▼ The researcher has adopted the rule of law as a theoretical framework to critically analyse European Union ('EU') competition law intervention in cases of refusal to license intellectual property right ('IPR'). The research also examined the approaches adopted by EU judiciary and competition authorities when dealing with a competition law defence. The study was particularly focused on the 'exceptional circumstances' test used by EU competition authorities to assess unlawful conduct of dominant undertakings. The exceptional circumstances test under Article 102 Treaty on the Functioning of the European Union ('TFEU') has aggressively expanded throughout EU case law. This has resulted in inconsistencies or gaps in law as EU case law progressed which could clash, to some degree, with one of the basic elements of the rule of law: the legal certainty, predictability consistency of decision-making. The case of finding abusive conduct by patent or standard essential patents' owners ('SEPs') under EU competition law can potentially challenge the rule of law doctrine, the essence of IPRs, the protection offered under CFREU and Directive 2004/48 on the Enforcement of Intellectual Property Rights. A lot of attention in contemporary EU law has been focused on the question of when should competition law compel a dominant undertaking to license its intellectual property ('IP') to its rivals? And what are the required terms, if supply was found to be mandatory? These questions are discussed with reference made to EU case law starting with one of the earliest cases, Volvo v Veng, and some of the latest cases, most prominently Huawei v ZTE. This thesis has contributed to knowledge through the use of the doctrine of the rule of law as a tool to assess EU case law and explore the extent to which the rule of elements has been met. It has also contributed to knowledge via the reflection on EU law and how it has been interpreted by national courts pre-and-post Huawei v ZTE. The UK, Germany and Netherlands are used as examples to evaluate how the EU competition law has been applied and interpreted by the domestic judiciary and to explore the implications of Huawei v ZTE on cases brought before domestic cases. The researcher ultimately called for major reforms to Article 102 TFEU to identify its scope and limitations and its main objectives. It was concluded that the EU competition law is built on a degree of uncertainty and EU decision-making can be categorised by unconformity that could be challenged by some of the rule of law elements. The study indicated that the EU judiciary and competition law authorities could adopt an approach similar to that of the UK by examining the legitimate expectations of both right-holders and licence seekers as opposed to the examination of the legitimate expectations of licence seekers.

▼ The EU is no longer an organisation that merely pursues economic objectives, but it also evolves towards a more political and constitutionalised Union. The thesis supports that the political integration in the field of EU fundamental rights, is primarily evolving through a 'triangular', inter-connected system of protection, including the constructivist transformation of EU citizenship, the institutionalised developments, such as the EU Charter, and the protection of fundamental rights as general principles of EU law. Yet major components of a flawless fundamental rights policy as a whole, are still absent and this is even more perceptible during periods of crises, such as the recent financial crisis, where a lack in citizens' rights protection is evident, especially in effective judicial protection, due to the difficulty in challenging the consequences of the conditionality imposed. The deficient protection largely derived from the restricted scope of application of fundamental rights under the Charter, its unstable judicial interpretation, and in turn from the unwillingness of the Court to rule on complex financial cases. The financial crisis and its mechanisms, therefore, constitute a useful case-study to assess the modern 'triangular' protection of rights and stimulate the interest in assessing new legal paths to reinforce it, by broadening fundamental rights' scope of application. Although EU citizenship has not played any substantial role in the financial crisis, it is believed that is not constrained to its current, 'confined' form, due to its evolving character, designed to encounter constant evolution and progress. The constructivist nature of EU citizenship has culminated with the judicially developed 'substance of the rights' doctrine, initiated with Rottmann, according to which an internal fundamental rights violation, can possibly fall within the scope of EU law, if it amounts to detaching Union citizenship rights of their substantive meaning. The doctrine has not only largely overcome the limits faced by the cross-border requirement and created an EU self-standing test towards wholly internal situations, but has importantly prompted the inclusion of new, unwritten rights in the concept of EU citizenship, such as the ability to benefit from equality in purely internal situations. This new jurisdictional test, can be effectively compared to the approach adopted in the financial crisis ruling of Associação Sindical dos Juízes Portugueses, where through the exercise of judicial activism, the ECJ managed to overcome the legal barriers of the Charter and rely on effective judicial protection under Art. 19(1) TEU, in a wholly internal situation. Through this comparison, the thesis aims to bring the doctrine a step further and propose an alternative, more effective use of rights, by establishing a link between EU fundamental and EU citizenship rights. ▼ It is generally assumed that the EU law regime excludes arbitration from its scope, since issues of EU law must be resolved within the EU legal order, according to the wording of the Treaties and the case law of the CJEU. It is also assumed