La gestion d’une entreprise expose l’employeur au risque de discrimination. Dans son acception originelle, la notion de discrimination vise les distinctions reposant sur un critère illicite. La mise en oeuvre effective de la prohibition des discriminations amène le juge à exiger de l’employeur qu’il justifie de façon pertinente ses décisions. L’entreprise est sommée de développer des outils lui permettant d’apprécier de manière objective les compétences de ses salariés. Au-delà de cet objectif initial, la lutte contre les discriminations doit dorénavant faciliter l’intégration d’un public défavorisé. Les notions d’égalité professionnelle, de diversité, d’actions positives et de discriminations indirectes font aujourd’hui parti du vocabulaire des entreprises. Bien qu’elles ne disposent pas toujours de leviers d’action efficaces pour agir, les pouvoirs publics les contraignent à négocier sur certains thèmes pour résorber les inégalités. L’employeur responsable ne peut ignorer cette métamorphose du concept de discrimination. Il doit déterminer les nouvelles frontières de ce risque afin de mettre en oeuvre les dispositifs adéquats pour faire obstacle à sa réalisation.

Managing a company incurs a risk of discrimination for the employer. In its original meaning, the notion of discrimination refers to distinctions based on an illegal criterion. To be effective, the prohibition of discriminations brings the judge to require that the employer give pertinent justifications of his/her decisions. The company is compelled to develop means of assessing in an objective manner employees’ professional skills. Beyond this initial objective, the fight against discriminations must now ease the integration of disadvantaged populations. The notions of equal access to employment, diversity, affirmative action and indirect discrimination are now part of companies’ vocabulary. Though companies do not always have effective leverage for action, public authorities force them to negotiate on certain subjects in order to reduce inequalities. A responsible employer cannot ignore this radical change in the concept of discrimination. He/she must now setthe new boundaries to this risk so as to implement adequate means to prevent its materializing.

L’éducation et la formation sont des institutions centrales de notre société. Garantes de l’intégration sociale et professionnelle des individus, elles ont aussi été érigées en piliers stratégiques du dynamisme économique dans la « société de la connaissance » (CE, 2000). Pour autant, bien que porteuses des valeurs démocratiques, elles sont le lieu d’observation de nombreuses inégalités, tant en formation initiale que professionnelle. Dans un contexte de précarisation du marché du travail, où le diplôme est nécessaire mais ne semble plus suffire pour assurer une intégration professionnelle stable, l’essor des Massive Open Online Course (MOOC) questionne. À partir d’une enquête mixte longitudinale, cette recherche s’est attachée à répondre à la problématique générale suivante : dans quelle mesure l’égalité formelle d’accès aux MOOC se traduit-elle par une égalité des chances pour les individus de les utiliser, d’y réussir et d’en tirer des bénéfices (objectifs et subjectifs) ? Cette étude des usages sociaux des MOOC et de leurs effets dans les trajectoires individuelles a été réalisée à partir de l’analyse de 5709 réponses d’inscrits au sein de 12 MOOC de France Université Numérique (FUN), réinterrogés un an plus tard (n=1778), et de 32 entretiens. Arguant en faveur d’une reproduction sociale des inégalités d’accès, les résultats montrent que l’égalité formelle d’accès ne suffit pas à une appropriation par tous de ces ressources. Ces usages restent principalement le fait d’individus détenant un capital humain élevé, bénéficiant d’une « insertion professionnelle assurée » (Paugam, 2007[2000]), coutumiers de la formation professionnelle et ayant d’intenses pratiques culturelles. Plus qu’une nouvelle voie d’accès à la formation, les MOOC semblent constituer un moyen supplémentaire, nécessitant des prérequis implicites. Pour autant, la construction d’une typologie d’usage a permis de mettre au jour que les MOOC peuvent constituer, même pour ces derniers, une réelle opportunité de formation. Majoritairement saisis dans un rapport a priori désintéressé de loisirs culturels, ils sont aussi utilisés pour satisfaire des objectifs formatifs variés. Ces six registres d’usage sont par ailleurs plus faiblement déterminés. L’évaluation de la réussite, lorsque les critères de l’achèvement et de la certification sont pertinents, met en évidence, pour ces individus favorisés, une égalité des chances d’y parvenir. Bien que ces usages sociaux n’aient, à court terme, aucun effet objectivable sur les trajectoires socio-professionnelles, ils sont porteurs de bénéfices plus subjectifs. Selon les particularités et la temporalité des « parcours biographiques » (Bourdon, 2010), ils participent au développement des identités personnelles et professionnelles ainsi qu’à une amélioration du vécu de certaines transitions. Loin de concurrencer en France le rôle des diplômes dans les parcours sociaux, les MOOC semblent plutôt en constituer un nouveau halo et participer à l’avènement d’une ère du signalement tout au long de la vie.

