▼ ENGLISH ABSTRACT: This thesis offers a descriptive study of the empirical customs issues that are required to reform the Eritrean Customs Administration towards its alignment to the global situation. The first chapter as a general introduction encompasses the background, the research premise and the methodology adopted. The second chapter discusses public service reform by putting emphasis on institutional and regulatory reform as framework of analysis. The intention is to review the generic characteristics of public service reform as macro-environment of customs administration in order to analyze the attributes of the general context shared by customs as a public service. Considering customs as a component of the broader environment of public service, the third chapter of the thesis focuses on the contemporary body of knowledge of customs administration that serves as a conceptual framework and micro-analysis of customs. In this section, the core issues and priorities of customs' service modernisation are highlighted; customs' best practices, standards and procedures as seen from the perspective ofthe new challenges of globalisation are also reviewed. From these reviews chapter three underlies two basic facts. First it is justified that raising customs' operation to a uniform, high standard procedure and achieving excellence in the customs service is a prerequisite for trade and tourism in general and promoting export in particular. Second, investment decisions will be made on the basis of a country's ability to provide an environment that is conducive to maintain a reliable, low-cost flow of goods and components with minimal trade barriers. Furthermore, the international trade, social and economic environments are in fact changing. World economies and communities are becoming more reliant on cooperation, partnerships, understanding and harmonisation. Factors such as growth in trade volume and tourism, trade liberalisation and investment, falling transport and communications costs and increasing international competition are driving customs administrations world-wide to change their traditional procedures. More importantly, customs administrations are expected to manage ever-increasing complexities and levels of transactions with static or ever-decreasing resources. Similarly, customs are requested to strike and maintain the right balance between control and facilitation. Hence, this thesis builds on the premise that Eritrea should align its customs administration to the global situation as an essential institution of national and international policy by reforming and modernising its management methods and operational procedures. Darbo tikslas – nustatyti mokesčių administravimo muitinėje teisinio reglamentavimo poveikį muitinės administruojamų mokesčių surinkimui, nustatyti ir išanalizuoti aktualiausias mokesčių administravimo muitinėje problemas ir surasti tų problemų sprendimo būdus. Lietuvos muitinė yra atsakinga už jos kompetencijai priklausančių mokesčių – muitų, akcizų ir pridėtinės vertės mokesčio teisingą apskaičiavimą, įregistravimą, apskaitymą, surinkimą, kontrolę ir pervedimą į Valstybės iždą. Muitinei pavesta išskirtinė funkcija – užtikrinti, kad būtų laikomasi tarptautinę prekybą reglamentuojančių įstatymų ir kitų teisės aktų, bei surinkti nustatytus importo ir eksporto muitus ir mokesčius, efektyviai taikant muitinės priežiūros priemones. Muitinės administruojamų mokesčių, jų įregistravimo, surinkimo ir išieškojimo teisinis reglamentavimas yra sudėtingas procesas ir mažai nagrinėtas teisinėje literatūroje. Darbe analizuojamos mokesčių funkcijos ir reikšmė, mokesčių administravimo samprata ir principai, nustatytas jų įtvirtinimas teis��s normomis, atskleisti ir išnagrinėti svarbiausi mokesčių administravimo muitinėje teisinio reglamentavimo pokyčiai Lietuvai įstojus į ES, jų įtaka mokesčių surinkimui ir išieškojimui, bei muitinės indėliui į valstybės biudžetą. Taip pat atliktas muitinės administruojamų mokesčių statistinis tyrimas, nustatytos ir aiškinamos mokesčių pokyčių priežastys teisiniu aspektu. The purpose of this work is to assess the influence of legal regulation of tax administration in customs on collection of taxes administered by customs, to determine and analyze the most relevant problems of tax administration in customs and to find solutions of these problems. Lithuanian customs is responsible for correct calculation, registration, accounting, collecting, control of taxes, which are in its competence, i.e., custom duties, excise duties and value added tax. It is also responsible for transferring these taxes into the Treasury. Customs is assign with special function, i.e., to ensure that there is observed the law and other legislation, which finetune international trade, and