utilisation. Le droit comparé se mobilise alors comme un outil de découverte autant que comme un révélateur des perspectives qui pourraient accompagner l’expansion de la régularisation en droit français. À partir de cette démarche, la notion a pu être précisée, désignant un processus de correction à effets rétroactifs, permettant de maintenir l’acte administratif dans l’ordonnancement juridique et de restaurer la légalité. Cette définition contribue à singulariser la notion et à en préciser le champ, permettant d’envisager ensuite ses effets juridiques. À cet égard, la construction d’un régime propre à la régularisation des actes administratifs a pour but d’en clarifier les implications juridiques. Ce régime repose alors sur la recherche d’un équilibre, en ce qu’il doit à la fois permettre de respecter les objectifs poursuivis par la régularisation et de contenir certains de ses effets négatifs, notamment à l’égard des tiers.
The regularisation of administrative acts is part of a global search for legal stability, which calls into question the familiar dialectic between legal certainty and administrative legality. It implies that administrative acts can be retained in the legal system despite their original illegality. Yet the French current legal system is characterised by a striking discrepancy between increasing references to regularisation in positive law, and uncertainty around its usage. On the contrary, regularisation has been embedded in Brazil’s legal architecture for twenty years as a power resting with the administration, which provides us with an example of mature use of this process. In this context, comparative law is both a tool to learn more about regularisation and a means to examine the prospects that could accompany its expansion within the French legal system. This approach allows for a definition of this notion as a corrective process with retroactive effects, enabling administrative acts to be kept in the legal order and legality to be restored. This definition helps to specify the scope of the notion, which then enables us to consider its legal effects. ▼ A presente pesquisa versa sobre a participação da coletividade como instrumento de limitação da discricionariedade nas decisões administrativas em matéria ambiental, sustentando que a participação ativa da coletividade nos processos decisórios teria o condão de reduzir a margem de discricionariedade da decisão administrativa, a qual ganharia em correção, em segurança e em legitimidade, constituindo expressão da democracia direta. Tendo como ponto de partida a classificação do meio ambiente como direito fundamental, verifica-se como são formadas as decisões discricionárias nas questões ambientais em meio à sociedade de risco, concluindo que as peculiaridades do bem ambiental têm o condão de limitar a discricionariedade da Administração Pública. Ademais, para que a participação seja efetiva, verifica-se a necessária mudança de pensamento do indivíduo acerca das formas de utilização e consideração da natureza, sendo a educação o instrumento capaz de transformar o agir humano sob a ótica dos princípios ecológicos, a fim de dar eficácia à cidadania ambiental.
Esta investigación se centra en la participación de la comunidad como una herramienta para limitar la discrecionalidad en las decisiones administrativas relativas al medio ambiente, con el argumento de que la participación activa de la comunidad en la toma de decisiones que tienen el poder de reducir la discrecionalidad de la decisión administrativa, que se beneficiaría de la corrección en seguridad y legitimidad, lo que constituye una expresión de la democracia directa. Tomando como punto de partida la clasificación del medio ambiente como un derecho fundamental, puede ser visto como decisiones discrecionales se hacen en temas ambientales a través de la sociedad del riesgo, concluyendo que las peculiaridades del bien ambiental tiene el poder de limitar la discrecionalidad de la Administración Pública. Por otra parte, para que la participación sea eficaz, es el cambio necesario en el pensamiento acerca de los usos individuales y la consideración de la naturaleza, con la educación es el instrumento capaz de transformar la acción humana desde la perspectiva de los principios ecológicos con el fin de hacer efectiva la ciudadanía ambiental.

