▼ In recent years increasing attention has been given to urban tourism research, and Tourism, Leisure and Recreation (TLR) have become critical tools in revitalising the economic, social and cultural fabrics and image of a number of British traditional manufacturing cities. The focus of this study is on the urban regeneration through utilising cultural production and consumption of one of these cities (Birmingham) in post-industrial society, and introduces the integrated innovative concepts of Amenity Places and Amenity Businesses. Birmingham International Convention Centre Quarter (ICCQ) is taken as a case study, and geography, history, planning, sociology and TLR are intertwined in order to examine and apply the new concept of Amenity Places and related ideas. The study employs a holistic approach and combines qualitative and quantitative techniques to investigate how the ICCQ redevelopments have taken shape, and the impacts of the regeneration of derelict former industrial sites along the inner city canals. Policy documents and other secondary and primary qualitative data were analysed through document analysis or simplified content analysis. Surveys were undertaken of key actors in the planning and redevelopment process (in-depth semi-structured interviews), and of Amenity Business operators (structured interviews) and users (face to face questionnaire surveys) of the ICCQ. The study found that, under the strong leadership of Birmingham City Council and their vision, which emphasised quality of design, culture and people, Amenity Places had been produced. Mixed land use spatial planning has enabled the creation of vibrant and cosmopolitan spaces, and these public open spaces and canals have provided an urban oasis in Birmingham City Centre. The majority of the businesses opened only after a massive amount of public money had been invested to make an attractive business environment. Despite frequent criticism of flagship developments, this redevelopment, in general, received overwhelmingly positive reactions from users and business occupants, and has brought with it significant economic impacts to, and image enhancement of, Birmingham. It was concluded, however, that there were limited benefits from the redevelopment to immediate residents compared to the new middle class which was found to constitute the majority of users of the ICCQ. This may have resulted from the limited involvement of local businesses and residents in the planning process. While Birmingham has made significant progress in winning new investment and improving its image, it still has some way to go before it can claim to be an attractive tourist destination.

