integruotų tiesinių laiko eilučių modelių su nestacionaria ilgąja
atmintimi dalinių sumų ribiniai skirstiniai ir tam tikros
statistikos, susijusios su dalinių sumų procesais. Philippe,
Surgailis, Viano 2006 ir 2008 m. darbuose apibrėžė kintančius laike
trupmeniškai integruotus filtrus su baigtine dispersija ir
nagrinėjo jų dalinių sumų ribinius skirstinius. Disertacijoje
Disertacijoje
apibendrinti šių autorių gauti rezultatai, t. y. įrodyta IR
statistikos centrinė ribinė teorema ir gauti poslinkio įverčiai,
kai stebiniai aprašomi tiesiniu laiko eilutės modeliu su trendu.
Praplėsta laiko eilučių klasė, kuriai IR statistika yra pagrįsta,
t. y. konverguoja į vidurkį.
In the thesis is studied the limit
distribution of partial sums of certain linear time series models
with nonstationary long memory and certain statistics which involve
partial sums processes. Philippe, Surgailis, Viano (2006, 2008)
introduced time-varying fractionally integrated filters and studied
the limit distribution of partial sums processes of these filters
under finite variance set-up. In the thesis is studied the limit
distribution of partial sums processes of infinite variance
time-varying fractionally integrated filters. We assume that the
innovations belong to the domain of attraction of an α-stable law
(1<α<2) and show that the partial sums process converges to
some α-stable self-similar process. In the thesis is studied the
limit of the Increment Ratio (IR) statistic for Gaussian
observations superimposed on a slowly varying deterministic trend.
The IR statistic was introduced in Surgailis, Teyssière, Vaičiulis
(2008) and its limit distribution was studied under the assumption
of stationarity of observations. The IR statistic can be used for
testing nonparametric hypotheses about d-integrated (-1/2 < d

▼ Vanduo – tai labiausiai organizmui
reikalingas elementas. Geriamasis vanduo turi būti ne tik skanus,
skaidrus, bet, svarbiausia, ir saugus. Baigiamajame darbe tirta
kaip buitiniai vandens filtrai išvalo vandenį. Gauti rezultatai
parodė, kad tiek vandentiekio, tiek gręžinio filtruotame vandenyje
oksidacijos – redukcijos potencialas yra aukštesnis nei
nefiltruotame. Filtrai turi įtakos vandens kietumui – Ca, Mg druskų
koncentracija neviršija 1,5 mmol/l, vanduo tampa minkštas arba
labai minkštas. Taip pat, kiekvieną kartą filtruojant vandenį,
mažėja elektrinis laidis. Filtruoto vandens pH, tiek vandentiekio,
tiek gręžinio vandenyje, žemesnis nei nefiltruoto. Tai reiškia, kad
vanduo tampa rūgštesnis. Didžiausi vandens kokybės pokyčiai gauti
organinių medžiagų kiekių atžvilgiu. Šių medžiagų koncentracija
sparčiai didėjo tiek vandentiekio, tiek gręžinio filtruotame
vandenyje priklausomai nuo filtro kasetės naudojimo laiko. Tai rodo
ir determinacijos koeficiento reikšmės – vandentiekio vandenyje –
R2 = 0,9, gręžinio vandenyje - R2 = 0,8.
Water - it's most needed element in the
body. Drinking water has to be not only delicious, clear, but most
importantly, safe and secure. There was studied domestic water
filter cleaning efficiency. The results showed that both tap water
and borehole water oxidation - reduction potential of the filtered
water is higher than the unfiltered. Filters affect the hardness of
water - Ca, Mg salt concentration less than 1.5 mmol / l, the water
becomes soft or very soft. The observed in the electrical
conductivity decrease each time by filtering the water. In
assessing the pH parameter, shows that the filtered water is more
acidic than the unfiltered. This means that the water becomes more
acidic. The most significant changes observed in filtered water by
organic matter content changes. These concentrations increased
rapidly, depending on the filter cartridge life both tap water and
borehole water. This shows a determination coefficient values - tap
water – R2 = 0.9, borehole water – R2 =
0.8.