▼ The analysis of energy detector systems is a well studied topic in the literature: numerous models have been derived describing the behaviour of single and multiple antenna architectures operating in a variety of radio environments. However, in many cases of interest, these models are not in a closed form and so their evaluation requires the use of numerical methods. In general, these are computationally expensive, which can cause difficulties in certain scenarios, such as in the optimisation of device parameters on low cost hardware. The problem becomes acute in situations where the signal to noise ratio is small and reliable detection is to be ensured or where the number of samples of the received signal is large. Furthermore, due to the analytic complexity of the models, further insight into the behaviour of various system parameters of interest is not readily apparent. In this thesis, an approximation based approach is taken towards the analysis of such systems. By focusing on the situations where exact analyses become complicated, and making a small number of astute simplifications to the underlying mathematical models, it is possible to derive novel, accurate and compact descriptions of system behaviour. Approximations are derived for the analysis of energy detectors with single and multiple antennae operating on additive white Gaussian noise (AWGN) and independent and identically distributed Rayleigh, Nakagami-m and Rice channels; in the multiple antenna case, approximations are derived for systems with maximal ratio combiner (MRC), equal gain combiner (EGC) and square law combiner (SLC) diversity. In each case, error bounds are derived describing the maximum error resulting from the use of the approximations. In addition, it is demonstrated that the derived approximations require fewer computations of simple functions than any of the exact models available in the literature. Consequently, the regions of applicability of the approximations directly complement the regions of applicability of the available exact models. Further novel approximations for other system parameters of interest, such as sample complexity, minimum detectable signal to noise ratio and diversity gain, are also derived. In the course of the analysis, a novel theorem describing the convergence of the chi square, noncentral chi square and gamma distributions towards the normal distribution is derived. The theorem describes a tight upper bound on the error resulting from the application of the central limit theorem to random variables of the aforementioned distributions and gives a much better description of the resulting error than existing Berry-Esseen type bounds. A second novel theorem, providing an upper bound on the maximum error resulting from the use of the central limit theorem to approximate the noncentral chi square distribution where the noncentrality parameter is a multiple of the number of degrees of freedom, is also derived. ▼ “Space, like language, is socially constructed; and like the syntax of language, the spatial arrangements of our buildings and communities reflect and reinforce the nature of gender, race, and class relations in society” (Weisman, 1992, p. 2). While institutions of higher education have granted physical access to African-American women over the last 150 years, their presence on American campuses has not been readily reflected in the physical design of the walls within which they learn. In examining the historical foundations of institutions of higher education, we cannot deny institutions consciously embed their values and basic assumptions within their physical manifestation (Bess & Dee, 2008). The architectural design of a campus reflects its history as well as its future aspirations (Markus & Cameron, 2002). In this way, the built educational environment has an important role in shaping and informing its community members of what education looks and feels like (Strange & Banning, 2001). The message of predominantly white institutions still remains founded in the voice and values of those in power. Therefore, in order for African-American women to succeed in the academy, they have adapted their racial and gender identities to fit the predominant culture (Fordham, 1993). However, the hidden and unspoken messages that reflect the historical, social, and cultural context of American societal discrimination based on race and gender still remain in the built educational environment. In order to center the voices, experiences, and perceptions of African-American women within a predominantly white community, this study uses a critical black feminist lens. In addition, through an interdisciplinary conceptual model founded on the tenets of equal access federal policy, semiotics, organizational