Tyrimo objektas ir problemos aktualumas Tyrimo objektas. Disertacijoje teisiniu požiūriu tiriamas vienas tarpšakinių teisės institutų – priesaika. Disertacijos tyrimas apima paprotinės ir pozityviosios teisės raidos etapuose susiformavusius teisinius santykius, atsirasdavusius ir tebeatsirandančius priesaikos instituto taikymo ir jo funkcijų įgyvendinimo srityse. Šiame darbe nagrinėjami istoriniai, lituanistiniai šaltiniai; nacionalinių, tarptautinių ir kitų valstybių teisės aktų normos, reglamentuojančios priesaikos institutą, taip pat šią temą nagrinėjanti Lietuvos teisės doktrina. Priesaikos teisinio instituto ir jo socialinio vaidmens tyrimas bendrąja prasme – tai vieno iš seniausių ir gilias tradicijas Lietuvoje turinčio teisinio instituto tyrimas. Priesaikos sampratos (sąvokos) pažinimas yra organiška teisės doktrinos, kaip vienalyčio darinio, dalis, tačiau šio instituto prasmė ir reikšmė teisės normose ir teorijoje (moksle) nėra plačiau tyrinėta. Šiuo tyrimu bandoma atskleisti socialinę teisinę priesaikos esmę, jos evoliuciją ir virsmą į tikrai talpų (vertybių ir atliekamų funkcijų požiūriu) teisinį reguliatorių, kuris laikytinas Lietuvos Respublikos Konstitucijoje įtvirtintų pamatinių vertybių koncentracija, o kartu ir jų veiksnumą užtikrinančiu įrankiu. The subject matter of the research and its relevance The subject matter. In the present paper one of the inter-branch law institutes namely – the oath is being under discussion. The treatment of the problem embraces the development of law from time honored stages up to the present state. Within the period the law terms has changed considerately and the process is still in progress, especially in the sphere of the implementation of its functions. In the given paper the objects of research are the historical and native Lithuanian sources; i.e. the norms of national, international legal acts and the acts of other states in which the oath institution is called upon, as well as the Lithuanian law doctrine dealing with this problem. The general approach to the research of the juridical Oath Institution and its social significance has a long standing tradition in Lithuania. The cognition of the concept of the oath is an organic element of the law doctrine, as an integral formation, however has never yet received a deeper research either in legal norms or in theory. The given paper is an attempt to reveal the juridical and social essence of the oath, its evolution and transformation into a really meaningful juridical regulation of values and its fitting functions. Le serment constitue un instrument privilégié pour étalonner la prégnance du domaine religieux alliée à l'instabilité du contexte politique qui caractérise la période Moderne (XVIe-XVIIIe). Il apparaît ainsi que les époques particulièrement troublées que représentent les guerres de religion puis la Révolution française connaissent un emploi permanent du serment destiné prioritairement à renforcer la solidité des liens et des accords. L'utilisation de l'institution connaît une évolution sans précédent dès les guerres de religion, mettant ainsi en lumière la nécessité d'exprimer une adhésion idéologique au côté de la traditionnelle garantie de fidélité. Durant cette période douloureuse et tout particulièrement son épilogue, le serment dessine une unité nationale désormais articulée prioritairement autour du lien politique, la dimension religieuse, bien que demeurant fondamentale, passant alors au second plan. La Révolution quant à elle, constitue l'âge d'or du serment d'adhésion, qui permet à « l'homme nouveau » d'apporter la sacralité indispensable à la régénération à une société qu'il veut déchristianisée. Au cours de cette période, le serment joue un rôle d'exclusion tout en servant de fondement à la répression révolutionnaire. Surtout, l'institution recèle des effets destructeurs, même lorsqu'elle est censée constituer l'outil créateur de la nouvelle Cité. Le recours au serment durant les périodes considérées met donc en lumière une construction de l'Etat Moderne par une sacralisation de la politique. Toutefois, l'essence même de l'institution résidant dans ses racines religieuses, un serment laïc ou servant de fondement à une société strictement laïque ne saurait exister sous peine de devenir vide de sens ou de se muer en une simple promesse.

