▼ South African ports are regulated by a compulsory pilotage system. This means that when a vessel enters or leaves any of the South African Ports regulated by Transnet National Ports Authority, this vessel is obliged by law to utilize a pilot to navigate the vessel safely into and out of the port. The reason for doing so is to reduce the risk of incidents that occur within the ports due to the fact that the pilots have specialized knowledge of the port’s specific conditions. However, collisions may still occur in these ports. One such incident is the collision of the MV Stella Tingas. The case of the MV Stella Tingas brought to light the unacceptable situation created by the lacunae in the Legal Succession To The South African Transport Act of 1989, where the innocent vessel that was involved in a collision with a vessel under compulsory pilotage could not get satisfaction for damages from either the ship-owner of the guilty vessel or from the Port Authority. In order to resolve this position, the Legislature enacted the National Ports Act 12 of 2005, specifically section 76, to resolve this problem. Section 76(2) states that the ship-owners of vessels under compulsory pilotage will be liable for all actions of a pilot, whilst section 76(1) provide that the Port Authority will not be liable for actions of the pilot done in good faith. The National Ports Act has however not defined good faith and the courts have not interpreted this concept since the commencement of the Act. This dissertation will investigate what good faith is, by examining exclusionary clauses and by exploring the concepts of gross negligence and intention in order to ascertain whether good faith excludes these concepts. Thereafter the dissertation will seek to discover a test that can be used in order to assess whether the actions of the pilot were done in good faith or not. The dissertation will trace the history of compulsory pilotage from its origins in English Law to South African law. It will also examine the relationship between the master and the pilot as well as the circumstances where the master can intervene in the affairs of the pilot, by ascertaining what an emergency is, as contemplated by the National Ports Act. ▼ In respect of company law, there are two main principles that govern it. The first principle is that a company is a juristic person, having a separate legal identity and thus existing separately from the individuals who stand behind the corporate veil and enjoy the benefits of the company. The second principle is that of limited liability. Collectively, these two principles aim to promote capital investment whilst limiting the liability of potential investors. In the maritime industry however, these two principles serve an entirely different purpose. Ship-owners form ‘one-ship’ companies where each vessel within the same fleet is registered under the name of a different shipping company. Hence due to the separate legal identity of companies, claimants could only proceed against the guilty ship. In 1983 South Africa enacted its reform legislation by introducing the Admiralty Jurisdiction Regulation Act with the aim to provide consistency and certainty within the legal sphere of the maritime industry. In doing so, the legislature saw the opportunity to remedy the mischief created by ‘one-ship’ companies by introducing the associated ship provisions which based the central enquiry in such arrests on ‘common-control’ rather than ‘common ownership’. Thus, the purpose of the provision was to provide claimants with a mechanism to penetrate complex corporate structures so as to locate and hold the true debtor in a maritime dispute liable. The general understanding therefore in associated ship cases was that the provisions concerned themselves with the ultimate or actual control of a shipping company. The leading case in interpreting the term ‘control’ is the Heavy Metal wherein the SCA adopted a restrictive and narrow understanding of ‘control’ which centralised the enquiry on the registered shareholder of a ship-owing company and in doing so, allowed for the existence of two repositories of control. It therefore allowed an association to be formed on the basis that the companies in question shared a common majority nominee shareholder without considering the fact that such a person may hold the said shares for two different entities. In this manner, the judiciary opened a ‘legal Pandora’s box’ in the sense that it created confusion and uncertainty in respect of the meaning to be acquainted to the term ‘control’. This dissertation will trace the background and history of the associated ship provisions so as to determine its nature, scope and underlying purpose. It will also conduct an investigation of the provisions and the relevant case law in order to determine what is meant by the term ‘control’. Lastly the dissertation will determine the correctness of the Heavy Metal case and its legal impact on courts applying its ratio. Advisors/Committee Members: Gevers, ,Christopher Carl. (advisor).

