Diese Masterarbeit war geeignet um mögliche Gründe dafür zu finden, warum die US-Regierung, nach Ihrem Rücktritt aus dem Joint Comprehensive Plan of Action im Mai 2018, Ihre Sanktionen auf iranische Ölexporte nicht sofort vollständig implementierten. Ein ökonometrisches Model wurde entwickelt um den Einfluss von veränderten globalen Ölvorraten auf weltweite Ölpreise festzustellen. Die Ergebnisse gaben Beweis um zu behaupten, dass es nach dem US-Austritt bis zum Ende der von der US-Regierung ausgegebenen Sonderfreigaben für das importieren von iranischen Öl in May 2019, keine Korrelation zwischen globalen Ölvorraten und Ölpreisen gab. Es wurde theoretisiert, dass entweder die gesunkenen iranischen Ölexporte soweit keinen Einfluss auf Ölpreise hatten, oder die US-Regierung sich mit den Sonderfreigaben Zeit gekauft hatte um den Ölmarkt vor den weiter sinkenden iranischen Ölexport zu stabilisieren. Des Weiteren, es wurde theoretisiert, dass es möglicherweise weitere politische Gründe für die Sonderfreigaben für Ölimporte gab. Dieses Forschungsprojekt hat herausgefunden, dass es globale Faktoren gibt die die Fähigkeit von Staaten um Sanktionen zu implementieren erschwert. Diese könnten die Effektivität von Sanktionen bedeutungsvoll limitieren.

This research project intended to find possible reasons why US policymakers were reluctant to immediately impose their secondary sanctions on Iranian oil products following the US withdrawal from the Joint Comprehensive Plan of Action in May 2018. An econometric analysis was conducted to determine the impact of changes to global oil supplies resulting from US sanctions on Iranian oil exports. Results provided evidence that fluctuations in oil supplies worldwide did not significantly affect global oil prices. It is theorised that either reductions in Iranian oil exports simply did not have an impact on global oil prices, or US authorities managed to take necessary measures to stabilise the market while their waivers were in effect. Further, due to the insignificant results in the econometric tests it was theorised that there may have been political reasons beyond oil prices that hindered the US from fully applying its secondary sanctions for a whole year. In summary, this research found that there may be important factors restraining the ability of states to impose sanctions, which may have a negative impact on the actual effectiveness of this economic instrument.

▼ Achievement of the 2015 nuclear agreement deal between Iran and the world powers was officially praised as a remarkable victory in the history of diplomacy by most of the world. However, elites’ reactions to it within Iran and the U.S. were contradictory. This study was launched to investigate opinion discourses in four prominent American newspapers with the aim of finding out how they constructed different versions of the nuclear deal. The first objective sought to identify discursive and rhetorical mechanisms through which authors represented and promoted their versions of reality. The second objective intended to place the newspaper opinion discourses in their context of production and consumption and examine them from cultural and socio-political perspectives. To achieve the above, I drew on three frameworks: Critical Discourse Studies, Classical Rhetoric, and Securitisation Theory (the first time, I believe, that these had been integrated in a single study of opinion discourses). In light of the first objective, I designed a three-dimensional model of analysis examining representational, dialogical, and argumentative features of the opinion pieces by drawing on classical rhetoric, and to accomplish the second objective regarding the relationship between discourses and context, I drew on securitisation theory to demonstrate how these discourses and their context constituted each other. My findings showed that all newspapers, except one (USA Today), took stances of either fully supporting or entirely opposing the nuclear deal, and depending on their positions towards the nuclear deal, they pursued particular patterns of representation and argumentation. Thereby, there were two opposite sets of representative and argumentative strategies employed by the two groups of anti-deal and pro-deal articles. Anti-deal articles, no matter which newspaper they belonged to, portrayed the deal, the negotiations and the countries involved in it in the same way. Pro-deal articles were similarly uniform. All articles in each group applied similar discursive strategies of representation, made similar judgements and predictions regarding the deal, and employed similar argumentation schemes to defend their claims. However, in regards to dialogical features, choice of interactional strategies appeared to be more associated with the newspapers’ statuses and professional principles than with their critical or supporting positions on the deal. While articles from the elite papers (The New York Times and The Wall Street Journal) opted for a more formal style of writing and a modest authorial voice, those from less prominent papers (New York Post and USA Today) tended towards a more conversational style and a strong voice. Investigating the opinion pieces from a political perspective, I found that they worked systematically towards either treating Iran’s nuclear programme as an urgent security matter (securitisation) or taking it into the realm of normal politics (desecuritisation). Diese Arbeit beschäftigt sich mit der Wahrnehmung des Joint Comprehensive Plan of Action (JCPOA) in der Islamischen Republik Iran und seiner Bedeutung für die iranische Außenpolitik. Sie analysiert, wie und in welcher Weise der JCPOA Bestandteil der iranischen außenpolitischen „Rechtfertigungslogik“ ist. Diese Rechtfertigungslogik, definiert als der hauptsächliche Rahmen, anhand dessen politische Entscheidungen beurteilt werden müssen, wird als Grundlage dieser Analyse dienen. Die im Rahmen dieser Arbeit durchgeführte Forschung basiert auf folgender Forschungsfrage: „Inwiefern hängt der Joint Comprehensive Plan of Action mit der iranischen außenpolitischen Rechtfertigungslogik zusammen?“ Diese Frage ist zweifellos politisch relevant, da das iranische Atomabkommen aus 2015 nach wie vor ein äußerst wichtiges Dokument mit weitreichenden Implikationen ist. Selbst nachdem US-Präsident Donald J. Trump den Austritt der USA aus dem JCPOA angekündigt hatte, dient das Atomabkommen nach wie vor als Beispiel für erfolgreiche Verhandlungen mit Ländern wie dem Iran. Darüber hinaus sind dessen Folgen im regionalen Kontext nach wie vor weitreichend. Trumps Entscheidung, sich aus dem Abkommen zurückzuziehen, beeinflusste nicht nur die anderen Mitglieder der P5+1-Gruppe, sondern auch Iran, die iranische Außenpolitik, sein Nuklearprogramm, und andere internationale Akteure wie beispielsweise Nordkorea. Da- her ist es essentiell den iranischen Standpunkt zu verstehen und ein Modell zu entwickeln, um zu erklären, warum bestimmte Staaten auf eine bestimmte Art und Weise auf Maßnahmen der internationalen Politik reagieren. Die Forschungsfrage dieser Arbeit basiert auf einem konstruktivistischen Verständnis des Systems der internationalen Beziehungen und der Iranischen Außenpolitik, da sie Wahrnehmungen, Ideen, Ideologien und Narrative ins Zentrum der Aufmerksamkeit rückt. Das Konzept der Rechtfertigungslogik folgt diesem theoretischen Zugang. Die diesbezügliche Herausforderung ist jedoch, dieses Konzept und seine Terminologie zu definieren und herauszufinden, wie es sich manifestiert. Diese Probleme beeinflussen die Art und Weise in welcher Informationen über dieses Konzept und dessen wechselseitige Beziehung mit dem JCPOA gesammelt, analysiert und interpretiert werden. Um analysieren zu können, wie der JCPOA und die außenpolitische Rechtfertigungslogik des Iran zusammenhängen, ist es nötig, das Forschungsdesign an die spezifische Natur der Forschungsfrage anzupassen. Der methodologische Ansatz dieser Arbeit kombiniert daher qualitative Expertinnen- und Experteninterviews mit qualitativer Inhaltsanalyse, um Daten zu sammeln, zu extrahieren und zu analysieren.