cultural transmission, and inclusive excellence, this study seeks to explore the dynamic that occurs between the built educational environment and its AfricanAmerican female students. Utilizing the portraiture methodology, nine women participated in the study through cognitive tours, individual interviews, self-reflective journaling, and photo documentation. The findings of the study depict a portrait of African-American women’s ability to reclaim the built educational environment of their predominantly white institution by physically and psychologically walking on its red brick path. ▼ To ensure an educational opportunity for every child that passes through Americaâ s schoolhouse doors, it is imperative that non-heterosexual studentsâ educational needs are not ignored in the educational milieu (Zirkel, 2006). In the last decade or so, the desire of non-heterosexual students to organize Gay-Straight Alliance (GSA) clubs on high school campuses have been met with angst by school leaders (Duncan & Rogers, 2008). Despite the passage of the Equal Access Act (EAA) in 1984, school leaders have often denied non-heterosexual students the right to establish GSA clubs on campus, consequently resulting in these students utilizing the judicial system as the venue to assert their rights under the law (Essex, 2005). As it is imperative that educational leaders understand the legal rights of all students under their care, and make informed decisions in order to avoid costly litigation, this research focused on analyzing the Equal Access Act of 1984, federal case law, legal commentary, and historical documents, in order to track the developments of non-heterosexual studentsâ ability to utilize the EAA to establish GSA clubs in the public schools in the United States. The study employed a traditional legal research methodology as described by Alder (1993) and Russo (1993), relying on electronic data bases and traditional legal finding tools to carry out the research. From the resulting legislation, case law, scholarly commentary, and other relevant documents reviewed and analyzed, an accurate historical perspective on the EAA as it relates to the formation of GSA clubs was constructed. In addition, the significant themes that arose from the findings were synthesized in order to offer guidance to educational leaders and policymakers when facing requests from students to establish GSA clubs on school property. Recommendations for school leaders when considering such requests from students to form GSA clubs under the EAA are provided. Advisors/Committee Members: Magliaro, Susan G. ▼ Introduction: Vulnerable European Union citizens (vulnerable EU citizens) are those who come to Sweden from EU member states. In Sweden the term “vulnerable EU citizens” is associated with the word “beggars”, which in turn is associated with Roma people. By November 2015 the number of vulnerable EU citizens in Sweden was estimated to be 4 700. The majority of these were from Romania. Roma as citizens of an EU member state have the right to reside in EU countries in accordance with the EU’s freedom of movement rights concept for up to but no longer than three months. However, to obtain the right for residence after three months, proof of financial resources and health insurance are required. Lacking these resources, vulnerable EU citizens have subsequently lost their right for residence and therefore became undocumented. They often find themselves in the same situation as undocumented migrants from outside the EU, having poor health outcomes and limited access to health care. In my study I aim to explore access to health care for vulnerable EU citizens in Umeå, a city in eastern Sweden. Methods: A qualitative design methodology has been applied in this thesis. Those contacted for this study were; Doctors of the World, Health on Equal Terms, Staff for planning and control Västerbotten Region, University Hospital of Umeå and representatives of vulnerable EU citizens’ community from Romania in Umeå. Seven in-depth interviews were collected with professionals and volunteers from these organisation/institutions and members of vulnerable EU citizens’ community. Questions were asked about their experience and knowledge regarding access to health care for vulnerable EU citizens. Data was analyzed using qualitative content analysis. Results: Three main categories and one final theme were developed during data analysis. The first category “Difficult to access health care for vulnerable EU citizens in Sweden without European Health Insurance” elaborates the dependence of vulnerable EU citizens’ access to health care on having health insurance, specifically European Health Insurance and National Health Insurance. It also describes what kind of access to