to collect fixed import and export duties and levies, while effectively practicing customs maintenance aids. Legal regulation of taxes’ that are administered by customs registration, collection and ingathering is complex process and it is poorly analyzed in legal literature. In this work there is analyzed taxes’ function and significance, the conception and principles of tax administration, there is determined its assessment by legal norms, there is disclosed and analyzed the most important changes of legal regulation of tax administration in customs that occur after Lithuania joined EU, its influence on taxes collection and ingathering and on customs’ contribution to state budget. ▼ Ever since the establishment of the Chinese Imperial Maritime Customs (CIMC) in Shanghai in 1853, the CIMC had operated different foreign-controlled custom stations at treaty ports which existed alongside the native customs and Likin stations controlled by the Qing government at non-treaty ports. Foreign steamships and Chinese junks were under the jurisdiction of the foreign and native customs respectively. This created the norm of a dual maritime customs system in China in the late Qing period, when foreign economic influences penetrated almost every sector of the Chinese economy. By adding in the context of high imperialism in China, this dissertation studies both competitive and co-operative interaction between different players in the maritime affairs of Hong Kong and Guangdong province during the turning points of the opening of the West River in 1897 and the signing of the Mackay Treaty in 1902. Through case studies of foreign-flagged Chinese junks, inland steam navigation and piracy on the West River, this dissertation provides concrete insights into daily dealings between Chinese and foreigners in the scattered streams and creeks of the Canton River and the West River deltas, and the native-foreign water borderline near Hong Kong. This demonstrates the importance of the customs system in China, which affected both Chinese and foreign patterns of shipping, with only vessels of a hybrid character, namely foreign-flagged Chinese junks and Chinese steam tugs, being able to win in the competition for coastal and inland river trade with Chinese junks and foreign steamers possessing only a single identity. Since there are no records of private Chinese junks and Chinese steam tugs that survive today, by chiefly analysing the unpublished and under-researched correspondence of the Kowloon Customs during the period under review, this dissertation fills a research gap in maritime history that demonstrates the evolving development of Chinese shipping, from Chinese junks to Chinese steam tugs, in Southern China during the last decade of the Qing dynasty. ▼ Canada Customs is currently faced with problems of overcrowding. This situation causes lost revenue and potential control problems, and detracts from its public image. Customs administration is interested in determining what changes, if any, can be made to help alleviate the problem. The goal of this paper is to analyze several alternatives which are available to customs officials, and to recommend changes which can be implemented to improve the current situation. To achieve this goal, several applications of Management Science methods were performed. The first application involved a cost-benefit analysis of the Peace Arch Crossing Entry (PACE) Project. It was found that the PACE project has positive net benefits of approximately $9.5 million provided that it is supported by sufficient staff levels. Results of the cost-benefit analysis also indicate that the social benefits of having an extra staff member available far outweigh the costs involved. In the second application performed, multiple regression techniques were used to analyze various characteristics of travellers which affect service time within the customs office. As a result, it is recommended that customs officials look into the possibility of keeping certain groups of individuals (whose processing times are relatively low) separate from the main flow of travellers, in order to save these travellers a great deal of time. In the third application, simulation and animation were used to replicate the current situation in the Pacific Highway Customs Office. Experiments were then conducted to determine the optimal mix of regular terminals and Self Declaration System (SDS) terminals. It was found that implementing SDS was not as efficient as adding a new regular terminal. It is recommended that a study be conducted to determine by how much the times for SDS can be reduced. If significant reductions in time are not possible, it may be in the best interest of all concerned to revert the SDS terminals to regular terminals.

