▼ In 1957, the Treaty of Rome was signed by six West European states to create the European Economic Community (EEC). Designed to foster a common internal market for a limited amount of industrial goods and to define a customs union within the Six, it did not at the time particularly stand out among contemporary international organizations. However, by 1992, within the space of a single generation, this initially limited trade zone had been dramatically expanded into the world's largest trade bloc and had pooled substantial sovereignty among its member states on a range of core state responsibilities. Most remarkably, this transformation resulted from a thoroughly novel political experiment that combined traditional interstate cooperation among its growing membership with an unprecedented transfer of sovereignty to centralized institutions. Though still lacking the traditional institutions and legitimacy of a fully-fledged state, in many policy areas, the European Union (EU) that emerged in 1992 was nonetheless collectively a global force. My dissertation argues that the organization's unprecedented transfer of national sovereignty challenged the very definition of the modern European state and its function. In structure and ambition, it represented far more than just a regional trade bloc among independent states: it became a unique political entity that effectively remodelled the fundamental blueprint of the conventional European state structure familiar to scholars for generations. How did such a dramatic transformation happen so quickly? I argue that three forces in particular were at play: the external pressures of globalization, the search for a new Western European and German identity within the Cold War world and the often unintended consequences of the interaction between member state governments and the Community's supranational institutions. In particular, I examine the history of the EEC's monetary union, common foreign policy, common social policy and the single market to explain the impact of the above forces of change on the EEC's rapid transformation. ▼ In the field of European studies, the notion of ‘differentiated integration’ (Stubb 1996) was developed in the late 1990s as an alternative to the crude membership/non-membership dichotomy. While the theoretical benefits of this approach are broadly discussed in the existing literature, further empirical studies have been deemed necessary (Holzinger and Schimmelfennig 2012). The Nordic states constitute a particularly interesting laboratory in order to study this phenomenon. Indeed, while these states share several socio-economic and political characteristics, they also differ in terms of their relationship with the European Union. Several studies on these relationships emphasise the relevance of certain contextual variables as key explanatory factors for the variation in attitudes between the Nordic states. However, there is also lack of analysis that looks into the domestic political features that these countries share. Furthermore, most studies in the field tend to ignore the respective government’s positions on European integration, and mostly adopt a top-down approach when focusing on the nation-state as a whole. Adopting a most similar systems design, this thesis aims to answer the following question: have Nordic government preferences on European integration been influenced by domestic political factors? In order to answer this question, four domestic variables are introduced and analysed: relative strength of parties in parliament; composition of government; type of government; and government ideology. Within this comparative framework, three Nordic countries have been selected: the first one belonging to the ‘inner core’ of the European Union (Finland);; while the second is located at its ‘outer core’ (Sweden);; and the third one serves as a control case as an ‘EU-outsider’ which is still located in the Union’s ‘inner periphery’ (Norway). For each state, the analysis starts in the early 1990s, when ‘Europe’ developed into a politically salient issue in domestic politics. The focus is furthermore set on their respective government’s positions regarding five distinct policy areas: participation in the European Economic Area; application for European Union membership; participation in the Schengen Area; participation in the Economic and Monetary Union; and participation in European Battle Groups. The main findings of the thesis suggest that when analysing governments’ positions on (differentiated) European integration, the domestic political features should not be downplayed. For instance, the Swedish government’s opposition to participation in the EMU in 1997 is mostly explained by a lack of party consensus over this issue, unlike in Finland where a broad inter-party agreement was secured for this policy area. The analysis further suggests that studies on party and government preferences on Europe should focus on policy areas rather than on the issue of integration as a whole. ▼ Energy policy in the European Union (EU) is a patchwork of diverging interests and preferences. While the European Commission pushes for a common energy policy, Member States are responsible for their own separate energy policies. These divergences in interests and preferences might create a conflict situation between the Commission and Member States. This thesis explores the Commission’s behaviour vis-à-vis the Member States, investigating the conditions under which the Commission is likely to try to deviate from Member States’ preferences in the external dimension of the EU internal energy market. Adopting a Principal-Agent Model (PAM), this thesis conceptualizes the Member States as principals and the Commission as their agent. A qualitative case study approach and process-tracing method are applied to appreciate the variety of preferences of the actors involved, and provide a means to study the various shades of post-delegation agent’s behaviour. This thesis looks at four in-depth case studies: 1) Decision 994/2012 on establishing an information exchange mechanism with regard to intergovernmental agreements between Member States and third countries in the field of energy; 2) Directive 2009/73/EC on common rules for the internal market in gas; 3) Energy Community Treaty; and 4) Energy Charter Treaty. These were selected based on their relevance to the research question. Findings suggest that two factors are likely to affect the Commission’s deviation from Member States’ preferences: a) the preference alignment among the principals and b) the preference alignment between the principals and the agent. This thesis suggests that when the preferences between the agent and the principals are heterogeneous, the agent is more likely to deviate from the preferences of the principals. This thesis also suggests that the preference alignment among the principals only has a secondary effect on the agent’s deviation. Finally, this research contributes to the further development of the PAM offering a possible categorisation of post-delegation agent’s behaviour going beyond the dichotomy of deviation and non-deviation.

