This study seeks to explain and understand the Nuclear Non-Proliferation Treaty (NPT) newlinein world politics. The Treaty was signed in 1961 and entered into force in 1970. Since newlinethen, the NPT evolved into the global non-proliferation regime consisting of about 190 newlinemember-states by the beginning of this century. The Treaty set three objectives: (1) newlinenuclear non-proliferation, (2) nuclear arms control and disarmament, and (3) civilian newlinenuclear cooperation. newlineOn the one hand, it is widely regarded that the NPT is the most successful case of an newlineintemational security regime, and an indispensable foundation of the nuclear nonproliferation newlineregime and intemational arms control and disarmament efforts. It is difficult newlineto deny the positive role of the NPT to stop (reverse or delay) nuclear proliferation, and newlineits contribution to intemational security as a whole. On the other hand, the Treaty has newlinebeen intensively criticized for its discriminative nature and function at the NPT Review newlineConference since the 1970s. Non-Nuclear Weapon States, together with India, criticizes newlinethat five Nuclear-Weapon States especially the US and Russia do not make progress in newlinetheir nuclear arms control and disaHl1ament obligations. Although the 1995 NPT REC newlinesuccessfully decided its indcfinite extension, the NPT-based non-proliferation regime has newlinebeen increasingly facing problems and losing legitimacy and trust to deal with further and newlinenew proliferation challenge today . newline newlineThis study analyzes the NPT to seek answers to the questions about (1) its evolution and newlinedynamics, (2) its role and function, and (3) its meaning and relationship to the newlinefundamental dilemma of order versus justice in world politics. For this purpose, this newlineresearch uses three IR theories (Reaiism, Liberalism, and Grotianl Intemational Society newlinetheory). Based on theoretical and phiiosophical pluralism, comparative theoretical newlineperspectives/approaches shed light on various aspects and meanings of the subject issue.

A questão das armas nucleares continua a figurar como um ponto central das Relações Internacionais Os esforços e ações concretas para o desarmamento, a não-proliferação e o controle das armas nucleares continuam sendo temas que geram tensões recorrentes entre os Estados. No entanto, no Brasil, são poucas as análises de caráter acadêmico acerca destes temas e, no que tange ao posicionamento corrente e prospectivo do Estado brasileiro no Regime de Não-Proliferação de Armas Nucleares, os estudos e análises são ainda mais escassos, ou incipientes. Tendo como objeto de estudo o Tratado sobre a Não-Proliferação de Armas Nucleares (TNP), o Regime dele decorrente e o processo de inserção do Estado brasileiro nesse Regime, a dissertação está estruturada em três eixos: o primeiro contempla o papel das armas nucleares na percepção de segurança dos Estados; o segundo abrange o TNP e o Regime dele decorrente; o terceiro analisa o processo de inserção do Estado brasileiro no Regime em pauta. Assim, em síntese, a pesquisa efetuada contemplou os motivos que levam os Estados à decisão de desenvolver armas nucleares; a gênese do TNP e a evolução da percepção do significado desse Tratado por parte dos Estados; bem como o processo e o grau de inserção do Brasil no Regime de Não-Proliferação de Armas Nucleares. A pesquisa efetuada buscou colocar o presente objeto de estudo no debate mais amplo das Relações Internacionais, tomando como base as abordagens consagradas da disciplina na questão do gerenciamento da segurança dos Estados, isto é, as duas abordagens que constituem o mainstream da disciplina, a perspectiva teórica liberal (e suas variantes neoliberais) e o pensamento realista (e neo-realista). Dessa forma, as conclusões obtidas valeram-se de lentes teóricas distintas, porém necessárias para a compreensão das partes específicas de um conjunto complexo e das conexões causais entre essas partes.