▼ "The right to know" is the basic right of the citizens in the democratic countries and information disclosure is an important way to show the governmentâs responsibility for the people. Conforming to the trends, all the countries in the world start to legislate related laws and our country respond by making the Freedom of Government Information Law. However, it seems to remain only a symbol for the negligent mistake of legislating. For example, the Paragraph 1 of Article 18 of the law, which is about the restrictions to open the information, is too abstract. It not only causes the difficulties of the authorities to execute the law, but also infringes the right to know of the people. This kind of law really damages the development of our democracy and legislation. Thus, this research found that the current Freedom of Government Information Law is not suitable for the needs of transparency and openness of our society. It is necessary to re-enact the Freedom of Government Information Law.
The main research method of this study is five major frameworks of
administrative law, which are Basic Principle,
Administrative Organization,
Administrative Authority,
Administrative Remedy and
Administrative Supervision. The study also adopts both literature review and historical induction methods. For the purpose of protecting the right to know of the people, the author reviews the Freedom of Government Information Law and the status of our society, suggesting that the current law can be re-enacted and perfected.

▼ In terms of ârebate,â a series of controversial issues will be referred, such as the distributor, the way to distribute, the standard, the amount of the distribution, the usage of the received debate and the question that whether the management of the debate is in accord with local culture. However, the Government in Taiwan chose to deal with the superficial situation instead of the core problems, so that the problems are left to be tackled drastically. To solve the current controversies and problems, the circumstance and problems of the rebate management should be redressed to find out an appropriate and reasonable manner to operate the debate, so that the purpose for publicâs well-fare and benefit can be made possible.
The five major frameworks of
administrative law, including the basic principle, the
administrative organization,
administrative authority,
administrative remedy and
administrative supervision is adopted as the basic theory in this paper to examine the legal system of rebate management in Kaohsiung City. In order to dressing the core problem of the rebate management of Kaohsiung City and the way to solve it, some research methods, such as reference, comparative analysis and induction analysis are also chosen to analyze the legal system of rebate management in Kaohsiung City with the five major frameworks of
administrative law. Moreover, the US and Japanâs related management will also be referred in this paper to study the legal system of rebate management in Kaohsiung City and the current situation in the society, so that a more specific way to manage and suggestion will be provided in this paper to enhance and perfect the legal system of rebate management in Kaohsiung City.

