▼ Este é um estudo sobre como se dá o processo de institucionalização da Atividade de Inteligência Prisional, ou seja, a incorporação institucional da prática da atividade de inteligência no âmbito prisional (AIP), considerando as variáveis da legitimidade e da efetividade. Com o objetivo de melhor compreender esse processo, a pesquisa verificou o caso específico da institucionalização da inteligência prisional israelense, seu contexto político, administrativo e da inteligência de segurança pública de Israel, bem como buscou determinar indicadores necessários a um processo de institucionalização de inteligência prisional eficiente e legítima. No processo em tela é realizada a contextualização do estudo de inteligência prisional dentro de uma análise mais ampla da área de inteligência, com o exame dos principais pressupostos teóricos a respeito do tema e o exame dos indicadores necessários a um processo de institucionalização da inteligência prisional eficiente e legítima. Para tanto, foi utilizado o método de estudo de caso único com pesquisa qualitativa (relatos dos entrevistados), observação participante (investigação nos estabelecimentos carcerários de Israel) e material teórico coletado em Israel (legislações, reportagens, artigos acadêmicos e pesquisas de opinião). A conclusão a que se chega é a de que a criação da AIP foi um fenômeno causado por atos intencionais, uma resposta às necessidades dos governantes (por meio do puro cálculo estratégico), com o objetivo principal de implementar seu domínio sobre a população carcerária, buscando informações sobre a atuação e articulação dos presos terroristas e resolvendo problemas informacionais relacionados à defesa nacional e da ordem pública. A efetividade foi preliminarmente comprovada pela demonstração, quanto ao seu impacto, de que a AIP tem condições de realizar a identificação e o acompanhamento dos presos e suas respectivas facções, de reduzir o crime organizado dentro e fora dos presídios, de antecipar crises e de neutralizar ameaças; quanto ao processo, possui uma complexidade organizacional bastante satisfatória e alto nível de profissionalização de seus agentes; no tocante à legitimidade, por sua vez, foi identificada estabilidade, bom desempenho institucional, existência de mandatos legais regulando a AIP e mecanismos de controle diversos. Porém, constatou-se problemas em relação à transparência/confiança de sua atuação, pois ela é considerada legítima quando o país se encontra em estado de guerra, de conflitos armados, com homens-bomba, terrorismo latente e ataques internos e externos que ameaçam a segurança nacional. Portanto, ela é justificada de acordo com a gravidade da situação, uma vez que se impõem medidas para neutralizá-la. Em tempos de relativa paz, a legitimidade é bastante contestada. ▼ Tax crimes, money laundering and other financial crimes threaten the strategic, political and economic interests of developed and developing countries. The problems encountered by the researcher, is the broad and vague meaning of financial crime compounded by the confusing and ill-considered use of the term by law- and policymakers, politicians, government agencies, agency officials and practitioners weakening effective communication about the phenomenon. The literature shows that given the complexity and multi-faceted nature of financial crime, combating financial crime in all its facets cannot be undertaken by investigative agencies acting in isolation. This study was undertaken with the aim to describe and systematically categorise financial crime and evaluate the prospect of using a Whole-of-Government approach as a framework to harness the capacity of the existing government agencies to combat financial crime more effectively. The research was underpinned by a pragmatic paradigm allowing the researcher to apply a qualitative research methodology using an exploratory and evaluation research design. A detailed review of the literature available nationally and internationally was conducted to establish a conceptual and practical understanding of the issues under investigation. An interview schedule with predetermined questions was developed, pre-tested and administered to participants who are active practitioners involved in combating financial crime in the primary government agencies responsible for combating financial crime based on a purposive sample. The data obtained from the literature and participants were analysed, interpreted and thematically listed according to the frequency with the aim of identifying and comparing similarities and differences between the data. The data was used to develop a system to categorise financial crime systematically based on descriptors used to describe the meaning and application of the term financial crime and to propose practical methods practises and models to combat financial crime more effectively. This research indicates that financial crime can be systematically categorised according to descriptors of the unlawful conduct and that the whole of government approach is a viable approach to combat financial crime more effectively according to the available models for arranging Whole-of-Government work. Objectives. A relatively small group of people are responsible for disproportionate amount of offenses which cause significant monetary and societal costs. It has been important to recognize different risk and protective factors for chronic offending in youth to develop effective treatment and preventive strategies. One subgroup of offenders who commit many offenses are individuals with high psychopathic traits. However, not all psychopathic individuals commit crimes and some seem well adjusted to society. High intelligence is considered as a protective factor from chronic offending. This study examines the relationship of psychopathic traits and intelligence on juvenile delinquency with seven-year long follow up design. Methods. The data of the study was employed from the Pathways to Desistance longitudinal study which material was collected in between 2000 - 2010. The sample included all male juvenile offenders (n=1170) from the cities of Phoenix and Philadelphia in the United States of America. The participants were 14 - 19 of age at the beginning of the study and 21 - 26 at the end. Psychopathic traits were assessed with PCL:YV and intelligence with WASI. The relationship of psychopathic traits and intelligence on delinquency was examined with binary logistic regression analysis. As well as the moderating effect of intelligence on the relationship between psychopathic traits and delinquency. Delinquency was assessed separately for violent and income related crimes based on the self-report of the participants with SRO method. Results and conclusions. High psychopathic traits were related to a higher risk for both violent and income offending in every measurement year of the seven year follow up. In addition, high psychopathic traits were related to a higher risk for faster rate of recidivism and to the continuity of criminal activity. Intelligence did not have either increasing or decreasing effect on delinquency and it did not have any moderating effect on the relationship between psychopathic traits and delinquency. However, further studies are needed to examine more closely the observed relationships, possible mediating factors and other risk and protective factors for crime. The results indicate that the risk and protective factors for delinquency in youth with high psychopathic traits needs to be intervened as early as possible to achieve effective treatment and preventive results.

