Alors que l’on enseigne classiquement la distinction radicale du droit pénal et de la responsabilité civile, une étude approfondie du droit positif révèle une tendance générale et profonde à la confusion des deux disciplines. Face à ce paradoxe, le juriste s’interroge : comment articuler le droit civil et le droit pénal de la responsabilité ? Pour y répondre, cette thèse suggère d’abandonner l’approche traditionnelle de la matière, consistant à la tenir pour une simple catégorie de classement des différentes branches, civile et pénale, du droit de la responsabilité. La responsabilité juridique est présentée comme une institution autonome et générale organisant la réaction du système à la perturbation anormale de l’équilibre social. Quant au droit de la responsabilité civile et au droit criminel, ils ne sont plus conçus que comme les applications techniques de cette institution en droit positif.Sur le fondement de cette approche renouvelée et par le prisme de l’étude des conditions de la responsabilité en droit privé, la thèse propose un ordonnancement technique et rationnel du droit pénal et de la responsabilité civile susceptible de fournir les principes directeurs d’une véritable théorie générale de la responsabilité juridique. En tant qu’institution générale, celle-ci engendre à la fois un concept de responsabilité, composé des exigences de dégradation d’un intérêt juridiquement protégé, d’anormalité et de causalité juridique et qui fonde la convergence du droit pénal et du droit civil, et un système de responsabilité, qui en commande les divergences et pousse le premier vers la protection de l’intérêt général et le second vers celle des victimes.

While the radical distinction between criminal law and civil liability is classically taught, a thorough survey of positive law reveals a general and profound trend towards a confusion of these two disciplines. Faced with this paradox, the jurist wonders : how to articulate the civil and criminal laws of responsibility ? To answer this question, the thesis suggests abandoning the traditional approach of the subject, which consists in treating it as a mere category of classification of the different branches, civil and criminal, of responsibility/liability. Legal responsibility is presented as an autonomous and general institution organizing the response from the system to abnormal disturbance of social equilibrium. Civil liability law and criminal law are, as far as they are concerned, henceforth conceived as the mere technical applications of this institution in positive law.On the basis of this new approach and through the prism of the study of liability conditions in private law, the thesis proposes a technical and rational organization of criminal law and civil liability that may provide the guiding principles of a real general theory of legal responsibility. ▼ Se demuestran las falencias e insuficiencias de los tres títulos tradicionales de imputación de responsabilidad al Estado por las actuaciones judiciales para garantizar el derecho a la indemnidad de los ciudadanos, teniendo en cuenta el rol actual del juez y los postulados teóricos a los cuales debería responder esta institución jurídica. Al confrontar la responsabilidad del Estado por las actividades administrativas y por las actuaciones judiciales, a la luz de las reflexiones sobre los fundamentos teóricos de la responsabilidad civil y de la identidad del juez en el Estado contemporáneo, surge la necesidad de replantear esta institución, con el propósito de que sea expresión de las teorías de la justicia que le subyacen, garantice el derecho a la indemnidad de los ciudadanos y responda a la concepción actual de la judicatura. La estructura del texto consta de tres capítulos teóricos y uno propositivo en el cual se responden las preguntas de investigación planteadas, haciendo uso de la información reseñada al inicio de la investigación. El primer capítulo desarrolla los fundamentos filosóficos y jurídico políticos de la responsabilidad, empleando como método una aproximación teórica conceptual con un componente histórico o contextual, cuya función es la de ser un objetivo investigativo en sí mismo y servir de base para el análisis de las reglas jurisprudenciales expuestas posteriormente, de tal forma que logre llamar la atención sobre la importancia de que el Estado responda equitativamente a los ciudadanos por los daños antijurídicos que le cause con independencia de la rama del poder público que los ocasione, así como sobre las exigencias