▼ When new buildings are constructed, the municipality create a zoning plan that regulate the land and water use. While creating the zoning plan, the municipality also needs to complete different investigations so that the land can be built on. The effectivity of the municipal planning process is often criticized and some of the criticism is pointed towards the investigations. Investigations take long time and is often contributing to high costs. The aim of this study is therefore to examine what type of investigations that are made before and during the planning process. The result shows that the investigations occurs during three different periods of the planning process; before the process, during the process and after the consultation of the plan. Many of the investigations are common through every plan, however some of them differs depending on the conditions of the building area.
Vid ny bebyggelse upprättar kommunen en detaljplan som reglerar mark- och vattenanvändningen. Vid framtagandet av en detaljplan krävs även att olika utredningar görs för att marken ska kunna bebyggas. Effektiviteten av den kommunala planeringsprocessen kritiseras och en del av kritiken är riktad mot utredningar. Utredningarna drar ut på tiden och bidrar ofta med höga kostnader vid upprättande av detaljplaner. I denna studie undersöks därför vilka utredningar som görs, både före och under detaljplaneprocessen. Undersökningen är en fallstudie som behandlar sex detaljplaner i tre olika kommuner. De utvalda detaljplanerna är bostadsområden som har vunnit laga kraft och är upprättade enligt Plan- och bygglagen (2010:900). Resultatet visade att utredningar sker vid tre olika skeden i planprocessen; innan planbesked, under planarbetet och kompletterande utredningar efter samrådet. Många utredningar var liknande i samtliga detaljplaner, men en del skiljde sig beroende på förutsättningarna av planområdet.

▼ The aim of this thesis is to examine whether law reforms in the detailed planning process can be an aspect that gets in conflict with the citizens rights to participate in the Swedish planning through dialogue, and how five chosen municipalities are working with citizen participation. To be able to answer the aim of the thesis a literature study and five semi-structured interviews was performed in purpose to get wide-ranging information from municipal officials working with detailed planning handling. Law changes that aims to make the detailed planning process more efficient has been implemented partly to satisfy the needs of dwellings since the detailed planning process among master builders seems to be slow and inefficient, which to the them means higher costs. The requirement on having a detailed planning program was taken away when the new planning law was adopted year 2011. The planning program was including a moment of citizen dialogue. The case studied municipalities have not been affected in this law change arguing that it’s still possible to bring a program if needed. 1st of January 2015 new procedures were implemented in the planning process in purpose to make the process more efficient, where most of the respondents argue that the process don’t have to be more efficient because of the reform, but that the room for citizen dialogue will probably be smaller. The best way of dialogue among municipalities is to include citizens early in the communication process. Nevertheless there are divided meanings whether how there is enough room for dialogue.

▼ Genom 2011 års plan- och bygglag (PBL) infördes krav på handläggningstiden för lov och förhandsbesked, vilket tidigare inte funnits i svensk lagstiftning. Enligt PBL 9:27 ska en ansökan om lov handläggas skyndsamt och sökanden ska meddelas beslut inom tio veckor från det att en komplett ansökan har kommit in till byggnadsnämnden. Syftet med kravet var att effektivisera handläggningsprocessen och minska skillnader i handläggningen mellan olika kommuner. I samband med införandet valde man att inte koppla någon sanktion till kravet med motivet att målet med en effektivare handläggningsprocess skulle uppfyllas ändå. Efter flera anmälningar till JO kan man konstatera att kommunerna i flera fall inte uppfyller kravet på en handläggningstid inom tio veckor. Eftersom det inte finns några sanktioner kopplade till kravet kan kommunerna utan risk ta den tid de anser sig behöva för handläggning. Därigenom motverkas även syftet med en enhetlig bygglovsprövning i Sverige. Syftet med studien är att undersöka hur långa handläggningstiderna är vid bygglov. Genom ett omfattande granskningsarbete av bygglovsärenden hos sju kommuner i Västra Götalands län skulle huvudfrågan om kommunerna handläggningstider uppfyller kravet i PBL 9:27 besvaras. Studien avgränsar sig till ärenden från 2014 med åtgärder gällande nybyggnation av byggnad. Materialet sammanställdes i en datamatris för respektive kommun. Utöver datamatrisen fick respektive kommun besvara ett frågeformulär angående arbetsbelastning. Syftet med formuläret var att koppla resultatet från granskningen till hur arbetssituationen såg ut för de anställda under år 2014. Av de 436 granskade ärendena var det 44 ärenden som inte uppfyllde kravet på en handläggningstid inom tio veckor, vilket motsvarar cirka 10 % av antalet granskade ärenden. Av de ärenden som inte uppfyllde kravet i PBL 9:27 var 32 fastigheter belägna inom detaljplan eller områdesbestämmelser och resterande tolv var belägna utanför detaljplanelagt område. Av de 32 ärendena vars fastigheter var belägna inom detaljplan eller områdesbestämmelse innebar 13 ärenden en liten avvikelse från gällande bestämmelser och resterande 19 överensstämde med detaljplanen eller områdesbestämmelserna. Utifrån resultatet är slutsatsen att kommunerna även fortsättningsvis behöver arbeta med sina handläggningstider. Under granskningen noterades även att det brister i kommunernas dokumentation kring viktiga datum och att kommunerna har olika syn på huruvida en ansökan ska anses vara komplett. Förslagsvis bör tydligare riktlinjer upprättas kring dokumentation och när en ansökan ska anses vara komplett.

