▼ Steady and laminar natural convection heat transfer and fluid flow for
power law fluids in an open channel between two parallel vertical plates that is entering from the bottom and exiting from top is studied. For the numerical computations, the ANSYS Workbench Fluent commercial package is used and the numerical output is post-processed and non-dimensional numbers are evaluated by MATLAB. The conservation of mass, momentum and energy equations solved numerically. The results for asymmetric and symmetric configurations of the heated plates, which are kept at uniform temperatures with an aspect ratio of 40, are presented for different non-dimensional numbers and
power law properties. Various values of Rayleigh number (Ra= 〖10〗

6 ), Prandtl number (Pr=10,100,1000), non-Newtonian
power law indexes (0.6≤n≤1.4) and temperature ratios of colder and hotter walls (r

A detailed comparison between Newtonian and non-Newtonian fluids are made in terms of the variations of the average Nusselt numbers representing the strength of heat transfer as a function of the non-dimensional governing parameters, Ra,Prand n.

▼ Whilst a lot of our strategic focus in the public sector is on linear policy approaches, many systems/ phenomena of importance are defined as non-linear or far from equilibrium. Traditional approaches to linear forecasting have not proved effective for non-linear systems, since non-linear systems follow a different set of rules. Historically, non-linear systems were too hard to forecast, but over recent decades some rules and approaches are starting to emerge.
One important and clearly defined category of non-linear systems are those that follow a ‘
power-law’ distribution rather than the ‘normal’ distribution, which is often associated with linear systems or systems in equilibrium. My research collects, analyses, and does a comparative analysis of the different
power law populations, as well as the main strategic forecasting techniques that can be applied to those populations/ systems.
Overall Conclusions and observations.
Just as in science and mathematics, there is now a clearly defined separation and understanding of linear and non-linear systems and the rules that apply to each. My thesis has as its central theme, the idea that strategy as a
subject also fits this same philosophical separation of approaches, which I have called the strategic planning versus the strategic thinking divide. Strategic planning is essentially the linear approach – being rational and assuming relatively stable conditions. Strategic thinking assumes the world is effectively non-linear and ‘far from equilibrium’. Non-linear approaches mean acknowledging concepts like; punctuated equilibrium,
power law ‘log-log’ graphs, ‘scale-free’ characteristics, ‘self organising criticality’, accepting only pattern prediction (including 1/f formulas) and not precise prediction etc. Understanding non-linearity is essential to understand such things as ‘Black Swans’. Luck, serendipity and ‘bounded rationality’ are always involved in non-linear complex adaptive systems, whereas linear systems tend to comply with the so called ‘rational’ traditions in science and economics.
Power law statistical distributions can be seen in a wide variety of non-linear natural and man-made phenomena, from earthquakes and solar flares to populations of cities and sales of books. This sheer diversity of effects that have
power law distributions is actually an amazing fact that has only become evident over the last decade or so. Since the world contains aspects that are clearly linear and other aspects that are clearly non-linear, it is essential for someone interested in strategy to be able to understand both systems and be able to apply
the correct techniques to each approach. The two parts of ‘punctuated equilibrium’ effectively link the two strategic approaches together as there is only one world and not two separate realities.
It therefore follows that a strategist needs a good understanding of both strategic planning and strategic thinking, since both are needed for different phases or periods, and perhaps both are needed for any period when you can't tell what phase…

▼ This dissertation explores the challenges that administrative reasoning places on classical theories about the nature of law or adjudication, the structure of the legal process, and the separation of powers, particularly in its relationship with legality and the active role of the administrative power in modern governance. It describes how traditional theories about the nature of law and adjudication have explicitly addressed the philosophical foundations of judicial reasoning in hard cases, but they have been oblivious about how administrative decision-makers should decide them. This dissertation argues for an eclectic model where administrative reasoning should ideally be informed by publicly validated expert knowledge that requires a moral and political compass oriented towards the fulfillment of the purposes and aspirations of a democratic polity that lives under the rule of law. To that end, it proposes that the administrative power ought to decide hard cases regardless of the empirical, theoretical or meta-interpretive nature of the disagreement they may elicit. It suggests that, unlike the judiciary, the administrative power is ideally endowed with original or delegated lawmaking authority, vested with democratic legitimacy, and equipped with specialized expertise and the procedural mechanisms to allow the active participation of the citizenry in the administrative process. Furthermore, it proposes that these features entail that administrative decision-makers should reason from principle and policy in deciding hard cases about the planning and allocation of valuable resources in a community by construing the grounds of law or deciding meta-interpretive disagreements based on publicly validated expertise. Finally, this dissertation ventures to speculate that the existence of administrative novelty may challenge the truism embraced by traditional jurisprudence according to which the solution to the tension between law’s certainty and its responsiveness is usually reserved to the interplay legislature-courts that regards the administrative power as a mere executor of legislation.

▼ This is a thesis about how to characterize the statistical structure of the tails of degree distributions of real-world networks. The primary contribution is a statistical test of the prevalence of scale-free structure in real-world networks. A central claim in modern network science is that real-world networks are typically "scale free," meaning that the fraction of nodes with degree k follows a
power law, decaying like k^-a, often with 2 < a < 3. However, empirical evidence for this belief derives from a relatively small number of real-world networks. In the first section, we test the universality of scale-free structure by applying state-of-the-art statistical tools to a large corpus of nearly 1000 network data sets drawn from social, biological, technological, and informational sources. We fit the
power-
law model to each degree distribution, test its statistical plausibility, and compare it via a likelihood ratio test to alternative, non-scale-free models, e.g., the log-normal. Across domains, we find that scale-free networks are rare, with only 4% exhibiting the strongest-possible evidence of scale-free structure and 52% exhibiting the weakest-possible evidence. Furthermore, evidence of scale-free structure is not uniformly distributed across sources: social networks are at best weakly scale free, while a handful of technological and biological networks can be called strongly scale free. These results undermine the universality of scale-free networks and reveal that real-world networks exhibit a rich structural diversity that will likely require new ideas and mechanisms to explain. A core methodological component of addressing the ubiquity of scale-free structure in real-world networks is an ability to fit a
power law to the degree distribution. In the second section, we numerically evaluate and compare, using both synthetic data with known structure and real-world data with unknown structure, two statistically principled methods for estimating the tail parameters for
power-
law distributions, showing that in practice, a method based on extreme value theory and a sophisticated bootstrap and the more commonly used method based an empirical minimization approach exhibit similar accuracy.