del Estado social de Derecho a la responsabilidad estatal. El segundo capítulo, denominado “Quién es el juez”, empleando la metodología de la primera parte, desarrolla los siguientes aspectos: el rol del juez en los Estados liberal, constitucional y neoconstitucional; los pilares teóricos para develar la identidad del juez en el Estado contemporáneo; y los órganos de cierre en el ordenamiento jurídico colombiano, resaltando el aumento en la importancia de la labor de este sujeto y que las decisiones judiciales son una expresión de los modelos de Estado. En este capítulo se identifica quién es el juez, cómo actúa, cómo se controlan sus actuaciones y de qué forma el Estado asume las consecuencias de estas. Darbe remiamasi Europos Sąjungos ir Lietuvos Respublikos teisės aktais, reglamentuojančiais klaidinančią reklamą bei atsakomybės už jos naudojimą taikymą, Europos Teisingumo Teismo ir Lietuvos Respublikos teismų bei atsakingų už reklamos kontrolę institucijų praktika, nagrinėjama Lietuvos ir užsienio šalių literatūra. Darbe atskleidžiami klaidinančios reklamos požymiai bei jų praktinis nustatymo mechanizmas Lietuvos Respublikos Konkurencijos tarybos veikloje bei vidutinio vartotojo samprata ir jo reikšmė reklamos pripažinimo klaidinančia procese. Analizuojama neleistina lyginamoji reklama klaidinančios reklamos kontekste, taipogi klaidinanti reklama kaip viena iš nesąžiningos komercinės veiklos vartotojų atžvilgiu rūšis. Darbe nagrinėjami dėl klaidinančios reklamos naudojimo kylantys prievoliniai santykiai, jų subjektinė sudėtis bei gvildenamos deliktinės atsakomybės sąlygos. Based on the work of the European Union and the Republic of Lithuania law on misleading advertising and liability for the use of the application, the European Court of Justice and the courts of the Republic of Lithuania and is responsible for monitoring advertising of institutional practices at issue in Lithuanian and foreign literature. The paper disclosed misleading advertising signs and their practical mechanism of Lithuanian Competition Council activities as well as the average consumer perception and recognition of its importance as misleading advertising process. Analyzed impermissible comparative advertising in the context of misleading advertising, misleading advertising also as one of unfair commercial practices, consumer types. The work deals with the use of misleading advertising resulting obligation is, their subjective well as deal with the composition of non-contractual liability terms. Disclosed in the Republic of Lithuania existing advertising self-regulatory authorities in development activities and their advantages and disadvantages of the test envisage improving the system perspective as well as their implementation capacity.

V magistrskem delu sem se osredotočil na veliko finančno gospodarsko krizo, ki se je leta 2007 začela kot hipotekarna kriza na ameriškem trgu in se kasneje razširila v finančni in realni sektor, ter njenega vpliva in posledice na izbrano podjetje – Silkem d.o.o. Še Danes živimo v okolju, ki se otepa s posledicami ekonomske krize in na dnevnem redu so informacije o stečajnih postopkih do še pred kratkim solidnih gospodarskih družb. Izredno pomembno za gospodarske družbe je, da najdejo tržne niše v pravem času, se zavedajo svojih konkurenčnih prednostih pred tekmeci oziroma konkurenti, ter s svojim izdelkom ali storitvijo zadovoljijo potrebe končnega uporabnika oz. porabnika. V času finančno gospodarske krize je pomembna vloga managerjev (ki velikokrat prevzamejo vlogo kriznih managerjev) ter sprejetje hitrih in pravilnih odločitev v danem trenutku. Vsako podjetje si želi uspešno poslovanje, dosegati zastavljene cilje in ustvariti dobiček ob koncu leta, ne glede na to ali se nahajamo v času gospodarske krize ali gospodarske rasti. Podjetje, ki želi mednarodno poslovati na dolgi rok in biti pri tem uspešno si mora odgovoriti na številna vprašanja. Podjetje se mora mednarodnega poslovanja lotiti premišljeno, saj mu vsaka nepremišljena poteza povzroči stroške, ki so lahko zelo visoki. V konkretno izbranem podjetju – Silkem d.o.o. je močna izvozna usmerjenost na tuje trge obvarovala podjetje pred negativnimi vplivi padajoče gospodarske rasti na domačem tržišču, ustrezni ukrepi pa so poskrbeli, da so posledice velike finančno gospodarske krize bistveno manj vidne. Relativno velika prilagodljivost ter fleksibilnost pri izpolnjevanju specializiranih zahtev kupcev je omogočila utrditev obstoječe tržne pozicije in hkrati pridobivanje novih kupcev.