▼ The housing shortage is currently one of our most significant societal challenges and the low housing production levels is one of the reasons behind this. The slow planning process is often assigned part of the blame for this and appeals of decisions to adopt detailed development plans for new development is often accused for obstructing and delaying such new development. This study has aimed at clarifying how the right to appeal detailed development plans is being used in practice and – especially – by whom? Furthermore, the study has aimed to clarify what the outcome of the appeals actually is. All 292 decisions to adopt new detailed development plans taken by any of the 26 municipalities of the county of Stockholm in 2013 have been studied. The study has showed that about 27 percent of the decisions were appealed. However, plans of especial importance, either due to containing many housing units or being of special significance to society in other ways were appealed in much greater extent. For example, 5 000 out of the total 10 000 housing units planned were appealed. Furthermore, the study has shown that the people appealing are not representative for the general population neither concerning age, education, purchasing power nor country of birth. However, the appellants have turned out to have an equal gender distribution. The study has also shown that the appeals to a very limited extent jeopardize the implementation of the plans. Although 5 percent of the appealed decisions were revoked, only one was revoked as a consequence of something that an appellant had actually stated in the appeal. In the remaining cases the decisions were revoked due to some other reason "evident from the circumstances". Out of the 689 individual appeals made concerning the studied plans only one and a half per mille (1 of 689) resulted in a revoked decision due to a reason actually stated in an appeal. An additional 2 percent (14 of 689) of the individual appeals resulted in a revoked decision due to some other reason "evident from the circumstances". In all cases where a decision to adopt a plan has been revoked, the municipality has commenced a new planning process in which the municipality assert to meet the demands of the county administrative board or the court. However, no such assertion has been made concerning the demands of the appellants whenever these differ from the ones of the authorities.

▼ Till stor del bygger samhällsplanering på förändring och utveckling av den fysiska miljön, vilket närboende kan ha olika synpunkter på. För att uppnå acceptans vid en förändring är det viktigt att berörda känner delaktighet i processen samt att informationen är tydlig och begriplig även för den som inte är kunnig inom området. Vid framtagande av en detaljplan ska planbeskrivningen ange de organisatoriska, tekniska, ekonomiska och fastighetsrättsliga åtgärder som krävs för dess tänkta genomförande. För att de berörda fastighetsägarna ska kunna läsa och förstå hur de påverkas av en detaljplan måste planbeskrivningen tydligt och begripligt redovisa det tänkta genomförandets konsekvenser. Syftet med studien är att få svar på i vilken omfattning konsekvensredovisning av genomförandefrågor förekommer och om kraven i 2011 års Plan- och bygglag (PBL) kan anses vara uppfyllda. PBL-kommittén konstaterar år 2005 att beskrivningarna av genomförandet av detaljplaner många gånger är bristfälliga eller saknas helt. Införandet av en ny PBL den 2 maj år 2011 syftade bland annat till att stärka genomförandefrågornas status. I studien undersöktes omfattningen av redovisningen med avseende på organisatoriska, tekniska, ekonomiska och fastighetsrättsliga frågor samt om redovisningen sker summariskt eller fastighetsvis. Studien omfattar 84 detaljplaner från Västra Götalands och Stockholms län som var i granskningsskedet under vecka 14 och 15, år 2014. För att få en bild av tillämpningen av 2011 års PBL 4:33 § skapades 19 frågor. Till dessa frågor togs ett antal kategorier/svarsalternativ fram som användes för att klassificera innehållet i planbeskrivningarna. Resultatet visar att det förekommer en stor variation på omfattningen av konsekvensredovisning i planbeskrivningen. Ett genomsnittligt värde på hur vanligt det är med bristfällig konsekvensredovisning (i de applicerbara fallen) i respektive huvudgrupp ger följande resultat: Organisatoriska frågor: 49 % Tekniska frågor: 30 % Ekonomiska frågor: 68 % Fastighetsrättsliga frågor: 13 % Studien visar också att fastighetsvis redovisning förekommer i mycket begränsad omfattning. Med ovanstående resultat är det tveksamt om ett flertal av detaljplanerna uppfyller lagens krav på redovisning och skulle klara en prövning i domstol

▼ Det har nu gått 5 år sedan den nya plan- och bygglagen trädde i kraft, där bland annat det obligatoriska arbetsplatsbesöket infördes. Införandet grundade sig i att myndigheterna tidigare inte hade så bra insyn i byggnationerna runt om i landet. För att öka myndigheternas insyn infördes obligatoriska arbetsplatsbesök. Vid ett arbetsplatsbesök som utförs av en handläggare som representerar byggnadsnämnden är den kontrollansvarige och oftast en byggherre närvarande. Syftet med denna uppsats är att undersöka kontrollansvarigas och byggherrars tankar om kvalitéten på arbetsplatsbesöken motsvarar plan- och bygglagskommitténs intention till att införa obligatoriska arbetsplatsbesök. Detta har gjorts genom intervjuer med kontrollansvariga och byggherrar i två olika kommuner. Intervjuerna visar att införandet av det obligatoriska arbetsplatsbesöket upplevs positivt men det finns fortfarande förbättringspotential. En av utvecklingspotentialerna handlar främst om brist på erfarenhet hos de yngre handläggarna. Det har även framkommit att det råder brist på resurser för att kunna utföra arbetsplatsbesöken i den omfattning som önskas. Det framkommer också att den nya plan- och bygglagen lämnar ett stort utrymme för egen tolkning av lagen, vilket har lett till att det är svårt att avgöra om ett arbetsplatsbesök har utförts på ett korrekt sätt.
It has now been five years since the new Planning and Building Act (Plan- och bygglagen) came into force, in which the mandatory workplace visit was introduced. The introduction was based in that the authorities had not previously had such a good insight into the construction work around the country. To increase transparency, the authorities introduced mandatory workplace visits. At a workplace visit conducted by an officer who represents the building committee is the control manager, and usually a developer present. The purpose of this essay is to examine the control manager´s and developer´s thoughts on the quality of workplace visits corresponds to the Planning and Building Committee's intention to introduce mandatory workplace visits. This has been done through interviews with control managers and developers in two different municipalities. The interviews show that the introduction of the mandatory workplace visit is perceived positively but there is still potential for improvement. One of the development potential is mainly about the lack of experience of the younger officers. It has also emerged that there is a lack of resources to carry out workplace visits, to the extent desired. It also emerged that the new Planning and Building Act (Plan- och bygglagen) leaves a lot of room for your own interpretation of the law, which has led to difficulties to determine whether a workplace visit has been carried out correctly.