The oath represents a key instrument for calibrating the prominence of the religious sphere combined with the political situation that characterizes the early modern period (16th-18th century). Thus, it appears that particularly troubled times -religious wars, then the French revolution- present a regular use of the oath, primarily intended to reinforce the solidity of bonds and agreements. The use of the institution experiences an unprecedented evolution as early as the religious wars, thus highlighting the need to express ideological allegiance along with the traditional guarantee of loyalty. During that painful period and especially at its conclusion, the oath conveys a national unity now primarily revolving around the political bond; the religious dimension, although still fundamental receding into the background. The Revolution is a golden age for the oath of allegiance, which enables “the new man” to provide the indispensable sanctity for the regeneration of the society he wishes to be dechristianized. During the period, the oath plays the role of exclusion while laying a foundation for the revolutionary repression. ▼ Political oaths were widespread in medieval times, but all over Europe their use dwindled in the early modern period, resulting in the institution being dismantled in many states. In previous research, this decay has been explained by pointing to the emergence of the state in this period, through processes such as bureaucratization, nationalization, and confessionalization, and, later, secularization. However, as some oaths are still in use in modern state systems, the swearing of them seems to be compatible with modern – bureaucratized, nationalized, and secularized – states. If nothing else, this indicates that the standard model for explaining changes in European oath-taking must be questioned. The main purpose of this dissertation is to analyse why political oaths were used in Sweden in the sixteenth and seventeenth centuries, as well as to explain why the usages changed. It is argued that oaths were performative means of instilling trust in a political relationship. Trust was accomplished by an oral utterance, during which the swearer claimed the position of a trustworthy subject. The study encompasses not only how the force of oaths was created, but also how uncertainty regarding the subject’s trustworthiness was handled, by examining its usage in coronations, rebellions, wars and political meetings. The dissertation has four conclusions. First, not only the use of oaths but also the oath event itself underwent changes during the period studied, leading to changes in its performative force. Second, the shaping of the oath event depended on the degree of uncertainty in the specific political relationship. Third, while in the sixteenth century oaths were used to establish trust in political relationships, in the seventeenth century they were re-directed to establish control. Fourth, the shift from trust to control reflected the rise of a written political culture. When political relationships shifted from being characterized by presence and personal contact, to being characterized by distance and impersonal delegation, written oaths were better suited to the situation. Ultimately, the written form transformed the action, for the ability of a political oath to instil trust was linked to its orality. What a written oath could do, though, was help establish control.

▼ The overall objective of the research presented in this dissertation is to establish ways in which the Red Scare and Cold War eras impacted social studies education in Georgia from the 1930s through the 1960s. My position is that the decision by the Communist Party’s international leadership to support African Americans in the southern United States through legal defense and the organization of sharecroppers’ unions impacted white segregationists’ interpretation of subversive activity as being inclusive of racially liberal ideas. Social studies education in Georgia was affected by the policies and curriculum decisions made in the context of Red Scare and Cold War influences. An analysis of the historiography of communism in the United States reflects the changing tenor of uncertainty and fear that gripped Americans when it came to radical ideas contrary to the democratic capitalist tradition. Historians tend to agree that the Party’s efforts in the African American community had minimal impact. However, the calibration used by scholars to measure “impact” should be adjusted to look beyond changes in Communist membership numbers and whether the lives of blacks in the South improved. My focus in this study is the peripheral impact the efforts of the Communist Party had on southern white segregationists who began to equate racially liberal actions with subversive activity. Chapters in this dissertation focus on the formation of the Communist Party’s Black Belt Self-Determination Thesis and how it was carried out in the American South, national efforts to combat communist infiltration through loyalty oaths and textbook reviews, and the evolution of civic and democratic education initiatives in social studies. Georgia’s scandalous episode of the early 1940s involving Eugene Talmadge’s manipulation of the state’s educational system is presented as an example of how the concepts of subversion and racial liberalism were equated in an effort to maintain segregation in the state. These chapters provide evidence of the Red Scare and Cold War eras’ impact on social studies education in Georgia from the 1930s through the 1960s. Advisors/Committee Members: Dr. Chara H. Comment croire ou mettre en doute les propos des individus qui montent à la tribune lors d’un procès de l’Athènes classique ? Les orateurs qui prennent la parole lors d’une affaire mobilisent tout un éventail de preuves pour construire leur discours comme crédible aux yeux des juges. Ces procédures constituent le dispositif de vérité, au milieu duquel les témoins se situent en bonne place dans les discours judiciaires, c’est-à-dire les textes des dix auteurs sélectionnés comme le canon des orateurs attiques des Ve et IVe siècles avant Jésus-Christ (Antiphon, Andocide, Lysias, Isocrate, Isée, Démosthène, Eschine, Hypéride, Lycurgue et Dinarque). Si aucune théorie de la preuve ne se fait jour dans ces corpus, la figure du témoin judiciaire apparaît comme centrale, comme l’illustrent les très nombreuses convocations testimoniales. Le rapport entre témoignage et documents écrits montre également la valeur probante des dépositions. Qu’est-ce qui, alors, permet aux paroles d’un témoin d’être présentées comme véridiques ? Les déposants peuvent être crus car ils engagent leur responsabilité, du fait d’une possible punition divine, s’ils prêtent serment, ou humaine, si l’adversaire lance un procès pour faux témoignage. En outre, les témoins doivent avoir une connaissance directe des événements en question. Mais cette exigence est paradoxale : ils sont le premier intermédiaire entre l’auditoire et les faits. Les plaignants rappellent donc fréquemment aux juges des points déjà connus, afin d’en faire leur propres témoins. Ils cherchent aussi à effacer leur propre rôle dans l’argumentation, en désignant leurs propos comme simples et en minimisant leur expérience oratoire.