▼ The primary aim of this study is to determine the significance of the application of physical surveillance as a method in the investigation of insurance fraud conducted by the Surveillance Unit at the Forensic Department of Discovery Life. Various objectives were fulfilled in this study:  To explore, identify and describe the value of the application of physical surveillance, as a forensic investigation method, in order to determine the significance of this method in the investigation of insurance fraud at the Forensic Department of Discovery Life.  To determine whether the application of physical surveillance at the Forensic Department of Discovery Life is achieving its intended objective relating to the degree to which the beneficiary’s (Discovery Life) situation has changed as a result of this method.  To apply new information, acquired from the findings of this study, to further develop good practice and enhance performance in order to empower investigators at Discovery Life with new knowledge relating to the application of physical surveillance in the investigation of insurance fraud. Semi-structured interviews were conducted with forensic investigators employed at the Forensic Department at Discovery Life. The research has revealed that the majority of forensic investigators, other than the Surveillance Unit, at the Forensic Department of Discovery Life do not utilise physical surveillance during insurance fraud investigations to assist them in gathering evidence. These investigators also had a lack of knowledge and skills regarding the utilisation of physical surveillance during insurance fraud investigations and the advantages of this method during insurance fraud investigations. As a result of the non-utilisation of physical surveillance during insurance fraud investigations conducted at the Forensic Department of Discovery Life, important information and evidence with regard to the movement and actions of identified perpetrators who commit insurance fraud are lost to the investigators. However, the significance of the application of physical surveillance in the investigation of insurance fraud is emphasised by the forensic investigators attached to the Surveillance Unit of Discovery Life who utilise physical surveillance on a daily basis to investigate insurance fraud. The research has further revealed that insurance fraud is a major concern to the insurance industry, but can be mitigated through the implementation of unconventional investigative methods, such as physical surveillance, to enhance investigative capabilities. It was recommended that all forensic investigators at Discovery Life be trained in the techniques of physical surveillance to address shortcomings of general and out-dated investigation methods. ▼ The purpose of this research study was to offer a critical analysis of the crime prevention role of the MPD in the SANDF. A recent development in SA where military personnel are deployed to quell acts of violence and xenophobic attacks, makes this requisite and pertinent research. A qualitative research method was adopted, which goes well with the pragmatist worldview. A pragmatist worldview affords researchers the flexibility to choose the type of technique, method and procedures to be utilised in the research study. A literature review was conducted, followed by interviews with members of the MPD. The researcher interviewed a total of 23 members from the MPD. These members were chosen based on their experience and knowledge as military police officials. The data received from participants was analysed using a computer software programme called Atlas.ti. The findings of this research study revealed that crime prevention in SA is the responsibility of the SAPS, not the SANDF. The defence force can be deployed as a last resort in extreme cases when the SAPS are not able to contain the situation. Members of the defence force are not trained to deal with matters of maintenance of law and order. However, the defence force has its own crime fighting component in the form of the MPD, which can perform policing functions anywhere and at any time as long as it is aimed at enforcing the Defence Act (Act 42 of 2002). The conclusion reached by this research study is that MPD members must be capacitated in terms of both human resources and training so that they are able to deal effectively with crime within the SANDF. ▼ The investigation of crime is one area in which the South African Police Service is measured on. There is no doubt that poor application of investigation methods results in acquittal of criminals or, at worst, failing to identify the perpetrator. In murder cases, the response from the communities who are directly affected is usually unpleasant and intolerable. This is so because murder is a crime against human life. One death in the family will have significant, undesirable implications to the family involved and, to a certain extent, the community. Violent crime such as