▼ This Thesis explores The Walt Disney Company’s (Disney) specific influence in the 1998 Copyright Term Extension Act (CTEA) enactment as well as the CTEA’s retrospective and prospective impacts. The benefits and disadvantages of the CTEA are elaborated in significant detail, and are supported by objective research and in-depth interviews of influential artists and industry experts. Research conducted for this Thesis has demonstrated that Disney was the primary lobbying organization for the CTEA Bill, both within the U.S. House of Representative as well as within the U.S. Senate. Through multiple and significant lobbying efforts, Disney directly influenced the CTEA’s enactment. It is also demonstrated that Disney’s lobbying influence as well as the United States’ Congress’ argument that economic benefits would not be achieved if U.S. Copyright Law was not harmonized with the European Union, were the primary contributors to the CTEA’s enactment. Additional research for this Thesis has demonstrated that the enactment of the CTEA in 1998 was necessary in part to rationalize U.S. Copyright Law term length and other protections with those of the European Union and other international countries; however, that this harmonization was not necessarily reciprocal in benefits afforded to the United States. Research has also demonstrated, that the $6.3 Million dollars used by Disney, to lobby for the CTEA’s enactment, was a paltry amount relative to the valuation of Disney’s intellectual property assets at that time, its risk exposure to loss of copyrights, and also when compared to Disney’s overall total gross annual revenues prior to the CTEA’s enactment. In addition, personal interview accounts of retired Disney and Disney Corporation affiliate employees, is conducted to better understand Disney’s non-financial brand contributory influence to the CTEA. It is this non-financial brand value influence originating from Disney’s iconic characters and themed amusements parks, which have become virtually inextricable from any childhood and an irrefutable asset for Disney. Furthermore, research conducted also demonstrates that CTEA proponents’ claims regarding the need for the CTEA to prompt creativity or to protect financial interests of content creators are overreaching and are not applicable to all creative endeavors or creative occupations. Lastly, interview research conducted for this Thesis with notable and established Hollywood entertainers, entertainment attorneys, music composers, publicists and an emerging artist provides evidence that neither awareness of the CTEA nor Copyright Law has had minimal to absolutely no direct influence in their respective creative endeavors, careers, their clients’ careers, or the bequeathment of real or intellectual property to their heirs. The subject matter of the scientific studies comprises a study of key issues of the protection of copyright as well as enforcement of other intellectual property rights. The basic methods of study used in the works are comparative, historical and teleological. The model of legal regulation of the protection of intellectual property rights chosen is the one existing in the states of droit d’ auteur and copyright systems, and based on this model the key issues of copyright protection are analysed by way of comparing and assessing the aspects provided for in the Lithuanian legislation. Lithuania follows the droit d’ auteur system. In general, the Lithuanian copyright law does not reflect any unique tradition. The development of intellectual property rights protection in Lithuania essentially coincided with the accession to international and regional organisations and to international agreements. When Lithuania decisively implemented one of its foreign policy aims — to become a member of the European Union — the approximation of its national law to the European Union legislation commenced in the field of intellectual property law as well as in the whole legal system. L’étude des rapports de la culture des communautés traditionnelles et du droit implique une vision large, mêlant approche comparative et internationale, car les conceptions sont variées et les instruments divers. Au Brésil, pays doté d’une grande diversité culturelle, la nécessité de la protection de la culture populaire est une demande croissante, justifiée et nécessaire. La France, de son côté, présente le double avantage d’être le berceau du droit d’auteur et de connaître, elle aussi, une part de culture traditionnelle. En outre, dès les années 1970, le mouvement international autochtone occupe progressivement une place grandissante dans les débats internationaux.Deux axes émergent alors pour tendre à protéger la culture des communautés traditionnelles. Il ressort d’abord des processus de négociations internationaux la possible utilisation des instruments classiques de protection des droits de propriété intellectuelle. A ensuite émergé, ces dernières années, une tendance à l’élaboration d’une protection spécifique de la culture traditionnelle.Dans cette perspective, l’analyse comparative des systèmes juridiques français et brésilien enrichit la réflexion sur des régimes dont la mise en œuvre effective s’avère particulièrement complexe. Cette thèse invite aussi à s’interroger sur les raisons de ce dysfonctionnement, en livrant une étude portant sur plusieurs instruments normatifs. Le résultat est une analyse à trois focales (internationale, nationale et, dans certains cas, locale) qui vise à mettre en évidence les enjeux majeurs de la régulation de la culture traditionnelle.

