▼ Accessing justice has been challenging, particularly for the poor due to the cost involved in seeking legal services. This has resulted in the recognition of the need for legal aid in improving access to justice for marginalized, excluded and impoverished groups. The purpose of this research was to compare two legal aid schemes with respect to their capacity and delivery of social justice. Theoretically, the arguments of this study are grounded in the justice theory, vertical equity theory and access rights theory. Methodologically, this research adopted a case study design using two legal aid providers. These were the International Federation of Women Lawyers (FIDA) Ghana and the Legal Aid Scheme (LAS). In all, 15 Paralegals, 2 Alternative Dispute Resolution Officers (ADRs) and 59 beneficiaries across the legal aid centres were interviewed for the study, using an interview guide. The research was conducted in the Greater Accra Region. Sampling of the ADRs and Paralegals was done purposively. A multi-stage sampling technique was used in sampling beneficiaries. Both thematic and trend analyses were used. Generally, there is a high demand for legal aid services from both LAS and FIDA. The services of these two organisations - FIDA and LAS have helped their beneficiaries to access justice. However, the lack of follow-up on cases by the two legal aid providers; the low engagement in public awareness creation on the availability of legal aid; dependence on donor funds and limited coverage will affect the promotion of meaningful justice. To promote social justice, legal aid institutions need to constantly monitor and evaluate the welfare of their beneficiaries who access justice using an effective feedback mechanism. Additionally, accessibility across all geographical areas should be increased by creating legal aid zones

▼ With the increased adoption of BIM into existing contract delivery methods becoming more common on construction projects, owners have begun investigating the
legal issues which may exist by adopting BIM. BIM processes have the potential to influence many contractual relationships and shift risk amongst project participants. The purpose of this study is to evaluate the potential methods to address the shift in risks that project teams may encounter when implementing BIM on a project, and identify methods they can take to appropriately allocate risk among the project team.
The research started with a literature review and a review of contracts on projects that included a degree of BIM implementation. Then interviews were conducted with eight attorneys specializing in BIM projects and two insurance underwriters with experience insuring organizations using BIM. The results were compiled through a detailed content analysis of the expert opinions. The analysis confirmed eight potential issues including Spearin warranties, Right of Reliance, Standard of Care, Privity of Contract, Economic Loss protections, Technology Dependence, Ownership of Data, and general insurance/risk protection methods.
While this research is not intended to provide specific language for use in a BIM contract, it will assist owners and team members in identifying potential issues that should be addressed in projects that are implementing BIM. In addition the research provides an analysis of each issue developed and provides contract language examples from existing BIM contracts.

▼ Care ethics is primarily about responding to needs. Yet, surprisingly, attempts to apply the ethics of care in the domain of law have paid almost no attention to the concept of legal needs. This study fills that gap by systematically defining legal needs. It does this by revising current understandings of legal need through a unified conceptual framework for the philosophy of needs and a comparative analysis of legal action, and its major alternatives in dispute resolution and prevention. The conception of legal need that results is both more sensitive to preventative functions of the law and opens the door to a much wider range of policy options beyond legal aid. Legal needs are found to be a special case of institutional needs, i.e. needs that cannot be satisfied without an institution. I argue that the existence of institutional needs means institutions, rather than any particular actor within them, can be caregivers, but not all conceptions of the ethics of care are compatible with this kind of need. Joan Tronto’s conception of care is found to be the most accommodating and is used as a framework for a series of policy recommendations to move us towards a caring legal system.

