Šiame darbe analizuojamas konkurencijos skatinimas bankų teisėje, vykdomas konkurencijos institucijoms atliekant ūkio subjektų veiksmų vertinimą. Rinkos struktūra lemia, kad bankai, veikdami fragmentuotoje ir koncentruotoje rinkoje, bus linkę naudotis turima rinkos dalimi, sudarydami draudžiamus susitarimus ar piktnaudžiaudami dominuojančia padėtimi. Dėl šios priežasties konkurencijos institucijos turi atsižvelgti į iki šiol nenagrinėtus galimus konkurencijos ribojimo atvejus – produktų siejimą, kooperatinių bei taupomųjų bankų bendradarbiavimą, kreditų registrus ir įvertinti, ar jie neigiamai įtakoja klientų judumą, o taip pat ir konkurenciją tarp bankų. Naujų susitarimų dėl kainų, teisinių bei praktinių ribojimų naujiems rinkos dalyviams buvimas taip pat rodo, kad nėra tinkamai veikiančios bendrosios rinkos. Kita problema, su kuria susiduria rinkoje konkuruojančios įmonės, yra vienam iš ūkio subjektų teikiama valstybės parama. Dažniausiai sunkumus patiriančioms įmonėms suteikiamos valstybės garantijos bei kapitalo įnašai, remiantis EB Sutarties 87 straipsnio 3 dalies c punktu. Dėl šios priežasties darbe taip pat buvo analizuotos ir konkurencijos taisyklių išimtys, kurios skatina konkurenciją - dauguma jų taikomos valstybės pagalbos institute. Komisija nėra priėmusi bankų sektoriui skirto išimčių reguliavimo, dėl to bankai ne visuomet gali būti tikri dėl savo veiksmų atitikimo konkurencijos taisyklėms. Improving competition in banking sector means competition institutions’ obligation to control undertakings behaviour. Market structure determines that banks acting in largely fragmented along national lines and concentrated markets tend to use their power to distort competition trying to conclude restrictive agreements or abuse the dominant position. For this reason, competition authorities must pay particular attention to the situations when competition can be restricted: product tying, cooperation between cooperative and saving banks, credit registers. These elements have not been examined yet, but can affect customer mobility and might distort competition. New price agreements, legal and practical obstacles to market entry suggest that there is no integrated single market in EU. More problems are related to the state aid which is granted to the one of the undertakings by states guarantees or capital injections. State aid to individual undertakings in difficulties is normally assessed under Article 87(3)(c) of the Treaty for rescuing and restructuring firms in difficulty. As there are no special regulations in banking sector to exempt state aid and other distortions of competition on purpose to improve competition, banks can not exercise their right to the principle of legitimate expectations. 2. McClary, Gregory Ian. Folkloric Flux.

Degree: MA -MA, Music, 2016, York University

This paper accompanies the authors original symphony for large orchestra, folkloric flux. Although primarily based on traditional symphonic formal and developmental features, folkloric flux also employs narrative to guide form, and textural procedures to supplement more traditional thematic and motivic development. Each movement recounts a folkloric narrative as a metaphor for recent events. Specifically, the four movements use 1) Humpty Dumpty to convey the effects of nationalistic militarism and veterans psychological trauma in relation to the US-Afghan war, 2) Jack and the Beanstalk to warn of hubristic technological advancement in modern industrial agriculture; 3) The Three Little Pigs to depict socioeconomic dimensions of the 2007-08 housing crisis; and 4) The Adventures of Pinocchio to examine quantitative easing, the widespread experimental monetary program. This paper documents 1) the relationship between narrative and form; and 2) how textural, thematic and motivic development contributes to narrative symbolism on an intra- and inter-movemental scale.
