▼ The study sought to achieve the objectives of determining the extent to which performance contracting has been implemented and to establish the factors that affect the implementation of Performance contracts in Kenya Revenue Authority. To achieve these objectives, the study was carried out through a case study design. Personal interviews were conducted on eight senior level managers by the research using interview guides which had open ended questions. The eight respondents were drawn from eight different departments so as to fully analyse the situation across various departments of KRA; Customs, Corporate Research and Planning, Domestic taxes Domestic Revenue, Domestic Taxes- Large Taxpayer Office, Road Transport, Information and Communication Technology and the Human resources department. The researcher sought appointments with these respondents where he asked the questions following the interview guide (attached appendix 1). The data collected was of qualitative nature and was analysed by content analysis whereby key theme, concept and argument from each response was identified and analysed. The findings were presented in a narrative format and they showed that performance contracting had not been fully implemented in the organisation as only a section of the staff signed performance contracts i.e. from grades one to ten. The rest of the staff, grades eleven to sixteen fill job evaluations, representing about forty percent of the staff. Secondly, the findings showed that the implementation of performance contracts in the organisation was affected by various factors including resource inadequacy, unrealistic and unachievable targets, reward and penalty system, communication and abrupt staff transfers hamper the implementation among others. The study recommends that all levels of staff should be introduced to the concept of performance contracting. Performance contracts should be developed for each grade depending on the duties. This is to ensure that they are rational and uniform. Targets sets should be realistic and achievable and lastly drastic staff transfers should be avoided midyear.

Управни уговор представља савремени облик управног дјеловања којим се задовољавају потребе од јавног интереса. У упоредном праву ужива репутацију института који рјешава савремене управне проблеме који се, између осталог, огледају у недостатку новчаних, кадровских и стручних ресурса за обављање текућих задатака. Управни уговор представља институт који се одликује посебним правним режимом који се не може срести код било које друге врсте уговорних односа. Јавна управа као уговорна страна располаже низом овлашћења која јој дају правно повољнији положај у циљу остварења вриједности које су дефинисане кроз уговорне норме. Ипак, његова улога ни данас није прецизно одређена у упоредном праву. У свом профилисању овај институт се суочавао са многим оспоравањима која до данас нису занемарена. Због тога се у раду посебна пажња посвећује његовом мјесту и улози у систему правних аката. Настоје се пронаћи заједнички елементи са уговорима приватног права и са другим инструментима управног поступања али и оно што га чини посебним правним институтом. У том смислу, настоји се доказати да је он акт који повезује јавно и приватно право. У упоредном праву не постоји сагласност око конститутивних елемената овог правног института. Свака земља је управни уговор прилагођавала својим потребама што је за посљедицу имало да се значајно удаљи од свог изворног концепта. Посебна пажња приликом приказивања рјешења у упоредном праву се поклања француском, њемачком и праву Европске уније као сету норми који у великом обиму уједначава правне системе у земљама Европске уније као и будућим чланицама. Управни уговор се испољава кроз различите облике. У раду су посебно обрађене поједине врсте управних уговора у циљу приказивања положаја и улоге управе као уговорне стране. Јавне службе су поље његовог дјеловања преко којег се остварује политика владајуће већине.