Resumo: A Aduana (ou alfândega) é um elo da cadeia internacional de suprimentos com a função de controlar a entrada e a saída de mercadorias de um país. A transposição de mercadorias pelas fronteiras está diretamente relacionada aos processos aduaneiros. Medidas de facilitação comercial objetivam tornar o controle da Aduana mais simplificado e efetivo, tornando a cadeia de suprimentos mais fluida e segura. Iniciativas como a utilização de laudos de imagens dos escâneres de raio-X, os programas de facilitação comercial, como o Despacho Aduaneiro Expresso (Linha Azul), e metas de desempenho para servidores aduaneiros podem ser citadas como medidas de facilitação comercial. O objetivo desta pesquisa é analisar o impacto dessas medidas de facilitação comercial na Aduana brasileira, em relação aos diversos tempos que impactam o fluxo de importação. Não existem estudos nas literaturas científica e profissional que analisem quantitativamente os impactos dessas medidas de facilitação comercial no Brasil. Caracterizada pelo método de pesquisa explicativa de natureza experimental, por meio da ferramenta de simulação de eventos discretos, foi desenvolvido um Projeto de Experimentos Fatorial 2^k Completo. O objeto do estudo experimental foi aplicado no fluxo de importação aérea no Aeroporto Internacional de Viracopos, Campinas. Os dados utilizados são originários dos sistemas TECAPLUS e MANTRA e de entrevistas com experts. Durante o desenvolvimento da pesquisa, diversos especialistas da área de comércio exterior estiveram envolvidos, desde a formulação do problema à validação do modelo computacional. Os resultados obtidos nas rodadas de simulação indicam uma melhoria progressiva do sistema simulado em todos os indicadores de desempenho entre o status quo e o cenário de melhor performance. A análise de contrastes dos fatores indica que: o aumento de empresas habilitadas em programas de facilitação comercial (Linha Azul) diminui o tempo médio geral de desembaraço aduaneiro; a utilização de laudos de imagens dos escâneres de raio-X melhora o desempenho de todos os indicadores relacionados à previsibilidade e ao tempo de desembaraço das empresas habilitadas no Despacho Aduaneiro Expresso; e, metas de desempenho para auditores-fiscais da Receita Federal contribui para o aumento da previsibilidade do sistema. A temática patente no presente estudo é definida em diversas partes de modo a obter-se uma visão sobre a REFORMA DA ADMINISTRAÇÃO PÚBLICA EM ANGOLA, especificamente O CASO DO SECTOR DA JUSTIÇA, sobretudo na questão que tem a ver com as alterações legislativas decorridas período entre 1992 e 2012. No capítulo I falámos da Contextualização de ANGOLA e da evolução do Sistema Constitucional. No Capítulo II fez-se uma retrospetiva histórica e aprofundou-se a matéria do Capítulo anterior. No capítulo III falámos em particular do Sistema de Justiça. No Capitulo IV elaborámos um levantamento sobre a abordagem metodológica empregue. A culminar elaborou-se uma conclusão que vai no sentido do ponto de vista de Guilhermina Prata, ex-ministra da Justiça da República de Angola (Luanda, 2012), conforme a citação seguinte: «São conhecidos por todos os diagnósticos feitos às vetustas leis do sistema judicial angolano, desajustadas à nova realidade e as críticas às práticas burocráticas de diversos serviços da justiça em Angola que contribuem para a existência ainda de uma cultura de desconfiança do cidadão».

The patent issue in this study is defined in several parts in order to obtain in detail the progress of PUBLIC ADMINISTRATION REFORM, specifically IN THE JUSTICE SECTOR, in their theme of law`s changes during the period between 1992 and 2012. In chapter I we spoke of Context ANGOLA and evolution of the Constitutional System. In Chapter II has become a historical retrospective and deepened the subject of the previous Chapter. In Chapter III we spoke in particular of the Justice System. In Chapter IV produced a survey of the methodological approach employed. The culmination was elaborated a conclusion that goes towards Guilhermina Prata, former Minister of Justice of the Republic of Angola (Luanda, 2012), taking the following quote: "They are known for all diagnoses made at age-old laws of the Angolan judicial system, inadequate to the new reality and criticism of bureaucratic practices of various departments of justice in Angola which contribute to the further existence of a culture of distrust of the citizen."