▼ The National Board of Housing, Building and Planning have been conducting housing needs assessments since 1995 (Boverket 2015). The latest assessment was conducted in 2015 and showed that 71,000 homes will need to be built annually by 2020. To be able to contribute to building more homes, Willhem AB is carrying out a project called ”Så bygger vi för alla”. As part of the work, this thesis will examine the building rules and how they can contribute to innovation. The purpose of this thesis is to investigate which rules, laws and norms we have to keep to in Sweden regarding housing construction. The aim of the work is to investigate whether the regulatory framework can create creativity amongst the players in the market. This thesis is limited to examining which laws, government policies and eventual municipal requirements that exist in Sweden. Therefore, industry rules, such as the AMA, and contracting regulations, such as AB and ABT, will not be taken into consideration. The survey is also limited to newly built multifamily houses only. Finally, the reference objects that are studied in the thesis will be in Sweden and be limited to being either construction-technical or plan-based innovative and have been recently executed. This thesis is based on the existing regulations and theories from previous studies. The data collected for this survey will be studied from a qualitative point of view. The survey aims to investigate a number of reference objects more thoroughly and conduct interviews with key people involved in the project, which means a qualitative approach is best suited. In 1987, Sweden received a new building legislation according to Örnhall (2017), which has resulted in a transition from specification requirements to functional requirements in order to increase the liberty in housing production. However, according to Örnhall (2017 the new legislation has contributed to a wider picture of the regulatory framework. The National Board of Housing, Building and Planning is the authority that has the overall responsibility for community planning, urban development, construction and housing (Nordstrand 2008). The most important laws and government policies that the social planning sector primarily have to obey are the Planning and Building Act (PBL), the Planning and Building Regulation (PBF) as well as and the Swedish National Board of Housing, Building and Planning (BBR) (Örnhall, Swedish Construction Service 2017a). The Planning and Building Act (SFS 2010:900), PBL, regulates the planning for land and water whilst the responsibility for maintaining the regulations lies with the municipalities. The purpose of PBL is to promote social development for long-term, equal, social and environmental sustainable development for today’s society and future generations (SFS 2010: 900). ▼ Green building design and technology has been developed to lower the impacts of buildings on the environment while maintaining, and in some cases improving all the functions and values of a traditional building. Although the initial costs of green buildings are higher than those of traditional buildings, increased performance and efficiency means that green buildings are more cost effective in the long-term. However, because of these higher initial costs and other barriers such as knowledge barriers, behavioural barriers, and regulatory barriers, uptake is still low in many countries, including New Zealand. Local government and the profession of planning have revealed interests in managing green building uptake. Therefore, the objective of this research is to investigate whether planning provisions in New Zealand are an effective way of increasing green building design and technology uptake. To conduct this research, a mixed methods approach was used. This included performing a plan analysis, a Section 32 report analysis, a hearing report analysis for the Proposed Auckland Unitary Plan and the Christchurch Replacement District Plan. Interviews were also carried out with representatives from these councils and the New Zealand Green Building Council. The findings of this research was that mandatory provisions written into unitary/district plans can be effective in increasing green building uptake. However, Section 18 of the Building Act prevents them from doing so. Therefore, the most effective methods at this time are incentive based schemes such as reduced resource consenting time and costs for green building consents, and the use of height and density bonuses. In conclusion, in the current regulatory environment, planners cannot effectively implement mandatory green building provisions. However, they can effectively manage non-mandatory provisions for increasing green building uptake. If in the future planners were to be able to successfully execute mandatory provisions to increase green building uptake, then Section 18 of the Building Act would need to be amended. For implementing mandatory green building provisions in the future, it is recommended that an incremental, step-by-step approach is used so as to avoid unnecessary stress on homeowners and developers.