▼ Under fast development of urban areas, more and more large public buildings with complex structure appear, such as shopping center, theater, stadium etc. Crowd in these buildings is relatively large and intensive. Thus, occupant evacuation is becoming a particularly prominent problem in events of various disasters. Building evacuation plan is a key to the safer and faster movement of people away from different types of hazards such as industrial or nuclear accidents, natural disasters, fire, and viral outbreak. Every building has limited number of exit passes as the egress points. Hazard occurrence can result in blocking narrow exits and delay the building evacuation. However, an effective evacuation plan can help to make more efficient use of available exit point and improve the survivability of evacuees. According to the literature, all studies conducted for building evacuation time minimization have considered reactive approaches and do not purpose any proactive approach to reduce the evacuation time. Most of the proposed solutions are focused on either enforcing or guiding evacuees to egress routes and there is no mention of facility allocation approaches to efficiently distribute the building occupants. Then a methodology is developed to evacuate the occupants in the fastest way possible using the available egress points by two approaches - EVACNET+ simulation software and JAVA algorithm. A prototype design is developed in AutoCAD with necessary requirements and available data sources.The simulations are run in such a way that existing design patterns are validated and the improvements to design are made based on the current design. The affecting factors include average walking speeds, levels of service, space availability and different age groups are considered. Finally, a case study is conducted based on a real-world problem - the evacuation process of the Annual College Education Fair held at the SeaGate Convention Center. The problem is modeled with the state dependent stochastic model and an evacuation is conducted and suggested solutions for improvement are recommended. ▼ Many researchers (Cronin&Taylor: 1992, 1994, Grönroos, 1984; Parasuraman, Zeithaml&Berry: 1985, 1988) have devoted considerable attention to the development and testing of models for the measurement of service quality. Although some researchers (Chang&Yeh, 2002; Otto&Ritchie, 1996; Sergio&Hudson 2006) paid attention to service quality research within the tourism industry, little is known about service quality research within the business tourism sector and specifically at an International Convention Centre (ICC). Service quality focuses on the standard of service delivery and the interaction between the customer and the service provider in order to ensure that the customer’s expectations are met (Hernon, 2001:1; Palmer, 2005:64). The literature addresses several models for service quality for example “SERVQUAL” (Parasuraman et al., 1985, 1988), the “Servicescape” model developed by Booms and Bitner (1981:39) and the “Servuction” model (Eiglier&Langeard, 1987 in Palmer, 2005:82). SERVQUAL plays a more important role in the measurement of the service quality at a service firm, i.e. an ICC, than “Servicescape”. SERVQUAL focuses on five service quality dimensions: (1) tangible; (2) reliability; (3) responsiveness; (4) assurance and (5) empathy as identified by Parasuraman et al. (1988:23), while “Servicescape” covers the physical features of a service firm. In this study the researcher seeks to add some conceptual insight to the theoretical literature on service quality. This paper explores the use of the SERVQUAL model at an ICC as a diagnostic tool and examines the difficulties that arise with regards to the measurement of the gaps in service quality in the convention consumer market segments, both domestically and internationally. Suggestions are made that the full value of SERVQUAL may not be fully realised if the measurement processes are not well executed. It may be easy to adapt the SERVQUAL model and implement it in a survey (i.e. the Council of Scientific and Industrial Research (CSIR) ICC) and continue to measure the outcomes, but if that is not acted on it becomes a futile exercise. L'analyse économique du droit conçoit les institutions d'arbitrage comme des prestataires de services qui offrent le service d'organisation de la procédure arbitrale. Comme tout marché, le marché de l'arbitrage institutionnel a besoin d'outils juridiques pour encadrer le nouement et le dénouement de ses opérations économiques. La technique contractuelle est le moyen le plus courant pour assurer la conclusion des transactions économiques sur les différents marchés de biens et services. Dans ce contexte, les prestations de services offertes par les centres d'arbitrage doivent sans doute prendre la forme d'une manifestation contractuelle qui encadre juridiquement leur activité sur le marché de l'arbitrage. C'est ainsi que le service d'organisation de l'arbitrage offert par le centre aux parties litigantes entraîne la conclusion d'un contrat d'organisation de l'arbitrage. Ce contrat dictera la relation contractuelle qui lie les parties litigantes à l'institution d'arbitrage. L'identification du contrat d'organisation de l'arbitrage nous a permis de présenter sa notion et de l'analyser via le prisme de l'ensemble contractuel de l'arbitrage. Il dérive d'une convention d'arbitrage principale et participe avec tous les contrats composant l'ensemble contractuel de l'arbitrage au bon fonctionnement de la procédure arbitrale. In fine, le contrat d'organisation de l'arbitrage devient le contrat par lequel le procès arbitral est intégré dans une structure investie, par la volonté commune des parties litigantes, de prérogatives contractuelles la rendant à même d'imposer des décisions institutionnelles garantissant ainsi un arbitrage efficace.

The economic analysis of the Law conceives the arbitration institutions as service providers that offer the service of the organization of the arbitration proceedings. Like any market, the market of institutional arbitration needs legal tools to regulate the outcome of its economic operations. Contractual technique is the most common way for the conclusion of economic transactions in the various markets of goods and services. In this context, the services offered by arbitration centers take the form of a contractual event that regulates the activity on the arbitration market. Thus, the service of the organization of the arbitration offered by the center to litigants leads to the conclusion of the contract of arbitration's organization. This contract will dictate the contractual relationship between the litigants and the arbitration institution. Identifying this contract allows us to present its concept and to analyze it through the prism of the "ensemble contractuel de l'arbitrage". Our contract derives from a main convention which is the arbitration convention. Ultimately, the contract of the organization of the arbitration is a contract by which the arbitration proceedings is integrated into a structure invested by the common will of the litigants with contractual prerogatives enabling it to impose institutional decisions ensuring an effective arbitration.