Cette thèse porte sur le mouvement associatif étudiant, et son impact sur les autres formes d’engagements collectifs des individus dans le monde social. Elle s’attache à montrer que le mouvement associatif étudiant génère des projets, des formes d’engagements dans le collectif, que l’on voit réapparaître quelques années plus tard dans les associations, ONG, syndicats, partis politiques, … Outre la capacité transitive du message associatif étudiant, c’est la place de préfigurateur des engagements collectifs qu’occupe le mouvement associatif étudiant qui sont les objets principaux de cette recherche. La démonstration s’établit sur deux chapitres. Le premier s’attache à démontrer la réalité historique de cette proposition, de la fin du XIXème siècle jusqu’aux années 80. La seconde partie en démontre l’actualité, notamment au travers des pratiques à l’œuvre au sein du réseau FAGE. Ce travail, alliant quantitatif et qualitatif, s’appuie sur la catégorie du sujet tourainien, démontrant notamment la participation du mouvement associatif étudiant à l’émergence du Sujet. Les aspects historiques de ce travail s’appuient sur les travaux de Monchablon, Fischer, et plus largement, du GERME. Les problématiques relevant du tiers-secteur sont décryptées à l’aune des travaux de Ion, Archambault, ainsi que ceux du MAUSS. La capacité transitive du message associatif étudiant s’appuie enfin sur les travaux de Fillieule, Mayer et Agrikoliansky. Il ressort de ce travail la capacité du milieu associatif étudiant à bousculer les consensus sociaux en matière d’engagement collectif des individus, et à agir pour l’institutionnalisation progressive de modalités innovantes et performatives.

This thesis focuses on the student union and its impact on other forms of individual devotion towards collective commitments in the Social world. It aims to demonstrate that the student union generates projects and forms of commitments in the collective, that reappear several years later in unions, NGOs, political parties. Although the student union message is transitive, the precursor nature of collective engagements, central to student union movement, is the focus of this research. The demonstration spans two chapters. The first demonstrates the historical reality of such proposal, from the end of the nineteenth century to the 80s. The second demonstrates its topicality, mainly through the activities within the network FAGE. This work, combining quantitative and qualitative analysis, is based upon the subject of Touraine category, with a particular emphasis on the participation of the student union in the emergence of the Subject. The historical aspects of this thesis are based on the work of Monchablon, Fischer, and more broadly, GERME. The problems associated with the third sector are considered under the point of view of Ion, Archambault and Mauss. The transitive capability of the student union message builds on Fillieule, Mayer and Agrikoliansky works. ▼ Exquisite visually-guided movements underpin expertise in fast interceptive sports. The assumption that skilled performance relies on superior visual skills has been challenged by studies of sporting expertise which typically advocate vision to be a poor predictor of sporting success. This discordance is addressed in this thesis by examining whether visual degradation (in the form of blur) affects the performance of an interceptive action where successful execution demands precise spatial and temporal visual-motor control.The vision of skilled cricket batters was blurred using contact lenses (four increasing levels: plano, +1.00, +2.00, +3.00) in each of two experimental phases. In the first phase batters faced a bowling-machine and in-situ bowlers to examine the effect of blur on bat-ball interception. The highest level of blur (+3.00) was required to produce a significant decrease in batting performance when facing the bowling-machine at medium-paced ball-velocities (105-115 kph). A similar effect of blur was found when facing in-situ bowlers of comparable ball-velocity, however performance was found to be affected by a lower level of blur (+2.00) for faster-paced ball-velocities (120-130 kph). The +1.00 blur was concluded even at this higher ball-velocity to have no measurable effect on interceptive performance in a natural setting.The second phase sought to investigate the effect of blur on anticipation: a perceptual skill established to be an important component of expertise in many interceptive sports. It was established, using temporal occlusion of a bowling sequence, that optimal anticipation required an opportunity for bat-ball interception (facilitating close coupling between perception and action). Coupled anticipation demonstrated velocity-dependent resilience to blur; +3.00 and +2.00 were required for respective decreases in the anticipation of action-sequences for medium- and fast-paced ball-velocities. Remarkably, results suggest that blur may enhance uncoupled (verbal) anticipation according to the movement velocity of the bowler.Experimental results led to the conclusion that clear vision is not necessarily required for optimal interceptive performance, even when the demanding spatio-temporal task simulates the