▼ Med den nya plan- och bygglagen (PBL) som trädde i kraft den 2 maj 2011, blev det möjligtatt redovisa fastighetsindelningsbestämmelser i en detaljplan på motsvarande sätt somgjordes genom fastighetsplan i 1987 års PBL. Den särskilda planformen fastighetsplan togsdärmed bort. Syftet med de nya bestämmelserna var att förenkla tillämpningen.Bestämmelserna möjliggör en mer detaljerad reglering i detaljplan, men medför också enskyldighet att göra en prövning redan i planarbetet enligt lagvillkor som finns utanför PBL.Syftet med detta arbete var att bidra med ny empiri avseende hur och i vilken utsträckningsvenska kommuner har tillämpat bestämmelser om fastighetsindelning i plan- ochbygglagstiftningen, samt vilken betydelse tillämparna haft för implementeringen avfastighetsindelningsbestämmelser i plan- och bygglagstiftningen. Genom att tillämpa ettimplementeringsperspektiv är avsikten att bidra med ett nytt perspektiv på tillämpningen avplan- och bygglagstiftningen.Målsättningen var att genom att undersöka och besvara min frågeställning vidareutveckladenna nyvunna kunskap i form av ett förslag till en metodbeskrivning för tillämpningen avlagstiftningen. Då examensarbetet utförts på Halmstads kommunsSamhällsbyggnadskontor var tanken att slutprodukten ska vara ett användarvänligt redskapför dem vid tillämpande av bestämmelser om fastighetsindelning. Metodbeskrivningenresulterade i ett flödesschema och en checklista.En fallstudiemetod tillämpades där implementering av fastighetsindelningsbestämmelservar det ”fall” som studerades och analysenheten bestod av Sveriges 290 kommuner.Datainsamling har skett genom en webbaserad enkät till landets alla kommuner.Det är endast drygt ett år sedan nya PBL trädde i kraft och det är fortfarande tidigt att dranågra slutsatser kring lagstiftningens genomslag. Mina slutsatser är att kommunerna inteanvänder sig av bestämmelserna i så stor utsträckning. Majoriteten av de bestämmelser sominförs avser fastighetsindelning och gemensamhetsanläggningar. Lantmäteriet spelar ennyckelroll vid tillämpandet av bestämmelserna, det är oftast lantmäteriet som prövar attbestämmelsen är förenlig med villkor i förrättningslagstiftningen. Och i de fåtal fall man tagit fram rutiner har man låtit lantmäteriet utarbeta dem. Tillämparna inverkar på implementeringen av lagstiftningen främst på två vis. För det första genom att tillämparna inte till fullo förstår lagparagraferna som reglerarfastighetsindelningsbestämmelser. Konsekvensen av det är att nödvändig villkorsprövninginte görs eller att kommunerna inte använder sig av fastighetsindelningsbestämmelser överhuvudtaget. För det andra genom att det är oklart vilka tillämparna av lagparagrafenfaktiskt är. Det innebär att implementeringsprocessen på lokal nivå kommer att tolkas iljuset av olika professionella perspektiv, exempelvis arkitekter, fysiska planerare, ingenjöreroch samhällsplanerare med en mängd olika utfall. I viss mån påverkas tillämparna av kulturoch tradition hur man tidigare arbetat med fastighetsplan i kommunen.

▼ 1 januari 2015 infördes en ny paragraf i plan- och bygglagen som säger att de kommuner som avser att ingå exploateringsavtal ska upprätta riktlinjer som anger förutsättningarna för hur dessa avtal skrivs. Riktlinjerna ska ange vilka mål som finns samt hur kostnader, intäkter och andra åtaganden ska fördelas mellan parterna som ingår avtalet. Drygt ett år har gått sedan den nya bestämmelsen infördes och flera av landets kommuner har nu upprättat dessa dokument. Studien syftar till att undersöka hur landets kommuner hittills tillämpat regeln i plan- och bygglagen 6 kap. 39 §. Avsikten är att kartlägga vilka kommuner som har antagit riktlinjer för exploateringsavtal, vad dessa riktlinjer innehåller, hur de är utformade samt vilka åtaganden, intäkts- och kostnadsfördelningar som tydliggörs i dem. Sveriges samtliga 290 kommuner har kontaktats varav 193 kommuner har svarat på frågan om de antagit riktlinjer eller inte. De riktlinjer som har tagits med i studien är de som författarna tillhandahållit mellan datumen 2016-03-16 och 2016-04-16 och som antagits efter lagändringens ikraftträdande, det vill säga efter 2015-01-01. Totalt tillhandahölls 37 antagna riktlinjer. Texten i riktlinjerna kan enligt studien delas upp i följande tre huvudkategorier: - Generell informativ text som inte enbart är knuten till kommunen i fråga - Kommunspecifik informativ text - Text som tydliggör hur kostnader och andra åtaganden ska fördelas mellan kommun och exploatör i exploateringsavtal Den sistnämnda av de tre huvudkategorierna kan delas upp i ytterligare 33 underkategorier för att belysa vilka åtaganden och kostnadsfördelningar som tas upp i de olika riktlinjerna. Studien tyder på att flera kommuner har börjat tillämpa plan- och bygglagen 6 kap. 39 §. Riktlinjernas innehåll och omfattning skiljer sig åt mellan kommunerna. Slutligen tyder resultatet på att de flesta kommuner i sina riktlinjer tydliggör vilka åtaganden och kostnadsfördelningar som gäller mellan kommunen och exploatören vid ingående av ett exploateringsavtal. Ett fåtal av kommunerna tydliggör inte i riktlinjerna vem av kommunen och exploatören som kommer få bekosta eller vidta en åtgärd utan beskriver endast vilka poster av kostnader och andra åtaganden som kommer att behandlas vid själva ingåendet av exploateringsavtal. Ingen av de undersökta riktlinjerna behandlar intäktsfördelning, vilket riktlinjerna ska enligt plan- och bygglagen 6 kap. 39 §.

▼ Modern society generates a growing waste production, associated with natural non-renewable resources depletion. Notably, the
building and construction sectors are believed to consume approximately half of the planet’s resources and to be responsible for around 30 to 50% of waste production. Awareness has grown worldwide, particularly within the themes of sustainable
building and resource consumption. The aim of this thesis is to evaluate the feasibility of the reuse of products in the
building industry and to present recommendations to promote this activity. This research is focusing on the Dunedin context and recommendations are made at the local and national levels.
A literature review has been undertaken where eight factors influencing the reuse of
building products have been identified: solid waste management, deconstruction, design for reuse and other similar design, designing with salvaged products, stakeholders, economic influence, statutory framework, and sustainable
building. In addition, interviews with key informants on the
building and waste industries have been conducted in Dunedin and Wellington to identify the local barriers and opportunities for this activity.
Results have demonstrated that the reuse of
building products is embedded within broader notions such as
building with sustainable
building and heritage buildings, demolition, and construction and demolition waste. There is currently a lack of research on topics relative to the reuse of
building products and a lack of leadership to encourage this activity and educate the New Zealand population accordingly. Although some New Zealand legislation is in theory favourable to this activity, the
building legislation hinders the reuse of products in the structure of buildings. Economic factors are also identified as a critical aspect of this activity as it can be commercial. A set of recommendations in these five areas has been designed to provide a better framework for and to encourage this activity.