▼ Depuis l’abolition de la monarchie absolue en 1932, le royaume a connu des situations politiques variées : les activités « contre-révolutionnaires » des royalistes ; l’arrivée au pouvoir des militaires ; l’émergence de nouvelles classes politiques ; les massacres de civils ; les compromis entre les militaires, les royalistes et les progressistes ; l’incertitude sur l’avenir du royaume et de la couronne... L’échec de la transition démocratique thaïlandaise est expliqué généralement par un argument convenu : l’immaturité de la société thaïlandaise ; la démocratie libérale de type occidental ne serait pas appropriée pour le pays, notamment pour des « pauvres ruraux ignorants » ; l’armée est le seul acteur capable d’encadrer le développement d’une démocratie. Pourtant, cette étude présente une explication alternative ; elle démontre que la vie politique du royaume est déterminée par trois axes du pouvoir : les élites traditionnelles, dont la monarchie, l’armée et la haute fonction publique ; c’est cette situation qui explique l’échec du progrès démocratique. Et le coup d’État est la méthode préférée pour protéger le statu quo ; quant à la constitution thaïlandaise est semblable à une « lettre morte » ou à un « instrument de la politique au quotidien » ; elle ne représente plus la norme suprême qui exprime l’idéologie politique du pays ; au contraire, elle est utilisée non seulement pour légitimer a posteriori un coup d’État, mais également pour défendre la domination politique des groupes dominants. Nous pouvons donc conclure que le coup d’État thaïlandais est déclenché par l’armée royale avec l’appui de la monarchie et son réseau de conseillers ; puis, il est justifié par le roi et le judiciaire, en assurant l’impunité de ses auteurs par les lois et la constitution.
Since the abolition of absolute monarchy in 1932, the kingdom has experienced the various political situations: the ‘counter-revolution’ of the royalists, the dictatorial regime, the emergence of the new middle classes, the massacres of civilians, the political compromise, the uncertainty about the future of the kingdom and the crown… The failure of a transition to democracy is usually explained by the usual arguments: the political immaturity of Thai society, the ‘Western-style liberal democracy’ would not be appropriate for the country especially for ‘the ignorant masses’, the army is the only actor, who capable to promote democracy. However, this study presents an alternative explanation. It demonstrates that the political life of the kingdom is determined by three axes of power: traditional elites, including the monarchy, the army and the senior civil servant. It is this situation that explains the failure of the democratic process. And the coup is the traditional method to protect their status quo. As for the constitution, it is similar to a ‘dead letter’ or an ‘instrument of everyday politics’. It isn’t represented as supreme norm that expresses the country’s political ideology. ▼ The first overall aim of the thesis is to demonstrate why it is important to include knowledge about emotion in legal-ethical judgment and decision-making. Chapter two explains what emotions are, demonstrates how emotions involve judgment and evaluation, and how emotions are connected to moral and ethical judgment. It is argued that the ability to account for both the positive and negative influences of emotion leads to better ethical judgment. Chapter three demonstrates how emotion is involved in ‘thinking like a lawyer’. The knowledge about emotion from Chapter two is used to expand the understanding of how emotion is involved in ‘thinking like a lawyer’ and legal-ethical judgment. It is argued that including the emotional aspects of legal-ethical judgment, will make legal ethics education more comprehensive and better equip law students for the reality of making ethical judgments in practice. The second overall aim of the thesis is to demonstrate how knowledge about emotion could be introduced into legal ethics education. This aim is achieved in Chapters four and five through the case study of the legal ethics curriculum at the Law Faculty, University of Technology Sydney. Chapter four argues that educating students about the role of emotion in legal-ethical judgment is best implemented via the pervasive and incremental approaches. Chapter five argues that by using concrete examples of how emotion is involved in legal-ethical judgment and how emotion can be integrated into teaching and learning strategies, this thesis will provide academics with a framework from which they can formulate their own teaching and learning strategies with a view to achieving learning outcomes for students such as: increased awareness and understanding of their own emotional capabilities and the ability to critically reflect on and analyse the role of emotion in ethical judgment.

▼ This study has made an effort to investigate the effects of traditional family arbitration and
legal
divorce on divorcees and their children. For its methodological convenience qualitative method
and non-probability purposive sampling techniques have been employed. Study participants have
been divorcees, their children and reconciled spouses after opening of file for divorce in the
court. The last five years (2010-2014) petition provided for divorce, divorced and reconciled
spouses data has been used as point of observation. In addition to in-depth interview FGD, key
informants’ interview and document analysis was done. Principal causes, prevalence, and effects
of divorce,
legal grounds of family arbitration, appointment and removal of arbitrators,
composition and roles of arbitrators have been critically addressed to identify effects of
traditional family arbitration. Moreover, fundamental reason of the court when redirecting the
case of spouses for arbitration has been assessed to know the advantages of traditional family
arbitration for divorcees and their children. Divorce is negatively affecting the social, economic
and psychological status of divorcees and their children. Traditional family arbitration is
believed to be the most effective and efficient conflict resolution mechanism among spouses.
Principal effects of arbitration on disputing spouses and their children are protecting unstable
families from disintegration, children separating from their parents, protects likely social evils
related to divorce, reduces resource and time wastage of both litigating spouses and the court and
shares court case overload. Potential challenges of arbitration are community’s lack of
understanding about gender equality, rights and interests of women, marginalizing women from
arbitration process, biased belief of women as if arbitration always favoring for men in their
expense, and passing decisions in favor of men in the case common property management and
parenting styles

the case of Meru municipality, Kenya. The study will be guided by the following objectives: To
establish the influence of cost of digital/electronic weighing and measuring instruments on legal
metrology; to assess the influence of operation of electronic weighing and measuring
instruments on legal metrology; to establish the extent to which technical know-how and
training on electronic weighing and measuring instruments influence legal metrology; to
establish how standardization of electronic weighing and measuring instruments influence legal
metrology. The study will target traders, weights and measures officers, licensed weights and
measures repairers in Meru region from Meru Municipality. The researcher will use stratified
random sampling procedure and then adopt descriptive research design. The data will be
gathered from the traders in Meru, weights and measures Officers in Meru region and of Meru
Municipality, through questionnaires structured on the basis of the objectives of this study. Data
required for analysis will be collected from the respondents and analyzed using Statistical
Packages for Social Service. The findings of the study will be significant to the Government of
Kenya, various stakeholders, weights and measures department staff of Meru Municipality.