conditions experienced at the highest levels of competition. Results are interpreted based on the predictions of the dual-pathway theory of vision, including differences in the underlying visual information processed via these pathways. A presente pesquisa tem como objeto de estudo as técnicas, princípios e filosofia da Arte Marcial Japonesa chamada Aikido, em diálogo com princípios e métodos desenvolvidos por Meyerhold, Rudolf Laban, Eugênio Barba e Grotowski, objetivando criar procedimentos que auxiliem a preparação corporal do ator e sua criação artística. Busca-se, portanto, o corpo cênico, seus movimentos e sua continua (re) organização. Este trabalho foi elaborado a partir de pesquisa bibliográfica e de freqüência em treinos de Aikido, de onde foram extraídos elementos importantes para o estabelecimento dos alicerces que permitiram a conexão entre esta arte marcial e o trabalho do ator. A parte prática constou de exercícios que tiveram como objetivo a busca de formas de transposição do corpo-cotidiano para o corpo em Estado Cênico. Nesses treinamentos foram desenvolvidos conceitos e práticas visando o auto-conhecimento corporal, a preparação para a cena e a criação de ações físicas extracotidianas ancoradas na prática do Aikido. Como principal resultado prático preparou-se a montagem teatral Separação de Corpos, monólogo composto de ações físicas criadas a partir das técnicas pesquisadas durante o treinamento e que tem como personagem uma mulher que, abandonada pela pessoa amada, busca compreender sua situação e superar a perda, recomeçando a vida de outra forma. A presença de uma ferramenta como o Aikido configurou-se como de grande utilidade para o trabalho do ator em cena, pois auxilia na disponibilização do corpo em cena, favorecendo, também, a concentração do ator no ato de representar.

This research has, as its object of study, the techniques, principles and philosophy of Japanese martial art called Aikido, in a dialogue with principles and methods developed by Meyerhold, Rudolf Laban, Grotowski and Eugenio Barba, in order to create procedures that provide assistance to the actord body preparation and their artistic creation. We search, therefore, the scenic body, its movement and its continuing (re) organization. This work was based on bibliographic research and frequency in Aikido training, from where important elements were extracted to establish the foundations that enabled the connection between this martial art and the actor´s work. The practice consisted of exercises that aimed at the search of ways of transposition from the daily-body to the scenic body. In these trainings concepts and practices were developed aiming at body self-knowledge, preparation for the scene and the creation of extra-daily physical actions anchored in the practice of Aikido. The main practical result was the preparation of the play \"Separação de Corpos\", a monologue composed of physical actions created from the studied techniques during the training and that has as character a woman who was abandoned by his lover and seeks to understand her situation and overcome the loss, starting a new life in a different way. ▼ Playwriting theory has, from its beginning, been concerned with the search for the essential nature of dramatic writing. Early playwriting treatises (poetics) defined the essential aspects of drama as being the plot (creation of sequences of fictional events), the moral character of its heroes, the idea of enactment, or the rhetorical and lyrical qualities of the text. These categories were kept through later treatises with different emphasis being put on each category. An understanding of drama as a sequence of fictional events (plot) has been central in acting theory. Modern theories and techniques centred on Stanislavsky’s ideas rely heavily on rehearsal methods that carefully establish the sequence of actions of the characters in a play as a result of psychological motivations. This method was described by Stanislavsky in An Actor’s Work on a Role, published in 1938, and is known as the Method of Physical Actions. This thesis reassesses the definition of playwriting as consisting essentially in the creation of a plot populated by suitable characters. Rather than discussing playwriting theory in isolation it attempts a bridge between acting theory and playwriting theory by using the Method of Physical Actions as an equivalent to plot. Acting theory is thus considered as a theoretical justification for the centrality of plot. The method used is hermeneutic — a systematic interpretation of poetics, unveiling in almost an archaeological manner the relevance of the essential definitions of drama, such as character, source, genre, and language to the concept of plot. The chronological path of development of dramatic theories is shown to be gradual: from the strict obedience to the narrative line imposed by the mythic sources, in classical treatises; through to an interest in the lyrical expression of the predicament of specific characters, in neoclassical theory; to an awareness of specific social types in the eighteenth century; and, finally, to the conception of the plot as a product of the mental life of individual characters in modern theory.