▼ Este trabalho objetiva realizar uma investigação dogmática dos institutos da revogação e da invalidação incidentes sobre os atos administrativos ampliativos de direitos. Essa tarefa será desenvolvida por meio da análise do regime jurídico administrativo constituído (ou ainda em processo de elaboração), em sintonia com a alteração e agigantamento do contemporâneo Estado Democrático Social de Direito brasileiro. Serão utilizados trabalhos científicos que se dedicam à teoria dos atos administrativos, especialmente os atos classificáveis como ampliativos da esfera de direitos de seus destinatários. Isso posto, o foco do estudo voltar-se-á para os atos administrativos ampliativos de direito, tracejando suas características e pontuando as principais diferenças em relação aos demais atos administrativos, que possam contribuir ou impor a conformação de um regime jurídico disciplinador da sua retirada, seja por força de razões de mérito (revogação), seja de legalidade (invalidação). Em sequência, serão analisados os institutos da revogação e da invalidação, com a fixação de algumas premissas da sua incidência sobre os atos administrativos em análise. Serão examinados os institutos referidos, com ênfase nos atos ampliativos de direitos, ainda que, para fins didáticos, seja apresentado um singelo e geral panorama dessas formas de retirada no sistema jurídico brasileiro. Dessa forma, serão verificadas as peculiaridades do regime jurídico de retirada, por revogação ou invalidação, dos atos administrativos ampliativos, tendo como parâmetro a atualidade da doutrina constituída e ainda marcante em nosso sistema. The objective of this study is to present a dogmatic research concerning the revocation and invalidation of administrative acts that broaden the scope of certain rights, such as, rightsbroadening administrative acts. This is task will be developed by analyzing of the current (or, yet, the ongoing) administrative legal framework in combination with the transformation and enlargement of the Brazilian Social Democratic System. Firstly, we will be used the bibliographical references on the theory of administrative acts in the light of administrative acts considered to widen the scope of rights of receptors. This is followed by an exam of rights-broadening administrative acts proper, establishing their features and pinpointing the main differences that, most likely, contribute to or shape a legal framework that rejects them, sometimes based on reasons of merit (revocation) or on reasons of law (invalidation). After that, we will exam the institutes of revocation and invalidation according to certain propositions governing the effects of both institutes on the said category of administrative acts. Also, revocation and invalidation are examined in more details under the perspective of rights-broadening administrative acts, and, for purposes of clarity, a brief and general overview of the Brazilian Legal System is provided. ▼ Avalik-õiguslike vaidluste lahendamisele keskendunud halduskohtumenetluses võib tühistamiskaebuse (kaebus haldusakti tühistamiseks) ja kohustamiskaebuse (kaebus haldusakti andmiseks või toimingu sooritamiseks kohustamiseks) lahendamist oluliselt mõjutada vaidlustatava haldusakti andmisest või toimingu sooritamisest kuni kohtuotsuse tegemiseni möödunud aeg või selle kestel toimunud sündmused (ajaline faktor). Näiteks võib ametnik, kes on esitanud kaebuse talle määratud distsiplinaarkaristuse tühistamiseks, olla vahepeal avalikust teenistusest vabastatud ja karistuse tühistamine ei pruugi olla talle enam vajalik. Samuti võib isik olla esitanud kohustamiskaebuse talle ehitusloa väljastamiseks, kuid kohtuotsuse tegemise ajaks on kehtestatud planeering, millega soovitud ehitusluba enam kooskõlas pole.
Doktoritöös uuriti, millised on võimalikud olukorrad, kus ajaline faktor võib tühistamis- või kohustamiskaebuse lahendamist mõjutada. Samuti käsitleti seda, milliseid menetlusõiguslikke lahendusi võib selline olukord kaasa tuua, st millal tuleb kaebus rahuldada või rahuldamata jätta või millal peaks kohus sooritama asja lahendamiseks täiendavaid menetlustoiminguid. Eelkõige uuriti neid probleeme Eesti õiguse kontekstis.
Selgus, et Eesti kohtupraktikas on ilmnenud seoses ajalise faktoriga küllaltki palju probleeme (nt haldusakti mõju lõppemine kui selle tühistamist välistav asjaolu, määrav hetk haldusakti või toimingu õiguspärasuse hindamiseks ja muud kohtupraktikas kujundatud seisukohad, mis välistavad muidu põhjendatud kaebuse rahuldamise). Samal ajal ei arvesta Eesti seadused, eeskätt halduskohtumenetluse seadustik, piisaval määral selliste olukordadega. Doktoritöö tulemusena leiti, et vajalik oleks Eesti seaduste täiendamine selliseid olukordi arvestava regulatsiooniga; Proceeding and granting of annulment action and mandatory action may be significantly influenced by time since the contested

administrative measure was taken and until judgment has entered or by events arisen during that time (time factor) in
administrative court procedure which adjudicates disputes arising in public law relationships. For instance, an official who has contested disciplinary penalty, may have been released from office by the time of entering the judgment and annulment of penalty is no more necessary for the person in question. Furthermore, an individual may have submitted a mandatory action for ordering a building permit to be issued but by the time of judgment, a plan which no more is in accordance with the permit required, is adopted.
Possible situations, where time factor can have an impact on the proceeding of annulment – or mandatory action, were studied in the dissertation. Additionally, feasible procedural solutions that may occur in such situation, were disserted, i.e. when should action be granted or dismissed or when should court perform additional proceedings. Primarily such problems were studied in the context of Estonian law.

