V stvarnem pravu, ki prvenstveno ureja razmerja med subjekti glede objektov, sem zasledil nedorečenost, ki jo želim raziskati podrobneje. Pridobitvi lastninske pravice na podlagi zakona, ki jo omogoča Stvarnopravni zakonik (SPZ) pravimo priposestvovanje. Za to, da na tak način nekdo pridobi lastninsko pravico, pa morajo biti izpolnjeni še nekateri nadaljnji pogoji, ki so potek priposestvovalne dobe, lastniška posest, ki jo sestavlja zavest priposestvovalca, da objekt poseduje kot lastnik ter dobra vera, ki pomeni da posestnik ne ve in ne more vedeti, da ni lastnik. Pri presoji ali je izpolnjen pogoj dobre vere za izvirni način pridobitve ene od naštetih pravic, se namreč pojavlja veliko različnih interpretacij tako s strani sodne prakse kot s strani pravne teorije. Sodna praksa se odloča za povsem drug pristop za presojo ali je pogoj dobre vere izpolnjen. Ne zahteva namreč, da je za pogoj dobre vere priposestvovalec tudi vpisan v zemljiško knjigo. Pravna teorija po drugi strani zastopa stališče, po katerem priposestvovalec ne more biti v dobri veri, če je iz javne zemljiške knjige razvidno, da ni vpisan kot lastnik. Ker mora poznati zakone na območju pravnega reda na katerem deluje mora tudi vedeti, da je pri pravnoposlovnih pridobitvah stvarnih pravic, ki se vpisujejo v zemljiško knjigo, konstitutivnega pomena za nastanek, prenos, obremenitev pravice ravno vpis v zemljiško knjigo. Ker mu to pravilo pa načelu ignorantia iuris nocet mora biti znano in ker je zemljiška knjiga javna knjiga, na vpogled vsakomur, se priposestvovalec mora zavedati da zaradi odsotnosti vpisa v zemljiško knjigo ne more biti lastnik. Zaradi tega tudi ne more biti dobroverni lastniški posestnik, iz česar izhaja tudi temeljna hipoteza moje naloge, ki jo bom skozi temeljito obravnavo bodisi potrdil ali zavrnil, obenem pa ponudil vpogled v rešitve teh vprašanj tudi v pravnih sistemih Nemčije, Avstrije in Švice.

Property law regulates relationships between different subjects, regarding objects. The main theme of my masters seminar is an institute in the area of civil law, with a funciton of uniting the legal portrait and the actual state of rights concerning real estate. It is a special way of aquiring ownership of immovable things, called prescription. In order for a person to aquire ownership by prescription, one has to be a possesor of the property, being in good faith he already is an owner. The good faith in Slovenian law means, that the possesor doesn't know and cannot know, he is not the actual owner of the immovable thing in his possesion. Slovenan courts and legal theorethics have very different approaches and criteria on deciding whether this condition is met in different cases. The courts have decided in many cases in so far, that the condition of good faith was fulfilled, even though the possesor wasn't enlisted as the owner in the land register. 2. Hilmy, Hanny. Sovereignty, Peacekeeping, and the United Nations Emergency Force (UNEF), Suez 1956-1967: Insiders’ Perspectives.

This research is concerned with the complex and contested relationship between the sovereign prerogatives of states and the international imperative of defusing world conflicts. Due to its historical setting following World War Two, the national vs. international staking of claims was framed within the escalating imperial-nationalist confrontation and the impending “end of empire”, both of which were significantly influenced by the role Israel played in this saga. The research looks at the issue of “decolonization” and the anti-colonial struggle waged under the leadership of Egypt’s President Nasser. The Suez War is analyzed as the historical event that signaled the beginning of the final chapter in the domination of the European empires in the Middle East (sub-Saharan decolonization followed beginning in the early 1960s), and the emergence of the United States as the new major Western power in the Middle East. The Suez experience highlighted a stubborn contest between the defenders of the concept of “sovereign consent” and the advocates of “International intervention”. Both the deployment of the United Nations Emergency Force (UNEF) and its termination were surrounded by controversy and legal-political wrangling. The role of UNEF and UN peacekeeping operations in general framed the development of a new concept for an emerging international human rights law and crisis management. The UNEF experience, moreover, brought into sharp relief the need for a conflict resolution component for any peace operation. International conflict management, and human rights protection are both subject to an increasing interventionist international legal regime. Consequently, the traditional concept of “sovereignty” is facing increasing challenge. By its very nature, the subject matter of this multi-dimensional research involves historical, political and international legal aspects shaping the research’s content and conclusions. The research utilizes the experience and contributions of several key participants in this pioneering peacekeeping experience. In the last chapter, recommendations are made –based on all the elements covered in the research- to suggest contributions to the evolving UN ground rules for international crisis intervention and management. This study provides a comprehensive analysis of both practical and theoretical legal issues raised by joint ventures in Europe. In the European Union member states and especially in Spain, joint ventures are viewed as a high efficient strategic operation - allowing alliances between firms, which may improve their competitiveness and adapt them to the growing dimensions of European markets and to the new global economy. Joint ventures are not organised as such by any statute law in Europe. European law focuses on the analysis of the effects they may produce on competition. Joint ventures obtain a legal content only in practice. The aim of this study is to define the "added value" of the practical work of lawyers, when they take part in processes of creation of joint ventures. This question allows to integrate the analysis of different legal aspects of joint ventures - their contractual and corporate structure as well as their legal treatment under competition law - which are traditionally treated in separate studies, and to point out the existence of on-going interfaces between them. This study focuses essentially on the contractual and corporate aspects of joint ventures. Practitioners set up, first of all, mechanisms which are compulsory - i.e. legal rules - for the firms involved in the operation according to their strategic interests. The result may be, for instance, the creation of a mere "contractual joint venture", of an European Economic Interest Grouping, or the incorporation of a "joint venture company". The complexity of the joint venture legal organisation prevents from studying separately the so-called "joint venture agreement" on which is based the operation, and the company which may be incorporated within it. The joint venture company is only a part of a more complex ensemble, which needs to be understood as such in order to be correctly analysed. The complex legal organisation of joint ventures differs from any other complex legal organisations because of its specific purpose, ie. establish a strategic alliance between firms. It aims to organise an operation in which: (i) participate two or more firms independently active on the market; (ii) are gathered the resources necessary to carry out a common business activity, possibly but not obligatory within a separate entity; and (iii) the participating firms jointly control the common business activity. Those three features are at the basis of the legal definition of joint ventures. The question of the legal validity and efficiency of the terms and conditions present in incorporated joint venture agreements is the more problematic one for the practitioners. The main difficulty in relation with joint ventures like in relation with many other complex agreements is to determine the limits of use of contractual freedom in company law. While organising the operation, the practitioners are also drawing the attention of the legislator on the legal needs of the firms willing to enter into alliances.