health care vulnerable EU citizens have in Sweden. The second category “Decision about how much access to health care provide for vulnerable EU citizens lies on medical personnel” discusses the situation of health care personnel when they treat vulnerable EU citizens in hospitals. The third category “Organisations, Doctors of the World and Health on Equal Terms, mediate connection between vulnerable EU citizens and hospitals, so they can have their right to health fulfilled” elaborates about the role the organisation plays when vulnerable EU citizens are in need of health care. ▼ In this thesis I aim to build a normative argument for equality of access to advantage at the global level, and motivate action conducive to the realization of this ideal. The normative argument is presented over the course of the first two chapters. In Chapter One I ask, ‘How should we conceive of distributive equality?’ Following G.A. Cohen, I argue that equality is best conceived as equality of access to advantage. I interpret this to require equal access to both ‘worldly autonomy’—a term I invoke to describe a certain basic threshold level of autonomy—and subjective preference satisfaction. In Chapter Two, I establish a justificatory basis for equality on a global scale. I argue that equality is justified at the global level on the basis of justice as reciprocity for the mutual provision of the global system of state-enforced borders, in which the participation of all people is equally necessary, and that makes possible a wide variety of institutional goods predominately enjoyed by people in rich developed countries. In Chapter Three, I take up the second aim of the thesis: to motivate action conducive to the realization of this global distributive ideal. I engage the concern that global equality is a poor ideal, demanding too much change in the attitudes and lifestyles of the well-off to motivate them to pursue it. I aim to show that, even if most people are not motivated to pursue global equality, there are alternative grounds for immediately feasible global reforms and redistributions likely to have greater motivational purchase on people’s sensibilities. Alternative grounds for redistribution and reform include reparative justice, cooperative justice, respect for basic human rights, and self-interest. Making these redistributions and reforms would not only be desirable from the perspective of the alternative grounds that explain them, but will have the further happy result of bringing the world closer to the global distributive ideal of equality of access to advantage. Plausibly, it will bring the world sufficiently close to this ideal that people will be motivated to pursue it for its own sake.

▼ Single Carrier Frequency Division Multiple Access (SC-FDMA) is a multiple access transmission scheme that has been adopted in the 4th generation 3GPP Long Term Evolution (LTE) of cellular systems. In fact, its relatively low peak-to-average power ratio (PAPR) makes it ideal for the uplink transmission where the transmit power efficiency is of paramount importance. Multiple access among users is made possible by assigning different users to different sets of non-overlapping subcarriers. With the current LTE specifications, if an SC-FDMA system is operating at its full capacity and a new user requests channel access, the system redistributes the subcarriers in such a way that it can accommodate all of the users. Having less subcarriers for transmission, every user has to increase its modulation order (for example from QPSK to 16QAM) in order to keep the same transmission rate. However, increasing the modulation order is not always possible in practice and may introduce considerable complexity to the system. The technique presented in this thesis report describes a new way of adding more users to an SC-FDMA system by assigning the same sets of subcarriers to different users. The main advantage of this technique is that it allows the system to accommodate more users than conventional SC-FDMA and this corresponds to increasing the spectral efficiency without requiring a higher modulation order or using more bandwidth. During this work, special attentions wee paid to the cases where two and three source signals are being transmitted on the same set of subcarriers, which leads respectively to doubling and tripling the spectral efficiency. Simulation results show that by using the proposed technique, it is possible to add more users to any SC-FDMA system without increasing the bandwidth or the modulation order while keeping the same performance in terms of bit error rate (BER) as the conventional SC-FDMA. This is realized by slightly increasing the energy per bit to noise power spectral density ratio (Eb/N0) at the transmitters.
