▼ This is a literature review article. The purpose of this article is to explain and provide a deeperunderstanding of economic and industrial espionage. Furthermore, it describes legal andillegal methods of espionage and highlights the different aspects of preventing espionage suchas; technical, operational, physical and personnel security. A number of theoretical conceptshave been extracted and analyzed from different scientific articles which have beensummarized and anticipated in the form of theoretical framework. Incredible results are oftenproduced by exploiting industrial espionage. By concentrating on complete security, and notsimply specialized security, data security experts can altogether hamper enemy endeavors totake their association's data resources.

▼ This dissertation includes three essays on players' incentives to acquire or share private information in competitive environments. In chapter 2, I study the role of one-sided private information in a two-player first-price all-pay auction where one player's valuation of prize is common knowledge while the other's is privately known. Then I study the incentives of spying in cases where spying (i) can be caught with an exogenous probability and (ii) can be fed false information after caught. I find that spying can be discouraged by increasing the chance of catching a spy, and spying may even be completely deterred when false information is fed back after catching a spy. In chapter 3, I study the incentives to form a quid pro quo information sharing agreement between ex ante symmetric players ahead of contests. I find that a limited-membership alliance, which includes a strict subset of all players, may arise even in the presence of small organization costs while an industry-wide sharing agreement may not. Such an alliance can strictly benefit alliance members, but may benefit or hurt the outsider. Even when the outsider is hurt, a Pareto improvement is possible if transfers can be arranged between alliance members and non-alliance members. In chapter 4, I extend the analysis of chapter 3 to a first-price auction. I find that a limited-membership information-sharing alliance can lead to Pareto improvements when players' private values take three discrete types. Furthermore, the player outside the alliance benefit strictly more than alliance players from the alliance.

▼ Les Etats s’espionnent depuis des siècles, soulevant des tensions. Toutefois, une régulation expresse ne peut être trouvée que dans le droit des conflits armés. Alors que les espions peuvent être capturés et punis, il est paradoxalement admis que leur envoi en temps de guerre n’est pas contraire au droit international. En revanche, aucune règle expresse ne vient réglementer l’espionnage en temps de paix. Une appréhension indirecte n’existe que par le biais de la souveraineté territoriale. En effet, en l’absence de son consentement, l’envoi d’un agent sur le sol d’un territoire étranger est illégal. Cela fait écho à la position ambivalente des Etats sur la scène internationale, qui ont toujours envoyé des espions en territoire étranger. Quand ces agents sont capturés, l’Etat peut les punir conformément à sa législation pénale, protester ou les échanger. Toutefois, l’applicabilité de ce cadre juridique est remise en question par l’émergence du cyber-espionnage, dans la mesure où la présence physique d’un agent n’est plus requise. Le fil d’Ariane de cette thèse est donc de savoir si la dématérialisation et la déterritorialisation de l’espionnage prévient l’application des règles de droit international au cyber-espionnage.La doctrine a tenté de faire face à ce manque de régulation expresse et ces changements. Les auteurs ont habituellement proposé d’appliquer les traités existants, d’examiner la légalité du cyber-espionnage à la lumière des règles de souveraineté et de non-intervention, ou essaient d’identifier de nouvelles règles coutumières. Toutefois, cette thèse perçoit de nombreux problèmes dans cette démarche. En effet, seules de rares références sont faites aux règles d’interprétation contenues dans la Convention de Vienne sur le Droit des Traités, les conclusions de la Commission de Droit International (CDI) sur l’identification du droit international coutumier, ainsi qu’à la pratique étatique. De plus, de nombreuses analogies reposent sur la supposition erronée que le territoire et le cyberespace sont similaires.Huit instruments sont analysés dans cette thèse. Afin de déterminer ce qu’ils ont à dire au sujet du cyber-espionnage, cette recherche propose de recourir aux règles officielles d’interprétation contenue dans la Convention de Vienne, les conclusions de la CDI, et d’incorporer le montant maximum de pratique étatique. Cette thèse conclut finalement que le cyber-espionnage ne viole pas les règles de souveraineté, de non-intervention, la Charte des Nations Unies, l’Accord sur les aspects des droits de propriété intellectuelle qui touchent au commerce et la Constitution de l’Union Internationale des Télécommunications. Elle révèle également que la plupart des règles applicables en temps de guerre sont inapplicables, et que ni l’espionnage ni le cyber-espionnage ne sont interdits par le droit international coutumier. Seule la surveillance des archives et documents digitaux, ainsi que la correspondance électronique et vocale violent la Convention de Vienne sur les Relations Diplomatiques.