The issue of nuclear weapons continues to appear as a focal point of International Relations. The efforts and concrete actions on disarmament, non-proliferation, and nuclear arms control are still issues that generate recurring tensions between States. However, in Brazil, there is little analysis of an academic nature about these issues and, with respect to current and prospective position of the Brazilian State in the Nuclear Weapons Non-Proliferation Regime, studies and analysis are even more scarce, or incipient. The present dissertation has as its object of study to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT), the Regime arisen from NPT, and the Brazilian State insertion process in this Regime. Therefore our research work is structured in three areas: the first one is about the role of nuclear weapons in States security perception, the second is about NPT and its Regime, the third runs over the insertion of the Brazilian state in this regime. Tous les États sans discrimination ont un droit inaliénable de développer les utilisations de l'énergie nucléaire à des fins civiles, à condition de ne pas détourner ces utilisations pacifiques vers des armes nucléaires. Cependant, il est accordé à cinq pays le droit de posséder ces armes, à savoir les États-Unis, la France, la Russie, la Chine et le Royaume-Uni. Autour de cette position, un vif débat à la fois juridique et éthique a été soulevé. En effet, pour ses opposants, le nucléaire représente un risque durable et non maîtrisable par la science. Les accidents nucléaires majeurs, les déchets radioactifs et le détournement du nucléaire à des fins militaires sont des risques ingérables et d‟une gravité exceptionnelle. En revanche, les défenseurs de cette énergie la présentent comme sûre, voire partie prenante du développement durable. Selon eux, le nucléaire est un moyen fiable de lutter contre le réchauffement climatique et aussi une solution à la pénurie énergétique à laquelle le monde est confronté. En examinant et analysant la fiabilité et la crédibilité de tous les arguments allant à l‟encontre et en faveur de cette industrie, on constate que la licéité et la légitimité du recours à l'énergie nucléaire sont mal fondées. Par conséquent, nous estimons qu‟il est nécessaire de dépasser le nucléaire par la conclusion d'une convention internationale posant l'interdiction progressive mais complète du nucléaire.

All states without discrimination have an inalienable right to develop the uses of nuclear energy for civilian purposes, provided they do not divert these peaceful uses to nuclear weapons. However, five states have been granted the right to possess these weapons, that is : United-States, France, Russia, China and United-Kingdom. Around this position a fierce debate, both legal and ethical, has been raised. Indeed for its opponents nuclear represents a persistent risk that is non controllable by science. Major nuclear accidents, radioactive wastes and the use of nuclear for military purposes are unmanageable risks of exceptionnal serious gravity. On the other hand, the proponents of this energy present it as safe, even as part of sustainable development. According to them, nuclear is a reliable means to fight global warming and is also a solution to the energy shortage the world is facing. When analyzing the reliability and the credibility of all arguments for and against this industry, it can be noticed that the lawfulness and legitimacy of the use of nuclear energy are ill-founded. Therefore, we believe there is a need to go beyond nuclear with the conclusion of an international convention dealing with the progressive but comprehensive nuclear ban.

▼ This study is designed to assess the effectiveness of the Nuclear Non-Proliferation Regime and analyze theories for effectively analyzing countries that are a risk for proliferating nuclear armaments. The initial phase of my research is designed to assess the existing literature and primary theoretical approaches for analyzing nuclear non-proliferation initiatives and potential nuclear proliferators. My main means of analysis will be to examine the national and international actors involved in each case. With this method, I plan to analyze a government at the level of each of its ruling institutions. Each of these institutions will be analyzed in the context of Joseph Cirincione's five drivers and barriers: security, prestige, domestic politics, technology, and economics. This study will then review multiple historical cases of countries and treaties related to the nuclear non-proliferation issue in the context of my method of analysis. In particular, each historical study will discuss major actors and institutions with respect to the five major proliferation concepts, as a means of demonstrating the validity of my method. The primary section of my thesis will be the application of my method to one of the preeminent nuclear proliferation threats today: Iran. After a discussion of the physical status of Iran's nuclear program, I will begin my analysis in terms of my concepts, and will examine the principal actors involved in the Iranian nuclear dispute. These will be the Iran's moderate and conservative factions, as well as the U.S., Israel, the EU-3, and IAEA, and they will be examined in the context of the five drivers and barriers. The final section will be my overall risk analysis for Iran. My preliminary analysis is that regime survival is the most critical issue when it comes to the principal motivations of a state to develop nuclear arms. If this is correct, policy options designed to take advantage of the actors' positions in Iran can be formulated based on the specific conditions that prevail in Iran.