▼ In my dissertation I seek to answer the questions regarding why some coastal populations turn to maritime crime in domestic and international waters, and others do not. In this work I advocate that generalizable geographic, political, and economic conditions can explain a significant portion of maritime crime. Broadly speaking these conditions are classified into geographic opportunity and a political and economic willingness to act. Through a qualitative analysis of historical outbreaks of maritime crime and international law, as well as a quantitative analysis of acts of maritime crime spanning from 1991 through 2007, I find that a global level of analysis can provide significant insight into outbreaks of maritime crime. Poor economic conditions, low levels of bureaucratic state capacity, and low levels of coercive state capacity encourage outbreaks of maritime crime in domestic and international waters. Furthermore, this project finds that acts of maritime crime in domestic and international waters are impacted by these conditions in different ways. Declining economic conditions have a stronger impact on acts of maritime crime in domestic waters than on acts of maritime crime in international waters. In terms of coercive force, very few states possess a naval capability which can deter acts of maritime crime in international waters. This work also finds that contrary to existing expectations maritime chokepoints are not consistent positive drivers of maritime crime. Rather chokepoints bordered by one to two states are negative drivers of maritime crime in domestic waters, and an insignificant driver of maritime crime in international waters. The only chokepoints which behave in a manner hypothesized by the existing literature are maritime chokepoints bordered in close proximity by the maritime claims of three or more states. These chokepoints with complex international borders create a legal environment which allows potential, and active, maritime criminals to obscure their port of origin, and evade pursuers as naval patrols are explicitly prohibited under the United Nations Convention on the Law of the Sea to pursue maritime criminals into the territorial waters of a second state.

La piraterie maritime est communément perçue comme le crime international originel en ce qu’elle a de manière consensuelle ouverte la possibilité aux états de procéder à sa répression sans aucune distinction au nom de la préservation des intérêts communs de la communauté internationale. Cette compétence universelle a largement contribué à l’élargissement du champ d’application du droit international, en particulier pénal, alors même que ce droit apparait aujourd’hui paradoxalement inadapté pour répondre aux exigences de lutte contre la piraterie moderne. Le contexte ainsi que les caractéristiques singulières des actes de piraterie actuels constituent un enjeu tant dans l’application des dispositions du droit international mais également de manière plus général à la coopération internationale indispensable pour lutter contre les crimes transfrontaliers. Ce projet se propose de mener une réflexion sur, d’une part, les raisons de l’inadaptabilité des dispositions du droit international et, d’autre part, la nécessité d’élaborer un nouveau cadre juridique de lege feranda répondant aux nouvelles réalités de la piraterie maritime.

Maritime piracy is commonly considered as the original international crime. In the name of the common interest, states acknowledged the need to repress the crime of piracy regardless of nationalities or places of occurrence.. This piracy-inspired universal jurisdiction has contributed to broaden the scope of international law. Paradoxically, the latter appears inadequate to meet the necessary requirements to fight against modern piracy. The singular characteristics and the context of modern piracy are both a challenge, not only for the application of international law but also more broadly for the international cooperation essential to fight cross-border crimes. This project studies the reasons for the inadaptability of international law provisions and also the need to develop a new legal framework lege ferenda that will meet the new realities of maritime piracy. This new legal framework should take into account the needs to harmonize legislations in order to establish cooperation at the national, bilateral, regional and international level.

ENGLISH ABSTRACT: In the context of maritime law enforcement (MLE), a human operator is typically required to make a variety of counter-threat decisions following the detection and evaluation of threats at sea. These decisions reside within a so-called response selection process during which MLE resources, such as patrol vessels, military vessels and armed helicopters, have to be dispatched to intercept maritime vessels that are deemed potential threats. Because the number of potential maritime threats can be overwhelming and the nature of the decision process is typically complex, the quality of resource assignment decisions can be improved signi cantly by providing maritime operators with computerised decision support. A generic, semi-automated MLE response selection and resource routing decision support system (DSS) is designed in this dissertation. This DSS is capable of assisting human operators in spatio-temporal resource dispatch decision making so that MLE resources may be employed effectively and efficiently. These decisions are made based on kinematic vessel-related data obtained from associated threat detection and threat evaluation systems, as well as subjective input data contributed by MLE response selection operators. Fully automated decision making is therefore not pursued; the aim of this study is to establish a support tool for an operator. Multiple response selection objectives are accommodated in the proposed DSS in a generic manner, so as to provide users of the system with the freedom of con guring their own, preferred goals. This generic DSS design is populated with examples of models capable of performing the functions of the various constituent parts of the system, and their workability is tested and demonstrated by solving the MLE response selection problem in the context of two realistic, but simulated, MLE scenarios. The MLE DSS proposed in this dissertation may be used in future to assist maritime operators in their complex decision making processes. In particular, operators may use it as a guideline to validate and/or justify their decisions, especially when the level of uncertainty pertaining to the observed maritime scenario is high and/or only parts of the problem may be resolved by hand. Use of this system in a real-world context is expected to reduce the stress levels of operators typically associated with diffcult decisions, while simultaneously improving the overall quality of MLE decisions in an integrated fashion.