▼ Foundation Chief Justice of Van Diemen’s Land, Sir John Lewes Pedder (1793-1859) was appointed by the Colonial Office to administer English law in the colony from 1824. As an official member of the Executive and Legislative Councils, he also provided policy advice and certified local legislation. Until his retirement in 1854, Pedder was a central figure in the colonial administration and settler community.
Contributing to the emerging fields of settler colonial studies and comparative colonial legal history, this thesis situates Pedder within the Anglophone colonial world at a significant period of transition from empire to nation-state. Engaging constructively with Philip Girard’s ‘window on an age’ model for writing the lives of colonial judges, it also broadens the focus from the presentist, professional concerns of conventional judicial biography to a more historically sensitive reading of the archive. Reconstructing Pedder’s life-world in the metropolis and the colony reveals how his formative experiences and personal connections shaped his values and professional practices. His repatriation to England in retirement also clearly identifies Pedder as an expatriate professional, rather than a settler-colonist.
From this biographically informed base, the thesis contextualises and tests three enduring popular and scholarly constructions of the chief justice: as a ‘hanging judge’, a puppet of government, and a champion of the Aboriginal people of Van Diemen’s Land. Building on a long literary tradition in which frontier judges were recast as judicial murderers, the tabloid press posthumously constructed Pedder as a Tasmanian Judge Jeffreys. Colonial case law and press commentary are used to demonstrate that mandatory sentencing and community expectations of retributive justice gave Pedder little scope for judicial discretion during the dying decade of the ‘bloody code’.
Inflected by the aspirational rule-of-law rhetoric of settler activists, Pedder’s construction as a puppet of government obscures the complex relationships between his judicial, executive and legislative roles. Comparative judicial biography reveals that colonial judges were routinely appointed ‘at pleasure’ by the imperial executive, and were expected to perform a range of extra-judicial functions. Linking Pedder’s experience in Van Diemen’s Land to current scholarship in other Anglophone settler polities, this thesis demonstrates that Pedder saw no essential conflict between his duties. Moreover, professional and political conservatism ensured that his primary loyalty was not to settler interests, but to the law and the Crown.
Pedder’s benevolent construction as a champion of the island’s Indigenous inhabitants centres on his 1831 objection to the policy of banishing all survivors of the Black War to the islands of Bass Strait. His concern that the exiles would ‘pine away when they found their situation one of hopeless imprisonment’ has been read as a rare challenge to the genocidal impulses of settler colonialism. ▼ El presente trabajo tiene como objetivo proponer la derogación del artículo 153 del Código Civil así como la derogación del último párrafo del artículo 122 de la Ley General de Sociedades, a efectos de evitar las inexactas interpretaciones y cuestionamientos provocados por la utilización de esta figura, circunstancias que perjudican a poderdantes, apoderados y terceros, ya que no pueden saber qué efectos jurídicos genera la cláusula de irrevocabilidad en los poderes, y si los poderes irrevocables pueden revocarse en cualquier momento en tanto la revocación es un derecho del poderdante en su exclusivo interés, no siendo válido renunciar a él.
Nuestra hipótesis es que no puede considerarse admisible la renuncia al derecho de revocación, pues el poder nace de un negocio unilateral en el que el “único titular” del negocio siempre será el poderdante; por lo tanto, su interés en la representación no puede cuestionarse, – aun cuando también haya intereses comunes entre él y su representante o un tercero - resultando inadmisible que se ejerza el poder en contra de su voluntad e interés, pues dentro de esta pluralidad de intereses existe un interés “superior”, que es el del poderdante, expresándose en la autorización del representado a realizar sus propios negociosy por tal razón constituyéndose en un derecho irrenunciable.
Además, percibir una antítesis entre el derecho a revocar en cualquier momento un poder y el poder irrevocable es equívoco, en tanto los intereses del representante o de los terceros perjudicados se encuentran protegidos por el Código Civil, conforme a las normas que sancionan el abuso del derecho en perjuicio de alguien (indemnización por daños y perjuicios), las mismas que son aplicables a cualquier relación jurídica por lo tanto, también a las revocaciones de poder extemporáneas.

▼ In 1819, Ferdinand VII ordered the creation of two Colegios de Abogados in Cuba to prevent the expansion of the number of
legal professionals, as well as the unauthorized practice of law. The strategy, however, failed, and lawyers increasingly became a force of political and social change in the island, being mostly inspired by the debates about the implementation of liberal agendas in and out of Cuba. Some Colegios de Abogados
eventually became centers of anti-Spanish conspiracy and lawyers even led recurrent uprisings for Cuban independence. Ideas of reform among Cuban lawyers, however, were diverse, and different interpretations of liberalism surfaced, especially under the influence of other movements such as annexationism and autonomism. This variety of ideas encountered one another at the Constitutional Convention of 1901, where self-proclaimed liberal delegates still questioned, for example, free education and universal suffrage, which made evident the many shades that liberalism still had in Cuba at this time.
This study takes
legal professionals to be a strategic window to approach and explain key social, political and intellectual transformations in nineteenth century Cuba, while unveiling the leading role lawyers themselves played in those processes. Relying on personal and professional documentation, correspondence and job applications, the dissertation recreates lawyers’ political, intellectual and social positions, and shows how they had a decisive participation in historical change in late colonial Cuba. Their ideas survived in periodical publications, newspapers, and political writings that they established or where they participated, as well as in legislations that they enacted, applied or commented on. Being the most influential professional group of the period under study, lawyers represent a perfect tool to understand the end of Spanish times in Cuba and its transit, under the flags of liberalism, to an independent republic.