that courts offer adequate and effective protection to litigants, thus arbitration does not make any further contribution to parties. This thesis challenges these ontological assumptions, using the case of bank depositors, and aims to investigate whether courts within the EU protect bank depositors effectively or whether arbitration would offer further protection. For this purpose, the nature of bank deposits is considered, and the approach of courts and arbitrators towards depositors are comparatively analysed, based on effectiveness of protection, as the appropriate tool of assessment. The findings of this examination lead to the final research question regarding the role, if any, of arbitration within the EU legal order and the relationship between arbitration and litigation, in particular within the context of the global financial crisis. Thus, the central argument of this thesis is that, if it is accepted that arbitration does have a place in the EU legal order, and based on the argument that bank deposits qualify as investment, bank depositors can enjoy the protection offered by international investment arbitration, which can protect them more effectively than litigation The originality of this work centers around three points. Firstly, this thesis aims to use the principle of effectiveness in a substantial sense rather than its procedural meaning, considering whether individuals do not only access the justice, but also being remedied effectively. Secondly, this thesis argues that bank deposits can be treated as investment, thus depositors could enjoy further protection offered by investment law. Finally, the thesis supports that the EU law regime does have some place available for arbitration, albeit its traditional exclusion, especially during the particular period of the financial crisis.

▼ In the last decade all four areas of European integration – economic, social, legal and political – have faced a series of unprecedented crises that have shattered the foundations of the integration process and have thrown into question the future of the European Union. Among the many paradoxes that have riddled the integration project since its inception, none is more puzzling than the one the EU faces currently. Arguably never in any other time has the EU been so integrated and so successful as it is today, and likewise, never in any other time has there been a greater cognitive dissonance and distance between the peoples of Europe and the EU. This project argues that the greatest crisis afflicting the European project is an epistemological crisis, resulting from our continued failure to understand the processes and forces that drive European integration. Attempts to address questions regarding the future of Europe are failing precisely because we are attempting to answer Europe’s ontological question, without first answering Europe’s epistemological question, in other words, we are attempting to agree on a future for Europe without first understanding the very nature of the integration process, and if we persist on this fallacy we are doomed to fail in both pursuits, as we have been failing for the last seventy years. This project argues that in order to solve this paradox, in order to determine the future of the EU and overcome Europe’s crisis, we must adopt a systems theory approach to understand the complex adaptive nature of the integration process. A systems theory approach to European integration theory allows us to uncover and to understand the different inputs that both constrain and compel European integration and allows us to create predictive models of future integration and disintegration. Modern competition occurs in a global market and straddles various state borders. This international dimension of competition law (antitrust law) subsequently raises concerns whether one state can apply its competition rules extraterritorially against an undertaking in another country, when the latter behaves in an anti-competitive manner that, for example, have adverse effects in the territory of the former. In the context of such extraterritorial enforcement, the concept of the Effects doctrine as created and developed in the antitrust jurisprudence of the United States plays an important role. In this dissertation the issue of extraterritorial antitrust jurisdiction is investigated in an attempt to suggest a suitable basis for assertion of such jurisdiction. The evolution of the Effects doctrine in the United States and its further development and qualification in American Antitrust jurisprudence is addressed as well as its interrelation with the concept of international comity. Thereafter the basis for assertion of extraterritorial antitrust jurisdiction by the European Community is investigated. In this regard the long favoured Single Economic Entity Theory is addressed as well as the development of a form of Effects doctrine by the European Commission which eventually culminated in acceptance of an “Effects/Implementa-tion doctrine” by the European Court of Justice in the Wood Pulp case. It should however be noted that the scope of the extraterritorial application of the competition rules of the European Community is extended by the EC Merger Control Regulation 139/2004. Thus, the jurisdictional range of the Merger Control Regulation is considered in chapter 4. It is submitted that although the Effects doctrine is competent as sole basis for exercising extraterritorial antitrust jurisdiction, it has various disadvantages, inter alia that it evokes conflict between states due to differences in competition law and policy and various states interests. Consequently co-operation on a bilateral level is investigated in chapter 5 as a possible solution. Finally, the South African stance on the extraterritorial enforcement of its Competition Act 89 of 1998 is investigated in chapter 6 and certain observations and suggestions are made for future exercise of extraterritorial antitrust jurisdiction.