murder has a negative effect, not only on the family who has lost the loved one, but also has a severe direct impact on the economy. For instance, no potential investors would want to associate themselves with a country where the incidence of violent crimes has become the norm and where the government appears to be reluctant to take tangible actions to remedy the situation. For years, the South African Police Service applied one methodology in murder investigations, even though their crime statistics showed that this type of crime was constantly increasing and required drastic steps to curb it. This study gives a detailed analysis of the prosecution-led investigation model and its feasibility in murder cases. This research was conducted on the basis that this model appears to work successfully in commercial crimes, judging by the conviction rates reported annually by the National Prosecuting Authority. The study discusses the current investigation model used by the South African Police Service in the investigation of murder and compares it to an intelligence-led investigation model. It then examines the meaning of the prosecution-led investigation. Finally, international experiences in terms of criminal investigation and prosecution procedures are discussed and compared with those of South Africa. The researcher explored the models from the selected countries and interviews conducted were used as a foundation for describing and explaining the future application of the findings emanating from this research. Using the qualitative approach, data was gathered by means of a literature review and qualitative interviews with the sampled participants to answer the research questions. The researcher is of the view that this study (analysing the prosecution-led investigation model in murder cases) presents a significant contribution to the development of practical guidelines that can be used to effectively and efficiently investigate murder cases. La tradition criminologique conçoit volontiers le crime comme un fait individuel. A rebours de cette conception, cette thèse se propose de comprendre le crime comme un fait social et politique. Les modèles matérialistes et culturalistes classiques ont pu rendre compte des variables économiques et culturelles explicatives du crime. Pour autant, ils ont insuffisamment pris en compte ce fait fondamental que l’activité criminelle est, dans sa masse, une activité de groupe. En particulier, ils peinent à expliquer la surreprésentation des minorités -notamment ethniques- dans le crime. Un modèle sociométrique dit d’ « encastrement criminel » permet de montrer en quoi la sociabilité des minorités donne des avantages comparatifs auxdites minorités dans la criminalité organisée.Parce qu’elle est d’abord un phénomène de réseaux, la criminalité s’explique donc en comprenant les logiques économiques qui motivent les membres des réseaux criminels, mais également les logiques ethno-culturelles qui les structurent. De telles logiques sont toujours prédominantes dans le monde contemporain, marqué par la globalisation, le caractère plus virtuel des échanges, le communautarisme et le terrorisme. Ces logiques économiques et culturelles ont insuffisamment été prises en compte par les politiques publiques de sécurité en France, en particulier les politiques de la ville et de renseignement criminel. Cela tient en bonne partie au modèle français, qui peine à appréhender les logiques du crime de façon pragmatique, et à prendre en compte l’ethnicité.

Criminal networks between economic and cultural logics The criminological tradition readily conceives crime as an individual fact. Unlike this conception, this thesis proposes to understand the crime as a social and political fact. The traditional materialistic and culturalist models were able to account for the explanatory economic and cultural variables of the crime. However, they have insufficiently taken into account this fundamental fact that criminal activity is, in its mass, a group activity. In particular, they are struggling to explain the over-representation of minorities-especially ethnic-in crime. A sociometric model called "Criminal embeddedness" shows how the sociability of minorities gives comparative advantages to such minorities in organized crime.Because it is primarily a phenomenon of networks, crime is thus explained by understanding the economic logics that motivate members of criminal networks, but also the ethno-cultural logics that structure them. Such logics are always prevalent in the contemporary world, characterized by globalization, the more virtual nature of trade, communitarianism and terrorism. These economic and cultural logics were not sufficiently taken into account by public security policies in France, in particular in urban governance and in criminal intelligence policies. This is largely due to the French model, which is struggling to grasp the logic of crime in a pragmatic way, and to take into account ethnicity.