▼ This paper critically analyses the use of anti-dumping regulation in the Southern African Customs Union (SACU) with specific reference to Botswana. Dumping takes place where products are introduced into the commerce of another country at less than its normal value, if the export price of the product exported from one country to another is less than the comparable price, in the ordinary course of trade, for the like product when destined for consumption in the exporting country. Anti-dumping duties are an internationally-recognised exception to three core WTO principles namely, bound tariff commitments, most-favoured-nation MFN) and national treatment. The use of anti-dumping in SACU has always been in accordance with existing WTO rules. The new SACU Agreement has important implications for the anti-dumping regime within the customs union. It changed the way in which tariff decisions, including anti-dumping tariffs, are made and it also requires member states to develop legislation on contingency trade remedies such as anti-dumping for the region and to establish national bodies to administer these remedies within different countries. The SACU council has given mandate to the International Trade Administration Commission of South Africa (ITAC) to undertake all trade remedies investigations and imposition of the necessary duties. From the inception of ITAC till now ninety-five percent (95%) of all anti-dumping applications filed at ITAC alleging dumping are instituted by South Africa industries. Thus, only five percent (5%) of all anti-dumping applications are from Botswana, Lesotho, Namibia and Swaziland (BLNS countries). The findings in this paper reveal that Botswana has never filed an application seeking protection of any of its industries. In terms of Article 14 of the SACU Agreement Botswana is in the process of establishing its national body like ITAC. The argument is that, since Botswana has never filed for any trade remedy how effective will this national body going to be? Therefore, critically analyzing the use of anti-dumping regulation is very crucial for Botswana as a SACU member. Such analysis will help assess the effectiveness of SACU institutions such as the tariff board and the Botswana national body to be established. ▼ In modern times customs services are the institutions entrusted with monitoring trade through collecting duties on imports and exports, preventing smuggling and patrolling national boundaries. The Chinese Maritime Customs Service of the Republic was imbued with many of these modern ideas. The Service maintained an extensive network of Customs houses both along China's coastline and inland. It maintained harbours and lighthouses and also established a preventive service to counteract smuggling. The comparisons, however, end here. The Chinese Maritime Customs Service was a uniquely cosmopolitan institution that emerged as a product of the Opium Wars and the Unequal Treaties. Headed by successive British Inspectors General, Sir Robert Hart (1863-1911), Sir Francis Aglen (1911-1927) and Sir Frederick Maze (1929-1943), the Service recruited foreigners to administer the Customs establishments. This dissertation examines the fate of the Customs foreign Inspectorate during the 1923-1937 period. By examining episodes such as the Canton Customs controversy of 1923; the Canton-Hong Kong Boycott 1925-1926; the Customs succession crisis; negotiations surrounding the proposed Hong Kong-China Trade and Customs Agreement 1929-30; the seizure of the Tientsin Customs 1930; and the loss of Customs houses in the northeast to Manchukuo authorities in 1923-1933, the themes of resistance and change are brought to the fore. The foreign administration of the Service encountered growing resistance on the part of the Chinese nationalists and it also faced resistance from the British establishment in China who no longer perceived the Service as an ongoing concern. To ensure its survival the Service had to change and in doing so embrace the Nationalist regime. Although during this period the significance of Customs revenue to the Chinese government and. to foreign investors was unsurpassed, the Service itself was undergoing a steady decline as it was pulled deeper into the machinations of China's political sphere without a British anchor for security. ▼ The last decade saw the rise of e-commerce trade and the shift of the manufacturing industry to the emerging economies, China first of all. In this context, the European Customs Authorities experienced an explosion of small parcels coming from e-commerce websites, often from China, and faced difficulties to detect fiscal frauds and security threats using their conventional risk management systems. To address this problem, the European project PROFILE brings together the customs administrations of Netherlands, Belgium, Sweden, Norway, and Estonia, aiming to provide the EU with a shared platform for: (1) accurately assessing customs risks; (2) optimizing operation and logistics by integrating multiple sources of information; (3) developing a shared data platform to share customs risk management (CRM) practices. As part of this project, the Dutch Customs Administration (DCA) and International Business Machines (IBM) Corporation are collaborating to deploy the cutting-edge technologies of artificial intelligence to automatically cross-check the customs declarations