▼ Since the dawn of the European Union, insurance and banking undertakings claimed to be subject to a special status vis-à-vis the application of EU competition law, due to the quasi social nature of the services they provide. Within the financial services industry, anti-trust concerns do arise in relation to mergers and acquisitions, possible abuses of dominant position and state aid; however Art. 101 TFEU and the regulation of forms of co-operation arguably represent the paramount and most intricate aspects of the application of the EU competition rules to the financial services sector. This is due to the fact that the insurance and banking industries historically have been characterised by intense forms of horizontal co-operation between undertakings deemed necessary for the correct functioning of the financial services industry. On a general level, any agreement establishing a homogeneous pricing structure vis-à-vis consumers represents a blatant violation of Art. 101 TFEU giving rise to serious anti-trust concerns. Nevertheless, as will be explored in this thesis, in the financial services sector the Commission has often allowed what the doctrine has correctly defined as “forms of horizontal agreements concerning a relevant cost element making up the final price vis-à-vis customers”1 through its decisions relating 1 See Faull & Nikpay, “The EC Law of Competition” OUP 2007, p. 636.to interbank fees in payment systems and through the enactment of a block exemption for the insurance industry. Art. 101 thus seems to manifest a common element for these two industries, presenting interesting and intricate teleological quandaries. This thesis endeavours to break the impasse down into questions to which an answer may be provided: Ought Art. 101 to apply to the financial services sector at all? If so, to what extent? Is there any justification for a block exemption in the insurance sector? Indeed, should the banking sector too benefit from a block exemption? This thesis endeavours to answer the above questions and thereby to contribute to the identification of an ideal regulatory framework for forms of horizontal co-operation in the financial services sector.

Le droit de l’Union européenne emprunte fréquemment aux techniques élaborées et perfectionnées par la science des conflits de lois. Le droit dérivé en général, vecteur de l’intégration juridique des États membres, est la source d’un nombre croissant de dispositions de droit international privé. Les directives européennes, en particulier, exploitent les différentes méthodes de droit international privé façonnées de longue date par les droits nationaux. Les instruments conflictuels y sont placés au service de la construction européenne et voient ainsi leur finalité séculaire redéfinie. Ce sont donc tant les objectifs que les origines des règles touchant aux conflits de lois qui sont modifiés dans le contexte européen. Les contraintes propres aux directives, ces normes à deux niveaux, sont autant de facteurs susceptibles de perturber le fonctionnement des mécanismes de droit international privé. La présente étude se propose d’expliquer l’influence des directives sur le conflit de lois à travers le prisme des méthodes du droit international privé. Elle tend à montrer qu’un double mouvement d’influence réciproque caractérise les relations entre ces textes et ces méthodes. La réception des méthodes traditionnelles par les directives provoque une série de perturbations susceptibles de renouveler leur analyse classique. Inversement, des procédés nouveaux, issus de la construction du marché intérieur et présents au sein des directives, enrichissent la théorie du droit international privé. Cette analyse permet de mettre en lumière la diversité des méthodes de droit international privé contenues dans les directives européennes.