▼ Foamed gypsum slurry is an integral part of gypsum wallboard. The present work describes the dynamics of foam injection into gypsum slurry, which is a
power-
law fluid with the consistency and behavior indexes depending on the local foam content. The work is divided into two parts. In the first part, the injection of a single straight foam jet into gypsum slurry at rest is studied numerically. The effect of the initial foam jet radius and velocity on the flow structure is elucidated at two different values of the Schmidt number. Also, the effect of the water stucco ratio (WSR) on the flow development and the rate of mixing is predicted. In the second part, gypsum slurry-foam mixture formed as a result of foam injection into crossflow is described. In both the cases, they are studied as a non-Newtonian
power-
law fluid with the consistency and behavior indexes depending on air content. The flow under consideration is a submerged jet of a boundary-layer type, which curves under the action of the fluid brought by crossflow. The numerical solution proposed here allows one to address the main parameters of interest – the depth of penetration and the rate of mixing.

▼ L´économie et le droit caractérisent de nombreux aspects divers de nos réalités de vie postmodernes : ils sont à parts égales constituants de notre compréhension du monde de travail et de la profession, de la société, de la culture et des sciences. Dans ce contexte, les deux catégories continuent souvent à produire leurs effets inconscients : Non seulement de manière manifeste dans les bilans, les contrats et les règlements, dans des législations codifiées les plus variées et dans des instru-ments de calcul quantifiés – elles jouent aussi et surtout implicitement des rôles clé dans l´attribution inhérente de valeur/s dans de multiples débats et discours actuels ainsi que dans le cadre de diverses réalisations pratiques. Ainsi, l´économie et le droit finissent par prendre un effet performatif grâce à leur réalisation dans la pré-sentation et permettent enfin d´entrer dans de maints processus de pensée et de distinction ou d´entamer des actions concrètes ou bien excluent de tels processus et actions. Ce projet de thèse de doctorat vise à tracer ces (im-)possibilités de prise d´effet et de taux de réalisation dans les histoires de vie de migrants d´Asie du Sud. Paral-lèlement, il est prévu de fonder les recherches sur l´idée ambitieuse d´intégrer des objets du droit et de l´économie et d´y faire converger des disciplines variées fai-sant partie des sciences humaines et sociales, dans le but de pouvoir les repenser dans l´ambiance constructive d´une approche multi-perspectiviste et transdiscipli-naire.
In the global context of our heterogenous postmodern world, new perspectives on the historical as well as geographical dimensions of normative orders are crucial. Using up-to-date dispositif-theoretical views on law and economy in order to analyze its diverse meanings and reproductions on various scales, this PhD theses aims at developing a theoretical research agenda as a starting point for further interdisciplinary work in contexts of mobiliy, migration and exchange. It argues that it is especially the intersection between Law, Economics, History and Human Geography which might, in conjunction with Cultural Studies, create fruitful understandings of a global environment of power.

▼ New York City hopes to reduce Green House Gas emissions from buildings by 3.4 million metric tons by 2025. Since the vast majority of buildings in New York City already exist, a crucial objective is improving the energy efficiency of the existing building stock. The slow implementation of energy efficient technologies in buildings can be explained by a lack of funding. This study explores methods for targeting deeper energy efficiency retrofits, as well as financing these improvements through reforming the City's zoning ordinance, specifically the governance of Transfer of Development Rights (TDR) transactions. Developments with transferred development rights create increased density that impose costs that need to be accounted for; with more building density there will be more energy usage at one point in space. Based on research and reasonable assumptions, this study of Manhattan alone demonstrates that placing a value capture tax on TDR transactions at a hypothetical 6% tax rate could raise between 46 million and 72.5 million. Similarly placing a flat 18 per square foot (PSF) charge could raise from 47 million to 67 million. The revenues generated by this transfer charge could be earmarked for energy improvements in residential buildings. Using existing technologies, it is estimated that this money could possibly reduce GHG emissions in the City of New York between 282,337 and 433,782 Metric Tons of CO2 equivalents- depending upon the approach adopted. Further consideration should be given to the benefits of energy efficiency grants as opposed to loans.

▼ It is well recognized that the role of zoning is essential in planning for wind energy. Wind energy zoning is not regulated at the federal level. The responsibility of regulating wind energy projects falls on states and cities, except on federal lands or when special laws apply (e.g. Federal Aviation Regulations). As more local governments explore their roles and responsibilities in climate change adaptation and mitigation, policies and zoning regulations related to distributed wind energy systems are constantly being added or updated. There is little consistency throughout the United States in regards to wind energy zoning. Local or state (or sometimes both) authorities can regulate wind energy facilities (Redburn, 2017). New York State's law, Chapter 388 of the Laws of 2011 that enacted Article 10 of the Public Service Law defines a major electric generating facility as facilities of 25 megawatts or more. The installation and modification of such facilities require environmental and public health impact analyses, a utility security plan, and advising interested parties and members of the public (Chapter 388 of the Laws of 2011). Facilities with capacity under 25 megawatts are not subjected to the requirement. This study does research on small-scale distributed wind energy conversion systems, as defined by the New York City Zoning Resolution (2018). Concerns related to visual impacts, sound, safety, and threats to wildlife are raised whenever there are wind energy facilities siting projects. The goal of the study is to analyze the regulations on which the amendment relies, identify if and how the zoning text addresses public concerns, challenges it encountered, and potential improvements.