Uprkos brojnim inostranim studijama koje
omogućavaju značajan uvid u fenomen zlostavljanja na radu malo se
zna o tome kako se doživljavaju negativni postupci koji čine
okosnicu zlostavljanja, posebno u različitim kulturnim i radnim
kontekstima. Koncept zlostavljanja na radu je danas ušao u novu
fazu u kojoj se grade teorijski modeli, u kojoj se zlostavljanje
razgraničava u odnosu na druge srodne koncepate, ali i u kojoj se
preispituje način njegovog merenja. U kontekstu tih tendencija,
ispitivanje načina doživljavanja negativnih postupaka predstavlja
veoma važan korak. Cilj ove studije je bio da se ispita doživljaj
prihvatljivosti negativnh postupaka u radnoj sredini, kao i
doživljaj njihove lične težine i kontrolabilnosti. Takođe, cilj ove
studije bio je i da se ispita uloga koju navedeni aspekti imaju na
odnos između izloženosti negativnim postupcima, sa jedne strane i
radnog ponašanja (namera da se napusti organizacija, percipirana
produktivnost i zadovoljstvo poslom) i zdravstvenog statusa, sa
druge strane. Različiti aspekti doživljavanja negativnih postupaka
analizovani su u kontekstu različitih karakteristika zaposlenih,
posla i radnih organizacija. Uzorak je činilo 329 zaposlenih mahom
iz privatnih i državnih organizacija. Dizajn istraživanja je bio
korelacioni. Za ispitivanje izloženosti negativnim postupcima
korišćen je Revidirani upitnik o negativnim postupcima na radu
(NAQ-R). Doživljavanje negativnih postupaka je takođe bilo
procenjivano korišćenjem NAQ-R koji je posebno bio modifikovan za
sva tri doživljajna aspekta (prihvatljivost, težinu i
kontrolabilnost). Svi indikatori radnog ponašanja osim zadovoljstva
poslom ispitivani su jednoajtemskim merama, dok je zadovoljstvo
poslom ocenjivano preko šest ajtema. Jedan od glavnih nalaza ove
studije je da se svi negativni postupci opažaju kao lično veoma
teški, ali su pojedinci podeljeni u pogledu njihove prihvatljivosti
i kontrolabilnosti. Rezultati ukazuju na to da zaposleni kao lično
najteže, najmanje kontrolabilne i najmanje prihvatljive u radnoj
sredini ocenjuju direktne napade na ličnost i fizički integritet.
Zaposleni su bili podeljeni u pogledu doživljaja prihvatljivosti i
kontrolabilnosti ponašanja kao što su: izolovanje, konstantno
kritikovanje, davanje besmislenih zadataka i preopterećivanja
poslom. Konačno, utvrđeno je da se ponašanja poput obavljanja
poslova ispod nivoa stručnosti, širenje glasina i tračeva, vikanja
i ignorisanja stavova i mišljenja u većem broju radnih sredina
prihvataju, ali da ih većina zaposlenih kontroliše. Žene ocenjuju
negativne postupke kao lično teže i slabije izlaze na kraj sa njima
od muškaraca. Zaposleni iz manjih organizacija (11-50 zaposlenih)
negativne postupke ocenjuju težim i prihvatljivijim u njihovim
organizacijama od zaposlenih iz malih organizacija (do 10
zaposlenih), dok se u odnosu na zaposlene iz većih organizacija
(51-250 zaposlenih i 251 i više zaposlenih) razlike nisu pokazale

