Délimitée par référence à la jurisprudence de la Cour Européenne des droits de l’homme, le champ pénal de l’Union européenne se révèle plus conséquent que ce que l’apposition du qualificatif « pénal », en droit de l’Union, ne le laisse penser. Envisager dans sa globalité, à l’aune des caractéristiques d’un système juridique et des modèles pénaux existant, les éléments du champ pénal de l’Union européenne peuvent alors s’agencer comme les pièces d'un puzzle qui prend progressivement forme et dont l'image générale se dessine peu à peu. Le champ pénal de l’Union européenne n’est plus qu’une compilation de normes. Il constitue désormais un système juridique : un ensemble d'éléments en interaction, évoluant dans un environnement déterminé, structuré en fonction des finalités qu’il est destiné à satisfaire, agissant sur son environnement et se transformant avec le temps sans perdre son identité. Son idéologie pénale à dominante répressive n’a rien de particulièrement original ; sa physionomie, en tant que système pénal, en revanche, reproduit l'atypisme proprement unioniste

Defined by the Europe court of human rights (ECHR), the EU extend its scope of action beyond the definition of « penal » as found in the EU law. Seen as a whole, taken the characteristics and models of already existing law systems, the different elements of the EU law scope can be put together like a jigsaw puzzle, revealing pieces after pieces the general picture. The penal scope of the EU isn’t just about regulations anymore. It acts as a legal system - a set of elements interacting with one another, evolving in set environment, structured to meet set up goals, taking action on its environment and evolving with time without losing its identity/nature. Its penal ideology and restrictive tendencies are not innovative, but its structure, on the other hand, replicate the atypical trait of the EU

Demokratinis valdymas be parlamento neįsivaizduojamas. Būtent parlamentui tauta rinkimuose paveda spręsti svarbiausius valstybės klausimus ir suteikia teisę kalbėti jos vardu. Parlamentarizmas pastarojo meto Lietuvos politiniame gyvenime, susiduria su problemomis ir sunkiai sprendžia svarbiausius šalies vidaus ir užsienio politikos iššūkius. Seimo nariai nevengia piktnaudžiauti suteiktomis teisėmis bei garantijomis. Pagrindinis šio tyrimo tikslas - atskleisti ir įvertinti parlamentaro konstitucinio statuso sampratą, bruožus ir probleminius aspektus. Magistro baigiamąjį darbą sudaro įvadas, trys darbo skyriai, išvados ir naudotos literatūros šaltinių sąrašas. Pirmajame skyriuje nagrinėjamos įstatymų leidžiamosios valdžios sampratos teorinės įžvalgos, antrajame – analizuojami Lietuvos Seimo nario teisinio statuso bruožai; kartu apžvelgti parlamento narių teisinio statuso ypatumai užsienio valstybių teisinėse sistemose. Trečiame tyrimo skyriuje atskleidžiamas Seimo nario teisinio statuso turinys Konstitucinio Teismo jurisprudencijoje bei analizuojami Seimo nario konstitucinio statuso probleminiai aspektai. Apibendrinant tyrimą formuluojamos tokios pagrindinės išvados: Seimo nario mandato individualumas, be kita ko, suponuoja, kad Seimo narys turi teisę ir pareigą tik pats asmeniškai įgyvendinti jam rinkėjų suteiktą Seimo nario mandatą. Tačiau patys Seimo nariai pripažįsta, kad šios Seimo kadencijos, taip pat ir ankstesnių Seimo kadencijų nariai ne kartą yra sudarę sąlygas kitam... [toliau žr. visą tekstą]

Democratic governance is unimaginable without a parliament. In the elections people dalegate to the parliament to deal with major public issues and the right to speak on its behalf. In recent Lithuanian political life the parliamentarism faced with difficult problems and hardly deals wtih the most important domestic and foreign policy challenges. The members of the parliament do not avoid the abuse of their rights and guarantees. The main purpose of this research - to reveal and assess the concept of parliament member's constitutional status, features and problematic aspects. Master's thesis consists of an introduction, three sections of work, conclusions and literature sources. The first chapter deals with the legislative power of the theoretical concept of insight, the second – analysis Lithuanian parliament member‘s features of legal status, also reviewed the singularities of the members of parliament in foreign legal systems. The third chapter of the work revealed the member‘s of the parliament legal status in the content of the Constitutional Court jurisprudence, also analysis constitutional status of member‘s of parliament problemic aspects. In summary, the research formulated following main conclusions: Individuality of parliament member‘s mandate, among other things, implies that the member of parliament has the right and obligation to implement his electoral mandate personally. Građevinarstvo-Čelične konstrukcije / Civil and Structural Engineering-Steel Structures