▼ A possible association between endometriosis and cancer- mainly ovarian cancer- has been repeatedly reported in the literature during the last two decades. Despite numerous studies published so far, most of these are limited by methodological bias and their conclusions are insufficient to change current clinical practice. The aim of this study was to analyze the expression of metastasis- suppressor genes KAI-1/CD82 and KISS1 in endometriosis. According to different studies, these genes suppress metastasis of various types of tumors.A systematic review of the literature of epidemiological studies evaluating the potential link between endometriosis and ovarian cancer was conducted. In parallel, a prospective observational study was conducted in 67 patients who underwent operative laparoscopy; 38 of these women had endometriosis and 29 had a benign gynecological disease, other than endometriosis. In respect to the systematic review of the literature, 16 studies fulfilled the inclusion criteria; five of these were case-control studies and 11 were cohort studies. A meta-analysis was not considered to be appropriate due to heterogeneity of these studies.Immunohistochemical analysis showed that KAI-1 expression was significantly decreased in the glandular eutopic endometrium of endometriosis patients as compared with that of patients without endometriosis (p=0.008), whereas in endometrial stroma, KAI-1 expression in endometriosis patients was significantly increased in the ectopic as compared with the eutopic endometrium (p=0.021). KISS1 expression in the ectopic glandular endometrium of endometriosis patients was significantly increased as compared with the eutopic glandular endometrium of endometriosis patients (p=0.004) and with the eutopic endometrium of patients without endometriosis (p=0.008). In the stromal endometrium, given that KISS1 expression was minimal, there was no significant difference in KISS1 protein expression between the three groups (p=0.061).In conclusion, the systematic review of the literature has shown that according to the majority of studies, endometriosis is associated with a slight increase of ovarian cancer risk, and endometriosis is related to specific histological subtypes of ovarian cancer. However, these results remain insufficient to change current clinical practice for these two disease entities, since they can be attributed to common pathophysiological and predisposing factors between endometriosis and ovarian cancer. Prospective studies with laparoscopic confirmation, localization and staging of endometriosis are needed, in order to further clarify this issue.KAI-1/CD82 and KISS1 are primarily expressed in the glandular epithelium of the eutopic and ectopic endometrium and endometriotic cysts. Expression analysis of KAI-1/CD82 and KISS1 in endometriotic cysts and the eutopic endometrium of patients with and without endometriosis showed that there are significant differences between these three study groups. This pattern of differential expression is compatible with Sampson’s theory on…

▼ This thesis examines visitors' awareness and experiences of cultural values for natural areas of importance to Māori. The South Island/Te Wai Pounamu contains natural landscapes with scenic and recreational values that attract large numbers of domestic and international visitors. Many of these areas have a cultural significance for members of the South Island's Ngāi Tahu iwi and hapu groups. The Ngāi Tahu Claims Settlement Act 1998 legally recognised the traditional relationships between the iwi and the natural world, whilst other Acts of Parliament provide direction to government agencies for encouraging iwi involvement in the management of natural resources. Measures include increased participation in the management of national parks through iwi representation on regional conservation boards, the New Zealand Conservation Authority, and the inclusion of Ngāi Tahu values within subsequent national park management plans.
National park interpretation may influence visitors' awareness of cultural values for natural areas as visitors encounter information panels, displays, publications such as visitor guides or brochures, experience guided tours and/or audiovisual shows and view other interpretive medium. The researcher investigated visitors' awareness of Māori values for landscape at three South Island case study sites: Aoraki/Mount Cook National Park, Fiordland National Park, and Lake Pukaki. An understanding of the Ngāi Tahu values for these areas was achieved through site visits, a literature review and informal interviews to enable comparisons of the management history of interpretation at the case study sites. Visitors' experiences at each site were explored with interviews, participant observations and a survey that provided qualitative and quantitative data. The survey was administered between January and April 2000 to 716 visitors, yielding 472 valid returns (65.9%).
A comprehensive profile of visitors' demographics, social and environmental values was developed from the survey data. Visitors were well educated with 70% having a tertiary education and the majority of visitors were employed in professional occupations. When asked about their previous experiences of other cultures, many visitors reported prior encounters with Australian Aborigine and Native Americans. Visitors considered Rotorua and the Bay of Islands as the locations most closely associated with Māori whereas the study sites were not regarded as significant to Māori, despite the presence of on-site interpretation conveying Māori values for each area. Māori culture was not an important travel motivation for most visitors to these areas and the research revealed diverse reactions from the survey respondents towards cultural interpretive material. Despite this a small percentage of visitors (14%), of domestic and international origins, had an extremely strong interest in future opportunities to experience cultural interpretation of the landscape, particularly in material that tended towards the narrative, for example mythology and legends.