▼ The ongoing trend with urban infill often implicates a conflict with urban green areas, which becomes a problem when green areas in cities are declining and when biodiversity is threatened on a global scale. This case study investigates how green areas and existing biological values are prioritized in an area in Malmö where infill is taking place (Översiktsplan för del av Kirseberg). Specifically, planning process and dialogue, on detailed comprehensive planning level, between the municipality and the landowner is analysed and compared with the policy plan for the area. The methods used are semi-structured interviews combining qualitative and quantitative data.The results show that many of the planning policies regarding green areas are prioritized and considered. However, when it comes to preserving existing vegetation and biological values, these policy goals are prioritized lower than the other policies, which leads to postponed conservation measures. Arguments for planning green areas are about structural concerns and attractivity. Municipal planners are concerned about the low amount of green areas and they find that policies and the planning and building act for green areas give a poor support in the planning process.Vague policy goals for green areas make it difficult for planners to balance between the many policy goals they need to consider. Although the actors have common interests and two-sided compromises are done, profit and a high exploitation level are the priorities of the landowner,which leads to fewer green areas. Landownership therefore limits municipal influence to planfor public interests like green areas. Furthermore, the political focus on high exploitation is another reason for this. Insufficient and outdated policies and planning material are also concerns that affects the planning of green areas.Green areas and biological values are not prioritized enough on the detailed comprehensive planning level neither in the policies of the plan, in the planning process nor in other policies. To change this, both planning laws, policies and political will need to prioritize green areas higher. Many studies state that the planning and building act is insufficient for planning green areas that support ecosystem services on private properties. This seems to apply to this case study as well.

▼ This thesis is an investigation into the implications that a warming climate has for the
housing retrofit programme recently completed at Rushenden on the Isle of Sheppey that
was the subject of the EU Interreg research project IFORE (Innovation for Renewal, 2010-
2014). The aim of this thesis is to inform UK public policy on social housing retrofit, as to
whether we are pursuing the correct goal by retrofitting with insulation and air-tightness,
a strategy to conserve heat, rather than one that would also combat summertime
overheating. The community of Rushenden was used as a case study to develop a specific
adaptation strategy for retrofitted social housing in the South-East of England.
Gaps in knowledge were identified relating to the role that insulation and air-tightness
has in reducing or increasing the overheating risk, and the analysis of a wider range of
shading strategies. The measures were discussed with sixteen households during
completion of the adaptations questionnaire and three focus groups. Six households
completed daily a longitudinal comfort questionnaire, over a period of two months.
Monitoring of internal and external temperatures was carried out as part of IFORE but in
addition questions about overheating were included by the author within the three IFORE
questionnaires that were submitted to one hundred households during the timescale of
the project.
Two models were built in ESP-r, a European standard building simulation tool: a singlestorey
and a two-storey house type. Dynamic thermal modelling, incorporating future
weather files, was used to evaluate different specifications of insulation and air-tightness
and the climate change adaptation measures. Future heating and cooling loads were
calculated and the overheating risk was assessed using the adaptive comfort algorithm.
The first results from the simulations showed that the light type of retrofit installed by
IFORE will reduce both the heating load and the cooling load in 2030s, 2050s and 2080s.
On the other hand, a deeper type of retrofit that complies with the Passivhaus standard
U-value for wall insulation, and air-tightness, will reduce the heating load but increase the
cooling load. Despite reduction of overheating risk using the lighter type of retrofit, the
living room of the single storey house will not meet the adaptive comfort set of criteria
and should be classed as “overheating”. The installation of internal white, opaque roller
blinds, will meet the adaptive comfort criteria and eliminate the need for cooling in both
the single and two storey houses. The adaptation measures were discussed in terms of
their practicality, affordability and the interaction between occupant and technology. The
discussion arising from this work is to judge the wider application of its results as a guide
to retrofit decision-making.

▼ Architecture is a creative process that relies on representational tools (drawings, physical scale
models, digital models etc.), which describe what is being designed. Such tools are useful in
showing the position of the solid elements that make up a building, their shape and size, as well
as the physical boundaries of the space. Even though these tools are “immaterial” representations,
they are different to the immateriality that is associated with space when experienced by users.
This research is interested in theoretical debates relating to immateriality as part of the users’
spatial experience and how these can inform the design process.
Firstly, this study discusses the relationship between architecture as a creative process, and the
lived experience of people as a way of consuming space. Space is seen as a product of the design
process and the context in which architecture exists. The particular context that this research is
interested in is that of Bahrain, as a typical example of a geo-cultural part of the world, whose
economic conditions and cultural values are changing fast.
Given that Bahrain is part of the Islamic world, the discussion of the context is extended to Islamic
architecture. The thesis will delve into how Islamic architecture, which is informed by religious
and cultural values, combines both material functions and immaterial aspects. However, the
economic and social transformation that the Gulf region has seen over the last few decades has
impacted on people and their relationship with the everyday space, the city, its design and the
way it is experienced.
Using both the place of dwelling, as a private space, and public spaces in the city, this thesis looks
at the spatial experience of city dwellers to consider how that experience relates to the context in
which those spaces exist. This thesis is particularly interested in the immaterial aspects of the
users’ spatial experience, which is often overlooked or naively assumed to be part of the design
brief. This study uses qualitative research approaches, as it aims to explore people’s lives and to
identify and clarify its underlying meanings. Firstly, case studies from the literature were referred
to in order to gain a sufficient understanding of architecture, culture, context and their impact on
people’s lived experience. Subsequently, fieldwork-based primary research was undertaken using
a variety of methods including semi-structured interviews, focus group discussion, organised
walks with participants and observations.
It is anticipated that the discussion would lead to a better understanding of some of the issues
around immateriality in architecture that could inform architecture as a practice and a discipline.
Such a practice would reflect the social, cultural and environmental conditions of this particular
context. In this respect, the design process will be informed by both material and immaterial
consideration of the users and their context.