How did the Athenians trust or doubt the words of someone who came up to the tribune during a trial? The speakers used a whole range of evidence to make their speech credible for the judges. All these techniques and the witnesses were a very important part of this process can be qualify as the truth apparatus in the orators’ speeches, i.e. the texts from the ten authors chosen as the canon of the Attic orators of the 5th and 4th centuries B.C.: Antiphon, Andocides, Lysias, Isocrates, Isaeus, Demosthenes, Aeschines, Hyperides, Lycurgus, and Dinarchus. Even if no proof theory has been found out, the witnesses were crucial in the courtroom, as we can see from the many times a litigant called a witness to testify. The relation between testimony and written documents also shows the convincing value of the witness statement. Therefore, to what extent could a testimony be considered as truthful? The witnesses were usually trusted because their responsibility was at stake: they could incur a divine punishment, if they swore an oath, or a humane penalty, if they were put on trial for false witnessing. Besides, the witnesses must have a direct knowledge of the events. Yet, there was a paradox in this requirement: they were the first part of the demarcation between the facts and the public of the trial. ▼ Children are often involved in the legal system as victims of maltreatment, and their disclosure of adult wrongdoing is necessary to initiate effective legal responses and protect them from continued abuse. However, external pressures and children's perceptions of the consequences of truth-telling (e.g., punishment, removal from the home) may result in the delay of disclosure or failure to disclose altogether. Research examining techniques for promoting children's truth-telling has almost exclusively relied on explicit requests to tell the truth (e.g., a promise, reassurance, assessments of conceptual knowledge and moral discussions), and the success of these techniques has varied. The present study examined the benefit of priming honesty (i.e., indirectly or non-consciously activating the goal of honesty) on children's disclosure of an adult's transgression. One-hundred fifteen 6- to 9-year-olds (M _age = 7.47 years) participated in a first aid/safety event during which an adult (mother or stranger) engaged the child in play with a box of forbidden puppets, broke a puppet that was designed to break, and requested that the child keep it a secret. Before responding to questions about the puppets, children were either (1) primed for the goal of honesty (prime condition), (2) asked to promise to tell the truth (oath condition), or (3) not provided with any further instructions or information (control condition). Then, children were asked open-ended, direct, and suggestive questions about whether they or the adult touched, played with, or broke any puppets. Regression analyses revealed that children’s truthful disclosures to direct questions increased when children witnessed a stranger transgressing rather than their mother. However, children’s truthful disclosures across the question types did not differ by age or when a prime relative to a promise to tell the truth was used. Results advance our understanding of how children disclose negative events and the effectiveness of different techniques (including a novel technique) in encouraging children’s true disclosures of a parent or stranger’s transgression. Magistro baigiamajame darbe aptariamas Lietuvos teisinėje sistemoje įtvirtintas apkaltos procesas – aukščiausių valstybės pareigūnų konstitucinės atsakomybės forma. Darbe nagrinėjami įvairūs apkaltos proceso elementai: aptariamas teisės pažeidimas kaip konstitucinės atsakomybės taikymo pagrindas, apkaltos proceso eiga ir jos reglamentavimo raida Lietuvoje, apkaltos proceso teisinių pasekmių klausimai. Darbe aptariama tiek konstitucinė apkaltos proceso samprata, tiek ir ordinarinėje teisėje įtvirtintas reguliavimas, taip pat praktinio pobūdžio problemos bei klausimai, kilę apkaltos procesą reglamentuojančias normas taikant praktikoje. Nagrinėjama, ar ordinarinėje teisėje įtvirtintas reguliavimas visada atitinka konstitucinę apkaltos sampratą, kokių priemonių vienu ar kitu metu turėjo imtis įstatymų leidėjas, siekdamas užtikrinti Seimo statute ar kituose teisės aktuose išdėstytų apkaltos proceso elementų atitiktį Konstitucijai. Darbo pabaigoje, atsižvelgiant į Europos Žmogaus Teisių Teismo sprendimą byloje Paksas prieš Lietuvą bei šio sprendimo įgyvendinimo problematiką, aptariami įvairių subjektų pateikti pasiūlymai, kaip turėtų būti keičiami vidaus teisės aktai, susiję su apkaltos proceso teisinių pasekmių klausimu.