The aim of this work is to create A method
for integrity support of requirements specification. For this
purpose a process model is developed, which consists of three main
tasks: the identification of requirements, specification and
composition. The first two tasks helps to identify the crosscutting
requirements of the following reduction the requirements dispersal
in requirements specification, also identify responsibilities of
requirements and identify required requirements. The goal of
composition task is to compose the requirements to give the
developer a view of the whole system and to identify and manage
conflicts between requirements. Integrity of requirements are
ensured keeping all requirements in a unique form. The paper
analyzes the identification of crosscutting requirements and

▼ The Māori language has been in a constant state of change and evolution since the arrival of the ancestors of Māori to New Zealand. The environment known by traditional Māori was vastly different to that known today. Daily tasks and conversation related greatly to providing food which relied on in-depth knowledge of the environment with lexis reflective of this. Lower levels of engagement, introduced flora and fauna and technological developments have seen a decline in the necessity of such knowledge and its associated lexis. Furthermore, the introductions of new technologies and techniques have been at a faster rate than the evolution of te reo resulting in an absence of appropriate vocabulary in certain contexts. This research explores the status of Te Reo Māori within the domain of hunting and cultural harvesting practices in order to propose a strategy for language new lexis development to support the cultural and linguistic preservation of these practices in the modern context.

▼ In this work is analyzed the use of digital
filter to improve the quality of a speech signal. For this purpose
the influence of noises on the understanding of language is
inspected and the digital filter design with optimal pole placement
is presented. In the process of experimentation the speech signal
was recorded by using Praat program, generated noise is made by
means of Matlab function randn (n) or the sum two or one cosines.
The notated speech signal is mixed with the generated noise. The
algorithm based on Matlab program is created to sum up the meanings
of speech signal with the corresponding meanings of the noise
amplitudes. In order to improve the quality of speech signal mixed
with the generated noise, the low pass, notch and strip filters is
used, depending on noise, which has been used for connection of
noise and a speech signal. The used programs are written down by
program Matlab. In the end of the work are show the texts of the
algorithms, the text of the created filters and groups of
words.

The aim of this work was to analyze the data
which was gotten from accelerometer mounted in mobile device during
the test drives through the city together with GPS (Global
Positioning System) coordinates, to detect and report the surface
conditions of roads as well as to find the way, how it could be
represented in the map. The research was started by analyzing
oscillation data from accelerometer. We had to keep in mind that
there can be road bumps, pit holes, speed bumps and other road
anomalies, car can accelerate quickly and break sharply or even
crash into something, what would cause a sudden stop. In order to
recognize events, different detection filters were applied on data.
In addition to this, neuron network was used to recognize pit holes
and speed bumps from all event flow. The results of event detection
algorithms were compared with other scientist’s works. In order to
represent results clearly, database was created holding coordinates
of the road events and other information like time, etc. The
results were represented using an application programming interface
made-up by Google, which was really suitable solution in our case.
The whole system was programmed using Java servlets, which allowed
to gather data from database using SQL (Structured Query Language)
queries. While trying to represent accelerometer data, we faced
difficulties in representing these road events on the map, as GPS
each time returned answer with small variation of coordinates. In
this case, we... [to full text]