▼ This thesis draws attention to the role of international law and norms in constituting different normative categories of membership in international society. Particular attention is paid to the notion of state crime, which can be seen to underlie the practice of international norm-enforcement and which is in tension with the traditional understanding of sovereignty. This tension is highlighted in contemporary international society, which is increasingly defined by the principles of universality and the rule of law. The politics and potential problems of normative boundary-drawing are viewed in light of the English School theory of International Relations. The theoretical framework allows the identification of certain criteria for assessing the appropriateness of international norm-enforcement in a given case. The research question is concerned with the extent to which such criteria are met in case of the UN Security Council sanctions on Iran, and the implications of this for the future strategy in the Iranian nuclear issue, and also for the non-proliferation regime and international society more generally. The research material consists mainly of speeches held by UN Security Council members and Iran in 2006—2009, which are interpreted hermeneutically, based on the theoretical framework and the background discussion. A key finding is that the punitive approach in the Iranian nuclear issue has not only been unsuccessful in promoting non-proliferation, but it has also intensified the underlying political conflicts and created obstacles for finding a compromise solution. It is argued that a clarification of goals and conflict management approach is needed to deal with the dispute. This, however, requires a paradigm shift on two levels: on the one hand, the US and Iran should overcome enmity in their bilateral relations, and on the other hand, the demands and assumptions behind the UN Security Council and other sanctions should be reconsidered. More specifically, a new approach requires moving away from the analogy of crime and policing to a more symmetrical notion of dispute settlement among states. The Iranian case shows that non-proliferation cannot be achieved only through governance and coercion, especially in cases where the legal process of norm-enforcement disguises an escalating political conflict. La notion d'« armes de destruction massive » (ADM) est insaisissable : au lieu d'avoir pour but de mieux définir un type d'arme, elle agit à l'inverse, en créant une confusion entre l'arme et les conséquences de son emploi. Cette nature inconsistante se poursuit au niveau juridique. En effet, bien que l'expression fasse très tôt son entrée au sein des Nations unies, aucun traité ni organe officiel n'a, jusqu'alors, réussi à en donner une définition probante. À défaut de définition incontestable, et en l'absence d'un critère vérifiable d'identification de ce qu'est une « arme de destruction massive », cette notion s'est avérée préjudiciable. L'écart entre la réalité de la menace existante en matière d'« armes de destruction massive » et la façon dont elle fut perçue, puis gérée par la communauté internationale, c'est-à-dire à la fois par les États de façon individuelle et par les organisations internationales et les traités de façon collective, a conduit à de multiples dérives. Par conséquent, s'agissant là d'une notion plus politique que juridique, il apparaît nécessaire qu'elle soit précisée ou abandonnée

The term « weapons of mass destruction » (WMD) is ambiguous: instead of aiming to clearly define a certain type of weapon, it does the opposite by creating confusion between the weapon itself and the consequences of its use. This confusion is also reflected at in the legal definition. Indeed, even though the term has been used by the United Nations from an early stage, no treaty or official entity has succeeded in providing a clear definition to this day. The lack of a clear definition, and the absence of defined criteria to determine what constitutes a « weapon of mass destruction », has turned out to be damaging. The dichotomy between the existing threat from « weapons of mass destruction » and the way it is perceived and handled by the international community, including individual states, international organisations, as well as collective treaties, has resulted in several instances of inappropriate use. As a consequence, the term has become a political rather than legal notion. A clearer legal definition is needed, or otherwise the term should be abandoned