▼ This thesis investigates the legislative measures employed in South Africa to combat the implication of lawyers in money laundering schemes. Criminals make use of sophisticated technological means to transfer money and launderers routinely approach lawyers to assist them in their illegal endeavours. The legal profession is almost tailor-made for abuse by launderers, because lawyers work with huge amounts of money, clients are entitled to legal professional privilege and the right to legal representation is guaranteed constitutionally. The South African anti-money laundering regime, for the most part, is contained in two statutes, the Financial Intelligence Centre Act (FICA) and the Prevention of Organised Crime Act (POCA). Whilst FICA and POCA require the legal profession to be vigilant and accountable in the fight against money laundering, unfortunately they also infringe on hard-won rights, such as legal professional privilege, the right to legal representation and attorney-client confidentiality. The study considers South Africa’s efforts to fulfil its international anti-money laundering obligations whilst upholding the criminal procedural rights guaranteed in the Constitution. It is suggested that certain sections of FICA and POCA fail to find the required balance between protecting citizens from the harms of money laundering and protecting the fundamental rights of attorneys and their clients. Lawyers are in a unique position of trust and in some instances have access to information that may incriminate their clients. Unfortunately, in its quest to combat money laundering, Parliament did not consider seriously enough the position of lawyers and took the easy option of criminalising fees paid with tainted funds, as well as the non-submission of suspicious transaction reports (STRs) and cash transaction reports (CTRs). ▼ This study concerns researching the need for an environmental crime intelligence system at regional and local level geared specifically for environmental crimes within the Swedish Police as well as the need for such a combined operation towards e.g. supervisory authorities. The study views the current situation of environmental crime and environmental damage in part being caused due to an environmental legal implementation deficit. The study explains and defines the need as well as initiates a theoretical systematic design for an Environmental Crime Intelligence which could help reduce the deficit and so help reduce environmental damage. An Environmental Intelligence which in operation from the national level down through the organization would be linking police, prosecutors and county administrations. Authorities – who are assumed to enable, simplify, and standardize discoveries, obligations, investigations and prosecution – would be better interlinked and processed for an improved view and control in the field of environmental crime. This study shows the need to rethink and reevaluate the current state of environmental crime prevention process in terms of priorities and chronological regard. It has shown to verify the theory of legal implementation deficiency. Besides this, the study has also shown a way to reduce that deficiency. With this in mind it has been made visible how the need for an Environmental Intelligence system on a local and regional level would with all probability do very well by current anthropogenic systems. The study finds the presence of an Environmental Intelligence a consistently desired, preferred, alternative from the perspectives of the authorities mentioned above. Many of the findings points straight towards a similarity – principally in prioritization and procedures – through the intent and purpose of research for reducing environmental crime on an international level. This is viewed as a suitable segment of the methodological foundation.

This Ph.D. thesis investigates the development of a methodology for the application of artificial intelligence and the information and communication technology in combination with the use of geographic information systems and remote sensing in decision-making in public management and judicial management services such as the Police Authorities, the Prosecutor's Office, Courts, Spatial Planning and Socio-Economic organizations, Educational Units, Municipal Authorities, environmental and water management organizations and other public services. The development of the methodology is based on the application of artificial intelligence methods, such as Artificial Neural Networks, Support Vector Machines, Random Forests of Decision Trees and Particle Swarm Intelligence in order to predict factors important in public management such as crime, environmental pollution factors such as ozone, socio-economic factors such as unemployment. In the present thesis, a new methodology is proposed, referred to as Predictive Management based on Artificial Intelligence. A new methodology has also been developed for the spatial prediction of decision factors such as crime, based on artificial intelligence techniques and geographic information systems. In addition, two new hybrid methods for classification of satellite images in public management were developed, based on a new proposed hybrid Support Vector Machine kernel and a new hybrid model of Artificial Neural Networks and Random Forest Decision Trees. The artificial Intelligence models were optimized by using Automated Machine Learning algorithms, such as Particle Swarm Optimization and Bayesian Optimization. The main objective of the proposed methodology in this thesis is the application of appropriate artificial intelligence methods to better address the decision-making issues of the public services involved. The implementation of the proposed system in decision-making in the public management through the prediction of various factors of major importance, such as crime, environmental and socio-economic factors, helps to optimize decision-making in various areas, such as crime prevention, environmental pollution, transportation safety and economic and spatial planning.

▼ Policing in The United Kingdom is an intricate business, balancing the enforcement of statute and other laws while dealing with public safety and security. Policing engages a diverse and complicated set of organisational structures and processes relying heavily on the skill and expertise of officers on the ground. Their role in preventing and or intercepting crime before, during and after it occurs is integral to sustaining peace, security, law and order in communities. The police operational and logistics staff work day to day with information and communication technologies, ranging from conventional databases and information systems to ubiquitous and specialised tools. Understanding the use of technology and its management in policing has formed the backbone of this research conducted through a qualitative approach. This study adopted an interpretive paradigmic analytical lens using ethnography situated in the workplace as a methodology. The qualitative study took the form of field immersion for nine months using interviewing, and shadowing/observation to suit the complexity of the socio-technical context. Analysis was conducted using thematic analytical methods. Understanding how the police force interact with and shape the way that information and communication technologies enable them to fight crime is, then, the subject of this thesis. The findings highlighted the complexities and intricacies involved in the use of technology, identifying unique differentiations in the way technology is engaged and integrated into policing including comparative understanding relative to other sectors and industries. On the whole the central features of this work highlight understanding of the role information and communication technologies; usefulness, usage in practice and operational activity, strategic business goals, knowledge management, business intelligence and intelligence led architecture, governance and performance models in policing the county of Bedfordshire, England.