▼ De multiples sanctions répondent à la violation du droit de la consommation. Ces sanctions sont perçues comme des outils indispensables au respect de ce droit. Leur prolifération ainsi que leur caractère dérogatoire au droit commun sont pourtant fréquemment dénoncés. Surpénalisation, prime à la mauvaise foi des consommateurs, automaticité, intrusion du juge dans la sphère contractuelle, atteindraient leur légitimité. L’instrumentalisation des sanctions provoquerait leur confusion et leur dénaturation généralisée. La pénalisation des sanctions civiles et la banalisation des sanctions pénales sont particulièrement critiquées. Mais ce double mouvement est-il systématique ? Ce travail entend apporter une réponse plus nuancée. L’abstraction de la protection offerte aux consommateurs exige certains aménagements. Saisir l’essence des sanctions devient alors nécessaire afin identifier celles qui participent d’un dévoiement. Certaines sanctions seront ainsi réhabilitées. D’autres, à l’inverse, seront condamnées. Après avoir mesuré le dévoiement des sanctions du droit de la consommation, une remise en ordre s’est avérée indispensable. Diverses propositions ont ainsi été formulées, dans une quête constante d’équilibre entre efficacité et validité, afin que l’effectivité du droit de la consommation soit elle-même mieux assurée.
Multiple sanctions respond to violations of consumer law. These sanctions are perceived as essential tools for the respect of this right. However, their proliferation and their derogatory nature from ordinary law are frequently denounced. Over-criminalisation, primacy over bad faith on the part of consumers, automaticity, intrusion by the judge into the contractual sphere, would achieve their legitimacy. The instrumentalization of sanctions would lead to their confusion and general distortion. The criminalisation of civil sanctions and the trivialisation of criminal sanctions are particularly criticised. But is this double movement systematic ? This work aims to provide a more nuanced response. Abstracting from the protection offered to consumers requires certain adjustments. Understanding the essence of sanctions then becomes necessary in order to identify those that participate in a misuse. Some sanctions will thus be rehabilitated. Others, on the other hand, will be condemned. After having measured the misuse of consumer law sanctions, it was essential to put them in order. Many proposals were then formulated, so that the effectiveness of consumer law could be better ensured.

▼ Corruption has long been a problem at all levels of society. It not only affects social stability and economic development of countries, but also hinders the effectiveness of democratic governance. Anti-corruption is the core value of modern governance as well as an important indicator to observe democratic countries. Taiwan scored 61 points and was ranked 35th out of 175 countries in 2014 Transparency International Corruption Perceptions Index (CPI). Notwithstanding Taiwanâs progress from 36th in 2013, there is still space for improvement. The survey showed that public sector corruption remains the biggest threat to all countries at any rate.
In Taiwan, although police authority is committed to anti-corruption, the reality is that police corruption cannot be eradicated completely. This study found that legal instruments for anti-corruption in police institutions still have many problems,: there are no clear lines of accountability between Internal Affairs Office and Civil Service Ethic Office, and Public-Private Partnership approaches are not applied to these legal instruments in which, however,
administrative ordinances prevailed. Given the fact that legal system of anti-corruption in police institutions are in conformity with neither "Rule of Law" nor "fairness and justiceâ, it need to be reviewed overall.
Under five major frameworks of
administrative law, namely Basic Principles,
Administrative Organization,
Administrative Authority,
Administrative Remedy and
Administrative Supervision, this study adopts both literature review and historical induction methods. In light of "fairness and justice", the author reviews legal instruments for anti-corruption in Taiwan police institutions and suggests that the current law should be re-enacted and perfected.

▼ Patent is a significant sign of modernizing a country. Protecting patents has been a problem since the Patent Law was conducted in 1949. At initial stage, inventors were unwilling to register patent because that they thought their inventions would not be protected by the Patent system. Until now, there are about 80,000 applications every year. It is clear that the patent system has developed more completely. However, it produced new proplems with us. For instance, the percentage of patent licensing is too law; the examining procedure is too long. Therefore, the patent system still need to be revised.
In this research, the author reviewed the patent law and mechanisms on the basis of the five frameworks of
administrative law, including Basic Principle,
Administrative Organization,
Administrative Competence,
Administrative Remedy and
Administrative Supervision, and literature review. For the purpose of improving Patent system, the researcher suggested that the Patent system should be revised.