▼ Best known for being a ‘rollercoaster’ and a ‘marriage of convenience’, various scholars have tried to reflect upon the true nature of Pak-U.S. relationship under this banner. However, no matter how one examines this relationship one thing is certain –– the experience for both countries has been harrowing. After India settled for non-alignment early in the Cold War, Pakistan seized the opportunity and aligned itself with the United States in the East-West struggle and pledged allegiance to fight communism in Asia. But that was not the only motive –– Pakistan secretly hoped that an alliance with the U.S. would provide it security against India with whom Pakistan had an antagonistic relationship over their outstanding territorial dispute of Kashmir. When the U.S. did not rescue Pakistan as it had hoped for during its war with India in 1965 and sanctioned both countries with an arms embargo, Pakistan felt betrayed. From that period onwards, Pakistan’s list of grievances against the U.S. developed into a narrative of betrayal and abandonment fed by several episodes in their relationship during and after the Cold War –– a period in which Pakistan developed and tested its nuclear weapons –– duly exploited by Pakistani leaders as a tool for populist politics. This dissertation provides the first scholarly account of Pakistan’s narrative and tests its merit against the U.S. non-proliferation policy towards Pakistan under five administrations from Ford to Clinton and finds that Pakistan’s narrative of betrayal and abandonment is uneven and misleading with respect to the objectives and successes of U.S. non-proliferation policy. This dissertation uses multi-archival documents to offer a counter-narrative which argues that Pakistan, although a small state, was able to brilliantly maneuver its way through restricted spaces in its relationship with the U.S. in the past five decades to not only acquire a decent conventional capability through U.S. military assistance but also nuclear weapons due to the fickleness of U.S. non-proliferation policy. This research concludes that the compromises made by the U.S. to accommodate Pakistan and its inconsistency in enforcement of non-proliferation laws has implications for the efficacy and success of U.S. non-proliferation policy with prospective proliferants. La fin de la confrontation Est-ouest va apparaître comme un tournant décisif dans la lutte contre la prolifération des armes nucléaires. Alors que le monde se réjouissait de la chute du mur de Berlin, le contexte qui va succéder à cette période est marqué par la poursuite, et même l’aggravation de plusieurs crises graves liées à la prolifération nucléaire en Inde, au Pakistan, en Iran et en Corée du Nord. Ces crises, intervenues alors même que la totalité des armes nucléaires à l’échelle mondiale avait été réduite de plus d’un quart depuis la fin de la guerre froide, ont fait l’objet d’une réaction mitigée de la part de la « communauté internationale ». Ces crises montrent qu’il est indispensable de renforcer le régime de non-prolifération nucléaire en apportant des réponses promptes, crédibles et dynamiques. Alors que des doutes sont apparus sur la capacité du régime classique à décourager ceux qui souhaitent développer des activités nucléaires à des fins autres que pacifiques, la nécessité d’envisager des outils modernes et adaptées au contexte géopolitique en pleine mutations, s’est révélée indispensable. Cela suppose un réaménagement du régime classique de non-prolifération dans la perspective de renforcer la légitimité de la norme de non-prolifération. De surcroît, ces crises montrent qu’il est indispensable de renforcer les mécanismes de mise en œuvre du Traité de non-prolifération nucléaire (TNP). Il s’agira d’assurer l’application universelle des accords de garanties de l’AIEA, qui est une obligation du TNP, ainsi que par l’universalisation du protocole additionnel

The end of the East-West confrontation appeared to be a watershed in the fight against the proliferation of nuclear weapons. While the world was celebrating the fall of the Berlin wall, the context that will succeed this time is marked by the continuity and the aggravation of several serious crises linked to nuclear proliferation in India, Pakistan, Iran and North-Korea. These crises occurred even though all nuclear weapons were globally reduced by more than a quarter since the end of the cold war, have been a mixed reaction from the " International community ". These crises show that it is essential to strengthen the nuclear non-proliferation system by providing prompt, credible and dynamic responses. While doubts have been raised about the ability of the classical regime to discourage those who wish to develop nuclear activities for other than peaceful purposes, the need to consider appropriate modern tools to change rapidly geopolitical context seemed to be essential. This implies a rearrangement of the classic nuclear non-proliferation system with a view to strengthen the legitimacy of the norm of non-proliferation. In addition, these crises show that it is essential to strengthen the mechanisms for implementation of the Treaty on the non-proliferation of nuclear weapons (NPT). The application of an additional protocol, coupled with the implementation of a comprehensive safeguards agreement, is indeed essential to obtain full insurance…