▼ Rakiura Māori continue a centuries old harvest of titi chicks (sooty shearwater, Puffinus griseus) which is governed primarily by Traditional Ecological Knowledge (TEK). The sustainability of titi harvesting is of high cultural, social and ecological importance. Some commentators view contemporary use of TEK as insufficient to ensure sustainability because it is no longer intact, too passive, and/or potentially inadequate to meet new ecological and technical challenges. Such assertions have been made in the absence of detailed description of TEK and associated social mechanisms. This thesis describes Rakiura Māori TEK practices and management systems that are in place and asks whether such systems are effective today, and whether they will remain effective in future.
Ecological, social and cultural factors are intertwined in cultural wildlife harvests so the methodology used was a combination of quantitative ecological methods and semi-directive interviews of 20 experienced harvesting elders. The research also used ecological science to evaluate potential harvest monitoring methods and to determine what sets the limits on harvest. These ecological studies focused on harvesting by four families on Putauhinu Island in 1997-1999.
Harvest is divided into two parts. In the first period ('nanao') chicks are extracted from breeding burrows during daytime. In the second period ('rama') chicks are captured at night when they have emerged from burrows. Nanao harvest rates only increased slightly with increasing chick densities and birders' harvest rates varied in their sensitivities to changing chick density. Although harvest rates can only provide a general index of population change a monitoring panel, with careful selection of participants, may be the only feasible way to assess population trend and thereby harvest sustainability or the resource's response to changed management.
Rakiura Māori harvesting practice constitutes common property resource management based on birthright and a system of traditional rules. Protection of island habitat and adult birds, and temporal restricitions on harvest are considered most important. Legislation and a belief system of reciprocity and connection to ancestors and environment aid enforcement of the rules.
Ecological knowledge is learnt through observation, hands-on experience and storytelling. Younger Rakiura Māori now spend less time harvesting which puts pressure on the transmission of knowledge. Paradoxically, use of modern technology for harvesting aids transfer of essential skills because it is easier and faster to learn, thereby contributing to the continuance of a culturally important harvest.
Limits on harvest are passive, with the numbers of chicks taken determined by the time spent harvesting and processing. Processing is more limiting during the rama period. Future innovations that decrease the time to process each chick during rama could greatly increase the total number of chicks caught. Recently introduced motorised plucking machines decrease the time required…

▼ The American Dream which boasts equal opportunity, meritocracy, and prosperity in accordance with an individual's hard work and dedication continues to instill hope in upward social mobility. Understanding social mobility necessitates an examination of individuals' or groups' ability to move upward or downward in status based on wealth, occupation, education, or some other social variable ("Social mobility," n.d.). Accordingly, social mobility within a hierarchical status system like the United States parallels inequality and presents challenges for underrepresented populations. More specifically, there is a gap that exists in the perceptions, generalizations, and realizations of social mobility for Black men in America resulting in a dichotomous disparity that is perplexing and adds to some of the greatest challenges and barriers to social mobility facing Black men. The purpose of this phenomenological study was to employ a cognitive lens to examine factors affecting the social mobility experiences of Black men throughout their educational and occupational pursuits, and/or community involvement; ultimately giving voice to a traditionally marginalized group. Cognitive problem solving styles, decision making, performed behaviors, and diverse social interactions were explored within the context of negotiating overarching stereotypes, overcoming barriers, making good decisions, and persisting towards social mobility. The conceptual framework for the study took into account cognitive function, race, and resilience by way of Kirton's Adaption-Innovation Theory, Critical Race Theory, and Resilience Theory, respectively. The study findings offer counter-narratives to rebuff dominant ideology about Black men in society, facilitate an understanding of values and motivators, introduce characteristics that aid social mobility, and may inform strategies, policies, and programing that affect Black men. Recommendations for further research are also offered.