The study of the relationship between the culture of traditional communities and law implies having a wide perspective, combining a comparative and an international approach, as the concepts are varied and the instruments diverse. In Brazil, a country with a great cultural diversity, the need for the protection of popular culture is a growing, justified and necessary demand. France, on the other hand, has both the benefit of being the birthplace of copyright and possessing, too, a part of traditional culture. In addition, since the 1970s, the international indigenous movement gradually took a growing place in international debates.Thus, two directions rise attempting to protect the culture of traditional communities. Firstly, the possible use of traditional instruments for the protection of intellectual property rights will result from the international negotiating processes. In addition, in recent years, the tendency of elaborating a specific protection for traditional culture has emerged. In this perspective, the comparative analysis of the French and Brazilian legal systems can allow us to broaden our reflection on regimes whose effective implementation seems to be particularly complex. This thesis prompts us to question the reasons for this dysfunction by providing a study on several normative instruments. Докторска дисертација се бави питањем дозвољености ограничења слободе изражавања у оквиру Савета Европе, Европског суда за људска права, Европске уније, медијског законодавства Републике Србије, домаће судске праксе, подзаконских аката Републичке агенције за електронске медије и мера које спроводи као и у оквиру Кодекса новинара Србије и мера које изриче Савет за штампу као саморегулаторно тело. У првом делу тезе, слобода изражавања се дефинише са историјског становишта, кроз међународне и регионалне организацијеи у оквиру медијског законодавства Републике Србије. Детаљно је објашњена хијерархија извора медијског права у Републици Србији. У другом делу дисертације, предмет истраживања су општа ограничења слободе изражавања, оивичена праксом Европског суда за људска права. Ограничење се сматра дозвољеним када је прописано законом, када постоји оправдан циљ и када је органичење неопходно у демократском друштву. Разматра се и критеријум „поље слободне процене“ који помаже ЕСЉП приликом процене нивоа самосталности државе у оцени оправданости ограничења.

▼ Digitalisation and the internet have enabled ordinary individuals to make copies of copyrighted content easily, costlessly and with no degradation in terms of quality. While digital private copying is permitted in Europe under Article 5(2)(b) of Directive 2001/29/EC, it represents a major challenge to the interests of the copyright owners and a thorny issue in the context of digital copyright. Despite the fact that all EU Member States, with the exception of Ireland and the UK, have incorporated a statutory limitation for acts of private copying in their national statutes, there is legal uncertainty as to the scope of this limitation. To be permitted, the use of copyrighted content ought to be private and non-commercial; these concepts, however, do not translate well in the digital environment. For instance, one can only wonder whether facebook friends qualify as a private circle and whether downloading works for free from file-sharing networks is a non-commercial act. This thesis provides answers to these questions and determines the actual scope of the private copying limitation. Yet, perfectly lawful private uses of copyrighted content may have an aggregate impact on the interests of the rightholders in the digital environment, where these activities are more widespread. To deal with the digital impact of private copying, Directive 2001/29/EC sets forth a twofold approach; while private copying is premised on condition that the rightholders are compensated for the unauthorised uses of their works, at the same time, the application of technological protection measures is rigorously protected. We examine the efficacy of these approaches in dealing with digital private copying and their adequacy for policy reasons. This thesis concludes that, even though private copying is permissible under the set of conditions laid down by Article 5(2)(b) of Directive 2001/29/EC, its legitimate exercise is jeopardised in the digital environment due to the fact that this limitation is not mandatory. This means that the ability of end users to make private copies may be either technologically or contractually restricted. Yet, the private copying limitation is a manifestation of the fundamental right to privacy, which prevails over copyright enforcement. We therefore urge for an explicit declaration of the imperative status of the private copying limitation against technological or contractual constraints.