This master thesis concentrates on impeachment procedures as it is a form of constitutional liability of highest state officials in Lithuania. There is a number of aspects of the impeachment procedure that are analysed in this paper: a violation of a law as a ground for applying constitutional liability, elements of impeachment procedure and the evolution of them through the years since Constitution of Lithuania was adopted in 1992, the questions concerning legal consequences of impeachment. In this paper it is analysed both the constitutional concept of impeachment and it‘s regulation in ordinary law and also the problems and questions that arose in practice when the legal norms regulating imeachment have been applied. Part of the research concentrates on whether the regulation in ordinary law is always compatible with the constitutional provisions and also what steps legislative had to make to make sure that Statute of Seimas or other acts are in accordance with Constitution. As European Court of Human Rights declared in it‘s verdict of the case Paksas v. Lithuania that Lithuania violated Article 3 of Protocol 1 of European Convention on Human Rights and Fundamental Freedoms by establishing unconditional and permanent prohibition to participate in parliamentary elections for a person guilty of breach of oath and thus removed from office, the proposals made to amend the Lithuanian legal system are also investigated.

▼ Η παρούσα μελέτη επιχειρεί να προσεγγίσει το «μη ομόσαι όλως» στα εξωβιβλικά κείμενα και στη βιβλική γραμματεία, κυρίως μέσω της ερμηνευτικής και θεολογικής ανάλυσης των διαβεβαιωτικών όρων και εκφράσεων. Στο σημείο αυτό κρίνεται απαραίτητο να διευκρινίσουμε ότι δεν γίνεται έρευνα στα εξωβιβλικά κείμενα και στην Παλαιά Διαθήκη αλλά επιχειρείται μια μέθοδος συσχετισμών ανάμεσα στους όρκους και στους διαβεβαιωτικούς τύπους των κειμένων αυτών. Ειδικότερα αποσκοπεί, πρώτον, να παρουσιάσει τη σημασία του όρκου στη λατρευτική, κοινωνική, οικονομική και πολιτική ζωή των αρχαίων λαών (Ασσύριους, Βαβυλώνιους, Αιγυπτίους, Χετταίους, Έλληνες) και στο βιβλικό Ισραήλ. Δεύτερον, να αναδείξει τη σημασία της χρήσης των βεβαιωτικών επιρρημάτων, μορίων, και ρημάτων «ναι ναι, αμήν αμήν, αληθώς αληθώς, μαρτυρώ κ.ά.) από τον 9ο αιώνα π.Χ. (αρχαία ασσυριο-βαβυλωνιακά και χετιτικά συμβόλαια, αρχαία ελληνική γραμματεία κ.ά.) έως την εποχή του Ιησού. Οι διαβεβαιωτικές αυτές εκφράσεις αποτελούσαν απαραίτητη προϋπόθεση για την επικύρωση ή την διασφάλιση της αξιοπιστίας των ανθρώπινων δραστηριοτήτων χωρίς να θεωρείται απαραίτητος ο όρκος. Firstly, the typological, morphological and structural analysis of the herodotean oaths aims to investigate if and what extend their historical and social dimension has been affected by their incorporation in the multilevel and multilateral text of Histories, given its complex intentionality, its roots and the requirements of the specific literary species it belongs to. In the second part of the dissertation oaths are categorized primarily on the criteria of the identity of the swearer and secondarily on the cause and result of their oath. The purpose of this division is to search if and by what means the herodotean oaths serve the basic thematic patterns of narration. This search is combined with the analysis of the specific function of each oath in its narrative context, in order to specify the versatile use of oaths as narrative tools. Finally, in the third part of the dissertation there is an effort to define the presence of oaths in the narrative body, based on the frequency of their appearance, their location and their connection to the thematic orientation of every book and of Histories as a whole. The results of the whole inquiry reveal the complex nature and multisided origin of the herodotean oaths and establish their various functions, which serve the narrative purposes as well as contribute to the formation of the narrattor’s persona and to the highlightening of the social, political, ideological and litarary settings of the his narration.