▼ Most of the common DBMS (ORACLE, Microsoft
SQL Server, MySQL, DB2, etc.) use disk storage as run time memory.
When data becomes necessary from database, DBMS reads them from
disk and loads it to RAM (Random Access Memory). This approach uses
small amount of RAM, but DBMS efficiency is relative poor. In this
work was created prototype of DBMS. This prototype is read-only
DBMS and holds all database data in RAM. The purpose of this work
is to compare efficiency of common DBMS against created prototype.
For this prototype was developed and optimized bunch of data
searching, sorting, grouping, joining algorithms. All of these
algorithms are based on the main prototype data model idea:
database table stores all data into table tree. Prototype and other
DBMS were tested with TPCH test, which consists of very different
22 SQL queries to test DBMS efficiency. The test result produced
good results for prototype: prototype was 30-40 times faster
against ORACLE on complex joining queries and 100-200 times faster
against ORACLE on simple joining and searching
queries.

▼ This dissertation investigates in what ways does mahinga kai offer opportunities for the discipline of landscape architecture, both within Aotearoa, New Zealand and potentially beyond. It applies a ‘dwelling perspective’ to the concepts of mahinga kai as a means to expand the discipline’s conceptualisation of landscape. It does this through adapting designoriented tools currently found within landscape architecture research, and grounding them in a case study and a design investigation located within the setting of productive landscapes. The results of this research are four-fold.
First, it finds that a culturally encompassing interpretation of mahinga kai, and its concepts, sites and practices, has significant potential to broaden landscape architecture’s conceptualisation of nature and landscape.
Second, it finds that a quadrant-based tool has the potential to extend landscape architecture’s current approaches in conceptualising the diverse concepts, sites and practices of mahinga kai. It illustrates mapping as a method of inquiry, in which the reciprocal relationships between site and practice, and the utilisation and protection of resources can be expressed and explored in greater depth.
Third, through a design investigation, it finds that concepts of mahinga kai have the potential to extend the scope of landscape architecture beyond its current focus to shape specific sites. It identifies that alternative mahinga kai driven practices – such as reciprocal learning programmes between outsiders and inhabitants – can be designed to materially produce the economic and ecological outcomes of productive landscapes.
Finally, it finds a future direction for landscape architecture is to further identify and develop methods that could embrace the cultural complexity of mahinga kai and its concepts. The research illustrates the potential for future research to engage in a greater depth of dialogue in which both landscape architecture and concepts of mahinga kai extend landscape’s role in engaging the positive influence of human activity in designing with nature.

▼ This thesis describes the development of an agent-based model for simulating cognitive style in the context of collaborative problem solving. Cognitive style describes the diverse ways in which people solve problems. Individuals’ cognitive styles can impact the success or failure of a design team. However, the effects of cognitive style in collaborative problem solving are not well understood. To address this gap, this thesis presents KABOOM (
KAI Agent-Based Organizational Optimization Model), the first agent-based model of teamwork to incorporate cognitive style. In this thesis, experiments using KABOOM investigate the interacting effects of a design team’s communication patterns, specialization, and cognitive style composition on a team’s performance. Testing the model with a race car design problem reveals that teams can strategically leverage diversity of cognitive style to improve performance. By simulating cognitive style and team problem solving, KABOOM lays the groundwork for the development of team simulations that reflect humans’ diverse problem-solving styles.