Iako je 2013. godine obeležena stogodišnjica pronalaska nerđajućeg čelika, njegova značajnija primena u građevinarstvu započinje tek početkom ovog veka. Austenitni nerđajući čelik odlikuje niz specifičnosti koje opravdavaju njegovu primenu u konstrukcijama posebne namene: postojanost i visoka otpornost na dejstvo korozije, značajan kapacitet plastifikacije i izražena duktilnost, poboljšanje svojstava materijala uticajem hladne deformacije, postojanost na visokim i niskim temperaturama, superiornost površinskog izgleda bez zaštitnih premaza, neškodljivost po okolinu. Najveći ograničavajući faktor za njegovu masovniju primenu je visoka jedinična cena, ali i nepotpunost tehničke regulative koja, još uvek, ne sagledava na odgovarajući način specifičnosti ovog materijala. Cilj istraživanja koje je prikazano u ovoj doktorskoj disertaciji je omogućavanje šire primene nerđajućeg čelika u konvencionalnim konstrukcijama kroz detaljnu analizu ponašanja centrično pritisnutih, hladnooblikovanih elemenata višedelnog preseka. Osnovni materijal primenjen u okviru istraživanja je nerđajući čelik austenitne mikrostrukture sa oznakom 1.4301. Predmet istraživanja su višedelni elementi formirani od dva C profila koji su međusobno direktno povezani šavovima ili zavrtnjevima. Eksperimentalnim ispitivanjem su obuhvaćene skoro sve osobenosti u ponašanju pritisnutih elemenata: ispitana su mehanička svojstva materijala, sagledan nivo asimetrije i anizotropije materijala, sagledan uticaj hladnog oblikovanja na poboljšanje mehaničkih svojstava materijala, utvrđen kapacitet nosivosti poprečnog preseka, izmerene početne geometrijske imperfekcije i određena nosivost elemenata na fleksiono izvijanje oko nematerijalne ose. Napredni numerički modeli na bazi metode konačnih elemenata su napravljeni da simuliraju ispitivanje pri fleksionom izvijanju a kalibrisani su na osnovu eksperimentalnih rezultata. Korištena je kvazi-statička analiza primenom eksplicitnog dinamičkog solvera softverskog paketa Abaqus. Ovako kalibrisani modeli na bazi MKE korišćeni su dalje za parametarsku analizu...

Aux lendemains des indépendances, les Etats de l’Afrique de l’Ouest ont constitués entre eux des organisations d’intégration économique dans le but de favoriser leur développement économique et social.Ces organisations conçues pour la plupart à partir du modèle Européen dispose d’une personnalité juridique autonome et d’un corps de règles propres ayant vocation à s’insérer de façon uniforme dans l’ordre juridique interne des différents Etats membres. Le fonctionnement harmonieux de ce système suppose l’existence d’un organe indépendant chargé, entre autres, de veiller à l’équilibre général du dispositif et d’assurer une interprétation uniforme des normes communautaires.Dans le cadre de l’UEMOA comme de La CEDEAO, cette fonction de protection est exercée par des organes juridictionnels intégrés dont la mission principale consiste à veiller au respect du droit dans l’interprétation et dans l’application des Traités constitutifs.L’objectif visé, à travers cette contribution, est de faire observer que le dispositif de protection mis en place fonctionne, d’une part, par les mécanismes de coopération institués entre les cours de justice et les autres composantes du système communautaire et d’autre part par le contrôle juridictionnel exercé sur les organes communautaires et les Etats membres.

After being freed from colonization, the West African States have set up commonly economic integration organizations to promote their economic and social development.The creation of the majority of those organizations is based on the European example and they have an independent legal personality and a body with specific rules in charge of integrating uniformly the internal legal environment of the different Member States.The harmonious functioning of the system requires, among others, the existence of an independent structure designed to take control of the general balance organization and achieve a uniform interpretation of the Community norms. Within the framework of the WAEMU as well as in the ECOWAS, this protective function is delegated to integrated judicial bodies whose main mission consists in making sure that a submission to the law related to the interpretation and compliance with Treaties is effective.The goal of such a contribution is to point out that the settled protection device is functioning, on the one hand, by the cooperation mechanisms introduced by justice courts and the other components of the Community system and, on the other hand, by the judicial control over the community structures and the Member States.