▼ The topic of creativity in schools is increasing in popularity with many recent initiatives taking place emphasizing 21st century skills or the arts. Business literature has indicated the work environment influences worker creativity as well as identified managers as having influence over the work environment. While educational research supports the influence of the principal over the school environment, little research has specifically examined the role of the principal concerning creativity in schools. The aim of the study was to illuminate the role of the principal in fostering creativity by examining the attributes and actions as self-reported by the principal and to gather the perspective of the teachers in the school. A guiding framework was created through combining business literature about creativity and the work environment with education literature concerning the principal's influence on the environment. A single-case, mixed-methods study was selected to examine how one international elementary school principal sought to cultivate a school culture and climate where creativity can thrive. Data sources included in-depth interviews with the principal, document collection, observations, individual interviews with three other stakeholders, a teacher survey, and teacher focus groups. Analysis revealed a holistic understanding of the principal's attributes and actions concerning a creative culture and climate in the school as well as the teacher's perceptions. Three types of attributes were identified: Personal, Core Educational Beliefs, and Vision for the School. The themes for the first attribute, Personal, were Personal Experiences, Whole Child Emphasis, and Attitudes and Outlooks. The themes for the second attribute, Core Educational Beliefs, included Creativity is Important, People are Important, Growth is Important. The themes for the third attribute, Vision for the School, were Common Expectations for All and Goal Oriented. Concerning the teachers’ perspectives regarding the principal, her actions resulted in them feeling Respected, Supported, and Empowered. The findings provide implications for both future research and current practioners.

▼ Most of today’s Internet of Things (IoT) applications assume that data will be moved off devices into centralized cloud platforms. While existing IoT systems leverage cloud-based analytics for meaningful data reasoning, the assumption that data should always be moved off the devices is problematic. The amount of data to be moved from devices over Internet gateways to cloud platforms is huge which potentially make it cost inefficient. In other scenarios, privacy concerns of customers or organizational rules complicate the process of transferring data to third-party data centers. This dissertation proposes architectures and dynamic overlay network algorithms for in-network and edge processing of data offered by the globally available IoT devices and provides a global platform for meaningful and responsive data analysis and decision making. The proposed techniques shift IoT analytics from a ”collect data now and analyze it later” scenario to directly providing meaningful information from the in-network processing of devices data at or near the devices. The techniques serve future IoT use cases including distributed context awareness, on-demand data analysis, and in-network decision making. The dissertation comprises three main components. The first component is a device management protocol for cloning devices’ data in proximate Edge Computing platforms. Unlike existing application-layer IoT management protocols the proposed protocol uses the LTE/LTE-A radio frame structure, device-to-device communication, and IoT data properties to avoid excessive network access latency in existing technologies. The second component realizes distributed IoT analytics as overlay networks of devices clones. By means of virtual network embedding, it selects and interconnects devices’ clones to efficiently realize applications’ virtual topologies to achieve goals such as minimum latency, minimum infrastructure cost, or maximum infrastructure utilization. Finally, the dissertation presents a communication middleware that allows autonomous discovery, self-deployment, and online migration of devices’ clones across heterogeneous Edge computing platforms. The middleware ensures that communication latency between clones is kept minimum despite the uncontrolled variability of the network and hosting platforms conditions. We evaluate the proposed architectures and algorithms through simulations and prototype implementation of various components in controlled testbed environments, which we evaluate using real user applications. ▼ Internet of Things, is a new expression described as the future of the internet, promises a new world surrounded by tiny smart objects interacting with the environment, communicating with each other, and controlled over internet. Investigating which low power wireless solution and authentication mechanism fits best for IoT networks, and applying these technologies on simulator and real hardware is the main task of this project. Bluetooth Low Energy, ANT, 6LoWPAN and ZigBee are investigated low power wireless technologies which might be used to create an IoT network. Yet, BLTE and ANT have narrower application areas compared to the others, therefore ZigBee and 6LoWPAN technologies are investigated in depth and compared as the 2 promising solutions for implementation and integration of Internet of things concept. SPINS, TinySec, TinyECC, SenSec, MiniSec, ContikiSec and AES CCM are the main security frameworks especially designed for wireless sensor networks providing confidentiality, authentication and integrity. These frameworks were described and compared to find out most suitable authentication mechanism for IoT networks. Contiki OS is used as the operating system of nodes during the implementation of network both on simulator Cooja and real hardware. ZigBee and 6LoWPAN were compared considering interoperability, packet overhead, security and availability. As a result 6LoWPAN came forward due to providing high interoperability and slightly less packet overhead features. ZigBee devices require extra hardware to operate with different technologies. Among the discussed security frameworks, ContikiSec and AES CCM were highlighted because of flexibility, providing different levels of security. Resource limited characteristic and diversity of IoT applications make flexibility a very useful feature while implementing a security framework. Experiments committed to implement a working IoT network were not hundred percent successful. 6LoWPAN was successfully implemented but implementation of the security framework was failed due to compatibility issues between the sensor and the router node. Firmware of the sensor node is not designed to provide any kind of security, therefore security features of the router node is also disabled.