▼ Kommunen har möjlighet att med hjälp av en detaljplan reglera användningen av mark- och vattenområden. Detaljplanens planbestämmelser är rättsligt bindande efter att planen har vunnit laga kraft och vad som får regleras med dem anges i 4 kapitlet plan- och bygglagen (PBL). Kapitlet är uttömmande vilket betyder att endast det som står uppräknat där får regleras. Kapitlet ger även krav på planbestämmelsernas tydlighet. I PBL finns även att läsa att det är en kommunal angelägenhet att planlägga mark och vatten vilket leder till att kommunen har planmonopol. I de fall kommunen använder sig av planbestämmelser i en detaljplan som inte har stöd i PBL:s 4 kapitel innebär det att gällande lagstiftning ej följs. Detta kan leda till att trovärdigheten för rättsystemet minskar samt dess otydlighet kan ge berörda fastighetsägare svårigheter att tolka bestämmelsernas innebörd. Tidigare arbeten har visat att kommunen använder sig av planbestämmelser som sträcker sig utanför gällande lagstiftning och i det här arbetet granskas ytterligare 279 planer för att undersöka om det förekommer planbestämmelser som saknar lagstöd eller anses vara otydliga. Bestämmelserna som i denna studie ansetts felaktiga har kategoriserats i fyra olika kategorier efter på vilket sätt de anses vara bristande. En kategori utgörs av planbestämmelser som saknar lagstöd och tre kategorier består av bestämmelser som på olika sätt är otydliga. Resultatet av granskningen visar att närmare hälften av de granskade detaljplanerna innehåller någon eller några detaljplanebestämmelser som inte uppfyller lagens krav på tydlighet eller inte ingår bland de uppräknade bestämmelserna i 4 kapitlet PBL. Studiens resultat visar också att otydliga planbestämmelser förekommer oftare än planbestämmelser som saknar lagstöd. Boverket hävdar att de felaktiga bestämmelserna ska anses ogiltiga men trots det kan förekomsten av dem ge konsekvenser. Orsakerna till dess förekomst kan vara många och ett antal olika lösningsförslag finns, bland annat utökad granskning och hänvisning till lagtext på plankartan vid varje använd bestämmelse.
Local authorities have the opportunity to regulate the use of land- and water areas with a detailed development plan. The restrictions of the plan are legally bound after the plan becomes final and the Planning and Building Act, chapter four regulate what a plan may include. ▼ Den 1 januari 2015 trädde en del ändringar i plan- och bygglagen i kraft. Detta då den dåvarande regeringen ville uppnå en effektivare planprocess, för att öka bebyggandet i riket. Lagändringen påverkade planprocessen samt förutsättningarna till upprättandet av genomförandeavtal. Genom övergångsbestämmelserna lades dock ett förbehåll in, för att reglera i vilka situationer äldre lagstiftning skulle användas. Detta förbehåll är att en detaljplan ska vara ”påbörjad” innan 1 januari 2015. Denna studie syftar till att undersöka när en detaljplan är ”påbörjad”. Studien grundar sig på att nu gällande plan- och bygglag (fortsatt kallat PBL) samt tillämpningen av denna undersöks utifrån olika metoder. För att tolka juridiken kring begreppet, har ett rättsdogmatiskt förhållningssätt använts genom olika tolkningsmetoder. För att få en förståelse för hur juridiken tillämpas har ett rättssociologiskt förhållningssätt nyttjats. Detta har skett genom att en enkätundersökning utförts, där Sveriges samtliga kommuner tillfrågats hur de tolkar begreppet. Undersökningen har påvisat att begreppet ”påbörjats” är oklart. I PBL regleras inte vad en ”påbörjad” detaljplan är. De definitioner som Boverket och regeringen har tagit fram är oklart formulerade. Den enkätundersökning som skickades ut till alla Sveriges kommuner gav ett varierande resultat som styrker teorin om att begreppet ”påbörjad” detaljplan är oklart. De befintliga definitionerna är i behov av förtydligande, för att likrikta kommuners tillämpning av dessa övergångsregler. Enkätundersökningen visade att 67 % av kommunerna tolkat begreppet ”påbörjad” efter de definitioner som Boverket samt regeringen utformat. Det som också framkommit genom studien är att skillnaderna i PBL innan och efter 1 januari 2015 är stora, vilket bland annat innebär att kommunens förutsättningar att upprätta detaljplaner och exploateringsavtal har förändrats.
1st of January 2015 some changes were made in the Planning and Building Act. This was made because of the Swedish government wanted to make the planning process easier. The law changes include the planning process and the development contracts for detailed development plans. The transitional provisions, however, made a reservation to regulate the situations in which older legislation would be used. The regulation is that older legislation should be used if the detailed development plan were initiated prior to 1 January 2015. The purpose of this study is to investigate when a detailed development plan is initiated. The study is based on current legislation and its application, this will be investigated using various methods. To interpret the law about the concept, legal dignity approach has been used through different interpretation methods. In order to gain an understanding of how the law is applied, a legal sociological approach has been used. ▼ The regeneration of urban places is a major force in the landscape of previously declining industrial cities. The processes and policies of regeneration have received considerable research over the years, with a particular emphasis on quantitative indicators to capture large-scale effects. One major change has been the rising role of culture within regeneration. In this thesis, a closer, qualitative view is taken to investigating urban regeneration, to uncover a narrative of two particular and related concerns within cultural urban regeneration. On the one hand, the risks of homogenisation as standardised practices are transferred globally; on the other, the demand for distinctiveness, and for regenerated areas to demonstrate unique and appealing characteristics to mediate global processes, and attract inward investment of economic, social, and human capital.
The thesis focuses on the iconic space of the waterfront, and studies three major regenerating cities in the United Kingdom, studying the dynamics of culture, homogenisation, and distinctiveness. From an initial synthesis of theories, a thematic framework is constructed. The thesis then captures the understanding of those themes as articulated by forty-seven elite actors who work within cultural regeneration in the three case study waterfronts, exposing the continuing impact of place in the face of homogenising forces.