Европска конвенција за заштиту људских права и основних слобода није формално саставни део права Европске уније, међутим њој се најчешће прибегава када се одлучује о основним правима у ЕУ. Демократске вредности у оквиру ЕУ су знатно ојачане закључењем Лисабонског споразума, 2007. године. Наиме, поред чињенице да је закључењем овог Споразума ојачана улога и значај Европског парламента у односу на Савет, Комисију и Европски савет, те да су проширена његова овлашћења, како је, кроз поделу надлежности, учињен допринос унапређењу демократског функционисања ЕУ и јачању одговорности њених институција, Лисабонски споразум је, такође, ојачао положај Уније у систему заштите људских права. Наиме, одредбом чл. 6 ст. 2 Лисабонског споразума предвиђено је да ће Унија приступити Конвенцији, чиме се неће дирати у надлежност Уније прописану Уговорима о ЕУ, што је додатно разрађено и Протоколом бр. 8 закљученим уз Лисабонски споразум, који се директно односи на поменуту одредбу чл. 6 ст. 2. Дакле, Лисабонски споразум је на неки начин дао основу приступању Европске уније Европској конвенцији за заштиту људских права и основних слобода, чиме је, надаље, ЕУ потврдила да ће учинити напоре да нормативно усклади принципе владавине права и унапреди заштиту људских права и основних слобода. Европска конвенција за заштиту људских права и основних слобода, заједно са својим протоколима, представља један од најзначајнијих међународних уговора који су ратификовале 47 чланица држава чланица Савета Европе, те којим актом су заштићена основна људска права. У међународној правној теорији, те пракси међународних судова, веома је значајно питање перспективе приступања Европске уније Европској конвенцији за заштиту људских права и основних слобода. Везано с тим испитује се демократски потенцијал Уније, пре свега могућност или обавеза приступања ЕУ Конвенцији, подстицање усклађеног развоја заштите људских права, најзад спречавање противречности у судској пракси Европског суда за људска права у Стразбуру и Суда правде Европске уније у Луксембургу.

▼ The Great Recession of 2007 – 09 was the worst global economic crisis since the Great Depression of the 1930s. The effects were felt across most of the developed world and Europe was no exception. In many European countries, austerity programmes were implemented in response to the recession, which were often deeply unpopular. Many governments lost power in the years following the recession, with sometimes strikingly harsh swings against them. One notable example was the Irish election of 2011, in which the incumbent Fianna Fáil was reduced from 71 to 20 seats, by far its worst result at any general election since independence in 1922. This is congruent with the theory of economic voting, according to which voters will remove from office governments that fail to deliver economic prosperity. Although there is an enormous empirical literature supporting this theory, almost all of this evidence pertains to the typical boom and bust cycle of individual countries and little is known about economic voting during a severe global recession. The Irish result could have been indicative of the usual economic vote, a bolstered economic vote due to the unusual scale and severity of the crisis, or of dissatisfaction with the government's handling of the crisis. This thesis investigates whether the usual economic vote in European countries was altered during the Great Recession. This thesis uses survey data from the 2004, 2009 and 2014 waves of the European Election Studies~(EES) to compare the economic vote in 25 European countries before, during and after the Great Recession. Multilevel methods are used to model voters' support for the parties they could vote for at general elections in their own countries. Using this method, the results show that the economic vote was weaker during the crisis than it was either before or after. In order to explain these results, I analyse which parties voters tended to prefer after the crisis and how attitudes towards the European Union evolved over time. The results find that there was a shift away from centrist and pro-European parties towards radical and Eurosceptic parties following the crisis. In addition, support for the EU fell over the same time period and voters were increasingly likely to hold the EU responsible for economic conditions. Given the timing of these shifts as well as the association between European institutions and austerity policies, these findings suggest that the austerity programmes implemented in the wake of the crisis may have been a stronger catalyst for economic voting in Europe than the Great Recession itself.