▼ This is a cross-cultural study of Indigenous
legal traditions in Nishnawbe Aski Nation (NAN), a political territorial organization in northern Ontario. By analyzing NAN’s resolutions (passed by NAN Chiefs-in-Assembly to direct NAN’s mandate), I identify
legal principles.
As law arises from worldviews, law’s function is to protect the values of that worldview. This study discusses two values (creation and interdependence) as analytic tools, used to recognise
legal principles. Context grounds the conclusions, as they relate to specific people and land.
Four
legal principles are identified: earthbound need, sacred/natural supremacy, gifted responsibility and relational jurisdiction. These principles together reveal that law in NAN is focused on the protection of life.
Overarching the results is a broader purpose, to take up the educative work previously shouldered by NAN alone. The duty to learn is more than political obligation, but as I argue, is a matter of life itself.

Samas puudub Eestis praegu optimaalne õiguslik lahendus, mis võimaldaks näiteks pärast ettevõtja surma jätkata äriühingu tegevust, kaitstuna perekonnasisestest lahkhelidest tulenevate probleemide, mõne pereliikme liigse tarbimise või riskijulguse ning võlausaldajate võimalike rünnakute eest. Seetõttu otsivad isikud abi välisriikidest, kus eksisteerivad sobivad õiguslikud lahendused. Tihtipeale kasutatakse selleks välismaiseid trust’e.
Trust-i näol on tegemist süsteemiga, mis võimaldab eraldada isiku vara hulgast esemeid, et tagada nende säilimine ja (eelduslikult tulutoov) valitsemine. Samas on võimalik garanteerida tulud kindlatele isikutele nii, et esemed pole ka nende vara koosseisus ja neil ei ole varaküsimustes otsustusõigust. Lisaks ettevõttega seotud surmapuhustele korraldustele, mida nimetati eespool, kasutatakse trust’e ka näiteks siis, kui soovitakse tagada ajalooliselt suguvõsa omandis olnud kinnisasja säilimine ja selle kasutamise võimalus tulevastele põlvedele. Samuti siis, kui inimene muretseb selle pärast, et ei ole kõrgesse ikka jõudes enam suuteline tegema varalistes küsimustes pädevaid otsuseid, või tal on puudega laps, kes ei ole pärast vanema surma võimeline varalisi otsuseid langetama. Ka saab vanem trust-i abil lükata lapse omanikuks saamist edasi kuni viimase täisikka jõudmiseni või teha korraldusi puhuks, kui on alust arvata, et laps ei ole varalistes küsimustes usaldusväärne ka täisealisena (on narkomaan või hasartmängusõltlane). Keerulisi olukordi põhjustavad ka segased pere- ja paarisuhted, näiteks kui abielulahutuse korral soovib üks vanem varakogumi eraldamise teel kindlustada laste tulevikku, välistades samas teise vanema otsustusõiguse selle vara üle.
Väitekirja eesmärk on leida vastus küsimusele, millised probleemid esinevad Eestis juba eksisteerivate õiguslike lahenduste kasutamisel perevara planeerimiseks. An international perspective in thiscontext means the regulation of domestic work as an international labour standard bythe International Labour Organization (ILO). Its national perspective entails the variousmodels of national regulation in three countries- South Africa Namibia and Indonesia.This dissertation also brings to the fore the nature of domestic work in its evaluation as a labour standard. It does this to give a general understanding of the
subject. In recent years, regulating domestic work has been a popular topic within international labour law circles. However, the popularity of this discussion is not reflected in the working lives of a majority of domestic workers worldwide. Therefore, this dissertation reiterates specific issues that affect the lives of domestic workers in a bid to contribute to the body of knowledge on the
subject; and the achievement of social justice and decent work in this “invisible' sector.This dissertation concludes that the proper regulation of the domestic work sector is the first step in the achievement of social justice for domestic workers. It also posits after a comparative analysis that the regulation of decent work requires a framework in which hard and soft law approaches are interwoven in the regulation of domestic work. This framework is important as the intertwining of hard and soft law regimes will enable the reaffirmation of and compliance with ILO standards for domestic work regulation. National legislation of ILO member states also have to be fine-tuned or amended to this dissertation reiterates specific issues that affect the lives of domestic workers in a bid to contribute to the body of knowledge on the