▼ Dada a vasta oferta de produtos existentes no mercado, o design acaba por assumir grande relevância, sendo frequentemente determinante na escolha do consumidor. Dada a importância da aparência, compreende-se que o produtor opte por investir cada vez mais e que, a par da novidade e da singularidade do aspeto do produto, se acabe por criar verdadeiras obras de arte. Nestes casos em que o design consubstancia uma obra de arte gera-se uma situação de alguma complexidade no que respeita à proteção conferida pelo direito que se vê obrigado a chamar à colação duas áreas diferentes que assentam em lógicas bem distintas: o Direito de Autor e o Direito de Propriedade Industrial. Na verdade, apesar de ambos os direitos serem provenientes da Propriedade Intelectual e pretendam com a proteção por eles conferida a uma determinada criação incentivar e recompensar o criador, não raras as vezes acabam por apresentar soluções contraditórias, deixando na mão do aplicador do Direito uma verdadeira bomba-relógio. Pese ainda que o design frequentemente é criado no âmbito de um contrato de trabalho, e, por esse motivo, uma situação já de si bastante complexa acaba por assumir contornos difíceis de destrinçar. O que nos propomos resolver com este estudo é precisamente o problema que o legislador não logrou responder: o que se deve fazer quando o design é protegido cumulativamente pelo Direito de Autor e pelo Direito de Propriedade Industrial no âmbito de um contrato de trabalho. Vamos então assinalar os pontos em que o Direito de Autor e o Direito de Propriedade Industrial diverge no Direito Português, através da análise do regime de cada um e da sua implicação no contrato de trabalho. Dada a complexidade desta questão quando confrontada com o direito vigente em Portugal, optamos por não fazer um estudo pormenorizado do disposto nos outros ordenamentos jurídicos e do Direito da UE, servindo-nos destes apenas quando o considerarmos necessário para alcançar uma solução. In order to develop this analysis, in Chapter Two, I critically analyse key academic writings on internet regulation and argue that I need to move away from the dominant ‘regulatory’ lens to my Actor-Network Theory-Foucauldian Power Lens (‘ANT-Foucauldian Power Lens’) in order to be able to capture the potentially complex web of power effects generated in YouTube and Facebook when copyright and personal data are protected and/or violated. In Chapter Three, I develop my ANT-Foucauldian Power Lens and explore how key ANT ideas such as translation can be used in conjunction with Foucauldian ideas such as governmentality. I utilise my ANT-Foucauldian Power Lens in Chapters Four to Seven to analyse how YouTube and Facebook are constructed as heterogeneous, contingent and precarious ‘actor-networks’ and I map in detail the complex power effects generated from specific local connections. I argue five key points. Firstly, I suggest that complex, multiple, and contingent power effects are generated when key social, legal, and technological actants are locally, contingently, and precariously ‘fitted together’ in YouTube and Facebook when copyright and personal data are protected and/or violated. Secondly, I argue that ‘materialities’ play key roles in maintaining the power effects generated by specific local connections. Thirdly, I argue that there are close links between power and ‘spatialities’ through my analysis of the Privacy Settings and Tagging in Facebook. Fourthly, I argue that my relational understandings of YouTube and Facebook generate a more comprehensive view of the power effects of specific legal elements such as how specific territorial laws in YouTube gain their authority by virtue of their durable and heterogeneous connections. Finally, I argue that we can extrapolate from my empirical findings to build a small-scale theory about the power effects generated in OSNS when legal values are protected and/or violated. Here I also consider the contributions made by my research to three distinct fields, namely, internet regulation, socio-legal studies, and actor-network theory.

The objective of the thesis is to examine in what extent the legislative framework and the exercise of the related right of phonogram producers in the digital era remains sufficient and effective. In order to provide answers, the content of the related right is examined in the first part. The concepts of the object and the subject of the right are analyzed, concepts that are provided in the Rome Convention and then they were modified by the WPPT Treaty in order to be adjusted in the digital environment. Then, the thesis focuses on the absolute and exclusive rights of the phonogram producers, as well as on their rights to remuneration. The analysis follows the legislative framework regarding the International Conventions and Treaties, the European Directives and the national law 2121/1993, as well as the court cases of the European Court of Justice, the national court cases and the court cases of other Member States. In the second part, the thesis examines the limits of the related right. Firstly, all the exceptions are analyzed regarding the particularities of the related right. Then the thesis approaches critically the exception for the transformative works, which demands its place on the closed catalogue of exceptions. The three-step test is also examined. Furthermore, the thesis focuses on the limitations of the right, such as the term of protection, the equitable remuneration or fair compensation.In the third part, the thesis focuses on the exercise of the rights of phonogram producers, from one hand from the contractual exercise of their rights and from the other hand from the viewpoint if the technology can be at last helpful for the beneficiaries and more specifically for the phonogram producers. In this context, the technological measures and the electronic rights-management information are examined, as well as the imposition of installation of filtering systems to Internet Service Providers.