▼ It all started with a bang! Maritime security drastically evolved due to the tragic events of 11 September 2001(9/11), when a series of coordinated terrorist attacks were made on the United States of America. This unprecedented and catastrophic incident of terrorism shocked the world but more importantly drew the attention of the international maritime security authorities to the vulnerabilities of the seaports to acts of terrorism and other criminal threats. The most significant international agreement relating to maritime safety and security is the 1974 International Convention for the Safety of Life at Sea (SOLAS), and this agreement was amended in 2002 in London, to include a new provision, that is the International Ship and Port Facility (ISPS) Code. The ISPS Code is in essence a framework of maritime security measures designed to enhance the security of ships and port facilities. This dissertation is a study of the ISPS Code, an analysis of the regulatory provisions of the ISPS Code, its implementation and impact. The ISPS Code was implemented on 01 July 2004 and currently applies to 162 States that are contracting governments to SOLAS. This study has four chapters, chapter one sets out the background to the development of maritime security and it includes a regional perspective on maritime security as well as a status update on the main commercial ports in South Africa. Thereafter, chapter two is dedicated to providing the reader with an understanding of the provisions of the ISPS Code, describing its purpose, objectives and key elements. Chapter three focuses on maritime security and terrorism. It provides the reader with summaries of maritime incidents that occurred prior to the implementation of the ISPS Code as well as incidents that took place after its implementation in order to assess its success in achieving its objectives of enhancing international maritime security. Finally chapter four provides a detailed analysis of the implementation and impact of the ISPS Code in South Africa as well as it implementation in other signatory countries of SOLAS such as Singapore, Iran and the United Kingdom. This chapter then concludes with recommendations made to the International Maritime Organisation to enable it to improve on its mandate of maritime security. Advisors/Committee Members: Lamb, Deepa. ▼ Following the 9/11 attacks, concerns about maritime terrorism prompted several international legal developments. These included amendments to the 1974 SOLAS Convention introducing the ISPS Code, and the Long Range Identification and Tracking of ships, with amendments to the 1958 Seafarers Identity Documents Convention also occurring. 2005 also saw the finalisation of amendments to the 1988 SUA treaties to better facilitate the interdiction of suspected terrorist vessels. Additionally, the US-led Proliferation Security Initiative has prompted critical re-thinks about the interdiction powers of States under the 1982 UN Law of the Sea Convention, and in exceptional cases, under Article 51 of the UN Charter. This Study examines the extent to which the above international agreements are likely to succeed in enabling the prevention of contemporary post-9/11 forms of maritime terrorism. It formulates the Maritime Terrorism Threat Matrix to statistically analyse all the ways in which maritime terrorism incidents have occurred, and might occur in future. The study combines these findings with analyses of how the ISPS Code and LRIT measures have developed since their entry into force, and also examines the debate amongst international legal scholars about the legality of vessel interdictions in the post 9/11 maritime security context. Through considering how the above international agreements might apply in practice, the Study highlights the importance of continual and rigorous application of ISPS Code security measures both by contracting governments and at operational levels within maritime industries. Whilst it identifies scope for flexible interpretations of UNCLOS (and possibly Article 51 of the UN Charter) relating to the interdiction of suspected terrorist vessels, it argues for increased ratification of the 2005 SUA Convention to reduce the scope for uncertainty and conflict. Overall the Study demonstrates that the international legal framework for preventing maritime terrorism incidents has been improved since 9/11. Going forward, it argues that instead of further reforms or new instruments, the international community’s focus should be on continually refining the prospects for the existing instruments to succeed, and outlines recommendations for how this might be achieved.