▼ The current PhD Dissertation belongs generally to the field of international relations and strategic studies - which consists a branch of political sciences - and especially to the sub-field of intelligence. The main goal of this dissertation is the detailed examination of the phenomenon of economic espionage under the prism of international relations theory. This dissertation uses empirical data concerning a specific state action (economic espionage) in order to assess the validity of the basic assumptions of the two key theories of international relations. Political Realism/Neorealism and Liberalism/Neoliberalism. The main research question is to identify the theoretical conclusions resulting from the study of economic espionage. In order to answer the main question we select the case studies of the U.S.A. the former Soviet Union/Russia, Japan and France. Because of the importance of the end of the Cold War for the structure of the international system it is extremely important to study the phenomenon of economic espionage, both during the Cold War and during the post Cold War era. The main conclusions of this dissertation are the following: • In a globalized international system characterized by rapid economic and technological advancement it is vital for a nation state to conduct economic espionage in all its dimensions in order not to fall behind economically and technologically, something which will affect negatively its power in relation with other nation states • In a world characterized by economic and technological advancement economic espionage is a widespread state action. Because of the dual use character of technology economic espionage affects both economic and military security • The study of economic espionage certifies and supports the assumptions of Political Realism/Neorealism, while proves the weakness of the Liberal/Neoliberal approach in the field of economy and technology where theoretically, the case of Liberalism/Neoliberalism is strong.
Η παρούσα διδακτορική διατριβή εντάσσεται γενικότερα στον τομέα των διεθνών σχέσεων και των στρατηγικών σπουδών - ο οποίος αποτελεί κλάδο των πολιτικών επιστημών - και ειδικότερα στον υπό τομέα της πληροφόρησης. Σκοπός της διατριβής είναι η ενδελεχής εξέταση του φαινομένου της οικονομικής κατασκοπείας υπό το πρίσμα της θεωρίας των Διεθνών Σχέσεων. Η διατριβή χρησιμοποιεί εμπειρικά στοιχεία σχετικά με μια κρατική συμπεριφορά (οικονομική κατασκοπεία) με σκοπό την αποτίμηση των βασικών υποθέσεων των δύο σημαντικότερων θεωριών των διεθνών σχέσεων του Πολιτικού Ρεαλισμού/Νέο-ρεαλισμού και του Φιλελευθερισμού/Νεοφιλελευθερισμού. economic analysis of trade secrets via data collected from prosecutions under the U.S.
Economic Espionage Act (EEA.) Ratified in 1996, the EEA increases protection for trade secrets by criminalizing the theft of trade secrets. The empirical basis of the thesis is a unique database constructed using EEA prosecutions from 1996 to 2008. A critical and empirical analysis of these cases provides insight into the use of trade secrets.
The increase in the criminal culpability of trade secret theft has important impacts on the use of trade secrets and the incentives for would-be thieves. A statistical analysis of the EEA data suggest that trade secrets are used primarily in manufacturing and construction. A cluster analysis suggests three broad categories of EEA cases based on the type of trade secret and the sector of the owner. A series of illustrative case studies demonstrates these clusters.
A critical analysis of the damages valuations methods in trade secrets cases demonstrates the highly variable estimates of trade secrets. Given the criminal context of EEA cases, these valuation methods play an important role in sentencing and affect the incentives of the owners of trade secrets. The analysis of the lognormal distribution of the observed values is furthered by a statistical analysis of the EEA valuations, which suggests that the methods can result in very different estimates for the same trade secret.
A regression analysis examines the determinants of trade secret intensity at the firm level. This econometric analysis suggests that trade secret intensity is negatively related to firm size. Collectively, this thesis presents an empirical analysis of trade secrets.