Esta dissertação tem como questão principal a funcionalidade do Serviço Europeu de Ação Externa (SEAE) como um ator diplomático efetivo e eficiente. A dissertação procura uma resposta viável através da analise de possíveis vantagens e desvantagens do SEAE como agente diplomático, agindo em termos políticos e económicos. A pesquisa segue uma linha de argumentação que estuda diferentes aspectos. Primeiro, a base técnica do SEAE, que inclui o fundamento jurídico, as funções e tarefas, assim como a organização interna estabelecida pelos tratados da União Europeia. Segundo, a análise da posição do Alto Representante no seu cargo de chefe do SEAE. Adicionalmente adissertação considera o funcionamento do SEAE em base das funções diplomáticas estabelecidas pela Convenção de Viena sobre Relações Diplomáticas e pela Convenção de Viena sobre Relações Consulares. A analise também reflete a existência e as implicaçõesdo SEAE em concomitância de outros serviços diplomáticos nacionais dos Estadosmembros da UE.

The main question that this research paper seeks to address is the functionality of the EEAS as an effective and efficient diplomatic actor. The thesis pursues the answer in ananalysis of possible advantages and disadvantages of the EEAS as a diplomatic agent inpolitical and economic terms.The research is based on the argumentation line studying different aspects. Firstly, thetechnical basis of the EEAS, including the juridical fundament, the functions and duties, as well as the internal organization established by EU treaties are reviewed. Secondly isanalysed the role of the HR/VP as chief executive of the EEAS. Additional the thesisconsiders the functioning of the EEAS on the basis of the diplomatic functions stated inthe Vienna Convention on Diplomatic Relations and the Vienna Convention on ConsularRelations. The analysis also reflects the existence and implications of EEAS alongsideother national diplomatic services of European Union member states.

▼ This thesis examines the changing role of the Court of Justice of the European Union (CJEU) from the perspective of its task of conducting constitutional review of EU legislation. It addresses a gap in the existing literature by providing a systematic analysis of how the methodology and intensity of constitutional review has changed over time. By focusing upon federalism and fundamental rights cases, it argues that a series of significant shifts may be detected in the jurisprudence of the Court since the coming into force of the Lisbon Treaty. In marked contrast with earlier periods in its history, the Court now subjects EU legislation to high-intensity review in cases of serious interference with the EU’s core constitutional principles. The Court has also adopted an increasingly “process-oriented” approach to constitutional review in recent years. This involves heightened scrutiny of the legislative process and evidence base upon which contested EU legislation was enacted. The result has been a gradual infiltration of procedural review into constitutional adjudication. These developments in the methodology and intensity of constitutional review form the basis for evaluating the changing role of the CJEU over time. It is contended that the case law reveals much about the contemporary, post-Lisbon role of the Court and, crucially, how this differs from previous periods in the history of European integration. Whereas the Court has long been criticised for failing to subject EU legislation to meaningful judicial scrutiny, there is growing evidence that the Court now takes its responsibility for constitutional review more seriously. Furthermore, recent judgments demonstrate the Court to be an institutional actor that is responsive to the wider legal and political context in which it now operates. These developments give rise to a reconsideration of exiting accounts which depict the CJEU as an “activist” or unwaveringly “pro-integrationist” institution. When viewed from the largely unexplored perspective of the evolution of constitutional review, it is concluded that the Court now engages in a finely calibrated, variable intensity approach to such review. In so doing, the Court has finally assumed the role of a veritable Constitutional Court whose primary role is one of upholding the checks and balances within a more mature EU legal order.