▼ Sub-Saharan African nations are highly dependent on the agricultural sector for livelihoods. South Africa and Nigeria depend on agriculture due to the availability of abundant land, labour and natural resources. According to the theory of comparative advantage a state exports the products that it has a comparative advantage in and imports those where it does not have a comparative advantage. This is facilitated by international trade. International trade is defined as trade among nations that enables a nation to buy certain products that it cannot produce from other nations at a cheaper rate. Furthermore, it is expected that every sovereign state would be able to provide not only food and water but also good access to sufficient food and water to its people. Section 27.1b of Chapter 2 of the South African Constitution of 1996 and Article 16 of Nigeria’s Constitution of 1999 enshrine this provision. A number of factors impact food security. The first is international trade. This is spelt out in the World Trade Organization (WTO) Agreement on Agriculture (AoA). The agreement establishing the WTO is commonly known as the “Marrakesh Agreement.” It was signed in Marrakesh, Morocco on the 15th of April, 1994, at the end of the Uruguay Round of Multiple Trade Negotiations. The AoA consists of three pillars: market access, export subsidies and domestic support .Market access requires all parties to the AoA to remove non-tariff barriers which comprise of import quotas and restrictions and convert them to tariffs; a process known as ‘tariffication’. States are also obliged to reduce export subsidies at the same time as increasing their imports. Domestic support, states are to remove subsidy it gives to its people a process that increases the price of goods. Another factor is trade liberalization. This study examines the effects of WTO agricultural trade liberalization on food security and the mechanisms available to address this issue. It focuses on the food security implications of the WTO AoA and asserts that the AoA favours agricultural producers in developed countries. The study seeks to ascertain the extent to which the realization of the objectives of the agreement will promote food security by looking into the abovementioned three pillars and their relationship with food security. Aux Comores, le droit maritime est une discipline qui, depuis longtemps, est restée dans le flou. Les textes internes qui étaient censés régir le droit maritime aux Comores étaient presque inconnus et difficilement trouvables. Ces textes hérités de la France, mériteraient d'être amendés ou remplacés par de nouvelles dispositions tenant compte des réalités et de normes internationales. A ce jour, le pays n'a adhéré à aucune des conventions internationales en vigueur régissant le droit maritime international. Il est en manque cruel de spécialistes en droit maritime, alors que les différends dans ce domaine ne cessent d'augmenter. Plusieurs zones d'ombre et de non-droit planent sur les questions relatives au droit maritime. en nous référant au droit français avec lequel le droit comorien entretient toujours d'étroites relations, cette thèse a pour objectif principal de revisiter le droit maritime comorien afin d'en déceler les lacunes et les originalités, dans la perspective de pouvoir proposer une réforme d'ensemble du droit maritime comorien.

In the Comoros, the maritime law is a discipline which, for a long time, remained in the blur. The internal texts whiwh were supposed to govern the maritime law to the Comoros were almost inknown and not easily findable. These texts inherited France, would deserve to be amended or replaced by new provisions taking account of realities and the international standards. To date, the country adhered to none international conventions in force governing the international maritime law. It is in cruel lack specialists in maritime law, whereas the disagreements in this field do not cease increasing. Several not-right and remote regions plane on the relative questions with the maritime law. While referring to us with the French right with the Comotian Right maintains still and always close relations, this thesis aims main aim to revisit the Comorian maritime law in order to detect the gaps and the originalities of them, with a view to be able to propose an overallreform of the Comorian maritime law.

Le retentissement des catastrophes maritimes de ces dernières années, Erika, Prestige, Deepwater Horizon, a confirmé l’importance des enjeux de pollution marine, tant auprès du grand public que des décideurs politiques. Aucune leçon n’aurait-elle été tirée de ces précédents? Les appels à une prise en compte accrue de la protection de l’environnement n’auraient eu que peu d’impact sur les pratiques des transporteurs et armateurs. Les atteintes à l’environnement marin doivent être au plus vite jugulées et ce grâce à des outils adaptés et efficaces. Or, le droit maritime, droit relatif à la navigation qui se fait sur la mer, ne serait plus en mesure de protéger correctement son environnement car fondé sur des principes de responsabilité civile. L’évolution des nécessités recommanderait que lui soient substitués les principes issus du droit commun de l’environnement, fondé sur la responsabilité pénale. Dans un premier temps, l’identification des risques maritimes, anciens comme contemporains, démontre que malgré une évolution certaine des technologies et un accroissement de leur complexité, ceux-ci demeurent fondamentalement identiques, avec en toile de fond le marin, le naviguant agissant dans le cadre d’une organisation. Dans un second temps, l’analyse du traitement des risques techniques démontre, en premier lieu, la capacité du droit maritime à se réformer en s’inspirant des bonnes pratiques issues de l’industrie offshore., L’analyse des risques juridiques confirme, en second lieu, que le droit maritime, malgré ses imperfections, possède les ressources pour se réformer et répondre aux attentes contemporaines en matière environnementale.