Η ειδολογική, μορφολογική και δομική ανάλυση των ηροδότειων όρκων έχει ως στόχο να αποδείξει κατά πόσον αλλοιώθηκε η ιστορική και κοινωνική τους διάσταση κατά την ένταξή τους σε ένα πολυσυλλεκτικό και πολυεπίπεδο κείμενο, όπως οι Ιστορίες, με την προθετικότητα, τις καταβολές, αλλά και τα ειδολογικά του συμφραζόμενα. Παράλληλα, με βασικό άξονα την ταυτότητα των ορκιζομένων και δευτερεύουσες παραμέτρους το σκοπό και την τύχη της δέσμευσής τους επιχειρείται κατηγοριοποίηση των όρκων, προκειμένου να διαπιστωθεί αν και με ποιο τρόπο αυτοί υπηρετούν βασικά θεματικά μοτίβα της ηροδότειας ιστορίας. Ταυτόχρονα εξετάζεται και η επιμέρους αφηγηματική τους λειτουργία, με σκοπό να προσδιορισθεί ο ρόλος τους ως εργαλείων της αφήγησης. Τέλος, αποτιμάται η παρουσία των όρκων στα εννέα βιβλία των Ιστοριών με βάση τη συχνότητα εμφάνισής τους, τη θέση τους σε καθένα από αυτά και τη σύνδεσή τους τόσο με το θεματικό πυρήνα κάθε βιβλίου χωριστά, όσο και με τον ευρύτερο θεματικό προσανατολισμό της αφήγησης. Τα αποτελέσματα της ευρύτερης έρευνας ανέδειξαν την σύνθετη φύση και προέλευση των ηροδότειων όρκων και την πολύπλευρη λειτουργία τους, η οποία υπηρετεί τους σκοπούς της αφήγησης, συμβάλλοντας, παράλληλα, στη διαμόρφωση της περσόνας του αφηγητή και στην ανάδειξη των κοινωνικών, πολιτικών, θρησκευτικών, φιλοσοφικών, αλλά και λογοτεχνικών συνιστωσών του έργου του.

▼ This dissertation examines the Pilgrimage of Grace and the Lincolnshire rebellion. Both rebellions occurred in England in 1536 during the reign of Henry VIII. The rebellions were primarily risings of the commons and occurred as the result of several causes. Much of the recent historiography has focused primarily on the causes of the rebellions and the motives of those involved. Most contemporary interpretations of the Pilgrimage of Grace have cast it primarily as either an economic rebellion or a result of social conflict between the commons and gentry. Practically no analysis of the role of the clergy exists, although it is clear that the religious reforms instituted by Henry VIII beginning in 1534 caused widespread disaffection. These reforms attacked traditional religious practice and worship, affecting the entire clergy and laity. The argument put forth in this dissertation is that the clergy—priests, friars, and monks—supported, stirred, and spread the rebellion throughout Lincolnshire and the North Country of England. In addition, this dissertation supports the argument that both the Lincolnshire rebellion and the Pilgrimage of Grace were essentially religious rebellions. Research makes it clear that a significant number of the clergy of northern England had the means, motives, and opportunity to incite the commons to rebel against the Henrician Reformation. Many of the available sources indicate that a significant number of priests, friars, and monks offered stiff resistance to the Henrician reforms. It is also clear that many members of the clergy opposed the royal supremacy as well as the reforms that attacked traditional practice and worship. Evidence also exists that members of the clergy initiated and spread a series of rumors throughout England. These rumors are important because they played a significant role in causing both the Pilgrimage of Grace and the Lincolnshire rebellion. Extant sources also indicate that many clergymen supported the rebels with words, money, and food. There is also evidence that several priests, friars, and monks stirred and spread rebellion. By addressing the role of the clergy in stirring, this dissertation adds a new approach to the historiography of the Pilgrimage of Grace.

