▼ This thesis proposes a new constitutional framework for ownership and control of natural resources in the federation of Nigeria. It identifies exclusive federal ownership of natural resources as a tool of ethnic domination by Nigeria’s three dominant ethnic groups of Hausa/Fulani, Yoruba and Igbo against the oil-producing minorities of the Niger Delta region. It is argued that the inextricable link between federal ownership of natural resources and the economic and political interests of the major ethnic groups denotes that the current system of natural resource ownership has become a divisive and destabilizing feature of Nigerian federalism. Considering that Nigerian multi-ethnic federalism is designed primarily to prevent the domination of one ethnic group by another and also encourage each constituent unit of the federation to develop at its own pace, it is arguable that exclusive federal ownership of natural resources negates these underlying principles of Nigerian federalism by entrenching the domination of the Niger delta oil-producing minorities and depriving the oil-producing states of the right to develop at their own pace. These circumstances have triggered waves of ethnic nationalism and armed insurgency in the Niger delta region with grave implications for national stability. The thesis argues therefore that only a new system of natural resource ownership which recognizes both national and regional interests in natural resource ownership and development can conduce to peace in the troubled Niger delta region of the federation. It proposes constitutional devolution of ownership rights over onshore natural resources from the federal government to the constituent units of the federation under an arrangement whereby the federal government retains its legislative and regulatory powers. It is argued that this framework, among other benefits, will preserve the underlying principles of Nigerian federalism and halt the drift toward instability in Nigeria’s Niger delta region.

Despite knowledge management studies being widely attributed to the business field, it was Public Administration that actually pioneered scholarly work on the subject. In 1975, the Public Administration Review published a knowledge management symposium that not only coined the term “knowledge management,” but also broadly examined “knowledge administration.” Relevant to the study of knowledge management is the idea of promoting knowledge sharing within the organization. Since the 1990s, when U.S. federal agencies initiated their efforts on knowledge management, knowledge sharing has become a key management proposition to the executive leadership within the federal government. There are two main driving forces for promoting knowledge sharing in U.S. federal agencies. First, an aging workforce requires the U.S. federal government to prepare for the transfer of knowledge from one generation of employees to the next. Second, knowledge sharing could be crucial for the U.S. federal workforce to accomplish the diverse and challenging missions of the U.S. federal government. For an agency to accomplish its mission, we need a better understanding of the mechanisms that lead to knowledge sharing. Using an institutional theory perspective, this study hypothesizes that culture, incentives and technology influences knowledge sharing behavior in U.S. federal agencies. The study uses a mixed methods design in which both qualitative and quantitative research methods are applied to obtain a better understanding of the institutionalization of knowledge sharing in U.S. federal agencies and to empirically verify the theoretical framework proposed in the study. Using the survey responses of U.S. federal employees within the executive branch agencies, the study finds that while culture and incentives influence knowledge sharing behaviors within an agency, technology has a neutral effect on knowledge sharing behavior within an agency. Given the scarcity of research in Public Administration on knowledge management, this research will contribute empirical work to the literature that hopes to not only deliver theoretical fruitfulness but also provide managerial direction to public sector leaders.

▼ Within the Canadian government, studies associated with staffing the federal public service have been endemic for over a century. Despite this, concerns about lack of change and dissatisfaction with staffing (too slow, too complex) remain hallmarks. The Public Service Modernization Act (PSMA) was introduced in 2003 as a means to bring about transformative change and yet, following a nearly two year study, the PSMA Review Report (2011) found that virtually no one was satisfied with changes in key aspects of the human resource and staffing regime. A strong desire for change was noted as existing, however, a diluted sense of ownership and powerlessness to change were also noted, even among the most powerful federal communities – deputy ministers, executives, and central agencies. As Canada’s largest employer, with an annual payroll that has been estimated at $22 billion and, with another era of potential change launched with the Public Service Commission’s 2016 introduction of New Directions in Staffing, federal staffing can be viewed as both timely and warranting academic examination. This dissertation combines the strengths of institutional change literature from political science, sociology and economics to examine the institution of federal staffing in the core public administration. It focuses on an extended period of time in order to identify if any substantive changes have occurred despite popular views of negligible change and to examine why change may not have occurred to advance toward the long expressed goal of simplified, efficient staffing of highly qualified (meritorious) public servants. This mixed methods case study uses documentary, archival, and qualitative and quantitative secondary source material as well as input from 49 semi-structured interviews with a variety of Canadian federal managerial and human resource representatives. It identifies and addresses issues that have only at times been identified and, others not typically detailed in government reports, particularly those associated with culture and path dependent history. Issues examined include power relations and key narratives as well as evolving ideas and logics of appropriateness that shape behaviour, some of which continue to exert pressure on current organizational and institutional choices despite having been in existence for, in some cases, 50 or 100 years. Some ideas for change are offered but this study suggests without attention to long-standing and systemic issues only highly incremental change should be expected.