▼ Every country has its own elements of prosecution, history, social backgrounds and culture. The differences of the elements therefore create the discrepancies of the design of prosecutorial system, status, and competencies. The prosecutorial is a rather essential part of the criminal justice as well as an important tool for preventing crimination and protecting property and safety of the people while executing the
administrative power. Thus, the prosecutorial system not only involves maintaining the rationality of the justice and protecting the nationâs and peopleâs interests, it also involves balancing the power of jurisdiction and implementing national policies. That confirms, the implementation and evolution of the prosecutorial system truly connect to the welfare of a nation and its people.
The types and cases of legal affairs across the Taiwan Straits had been largely increased shortly after the ROC government enforced the lifting of martial law on 16 July, 1987. Hence, the research investigates and analyzes the planning of the legality of the judicial authorities across the straits by conducting the comparative study of the prosecutorial systems and studying the interactions of the prosecutorial organizations. Specifically, this research will analyze the prosecutorial system from a more comprehensive perspective by applying five elements in the
administrative law, including the principles of the prosecutorial systems, the establishment of related organizations, the use of the
administrative authorities, the
administrative remedies, and the
administrative supervision. Its purpose aims to deduce the possibilities of the development of the Cross-Strait relationships in the future. If the prosecutorial system goes well, it will practically help increase the welfare of the people. Although the differences of the legal systems exist in mainland China and Taiwan, the core principles of prosecuration to prevent crimination and protect people are essentially similar for the people on the two sides. Moreover, the common origins and culture tradition can serve as the foundation for building the mutual trust and increasing interactions for the prosecutorial organizations of the Cross-Strait. When the two sides increase the economic and cultural interactions, the legal problems will come up. The study of cooperation, wisdom-sharing, and reaching-consensus shall come to the crucial point. Based on the current prosecutorial systems and conditions, the research will conclude with the possible suggestions for the decision-makers who may consider to work out the welfare for the people of the Cross-Strait.

▼ Drawing on insights from sociolinguistics, the thesis investigates the relationship between speech patterns and social context in three ancient Greek narratives: the Acts of the Apostles, Acts of John, and Acts of Philip. The thesis explores how characters’ speech patterns correlate with their Christian status, and with the Christian status of their addressees. The relationship between speech patterns and gentile/Jewish identity is also assessed. Linguistic variables include plural forms of address and third-person references to Jesus and the Christian god. The thesis shows that Christian characters are portrayed as speaking differently amongst themselves than when addressing non-Christian characters. It also demonstrates that parameters of sociolinguistic variation in each text point to differing understandings of Christian identity. It is argued that attention to sociolinguistic relationships highlights the importance of ascetic practices and baptism in the Acts of Philip, the gradual nature of Christian conversion in the Acts of John, and the close relationship between Jewish and Christian identity in the Acts of the Apostles. The thesis also examines characterization and implied audience, and argues that attention to social context is necessary to appreciate the full significance of an author’s choice of words.

▼ This thesis contributes to the comparative
study of ancient novelistic literature by examining the
characterization of the primary rival lover figure in Chariton’s
Callirhoe and the
Acts of
Andrew, two Greek novels dated to the first through
third centuries CE. In Chariton’s
Callirhoe,
this rival lover is Dionysius, whose love for and marriage to the
novel’s female protagonist – Callirhoe – temporarily prevents her
from being reunited to her first husband and lover, Chaereas. In
the
Acts of Andrew, the central rival lover is
the pagan husband Aegeates, who is a “rival” insofar as he is an
enemy to the apostle Andrew (the story’s protagonist) and his
wife’s unwanted lover. <span>This study
explores features of Dionysius’ and Aegeates’ characterization that
lead readers to empathize or sympathize with them. </span>In
my analysis of empathy, I adopt the recent cognitive approach to
narrative immersion, which refers to the reader’s mental state of
being absorbed in the narrative world such that she may experience
it as if it were the actual world. In my analysis of sympathy, I
examine instances of mediated sympathy (i.e., sympathetic in-frame
reactions towards the rival) alongside passages that portray the
rival’s suffering as
not primarily caused by
his own culpable actions. This thesis advances
comparative scholarship on the ancient novels by demonstrating that
similarities between the Greek novels and Apocryphal
Acts are not
limited to motifs and themes, but extend to narrative strategy.
This study also contributes to a recent trend within scholarship
that reassesses the literary quality of these texts. By showing the
complexity of Dionysius’ and Aegeates’ characterization, this study
challenges the established scholarly view that ancient novelistic
characters lack any kind of depth. Furthermore, this study
demonstrates the usefulness of the distinction between “sympathy”
and “empathy” in reader-response approaches to the ancient novels
and Christian Apocryphal
Acts.