Entre Sociologie politique et Anthropologie religieuse, cette thèse tente de comprendre l’interaction entre « Religion locale et pouvoir politique» dans la perspective de consolidation du pouvoir en Afrique, plus précisément au Gabon. Elle met l’accent sur la gestion du pouvoir politique en Afrique et analyse les rapports du rite initiatique Ndjobi avec le pouvoir politique dans la communauté Mbede. Ce champ thématique est déconstruit jusqu’à la nation gabonaise à travers l’initiation et l’implication des politiques locaux aux religions locales. Le rite Ndjobi serait une contre-offensive locale visant à réparer l’univers social et à protéger les Mbede. C’est un élément fondamental au maintien de l’ordre à travers le symbolisme de l’Okèlè é Ndjobi qui est l’affirmation par laquelle un initié prend à témoin le sacré et la vérité de la déclaration qu’il profère devant le panier contenant les reliques du Ndjobi. Pour un chef traditionnel, ce rite serait un moyen de compenser une déficience constitutionnelle de son pouvoir politique afin d’entretenir chez ses sujets initiés respect et surtout crainte. Le serment du Ndjobi serait un contrat politique de confiance à un chef de village, à un responsable politique initié à ce rite. A travers cette déconstruction, cette religion locale pourrait être appréhendée comme un support du pouvoir politique gabonais à l’échelle nationale. Les serments se font avec des paroles ; mais en Afrique noire, ces paroles ne sont pas légères. Elles permettent d’agir sur soi, sur les autres et sur le monde concerné comme une contrainte comparable à une épée de Damoclès. Cette contrainte s’exerce d’une manière subtile et imposée avec quelques négociations intra-politiques liées à la « politique du ventre » pour que l’initiation ne s’apparente pas à un acte subi et sorcellaire aux yeux de la population. La sorcellerie comme une sanction du rite Ndjobi est vécue par l’ensemble des Mbede et des initiés politiques, comme une menace permanente d’agression visant leurs corps, leurs biens et leurs familles. En effet, certains chefs traditionnels dit « Nga Mpugu» choisissent la ruse, la fraude, les crimes rituels, la possession matérielle comme moyen politique afin non seulement de contrôler la population, mais aussi de manipuler les envies de pouvoir de leurs adeptes et de leurs proches collaborateurs. En Afrique, « gouverner c’est prévoir » et prévoir, c’est mettre en place un mécanisme permettant d’éviter d’être surpris par l’ennemi qui peut être un proche. Ce serait, en fait, la mise en fonction d’une « Démocratie traditionnelle ». C’est dans ce sens que cette thèse peut s’inscrire dans la perspective de compréhension et d’analyse du politique en Afrique noire à travers les religions locales comme fondement du pouvoir politique malgré l’arrivée actuelle des obédiences religieuses modernes et des parrainages

▼ Initiationsrituale werden im zeitgenössischen China aus der Tradition fortgeführt und breiten sich weiter aus. Mit Blick auf diese interessante Seite sozialer Rituale und Ritualisierungen gilt es, einige wichtige Fragen aufzuwerfen und zu überdenken. Welche Funktionen übernehmen Initiationsrituale im zeitgenössischen China? Wie ist deren Ablauf? Wie ist der Einfluss innerhalb der Gesellschaft einzuschätzen? Wohin geleiten solche Initiationsrituale? In der Historischen Anthropologie liegen vielfältige Möglichkeiten, die komplexe Arbeit der Analyse anzugehen. Dabei kann die Historische Anthropologie nicht auf ein singuläres Forschungsfeld reduziert werden: die Forschung zielt ebenso auf das menschliche Verhalten wie auf soziale und kulturelle Zusammenhänge. Chinesische Initiationsrituale werden hier innerhalb dieses großen und vielseitigen Raums der Historischen Anthropologie verortet, um diese zu beschreiben und zu analysieren und ihre verborgenen Dimensionen und Beziehungen aufzuspüren. Eine Prozessanalyse spielt daher eine zentrale Rolle in der Untersuchung. Hauptthemen Chinesische Initiationsrituale Die chinesischen Initiationsrituale als eine Art von Übergangsritualen haben eine lange Geschichte von mehr als 2000 Jahren. Dabei lässt sich nicht von einer kontinuierlichen Entwicklung sprechen. Ein wichtiger Umbruch in der jüngeren Geschichte zeichnet sich zwischen den Ritualen „Guan Li“ und der „Schwur-Zeremonie im 18. Lebensjahr“ ab. Die Historische Anthropologie als eine neue Perspektive zur Analyse von chinesischen Initiationsritualen Die Historische Anthropologie nimmt den menschlichen Körper als ihren zentralen Untersuchungsgegenstand und nutzt Konzepte wie Mimesis, Performativität, Ritual, Geste, Bild, Phantasie etc. zur Konstruktion eines Untersuchungsrahmens. Um die Geschichte, die Prozeduren, Funktionen und weitere, verborgene Dimensionen von chinesischen Initiationsritualen zu erforschen bietet die Historische Anthropologie neue Perspektiven. Wie die Struktur einer Doppelhelix Basierend auf der Interaktion zwischen Theorie und Praxis, ergibt