▼ This dissertation examines the attitudes, pedagogical practices, and teaching materials of Canadian contract law professors to better understand the relationship between theory and practice in legal education. Professors express a widespread aspiration to translate theory into practice – to incorporate theoretical and critical perspectives as a means of producing “better lawyers.” However, an analysis of the substantive theoretical attitudes about law reveals that this aspiration is imperfectly realized.
When professors describe their beliefs about law, they overwhelmingly express strong commitments to realist and critical ideas, drawn largely from American legal thought, that emphasize law’s contingency and indeterminacy, and that construe considerations of policy, context, and politics as central to an understanding of law. However, the attitudes about law reflected in key manifestations of “practice” reveal an apparently contradictory set of commitments. Professors describe and conceive of legal reasoning, which can be considered a foundational practice shared by legal professionals, in a way that foregrounds formalist attitudes of law. These conceptions treat judicial reasoning seriously, privilege the importance of doctrine, and emphasize the determination of relevance with reference to an internally coherent set of rules – all of which effectively marginalizes considerations of policy, politics, and context. Moreover, the way professors teach, how they formulate their learning objectives, the decisions they make about substance, and the materials they use all put into practice these formalist ideas, rather than the realist and critical attitudes to which professors are purportedly committed. A similar tension arises as between critical introductory statements in Canadian contract law casebooks and the casebooks’ more conventional presentation of substance, as viewed through the remedies chapters.
These observations imply that Canadian legal thought may be characterized by theoretical eclecticism co-existing with methodological homogeneity, a failure to operationalize theoretical commitments. Moreover, the dynamics reveal a complex interplay between structure and agency in legal education in which professors participate affirmatively in reproducing the structures that condition them. This complex interplay partially accounts for the tenacity of conventional categories, concepts, and pedagogical formulae, and is a crucial factor to understand in the pursuit of any transformative vision for legal education.

legal case
perspective regarding a class action lawsuit describing the defendant positively or
negatively and were accompanied by one of five stacked-bar graphs, or no graphic at all.
The graphics were designed to manipulate visual features of the graph, including salience
and hue. We presented learners with either an achromatic graphic, chromatic red graphic
or chromatic green graphic representing the success or failure of the company. We
measured learner evaluations of the company???s positive and negative characteristics, and
doubt about the company???s guilt. Results indicated that there was no difference on
evaluations and judgments when an achromatic graph was presented, but that both
salience and hue influenced evaluations???specifically, that red lead to negative
evaluations, except for when it is accompanied by a positive case perspective.

▼ A fundamental question in decision-making is how instructions can be used to influence behavior. Nowhere is this question more important than in the legal system, in which the fate and lives of individuals are in the balance. In the United States, jurors are frequently instructed to apply poorly defined and varied decision thresholds (burdens of proof), as well as instructions to disregard inadmissible evidence. For civil trials, a preponderance of evidence (PoE) is set as the decision threshold, while criminal trials require the more stringent threshold of beyond a reasonable doubt (BaRD). It is unclear, however, how decision threshold and disregard instructions are applied by laypeople and how they compare to participants’ intuitive decisions. To evaluate burden of proof instructions, here we applied quantitative, psychometric analyses to assess and compare decision thresholds across instruction-type in both legal and non-legal contexts. We found a consistent pattern across all legal scenarios, non-legal scenarios, and psychophysical tasks: As expected, naive individuals interpreted PoE less stringently than BaRD, but surprisingly, they interpreted PoE more conservatively than their own intuitive belief (IB) and the legally prescribed threshold. Decision thresholds were also more stringent for legal than any non-legal contexts. Follow-up studies addressed why laypeople's PoE standard is interpreted more stringently than expected, and why adjudication in the
legal domain is consistently more conservative than any other domains of decision-making tested. We also examined how domain expertise affected this pattern of results. Furthermore, to understand the application of disregard instructions we built on an existing neuroimaging paradigm to evaluate the brain mechanisms involved in assessing biasing character evidence and admissibility instructions using fMRI. We found that an instruction allowing individuals to consider evidence increased punishment independent of character evidence, and identified several prefrontal regions associated with individual differences in the application of this instruction. Taken together, our findings suggest that
legal instructions can influence decisions in ways not intended or accounted for by the law. This may call for a re-assessment of the intended outcomes of legal standards – particularly PoE – as well as the potentially biasing effect of admissibility rulings.

▼ This thesis examines the relationship between the moral rules that apply to all persons by virtue of their humanity (‘universal moral rules’) and the rules they must follow to continue serving in particular (often socially important) roles (‘role responsibilities’). It provides a general framework for what to do if universal moral rules and role responsibilities conflict, focusing particularly on the role of lawyer and similarly state-involving professions. It argues that ideally constituted roles will not create duties to infringe universal moral rules and defends the general priority of universal moral rules when a role’s non-ideal constitution leads to conflict. It then offers a limited exception to the general priority of universal moral rules that applies when a role can only be performed if one violates a universal moral rule and the role is necessary for a well-developed society to maintain a certain level of functioning, but suggests one ought to regret the bad effects of acting under that exception.