Pirmoje darbo dalyje yra aptariamos juridinio asmens kilmės teorijos bei jų įtaka juridinio asmens dalyvio atsakomybei, analizuojamas dalyvio atsakomybės pagal juridinio asmens prievoles institutas, aptariami juridinio asmens dalyvio atsakomybės modeliai, remiantis teismų, doktrinos išaiškinimais bei teisės normų analize nustatinėjama dalyvio atsakomybės pagal juridinio asmens prievoles kilmė. Antroje darbo dalyje aptariama ribotos ir neribotos atsakomybės juridinių asmenų dalyvių teisinio statuso ypatumai, analizuojami juridinio asmens dalyvių sampratos išaiškinimai Lietuvos teismų praktikoje bei teisės doktrinoje, taip pat aptariami teisės aktų prieštaravimai bei teismų praktikos probleminiai aspektai, susiję su ribotos ir neribotos atsakomybės juridinių asmenų dalyvių teisinio statuso ypatumais. Trečioje darbo dalyje aptariama ribotos atsakomybės juridinio asmens dalyvio atsakomybės pagal juridinio asmens prievoles atsiradimo pagrindai ir jų taikymas Lietuvos teismų praktikoje. This Master’s thesis analyzes peculiarities of application of the liability of a legal entity’s member under the legal entity’s obligations in Lithuanian case-law. The first part deals with theories on the origin of a legal entity and their impact on the liability of a legal entity’s member, analyzes the institution of a member’s liability under the legal entity’s obligations, discusses models of the liability of a legal entity’s member and determines the origin of the liability of a legal entity’s member under the legal entity’s obligations based on interpretations of courts and the doctrine as well as on an analysis of legal norms. The second part discusses peculiarities of a legal status of members of legal entities with limited and unlimited liabilities, analyzes interpretations of the conception of a legal entity’s member in Lithuanian case-law and legal doctrine and also deals with contradictions in legislation and problematic aspects of the case-law related to peculiarities of a legal status of members of legal entities with limited and unlimited liabilities. Si l'histoire de la construction européenne a été marquée, à partir des années 1970, par les tensions entre la Communauté puis l'Union, d'une part, imposant la primauté absolue de son droit, et les États membres, d'autre part, revendiquant la suprématie de leur droit constitutionnel, cette problématique tend à se cristalliser depuis quelques années autour d'une notion : celle d'identité constitutionnelle de l'État membre. Pourtant la vertu fédératrice qu'on pourrait lui prêter contraste avec la polysémie de la notion. C'est précisément l'objet de cette étude de droit constitutionnel européen que de tenter de dégager des données du droit positif des États membres et de l'Union un concept empirique viable de la notion d'identité constitutionnelle de l'État membre, inspiré par une grille d'analyse issue des sciences sociales.La fondamentalité, dont l'objectivation passe par la référence à l'histoire de l'État, constitue un critère de définition nécessaire, quoiqu'insuffisant, de l'identité constitutionnelle, quelle que soit la façon dont celle-ci est conçue. Ecartées les formes contingentes de l'identité constitutionnelle qui conduisent à terme au dépérissement de la notion, selon des processus variables, que l'identité soit envisagée à partir de ce qu'il y a d'identique entre les États membres ou de spécifique à chaque État membre vis-à-vis de l'Union (et en dernière analyse vis-à-vis de ses pairs), c'est une conception de l'identité constitutionnelle inhérente à l'État membre qui s'imposera finalement. Ainsi conçue à partir de ce qui est ontologiquement commun aux États membres et irréductiblement spécifique vis-à-vis de l'Union, l'identité constitutionnelle assure en définitive la pérennité de l'étaticité des membres de l'Union et de l'origine stato-nationale de toute puissance publique, étatique ou européenne, en Europe.