sich im Rahmen dieser Arbeit die Struktur zweier Helices, welche sich zu einer DNA-Doppelhelix formieren. Eine Rekonstruktion der Konzeption der historischen Anthropologie Im Kontext dieser Untersuchung konstruiert sich die Historische Anhroplogie aus wichtigen Begrifflichkeiten und Ideen. Die Untersuchung chinesischer Initiationsrituale bedarf der Formilierung entsprechender Konzeptionsentwürfen. Dabei bilden Körper, Ritual, Performativität, Geste, Bild, Imagination, Mimesis, Sprache und andere Begriffe die grudlegende Dimension sowie Ausgangspunkt für die weitere Entwicklung der Historischen Anthropologie. Ausgehend vom Interesse und Sorge an Chinesischen Initiationsritualen, vermittelt die Historische Anthropologie eine systematische Interpretation und Analyse. ▼ This present article “An institution of impeachment in Lithuanian constitutional law” analyses the origins of this institution in national law, gives a comparative analysis of constitutional regulation of an impeachment procedure in Lithuania and in other states. The paper presents the definition of “institution of impeachment”, shows an importance of this institution in Lithuanian and in West States law, the problems of implementation of this institution and the process of impeachment in Parliament and in Constitutional Courts. The paper analyses an evolution of this institute in common law counties – especially in USA and in civil law countries. The paper shows the list of impeachment subjects and the grounds of impeachment application. Also it analyses the part of Constitutional Court in the process of impeachment. It should be mentioned that only the Court can decide if the Constitution was outraged, the crime or the perjury was done. The official constitutional doctrine of the Constitutional Court shows the actual limits and grounds of the constitutional liability application. That means, that the constitutional jurisprudence, not the Constitution provisions shows actual features of impeachment institution. Also the ratio of law and fact in the impeachment process is analyzed. The present article discusses the question of Constitutional Court established facts and the question of legal consequences originated from the useful impeachment procedure application to persons. ▼ This dissertation, based on material of archives, shows aspects of society on the island of Crete under Venetian rule in the 16th (mainly) and 17th century through criminality and penal procedures. The 16th century was important because of the changes in the economic process of the states of western Europe and the eastern Mediterranean, which contributed to a change in the balance of powers among the western states. These, as well as the changes in religious issues in Christian Europe at the same period, heralded a period of transition in the formation of the modern European state, with particular characteristics and problems which continued into the 17th century and defined the procedures of the criminal code and punishment. The Venetian state, already at the maximum of its expansion at the dawn of the 16th century, demanded centralisation of power and legal organisation so as to achieve cohesion between the metropolis and its dominions and to cope with various problems. The century also ushered a period of crises for Crete, which were connected with criminality and the administration of justice. In the preface we present the archival sources, the methodology and we quote a brief structure of the study. In the introduction there is a brief reference to the history, institutions, administrative and social organisation and law of Venice and Crete and also to the problems that the metropolis and the dominion faced during the 16th century. In part A (“Justice Services and Society”) we examine the organisation and the composition of courts on the island (criminal and civil courts, superior and lower), in towns and the countryside, with references to the origin of their members (Venetians or members of the local elites), to the very often mutually overlapping competences and to similar institutions of Venice. We also present the policing services and other services of the courts and the causes of the malfunction of justice, in the cities and the countryside too. In part B (“Penal Procedure in the Venetian Crete”) we cope with the procedure of accusation but also the new judicial practices (delegazioni, rito of Council of Ten, servatis servandis) and interrogatory practices (confession with torture, statements, oath) of the new investigative process (inquisitorio) in the framework of a criminal trial, in the metropolis and the dominion. Subsequently, we examine in detail the kinds of the imposed penalties (fines, corporal punishments, incarceration, death penalty, exile, galley service) and their public and symbolic character, their differentiation according to social class, Venetian citizenship or not, sex, age, religion of the culprit. Finally, we examine the possibility of petition for and granting official pardon, either in Crete or in Venice. In part C (“Delinquency and Society in Crete”) we research the indictable offences for the society of that time, the presence at the sources concerning Crete of particular crimes and the rarity of others, the reasons that many of them were not prosecuted at the…