La Conférence du Désarmement en tant que « forum unique de négociation multilatéral sur le désarmement » subit une impasse de plus de 15 ans. Elle demeure sans aucun résultat après la dernière négociation du TICE qui s’est terminé en 1996. C’est la raison pour laquelle, tout d’abord nous essayons d’analyser les cadres de négociation et les contenus des traités dans le domaine du désarmement et de la non-prolifération en présentant en deux titres, pour analyser la formation de la normativité et des accords dans ce domaine. En effet, cette thèse couvre tous les types d’armes et ses traités pour la limitation ou l’interdiction de l’arme de destruction massive, y compris les armes nucléaires, biologiques et chimiques, et conventionnelles. La portée de ces instruments varie aussi à partir de traités comme le TNP jusqu’au soft law comme le programme d’action pour les armes légères et de petit calibre. En ce qui concerne la formation de la normativité, le dernier titre essaye d’analyser aussi l’aspect juridique de la négociation et le mécanisme pour renforcer le respect du traité. Ce sont les éléments essentiels pour la naissance de la normativité primordiale des accords en tant que documents juridiquement contraignants, et leur validité. Nous essayons aussi l’analyse du soft law et de la jurisprudence de la Cour internationale de Justice comme source de normativité dans l’ensemble de normes autour du désarmement et de la non-prolifération. C’est ainsi que cette thèse va essayer l’étude minutieuse des problèmes autour de la formation et de la normativité des accords multilatéraux dans le domaine du désarmement et de la non-prolifération.