Na sociedade, a identificação humana é indispensável tanto por razões legais como humanitárias. Porém, existem situações em que corpos encontrados não são passíveis de reconhecimento ou quando não há suspeição, impossibilitando a identificação. Nesses casos,
análises antropológicas são de extrema importância, pois permitem estabelecer o perfil biológico do sujeito. Assim, realiza-se a Reconstrução Facial Forense (RFF) para possibilitar o reconhecimento e levar a uma possível identificação. A RFF, para ser realizada, precisa dos valores das espessuras de tecidos moles faciais (ETMF) em diversos pontos craniométricos. Essas medidas servem como guia para se estabelecer um limiar do contorno da face e podem ser influenciadas por diferentes fatores como sexo, ancestralidade, idade e índice de massa corporal (IMC). Não há na literatura tabelas de ETMFs de crianças e adolescentes brasileiros, para auxiliarem na RFF. O objetivo desse trabalho foi realizar a mensuração da espessura de tecidos moles de crianças e adolescentes brasileiros, a partir de dados de imagens de Tomografias Computadorizadas de Feixe Cônico (TCFC) de indivíduos vivos, considerando-se as variáveis sexo, idade, cor da pele e índice de massa corporal. Neste estudo, foram
mensurados os 21 pontos craniométricos pré- determinados por meio do software Osírix Lite, de imagens de TCFC da região de cabeça e pescoço de 103 não adultos brasileiros (39 crianças e 64 adolescentes), obtidas junto aos arquivos de imagens de uma clínica de Radiografias e Documentações Odontológicas localizada na cidade de Araraquara – SP. De acordo com os resultados obtidos houve diferença significativa (p≤0,05) nos pontos supraglabela, glabela, rinio, supradentale, supraorbital e gonion mensurados em crianças, e na amostra de adolescentes as diferenças significativas existentes foram nos pontos nasion, rinio, filtro-médio, supradentale, infradentale e na eminência frontal. Em todos esses pontos o sexo feminino apresentou média de espessura menor do que a do sexo masculino. Em 16 pontos craniométricos, crianças do sexo feminino brancas apresentaram médias de ETMFs mais baixas do que as não brancas. O mesmo, no sexo masculino, aconteceu com 9 pontos. ▼ This dissertation offers an unprecedented empirical window into federal prosecutors’ everyday work. The ethnographic research that constitutes it includes 133 interviews with Assistant U.S. Attorneys and participation in 68 case preparation meetings and 26 jury selection proceedings between 2013 and 2017. It also includes participant observation during two trials that fell at the beginning and end of the research period. Analysis of these cases draws on pertinent trial transcripts, sidebar interactions, and strategy meetings.
My argument is that jurors play a central role in prosecutors’ decision-making, professional identities, and formulations of justice. This is because the possibility of lay scrutiny at trial, however remote, creates an opening for prosecutors to invoke nonlegal knowledge about the fairness of their cases and their responsibilities as public servants. I argue, further, that prosecutors’ references to jurors as a routine part of their technique exceeds the instrumentality of obtaining guilty verdicts. The pervasive invocations of real and imagined laypeople that ethnography brings to light make a case for the jury’s value and continuing impact as prosecutions are made and abandoned in their name.
This study contributes to the discipline of anthropology by demonstrating the collaborative, contingent, and creative character of
legal technique in the United States. The findings that emerge from it also unsettle conventional understandings of prosecutorial discretion and lay participation. First, it challenges dichotomous conceptions of lay and professional expertise, as prosecutors regularly bring common sense understandings of justice into their discussions. Second, it demonstrates that prosecutors do not constitute a monolithic professional group. Rather, they invoke jurors as a narrative resource with which to critique and adjust their approaches to cases. And third, prosecutors negotiate their ethical and professional commitments as representatives of the federal government with reference to the laypeople who may evaluate their work.

▼ This thesis writes a history of the institutional life of coronial law in the nineteenth and twentieth centuries. The office of coroner has occupied an important role in the common law since the twelfth century. Its status may have waned, its duties may have changed, yet its enduring concern with investigating the causes of death has preserved its vital role in the juridical governance of the dead. This thesis offers a historical account of the modalities by which coroners have occupied their offices and formed lawful relations with the dead in Australia. It does so by examining coronial law in terms of its technologies and its institutional formations. The chapters that follow explore a range of lawful technologies, including place-making, architecture, super visum corporis, manuals and files, each of which became attached to the conduct of the office of coroner in the nineteenth and twentieth centuries. The thesis thus offers an institutional history of the coroner by thinking through how technologies have attached the dead to coronial institutions, how coroners have performed their offices, and how they have assumed responsibilities for caring for the dead.

▼ Pakistan has been undergoing considerable changes in legal education and legal practice which has resulted in a growing disjunction noticed by the legal fraternity. Graduating law students lack the skills needed to apply theory in practice and at the same time practitioners have changed the shape of how the law should be applied. The supreme court of Pakistan has acknowledged that this disjunction threatens to tear apart the relationship of legal education and legal practice. This research explored how different stakeholders are impacted by this disjunction and how the growing disjunction can be bridged. Using Pier Bourdieu's theoretical framework of social capital and cultural reproduction theory this exploratory case study sought to answer the following central research question: How can the current state of law education be improved to minimize the disjunction between the education of law and practice of law in Pakistan? Qualitative analysis of the experiences and perceptions of lawyers', law students', experiences led to the following major findings. There is an inadequacy in the legal curriculum for the support of legal practice. There are not enough practical components to train students in law practice. There is too much societal pressure to join law schools for personal protection. There is inadequate teaching staff for law. No teaching skills programs are available for law teachers. Lastly, changes to law programs are driven by political reasons. Implications for practice and areas for future research are discussed.