▼ The continuum of western North American hydroclimate during the last millennium is analyzed here using instrumental records, proxy data, and global climate model (GCM) simulations. We find that variance at long timescales (low frequencies) is generally more substantial than variance at short timescales (high frequencies). We find that local sources of autocorrelation (e.g., soil moisture storage) likely explain the tendency for variance to increase from monthly to interannual timescales, but that variance at longer timescales requires remote climate sources of variability. Our analysis of global climate model data indicates that at least one fully coupled GCM can reproduce the characteristics of the continuum on short (interannual) and long (multicentury) timescales, but that proxy spectra and GCM spectra disagree about the amount of variance present on intermediate (decadal to centennial) timescales. Since instrumental records, as well as multiple independent types of paleoclimate records, provide evidence that variance increases with timescale at these frequencies, and because numerical experiments indicate that local autocorrelation is not a likely source of variance at these timescales, we argue that climate model simulations underestimate the full range of low-frequency drought variability. Moreover, the models may also underestimate the risk of future megadroughts, which we attempt to quantify using a new method that combines frequency information from observational data with projections of 21st century hydroclimate. Our results indicate that the risk of a severe, decadal-scale drought during the coming century is at least 1-in-10 for most of the US Southwest, and may be as high as 1-in-3. These findings should be incorporated into adaptation and mitigation strategies to cope with regional climate variability and climate change.

▼ This dissertation asks how legal, political and social actors affect the beliefs and actions of public interest law organizations. In order to answer this question requires two conceptual prerequisites. The first is the concept of power. There are substantial limitation with current understandings of what it means to affect others . I conduct an ordinary language analysis to illustrate interest group scholars’ acceptance of one sense of power—as domination. In the process, I recover another sense of power— as influence—the ability to affect others through imperceptible and non-coercive means. The second conceptual prerequisite is what public law organizations do, and how these actions reinforce one another. I create the concept of triangular advocacy to explain how these groups try to change society through a combination of legal, political, and social advocacy. While legal advocacy is central to public law groups’ efforts, political and social advocacy complements their goals. With the concepts of power—as influence, and triangular advocacy, I examine the question that I posed at the outset: how key actors have power with public law groups. I find that legal and social advocacy are important ways for PILOs to overcome challenges that political actors and the broader public place in their way. If public law groups perceive themselves as having good relationships with political actors, however, then they can concentrate on insider forms of politics, and do not need to emphasize social change as strongly.

▼ Marriage law is often conceptualised as an instrument of power that illegitimately imposes the will of the State on its citizens. Paradoxically, marriage law is also offered as a route to liberation. In this thesis, I question the efficacy of this type of analysis by investigating the actual power effects of marriage law. Using Michel Foucault’s concepts of bio-power and government, and his genealogical approach to history, I identify the role played by marriage law in governing the social domain over a discrete period of Irish history. Drawing on this analysis, I suggest that marriage law is part of a dense network of power relationships that cannot be reduced to a binary relationship of oppression and liberation. Rather, marriage law acts, in conjunction with other techniques of government, to conduct conformity in social behaviour.
Until the 1960s, marriage was considered a fully social matter outside the jurisdiction of politics. With the adoption of a Keynesian economic model at the end of the 1950s the welfare of the population became a matter of political concern. In the 1970s, the vulnerable dependent wife emerged as an object of regulation and marriage law was enacted to protect her through enforcement of the obligations of morally bound, gendered, lifetime marriage. The need to protect this form of marriage drove
further reform of marriage law in the 1980s and divorce legislation enacted in 1997. An increasingly rationalised, economic approach to government, adopted following ratification of the Maastricht treaty, required the deployment of social scientific knowledge by government. Within the domain of family life, science connected social stability to relationship stability. Marriage law reform in the 2000s, therefore aimed to promote stability in relationship behaviour by acknowledging, regulating, and promoting relationship practices that performed lifetime marriage. Over the research period, marriage law operated as one among many techniques of government that installed a detailed apparatus of surveillance and control around individual lives, with the objective and effect of conducting conformity in relationship behaviour.