▼ In dieser Masterarbeit wird der Joint Comprehensive Plan of Action bzw. die Risiken eines Scheiterns der in der Vereinbarung niedergelegten Bestimmungen analysiert. Ziel des JCPOA ist es der Islamischen Republik Iran Anreize zu geben um – von sich aus – die potenziell auf die Erzeugung von Kernwaffen abstellenden Teile ihres Atomprogramms einzustellen. Das Atomabkommen wurde zwischen den E3+3 und dem Iran geschlossen und sieht detaillierte Regelungen vor, die die Zielerreichung sicherstellen sollen. Zum Einen ist darin niedergelegt, dass jegliche multi- und unilateralen Wirtschaftssanktionen die im Verlauf der letzten Jahrzehnte gegen den Iran erlassen wurden sukzessive aufgehoben werden. Zum Anderen ist die Bedingung für diese wirtschaftliche Reintegration des Irans primär, dass auf die Anreicherung von Uran über einen gewissen Schwellenwert verzichtet wird und zusätzlich von der Erzeugung anderer –für die Herstellung von Atombomben essenzieller – Bestandteile des nuklearen Brennstoffkreislaufs Abstand genommen wird. Da die gründliche aber vor allem seriöse Behandlung des Stoffes der Auseinandersetzung mit wichtigen Grundsätzen des Völkerrechts bedarf, wird zunächst auf einschlägige Elemente eingegangen. Vor allem die Kontextualisierung des modernen Verständnisses von Souveränität – sowie dessen historische Grundlagen – soll dabei hervorgehoben werden. Danach werden die Meilensteine der diplomatischen Verhandlungen im Vorfeld zum Abschluss des JCPOA skizziert um im Anschluss daran eine völkerrechtliche Einordnung des Atomabkommens zu treffen. Diesbezüglich ist besonders die Relevanz der UN Sicherheitsratsresolution 2231 hervorzuheben, die den Bestimmungen letztendlich rechtsverbindlichen Charakter verleiht. Des Weiteren wird auf die grundsätzliche Rolle dieser Rechtsinstrumente im Bereich der internationalen Beziehungen eingegangen. Im vorletzten Teil der Arbeit wird zunächst auf die Veränderungen der EU GASP im Zuge des Vertrags von Lissabon eingegangen, die eine kohärente Gegenüberstellung der 1996 erlassenen EU Blocking Statute mit ihrem (wiederbelebten) zeitgenössischen Pendant ermöglicht. Dabei wird detailliert auf den Stellenwert einer vollwertigen gemeinsamen europäischen Außen- und Sicherheitspolitik eingegangen. Die Erläuterungen bezüglich dieser (bereits erfolgten) Aufwertung dient als Fundament für die Umschreibung der Kernelemente der Instrumente. Hierbei wird vor allem analysiert wie die EUBS die nachteilige extraterritoriale Wirkung unilateraler Wirtschaftssanktionen anderer Staaten neutralisiert um die legitimen, wirtschaftlichen Interessen von Entitäten europäischer Provenienz zu schützen. Abschließend wird hinsichtlich des außerplanmäßigen Austritts der Vereinigten Staaten von Amerika aus dem Abkommen eine Prognose zum Fortbestandes des JCPOA gegeben und die Meinung des Autors präsentiert.