▼ This thesis draws on the theory and method of social ontology to explore why labour law struggles to provide for wage security and clarity of employment status today. It starts by exploring at a conceptual level the relationship between law and capitalism, before moving on to engage more specifically with the concept of the wage, situating the analysis in a theory of the wage's socio-economic function. The thesis understands the 'wage' as, initially, the market price of the commodity, 'labour power', which is exchanged in the labour market. As with any other 'price', the wage functions to coordinate decision making in the market. At the same time, however, the wage is also the cost of reproducing that commodity, a process which is not confined to the market but takes place in society more generally: this is the function of social reproduction. These two functions are not only conceptually and materially distinct; they are frequently in conflict. The price the market assigns to the labour commodity is not always, and not necessarily, that which is required to cover its costs of (re)production. The thesis shows that these functions of the wage find their expression in the various concepts the legal system uses to describe the payment made by employers to their workers. For example, the legal concept of the 'wage' corresponds closely to the economic idea of the wage as price, and the concept of 'remuneration' to the wage as the cost of social reproduction, shifting some of the social costs of employment onto the employer. How these conceptual tools are deployed, however, and thus how effectively these functions are performed in practice, depends on law's own view of its ontological status: that is, the implicit position that the legal system takes on what constitutes 'social reality' beyond the text of a particular case or statute, and thus its view of whether, and to what extent, legal concepts can shape, as well as respond, to it. The thesis shows that whether the legal system sees its concepts playing an active role in constituting social and economic relations, or whether it sees them as passively reacting to the 'demands' of a 'pre-constituted' economic system makes a difference to the effectiveness of law in practice. Understanding law's implicit ontology in this sense helps us to see why labour law struggles to provide for wage security and clarity of status. Thinking about law's relationship with social reality can thus make an important contribution to our understanding of the problems of low pay and unclear employment status today.

▼ This dissertation examines how ordinary people in England and Russia form their perceptions of legal institutions in their experiences with lower courts. This work is based on a qualitative study involving interviews and observations in county and magistrates' courts in England and courts of Justices of the Peace in Russia, a number of focus groups with the court users and the judges, as well as a variety of secondary sources. The goal of this study is to investigate the inner workings of the English and Russian legal cultures through the analysis of stable attitudes towards legal institutions and their interplay with the people's perceptions of their individual experiences. My examination of these complex sets of ideas and images includes the analysis of people's preconceptions about institutions of justice, people's perceptions of administrative and procedural models, their interaction with court administration and legal professionals, and evaluations of the final outcomes of their cases. I argue that perceptions of legal institutions even at the lowest level are linked to the traditional images of courts in the Russian and English societies. The perceived position of legal institutions within the framework of the state, i.e. the level of their independence and impartiality, is one of the leading factors that shape people's long-standing attitudes of trust in legal institutions. The availability of administrative and procedural mechanisms that create and reinforce perceptions of transparency, equality, and reliability of legal institutions in people's everyday experiences contributes to the creation of stable attitudes of institutional trust. Peopleâs perceptions of the English and Russian lower courts reflect how ordinary citizens see the law and the institutions of justice in their countries, and how they perceive their own ability to obtain justice with the use of official legal mechanisms. These perceptions reveal the underlying relationships between people, law, and legal institutions in different societies and, therefore, contribute to our understanding of legal cultures.

▼ The aim of this study is to explore the issues
surrounding the implementation, monitoring and management of
legal
deposit in South Africa.
Legal deposit is a statutory obligation
which requires that a producer of any type of publication which is
available to the public, be it a commercial, public or private
organisation or an individual, deposit one or more copies of the
publication with a recognised national institution. The
Legal
Deposit Act of 1997 governs the deposit of publications in South
Africa. Section 8 of the
Legal Deposit Act makes provision for the
constitution of a
Legal Deposit Committee to oversee the
implementation of the Act. This Committee, which consists of a
broad spectrum of role players, expressed a need for an
investigation into the many issues and questions relating to the
provision of publications
subject to
legal deposit as required by
the
Legal Deposit Act. Although the
Legal Deposit Act, at the time
of its promulgation in 1998, was one of the first in the world to
make provision for the deposit of electronic publications, this
study focuses mainly on the
legal deposit of books as this was
identified by the Committee as an area of immediate and critical
concern. The study begins with a comprehensive literature study to
obtain sufficient theoretical information on
legal deposit and of
the problems and issues surrounding the
subject internationally and
in South Africa. - An overview of elements and issues covered in
legal deposit legislation provides the background against which the
investigation into the state of
legal deposit and its
implementation is undertaken. With the aim of contextualising South
African legislative issues, a comparative study of legislation in
the United Kingdom, Australia, Malaysia and South Africa is also
undertaken. -A discussion of the stages and activities involved in
legal deposit, the need for monitoring and enforcement procedures
and the external and internal factors that influence the way in
which
legal deposit is implemented in a country, provides an
overall understanding of the
legal deposit process -The
implementation of
legal deposit also depends on the committed
participation of various role players. The individual roles and
needs of these stakeholders in the
legal deposit process are
identified. The empirical investigation was conducted in two
stages. The first phase of the study involved a survey to explore
the attitudes, opinions and actions of publishers and
legal deposit
libraries, as the two main role players, to determine how these
factors affect the successful implementation of
legal deposit in
South Africa. This forms the bulk of the study. The second phase of
the study consisted of a feasibility study to determine the state
of compliance with
legal deposit in the country The outcomes of the
empirical study were used to identify gaps and weaknesses in the
current