▼ While several studies have questioned the integrity of public policies produced during periods of divided government, this analysis will examine the potentially positive effects of divided partisan control on distributive federal spending policies. It suggests that an increase in veto players through political parties will reduce the discretionary authority of the political branches, especially the Executive through the decrease in non-formulaic monies thereby facilitating more formulaic spending and hence greater genuine checks and balances between the branches. During divided government, there will also be more bi-partisan deliberation and negotiation regarding substantive policy making and hence less partisanship and particularistic tendencies that are typical of unified government. As a result, under divided government there will be more effective institutional veto players positioned against each other and thus more of a need for significant deliberation between these players to accommodate differing policy perspectives. Furthermore the allocation of the majority of federal grants is possibly more proportional during divided government due to the greater potential for such institutional veto points. Thus, when national government is controlled by multiple parties serving as effective veto players, consensual policymaking is more prevalent and congressional formulas generally favor broad, non-competitive patterns of distribution with minimal political influences by way of presidential objectives or committee/sub-committee assignments for example. Alternatively, under unified government, fewer veto players are positioned against each other-a condition which enhances the ability to create congressional formulas that support less formulaic distributive patterns. Instead such formulas favor much more targeted and competitive disbursements which are also more partisan and particularistic and less proportional. In sum, divided government with more unaligned institutional veto players tends to generate less targeted, less competitive, less non-formulaic disbursements of federal grants than unified government and such distributive patterns are inclined to be less partisan and particularistic and hence less conciliatory to the presidential agenda. Furthermore divided government necessitates greater negotiating and consensual policymaking as more interests need to be accommodated thus expanding the policymaking process rather than facilitating exclusive, particularistic politics. ▼ This thesis investigates whether the people of Solomon Islands would be better served by a form of governance that is politically hybrid than through the current Westminster unitary-state model. In remote provinces such as Choiseul, the reach of the state is limited. Here, notions of citizenship and national identity have gained little traction because kin group relations underpin society and form the basis for peoples’ identity. In such societies customary institutions, in the form of chiefs, and the church provide order. In these self-governing rural communities governance is distinctly parochial in its application and often hybrid in form. This study examines whether the hybrid polities of such communities have an application within the proposed Federal Constitution of Solomon Islands. The thesis, first, examines the international concepts of governance that have shaped and provided a framework within which the state of Solomon Islands, and its systems of governance, have evolved. State governance today, is very much a product of historical antecedents. However, an analysis of these antecedents demonstrates that Solomon Islanders have been particularly adept at appropriating introduced systems for their own purposes, and matters of governance are no exception. Using semi-structured interviews, the fieldwork component of this thesis examines the hybrid form of governance that exists in a Choiseulese village to determine whether such models have an application within the proposed Federal Constitution, thus providing a greater degree of political legitimacy than exists under the current Westminster system. Three tiers of government are proposed in the Federal Constitution – Federal, State and Community Governments. Of these, Community Governments provide a particularly suitable political arena where hybridised forms of village governance, which locally have a considerable degree of political legitimacy, can be combined with such functions of state as are necessary to achieve good governance. This, it is argued, will allow the development of forms of governance that are much more suited to local conditions than is possible under the current constitution.