The impact of the maritime catastrophes of recent years such as Erika, Prestige, and Deepwater Horizon, has confirmed the concerns regarding marine pollution, both with the general public and political decision-makers. Has no lesson been learned from these events? Calls for greater awareness for environmental protection have had little impact on the practices of transporters and shipowners. Violations of the marine environment must be halted as soon as possible, using suitable and effective methods. Maritime law, which relates to navigation by sea, is no longer able to protect the environment because it is based on principles of civil responsibility. Changes in obligations suggest that this should be replaced by principles derived from common law on the environment, based on criminal responsibility. In the first part, the identification of maritime risks, both old and contemporary, demonstrates that in spite of some developments in technology and an increase in its complexity, it remains fundamentally identical, with the backdrop of the sailor, the navigator, acting within the framework of an organization. In the second part, the analysis of the treatment of technical risks demonstrates, firstly, the capacity of maritime law to reform, taking the lead from good practice derived from the offshore industry. Поморско право, пружа јасан увид у начин настанка и развијања правних норми на основу развоја и ширења одређених делатности у друштвеним заједницама. Потреба заједницâ да очува одређене односе настале око таквих делатности, и да их даље развија, довела је до њиховог нормирања и коди фикације. Са сваком значајнијом променом у организацији кључних делатности, овај процес се стално обнављао, што је условљавало и промену уређења заједница. На примеру поморског права то може да се прати скоро непрекидно, од првих писаних правних споменика, до данас. Међусобна повезаност поморства и трговине, један је од кључних подстрекача овог развоја, и чини га нарочито живим. Потреба за проширењем тржишта ставља пред поморство увек изнова проширене захтеве, а технички развоје поморства омогућио је узлет трговине. Због тога су заједнице настале око поморске и, нужно, трговинске делатности, у свом трајању увек показивале динамичност и активизам. Њиховој делатној природи може се захвалити и за настанак и развој правног оквира поморства и поморске трговине. Као посебна по значају и доприносу, издваја се епоха развоја поморства и трговине у средњем веку, и касније, до настанка грађански х друштвен их и правних система, у аутономним комунама и државама на Јадран у. Водећа међу њима, свакако је била Венеција, али су свој не мали допринос грађењу поморског права, дала и два града на источној обали Адриатика - Котор и Дубровник. Њихови статути богато су правно наслеђе, сведочанство о доприносу општем току развоја поморског права; уз ова два основна правна споменика, стоје подједнако важни и други : статути братовштина, остали поморско-правни зборници, као и бројне нотарске исправе. Котор се у општем току развоја поморства и поморске трговине, издвојио нарочитом улогом једног струковног удружења, Братовштине Светог Николе Морнара.

La dématérialisation est une opération liée à une technologie consistant à remplacer un support matériel tangible par un procédé électronique. Par exemple le connaissement dématérialisé est détaché de son support matériel historique à savoir le papier. Le passage de la frontière numérique implique des changements et soulève des questions intéressantes, que la thèse se propose d’examiner sous l’angle du droit maritime. À travers une approche interdisciplinaire, les concepts sont clarifiés pour procéder à une qualification du document numérique et montrer les variations et les similitudes terminologiques autour des notions de document original, de copie, de signature électronique, d’archivage, d’intégrité et d’authenticité ; proposés par la Loi type sur le commerce électronique et la Loi type sur la signature électronique. Le statut du document électronique est analysé, en évaluant conjointement sa valeur probante et informationnelle. Confrontant les principes à la pratique, la thèse prend la mesure du débat sur la dématérialisation des titres négociables. Compte tenu des incertitudes, controverses et contradictions relevées, on souligne la nécessité d’une réforme homogène et transversale pour mieux encadrer les pratiques de numérisation et ainsi permettre une véritable reconnaissance de la dématérialisation du document valant titre de propriété. Il convient de rappeler que le point de vue proposé est basé sur le droit de tradition civiliste, en particulier le droit Français et Africain, étant donné la place centrale que l’écrit occupe sur le terrain probatoire. La qualification technique et juridique du document électronique et la copie numérique passe nécessairement par l’examen des notions de support et de langage informatique. En l'occurrence, on observe que si ces notions sont communes à la technique et au droit, elles n’y sont pas exactement comprises de la même manière. On ne manquera pas de souligner les convergences et les divergences à cet égard et la nécessité cruciale de clarifier le sens que l’on donne aux concepts lorsqu’on touche à une question technique comme la dématérialisation ou la preuve des actes juridiques. Si la dématérialisation a posé des difficultés par le passé, c’est à cause du support de l’écrit et de la notion d’orignal électronique. Dans le contexte d’aujourd’hui, le support est inopérant face au concept d’équivalence fonctionnelle. L’original n’est pas une notion tributaire du papier ou du support électronique : un original peut désormais être un écrit électronique revêtu d’une signature électronique, les notions classiques d’écrit et de signature ayant été adaptées en ce sens par le législateur.