Αντικείμενο της διαδακτορικής διατριβής αποτελεί το κατά πόσο η νομοθετική πρόβλεψη του συγγενικού δικαιώματος των παραγωγών φωνογραφημάτων και η εφαρμογή του στη σημερινή ψηφιακή εποχή παραμένει ικανοποιητική και αποτελεσματική. Προκειμένου να δοθούν απαντήσεις, αναλύεται το περιεχόμενο του δικαιώματος στο πρώτο μέρος, προσεγγίζοντας τους ορισμούς του αντικειμένου και του υποκειμένου του δικαιώματος, οι οποίοι προβλέφθηκαν νομοθετικά στη Διεθνή Σύμβαση της Ρώμης και έκτοτε τροποποιήθηκαν προκειμένου να προσαρμοσθούν στο ψηφιακό περιβάλλον με τη Συνθήκη WPPT. ▼ Extensive consumer protection legislation has existed in Australia for nearly four decades. The new Australian Consumer Law (‘ACL’) in schedule 2 of the Competition and Consumer Act 2010 (Cth) (‘CCA’)1 is the most significant change to consumer rights since the introduction of the Trade Practices Act 1974 (Cth) (‘TPA’). Over a corresponding period of time, the landscape of the higher education sector has been transformed into a culture of consumerism with the student at the centre as the consumer. However, students have seldom sought redress in relation to infringement of their rights as consumers under consumer protection legislation and more rarely successfully. It is recognised that some rights do accrue to students as consumers of educational services under the ACL, principally with regard to promotional activities of higher education institutions (‘HEI’).2 It is not certain that the ACL can provide effective protection for students as consumers of educational services beyond this known application to address issues regarding the nature of the service provided. This research is specifically concerned with whether the introduction of an Unfair Contract Terms (‘UCT’)3 regime in the ACL overcomes identifiable barriers faced by students using consumer protection as a means to ensure they receive services as promised and advances their rights as consumers.The ACL saw the introduction of an UCT regime, which previously had only existed in limited jurisdictions in Australia, notably Victoria, as a means of protection in consumer contracts. Now any term in a consumer contract that is an unfair term as defined under the ACL is void. The application of these provisions in the context of the student as a consumer of educational services will require first an assessment of whether there exists in Australia a contract between the student and HEI. Further, for the UCT to apply, the student–HEI contract must be a ‘standard form’ ‘consumer contract’4, for ‘services’ occurring in ‘trade or commerce’5. Importantly the analysis will identify any connection between the UCT provisions regarding substantive unfairness and the protection this affords students in the context of the provision of educational services, such as the design and delivery of courses, as distinct from promotional activities.Ordinarily, claims concerned with the nature of the educational service provided are considered matters that involve questions of academic judgement. Courts have been consistent in their reluctance to examine matters relating to the exercise of academic judgement and accordingly such matters are considered non-justiciable. The significance of the UCT provisions is that rather than just focusing on procedural unfairness, they attempt to deal with substantive unfairness.6 In the context of the student–HEI contract and provision of educational services, the UCT provisions have the potential to ensure that the student–HEI contract does not contain terms that are substantively unfair. La condition, la forme et la justification théorique des exceptions sont aujourd’hui au coeur du débat sur l’avenir du droit d’auteur. L’objectif primaire de ces normes particulières est de garantir la cohérence du droit d’auteur. Et pourtant les chercheurs s’accordent sur la nécessité de leur reconceptualisation.Cette thèse a pour but de découvrir la signification, les origines et les conséquences de la crise qu’engendre le ressentiment à l’égard des exceptions aux droits de l’auteur dans leur forme actuelle. Tenant compte d’une certaine fragilité axiologique de la matière, elle essaie d’appréhender les phénomènes étudiés selon une posture épistémologique neutre. À cet égard, la théorie des paradigmes scientifiques lui offre un cadre d’analyse scindé en deux. La reconstruction de l’état normal et voulu des principes élaborés par la tradition française du droit d’auteur en matière des exceptions permet de repérer les signes de leur dépassement par la réalité juridique mouvante.De cette analyse résulte d’abord le modèle d’une exception cohérente, internalisé par le droit d’auteur objectif qui a complètement résolu le conflit entre la création et la consommation des oeuvres de l’esprit. Cette image est ensuite confrontée à des forces destructrices ayant leur origine dans des normes extérieures au droit d’auteur objectif. Celles-ci se substituent aux exceptions prévues par le droit d’auteur et remettent en question l’idée de son autarcie.L’idylle du droit d’auteur autosuffisant n’est toutefois pas une utopie. Entre l’état normal et la maladie des exceptions se noue un lien dialectique. Vus ensemble, ces deux éléments s’éclairent réciproquement, de sorte que la crise qui les résume devient un processus réversible.