▼ The persistent increase in the price of energy, the clamour to preserve our environment from the harmful effects of the anthropogenic release of greenhouse gases from the combustion of fossil fuels and the need to conserve these rapidly depleting fuels has resulted in the need for the deployment of industry best practices in energy conservation through energy efficiency improvement processes like the waste heat recovery technique.
In 2006, it was estimated that approximately 20.66% of energy in the UK is consumed by industry as end-user, with the process industries (chemical industries, metal and steel industries, food and drink industries) consuming about 407 TWh, 2010 value stands at 320.28 TWh (approximately 18.35%). Due to the high number of food and drink industries in the UK, these are estimated to consume about 36% of this energy with a waste heat recovery potential of 2.8 TWh.
This work presents the importance of waste heat recovery in the process industries in general, and in the UK food industry in particular, with emphasis on the fryer section of the crisps manufacturing process, which has been identified as one of the energy-intensive food industries with high waste heat recovery potential.
The work proposes the use of a dual heat source ORC system for the recovery and conversion of the waste heat from the fryer section of a crisps manufacturing plant to electricity. The result, obtained through modelling and simulation, shows that the proposed technology can produce about 92% of the daily peak electricity need of the plant which is currently 216 kW. Also, the economic analysis shows that the proposed technology is viable (even at an inflation rate of 5.03% and discounted rate of 6%), with a payback period of approximately three years and net present value of over £2.2 million if the prices of electricity and carbon is at an average value of £0.16 and £13.77 respectively throughout the 30 years service life of the plant. The life cycle assessment study shows that the proposed technology can reduce the CO2 emission by 139,580 kg/year if the electricity produced is used to displace that which would have been produced from a conventional coal-fired power plant.

▼ My work, published essays and books listed below, provides new insights into
architects’ approaches to housing design since the beginning of the twentieth century.
Drawing on methods from both history and practice the work uses primarily drawn
building studies familiar in professional journals for comparative analysis. Two
interrelated issues, housing designed to be adaptable (or flexible) and housing
designed for families other than the norm of the static, nuclear family, characterise the
approach to the work implicit through the selection of case studies. A reflective essay
considers the work in the context of attempts to introduce flexible housing typologies
and the potential impact on the role of the architect and the consumer. Further
context is provided in an appendix setting out an annotated chronology of relevant
legislation, reports and recommendations, to raise questions about its complexities
and the contemporary renewed focus on minimum space standards as the primary
tool to improve housing quality.

The aim of this thesis is to inform UK public policy on social housing retrofit, as to whether we are pursuing the correct goal by retrofitting with insulation and air-tightness, a strategy to conserve heat, rather than one that would also combat summertime overheating. The community of Rushenden was used as a case study to develop a specific adaptation strategy for retrofitted social housing in the South-East of England. Gaps in knowledge were identified relating to the role that insulation and air-tightness has in reducing or increasing the overheating risk, and the analysis of a wider range of shading strategies. The measures were discussed with sixteen households during completion of the adaptations questionnaire and three focus groups. Six households completed daily a longitudinal comfort questionnaire, over a period of two months. Monitoring of internal and external temperatures was carried out as part of IFORE but in addition questions about overheating were included by the author within the three IFORE questionnaires that were submitted to one hundred households during the timescale of the project. Two models were built in ESP-r, a European standard building simulation tool: a singlestorey and a two-storey house type. Dynamic thermal modelling, incorporating future weather files, was used to evaluate different specifications of insulation and air-tightness and the climate change adaptation measures. Future heating and cooling loads were calculated and the overheating risk was assessed using the adaptive comfort algorithm. The first results from the simulations showed that the light type of retrofit installed by IFORE will reduce both the heating load and the cooling load in 2030s, 2050s and 2080s. On the other hand, a deeper type of retrofit that complies with the Passivhaus standard U-value for wall insulation, and air-tightness, will reduce the heating load but increase the cooling load. Despite reduction of overheating risk using the lighter type of retrofit, the living room of the single storey house will not meet the adaptive comfort set of criteria and should be classed as “overheating”. The installation of internal white, opaque roller blinds, will meet the adaptive comfort criteria and eliminate the need for cooling in both the single and two storey houses. The adaptation measures were discussed in terms of their practicality, affordability and the interaction between occupant and technology. The discussion arising from this work is to judge the wider application of its results as a guide to retrofit decision-making.

