Le droit de l’environnement est un droit relativement jeune, dont la filiation naturelle à l’intérêt général en a fait l’affaire exclusive des pouvoirs publics. Mais aujourd’hui, alors que « toute personne a le devoir de prendre part à la préservation et à l’amélioration de l’environnement » (article 2 de la Charte de l’environnement), il ne saurait rester cantonné dans les bastions du droit public. La tendance contemporaine à la contractualisation du droit, traversant de nombreuses branches, touche le droit de l’environnement qui y puise les ressources de son déploiement. A cette fin, parler de « contractualisation du droit de l’environnement » recouvre deux réalités. C’est, d’abord, constater que le droit de l’environnement investit le contrat, qu’il s’agisse de diversifier son objet environnemental ou laisser y proliférer des obligations environnementales. La stratégie est simple. Le droit de l’environnement se place dans le contrat. Et le contrat, tel un « cheval de Troie », le fait pénétrer dans l’enceinte des relations interindividuelles. Vecteur de diffusion du droit de l’environnement, le contrat en devient un outil de gestion favorisant sa réception par les individus. C’est, ensuite, remarquer que le contrat agit sur le droit de l’environnement. Son action est, en premier lieu, créatrice de droit. A cet égard, la contractualisation recoupe, pour une part, l’hypothèse du droit négocié portant une dimension collective dans l’élaboration du droit et soulève, pour une autre part, la question débattue du potentiel normatif du contrat individuel, qui paraît pleinement se déployer en matière environnementale. L’action du contrat est, en second lieu, réformatrice. Une profonde mutation structurelle du droit de l’environnement est en effet à l’oeuvre, posant les fondations d’un ordre juridique environnemental, dont l’architecture glisse « de la pyramide au réseau ». Un tel changement de physionomie s’accompagnerait d’un changement de philosophie, vers un droit du développement durable. Mais c’est davantage au soutien d’un développement durable du droit de l’environnement que la dynamique de contractualisation trouvera sa pertinence. Dans le contrat et par le contrat, le droit de l’environnement prend de l’envergure : il rayonne et il s’impose, prêt à relever le défi de sa « modernisation ».

Environmental law is a relatively young law. Due to its natural filiation to public interest, it was exclusively governed by the public authorities. But today, while "everyone has the duty to participate in the conservation and in the improvement of the environment" (article 2 of the Charter for the environment), it could not remain quartered in the realm of public law. Le droit impose à l’immeuble une fonction de protection de la nature. Cette fonction se décline d’abord par l’accumulation des contraintes de protection sur l’immeuble lui-même, ou sur les activités qui peuvent y être exercées. Mais elle s’affirme pleinement avec l’essor de la notion de patrimoine commun. Car en imposant à l’immeuble de protéger les éléments du patrimoine commun naturel, le droit révèle sa part collective. Il comporte ainsi un domaine commun et un domaine individuel. Le premier, conservé par la communauté, a pour objet d’assurer la conservation de l’immeuble dans un état suffisant pour qu’il assure sa fonction de protection de la nature. Le second symbolise la part de l’immeuble dont l’usage est laissé au propriétaire, à charge pour lui de ne pas altérer le domaine commun.Affirmée par le droit, la fonction n’a de valeur que si elle est préservée. A l’étude, sa préservation présente un double effet. Il sera atténué lorsqu’il permet des exceptions à l’impératif de protection de la nature. Il sera intégral s’il ne s’en accommode pas. L’effet atténué est matérialisé par le régime de la compensation écologique. Outre qu’il n’est pas certain qu’une nature reconstituée est l’équivalent d’une nature originelle, le régime soulève des écueils temporels, que le statut juridique de l’immeuble de l’immeuble permet de lever. Si le dommage est accidentel, l’effet de la préservation de la fonction sera alors intégral. Sans conciliation possible, le droit sanctionne toute dégradation du domaine commun.