European Union law frequently utilizes from techniques elaborated and continuously improved by the conflict of laws science. Secondary law in general, vector of the legal integration of Member states is the source of an increasing number of private international law measures. In particular, European directives leverage the various methods of private international law designed by the respective national laws a long time ago. In these specific norms, conflicts resolution instruments are repositioned to serve the objective of European construction and therefore have their secular purpose redefined. Thus, both the objectives and the origins of rules relative to the conflict of laws are altered in the European context. As two level laws, directives have specific constraints, which can disrupt how private international law mechanisms operate. The present study aims at explaining the influence of the directives on the conflict of laws from the private international law methods standpoint. It tends to show that these texts and methods operate in a reciprocal influence model. The integration of the traditional methods into directives causes a series of disturbances which can renew their classic analysis. Le non-conventionnel, primat de la conflictualité contemporaine, modifie les voies utiles de son règlement juridique et militaire. De facto, à la traditionnelle dichotomie combattants et non-combattants, et aux notions obsolètes de déclaration de guerre et de guerre, se substituent une pluralité d’agresseurs et une superposition de cadres juridiques, fondement même de l’interaction des normes applicables en l’espèce, tant au niveau du droit local interne, que régional européen, ou encore international. La traduction juridique de cette confusion apparaît particulièrement dans les jurisprudences européennes et plus généralement dans la montée de l’Europe et de ses droits. Les connexions inter-juridictionnelles complexes, tant horizontales que verticales, s’illustrent particulièrement en matière de lutte contre le terrorisme, incarnant la mise en balance continue entre sécurité collective et protection des droits fondamentaux. En outre, le déplacement du centre de gravité des nouvelles conflictualités, du champ de la sécurité publique vers celui de la défense, revêt des conséquences en matière de respect des droits fondamentaux et de doctrine d’emploi des forces armées. Celles-ci sont les actrices principales de l’altération concrète du distinguo jus ad bellum, jus in bello, actionnées qu’elles sont sur le fondement de concepts nouveaux, qui sont autant de considérations à l’appui d’une refonte de modus operandi obsolètes, et motivant des interrogations relatives à l’interprétation du droit existant (lex lata) et de la nature des modifications à porter (lex ferenda)

The non-conventional, primacy of the contemporary conflicts, alters the useful ways of legal and military settlement. De facto, beyond the traditional dichotomy combattant versus non combattant, and to the obsolete notions of declaration of war and war, substitute a wide diversity of aggressors and a superposition of legal frameworks, the very basis of the interaction of applicable standards in this case, at the level of both the local internal law, the regional European law and the international law. The legal translation of this confusion figures particularly in european case law and more usually in the rise of Europe and its laws modifications. The complex inter-jurisdictional connections, horizontal and vertical, are particularly present in case of fight against terrorism embodying the continuous balancing test of the collective security and protection of fundamental laws. In addition, the shift in the centre of gravity of the new conflicts, from the scope of the public security to the defence, leads to consequences in the field of fundamental laws respect and doctrine of use of armed forces. They are the main agents of the practical weathering of the distinguo jus ad bellum, jus in bello, sued on the basis of new concepts, which are so many arguments to overhaul the obsolete modus operandi, explaining questions related to interpretation of existing law (lex lata) and the nature of the necessary modifications (lex ferenda)

▼ Abstract Is the Court of Justice of the EU (CJEU) best described as a run-away agent, free to influence the EU according to its own preferences, or as an obedient servant of EU member state governments? In this dissertation, Olof Larsson argues that neither description fits the CJEU. Rather, the CJEU is dependent upon the support of at least a minority of EU member states in order to be able to change the EU in ways counter to the wishes of the majority. The CJEU has not become one of the most powerful institutions of the EU because it has been insulated from government pressures, but rather because the governments of the EU have been divided on most of the important issues. Inspired by Separation-of- Powers theories developed to explain the Supreme Court of the United States, it is argued that these divisions among the member states has been an underestimated factor in explaining the independence of the CJEU. Correspondingly, the more united the governments are against the Court, the higher the risk of backlashes, i.e. political attacks against the Court or attempts to change the impact of its decisions. The dissertation is composed of four empirical chapters, two of which have previously been published in peer-reviewed journals. In the first, Larsson and co-authors argue that the CJEU reacts to the stated preferences of the EU member states in ways which can best be explained as a strategic adaptation in order to minimize the risk of backlashes. In the second, Larsson argues that such backlashes have happened. In the third, Larsson and co-authors argue that the most fundamental division among the EU member states in regards to the issues the CJEU handles is one between Liberal and Social Market Economies. In the fourth and final empirical chapter it is argued that the CJEU also uses legal arguments, in the form of references to precedent, in order to convince recalcitrant governments of the validity of its judgments. In short, the CJEU both listens to and speaks back to EU governments. These governments are often divided along lines separating Social from Liberal Market Economies, but when they are sufficiently united, backlashes against the CJEU do happen.