▼ The aim of this study is to explore the issues
surrounding the implementation, monitoring and management of
legal
deposit in South Africa.
Legal deposit is a statutory obligation
which requires that a producer of any type of publication which is
available to the public, be it a commercial, public or private
organisation or an individual, deposit one or more copies of the
publication with a recognised national institution. The
Legal
Deposit Act of 1997 governs the deposit of publications in South
Africa. Section 8 of the
Legal Deposit Act makes provision for the
constitution of a
Legal Deposit Committee to oversee the
implementation of the Act. This Committee, which consists of a
broad spectrum of role players, expressed a need for an
investigation into the many issues and questions relating to the
provision of publications
subject to
legal deposit as required by
the
Legal Deposit Act. Although the
Legal Deposit Act, at the time
of its promulgation in 1998, was one of the first in the world to
make provision for the deposit of electronic publications, this
study focuses mainly on the
legal deposit of books as this was
identified by the Committee as an area of immediate and critical
concern. The study begins with a comprehensive literature study to
obtain sufficient theoretical information on
legal deposit and of
the problems and issues surrounding the
subject internationally and
in South Africa. - An overview of elements and issues covered in
legal deposit legislation provides the background against which the
investigation into the state of
legal deposit and its
implementation is undertaken. With the aim of contextualising South
African legislative issues, a comparative study of legislation in
the United Kingdom, Australia, Malaysia and South Africa is also
undertaken. -A discussion of the stages and activities involved in
legal deposit, the need for monitoring and enforcement procedures
and the external and internal factors that influence the way in
which
legal deposit is implemented in a country, provides an
overall understanding of the
legal deposit process -The
implementation of
legal deposit also depends on the committed
participation of various role players. The individual roles and
needs of these stakeholders in the
legal deposit process are
identified. The empirical investigation was conducted in two
stages. The first phase of the study involved a survey to explore
the attitudes, opinions and actions of publishers and
legal deposit
libraries, as the two main role players, to determine how these
factors affect the successful implementation of
legal deposit in
South Africa. This forms the bulk of the study. The second phase of
the study consisted of a feasibility study to determine the state
of compliance with
legal deposit in the country The outcomes of the
empirical study were used to identify gaps and weaknesses in the
current
legal deposit system. This formed the basis to make
recommendations for the improvement of procedures, methods and

▼ This thesis describes the options for setting up a Tasmanian Community Legal Centre.
One problem for a Tasmanian-based operation is that there is no definitive model that can be
followed. There are many community legal centres operating on the mainland but they are diverse
heterogeneous entities that differ markedly between states and often even within states. This thesis looks at
some of the problems inherent in defining what a Community Legal Centre (CLC) is, how it can relate both
philosophically and practically to its surrounding community, and how it sees it role, not only in terms of
delivery of legal services but also in terms of a philosophical commitment to changing the agenda for legal
service delivery, legal education and access to law.

Simon (1998; 2004) presented a psychological model of legal adjudication known as coherence-based reasoning. Coherence-based reasoning extends from a constraint satisfaction understanding of reasoning, and is typified by the presence of a coherence shift. The model has been successfully measured empirically using legal decision tasks (Holyoak & Simon, 1999). The current thesis explores coherence-based reasoning as an explanatory model within the context of complex contract law adjudication. The ecological validity of the model was examined in relation to multiple legal factors including legal expertise, dispute difficulty, decision confidence and legal utility. Coherence-based reasoning was demonstrated to be a suitable explanatory model for the reasoning process of judging real Australian contract law disputes. Particular interest was directed toward measuring the coherence shift, legal consensus and utility of deciding contract law disputes with systems of legal rules that differ on their level of specificity. Broad principles were compared to detailed rule law models in order to contribute empirical evidence to the ongoing jurisprudential debate regarding the optimal expression of contract laws in Australia. The results indicated that using broad principles to guide decision making produces greater decision consensus than using detailed rules, but only for disputes that are easier to decide. For harder disputes, the use of broad principles produced lower decision consensus than the use of detailed rules. Decision consensus among participants who used detailed rules to guide their decision making was moderate, and there was no difference in consensus between easier and harder disputes. For all levels of dispute difficulty and for all law models, a coherence shift was demonstrated and participants reported moderate to high levels of decision confidence.