▼ Over the last thirty years several national and domestic common law legislatures have sought to better protect and promote human rights by the enactment of legislative bills of rights which have imposed obligations on government bodies and public authorities to comply with human rights standards in their conduct and decision-making. Over the same period the concept of the state and the role of government has been transformed, with activities that were traditionally viewed as the responsibility of government being contracted-out to non-government actors. Human rights primarily focus on the relationship between the individual and the state by restraining the exercise of state power or imposing positive duties on the state. The ‘hollowing out’ of the state through contracting-out public services has challenged this conceptual basis of human rights, by relocating significant power to non-state actors. This thesis examines how the legislative human rights charters adopted in New Zealand, the UK, Victoria and the Australian Capital Territory have addressed this challenge. The thesis analyses how these Acts have employed the concept of ‘public functions’ as the basis for extending human rights obligations to non-government entities performing contracted-out activities. However, the interpretation of the concept of ‘public functions’ has often failed to give clear direction to non-government entities providing contracted-out public services. The effectiveness of each of the Acts in providing certainty to non-government entities regarding their human rights obligations is also considered.The thesis concludes that legislative specification as to what is meant by ‘public functions’, parliamentary explanatory guidance regarding the term and provision for accessible remedies for individuals where service delivery has not complied with human rights standards can provide greater certainty to non-government organisations regarding their human rights obligations. The thesis further concludes that governments should use service contracts, regulatory mechanisms and provide education and training to non-government services to ensure greater compliance with legislative human rights standards in the delivery of contracted-out public services. By the use of such measures the legislation would better be able to protect individuals against the arbitrary exercise of power - whoever exercises it - whilst maintaining the conceptual framework underpinning human rights. Les notions de pouvoir adjudicateur et d'entité adjudicatrice délimitent le champ d'application personnel de la réglementation européenne des marchés passés respectivement dans les domaines classiques de l'activité administrative et dans certains secteurs d'utilité publique organisés en réseau. Ces notions sont définies selon une approche fonctionnelle qui soulève des interrogations au regard de différents concepts du droit interne. L'étude de trois exemples représentatifs, à savoir le droit français, le droit allemand et le droit anglais, permet de mettre en évidence ces problèmes qui peuvent être synthétisés autour de deux thématiques: la forme juridique de l'acheteur et sa dépendance à l'égard des pouvoirs publics. D'une part, il s'agit d'étudier les incidences de la nature publique ou privée et, plus généralement, de Ia personnalité morale d'une entité sur la mise en œuvre en droit interne des notions de pouvoir adjudicateur et d'entité adjudicatrice. D'autre part, il s'agit d'examiner, à partir de l'interprétation jurisprudentielle de ces notions mais aussi de certaines réglementations nationales spéciales, dans quelle mesure l'activité de différents organismes et les liens, notamment économiques, qu'ils entretiennent avec les pouvoirs publics justifient de les soumettre à la réglementation de marchés publics.

The concepts of "contracting authority" and "contracting entity" are the defining elements of the personal scope of the EU Directives on Public Sector and Utility Sector Procurement. The content of these concepts is determined according to a functional approach which raises a number of questions in relation to various notions of domestic law. A comparative study of three representative legal orders, namely French, German and English Law, illustrates these questions which revolve around two issues: the legal form of the purchasers and the nature of their dependency on the State. The first issue involves studying the extent to which the public or private nature of an entity as well as, more generally, the existence or lack of legal personality, have an impact on the implementation of the concepts of "contracting authority" and "contracting entity" in domestic law. Based on the relevant EU and national case law as well as on other specific national provisions, the second issue involves examining the extent to which the nature of an entity's activity and its different ties in particular financial, with the State justifies the application of the public procurement rules on such an entity.

▼ In 2010, the Financial Services Regulatory Authority (FSRA) of Swaziland noticed a significant increase in employee absenteeism which they discovered was related mainly to: poor health (sick leave), personal and financial stress (garnishee orders were increasing), and low staff morale, the consequence of which was low productivity and missed deadlines (FSRA, 2010:7). High levels of absenteeism meant that a sizeable number of employees were unable to complete their daily tasks (FSRA, 2010:7). Consequently, in 2011, the FSRA Human Resource Department started a wellness programme for all employees in the organization in an attempt to respond to the human resource challenges reported in 2009/10 financial year. By the end of 2012, FSRA management reported that the introduction of the EWP had not yielded the expected results. This therefore prompted management to request an evaluation of the FSRA employee wellness programme. The aim of this research was to identify and prioritize the needs of employees in terms of requirements of a wellness programme and how it should be delivered. The specific objectives of the study are as follows: to identify the wellness needs of employees, to identify employee preferences in terms of the type of interventions to be included in a wellness programme, to identify the preferred mode of delivery of the wellness programme and to make recommendations to management on the design of a wellness programme. Questionnaires with closed ended questions were used to collect data for this survey. The questionnaire used is attached as Appendix A. By means of a needs analysis survey, this research was designed to assess the FSRA employees’ needs in terms of an employee wellness programme, as well as the preferred EWP delivery methods. About 70 percent of FSRA employees participated in the survey. The respondents completed the questionnaire and submitted it online over a period of 10 working days (2 weeks). This report is structured into three sections, namely; section one, which is the evaluation report that gives details of the importance of the study, highlights research methods and then present the results, discussions and recommendations. Section two deals with the literature review while section three reports on the research methodology, research design and procedures and the limitation of the study. In light of the findings on the wellness needs of employees, 72 percent of the respondents felt the current wellness programme was very inadequate and a further 10 percent added that it was inadequate in addressing their wellness needs largely because the needs were not known. The most important wellness needs identified included: exercise, nutrition, personal hygiene, disease awareness and treatment of illness, coping with stress, coping with workload, ventilation, safety, bereavement, personal debt, and retirement planning. The most preferred wellness interventions that respondents proposed include Flexible Work Schedule, Safe Workplace, Improved Ventilation, Retirement Planning Advice and Gymnasium.…