coming from Chinese e- commerce against online information. Through a Design Science approach, I carried out this research for the Delft University of Technology, written in collaboration with IBM Netherlands, aiming to deliver a preparatory study for the developing team before the PROFILE project begins. This includes knowledge brokering between the Dutch Customs Administration and IBM Netherlands so that a more precise problem scope can be defined, and the requirements elicited. In particular, this research focuses on the first part of the project: the development of an adaptive web-crawler for e-commerce, able to compare the declarations documents against online information. According to the Dutch Customs Administration, the web-crawling system should gather the description of the goods from declarations, search the product on the web, find its price of sale on the e-commerce platforms, compare it with the value declared in the declaration, and return a risk indicator of green/red flag to the targeting officer. The design process of this system follows approaches coming from the systems engineering discipline, starting with the requirement analysis, addressing them with the state-of-the-art big data analytics, and finally deriving the logical components of the system, whose design is presented through a logical architecture. First, the application domain is investigated. When goods entry the Netherlands need an entry declaration. These goods arrive at the harbor of Rotterdam or airport of Schiphol, where some of these are imported into the country and become import/export, and others stop temporarily as transit waiting to be shipped somewhere else. The Dutch Customs Administration monitors these processes through risk management systems aiming to stop non-compliant goods. This research describes these practices, with a higher focus on the e-commerce risk targeting. ▼ The value and applicability of western management theories and practices to the developing world is rarely discussed within the current rush to globalise the world economies, capture untapped wealth and seek to establish businesses within indigenous societies. This is especially relevant to the use of Voice of the Customer (VOC) methods and tools when applied to indigenous peoples and service organisations, where customer information is used to design or improve services. There has been limited concentration and much debate as to whether VOC tools are as effective as anticipated, and can solve the unique problems that appear when used in unfamiliar diverse cultures in developing countries. A risk when using a particular method or management technique is the desire and expectation that it will be transferable for use in similar businesses in other countries. Service quality is reliant on what the customer feels and often cannot be measured easily. This can be compounded in a developing nation scenario, by the fact that methods are usually developed, implemented, interpreted and validated through a western ‘lens’. Armstrong and Pont et al (2011, page 6 -7) describe these issues succinctly when they state… ‘a survey of the leading academic journals suggest that well over 90% of the articles published are concerned with establishing basic causality behind certain phenomena. Very few studies investigate whether a certain method used by management is effective or not …. as practitioners we are more interested in what works than the intricacies of causality’. This research specifically explored the use of VOC tools in the Bougainville Village Court (VC) to identify service elements customers considered important to the functioning of the VC in their village communities. Tools that were used included quantitative measurement tools - a combined Garvin–SERVQUAL tool, the RATER model, and Quality Function Deployment (QFD) principles, and the more qualitative New Zealand Business Excellence Criteria (NZBEC). The research demonstrated that the quantitative VOC methods used did not fully fit, or account for some service elements important to the customer in this particular context, where societal trust and continuous contact are important service elements. The methods used were thus, unable to completely capture the full humanistic elements and contributing causal factors. In this research study cultural context in the form of history, environment, tradition, community relationships and structures, played a vital role in determining what the customer considered were important service elements. It was found that these elements were more easily captured through use of the more qualitative NZBEC as it enabled collection of more diverse perspectives through its open question structure. Generic VOC ‘western developed’ quantitative tools did gather VOC information. However, they were only effective after adaptation to each VC location and after cultural input. Dissertação para obtenção do Grau de Mestre em Auditoria Orientação científica do Professor Coordenador Rodrigo Mário Oliveira Carvalho