If the history of European integration has been marked, from the 1970s, by the tensions between, on one hand, the Community and the Union, imposing the absolute primacy of its law and, on the other hand, the Member States, claiming the supremacy of their constitutional right, this problem aims to crystallize in recent years around the notion of the constitutional identity of the Member State. Yet, the unifying virtue which we could lend it contrasts with the polysemy of the notion. This is precisely the purpose of this study of European constitutional law to try to extract from the data of the positive law of the Member States and the Union an empirically viable concept of the notion of constitutional identity of the Member State, inspired by an analytical framework from the social sciences. The fundamentality, objectified by reference to the history of the state, is a necessary but insufficient defining criterion of constitutional identity, regardless of how it is conceived. Put apart the contingent forms of constitutional identity that lead ultimately to the decline of the notion, according to variable processes – that identity is seen as identical between Member States or as specific to each…

▼ This study is an exploratory inquiry into â€˜hybrid state formationâ€™ in Timor-Leste. Due to the escalating number of internal conflicts since the end of the Cold War, the UN and the international community have made efforts to stabilise so-called failed or fragile states, which are mainly in the non-Western and post-colonial context. In spite of their efforts, international peacebuilding and statebuilding have not made successful records in these states. One of the mistaken approaches of international peacebuilding and statebuilding is that these projects were designed based on an ideal form of the state that follows Weberian tradition, and which mainly developed in the process of Western European modernisation. This international top-down approach has disregarded the local norms, values, social structure and tradition, and has therefore encountered the legitimacy problem and dysfunctional state institutions. In order to address the problems of the top-down approach, some critical scholars suggested â€˜hybrid institutionsâ€™ to increase legitimacy, which involves incorporating local institutions within the international idea of the ideal state. However, this study argues that the institution-focused hybrid approach still retains the Weberian concept of the state and the top-down approach. The study, therefore, calls for the necessity of a new approach to understand the local-centred forms of the state, which reflects its local history: this approach is referred to as â€˜hybrid state formationâ€™. This study draws on the case of Timor-Leste to theorise hybrid state formation. Timor- Leste retains traditional values and institutions that still significantly influence ordinary Timorese peopleâ€™s daily life, despite the fact that external forces such as Portuguese colonial power, Indonesian invaders and the UN mission have intervened to rule the society by implanting the modern state. By shedding light on this phenomenon, this study suggests a framework named â€˜a web of authoritiesâ€™ to delineate the Timorese hybrid state, in which a rational-legal authority co-exists with traditional and religious authorities. This framework also empirically explains the ways in which Timorese state formation has developed, and investigates the key state formation mechanism in Timor-Leste. Based on literature and via field research, this study identifies Timor-Lesteâ€™s traditional, religious and rational-legal authorities and analyses the relation between these multiple authorities, in order to consider the Timorese â€˜web of authoritiesâ€™ as a form of hybrid state. ▼ As a whole, this work serves to illuminate the tragic as a fundamental human phenomenon and an objective fact that is distinct not only from comedy and irony but from other forms of calamity and modes of failure. I consider three distinct sources of philosophical knowledge on tragedy. The first is tragic drama and literature, the second is the theory of the tragic and the third source consists of the employment of the concept of tragedy to discuss events or characters that one encounters in life. I carefully draw upon the first two sources to thicken the elaborations of four different facets of the third. In this process, I extrapolate Szondi?s notion that tragedy is a specific dialectic in a specific space. In the course of this work, I place a greater emphasis upon this general concept of the tragic as opposed to a poetics of tragedy. The dissertation bears out, however, that it is ultimately poetics - and not the dialectic as general concept - that provide us with the richer insights into tragedy as it unravels in life. The specific dialectic of tragedy unravels so as to cause the irreplaceable loss of something of great value. This provides me with a structuring element that ties the four central chapters together. In terms of content, I emphasize also upon the tragic flaw as a set of character traits (manifested by an individual or some form of collective) which keep tragedy in place. The consideration of the figure of Willy Loman allows me to examine the tragedy of failure of expectations which is a distinct category of the tragic and yet it oscillates such that ties together the other themes. A central idea that emerges from an analysis of the overlapping themes is that prior to tragedy is the investment of the deepest inner resources into a process. This investment gives rise to identity and to expectations. As a tragedy unfolds, the source of the identity or of expectation becomes also the birth place or the generator of all threats to this identity and the collapse of long nurtured expectations. Die vorliegende Diplomarbeit hat das Thema „Staatszerfall vs. Räume begrenzter Staatlichkeit“. Das Ziel des Vergleichs dieser beiden Konzepte liegt darin, festzustellen, welches Konzept besser zur Darstellung von Staatlichkeit außerhalb der OECD geeignet ist. Folgende Unterfragen werden gestellt, um dieses Ziel zu erreichen: Welcher Staatsbegriff liegt den Konzepten zu Grunde? Welche Form von Staatlichkeit wird Staaten außerhalb der OECD-Welt in den Konzepten zugeschrieben? Welchen erkenntnistheoretischen Nutzen und welche Schwächen haben diese Konzepte? Anhand der Analyse der beiden Konzepte wurden die folgenden Unterschiede herausgearbeitet. Der Staatsbegriff wird von dem Konzept des Staatszerfalls weit definiert. Diese Definition bedeutet, dass der DRIS westlicher Prägung (Leibfried und Zürn 2006) als Vergleichsfolie und Ziel verwendet wird. Das Konzept Räume begrenzter Staatlichkeit verwendet hingegen einen engen Staatsbegriff. Um Definitionsfragen nicht zu Forschungsfragen zu machen, spricht man sich dafür aus, den Staat so eng wie möglich zu definieren. Diese Definition umfasst die „effektive Souveränität“ sowie die Herrschaftsbegrenzung eines Staates. Als Lösungsansatz dient beiden Konzepten das Konzept Governance, jedoch in unterschiedlichen Verständnissen. Während in der Literatur zu dem Konzept Staatszerfall Governance ein normatives Verständnis erfährt (z.B. Good Governance), wird in der Literatur zu Räumen begrenzter Staatlichkeit ein analytisches Verständnis von Governance verwendet, um die Erbringung der Leistungen in den Bereichen Herrschaft, Sicherheit und Wohlfahrt zu untersuchen. Das Fazit, das aus dem Vergleich gezogen wird, ist, dass es dem Konzept Räume begrenzter Staatlichkeit besser gelingt, Staatlichkeit außerhalb der OECD zu untersuchen, als dem Konzept des Staatszerfalls. Dem Befund von fehlender Staatlichkeit vor der Folie des Ideals eines westlichen Wohlfahrtsstaates muss die Frage nach dem „Inwiefern anders?“ folgen. Das Konzept Räume begrenzter Staatlichkeit stellt diese Frage, im Gegensatz zum Konzept des Staatszerfalls und daher ist der erkenntnistheoretische Nutzen größer.