▼ Food Festivals allow communities to celebrate local food and drink. This original thesis examines the mutual relationship between food festival organisers, festival attendees and festival spaces. Two unique New Zealand regional food festivals – Kāwhia
Kai on the West Coast of the North Island and Wildfoods Hokitika on the West Coast of the South Island - are critically examined. The research addresses three questions. First, how do these food festivals construct their locations and vice versa? Second, in what ways do food festivals contribute to place identity? And, third, how do food festival attendees sensually experience the festivals?
The concept of embodiment provides the overarching framework for this research. With academic interests in both tourism and geography, I weave understandings of culinary tourism, festivals, tourist embodied experiences, sensuality, visercality and abjection to address my research questions. I use this theoretical ‘toolbox’ alongside qualitative methodological approaches which enable research participants to express their embodied experiences and emotions. Ten semi-structured interviews were conducted with festival organisers and food stall holders. Participant ‘sensing’ was carried out in both Kāwhia and Hokitika. In thinking about the social, cultural and ‘felt’ aspects of food, I also use my own body as an instrument of research. Promotional texts were collected and all data analysed using critical discourse analysis.
The empirical material is divided into two themes. The first theme focuses on location and place identity. Concepts of ‘place attachment’ and ‘sense of belonging’ construct food festival regions. The formation of ‘new colonial’ and ‘new Māori’ traditions is another way in which these food festivals created unique place identities. The second theme highlights the embodied experiences and spaces of both food festivals. Bodily senses, place and spaces are created through visceral and abject reactions to food experiences.
Food festivals have the potential to enhance the economic, social and cultural wellbeing of regional communities. The success of food festivals, however, is dependent on multi-sensual embodied experiences.

▼ Mahinga
kai (food gathering sites and practices) emerged at the beginning of the creation narratives when the Māori world was first formed and atua (deity, Gods) roamed upon the face of the land. Mahinga
kai sites are imbued with practices, embedded with whakapapa (genealogy), and clothed with knowledge that have implications for how we view and understand Māori Physical Education (PE) and health. Māori PE and health is rooted in a Māori worldview, guided by the relevance of the Treaty of Waitangi, inherent to an holistic approach to health, and connected to the natural environment.
The aim of this research was to critically evaluate the emergent discourses of mahinga
kai (and its subsequent discourses) against the recontextualised thinking about Māori PE and health based on the synergies of Kaupapa Māori theory, whakapapa and Critical Discourse Analysis (CDA). These theoretical and methodological frameworks are utilised to further the goals and aspirations of the Māori community of Kāti Huirapa ki Puketeraki hapū (sub-tribe) in Karitāne that I worked alongside of, privileging mātauranga (Māori knowledge) and legitimising a Māori worldview. The methods of the research were: semi-structured interviews (4), wānanga kōrero (3 group interviews), reflective pieces (9), and a case study with Kāti Huirapa ki Puketeraki hapū.
There were multiple discourses of mahinga
kai that emerged from key creation narratives, the Treaty of Waitangi translation texts and Waitangi Tribunal texts. The emergent discourses of mahinga
kai were mahinga
kai as: whakapapa; whanaungatanga (relationships); tikanga (custom) and the subsequent discourse of tapu (sacred, set apart); mātauranga; identity; taonga (treasure) and the ensuing discourses of forestry and fisheries; kaitiakitanga (protection, guardianship) and the succeeding discourses of mauri (life force) and kaitiaki (guardian) and; rangatiratanga (chieftainship) and the consequent discourse of mana (authority, power). The operationalisation of the discourses of mahinga
kai were evident in the Ki Uta Ki Tai case study and illustrated the importance of connecting to one another, the communities we serve, and the environment we are a part of.
This thesis argues that the emergent discourses of mahinga
kai, embedded in a framework of cosmogonic whakapapa, are key to understanding and exploring notions of Māori PE and health and has benefits for Māori and non-Māori alike engaging with this notion as they learn the importance of connecting to people and place. Knowledge gained from this research will: assist communities who are wanting to implement similar strategies to their resource management plans; provide evidence that supports a mutually beneficial relationship (partnership) between University staff and students, and their local communities and; recontextualise how we think and view Māori PE and health.