The position with regard to a number of fairly small result of the proximity of these islands to the coast of South West Africa and the fact that the latter is also entitled to lay claim to maritime zones, the potential for overlapping claims to such zones clearly exists. Consequently a solution is proposed to delimit these zones equitably. It amounts in short to awarding an enclave jurisdictional zone of 12 nautical miles to each of these islands, delimited in accordance with the equidistant principle. It is conceded, however, that in the final instance, the eventual delimitation of all these maritime zones depends on agrertent between the two parties concerned. islands off the coast of South West Africa/Nar'ibia, generally known as the Penguin Islands, their status as well as the maritime zones they may generate, are examined in this study. With the emphasis on the 1958 Geneva Conventions and the 1982 Law of the Sea Convention the endeavours to codify the rules of the Law of the Sea are set out as the backdrop against which the rules applicable to the position of these islands are to be discovered. The various definitions of islands in these codifications are identified and the elements of the definition in the 1982 Convention as well as some of the elements proposed by a number of delegations to the United Nations Law of the Sea Conference, are examined in detail. An investigation into the applicable conventional provisions and state practice, prove that in principle islands, just like mainland areas, are capable of generating territorial waters, a contiguous zone, an economic or fishing zone as w all as a continental shelf. In terms of the 1982 Convention so-called rocks do not qualify to generate areas of jurisdiction to the same extent as islands. The effect of islands on the delimitation of maritime zones between adjacent and opposite states is examined with a view to finding principles which could by analogy be applied to the delimitation of the maritime zones generated by the Penguin Islands and the mainland of South West Africa. In the case of territorial waters, it is initially left to the parties concerned to come to an agreement. Failing such agreement the equidistant principle applies unless a historic title or special circuitstances requires an alternative solution. In a number of instances the solution eventually arrived at amounted to awarding enclave maritime zones to islands and delimiting such zones against that of the opposite state by way of the equidistant principle. In the case of the delimitation of the continental shelf state practice revealed that, depending on their relative geographical location in relation to their own and opposite states, islands are accorded full or limited weight in delimiting the continental shelf between the mainland states concerned. Corresponding principles are applied in the delimitation of economic or fishery zones. Si l'institution d'un Consulat de la mer à Civitavecchia en 1742 s'inscrivait avec retard dans un mouvement de réappropriation de l'exercice de la justice, l'événement symbolisait à la fois les prétentions romaines en matière de mercantilisme et les contradictions de son application pratique. Cette création institutionnelle devait en effet composer avec une ambigüité propre aux ports francs : être à la fois une porte d'entrée au commerce international et le filtre des échanges étrangers. Dans un contexte où le commerce ‘actif' devenait la ligne politique du pouvoir, le quotidien des acteurs économiques s'apparentait plutôt à une réinterprétation sociale des règles locales. Les agents institutionnels étaient en effet très souvent liés aux protagonistes du commerce. Acteurs économiques et institutions étaient alors à même d'incarner les normes avec un haut niveau de flexibilité. À ce titre, dans un contexte de création et d'affirmation d'une identité ‘étatique', l'insertion initiale des capitaines étrangers par l'intermédiaire de l'appareil normatif réglant les trafics maritimes romaines concrétisait la patiente accumulation de savoirs informels et la construction d'un réseau d'intermédiaires stratégiquement positionnés. Des savoirs qui furent un tremplin professionnel et économique mêlant pluriactivité et stratégies d'interprétation institutionnelle. Jouant en effet sur leur condition de stranieri ayant la capacité d'agir comme sudditi pontifici, ces capitaines et marins devinrent par la suite des opérateurs marchands économiquement profitables et incontournables.

If the creation of the Consolato del mare court of Civitavecchia in 1742 was the late expression of an ancient and global movement for the restoration of a State-controlled justice, it also epitomizes the pontifical contradiction in the application of mercantilism. This institution was however facing the free ports ambiguity: at the same time opened to international trade and supposed to screen foreign activity. Above all, the mercantilist political context pushed the economic actors to a daily reinterpretation of local rules. Indeed, institutional agents were usually connected with the protagonists of trade. Therefore, economic actors and institutions were able to enforce justice with a high degree of flexibility. As such, in a context of creation and assertion of a State identity, the initial insertion of foreign captains by the means of normative apparatus regulating papal maritime trade gave concrete expression to the slow accumulation of informal skills and the development of a network of strategically positioned go-betweens. Such skills revealed to be a professional and economic stepping stone, combining diversified activities and institutional interpretation strategies. Using their condition of stranieri, with the ability to act as sudditi pontifici, these captains and seamen became economically profitable and crucial merchant actors.