▼ O objetivo do trabalho é estudar as situações em que práticas de distribuição tendentes à exclusão podem configurar ilícitos de abuso de posição dominante por parte de fornecedores de bens e serviços. Fornecedores de bens e serviços precisam identificar qual a forma mais eficiente de fazer que seus produtos cheguem até o consumidor final. Em determinadas circunstâncias, contudo, um fornecedor pode ocupar uma posição de domínio em determinados mercados e suas práticas de distribuição podem ter potenciais efeitos de exclusão, possivelmente causando efeitos indesejáveis sobre a concorrência. Ao longo do trabalho, buscamos contextualizar e compreender a ideia de exclusão, com recurso à análise do tratamento dado às condutas de exclusão por parte do direito antitruste dos Estados Unidos, do direito da concorrência comunitário europeu e do direito da concorrência brasileiro. Buscamos, ainda, traçar um panorama das principais linhas da teoria econômica que oferecem subsídios à compreensão da ideia de exclusão, bem como as contribuições específicas com referência ao tema. Examinamos, também, as principais práticas de distribuição tendentes à exclusão, que classificamos em tradicionais e não tradicionais, buscando compreender seus efeitos e motivações. Ao final, apresenta-se um diagnóstico e a conclusão. The work seeks to examine situations in which distribution practices tending towards exclusion may characterize illicit acts of abuse of a dominant position by suppliers of goods and services. Suppliers of goods and services need to identify the most efficient way of getting their products to the end user. In certain circumstances, though, a supplier may occupy a dominant position in given markets, and its distribution practices may have effects of exclusion, possibly affecting competition unfavorably. Throughout the work, we attempt to contextualize and understand the idea of exclusion, using an analysis of the treatment given to exclusionary conducts under United States antitrust law, the competition law of the European community and Brazilian competition law. We also seek to sketch out an overview of the main lines of economic theory that assist in an understanding of the idea of exclusion, along with specific contributions making reference to the issue. We also examine the main distribution practices tending towards exclusion, which we classify into traditional and non-traditional, seeking to understand their effects and rationale. Lastly, a diagnosis and conclusion are presented. ▼ Power Laws são leis estatísticas que permeiam os mais variados campos do conhecimento humano tais como Biologia, Sociologia, Geografia, Linguística, Astronomia, entre outros, e que têm como característica mais importante a disparidade entre os elementos causadores, ou seja, alguns poucos elementos são responsáveis pela grande maioria dos efeitos. Exemplos famosos são o Princípio de Pareto, a Lei de Zipf e o modelo de Incêndios Florestais. O Princípio de Pareto diz que 80% da riqueza de uma nação está nas mãos de apenas 20% da população; em outras palavras, uma relação causa e efeito chamada 80-20. A Lei de Zipf enuncia que o comportamento da frequência versus o ranking de ocorrência é dado por uma curva hiperbólica com um comportamento semelhante a 1/x. O modelo de Incêndios Florestais modela o comportamento do crescimento de árvores em uma floresta entre sucessivas queimadas que causam destruição de agrupamentos de árvores. As Power Laws demonstram que uma porcentagem pequena de uma distribuição tem uma alta frequência de ocorrência, enquanto o restante dos casos que aparecem tem uma frequência baixa, o que levaria a uma reta decrescente em uma escala logarítmica. A partir de simulações utilizando o conjunto de benchmarks SPEC-CPU2000, este estudo procura investigar como essas leis estatísticas podem ser utilizadas para entender e melhorar o desempenho de caches baseados em diferentes políticas de substituição de linhas de cache. O estudo sobre a possibilidade de uma nova política de substituição composta por um cache Pareto, bem como um novo mecanismo de chaveamento do comportamento de algoritmos adaptativos de substituição de linhas de cache, chamado de Forest Fire Switching Mechanism, ambos baseados em Power Laws, são propostos a fim de se obter ganhos de desempenho na execução de aplicações.
Power Laws are statistical laws that permeate the most varied fields of human knowledge such as Biology, Sociology, Geography, Linguistics, Astronomy, among others, and have as most important characteristic the disparity between the cause events, in other words, some few elements are responsible for most of the effects. Famous examples are the Pareto Principle, the Zipfs Law and the Forest Fire model. The Pareto Principle says that 80% of a nations wealth is in the hands of just 20% of the population; in other words, a cause and effect relationship called 80-20. Zipf\'s Law states that the behavior of frequency versus ranking of occurrence is given by a hyperbolic curve with a behavior similar to 1/x. The Forest Fire model represents the behavior of trees growing in a forest between successive fires that cause the destruction of clusters of trees. The Power Laws demonstrate that a small percentage of a distribution has a high frequency of occurrence, while the rest of the cases that appear have a low frequency, which would take to a decreasing line in a logarithmic scale. ▼ O trabalho em apreço trata do contexto legal do poder disciplinar do empregador e a sua regulação, no Direito do Trabalho Português, salientando as posições doutrinais da doutrina nacional e internacional e da respectiva jurisprudência, aludindo-se pertinentemente ao espírito legal do legislador.
Para além dos poderes e deveres do empregador, este trabalho alude também o trabalhador e a sua função enquanto agente envolvente da relação laboral. Os seus direitos e deveres são dissecados de forma a possibilitar uma confrontação e noção do contexto laboral actual e a sua dinâmica, tendo em conta as infracções disciplinares e respectivas sanções e procedimentos ao nível da disciplina laboral.
The present work deals with the legal context of disciplinary power of the employer and its regulation in the Law of the Portuguese Labour, highlighting the doctrinal positions of national and international law doctrine and alluding to the legal mind of the legislator.
In addition to the powers and duties of the employer, this work also alludes to the worker and his role as agent surrounding the employment relationship. Their rights and duties are dissected in order to enable a confrontation and the notion of the current labor context and its dynamics, taking into account the disciplinary offenses and their penalties and procedures at the level of labor discipline.

▼ Multistakeholderism has become one of the fundamental principles of internet governance. It is commonly defined as a model of governance that requires the participation of three stakeholder groups - states, the private sector and civil society - “in their respective role.” However, the how, when, and more importantly the why of the stakeholders’ respective involvement have not been satisfactorily spelled out. This uncertainty is unsettling. Multistakeholderism is increasingly used to prevent governments from making decisions that may impact the internet pursuant to intergovernmentalism. A result of this pushback against intergovernmental initiatives in the field of the internet is the rarity of internet-specific international
law. If multistakeholderism is to prevent the making of international
law, its legitimacy should not remain a mystery. Whether we like it or (increasingly) not, traditional international law’s legitimacy is firmly grounded in state consent. There is no such clear legitimacy story supporting multistakeholderism.
Relying on global constitutionalism, this dissertation addresses this gap. It develops a model for a composite global constituent
power, comprised of a state component and a global component, and explains how it may be exercised, whether directly or, under certain conditions, through mediators. The model is then used to assess multistakeholderism. It concludes that the composite global constituent
power model legitimizes equal multistakeholderism. In this version of multistakeholderism, states on the one hand, and the private sector and civil society on the other hand, are the mediators of the state component and the global component respectively and are on strictly equal footing.

▼ This thesis uses the concept of legitimacy, a measure of the public’s support of government operations, as a lens through which to approach environmental legal reform in Canada. An analysis of the legitimacy of Manitoba’s environmental regulatory regime as it pertains to the hydroelectric industry is undertaken, with an emphasis on opportunities for public participation. As a result, it is suggested that environmental governance in Manitoba has suffered a significant loss of legitimacy. This indicates that environmental reforms are needed to support meaningful public participation. Based on the components of meaningful public participation recognized by Canadian legal scholars, legal reforms are identified that could be enacted in Manitoba to restore lost legitimacy. It is suggested that the most effective means of restoring legitimacy would be to focus on reforms that clarify the environmental obligations of government and allow citizens to more meaningfully participate in the enforcement and review of environmental protection measures.