My diplomacy thesis with the title „State Failure vs. Areas of Limited Statehood“ deals with the question which of those two concepts describes statehood outside of the OECD more adequately. Following research questions were posed: Which definition of statehood is being used in the concepts? Which form of statehood is being ascribed to states outside of the OECD by the concepts? Which epistemic value and which deficits do the concepts have? The concept of State Failure uses a wide definition of statehood. ▼ Introdução: Os Benzodiazepínicos estão entre as drogas mais prescritas no mundo. Possuem características ansiolíticas, hipnóticas, miorelaxantes e anticonvulsivantes. Estudos prévios evidenciam inadequações nas prescrições de benzodiazepínicos, como uso equivocado para quadros inespecíficos, tratamento prolongado e abuso por idosos. Benzodiazepínicos podem trazer sérios efeitos adversos, sobretudo em idosos, como sonolência diurna, deterioro da memória e funções cognitivas, desequilíbrio e quedas. Objetivos: Analisar a prevalência do uso de benzodiazepínicos nos pacientes do Centro de Atenção Psicossocial (CAPS) de Campo Bom-RS em um período de 24 meses (Junho de 2013 a Maio de 2015), faixa etária, frequência de dispensações, dosagens, CIDs e especialidades dos médicos prescritores; bem como possíveis relações com a função cognitiva, afetiva, e quedas em idosos. Métodos: Estudo transversal, com informações coletadas e tabuladas a partir dos prontuários e prescrições médicas do CAPS Campo Bom, bem como do seu sistema informatizado de gerenciamento (Software Multi 24 Horas). Foram obtidos dados como idade, gênero, identificação dos CIDs; bem como informações sobre prescrições de Benzodiazepínicos, como frequência, quantidade, tipo de medicamento, posologia, profissional prescritor e demais medicamentos utilizados. Critério de inclusão: utilização de qualquer benzodiazepínico disponível na rede SUS: Clonazepam 0,5mg, Clonazepam 2,5 mg/ml, Clonazepam 2mg e Diazepam 5mg. Foram aplicados os testes MEEM e GDS nos pacientes idosos, em entrevistas individuais, nas quais também se avaliou a escolaridade, ocorrência e frequência de quedas, além das comorbidades auto relatadas. Para construção do banco de dados foi utilizado o Software Microsoft® Office Excel® 2007, e para análise estatística o Software PASW V18 (SPSS®). Resultados: O número total de pacientes ativos identificados no CAPS foi de 855 indivíduos, sendo 543 (63,5%) mulheres e 84 idosos (9,8%). A prevalência de utilização de BZD nesta população representou 47,2% (n=404 indivíduos). Foram identificadas 12.680 prescrições médicas dispensadas e, deste total, a prevalência de prescrições de benzodiazepínicos foi de 21,7% (n=2.748). Dentre os pacientes que receberam BZD, 297 (73,5%) eram mulheres e 59 idosos (14,6%), dos quais 56 foram entrevistados. Dentre os idosos entrevistados, 42 (75,0%) possuíram significativa sintomatologia depressiva (GDS≥5) e 32 (57,1%) apresentaram duas ou mais quedas no período de 1 ano. Dezoito pacientes idosos demonstraram fazer uso de dois ou mais BZDs. Houve correlação linear negativa entre os escores do MEEM e do GDS (r = - ,416; p=,002). Houve também uma correlação linear negativa entre o escore do MEEM e número de quedas em idosos (r = -,327 p=,016). Conclusões: Os benzodiazepínicos corresponderam a 21,7 % do total de prescrições do CAPS e do total dos indivíduos 47,2% receberam benzodiazepínicos. This study aims to examine member State liability for breaches of EU law. In order to achieve this the greek rules on State liability are examined (mainly in connection to the greek case law). Furthermore, the theoretical foundations of the principle of member State liability for breaches of EU law are examined as they have been set out by ECJ/CJEU. Besides this, the integration of the european case law conclusions into national law is observed. Thus it easier to compare the two legal systems of State responsibility (national and european). The most important conclusion is that the existing double layer system of State liability results in two level protection, where there are differences especially when it comes to establishing the member State liability. The coordination and convergence of these two legal protection systems are crucial in order to achieve a coherent and satisfactory level of judicial protection. In this context it is examined whether article 105 of the greek Introductory Law to the Civil Code can be interpreted by the Greek judge in a way which helps eliminate the fragmentation of law of State liability and the two-speed protection.