▼ Arundhati Royâs award-winning novel, The God of Small Things, features a highly personal writing style as well as complex narrative strategies. The present thesis argues that such writing is in line with Jean-FranÃ§ois Lyotardâs philosophical politics and reads the novel from Sara Ahmedâs theory of fear. Royâs political agenda in the novel is to voice for the depressed through personal affects. Thick with negative emotions, the novel depicts the reduced circumstances of the characters under the rule of the caste system. Among all the unpleasant feelings, fear is singled out as the most distinctive emotion, as the affect is employed by the caste system to subdue its subjects. To further explore the operation of fear among the characters, the present thesis approaches the novel by mainly incorporating Sara Ahmedâs model of fear into the analysis. I will begin by delineating the Love Laws as the metanarrative that regulates the strict caste regulations and triggers fear as they prescribe the proper interactions among their subjects, the Touchable and the Untouchable alike. The notion of (im)purity in the caste system is of paramount importance regarding the caste classification, because it not only divides them in both physical and genetic sense, but also creates the mutual fear between these two classes. Moreover, Royâs writing is in itself a way to express fear. Through repetition of the horrible images, Roy builds up a network of negative associations that creates a permeating sense of fear in her novel. Such repetitions not only help to intensify fear but also create a circular effect in her narration that imitates the wounded memories of the twins. Royâs writing of fear is an attempt to raise the readerâs concern for the reduced circumstances of the characters by seeing from the depressed peopleâs perspectives. Her radical politics lies in her exploration of the possibility of overcoming the fear engendered by the Love Laws. Jusqu’à l’entrée en vigueur de la loi Badinter du 5 juillet 1985, l’indemnisation des victimes des accidents de la circulation était régie en France par le principe général de responsabilité du fait des choses développé par la jurisprudence française sur la base de l’article 1384, alinéa 1er , Code civil. Le Code civil jordanien de 1976 comprend un principe de responsabilité du fait des choses inspiré de celui qui existe en France. Toutefois, la jurisprudence jordanienne n’applique pas ce principe dans le domaine des accidents de la circulation, en dépit de l’inexistence en Jordanie d’une loi similaire à la loi Badinter du 5 juillet 1985. L’indemnisation des victimes de ces accidents est donc régie en Jordanie par le droit commun de la responsabilité du fait personnel et par une loi de 2010 instituant un régime d’assurance obligatoire au profit des victimes des accidents résultant de l’utilisation des véhicules. Le système mis en place autorise le débiteur de l’indemnité ou son assureur d’opposer à la victime son propre fait dommageable, quel que soit son degré de gravité. Les victimes voient donc souvent leur droit à indemnisation intégrale réduit, voire supprimé.

Until the enactment of the so-called loi Badinter of 5 July 1985, the compensation of traffic accident victims was governed in France by the general principle of liability for the action of things developed by French case law on the basis of article 1384, paragraph 1, of the French Civil Code. The 1976 Jordanian Civil Code includes a principle of liability for the action of things inspired by the French model. However, this principle is not applied by Jordanian courts in the field of traffic accidents, in spite of the fact that there is no law in Jordan similar to the loi Badinter of 5 July 1985. Hence, compensation in cases of traffic accidents is still governed in Jordan by general rules of tort law which govern liability for one’s own actions and by a 2010 law creating a compulsory motor insurance scheme, which protects victims of accidents resulting from the use of motor vehicles. In accordance with these rules, the compensation’s debtor or her/his insurer is authorized to put forward the victim’s own harmful action, disregarding its seriousness. As a result, the victim’s right to full compensation ifs often reduced or even withheld.