▼ Zipf’s law is one of the empirical statistical regularities found within many natural systems, ranging from protein sequences of immune receptors in cells to the intensity of solar flares from the sun. Verifying the universality of Zipf’s law can provide many opportunities for us to further seek the commonalities of phenomena that possess the power law behavior. Since power law-like phenomena, as many studies have previously indicated, is often interpreted as evidence for studying complex systems, exploring the universality of Zipf’s law is also of potential capability in explaining underlying generative mechanisms and endogenous processes, i.e. self-organization and chaos theory. The main purpose of this study was to verify whether Zipf’s law is valid for city sizes, city numbers and population extracted from natural cities. Unlike traditional city boundaries extracted by applying census-imposed and top-down imposed data, which are arbitrary and subjective, the study established the new kind of boundaries of cities, namely, natural cities through using four location-based social media data from Twitter, Brightkite, Gowalla and Freebase and head/tail breaks rule. In order to capture and quantify the hierarchical level for studying heterogeneous scales of cities, ht-index derived from head/tail breaks rule was employed. Furthermore, the validation of Zipf’s law was examined. The result revealed that the natural cities had deviations in subtle patterns when different social media data were examined. By employing head/tail breaks method, the result calculated the ht-index and detected that hierarchy levels were not largely influenced by spatial-temporal changes but rather data itself. On the other hand, the study found that Zipf’s law is not universal in the case of using location-based social media data. Compared to city numbers extracted from nightlight imagery, the study found out the reason why Zipf’s law does not hold for location-based social media data, i.e. due to bias of customer behavior. The bias mainly resulted in the emergence of natural cities were much more frequent than others in certain regions and countries so that making the emergence of natural cities was not exhibited objectively. Furthermore, the study showed whether Zipf’s law could be well observed depends not only on the data itself and man-made limitations but also on calculation methods, data precisions and scales and the idealized status of observed data.

▼ Clean energy and energy supply have become a concern worldwide, for energy itself is deemed a strategic trading commodity. This inquiry explores whether the consideration of cross-border interconnection of transmission grids at a large-scale along with unrestrained legally-secured power transit might play a significant role in solving such a concern whilst contributing to achieve sustainable development.
Despite potential benefits of such a configuration, power grid interconnection is far from being the standard at international level. Although legal doctrines and rules have been developed for protecting international energy-related investments, power-trading and power transit remains inadequately regulated and subjected to political whims and calculations.
By using a thematic approach to three selected case-studies, the research delves into the Brazilian scheme to set up an energy mix based mostly on renewable sources and its relationship with transmission grid expansion processes. Despite failing to create a single power market, the European Union is worth analysing as the most advanced regulatory model for transnational power transit. Lastly, a non-integrated developing area: South America is considered as a suitable regional context in which testing the research’s argument.
This research explores, therefore, from a legal perspective, the paradoxical phenomenon of power grid isolation and looks for an explanation about why it still prevails internationally. Specifically, it addresses the question of what international legal mechanisms could be employed to remove barriers – whether internal or external - hindering cross-border grid interconnections, thus facilitating power-trade and transit as well as to take advantage of opportunities for energy efficiency capable to secure ‘green’ energy supply, reduce atmospheric emissions and, ultimately, targeting sustainable development, at least, in regional contexts.
The thesis advances the proposition that cross-border power grid interconnection coupled with an international legal framework realigned to harmonise energy mixes may solve the concerns on clean energy and energy security by contributing to the integration of renewable energy technologies at a large-scale and promoting unrestrained power flow and trade across-borders.
As a practical outcome the thesis develops legal recommendations and models of an international declaration and a transnational agreement on grid interconnection and power transit in which the findings of the inquiry are embodied in the form of a set of international legal propositions.

▼ This thesis examines the Treason Felony Act 1848 and the issues it raised when it comes to regulating radical dissent. A detailed analysis of the Hansard debates, and State Trials in Ireland, reveals a story that transcends the accepted narrative of the Irish question. At an intrinsic level, the thesis exposes how a government, a parliament, and the courts understood their commitment to a set of inherited beliefs and long-standing principles designed to limit the exercise of (executive or judicial)
power when regulating radical dissent. The analysis reveals an emerging concentration of executive
power in Cabinet arising from the government’s majority, its growing alignment with the legislature, and the benign response of the courts to intrusions on the constitution and the common
law. As such the story of the Act provides valuable insights into the role
law played (or did not play) in 1848 in limiting the possibility that the exercise of
power may become arbitrary when regulating radical dissent. The thesis shows that beyond its immediate focus, the Act speaks to an older narrative, one that continues to preoccupy us and that concerns the relationship between
law and
power. This narrative reflects a way of thinking and arguing about
law as a system of transmitted ideals, values, beliefs, and (institutional) principles that aim to restrain arbitrary
power; and which we now understand as rule of
law, or as the thesis identifies it, the rule of
law tradition. While elements of this research may have a contemporary resonance, its primary aim is not to draw parallels between regulating dissent today and the events of 1848. Nor is it to arrive at definitive conclusions on the broader nature of the tension between parliamentary sovereignty and the rule of
law. Much like Thompson's conclusions on the Black Act, this episode in constitutionalism cannot carry any universal significance. Nevertheless, the Act and the case of Ireland suggest that when it comes to regulating radical dissent, it is important to acknowledge the role genealogy can play in helping us to reflect critically on how we understand the relationship between
law and
power. They also show that what the rule of
law can achieve depends, in significant part, on context rather than just the characteristics of the
law itself. Together, context and genealogy help us in defining the culture of legality we aspire to, and more importantly the outcomes we seek to achieve when we invoke the rule of
law.

▼ Over the last decades there have been a shift in the power balance between the transnational corporation and the state. This shift is due to the transnational corporation’s power has increased. Therefore, this thesis will examine the impact of the power balance between the state and the transnational corporation on the enforcement of law concerning human right abuses by transnational corporations. It will focus primary on the state’s possibility to enforce its international human rights obligations. In order to find out the impact the power balance has on the enforcement, I will discuss different challenges that could stand in the way for the state due to the power of the transnational corporation or that the state is powerless over the transnational corporation. The result is that the state only has a small possibility of enforcing human rights regulation on the transnational corporation. The reason for this is because the state is relying on the economic opportunities from the transnational corporation and the system is constructed in a manner which made the state powerless in relation to the transnational corporation. The result was therefore that the state has difficulties in enforcing the law concerning human right abuses by transnational corporations. After this conclusion it is quite clear that the power balance between the state and the transnational corporation plays a crucial role in the enforcement of the law concerning human rights abuses by transnational corporations. However, it is possible to make changes in the system so that the power balance between the state and the transnational corporation do not have the same negative effect on human rights and therefore strengthening the protection of human rights.