O combate à fraude e evasão fiscais revela-se uma obrigação do Estado, por uma questão de justiça mas também de sobrevivência. Esse combate será realizado fundamentalmente pela Direção Geral dos Impostos (DGCI), atual Autoridade Tributária e Aduaneira (AT), por via da sua missão de arrecadar impostos. Esse combate é necessariamente concretizado em parceria com o legislador, através não só de uma melhor educação fiscal, mas também através de uma eficaz ação penal. O objetivo do presente estudo é a análise da fraude e evasão fiscais, quanto à sua natureza, aos meios para o seu combate, avaliando particularmente os resultados quantitativos obtidos por parte da DGCI/AT e tornados públicos. Desta forma pretende avaliar-se de que forma têm sido executadas as metodologias suportadas na legalidade, mas também as metodologias internas apoiadas nos sistemas de informação. Esta avaliação resultará no insucesso ou sucesso na atuação da DGCI/AT. Pretende-se, também, tendo por base os resultados obtidos e as metodologias preconizadas para o futuro próximo, avaliar quais as mais fraturantes e as que poderão ter mais sucesso neste combate. Para a concretização do presente estudo usou-se o método dedutivo para concluir sobre o sucesso ou insucesso da atuação da DGCI/AT, analisando os indicadores de divulgação pública geralmente aceites, tanto internos como externos. Em função desses resultados, através do método indutivo e dialético procedeu-se a propostas legislativas, mas também metodológicas a adotar pela Administração Pública, acrescentando ou reforçando as atuais propostas. Concluiu-se que a fraude e evasão fiscais conduzem a uma diminuição das receitas fiscais de tal forma que constitui um obstáculo à evolução do país. A economia não registada em Portugal tem vindo a adquirir maior representatividade no total da economia nacional, atingindo perto de 25% do PIB em 2010. Também ficou evidente que a DGCI/AT tem vindo a implementar medidas eficazes no combate à fraude e evasão fiscais, suportadas na legalidade. Ficou também evidente a existência de resultados elevados nos indicadores reveladores que grande parte do trabalho de otimização de processos já se encontra realizado. O trabalho realizado pela DGCI/AT é fundamental neste combate, mas não será único, e só poderá ter sucesso se devidamente sustentado numa legislação robusta, numa educação fiscal ainda precoce e numa ação penal eficaz. Interessa que se continue a realizar o trabalho até agora efetuado, perseverar no aumento da eficácia e eficiência até agora evidenciadas, eventualmente intensificar as medidas massificadoras apoiadas nos sistemas de informação. Concluiu-se também que se mostram necessárias alterações legislativas que resultarão num recuo face ao atual regime de presunção da verdade declarativa, mas também no alargamento da base tributável. I problemdiskussionen lyfts att litteraturen och forskningen utgår från att en controller är en ekonom som arbetar med ekonomistyrning. Enligt min erfarenhet stämmer inte detta för verksamhetscontrollers i statliga myndigheter. Syftet med uppsatsen är att öka kunskapen om rollen som verksamhetscontroller i statliga myndigheter. Forskningsfrågorna är vilka krav ställer myndigheterna vid rekrytering av verksamhetscontrollers och hur beskriver de arbetsuppgifterna? Vad innehåller tertialuppföljningarna? Metoden har varit att genom en diskursanalys studera innehållet i tertialuppföljning på Socialstyrelsen, Statens institutionsstyrelse och Tullverket. Dessutom har myndigheternas rekryteringsannonser som avser verksamhetscontroller analyserats. Slutsatsen är att arbetsuppgifterna för verksamhetcontrollers på myndighetsnivå är likartade och det ingår inte ekonomiska arbetsuppgifter. De förefaller dock ha olika mandat. Arbetsuppgifterna på avdelnings-/ kompetenscenternivå skiljer sig mellan och inom myndigheterna och inte heller dessa verksamhetscontrollers har ekonomiska arbetsuppgifter. Kraven som ställs på utbildning och erfarenhet har stor spännvidd och ibland har man krav på att den sökande ska ha ekonomisk bakgrund. Min slutsats är att rollen som verksamhetscontroller på avdelnings-/ kompetenscenternivå är under utveckling och att rollen på myndighetsnivå är tydligare.

In literature and research the definition of a controller is an economist working with financial control. According to my knowledge this is not correct for controllers focused on operations management in government agencies The purpose of this thesis is to increase the knowledge of the role as a controller focused on operations management in state agencies. The questions to be answered are what demands does government agencies have when they recruit operations management controllers and how do they describe the assignments? What is included in the four month follow ups? The method has been by discourse analysis study the content in the four month follow ups at the National Board of Health and Welfare, the National Board of Institutional Care and the Swedish Customs. In the thesis the agencies recruitment ads for controllers focused on operations management is also analyzed. The conclusion is that the assignments for controllers focused on operational management on the agency-wide level is similar between the agencies and few financial assignments are included. The assignments for the lower levels differ within and between the agencies and financial assignment are not included. The controllers at the agency-wide level seem to have different mandates between the agencies. The agencies demands for education and experience varies widely and some of the ads have demands for a background in finances. My conclusion is that the controller at the department level is under development and the role at the agency-wide level is more distinct.