Le Règlement (UE) n° 650/2012 du 4 juillet 2012 apporte une véritable révolution dans le domaine des successions internationales. Depuis toujours, en effet, cette matière a donné lieu à d’innombrables difficultés et divergences entre les systèmes juridiques nationaux, notamment au sein de l’Union européenne où la nécessité de garantir la liberté de circulation des personnes a rendu indispensable la mise en place d’une réforme commune du droit international privé des successions. C’est alors dans cette perspective qu’est intervenu le nouveau Règlement « Successions », voué à garantir une protection effective et certaine des droits successoraux des citoyens de l’Union. Or, bien que la prévision de règles de conflits communes reste certes son objectif premier, celle-ci ne constitue pas le seul dessein poursuivi par cet instrument. En effet, ce dernier semblerait viser à un résultat ultérieur et davantage plus ambitieux : le rapprochement des droits nationaux. Pour ce faire, le législateur européen a fait recours à deux moyens : d’une part un instrument de droit international privé traditionnel et inéliminable, l’ordre public ; d’autre part un instrument de droit matériel, innovant et totalement de dérivation européenne tel le certificat successoral. Dès lors, le Règlement n° 650/2012 ne limiterait pas son action au seul domaine du droit international privé pur, mais contribuerait également à une progressive convergence des droits internes aux États membres, en favorisant ainsi le développement d’un véritable et effectif espace de liberté, de sécurité et de justice au sein de l’Union.

Regulation (EU) n° 650/2012 of 4 July 2012 led to a considerable revolution in the field of international successions. Indeed, such a subject has always caused several divergences among national legal systems, especially at the European level where the need for a proper functioning of the free movement of persons have led to an essential common reform of private international succession law. As a results, rules governing cross-border successions have been globally harmonised and citizens are finally able to organise their succession in advance. Nonetheless, Regulation n° 650/212 should not be limited to the only harmonisation of conflicts-of-laws rules ; these latter are certainly its primary objective, but not the only one. Indeed, the new instrument should aim at a more ambitious goal : the convergence of national legal systems. In order to achieve such a purpose, the European legislator has provided for two different means : on one side a typical and essential instrument of private international law like the public policy ; on the other side a new and unique instrument of substantial law such as the European certificate of succession. As a consequence, the new Regulation should not leed to a sample unification in the field of the private international law, but would also contribute to a progressive uniformisation of national rules of Member States. ▼ The process of concealing illegally obtained proceeds, better known as money laundering, is criminalised virtually all around the world and has been a law enforcement priority since the early 1990s. The international nature of money laundering, combined with estimations on the scope and the distorting effects it may bring about, make it a grave danger to national and international financial markets. At the same time money laundering is considered a danger to society due to its strong interaction with organised drugs and white-collar crime. Over the years a ‘twin-track approach’ has been developed aiming at the prevention of money laundering on the one hand, and punishing the money launderers on the other. Within the preventive anti-money laundering policy, supervision plays a key role. Although money laundering in general has attracted a great deal of attention from the academic world, supervision is an aspect that has remained underexposed in research. This research therefore focuses on the effectiveness of anti-money laundering supervision of banks, real estate agents and accountants in the European Union. Understanding that the EU Directive on the prevention of the use of the financial system for the purpose of money laundering and terrorist financing (‘Third Directive’) has left the design of supervision mostly to the EU Member States, their choices have been influenced by factors such as national politics, culture, the legal system, the economy and finances. As a result of these influences, a patchwork of anti-money laundering supervisory architectures exists in the European Union. This research identifies four supervisory models in the EU: the FIU model, the external model, the internal model and the hybrid model. The FIU model’s main characteristic is that the financial intelligence unit is the national authority with the final responsibility foranti-money laundering supervision. In the external model, supervision is formally exercised by public administrative or Government authorities that have no direct or professional relationship with