The condition,shape and theoretical justification of copyright exceptions are at the heart of the debate on the future of copyright. The main objective of these particular rules is to ensure the consistency of copyright law. Yet, researchers agree on the need of their reconceptualization.This doctoral thesis aims to explore the meaning, origins and consequences of the crisis that brings resentment toward copyright exceptions in their present form. Taking into account a certain axiological fragility of the subject, it tries to apprehend it in the respect of a neutral epistemological posture. Therein, the theory of scientific paradigms offers a framework split in two. The reconstruction of the normal and wanted state of the principles developed by the French tradition of copyright in the field of exceptions allows to identify the signs of their violation by the changing legal reality.This analysis reveals, on the one hand, the model of a consistent exception, internalized by the copyright law which completely resolved the conflict between creation and consumption of works of the mind. On the other hand, this image is faced with the destructive forces that originate in the norms that are external to copyright law. These replace the copyright exceptions and, therefore, question the idea of its autarchy.The idyll…

▼ The Internet is long-acclaimed to provide a medium for easy sharing of ideas and collaboration, and has huge potential for academic and training organisations to share learning resources. However, there are no formal mechanisms for managing intellectual property (IP) and there remain today tensions between freedom to share and ownership of creativity. Theories around land property rights have contributed to the rights of IP as we know them today. Creating digital IP, however, is not a physical labour like toiling the land. It does not preclude the owner from retaining a copy and copying the IP does not make the IP more scarce, or competitive to possess. Management of IP rights is about finding a balance between over zealous enforcement and 'free' use of IP. Protection of IP can be achieved by law and technology, and a mechanism for managing the use of digital learning objects would require a digital rights management (DRM) framework. Architecture of XML (eXtended Markup Language) Web Services is emerging as a standardised approach to dynamic component connectivity and interoperability that relies on self-describing components and open connectivity standards and emerging standards, including IP (Internet Protocol), SOAP (Simple Object Access Protocol), WSDL (Web Services Description Language) and UDDI (Universal Description, Discovery and Integration). XML Web Services technologies have great potential as the underlying technology for the establishment of a DRM framework for learning objects (LOs) on the Internet. An initial survey, with endorsement of findings by experts in Information and Communication Technologies (ICT) in education, identifies the components of an online contract that would license an educator to use LOs. A framework is proposed and a prototype of an intellectual property electronic management system (IPeMS) is designed and developed. Web Services operations authenticate teachers and enable the teachers to search for LOs. The teachers can view permissions and constraints of use of the LOs, and can create a contract, with or without payment as the conditions dictate, that, on agreeing to, will license the teachers to use one or more learning objects. Another evaluation survey completes the research study, giving feedback about IPeMS, with respect to its application to an educational environment, to license an educator to use digital LOs.