La piraterie est un phénomène international depuis l'Antiquité. Sa répression a fait l'objet de différentes mesures de la part des États. Mais c'est du XVe au XVIIIe siècle que cette infraction a été reconnue comme crime international. La découverte du Nouveau Monde, le commerce et les profits qu'il a engendrés ont poussé les nations à prendre fait et cause contre « l'ennemi du genre humain ».Ainsi, les nations sont parvenues à mettre en place une définition commune puis à mettre en œuvre des instruments juridiques parachevant la compétence universelle. Ainsi définie, cette dernière permet à n'importe quel État de poursuivre et d'arrêter les pirates sans considération de naturalité et les autorise à les ramener dans leur pays pour qu'ils soient jugés selon leur droit interne. Cette répression particulière tient aux différents éléments constitutifs de l'infraction ainsi qu'au besoin d'efficacité de la répression.L'étude de la répression de la piraterie aux Caraïbes entre les XVe au XVIIIe siècles permet de comprendre la création de ce mécanisme particulier, d'en saisir les enjeux et les contours et d'appréhender plus facilement un mécanisme international encore exploité aujourd'hui.

Piracy is an international phenomenon since Antiquity. Its repression was the subject of different measures that states have taken. But, it's from the 15th century to the 18th century that its internationalization has been dedicated. The discovery of the New World, commerce and profits which it spawned have pushed nations to take up the case against “the enemy of the human kind”.Nations have thereby succeeded in establishing a common definition then to implement legal instruments allowing the application of the universal jurisdiction. Thus defined, this last allows any State to pursue and arrest pirates without consideration of naturality and to bring them in his country to been prosecuted according his internal law. This particular repression considers of his various components of the infraction as well as the need for an effective repression.Studying the repression of piracy in Caribbean between the 15th and the 18th centuries allows to get a better understanding of the creation of the particular mechanism of universal jurisdiction, to grasp its stakes and contours and to apprehend more easily an international mechanism still exploited today.