the supervisees. The guiding principle of the internal model, is that where anti-money laundering supervision can be carried out by internal supervisors, these will be assigned with this task. The hybrid model combines, in different gradations, different elements of the aforementioned models. The models are the foundation for the country selection in this research. The countries that are further studied are the Netherlands, Spain, Sweden and the United Kingdom. They each represent one of the models identified. From the perspective of effective supervision this research thoroughly analyses the legislation, the institutional settings and competences of the anti-money laundering supervisors in the four selected countries, as well as the application of these competences in practice. Lietuvai tapus Europos Sąjungos valstybe nare privatūs asmenys įgijo teisę kreiptis į nacionalinius teismus ir reikalauti iš Lietuvos valstybės žalos atlyginimo, kuri kilo pažeidus ES teisę. Kadangi asmens teisė į valstybės valdžios institucijų veiksmais ES teisės nuostatų pažeidimu sukeltos žalos atlyginimą priklauso nuo skirtingų nacionalinių teisinių sistemų, Lietuvos Respublika, kaip ir kitos ES valstybės narės turi pareigą užtikrinti, jog nacionalinės teisės normos atitiktų Teisingumo Teismo formuojamą praktiką. Todėl šio darbo pagrindinis tikslas – išanalizuoti Lietuvos teisėje įtvirtintą valstybės atsakomybės už žalą doktriną, siekiant nustatyti, ar nacionalinis teisinis reglamentavimas neriboja galimybės asmenims pasinaudoti teise į žalos atlyginimą ir yra suderinamas su ES teise. Darbe analizuojama valstybės atsakomybės už žalą pažeidus Lietuvos teisę doktrina, įtvirtinta Lietuvos Respublikos civilinio kodekso 6.271 ir 6.272 straipsniuose, nagrinėjamas nacionalinių nuostatų atitikimas ES teisės reikalavimams. The Master thesis examines the liability of the state for the damages caused as a result of a breach of the European Union legislation within the legal framework of the Republic of Lithuania. As Lithuania has become a full member of the European Union, private entities also have gained the right to apply to the national courts and request for indemnification of damages caused as a result of a breach of the EU law from the State of Lithuania. As the person’s right to indemnification of damages caused as a result of a breach of the EU legal rules by the actions of public authorities depends on different national judicial systems, the Republic of Lithuania, just like other member states of the EU, is obliged to ensure that the national legal rules were in compliance with the case-law established by the Court of Justice. Therefore, the present thesis aims at analysing the concept of the state liability for damages established in the law of Lithuania with a view to determining if the national legal regulation does not restrict the possibility for the persons to exercise the right to indemnification and is compatible with the EU law. ▼ The purpose of this study was to examine the nature of the trade-development nexus in economic relations between the European Union and Pacific island states. Two interrelated but competing International Relations theories are utilised as tools for analysis: the dependency theory and realist theory. The research consists of analysis of the approaches, assumptions and applicability of both theories in the wider context of North-South relations, with a focus on recent changes in the relationship between the European Union and Pacific island states. The thesis revealed that the lack of success in reaching policy objectives throughout a long-lasting relationship was a key driving force for several policy shifts; these resulted in the implementation of the trade-development nexus into new foreign policy instruments, the Economic Partnership Agreements. Research demonstrated that new dependency theory forecasts more emphasis on the internal development dimension and a development-friendly trade-development nexus. Realist theory however estimates that, depending on power projections and self-interests involved, the trade-development nexus may lead to either more co-operation or more conflict in relations between the European Union and Pacific island states. In order to test the theoretical propositions, the thesis turned to the analysis of two case studies. It looked at the sugar sector in Fiji and the fisheries sector in the South Pacific. Both case studies demonstrated how the trade-development nexus selfadjusts to a given situation or changes through a set of conditions present at any given point in time— a phenomenon that is a defining feature, and possibly the actual essence of the nexus. This flexibility may positively contribute to the European Union's aspirations of becoming an influential global actor through trade and development policies. However, flexibility renders the trade-development nexus unpredictable as policy instrument and therefore less desirable from the perspective of Pacific island countries than it would appear in light of the case-studies.