▼ Les termes du traité de paix entre Charles VI et Henri V qui est ratifié par les deux souverains à Troyes en mai 1420 sont plutôt clairs et paraissent aisément applicables : l’unique héritier de Charles VI, le dauphin Charles, est déshérité; Henri V, par le mariage qui l’unit à la fille du roi de France, Catherine, devient le nouveau successeur légitime de Charles VI et, lorsque celui-ci mourra, règnera sur le France et l’Angleterre sans toutefois unir les deux royaumes; le traité scelle aussi l’alliance entre la Bourgogne, l’Angleterre et la moitié nord de la France dans la guerre contre le parti armagnac que dirigie le dauphin Charles et qui contrôle la moitie sud, le royaume de Bourges. Toutefois, lorsque la cérémonie de la cathédrale Saint-Pierre-et-Saint-Paul de Troyes se termine, la théorie du document se heurte à une réalité bien différente. Alors que le traité prévoit une adhésion totale de la moitié nord de la France à la paix et la disparition politique du parti armagnac du dauphin Charles, c’est tout le contraire qui se produit : des mouvements d’opposition ou de résistance au traité et à l’autorité qu’il confère à Henri V comme héritier et régent de France surgissent de toute part et le parti du dauphin, bien loin de disparaître, tient tête à la « coalition » anglo-franco-bourguignonne. À tout cela vient s’ajouter le décès prématuré, en août 1422, d’Henri V qui, lorsque Charles VI le suit dans la tombe en octobre de la même année, laisse les royaumes de France et d’Angleterre entre les mains d’un roi qui n’a pas encore un an. Tous ces faits semblent bien signifier l’échec de la paix et les responsables chargés de l’appliquer en sont tout à fait conscients. Il n’en demeure pas moins que la décennie qui suit la ratification du traité, malgré tout ce qui s’y oppose, est le théâtre d’une véritable tentative d’application de la paix de Troyes ou, du moins, des articles et des éléments de celui-ci que l’ont peut réellement mettre en pratique. Surgical medicine appears almost simultaneously with the appearance of man onearth. Injuries and diseases forced prehistoric people to carry out surgical operationsto remove foreign bodies, orthopaedic operations and skull trephinations.The main aim of this paper was to highlight the history of surgery as a distinctmedical speciality, its beginnings and establishment through the centuries. Movingbeyond theological theories and superstitions, medical surgery evolved anddeveloped.We conducted a long painstaking research into primary sources, Greek andinternational literature, scientific research and the works of many scientists. Weisolated and collected the data indicating the beginning, evolution and course ofsurgical medicine.The term chirourgiki [which led to the word surgery in English and similar variationsin other languages] was of course inspired and coined in ancient Greece (as did mostinternational medical terms).It is a compound of the words chir (hand) and ergo (work), which composed the wordchirourgiki.Surgical medicine was established in Greece between 500 BC and 500 AD (Classicalto Late Antiquity).From Macedonia to the coast of Asia Minor, from Sicily to the depths of Asia, wherethere were Greeks there were sciences and philosophy.Asclepius established Medicine as a science. The healing rod and snake is a globalsymbol. He founded the contemporary hospices, the Asclepieia.Alkmaion founded Ancient Greek Medicine. Empedocles, Thales of Miletus andmany other ancient Greek doctors presented findings, theories and treatmentsunprecedented for their time.Hippocrates discovered acetylsalicylic acid in the leaves of willow. He describedcancer. He wrote dozens of books on numerous diseases. He conducted trephinations,specialized orthopaedic surgery (he pioneered the external fixation device), empyemaand exudate drainage, he managed bladder lithiasis, operated on pericolonicabscesses, haemorrhoids, liver abscesses, uterine prolapses, fibromyomas and otherdiseases.He constructed tools, many of which are used in their original form even today.He composed and wrote a guide of conduct and the principles of medicine that binddoctors across the world today, the Hippocratic Oath.Many schools after Hippocrates continued his admirable work. Galen followed in thefootsteps of Hippocrates. He developed methods and tools. Until the last century, thetreatment of eye cataracts was performed exactly as Galen had described andimplemented.In conclusion, surgery as a science, was founded and developed to an admirabledegree by philosophers and scientists in Ancient Greece.