▼ Village courts are the lowest ranked courts in Papua New Guinea's legal hierarchy with jurisdiction over civil disputes and minor criminal offences as defined both by the laws of the State and customs of the people. The workings of village courts is controversial in both popular and academic discourse. in these critiques they are either praised or blamed for being "too customary", "too legal", or for being hybrid. The dualisms of society and individual, symbolic and material that are embedded in these accounts enable a cross-cultural generalisation that equates 'law' and 'custom' as mechanisms of "social control". I identify two forms of this foundationist critique: universalist and relativist. In developing a way of going beyond foundationist critique I elaborate a connection between the 'performative' approach used in science and technology studies by John Law and Bruno Latour, and the anthropological work of Marilyn Strathern and Helen Verran. I articulate a relational approach to generalisation in the context of critiquing the workings of Village Courts. I understand this relational approach as enabling a postcolonial form of critique. I argue that a postcolonial generalisation requires a way of seeing the micro/macro relation that does not rely on abstraction and objectification. As such, postcolonial generalisations require an ontology of figured relations, and an epistemology of specificities. This alternative non-foundationist image of making generalisations works by pointing to concrete, figured partial relations that make up persons and things. The task of analysis in postcolonial critique is thus to show the specific and material generalisations that link the micro and the macro through themselves. This is doing a relational politics of difference. Difference is not understood as existing between singulars, but as an outcome of concretely embodied relations that achieve singularities. A generalisation unravels these singularities figuring and perhaps re-figuring these relations through itself. Following these effects can show how difference is done, and how it might be done differently. In this thesis I unravel the "summons paper" as such a generalisation. I argue that making a "summons" unravels Village Court, the State, complainants, defendants, law and custom to show the multiple ways they are effected. Filling out a summons form performs a series of conversions. This notion of generalisation makes it possible to develop a generative critique of Village Courts by making explicit multiple sites of conversions, sites where critique is done with materials. It is showing, for example, that law/custom are connected, not externally through some argued for generalisation, but at multiple sites of conversion where one is converted to another. This notion of generalisation has the work of designing the summons form as not a mere technicality, but as a robust critique of Village Courts.

La presente investigación busca analizar la tensión entre la tradición y la contemporaneidad, en el marco de las diferentes dinámicas y relaciones que se entretejen entre los agentes del subcampo de las prácticas artísticas de la danza tradicional colombiana en torno a las políticas de estímulos en Bogotá. La investigación realiza una contextualización mostrando cómo el pensamiento moderno ha establecido y remarcado la tensión entre tradición y contemporaneidad. Se presentan las diferentes tendencias de las prácticas artísticas de proyección escénica de la danza tradicional colombiana, caracterizándolas a partir de las entrevistas realizadas a directores/as. De igual manera, se analiza el programa distrital de estímulos como parte de las políticas culturales y publicas de Bogotá, observando los diferentes procesos de estímulos que se han realizado enfocados hacia la danza tradicional colombiana y la relación de los procesos de creación con las condiciones de producción. Finalmente se presentan las relaciones entre las políticas y prácticas artísticas, mostrando cómo las convocatorias de estímulos influencian en la selección de un tipo de tendencia específica de puesta en escena de la danza tradicional colombiana, dejando de lado a otras tendencias y reforzando la tensión interna entre lo tradicionalista y lo contemporáneo.

Abstract. This research seeks to analyze the tension between tradition and contemporaneity, under the different dynamics and relationships that interweave between agents subfield of artistic practices of traditional Colombian dance around district grants in Bogota. The research makes a contextualization showing how modern thought has established and highlighted the tension between tradition and contemporaneity. Presents the different tendencies of artistic practices for stage of traditional Colombian dance, characterizing them from interviews with directors. Similarly, the district grants program is analyzed as part of cultural and public policies of Bogotá, observing the different processes that have been made focused on traditional Colombian dance and the relationship of the creating process and the conditions for production. Finally the relations between political and artistic practices are presented, showing how the calls for grants influence the selection of a specific type of trend staging of traditional Colombian dance, leaving aside other trends and strengthening the internal tension between the traditionalist and contemporary.