▼ Many countries around the world have been attempting decentralization process to create or strengthen sub national governments for several reasons and with varying degrees of intensions and success. Ethiopia-with no exception- is among federal countries embarking on the process. Accordingly, ethnic based regional state governments are created. However, the process presumes appropriate assignment of power and resources to autonomous sub national governments. In Ethiopia, there is universal deficiency of regional own revenues relative to the assigned bulk of expenditure requirements. The vertical fiscal imbalance in Ethiopia is thus explained more by monopolization of the Central Government over the most lucrative tax bases and partly by high expenditure requirement of regional state governments. The other feature of decentralization in Ethiopia is the skewed distribution of revenue across the regions where by more than 88% of domestic revenue is collected in the largest four regions (Ahhara, Oromya, SNNP, and Tigrai ) while the smallest ( Afar, Somali, Gambella, and Benishangul- gumuz ) regions collect less than 6%. As a result federal transfers play a crucial role in closing the gap. However, the formula designed and the weight assigned to the variables has significant implication on the amount to be transferred to region. As regional governments in Ethiopia differ in their capacities, federal subsidy focusing more on population size is seen favoring the largest regions. Therefore, unless true measures of decentralization are taken, the existing vertical and horizontal imbalance is quite to exacerbate threatening the presumed benefits of decentralization. The practice in Benishangul Gumuz region shows neither the adequacy of own revenues nor adequate administrative capacity to utilize the existing resource. As a result, the over all fiscal position of the region shows its heavy dependence on federal subsidy at the same time woredas in the region are extremely dependent on transfers from the region Advisors/Committee Members: Mehari Mekonnen (PhD) (advisor).

▼ A four-frame analysis of NCLB was conducted. The first frame involved constitutional federalism as defined by the Guarantee Clause of the Constitution, the Tenth Amendment and its intersection with the Spending Clause, the Fourteenth Amendment, and the Eleventh Amendment. The historical context of each constitutional component was examined and presented in the belief that text without context fails to provide full understanding. 135 court cases, primarily Supreme Court cases, were examined using legal analysis procedures. Peter Senge’s systems thinking formed the second frame, while the third frame centered on Ronald Heifetz’s concept of the adaptive work required to close the gap between the vision (no child left behind) and the reality (achievement gaps). The fourth frame, federalism as a public policy approach, emerged from writings by Alexander Hamilton, James Madison, Justice Felix Frankfurter, and Akhil Reed Amar as well as opinions by Justices Brandeis and O’Connor. Federalism as a public policy views the federal and state governments as equal partners wherein states serve as laboratories engaged in experimentation to find solutions to complex problems. Comparative analysis and rational argument were used for the last three analytical frames. Historical research and analytical study broke new ground regarding: the thread of America’s answer to Aristotle’s question regarding a government based on the rule of law or of individuals; Madison’s activities as reflecting both possible answers to Aristotle’s question; the intertwining of treaty rights, the status of tribal governments, and citizenship rights for tribal citizens; and the substitution of argumentative tricks for sound analysis in recent Tenth and Eleventh Amendment jurisprudence. The following findings were reached: 1) NCLB possibly violates one or more of the conditional spending tests articulated in Dole v. South Dakota; 2) NCLB does not take a systems approach to the system of children’s well-being in America; 3) NCLB treats a symptom (achievement gaps) and ignores the primary cause of those achievement gaps (poverty); 4) by treating a symptom as a cause, NCLB ignores the adaptive work needed to close the gap between NCLB’s vision and the reality of achievement gaps primarily caused by inequitable distribution of incomes and poverty in America; 5) poverty exerts a primary force upon education that is negative, that acts as a fundamental factor impacting the system of children’s well-being, and that inhibits a child’s ability to fully benefit from education; 6) NCLB does not utilize a public policy approach based upon federalism; and 7) until the system of children’s well-being is addressed, achievement gaps will persist. It is recommended that the amicus curiae brief submitted by the National Council of State Legislatures in Dole be used as a model for a constitutional challenge to NCLB. A travers l’étude des musées de la Smithsonian Institution dans les décennies qui suivent la Seconde Guerre mondiale, cette thèse propose des pistes méthodologiques pour penser le nationalisme aux Etats-Unis. La Smithsonian Institution regroupe des activités de recherche, financées par des fonds indépendants et par des subsides fédéraux, et les Musées Nationaux, essentiellement financés par l’Etat fédéral. Ces musées sont pour la plupart situés sur le National Mall à Washington, dans le centre monumental de la capitale fédérale. Ils sont un observatoire privilégié du nationalisme : en effet, ils se situent à l’articulation entre le pouvoir fédéral et l’activité des professionnels des musées, ce qui permet d’évaluer le degré d’implication de l’Etat dans les Musées Nationaux et la contribution de ce dernier à l’entretien du sentiment national en leur sein. Par ailleurs, la création de nouveaux musées et de nouvelles expositions pose la question de la temporalité dans laquelle s’inscrivent les pratiques nationalistes. Enfin, le rôle des musées, entre explication des phénomènes universels et représentation de la nation, reflète la tension entre l’universel et le particulier qui fonde le nationalisme, compris comme une manière nationale d’être au monde.