▼ This thesis examines the changing role of the Court of Justice of the European Union (CJEU) from the perspective of its task of conducting constitutional review of EU legislation. It addresses a gap in the existing literature by providing a systematic analysis of how the methodology and intensity of constitutional review has changed over time. By focusing upon federalism and fundamental rights cases, it argues that a series of significant shifts may be detected in the jurisprudence of the Court since the coming into force of the Lisbon Treaty. In marked contrast with earlier periods in its history, the Court now subjects EU legislation to high-intensity review in cases of serious interference with the EU’s core constitutional principles. The Court has also adopted an increasingly “process-oriented” approach to constitutional review in recent years. This involves heightened scrutiny of the legislative process and evidence base upon which contested EU legislation was enacted. The result has been a gradual infiltration of procedural review into constitutional adjudication. These developments in the methodology and intensity of constitutional review form the basis for evaluating the changing role of the CJEU over time. It is contended that the case law reveals much about the contemporary, post-Lisbon role of the Court and, crucially, how this differs from previous periods in the history of European integration. Whereas the Court has long been criticised for failing to subject EU legislation to meaningful judicial scrutiny, there is growing evidence that the Court now takes its responsibility for constitutional review more seriously. Furthermore, recent judgments demonstrate the Court to be an institutional actor that is responsive to the wider legal and political context in which it now operates. These developments give rise to a reconsideration of exiting accounts which depict the CJEU as an “activist” or unwaveringly “pro-integrationist” institution. When viewed from the largely unexplored perspective of the evolution of constitutional review, it is concluded that the Court now engages in a finely calibrated, variable intensity approach to such review. In so doing, the Court has finally assumed the role of a veritable Constitutional Court whose primary role is one of upholding the checks and balances within a more mature EU legal order.

La thèse procède à une analyse descriptive et évaluative du droit fondamental à la protection des données personnelles dans l’ordre juridique de l’Union européenne. Ce droit a été distingué des autres droits fondamentaux tels que le droit au respect de la vie privée. Afin d’en mesurer la portée, l’étude analyse les restrictions dont il peut faire l’objet lorsqu’il entre en conflit avec d’autres intérêts individuels également protégés ou avec des contraintes collectives relevant de l’intérêt général. En effet, la révolution numérique permet certes aux individus d’augmenter leur liberté, mais elle renforce aussi la capacité de l’État de contrôler l’individu. C’est pourquoi, la progressive constitutionnalisation du droit à la protection des données personnelles dans l’Union européenne entend améliorer la protection offerte à l’individu en constituant un moyen d’expression de l’identité et des valeurs de l’Union européenne. A cet égard, le rôle de la Cour de justice s’avère central et stratégique, non seulement à l’échelle européenne mais également à l’échelle mondiale. A travers des arrêts au retentissement international, elle s’efforce de garantir le juste équilibre des intérêts en jeu en évaluant la nécessité et la proportionnalité des mesures adoptées, assurant un effet extraterritorial au droit à la protection des données. La reconnaissance de la Charte des droits fondamentaux en tant que source du droit primaire a apporté une contribution décisive aux derniers développements de sa jurisprudence en matière de données à caractère personnel, et a donné une impulsion au processus d’autonomie du système de l’Union par rapport à celui de la Convention européenne des droits de l’homme.

The thesis carries out a descriptive and evaluative analysis of the fundamental right to the protection of personal data. This right has been distinguished from other fundamental rights such as the right to respect for private life. In order to measure the impact of this right, the study analyzes the restrictions that may be placed on it when it conflicts with other equally protected individual interests or with the general interest on the basis of the proportionality principle. In fact, the digital revolution on the one hand allows people to exercise some of their rights but, on the other hand, allows the governments to control the individual. The progressive “constitutionalisation” of the right to personal data protection would improve the protection offered to the individual.Furthermore, the fundamental right to the protection of personal data would constitute a means of expressing the identity and values of the European Union.In a context marked by the technologies of surveillance and exchange of personal data, the European Union has chosen a model that respects fundamental rights.the role of the Court of Justice of the European Union appears to be central and strategic, not only at European level, but also globally, guaranteeing the right balance of interests by assessing the necessity and proportionality of the measures adopted.…