▼ This thesis argues that a prominent concern among contemporary writers of fiction is the recuperation of lost or occluded histories. Increasingly, contemporary writers, especially postcolonial writers, are using the medium of fiction to explore those areas of political and cultural history that have been written over or unwritten by the dominant narrative of “official” History. The act of excavating these past histories is simultaneously both traumatic and liberating – which is not to suggest that liberation itself is without pain and trauma. The retelling of traumatic pasts can lead, as is portrayed in The God of Small Things (1997), to further trauma and pain. Postcolonial writers (and much of the world today can be construed as postcolonial in one way or another) are seeking to bring to the fore stories of the past which break down the rigid binaries upon which colonialism built its various empires, literal and ideological. Such writing has in a sense been enabled by the collapse, in postcolonial and postmodernist discourse, of the Grand Narrative of History, and its fragmentation into a plurality of competing discourses and histories. The associated collapse of the boundary between history and fiction is recognized in the useful generic marker “historiographic metafiction,” coined by Linda Hutcheon. The texts examined in this study are all variants of this emerging contemporary genre. What they also have in common is a concern with the consequences of exile or diaspora. This study thus explores some of the representations of how the exilic experience impinges on the development of identity in the postcolonial world. The identities of “displaced” people must undergo constant change in order to adjust to the new spaces into which they move, both literal and metaphorical, and yet critical to this adjustment is the cultural continuity provided by psychologically satisfying stories about the past. The study shows that what the chosen texts share at bottom is their mutual need to retell the lost pasts of their characters, the trauma that such retelling evokes and the new histories to which they give birth. These texts generate new histories which subvert, enrich, and pre-empt formal closure for the narratives of history which determine the identities of nations.

L'objet de cette thèse est l'étude de la propriété (T) relative à l'espace (ou rigidité au sens de Popa) d'actions de groupes dénombrables sur des espaces de probabilité standards préservant une mesure de probabilité (pmp). Ces dix dernières années, la propriété (T) relative à l'espace a permis de résoudre de nombreux problèmes dans le cadre de la théorie ergodique des actions de groupes et des algèbres de von Neumann. Néanmoins, certains aspects théoriques de cette notion restent largement mystérieux. Une question encore ouverte consiste à déterminer les groupes admettant une action libre ergodique pmp ayant la propriété (T) relative à l'espace. Nous montrons dans cette thèse que les groupes de type fini non-moyennables linéaires sur un corps de caractéristique nulle admettent une action ergodique pmp possédant cette propriété. Si le groupe est à radical résoluble trivial, l'action que nous construisons est aussi libre.Pour ce faire, nous commençons par étudier la stabilité de la propriété (T) relative à l'espace vis-à-vis de différentes constructions d'actions pmp : produit, restriction, co-induction, induction. Puis, nous donnons une caractérisation de la propriété (T) relative à l'espace dans le cas d'actions pmp sur un espace homogène G/Λ de groupe de Lie p-adique d'un sous-groupe dénombrable Γ du groupe des transformations affines de G stabilisant le réseau Λ. L'action de Γ sur G/Λ a la propriété (T) relative à l'espace si et seulement s'il n'existe pas de mesure de probabilité Γ-invariante sur l'espace projectif de l'algèbre de Lie de G. Par ailleurs, nous étudions le cas d'actions de groupes par automorphismes sur des nilvariétés définies par des graphes finis.

The purpose of this thesis is to study the Kazhdan's property (T) relative to the space (also called rigidity in the sense of Popa) of probability measure preserving actions of countable groups on standard probability measure spaces (p.m.p.).This last decade, some problems in the theory of ergodic theory and von Neumann algebras were solved using the property (T) relative to the space. However, the theoretical aspects of its study remain largely mysterious. An open question asks which groups admit a p.m.p. free and ergodic action which has the property (T) relative to the space. We show in this dissertation that every finitely-generated non-amenable linear groups over a field of characteristic zero admits a p.m.p. ergodic action which has this property. If this group has trivial solvable radical, we prove that these actions can be chosen to be free.In order to obtain these results, we start by investigating natural questions concerning the stability of the property (T) relative to the space through standard constructions : products, restriction, co-induction, induction. Then, we give a criterion for the property (T) relative to the space to hold in the case of p.m.p. actions on homogeneous space G/ Λ of a p-adic Lie group for a countable subgroup Γ of affine transformations of G stabilizing the lattice Λ.