▼ A padronização figura como uma alternativa importante para a indústria, trazendo redução de custos, aumento de produtividade e de qualidade dos processos e produtos gerados. No setor naval da Bacia do Sudeste, ela apresenta-se de forma mais tímida, uma vez que o volume de embarcações produzidas é muito menor se comparado a indústrias de massa. O presente trabalho apresenta um estudo sobre a padronização na indústria, demonstrando definições importantes relacionadas ao tema, bem como a apresentação de metodologias para a padronização de produtos e processos. De forma a gerar subsídios para a avaliação estrutural de projetos navais, são propostas duas diferentes metodologias, a primeira de cunho naval, proveniente da literatura técnica da área, e a segunda híbrida, baseada em uma norma para estruturas metálicas, que é validada através de uma análise não linear em elementos finitos. É realizado também um estudo preliminar visando desenvolver uma avaliação econômica, que considere diversos custos de fabricação e operação de uma embarcação, bem como contempla os benefícios da padronização. As metodologias mencionadas são utilizadas em três diferentes aplicações, aonde são propostas diversas configurações para o projeto de um painel básico de uma embarcação real, e os resultados destas análises são comparados ao projeto original, dando subsídios para uma avaliação preliminar da viabilidade econômica da padronização. Os dados gerados nestas análises são utilizados como parâmetros de entrada de um algoritmo de ajuste de leis potenciais chamado SLAW®, aos quais são capazes de prever o custo de determinada configuração através do cálculo de alguns parâmetros do projeto, permitindo identificar quais parâmetros são mais importantes na definição do custo do objeto em estudo. Ao final tem-se uma discussão dos resultados obtidos através das ferramentas mencionadas, visando avaliar a importância da padronização no custo da embarcação.
Standardization figure as an important alternative for the industry, bringing cost savings, increased productivity and quality of processes and products generated. In the naval sector of the Southeast Basin, it presents more timid, since the volume of produced vessels is much lower coMPared to mass industries. This paper presents a study on standardization in the industry, demonstrating important definitions related to the topic, and the presentation of methodologies for the standardization of products and processes. In order to generate subsidies for the structural evaluation, of naval projects, two different methods are proposed, the first hybrid, based on a standard for steel structures, which is validated through a nonlinear finite element analysis, and the second from naval sector, belonging to the technical literature. There are also proposed the basis for a methodology for the economic evaluation, which considers various manufacturing and operating costs of a vessel and includes the benefits of standardization. ▼ Resumo: Nessa pesquisa, realizo uma análise sociológica sobre o conceito de estado de direito e mostro as implicações da adoção desse conceito para a formação de uma visão própria do mundo social. Mostro que, se observarmos o estado de direito como uma construção coletiva operada no campo maior do poder, e não como uma formulação doutrinária gerada apenas no universo acadêmico das faculdades de direito, o estado de direito portará muitos significados diferentes, ambíguos e mesmo contraditórios. Mas será precisamente por essas qualidades que serão tão decisivos para a manutenção de uma identidade do poder estatal sob seu emblema. Para compreender o processo histórico através do qual o signo do estado de direito encontra sua supremacia, realizei uma sociologia histórica sobre a ascensão global das elites jurídicas no campo do poder em meio ao processo de decadência do regime militar e a concomitante redemocratização dos anos 1990. Para compreender a ampla gama de significados do estado de direito, decorrentes do caráter coletivo de sua formação, analisei um conjunto extenso de artigos de opinião sobre criminalidade, violência de estado e segurança pública publicados no principal jornal impresso brasileiro desde aquela época, a Folha de S. Paulo. Esses artigos foram escritos por uma variedade expressiva de representantes de elites de diferentes campos sociais, mas prevalentemente por sujeitos com formação acadêmica em direito. Ao reconhecer algumas estruturas compartilhadas entre a maior parte dos debatedores na formação de seus argumentos e discursos, a despeito de tantas diferenças aparentes entre suas perspectivas políticas, busquei os elementos estruturantes de uma teorização própria do social na perspectiva juridicista.
In this research, I perform a sociological analysis of the concept of rule of law and demonstrate the implications of this concept in the formation of a particular vision of the social universe. I demonstrate that, if we focus on its construction as a collective one, operated at the major field of power more than a doctrinaire formula generated mainly inside the academic universe of the law universities the rule of law will hold many different, ambiguous and even contradictory meanings. But it is precisely because of this quality that it will be decisive for the conservation of a state power identity under its emblem. To understand the historical process through which the rule of law symbol reaches its supremacy, it was necessary to perform a historical sociology on the global ascension of legal elites in the field of state power, at the historical process of decay of the military regime and further redemocratization at the 1990s. To understand the amplitude of meanings of the rule of law that stems from its collective character, Ive analyzed an extent ensemble of articles published on the most important brazillian newspaper since that time, the daily Folha de S. ▼ A presente pesquisa tem por objeto de estudo a experiência das sessões de pré-mediação instituídas pelo Poder Judiciário de Pernambuco com o objetivo de investigar, descrever e analisar a estrutura de partição dos interlocutores, mediante a gravação do evento e posterior transcrição e formatação da transcrição para análise do material por meio da abordagem da Análise Crítica do Discurso, em especial, da análise em fala em interação institucional. Como contraponto, verifica-se o que efetivamente na prática a pré-mediação corresponde ao marco prescritivo que o Poder Judiciário de Pernambuco se impôs ao institucionalizar o Sistema Auxiliar de Resolução de Conflitos, formalizado através de Centrais de Conciliação, Mediação e Arbitragem (Resolução n 222/2007, de 04/07/2007; artigos 73 e 74 do Código de Organização Judiciária do Estado de Pernambuco - Lei Complementar Estadual n 100, de 21/11/2007). Deste quadro fático, cristalizam-se questões sociais importantíssimas, em especial para o Direito, vez que se estuda política pública do Poder Judiciário de Pernambuco, recém implementada e ainda não submetida a esse tipo de abordagem. Como também contribui para a nucleação e consolidação de atividades de pesquisa na perspectiva da Análise Cítica do Discurso (ACD) na área do Direito.
This research has the object of study of the experience of pre - mediation sessions imposed by the judiciary of Pernambuco in order to investigate , describe and analyze the partition structure of the interlocutors, by recording the event and subsequent transcription and formatting transcription for analysis of the material by the Critical Discourse Analysis approach , in particular , analysis of speech in institutional interaction. As a counterpoint , there is what effectively in practice the pre - mediation match prescriptive framework that the Judiciary of Pernambuco was imposed to institutionalize the Auxiliary System Conflict Resolution , formalized through Central Conciliation , Mediation and Arbitration ( Resolution No. 222/2007 of 04/07/2007 , articles 73 and 74 of the Code of Judicial Organization of the State of Pernambuco - State Complementary Law No. 100 of 21/11/2007 ) . This factual context , crystallize very important social issues , particularly on the Right , since studying the Judiciary of Pernambuco public policy , recently implemented and not subjected to this kind of approach . But also contributes to the nucleation and consolidation of research activities in view of the Scythian Discourse Analysis ( CDA) in Law .