▼ One of the central purposes of the international law of the sea is to define various maritime zones, their extent and limits. One of these zones is the continental shelf. The continental shelf in modern international law has two aspects: The continental shelf within 200 nautical miles from the shore of coastal States and the continental shelf beyond that limit. The United Nations Convention on the Law of the Sea provides that information on the limits of the continental shelf beyond 200 nautical miles shall be submitted by the coastal State to a scientific and technical commission, namely the Commission on the Limits of the Continental Shelf. The Commission is responsible for making recommendations to coastal States on matters related to the establishment of the outer limits of their continental shelves beyond 200 nautical miles. If the limits of the shelf established by a coastal State are on the basis of the recommendations, they are final and binding. The establishment of the continental shelf beyond 200 nautical miles has two main features: The establishment of the boundary line between the continental shelf and the international seabed area and the establishment of the boundary between the continental shelf of adjacent or opposite coastal States. Many questions concerning the relationship between these procedures have been left unanswered as well as the relationship between the Commission and international courts and tribunals. This thesis analyses the role of coastal States, the Commission and international courts and tribunals in the establishment of the continental shelf beyond 200 nautical miles and the interplay between them. It explores how the various sources of international law have contributed to the establishment of the current legal framework. The thesis explores the differences between the delineation and delimitation of the continental shelf beyond 200 nautical miles. It demonstrates that the role of the Commission is to curtail extravagant claims to the continental shelf beyond 200 nautical miles and protect the territorial scope of the international seabed area. It also shows that the role of international courts and tribunals in this field is essentially the same as their role in other types of disputes. It explains that the establishment of the boundary line between the continental shelf and the international seabed area and the establishment of the boundary between the continental shelf of adjacent or opposite coastal States is a separate process. Furthermore, it clarifies that the three-stage boundary delimitation method is applicable beyond 200 nautical miles. It also displays that no special rule of customary international law has evolved that is solely applicable to delimitations regarding the continental shelf beyond 200 nautical miles. The thesis addresses the interaction of the various mechanisms within the United Nations Convention on the Law of the Sea concerning the continental shelf beyond 200 nautical miles. Les sûretés réelles sur le navire (qui a une valeur énorme et une fonction essentielle pour l'activité maritime) présentent une particularité par rapport à celles sur les biens meubles, en droit continental ainsi qu'en Common law. D'abord, il concerne les sûretés conventionnelles -l'hypothèque maritime (droit français et coréen), le statutory ship mortgage (droit anglais) et le preferred ship mortgage (droit américain), qui sont le résultat des efforts de chaque pays pour améliorer le financement maritime. Ensuite, il s'agit du privilège maritime/maritime lien (la sûreté légale) qui grève le navire de plein droit pour garantir certaines créances généralement relatives à son exploitation (qui diffèrent selon les pays). En effet, chaque pays a essayé de qualifier sa nature juridique particulière et sa nécessité, par exemple par la théorie du patrimoine maritime, la théorie de la personnification du navire, ou dans une relation avec l'action in rem etc. Les prérogatives des titulaires de ces sûretés ainsi que les modes, procédures et conditions de les exercer sont différentes d'un pays à l'autre. The security interests on the ship (which has an enormous value and an essential function for the maritime activity) present a peculiarity in comparison with those on chattels, in continental law as well as in Common law. First, it concerns the conventional security interests - the maritime hypothec (French and Korean law), the statutory ship mortgage (English law) and the preferred ship mortgage (American law), which are the result of each country's efforts to improve the maritime financing. Second, it concerns the privilege maritime/maritime lien (the legal security right) which occurs automatically on the ship for certain claims generally related to its exploitation (which differ in each country). ln fact, each country has tried to qualify its particular legal nature and its necessity, for example by the maritime patrimony theory, by the theory of the personification of the ship, or in a relation with the action in rem etc. The prerogatives of the holders of these security interests as well as the modes, procedures and conditions for exercising them are different from country to country. ▼ Taiwan is an island surrounded by ocean, where its unique geographical location has placed Taiwan the role of the Asian maritime hub. Heavy traffic is around the surrounding water with thousands of ships passing through each day. The prosperous shipping industrial bring economic benefits, nevertheless, it also enhances the risk of marine pollution. Facing the potential marine environmental impact incurred by shipping, it is imperative to review the current inspection system and related policies designated to the prevention of ship pollution. Currently in Taiwan, Port State Control (PSC) is implemented by the harbor bureaus, who enforce the regulations articulated by PSC. The objectives of PSC are to protect human life and cargo safety at sea, and to prevent the pollution from ships. Due to the lack of dedicated units and personnel, there are no frequent ship inspections and thus less effective PSC operations. In addition, without any appropriate vessel to navigate off coast, the harbor bureaus cannot perform investigations on board for the ships sail around Taiwan waters. It is therefore possible that the ships discharge waste oil and sewage into the sea intentionally or negligently, and cause marine environmental pollution and impact marine ecology. The study has identified the inadequate capacity for maritime enforcement in Taiwan. To improve the current situations, it is necessary to refer to law enforcement experiences from developed countries. After careful review the related literatures, the study has also interviewed several domain experts and presented the results using the SWOT table. In addition, a multi-objective programming (MOP) model has been formulated to suggest the allocation strategies of inspection resources based on the objectives of cost and performance. Finally, the study has analyzed the historical events, enforcement capacities, equipment, laws, and policies, and has proposed the comprehensive suggestions to overcome the current problems and thus improve the supervision of oil pollution from ships. The goals of marine environmental protection and sustainable marine ecology are therefore achievable. ▼ Maritime transport is essential to the world’s economy and maritime arbitration plays a crucial role in maritime dispute resolution. Nowadays, many coastal jurisdictions have set up their own maritime arbitration institutions such as those in the US, the UK, Germany, Australia, China, Japan, Hong Kong, and Singapore. Building a national world-advanced maritime arbitration system as soon as possible to suit China’s rapid developments in shipping and international trading does not permit of any delay. How should China improve her laws, rules and institutions, including those for the enforcement of maritime arbitration awards, having regard to leading international maritime arbitration systems?It is posited that selective adaptation from the successful experience of other maritime arbitration systems is the most convenient and effective way to achieve such a goal. This adaptation will follow from a comprehensive and comparative study of the maritime arbitration laws, rules and the maritime arbitration institutions, including the laws relating to the enforcement of maritime arbitration awards, from these main global maritime arbitration centres in order to make China’s maritime arbitration more competitive at the international level.This thesis does not purport to cover every research field relating to maritime arbitration. Instead, as previously stated, it will focus only on the comparative study of some selected key issues of international commercial arbitration among the selected jurisdictions. A comprehensive study of international commercial arbitration or international maritime law is not the subject of this thesis. It should be noted further that this research basically concentrates on the practical problems of maritime arbitration practices, rather than taking an overly theoretical approach.The thesis selects the UK, the US, Singapore and Hong Kong as the target jurisdictions for comparison. Through selective comparative analysis of the key issues of maritime arbitration systems in the selected jurisdictions, which are internationally recognised as significant by many arbitration scholars, this thesis proposes that all these issues could conveniently be categorised into four key criteria; namely, fairness, confidentiality, efficiency and enforceability. It follows that the adaptations of the Chinese maritime arbitration system should mainly focus on these four criteria, as these are the most critical factors for the development of Chinese maritime arbitration system. Moreover, these four criteria should also have significance for other underdeveloped maritime arbitration systems. Also, based on these four key criteria, the thesis provides some specific suggestions on how the Chinese maritime arbitration system can be adapted to reflect other selected jurisdictions in the respects of some key issues of international commercial arbitration.