▼ As pressures continue for colleges and universities to find new ways of doing business, the calls for change heighten and the potential for conflict ensues. The purpose of the research study was to explore change as conflict via an exploration of organizational change related to preferred cognitive style, as measured by the Kirton Adaption-Innovation (KAI) instrument, and conflict management style, as measured by the Rahim Organizational Conflict Inventory-II (ROCI-II) instrument. The two instruments were administered to 72 university administrators at a large flagship university. The results indicate that the preferred cognitive style of university administrators is not significantly different from that of the general population. In addition, there were no statistically significant differences in style when comparing functional reporting area, gender, or education level. University administrators were found to prefer using the integrating conflict management style, followed by the compromising and obliging styles. Dominating and avoiding styles were the least used by university administrators. An understanding of cognitive styles and conflict management styles may help university administrators to be more self-aware and to know when each style is appropriate for use, particularly as it relates to problem-solving in teams with a diversity of styles to manage change and enhance organizational effectiveness.

Cognitive Style and Conflict on Superintendent-School Board Teams
By Douglas J. Asbjornsen
Chairperson of the Dissertation Committee:
Dr. Thomas Alsbury
School of Education
Quality learning and high student achievement are primary goals of K-12 public school education. Superintendent-School Board teams can have a positive impact on both. Collaboration is critical to these teams’ effectiveness and efficiency. Research has suggested conflict can have a negative impact on collaboration and may be related to the diversity on the team. One type of diversity is cognitive diversity within the construct of cognitive style, as defined by the Kirton Adaption-Innovation Theory (A-I Theory). In alignment with this theory, the Kirton Adaption-Innovation Inventory (KAI) was designed to measure where one falls on a continuum of cognitive style. The difference between individual scores of team members is defined as cognitive gap. A-I Theory posits that at significant levels, cognitive gap can contribute to conflict. Using a mixed-method, explanatory participation selection design, this study identified and documented examples where cognitive gap has likely contributed to conflict within superintendent-school board team members. In addition, findings suggest a relationship may exist between superintendent KAI scores and their age. This study introduces cognitive gap as a possible contributor to conflict not currently documented in the education literature focusing on superintendent-school board teams. Knowledge of A-I Theory and KAI scores may help prevent or mitigate certain types of conflict on these teams, which may have positive impact on student learning and achievement.

▼ In Canada and New Zealand there are increasing calls for recognition of aboriginal rights which previously were ignored or denied because of the application of English law to concepts of property rights and ownership. English legal principles are vitally important in Canadian and New Zealand society, but there has always been room for local adaptations which could have recognised the existing practices and rights of the indigenous peoples.
The English law makes various assumptions about ownership of rivers, dividing them into bed, banks and water, and applying various tests of adjoining occupation, tidalness and navigability to determine rights. Aboriginal property rights have been guaranteed and protected by various mechanisms such as government policy, treaty, and the courts, but there is uncertainty about the status of rivers. The form of the survey definition of reserves and rivers is also fundamental to how property rights may be determined. This thesis examines the situation of rivers in Canada and New Zealand through common law, treaty provisions and through what is now, a developing body of applicable and recognised customary/Aboriginal law. From these three legal foundations, a case study approach focuses on the practical situation of the Siksika people on the Bow River in southern Alberta, and the
Kai Tahu on the Taieri River in Otago.
This investigation concludes that there are various legal mechanisms by which indigenous people may claim rights to the rivers with which they have a relationship; by resorting to English common law principles; by applying new and developing conceptualisations of customary and aboriginal rights doctrines; by appealing to tribunals examining treaty agreements; or by direct negotiation with the Crown. All of these processes require evidence of past and current relationships, use and occupation of rivers by the indigenous claimants. Current undisputed possession and control may be a satisfactory outcome, but ultimately an acknowledgement of ownership may depend on politically negotiated settlements.