▼ This thesis presents a framework for understanding the historical basis of copyright in the United States and the impact that recent events have had upon the public domain and fair use. The necessity of technical communicators as writers and educators becoming educated on copyright so that they can knowledgeably navigate copyright laws and emerging issues is the central argument of this thesis. Â Â Federal laws and international treaties have caused significant changes. The latest extension of the term of copyright under the Sonny Bono Copyright Act of 1998 has increased the length of copyright for another two decades, benefiting the copyright holder and trade interests, but causing a delay in the arrival of these works within the public domain. It's the public that reaps the benefits of these works when they enter the public domain since they may then freely use these works for knowledge or new creations. This is part of the historical balance of copyright where the creator benefits for a limited time and then the public gains access for its own benefit. Due to changes to copyright laws, this balance has changed, with critics of these changes arguing that the public benefit has been lessened. International treaties also have depleted the public domain since foreign works with an expired American copyright still receive copyright protection if their foreign copyright remains in effect. The eroding public domain also affects the ability of technical communicators and others to access important information for a number of uses.Â Â The passage of the Digital Millennium Copyright Act in 1998, which makes it illegal to circumvent technological controls that prevent unauthorized access to digital content, has made it more difficult for technical communicators as writers or educators to view this protected content. This lack of access may prevent them from finding the latest information, necessary for the production of a technical document. It also hampers the practice of fair use, which has historically occurred without permission, and allows for the partial and limited use of material. That use of material could include writing reviews or expressing opinions, including criticism. In the classroom, it could include using portions of the content to educate students. By preventing access, these technological controls create walls between information and knowledge and the public. Ultimately, this denial of access affects free speech since there can be no comments or criticism made about information that cannot be viewed.Â Â This thesis draws upon the research and writings of academics and lawyers who are concerned about these copyright changes and their impact on society. It argues that there is a need to educate technical communicators about these issues so that they may navigate copyright without infringement and be aware of their rights to use information in the public domain or through fair use.Â Â Advisors/Committee Members: Eble, Michelle F. L’évolution d’une économie industrielle vers une économie de la connaissance et du savoir a propulsé la propriété intellectuelle sur le devant de la scène. Désormais les droits intellectuels s’intègrent à tous les domaines de la vie moderne. De ce fait, le besoin de les protéger efficacement par des règles juridiques appropriées et d’inciter en conséquence les créateurs à produire de nouvelles créations est devenu une nécessité de premier ordre. Cependant, la spécificité de la nature de l’œuvre protégée par la propriété intellectuelle exige la prise en considération de multiples intérêts antagonistes. C’est pourquoi le législateur a cherché, au nom de l’intérêt général, à créer un juste équilibre interne entre les principaux intérêts présents au sein du régime de la propriété intellectuelle. Or, l’exercice des prérogatives octroyées par le régime de propriété intellectuelle effectué par le titulaire de droit a généré une importante expansion de ses intérêts au détriment des autres intérêts concurrents – présents dans la matière. Cette situation a provoqué, en conséquence, une rupture de l’équilibre interne de ce système, préétabli en amont par le législateur. Or, l’intérêt général peut jouer un rôle central dans le rétablissement d’un équilibre en la matière. Dans cette perspective, le juge peut, grâce à son pouvoir créateur de règles jurisprudentielles, se servir de l’intérêt général comme d’une ligne directrice servant à rétablir ce juste équilibre dans le système de la propriété intellectuelle. The evolution of the industrial economy towards the economy of knowledge has propelled intellectual property to the forefront. Intellectual property has become integrated in all the domains of the modern life. As a result, it has become a necessity to protect it effectively through appropriate legal rules that encourage creators to continue to provide new creations. However, the specificity of the nature of the work protected by intellectual property requires the consideration of multiple conflicting interests. As such, the legislator has sought, in the name of the general interest, to create a fair internal balance between the main interests present within the system of intellectual property rights. Nevertheless, the exercise of the prerogatives granted by the intellectual property system, carried out by the owner of intellectual property, has caused an important expansion of the interests of this owner, to the detriment of other concurrent interests. This has consequently