▼ Architecture is a creative process that relies on representational tools (drawings, physical scale models, digital models etc.), which describe what is being designed. Such tools are useful in showing the position of the solid elements that make up a building, their shape and size, as well as the physical boundaries of the space. Even though these tools are “immaterial” representations, they are different to the immateriality that is associated with space when experienced by users. This research is interested in theoretical debates relating to immateriality as part of the users’ spatial experience and how these can inform the design process. Firstly, this study discusses the relationship between architecture as a creative process, and the lived experience of people as a way of consuming space. Space is seen as a product of the design process and the context in which architecture exists. The particular context that this research is interested in is that of Bahrain, as a typical example of a geo-cultural part of the world, whose economic conditions and cultural values are changing fast. Given that Bahrain is part of the Islamic world, the discussion of the context is extended to Islamic architecture. The thesis will delve into how Islamic architecture, which is informed by religious and cultural values, combines both material functions and immaterial aspects. However, the economic and social transformation that the Gulf region has seen over the last few decades has impacted on people and their relationship with the everyday space, the city, its design and the way it is experienced. Using both the place of dwelling, as a private space, and public spaces in the city, this thesis looks at the spatial experience of city dwellers to consider how that experience relates to the context in which those spaces exist. This thesis is particularly interested in the immaterial aspects of the users’ spatial experience, which is often overlooked or naively assumed to be part of the design brief. This study uses qualitative research approaches, as it aims to explore people’s lives and to identify and clarify its underlying meanings. Firstly, case studies from the literature were referred to in order to gain a sufficient understanding of architecture, culture, context and their impact on people’s lived experience. Subsequently, fieldwork-based primary research was undertaken using a variety of methods including semi-structured interviews, focus group discussion, organised walks with participants and observations. It is anticipated that the discussion would lead to a better understanding of some of the issues around immateriality in architecture that could inform architecture as a practice and a discipline. Such a practice would reflect the social, cultural and environmental conditions of this particular context. In this respect, the design process will be informed by both material and immaterial consideration of the users and their context.

It builds on previous work developed in the 2010 Amman Master Plan to propose, a first for the city, sustainable high density mixed use (HDMU) development in three distinct geographical areas in the city. High density mixed use developments conceived as part of the master plan is a new approach for the city of Amman and for Jordan.

▼ This thesis explores the notion of site as a generative basis for architecture. Site is conceived
not only as a plot of land where a building is located, but also as something that is the result of
agency: the architectural intervention. Site is thus constructed with architecture; it is as much a
consequence as a thing.
Still Creek was chosen as a provocative site in which to explore this idea. Once Vancouver's
largest salmon-bearing stream. Still Creek now exists in a barren, degraded state — the result
of a century of urbanization. In its fragmented course from its headwaters to Burnaby Lake,
Still Creek flows above and below ground through a diversity of site conditions, ranging from a
primeval ravine to a polluted industrial area. Recently, sensibilities about the stream have
changed. There are presently a variety of groups interested in Still Creek, not only as a public
amenity, but also as an urban ecosystem. In response, it was proposed that (1) an urban trail
be located along the discontinuous course of the stream, and (2) a facility be located along the
stream that addresses some of the needs of these interested groups.
The Still Creek Interpretive Facility marks both the beginning of the stream and the start of the
urban trail. Located at the edge of the Renfrew Ravine where the stream first emerges from a
subterranean culvert, the building makes apparent the many forces present on the site. An
initial gesture of excavation reveals the culvert and demarcates a constructed and a natural
edge. The constructed edge of the excavation is heightened with a veil of translucent solar
panels that diffuse sunlight and help power the building. A wood screen along the natural edge
of the excavation acts as a foil to the alder forest, allowing the building to maintain a quiet
presence in the ravine as well as creating shimmering views of colour and light. The stream
fills the lowest part of the excavation, mitigating high runoff flows and making a reflective pool
for light, precipitation, and sound. The excavation and screen walls form a vessel into which
mute volumes are inserted, creating a variety of indoor and outdoor spaces, some relating
more to site, others relating more to programme. Exterior building circulation winds through
the whole assembly — an extension of the urban trail — forming a rich experiential descent
from street...through building...to stream beyond...

▼ The influence of consumer activities on the performance of retail locations and retail property market in cities can be critical. This is because where and how retail consumers choose to transact influences the locational performance of retail property markets in cities. This study investigates relationships between consumer movement and the performance of retail property markets (RPM) between 2010 and 2017 in York, Leeds and Newcastle. The study adopts the spatial configuration (street segment) analysis technique to compute consumer movement patterns (CMP) on the sampled cities’ layouts using DepthMapX to obtain the CMP variables; specifically, integration, choice and NACH metrics. The RPM data were sourced from valuation summary lists belonging to the VOA dataset and analysed using MS Access and MS Excel to obtain RPM variables, namely, changes in retail rental value and changes in retail stock across locations. The study investigates the spatial and statistical relationships between the CMP and RPM variables of cities at mesoscales and macroscales using QGIS and SPSS tools, respectively. The spatial investigations visualise locational relationships between changes in RPM variables and the spatial accessibility index of the CMP variables. The statistical analyses adopted Spearman-rho coefficients to investigate the rank correlation between the RPM and CMP variables. Further statistical (multiple regression) analysis were undertaken to estimate the locational performance of the RPM (dependent variable) using the CMP (independent variables) across all the estimable city layouts. Findings show that there are significant relationships between changes in retail rental value and all the CMP variables at York mesoscale, Leeds mesoscale and Newcastle macroscale. The results indicate that the relationship between configured consumer movement and changes in retail rental value are influenced by scale and city characteristics. The research is the first to estimate the location performance of commercial property by way of spatial configuration analysis. The research outputs are useful tools for retail property market actors to make locational decisions on investments, occupation, development and the strategic management of urban retail space. The study recommends further studies on the prospects of spatial configuration analysis and other methods in estimating the future performance of the commercial property market for optimum utilisation and the management of urban resources.