This dissertation focuses on the Smithsonian Museums in the decades following World War II and tests ways of conceptualizing nationalism in the United States. The Smithsonian Institution includes some research bureaus, which are funded with federal and independent funds, and the National Museums, mostly run with federal funds. Almost all National Museums are situated on the National Mall in Washington, D.C., at the monumental heart of the federal capital. They provide an observatory of nationalism, as they are a contact zone between the federal power and museum people, which brings to light the degree to which the government gets involved in the National Museums and the federal contribution to the maintenance of national feelings through museums. Besides, the creation of new museums and new exhibitions suggests that nationalist practices develop within a specific time frame. Finally, as museums oscillate between the exhibition of universal phenomena and that of national features, they magnify the tension between universalism and particularism that is the basis for nationalism, defined as a national way of belonging to the world.

The thesis consists of three essays. In the first essay, the role of party politics in provision of public goods within a federal economy is analyzed. The public goods, which have inter-jurisdictional spillover effect, are locally produced with federal transfers and local revenues. The federal government can not commit to the level of transfers. The direction and magnitude of federal fund flows are influenced by local revenues as well as the re-election probability of the parties in power at the federal and provincial levels. Under such a scenario, politically motivated grants alter the incentive for raising local revenues. If votes swing heavily in favor of either the incumbent or the challenger in the provincial elections and/or if the coefficients for absolute prudence from the utility of public good are low enough, then grants are designed in such a way that the incentive for increasing revenues is lower in the province where the party identity is similar with the federal government. If these conditions are not met, such incentive is higher in the politically favorite regime. This result is generalized over different combinations of ruling parties in different seats of government.

In the second essay, the issue of dynamic public good provision within a federation is analyzed. Provinces lobby for more federal funds to produce a pure, dynamic public good such as an improvement in environmental quality. Allocation of federal funds is dictated by the level of lobbying. Consumers' welfare equals utility from the public good, net of lobbying cost. For symmetric provinces, the steady state lobbying level and stock of public good may be greater in the case when lobbyists are non-benevolent and captures a part of the federal grant as private rent. Second, with a rent-appropriating lobbyist, the welfare of the consumers may be higher under non-cooperative lobbying protocol. In case of asymmetric provinces, welfare may 'flow' from the less efficient province to the more efficient province, violating equalization principle within a federation.

In the third essay, the disciplinary role of elections is discussed. The incumbent politician in a province, with locally procured taxes, provides a local public good and appropriates some private rent. The incumbent's reputation decreases with the amount of rent. Voters may judge the performance of the incumbent in two ways: either his absolute performance matters or his performance is compared with that of the neighboring provinces' incumbent through yardstick competition. In a static setting, the unitary evaluation fares better than relative evaluation in restraining the politician. However, in a dynamic setting, when the stock of reputation increases through time, a relative evaluation imposes higher discipline on incumbent politician.