Não se pode negar que as atuais noções acerca desses três âmbitos do saber apresentam semelhanças quanto ao modo de sua constituição moderna, caracterizados por um racionalismo exacerbado capaz de dissociá-los do aspecto social. Entretanto, o pós modernismo inovou nesses âmbitos criando um espaço de consideração múltipla e interdisciplinar. Nesse espaço são muitas as considerações a serem traçadas, em especial a percepção do outro a partir de práticas discursivas que atuam na formulação de um saber. O Direito, como encarado pelos acadêmicos da área, busca o seu desenvolvimento e de seus institutos, não sob o aspecto externo, mas pelo seu caráter interno, abandonando a consideração do veio social, numa falsa e pretensa ausência de dependência, ignorando a existência desse universo. Entretanto, o fenômeno jurídico e seus institutos não podem prescindir da compreensão humana e seus fenômenos. Desse modo é que se tornam importantes as considerações sobre as relações de poder, como forma de constituição de um saber, bem como a observação de que é a partir de uma nova leitura e compreensão da história do direito, que se pode vislumbrar meios para que se propicie um espaço de negociação cultural no próprio direito, retomando, desse modo, seu papel de centralidade social
Culture , history and law keep close relationship as a way of incorporating a company. One can not deny that the current notions about these three areas of knowledge keep similarities as to how its modern constitution, characterized by an exaggerated rationalism able to dissociate them from the social aspect. However, postmodernism innovated in areas creating a space for multiple and interdisciplinary consideration. In this space there are many considerations to be drawn, especially the perception of others from discursive practices that operate in the formulation of knowledge. The law , as seen by academic area , seeks its development and its institutes , not under the external appearance but by its internal character , leaving the consideration of the social came on a false pretense and lack of dependency , ignoring the existence of such universe. However, the legal phenomenon and its institutions can not ignore the human understanding and its phenomena. ▼ Many complex biological systems, such as blood and polymeric materials,
can be approximated as single constituent homogeneous fluids whose properties
can change because of the chemical reactions that take place. For instance, the
viscosity of such fluids could change because of the chemical reactions and the
flow. Here, I investigate the pulsatile flow of a chemically-reacting fluid whose
viscosity depends on the concentration of a species (constituent) that is governed
by a convection-reaction-diffusion equation and the velocity gradient, which can
thicken or thin the fluid. I study the competition between the chemical reaction
and the kinematics in determining the response of the fluid.
The solutions to the equations governing the steady flow of a chemicallyreacting,
shear-thinning fluid are obtained analytically. The solution for the velocity
exhibits a parabolic-type profile reminiscent of the Newtonian fluid profile, if
the fluids are
subject to the same boundary conditions. The full equations associated
with the fluid undergoing a pulsatile flow are studied numerically. A comparison
of the shear-thinning/chemical-thinning fluid to the shear-thinning/chemicalthickening
fluid using a new non-dimensional parameterâÂÂthe competition number
(CN) shows that both the shear-thinning effects and the chemical-thinning/thickening
effects play a vital role in determining the response of the fluid. For the parameter
values chosen, the effects of chemical-thinning/thickening dominate the majority
of the domain, while the effects due to shear-thinning are dominant only in a small
region near the boundary.

▼ The Navier-Stokes equations can be expressed in terms of the primary variables
(e.g., velocities and pressure), secondary variables (velocity gradients, vorticity, stream
function, stresses, etc.), or a combination of the two. The Least-Squares formulations of
the original partial differential equations (PDE's) in terms of primary variables require
C1 continuity of the finite element spaces across inter-element boundaries. This higherorder
continuity requirement for PDE's in primary variables is a setback to Least-Squares
formulation when compared to the weak form Galerkin formulation. To overcome this
requirement, the PDE or PDE's are first transformed into an equivalent lower order
system by introducing additional independent variables, sometimes termed auxiliary
variables, and then formulating the Least-Squares model based on the equivalent lower
order system. These additional variables can be selected to represent physically
meaningful variables, e.g., fluxes, stresses or rotations, and can be directly approximated
in the model. Using these auxiliary variables, different alternative Least-Squares finite
element models are developed and investigated.
In this research, the vorticity and stress based alternative Least-Squares finite
element formulations of Navier-Stokes equations are developed and are verified with the benchmark problems. The Least-Squares formulations are developed for both the
Newtonian and non-Newtonian fluids (based on the
Power-
Law model) and the effects of
linearization before and after minimization are investigated using the benchmark
problems. For the non-Newtonian fluids both the shear thinning and shear thickening
fluids have been studied by varying the
Power-
Law index from 0.25 to 1.5. Also, the
traditional weak form based penalty method is formulated for the non-Newtonian case
and the results are compared with the Least-Squares formulation.
The results matched with the benchmark problems for Newtonian and non-
Newtonian fluids, irrespective of the formulation. There was no effect of linerization in
the case of Newtonian fluids. However for non-Newtonian fluids, there was some
tangible effect of linearization on the accuracy of the solution. The effect was more
pronounced for lower
power-
law indices compared to higher
power-
law indices. And
there seemed to have some kind of locking that caused the matrices to be ill-conditioned
especially for lower values of
power-
law indices.