The Conference on Disarmament as “the single multilateral forum of negotiation on disarmament” suffers from more than 15 years’ stalemate. Its annual session ends without any result every year after the last negotiation of the CTBT until 1996. That is the reason why this doctoral dissertation tries to analyze the framework of negotiation first of all and then the content of the treaties in the field of disarmament and non-proliferation. It also tries to analyze for the normativity of the various instruments in this field. In fact, this dissertation covers every type of weapons and the treaties for their limitation and prohibition starting for weapons of mass destruction to conventional weapons. The coverage of the instruments also varies from the treaties such as NPT to the soft law like the program of action for small arms and light weapons. As for the formation of the normativity, the last part tries to analyze the legal aspect of the negotiation and the mechanism to strengthen the compliance of the treaty. They are the essential elements for the primordial normativity of the treaties as legally binding documents and their validity. The analysis also covers the soft law and legal cases sentenced by the International Court of Justice as a source of normativity in the holistic approach so as to clarify the norms related to disarmament and non-proliferation. ▼ Energy is the natural power stored in matter which can be potential and kinetic energy. This occurs in nature in various forms such as chemical energy, thermal energy, electromagnetic radiation, gravitational energy, electric energy, elastic energy, nuclear energy, and rest energy. The scientific research relating to nuclear energy has revealed that atoms are the foundation of matter. In 1905 Albert Einstein initiated the quantum revolution utilising the Newtonian mass-energy equivalence concept in order to put his famous equation: E =mc2, where energy is (E). This facilitated the nuclear research which focused on manufacturing the first atomic bomb. In 1945 the USA acquired its first two atomic bombs which were dropped on Nagasaki and Hiroshima, killing 200 000 people; mostly civilians. But nuclear energy research has been redirected by scientists in order to industrialise nuclear technology in order to address growing power needs. This encouraged policy makers to consider the risks posed by utilising nuclear energy for civil purposes. The shift towards peaceful nuclear energy applications has been motivated by the many valuable contributions to humankind which nuclear energy offers - for instance in the fields of energy generation, human health, agriculture and industry. The nature of nuclear energy lends itself to becoming an important component of the world energy and global economic system. Nuclear energy is a viable option for many countries including South Africa, because it offers an economic and clean source of electricity; the primary engine for socio-economic development. South Africa operates the only two nuclear power reactors in Africa, (Koeberg 1 and Koeberg 2) generating 1.8 GWe. South Africa’s energy supply infrastructure consists fundamentally of coal-fired power plants which pose serious threats to the environment. Therefore, it is assumed that the planned 9.6 GW of new nuclear capacity by 2030 will meet the requirements of South Africa’s policy regarding the diversification of available energy resources to secure energy supply, support economic growth, and contribute to environmental management. Consequently, the legal system which governs nuclear energy programme is intended to prohibit the proliferation of nuclear weapons, ensure security and maintain the safe operation of nuclear facilities. The study is about the US policies towards the Indian and the Pakistani nuclear weapons programs in 1945-2001. In addition to the two nuclear weapons programs and the reasons behind them, also US policies towards them and the factors that have contributed to the success of the policies are considered, as well as US goals and interests in South Asia in general. The research method used is this non-experimental case study is critical literature analysis. The research material consists of books, articles, and statements about US non-proliferation policies, the South Asian nuclear weapons programs, and geopolitical and realist theories as well as theories about nuclear weapons. There are several reasons behind the Indian and the Pakistani nuclear weapons programs, of which the most important seem to be threats to security, the Indian aspiration to become a major international player, and domestic politics. The US seems to have been constantly against nuclear proliferation in South Asia, but its non-proliferation policies have not been totally successful. Preventing nuclear proliferation has not always been ensured because it has been secondary to some other goals of the US, most notably to that of opposing the Soviet Union during the Cold War. The US non-proliferation policies have somewhat concentrated on trying to prevent the spread of nuclear material and technologies but it has also tried to affect the reasons for proliferation. However, differing views on the best non-proliferation policies between the US Congress and the President and a lack of support from other states have caused certain ineffectiveness of US policies.

▼ Four years after the US State Department first publicly accused the Russian Federation of violating the Intermediate Nuclear Forces (INF) Treaty, the dispute surrounding the compliance of both parties has largely remained unchanged. Despite numerous indications of interest in withdrawal from the INF Treaty, Russian policymakers have yet to make an effort to do so. Instead, these officials have used the opportunity to express their continued interest in the survival of the INF Treaty, and to condemn the behavior of US military and political elites that the Russians claim has weakened the legitimacy of the treaty. Ultimately, evidence suggests that one can tie Russian retention of the INF Treaty to a desire to maintain strategic parity with the United States while upholding Russia’s reputation as a leader in the field of international arms control. This indicates that the Russians perceive the INF Treaty as both a guarantor of Russian security, and a tool through which to promote their interpretation of the moral and practical principles driving the international arms control regime. Ultimately, evidence suggests that one can tie Russian retention of the INF Treaty to a desire to maintain strategic parity with the United States. At the same time, formally adhering to the ideals of the INF Treaty preserves Russia’s reputation as a responsible participant and leader in the field of international arms control that can credibly advocate for a distinctly Russian interpretation of the nature and goals of arms control to the larger international community. With this in mind, US policymakers can expect their Russian counterparts to push US policymakers to make concessions benefitting Russian security during future INF Treaty negotiations. On the other hand, these experts can expect Russian policymakers to respond to US withdrawal from the INF Treaty in an extremely negative manner that will incorporate political and military actions that destabilize Europe, and undermine NATO unity. The potential risks surrounding US withdrawal from the INF Treaty suggest that US policymakers must make every possible effort to preserve the Treaty. This can be achieved through either wider dissemination of technical information surrounding the Russian violation, or the organization of technological demonstrations for US and Russian experts of systems evoking concern from both parties.