▼ At its inception, the Medicare program was designed to insure that the elderly would not be denied access to the health-care system because of a lack of financial resources. But, with lobbying efforts, the original Medicare bill was amended to add coverage for those individuals with end-stage renal disease (ESRD), permanent kidney failure requiring dialysis or kidney transplant. To date, patients with ESRD are the only disease-specific population entitled to federal coverage for services on virtually a universal basis. \r\n\r\nBecause of the unique nature of funding for the ESRD program, the question arises as to whether it is ethically appropriate for the federal government to allocate monies on the basis of disease status. To answer this question I examine the politics, morality, economics, and human behavior that impact ESRD and the patients, the public, and the political response to it. I will look at the variety of issues, both within and beyond the range of medical practice, that reveal how ESRD is treated in the United States. To address these concerns, this research will explore the history, describe the current conditions, and then suggest possible futures for the ESRD program. \r\n\r\nThrough this research, I will argue that the Medicare ESRD Amendments were a unique phenomenon, the result of a perfect storm. The technology was available to save lives and it worked. Further, not only did the technology save people, but also it had the capacity to restore terminally ill individuals to normal and productive lives. This idea was irresistible. However, while created with good intentions, the ESRD program was a strategic mistake. Caught up in the rescue fantasy, politicians and providers gave inadequate forethought to the ethical, economic, and regulatory demands the program would impose on the federal government. \r\nHowever, for all the problems and unintended consequences, I will argue that the ESRD Amendments are more than just a run-of-the-mill federally funded health-care program. The Amendments created a legal right, a moral promise, and a special covenant, that cannot be revoked, between the federal government and patients with a life-threatening illness.\r\n Advisors/Committee Members: William J. Congress has encouraged the use of Alternative Dispute Resolution methods to resolve disputes arising in federal government contracting. Alternative Dispute Resolution includes a broad range of techniques, including mediation; however, use of Alternative Dispute Resolution to resolve disputes in contracting has focused on arbitration. Arbitration is the Alternative Dispute Resolution method most similar to a trial. Attorneys largely lead the resolution of these contractual disputes given their expertise in contract law. This expertise in contract law as well as comfort and familiarity with the litigation process may encourage attorneys to select arbitration over other means of Alternative Dispute Resolution that may be more beneficial to all parties. "Lawyers bred in litigation may not realize when one or more of the techniques in the ADR procedural array may be far preferable to court litigation, and they may take an unnecessarily narrow view of their clients' interests" (Section of Administrative Law and Regulatory Practice, 2001). "Arbitration has become expensive and time consuming because of increasing demands for discovery (a process through which both parties exchange information prior to an administrative or judicial hearing), which results in an unintended consequence of participants not fully engaging in Alternative Dispute Resolution processes. The increased costs of arbitration associated with the discovery process encourages disputants to forgo investing in Alternative Dispute Resolution methods and proceed directly to administrative or judicial hearings where the parties can get a final ruling on the merits of the case with limited appeals options. If Alternative Dispute Resolution is to fulfill its original mandate or promise, parties must find resolution before the parties even get to arbitration. To encourage a fuller exploration of other Alternative Dispute Resolution methods, federal contracts should include mandatory dispute avoidance measures and mediation. Mediation should be required before parties can proceed with a grievance or a lawsuit. This research introduces a new model for understanding how narratives around poverty and federalism interact. This PovFed model uses a principal-agent structure to identify the federalism orientation of individual states and a deservingness model to identify orientation toward poverty. Putting these two together provides a tool for understanding how these two narrative frameworks interact. The PovFed model enables social workers in policy and public administration conserve advocacy resources in the short term by framing policy options in line with prevailing narratives, and provides a structure for building toward long-term narrative change.The way we talk about policy issues conveys important evidence of the stories we form around social problems. These shared stories are more deeply held than political or ideological orientations. Narrative policy analysis provides a framework for identifying linkages between these explanatory stories and policy initiatives; creating a powerful tool for social workers and public administrators to increase the productivity of their efforts toward social justice goals. This paper tests the utility of this approach focusing on state poverty reduction initiatives and the intersectionality of causal stories related to poverty and the state-federal partnership.The debate over whether and how to intervene to reduce poverty and/or alleviate can be described not as one coherent narrative but as several narrative frames that each remain relevant today. Similarly, narrative frames regarding the parameters that bound state-level and federal-level intervention in poverty, the boundaries of federalism, remain both contested and enduring. Analyzing state poverty initiatives in the wake of the economic crisis of 2008-2009 reveals that states who took up these initiatives generally aligned with theories related to devolution rather than hollow state theories, as these states assign significant levels of agency to their level of government. These states also were aligned more strongly with causal stories or narrative themes related to poverty that locate cause in societal and economic spheres rather than on individual behaviors. A typology of states is proposed that may future efforts to reduce poverty within states by focusing on causal stories. While further research is required to validate this typology with larger sets of states and comparative data using a poverty measure that accounts for state actions, this theoretical typology of states may inform future state-federal partnerships that leverage the complexity of poverty-related narratives to reduce poverty.