O objetivo da presente pesquisa é analisar a arbitragem internacional que é desenvolvida pelo Centro Internacional para Solução de Disputas sobre Investimentos (CISDI), organização internacional criada pela Convenção de Washington de 1965 (CW), sob os auspícios do Banco Mundial (BM), com o propósito de assegurar aos investidores e aos Estados um instrumento internacional de solução de controvérsias neutro. A arbitragem internacional exercida pelo CISDI se reveste de características peculiares por permitir que particulares, pessoas físicas ou jurídicas, ingressem diretamente em face de um Estado num foro internacional. O ingresso direto de particulares a foros internacionais não configura como uma regra geral em Direito Internacional Público. Em razão disso, ao consentir em ser provocado no plano internacional por um particular estrangeiro, o Estado abdica da sua prerrogativa jurisdicional sobre as pessoas domiciliadas no seu território. Na hipótese de o Estado receptor de investimento figurar no pólo passivo de determinada execução, em que pese a natureza definitiva do laudo arbitral do CISDI, a discussão sobre a sua imunidade de execução certamente será suscitada, podendo afetar a celeridade do cumprimento das obrigações pecuniárias contidas na decisão do CISDI, colocando sob suspeita a efetividade do seu sistema arbitral. Diante do empenho da comunidade global pelo constante desenvolvimento econômico internacional, cabe questionar a efetividade do sistema arbitral previsto na CW, especialmente sobre a execução dos laudos arbitrais proferidos no âmbito do CISDI em face dos Estados receptores de investimentos.

The goal of this research is to analyze the international arbitration which is developed by the International Centre for Settlement of Investment Disputes (CISDI), an international organization created by the Washington Convention of 1965 (CW), under the auspices of the World Bank (WB) with intended to provide investors and States an instrument of international dispute resolution neutral. International arbitration exercised by CISDI is of peculiar characteristics by allowing private individuals or corporations, join directly in the face of a State in the international forum. The direct entry from individuals to international forums not configured as a general rule in Public International Law. As a result, the consent to be caused by an internationally particular alien, the State abdicates its judicial prerogative of persons domiciled within its territory. Should the receiving State investment defendants appear in a particular implementation, despite the finality of the arbitral award CISDI, discussion of its immunity from execution certainly be raised, affecting the speed of completion of pecuniary obligations contained in deciding the CISDI, placing under suspicion the effectiveness of its system of arbitration. ▼ Emergent morphogenetic designs provide a superior architectural response to programmatic, technical, structural, environmental and spatial requirements that conventional unit based architectural forms are too inflexible to fully address. Architecture has reached an exciting stage in its development, where structures are attempting to behave more like nature, which does not function as a static state, but as a complex grouping of symbiotic processes which are constantly evolving to adapt to environmental changes. Digital fabrication and materials engineering have promoted an explosion in formal architectural typologies. By utilizing these digital tools and enhanced materials to embrace a morphogenetic design strategy, architecture can respond rapidly, through multiple permutations to respond to multiple performance criteria. This approach outlines a design process that generates a typology and through multiple reiterations, changes as the design reacts to new performance criteria being added, or the model not adequately meeting the criteria being tested. The terms used to encompass this new design strategy are emergence, evolutionary optimization or morphogenetic design. This strategy utilizes tools in parallel that have been developed independently by different disciplines, including theoretical mathematics, materials engineering, bio-mimicry, environmental studies and digital technologies. The site is a parcel located on Tampa Bay at the outlet of the Hillsborough River, where the existing unit based Tampa Convention Center will be replaced with the new performance based Convention Center. The research methods will be simulation and modeling research. This method will start with a performance based program, and submit the models to multiple permutations. Each performance criteria will be applied to develop an iterative process that re-informs the shape, design, structure and materials, and can be evaluated at the conclusion of the design process, testing the accuracy of the Thesis.

▼ The primary goal of this study was to identify key success factors for the management of a conference centre in South Africa. This goal was achieved by firstly portraying an overview of the conference industry in South Africa. Secondly, a literature study was conducted in order to determine the aspects in the literature that are regarded as of vital importance in managing a conference centre. Thirdly, the results of the empirical research were discussed. Lastly, conclusions were drawn from the research and recommendations were made with regard to further research. From the literature study, aspects of strategic management, financial management, marketing management, human resource management and management of operational aspects were identified as being important in the management of a conference centre. These aspects were used to compile a questionnaire. The objective of the questionnaire was to measure the importance that conference centre managers attach to the identified elements. Questionnaires were e-mailed to 250 conference centres. A total of 100 questionnaires were received back. The study population consisted of a database as compiled by the researcher from the Direct Access Conference Handbook (2004) and the Africa Conference Directory (2006/7). Questionnaires were also handed out personally to exhibitors at the INDABA Tourism Exhibition (2006). From the responses to the questionnaire it can be deduced that conference centre managers regard the aspects of strategic management, financial management, marketing management, human resource management and management of operational details as important to very important. A factor analysis was done to determine the key success factors in managing a conference centre. The following factors were identified, namely to: • Provide a conference centre with a functional layout and the correct variety of activities; • perform marketing management; • ensure that operational aspects are in place; • do proper planning; • provide an attractive venue and conduct a post-conference evaluation; and • perform human resource management. Conference centre managers have to apply the above-mentioned key success factors to ensure that the conference centre is successful over the longterm.