caused a break in the internal balance of the system, instigated by the legislator. Nonetheless, the general interest can play a key role in restoring balance through the application of external rules to the intellectual property regime. Second, this thesis explores whether the maximum duration of fixed-term agreements should be limited by statute. Various aspects affecting parties to these agreements, for instance the freedom to contract, pacta servanda sunt, and standard-form agreements, are considered. The South African position is then compared to the position in Singapore under the Consumer Protection (Fair Trading) Act, and to the United Kingdom under the Consumer Rights Act, to gain perspective and objectively evaluate the provisions of section 14 of the Consumer Protection Act 68 of 2008 to establish whether South Africa can benefit from lessons learnt from these jurisdictions. Finally, principle-based amendments to the provisions of the CPA are recommended to improve the position of the consumer under fixed-term agreements to effect best practice solutions and ensure adherence to the aims and purposes of the Consumer Protection Act 68 of 2008 and international guidelines. This thesis is based on the law as at 18 June 2020, found in sources available in South Africa, and Singaporean law available in the database of the National University of Singapore.; Hierdie proefskrif is ’n kritiese analise van die posisie van partye tot vastetermynkontrakte ingevolge artikel 14 van die Suid-Afrikaanse verbruikersbeskermingswetgewing, die Consumer Protection Act 68 van 2008 (CPA). Die doel van die analise is eerstens om vas te stel of partye tot ’n vastetermynkontrak ingevolge artikel 14 van die CPA beter beskerming geniet ingevolge die CPA wanneer die verbruiker die vastetermynkontrak moet beëindig weens die wesenlike wanprestasie deur die verskaffer, as ingevolge die gemenereg. Tweedens ondersoek die proefskrif of dit wenslik is dat die maksimum duur van vastetermynkontrakte deur wetgewing beperk word. Verskeie aspekte wat die posisie van partye tot vastetermynkontrakte beïnvloed word ondersoek, onder andere kontrakteervryheid, die leerstuk pacta servanda sunt en standaardkontrakte. Die Suid-Afrikaanse posisie word dan vergelyk met dié in Singapoer, ingevolge die Consumer Protection (Fair Trading) Act (CPFTA), en die Verenigde Koninkryk, ingevolge die Consumer Rights Act (CRA) om perspektief te kry op die studie, en ten einde die bepalings van artikel 14 objektief te oorweeg om vas te stel of Suid-Afrika kan kersopsteek by hierdie jurisdiksies. La condition juridique de l'artiste-interprète se caractérise par une imbrication étroite du droit du travail et du droit de la propriété intellectuelle. Chaque source de droits appréhende des temps différents de l'activité de l'artiste-interprète. Le droit du travail s'intéresse à l'artiste-interprète en tant que travailleur. Le modèle du salariat s'impose largement puisque le législateur a instauré une présomption de salariat. Le droit de la propriété littéraire et artistique s'intéresse au résultat du processus de création sur lequel les artistes-interprètes bénéficient de droits voisins du droit d'auteur. L'artiste-interprète se trouve donc au cœur d'une articulation délicate entre la liberté d'expression inhérente à son activité et la subordination juridique qui caractérise la relation de travail salariée. En réalité, le droit du travail n'ignore pas la nature particulière de l'activité de l'artiste-interprète. D'une part, l'artiste-salarié est largement soustrait aux conditions traditionnelles de la subordination juridique, d'autre part, un espace est laissé aux artistes qui souhaitent exercer en qualité d'indépendant. Malgré l'existence d'une double protection juridique, l'artiste-interprète demeure un sujet de droit fragile. Il fait souvent figure de travailleur précaire avec la généralisation de formes d'emploi flexibles et son droit voisin fait figure de « parent pauvre». L'artiste-interprète est d'autant fragilisé que son droit fait l'objet de contestations dans le cadre de l'Internet. Le rapport de force avec les acteurs de l'économie numérique est inégal et les revendications du public sont fortes. Il s'ensuit le besoin de définir un cadre plus équitable.

The legal position of the performer consists in a narrow interweaving of the labour law and intellectual copyright rights. Each source of rights bandles different times related to performing artists's activities. Labour law refers to the performer as a worker. Salaried staff status is predominant since the legislator bas introduced a presumption of employment. Literary and artistic property rigbts focus on the result of the creating process on which performers benefit from rights related to copyright. Performing artists are indeed at the heart of a delicate joint between the freedom of speech inherent to their activity and the legal subordination which characterises salaried staff relations. Actually, the labour law is not unaware of the peculiar nature of performing artists's activities. On one band, the salaried artist is exempt from the usual requirements of legal subordination; on the other hand, room is left to artists hoping to work as self-employed. Although a double legal protection exists, performing artists remain a fragile subject of law. They are often considered as precarious workers with the generalization of flexible forms of work and their neighbouring rights are often seen as a poor relation.