The law imposes a duty of nature protection on real estate property.The rise of the common heritage principle has bought this duty to the forefront; this has translated into an accumulation of protection constraints on the real estate (property) itself, but also on the activities which may be exercised within it.By imposing an obligation to protect the natural common heritage, the law demonstrates the common dimension of real estate property. Therefore it includes a common domain and a private domain.The first aims to maintain the real estate property in good and sufficient repair so that it can fulfill its nature protection duty.The second symbolizes the part of the real estate property whose use is left up to the owner, in which case it is up to him not to alter the common domain.However this duty is of no value if it isn’t guaranteed/protected. This thesis shows that this preservation has two different effects. The effect is attenuated when it allows exceptions to the nature protection imperative and it is full when it does not.The attenuated effect is materialized by the environmental compensation system. Apart from the fact that it is never certain that a restored environment is the equivalent of the original one, the system also raises issues concerning the length of the effect; issues that the legal status of real estate property help to clear. Le régime juridique relatif à la conservation de la biodiversité dans les zones maritimes internationales est actuellement au cœur des discussions entre États au sein des Nations Unies. En effet, la Convention des Nations Unies sur le droit de la mer, véritable «Constitution des océans», ne permet pas d’assurer une conservation effective de la biodiversité dans la Zone et en haute mer. En 1982, lorsqu’elle a été adoptée, la notion de «biodiversité» n’existait pas encore, la Convention s’y référant alors uniquement de manière indirecte. Certaines ressources comme les ressources génétiques marines ne sont ainsi pas couvertes par la Convention, de même que certaines activités, ou outils de protection tels que les aires marines protégées. De plus, la division des océans en différentes zones aux régimes juridiques distincts et fragmentés ne permet pas aux États de mettre en œuvre leurs obligations conventionnelles de manière efficace. L’adoption d’un nouvel accord de mise en œuvre de la Convention dans le cadre des Nations Unies pourrait permettre, dans une certaine mesure, de pallier ces diverses insuffisances. Cependant, l’issue des négociations reste encore incertaine. Finalement, il conviendra d’observer que seule une approche plus globale, fondée sur la reconnaissance de l’existence d’une obligation générale de conservation de la biodiversité dans les zones maritimes internationales, pourrait permettre de dépasser les limites inhérentes à une approche exclusivement spatiale de la conservation de la biodiversité dans des espaces communs à tous les États, aux régimes distincts voire opposés.

Marine biodiversity conservation beyond national jurisdiction is currently subject of discussions in the United Nations. Indeed, the United Nations Convention on the Law of the Sea, the «Constitution of the Oceans», is not sufficient to protect marine biodiversity efficiently, in the high seas and the Area. In 1982, the word «biodiversity» did not exist yet, so the Convention only refers to marine pollution or biological resources conservation or management. Some resources, as marine genetic resources, are not covered by the Convention, as well as certain activities or conservation and management tools like marine protected areas. The division of the oceans in different maritime zones, moreover, with distinct and fragmented legal regimes, does not allow States to accomplish their conventional obligations dealing with biodiversity conservation. The adoption of a new implementing agreement related to the United Nations Convention on the law of the sea and dealing with marine biodiversity conservation and sustainable use beyond national jurisdiction would clearly improve the cur-rent regime. However, such an agreement could turn not being enough toward this objective, and the achievement of the process of negotiation remains uncertain. ▼ The Canada-Colombia Free Trade Agreement (CCOFTA) came into force in August 2011 amidst concerns that the provisions protecting Canadian investment in Colombia could exacerbate the precarious human rights situation. The Agreement concerning Annual Reports on Human Rights and Free Trade between Canada and Colombia was negotiated to address such concerns by enshrining the first ever human rights impact assessment (HRIA) of a free trade and investment agreement (TIA) in an internationally binding instrument. This thesis builds on a growing body of international legal scholarship that has considered the duty of home states of private investors to regulate their activity in the host state so as to prevent them from causing or contributing to human rights and environmental harm. It examines state obligations found in human rights, environmental and general principles of international law to propose that while an obligation might exist for the home state to exercise unilateral regulation of its investors, in the presence of a TIA that could cause or enable private human rights or environmental harm, investor regulation through the TIA can be seen as duty for both the home and host states. In view of the absence of such regulation in the CCOFTA, this thesis will consider if the annual HRIA mechanism is an alternative for preventing human rights and environmental harm caused or enabled by the TIA. It is submitted that while HRIAs of TIAs are a novel concept for which little international practice exists, this mechanism has the capacity to provide concrete evidence of human rights or environmental harm caused or enabled by the TIA, but only if based on a methodological model that uses existing state international human rights law obligations as indicators to measure a change in the human rights situation, draws unequivocal causal links between the investment protection provisions and human rights indicators, and allows for broad public participation, especially from the most marginalized and underrepresented groups in the host state to validate its methodology and findings. While under international law all investment-exporting states might have a duty to conduct HRIA on the effects of a proposed TIA as part of the due diligence to prevent transnational harm, the enshrinement of such assessments in an internationally binding instrument triggers a duty for the home state to, on one hand use the HRIA mechanism to prevent transnational human rights or environmental harm and, on the other hand, structure its annual assessments according to the described model in order to give effect to the duty to prevent. Broad and inclusive participation of the local affected communities from the host state in the HRIA becomes an integral component of the home state duty to prevent that can be expected to reveal any negative effects on the human rights situation from the TIA provisions, as well as the type of action required from both states parties to address them.