Esta tese analisa os fatores que afetam as escolhas dos governos subnacionais com relação à provisão de serviços públicos na federação brasileira, tomando como objeto empírico de análise o crescimento da municipalização do ensino fundamental no país (1997-2006). A interpretação dominante sobre a municipalização no Brasil aponta o Fundef, uma norma aprovada pelo governo federal, como o único fator explicativo desse resultado. A razão para isto é que as regras desta norma federal passam a atrelar o atendimento de alunos à receitas orçamentárias, o que teria despertado o interesse dos municípios em ampliar suas redes de ensino. No entanto, esta tese demonstra que o Fundef não é um fator suficiente para explicar nem a municipalização, nem a grande variação nos graus de municipalização verificados nos estados, bem como um número significativo de municípios paulistas que, mesmo com os incentivos do Fundef, optaram por não aumentar o atendimento municipal. Esse resultado só pode ser explicado por um conjunto de fatores que incluem outras regras federais e estaduais, a situação das contas públicas no momento da implementação do Fundef, o patamar inicial das matrículas, o partido político de governadores e prefeitos e outras variáveis de contexto local, como disponibilidade orçamentária e aspectos demográficos. As principais conclusões desta tese são: 1) o interesse dos governos estaduais em transferir o atendimento para seus municípios é o fator mais importante para explicar a municipalização e 2) quando este interesse se consubstancia em programas estaduais de municipalização, com incentivos adicionais ao Fundef, esses se tornam o principal fator explicativo da variação observada.

This thesis analyses the factors which explain the choices of subnational governments concerning the provision of public policies in the Brazilian federation. As a means of empirical testing, the decentralization of primary education from the states to municipalities, between 1997 and 2006, is taken as an object of study. The predominant interpretation on this matter points to the approval of a federal norm, known as Fundef, as the sole factor explaining decentralization. The reason for this interpretation is that the norm links the number of students being attended to the distribution of revenues, therefore, motivating city mayors to expand their school systems. However, this thesis shows that Fundef is not a sufficient factor to explain neither the decentralization nor the variation observed in the levels of decentralization among Brazilian states. Furthermore, an analysis of the choices made by municipalities in the state of São Paulo reveals that a significant number of them decided not to increase their school systems after the approval of the federal norm. All these results can only be explained when a set of other factors are incorporated into the analysis. Com a introdução das tecnologias da informação e comunicação (TICs) em governos, em especial a internet, tornou-se possível ampliar não só a capacidade e níveis de qualidade dos serviços prestados, mas também o enfoque na transparência, provocando diversas mudanças no âmbito do controle social e participação cidadã. Esta nova perspectiva de uso das TICs em governos para fins de ampliação de canais de participação é conhecida como governança eletrônica (e-governança). O objetivo desta dissertação é identificar quais os impactos da participação cidadã nas consultas públicas para a produção de leis e os limites e os desafios das consultas públicas online do Poder Legislativo federal. Os instrumentos de coleta de dados foram a visita estruturada ao website da consulta pública online, o e-Democracia, e entrevistas semiestruturadas dos gestores responsáveis pela consulta pública, bem como deputados envolvidos na elaboração da Lei das Lan Houses e seus apensados. Também foram entrevistados participantes da consulta pública e a associação de lan houses do Brasil. Em segundo lugar, foi realizada uma análise documental das contribuições para verificar quais as principais mudanças do pré-projeto em relação ao projeto final afim de mensurar o impacto da participação cidadã através da contagem das 10 palavras mais utilizadas em cada área documental; Proposições Legislativas dos Deputados, Contribuições Cidadãs pelo e-Democracia e Projeto Final enviado ao Senado Federal. Foi constatado neste estudo que as consultas públicas online podem ser consideradas um ambiente em que a e-participation se realiza, contudo, ainda existem limites e desafios para que esta participação ocorra devido a problemas gerenciais destas ferramentas de participação cidadã online e de outros problemas externos os quais literatura específica aborda e são retratadas na revisão de literatura e ressaltados nas considerações finais deste trabalho. As conclusões indicam que há evidências de que a participação cidadã tem impactos na produção colaborativa de legislações no governo federal, contudo, elas estão condicionadas a uma série de processos e condutas das áreas política, cultural, de recursos e de tecnologia.