▼ Background: Dietary assessment forms an integral component of most dietitians’ work and with increasing use of technology, dietary assessment software (DAS) tool use is also increasing. Previously published literature based on expert comments suggest that the most important features of software for dietitians are its user-friendly nature, the database, search strategy, output, price and extra support available. However there is limited literature on the use of DAS among dietitians and what dietitians themselves consider to be important component of DAS tools. Therefore whether their views of DAS experts are congruent with those of dietitians is unknown.
The Department of Human Nutrition, University of Otago has developed
Kai-culator, a web-based DAS tool that has been developed specifically for use within a research and teaching setting. It is of interest to examine whether this tool could be adapted to meet the needs of dietitians in other settings.
Aim: To determine DAS needs of current New Zealand (NZ) dietitians and to determine how
Kai-culator might be adapted to better meet these requirements
Methods: This cross-sectional study recruited participants via a newsletter and email through Dietitians New Zealand. Fifty-two dietitians completed a self-administered online questionnaire to determine NZ dietitians’ current dietary assessment practices, current use of DAS and their ideal DAS tool features. Eight of the participants also trialled
Kai-culator and completed a semi-structured in-depth interview with the candidate to determine how they found
Kai-culator and how it could be improved to better meet their needs.
Results: Most participants (73%) currently use DAS, with Foodworks being the most popular. The main reasons for not using software were lack of time and that it was not suitable for their area of dietetics. Common features described as the best and worst aspects of their current software were dependent on the software used. Features reported as needing improvement overall included the food database, serving size quantification and format of output. Dietitians described their ideal DAS as being easy and intuitive to use, including a comprehensive food database and information on all nutrients presented as tables and graphs as well as comparisons of intake to nutrient reference values (NRVs). Overall, half of the eight dietitians who completed the in-depth interview found
Kai-culator to be mainly suitable for their dietetic work. Common reasons dietitians considered
Kai-culator suitable were the large database of NZ-specific foods, appropriate portion sizes, easy accessibility and quick to enter data. On the other hand, no comparison to NRVs, lack of nutritional supplements, specialised ‘free-from’ and paediatric products were features that hindered the suitability of
Kai-culator.
Conclusion: The majority of NZ dietitians surveyed were using DAS tools. This indicates that DAS forms an important component of dietetic practice. With an overall satisfaction rating of only 57% for their…

▼ Wesleyan missionary James Watkin established the first mission station in the South Island at Karitāne in May 1840 and in 1844 he shifted to Wellington, where he remained with his family until 1855. During this time Watkin recorded his mission work in his journal, a key primary source for this research. While his efforts as a missionary have been considered particularly in texts covering New Zealand mission and South Island history, this thesis focuses on how James Watkin’s work helped to encourage physical and moral peace where he was located. Key elements of this work involved running church services for Māori and Europeans, and commencing schools at which Māori were taught literacy in their own language. By these avenues, Watkin diffused among his hearers the Christian teachings which encouraged peaceful conduct and moderation over violence and excesses which proved detrimental to the wellbeing of the community. Through more direct interventions, Watkin helped to defend young and lowly members of society from violence intended or practiced against them. This diffusion of Christian teachings and Watkin’s direct interventions encouraged peace within the community. Secondly, missionaries aimed to foster peace amidst times of war by assuming the role of mediators and encouraging chiefs to adopt Christianity, by which means peaceable sentiments could be fostered within their tribe. By visiting each area of his circuit and organising church gatherings, Watkin helped to facilitate peace within and between tribes, as Wesleyan Māori from various areas assembled to participate in church activities where amiable sentiments were fostered. This thesis proposes that by these various avenues, the Reverend James Watkin contributed to the fostering of peace in the community and in times of war.

▼ The authenticity and interpretation of two Sixth Patriarch paintings, traditionally attributed to Liang
Kai, have long been debated by critical scholars. Because of the lack of inscriptions on the paintings to indicate the identity of the depicted figure, the association of him with the Sixth Patriarch of Zen Buddhism, Huineng, has shed much enigmatic light onto the decipherment of these two paintings’ motifs. While historical and literal traditions of Huineng in Zen Buddhism provide no conspicuous references, Zen’s art tradition, on the other hand, provides a more fascinating reading of the Sixth Patriarch paintings by formulating and reconstructing a paradigmatic figure of Huineng and Zen romanticism without restricting itself to historical and literal accuracy.