▼ Since their introduction to the petroleum literature in 2008/2009, the stretched exponential (SE) and the
power-
law exponential (PLE) relations have become the "conservative" standard for time-rate (decline curve) analysis of well performance data from low/ultra-low permeability reservoirs. The origins of the SE relation can be traced to Rudolf Kohlraush circa 1854; however, its use as an expression for time-rate production data analysis essentially began in 2009 with Valkó. The PLE time-rate relation, on the other hand, was derived empirically (and independently) from observations of well performance data by Jones in 1942 and by Ilk and Blasingame in 2008. To date, there is no "proof" of the SE/PLE from a theoretical basis; however, there are many references devoted to the characteristic functions which have been proposed or derived from the given form of these relations.
In this work, we attempt to provide analytical and semi-analytical bases/relations for the SE/PLE functional form to deliver insight on its mathematical behavior and to offer an understanding of its performance as a production forecasting tool. Our first approach consists on approximating the SE/PLE relation by a truncated sum-of-exponentials providing that the SE/PLE model behave as a linear superposition of exponentially decaying functions. For completeness, we extend this work to approximate the hyperbolic and modified hyperbolic time-rate relations with this mentioned sum-of-exponentials function.
Next, we develop numerical approximations of the SE/PLE relation in the Laplace domain using three approaches — using the Taylor series expansion, the Laguerre quadrature, and applying the methodology proposed by Blasingame which transform a piecewise
power-
law function into the Laplace domain. Our goal in this section is to use the Laplace transform and the convolution identity to resolve the SE/PLE decline model in the Laplace domain with the perspective that there may be some sort of diagnostic capability or another sort of mathematical identity, which in the process, may arise.
The last part of this work is devoted to "reverse engineer" the flowing bottomhole pressure required to generate a specific SE/PLE case using numerical reservoir simulation. By means of the pseudosteady-state flow equation, the material balance equation, and a prescribed time-rate model (for our case, the SE/PLE, and the hyperbolic time-rate relations), we are able to get a mathematical expression for the flowing bottomhole pressure as a function of time. This mathematical model will be compared against well performance obtained from numerical reservoir simulation. This part of the "reverse engineering" approach provides a "proof of concept" of the validity of the SE/PLE time-rate relation and corroborates the derived functional form of the flowing bottomhole pressure.

▼ Growing energy demand has led to the focus being shifted to unconventional reservoirs. One such reservoir type is shale gas. The introduction of hydraulic fracturing has helped make production from shale gas reservoirs economical. But there are a number of difficulties in accounting the reserves for a shale gas reservoir. The low permeability of shale increases the time taken for the pressure transient to hit the external boundary. Thus an understanding of the decline trend during the early transient period would help improve the forecast. Newer analytical tools available for decline curve analysis help improve forecast by obtaining a better match for decline trends observed during early transient period. The forecast made using production data of a reservoir producing under early transient period leads to an over estimated value of reserves. The first step in this work is directed towards understanding the trend exhibited by decline rate (D) and decline exponent (b) during early transient period and it was observed that these values were not constant during this period. Production data was generated analytically by solving respective flow equations in Laplace space. Then the inversion from Laplace space to real space is done by Stefhest algorithm. Using this data a study of the trends for decline exponent (b) for radial and linear flow was conducted and the same was done for dual porosity system. Various decline curve analytical tools were analyzed which include Arp’s,
Power Law Loss Ratio and Stretched Exponential. It was found that modified
power law loss ratio and
power law loss ratio have a reliable forecast for reservoirs flowing under radial and linear flow conditions, while stretched exponential has a more reliable forecast in case of a dual porosity system.

via estat´ıstica geom´etrica, onde linhas e c´ırculos desempenhar˜ao o papel das rachaduras
e ser˜ao distribu´ıdas aleatoriamente sobre a superf´ıcie. A escolha das rachaduras ser´a
feita com a distribui¸c˜ao de probabilidade respectiva a cada ente geom´etrico: a linha ou
o c´ırculo. Estas distribui¸c˜oes foram obtidas a partir de uma an´alise da propaga¸c˜ao e,
principalmente, da dissipa¸c˜ao da energia cedida pelo proj´etil. Ao construirmos o disco
fragmentado, calculamos a ´area de cada fragmento e, ent˜ao, chegamos `a distribui¸c˜ao cumulativa
das massas dos fragmentos maiores ou iguais a m, P(m). Observamos que esta
´ultima est´a em grande concordˆancia com os dados experimentais obtidos por T. Kadono

▼ We address transparency of trade spends in consumer goods industry and propose a set of business performance indicators that follow Pareto (80/20) rule – a popular concept in optimization problem solving. Discovery of
power laws in behaviors of travelling sales persons, buying patterns of customers, popularity of products, and market demand fluctuations – all that leads to better-informed decisions among all those involved into planning, execution, and post-promotion evaluation. Practical result of our work is a prototype implementation of proposed measures.
The most remarkable finding – consistency of travelling sales person journey between customer locations. Loyalty to brand, or brand market
power – whatever forces field sales representatives to put at least one product of market player of interest into nearly every market basket – fits into small world model. This behavior not only changes from person to person, but also remains the same after reassignment into different territory.
For industrialization stage of this project, we outline key design considerations for information system capable of handling real-time workload scalable to petabytes. We built our analyses for collaborative processes of integrated planning that requires joint effort of multidisciplinary team. Field tests demonstrate how insights from data can trigger business transformation. That is why we end up with recommendation for system integrators to include Knowledge Discovery into information system deployment projects.