La Convention pour le règlement des différends relatifs aux investissements entre États et ressortissants d'autres États a institué un système de conciliation et d'arbitrage, à la fois spécialise, autonome et exclusif, lequel est administre par le centre international pour le règlement des différends relatifs aux investissements (“CIRDI"). La Convention de Washington de 1965 ne prévoit que trois voies de recours à l'encontre des sentences. Elles doivent être exercées dans le cadre de la Convention, à I' exclusion des recours devant les juridictions nationales. Le recours en annulation devait être employé dans des circonstances exceptionnelles. Toutefois, le succès obtenu par plusieurs requetés en annulation a suscité des doutes sur l'efficacité du système du CIRDI. Alors que les rédacteurs de la Convention voulaient distinguer le recours en annulation d'un appel, les instances de contrôle ont procédé à une révision extensive du bien-fondé des sentences.

The Convention on the Settlement of Investment Disputes between States and Nationals of Other States established a specialized autonomous and self-contained conciliation and arbitration system administered by the International Centre for Settlement of Investment Disputes, an international institution created by the Convention ("ICSID"). The Washington Convention of 1965 provides only for three remedies, which can be invoked against awards. They must be exercised within the framework of the Convention, the intervention of national courts being excluded. The remedy of annulment was intended to be used in exceptional circumstances. However, the success of several annulment proceedings raised serious concern about the effectiveness of the ICSID system. Although the drafters of the Convention wanted to distinguish an annulment proceeding from an appeal, the review panels were drawn into a detailed review of the merits of the awards.

▼ Whilst policy formulation has been extensively studied and theorised in the literature, far less attention has been paid until fairly recently to the issue of policy implementation. For a long time it was more or less assumed that once policy was formulated, implementation was a relatively straightforward administrative matter. In the past twenty or thirty years, however, public administration scholars (such as Pressman and Wildavsky and, in the South African context, Brynard and de Coning) have devoted more attention to unravelling the complexities of policy implementation. The current study intends to apply these more theoretical approaches to an analysis of the implementation of the 1997 White Paper for Social Welfare with particular respect to children in conflict with the law, focusing specifically on the One Stop Child Justice Centre in Mangaung, Bloemfontein. Welfare Service in South Africa before 1994 had a racial bias with services mostly unavailable to the majority of the citizens of the country. The 1997 White Paper for Social Welfare, based on a developmental approach to social welfare, was designed to take the country in a new and inclusive direction. In line with South Africa’s 1996 ratification of the UN Convention on the Rights of the Child, as well as other international instruments, Section 4 of Chapter 8 of the White Paper focuses on crime prevention through development and restorative justice, and recommends diversion wherever possible in the case of juveniles. With respect to Juvenile justice, this section of the White Paper makes provision for the establishment of One Stop Child Justice Centres, where a variety of services, from Social Development, the Department of Justice, the South African Police Services, Correctional Services, and the NPA, would be available to clients under one roof. All of these role players, it was envisaged, would operate as a multi-disciplinary team to achieve the objectives of the White Paper with respect to developmental and restorative forms of justice. The Centre at Mangaung is one of only a few centres to have been established as yet in South Africa. Although focusing in particular on the implementation of the 1997 White Paper, the study is also informed by other policy and legislative measures with respect to juvenile justice, in particular the Child Justice Bill of 2002 (now the Child Justice Act of 2008) and the Probation Services Amendment Act of 2002. It is generally accepted by the Government and its critics alike that the policy scene in South Africa in the period since 1994 has been characterized by good policies but poor execution. This is, however, a relatively untested hypothesis and needs further investigation. In the light of this, it is anticipated, that the present study will make a contribution to the literature on policy implementation in South Africa, as well as providing useful insights and lessons that can inform general government policy in this regard, and policy with respect to juvenile justice in particular.