Η παρούσα μελέτη έχει ως στόχο να μελετήσει ενδελεχώς την αστική ευθύνη του Κράτους μέλους της Ευρωπαϊκής Ένωσης για παραβιάσεις του ενωσιακού δικαίου. Σε αυτά τα πλαίσια αναλύεται το εθνικό ρυθμιστικό πλαίσιο της αστικής ευθύνης του Δημοσίου κυρίως μέσα από την προσέγγιση και εξέλιξη αυτού εκ μέρους της εγχώριας νομολογίας. Αναλύονται οι θεωρητικές βάσεις της νομικής θεμελίωσης της ευθύνης του Κράτους μέλους της Ε.Ε. για τις παραβιάσεις του ενωσιακού δικαίου και οι προϋποθέσεις θεμελίωσης της ευθύνης αυτής κατά τη νομολογία του ΔΕΚ/ΔΕΕ. Εξετάζεται δε και η ενσωμάτωση των συμπερασμάτων της ενωσιακής νομολογίας στην ελληνική έννομη τάξη. Κατ' αυτό τον τρόπο είναι δυνατή η άμεση αντιπαραβολή των δύο ρυθμιστικών πλαισίων (εθνικού και ενωσιακού). Βασικό συμπέρασμα αποτελεί το γεγονός ότι το υφιστάμενο (διττό) σύστημα αστικής ευθύνης οδηγεί σε προστασία του ζημιωθέντος σε δύο επίπεδα (εθνικό και ενωσιακό), τα οποία διαφέρουν ιδίως ως προς τις επιμέρους προϋποθέσεις θεμελίωσης της αστικής ευθύνης του Δημοσίου. Διαπιστώνεται η ανάγκη σύγκλισης των δύο συστημάτων προκειμένου να παρασχεθεί ένα ομοιόμορφο και ικανοποιητικό επίπεδο δικαστικής προστασίας. Σε αυτά τα πλαίσια εξετάζεται εάν το άρθρο 105 ΕισΝΑΚ μπορεί να αποτελέσει εργαλείο στα χέρια του Έλληνα δικαστή, ώστε να αμβλυνθούν τα φαινόμενα κατακερματισμού του δικαίου αστικής ευθύνης του Δημοσίου και της συνεπακόλουθης προστασίας δύο ταχυτήτων.