L'administration utilise de plus en plus le procédé contractuel, notamment les marchés publics, contrats par lesquels elle satisfait ses besoins en travaux, fournitures et services. Au sein des marchés, à côté des procédures formalisées soumises aux directives communautaires, une catégorie particulière de marché a été créée par le code des marchés publics de 2004 : les marchés à procédure adaptée (M.A.P.A.). Ces marchés, qui constituent une innovation du code de 2004 et qui ont été repris par le code de 2006, sont définis par l'article 28 du code comme les marchés « dont les modalités sont librement fixées par le pouvoir adjudicateur en fonction de la nature et des caractéristiques du besoin à satisfaire, du nombre ou de la localisation des opérateurs économiques susceptibles d'y répondre ainsi que des circonstances de l'achat ». Les modalités laissées à l'appréciation du pouvoir adjudicateur ne doivent pas pour autant porter atteinte aux principes généraux de la commande publique (liberté d'accès à la commande publique, égalité de traitement des candidats et transparence des procédures). Ainsi, la liberté accordée aux acheteurs publics dans le cadre des M.A.P.A. a pour contrepartie une responsabilité accrue. Cette marge de manœuvre accorde une place importante à la jurisprudence pour définir le régime de ces marchés et laisse place à l'innovation des acheteurs publics.

The administration uses increasingly the contract process, including procurement, contracts under which it satisfies its needs works, supplies and services. In markets, in addition to formal procedures subject to EU directives, a particular category of contract was created by the Public Procurement Code 2004 : markets appropriate procedure (MAPA). These markets are an innovation of the Code of 2004 and which were included in the Code of 2006, are set out in Article 28 of the Code as markets "whose terms are freely set by the contracting authority in accordance with the nature and characteristics needed to meet the number or location of economic operators likely to respond and the circumstances of the purchase. "Terms at the discretion of the contracting authority should not necessarily undermine the general principles of public procurement (freedom of access to public procurement, equal treatment of candidates and transparency of procedures). Thus, the freedom granted to public purchasers within the MAPA is offset by an increased responsibility. This flexibility gives an important place to the courts to define the treatment of these markets, leaving room for innovation in public buyers.

À l’issue de la Révolution, la rationalisation de la politique architecturale opérée au moyen d’une centralisation des affaires qui s’appuie sur un découpage administratif très hiérarchique allait permettre, en moins d’un demi-siècle, de fournir aux nouvelles institutions les édifices nécessaires à leur exercice et d’inscrire leur existence symbolique dans le bâti. Comme commission consultative établie auprès du ministre de l’Intérieur en 1795, le Conseil des bâtiments civils fut appelé à se prononcer sur l’ensemble des questions relatives à l’architecture que lui soumettait le ministre. Ses compétences portaient tout autant sur l’examen sous le rapport de l’art de tous les projets d’architecture construits aux frais de l’État que sur des sujets aussi divers que le règlement des honoraires, les alignements de voirie ou la liquidation des sommes dues aux entrepreneurs. Principal outil de la politique architecturale de l’État, le Conseil des bâtiments civils allait être à l’origine d’une pratique encadrée de l’architecture. En commandant l’accès à la commande publique la plus rémunératrice et la plus importante pour la notoriété de l’architecte, et par la normalisation du processus de production architectural, le Conseil et l’administration des bâtiments civils furent à l’origine, selon le mot de Georges Teyssot, d’un véritable « système des bâtiments civils » dont le rôle fut sans doute plus déterminant encore que celui de l’École et de l’Académie des Beaux-Arts dans la première moitié du XIXe siècle.

At the end of the Revolution, the rationalization of the architectural policy that engendered a centralisation based on a strict hierarchical administrative division would, in less than a century, allow to give to the new institutions the buildings they needed and to inscribe their symbolic existence in the built. As a consultative commission established next to the Interior ministry in 1795, the Conseil des bâtiments civils was called to decide on all architectural matters submitted to it by the Minister. His competences were equally relevant to the examination of all architectural projects built at public expense under the art point of view, or on topics as diverse as the payment of fees, road alignments or liquidation of amounts due to contractors. Main tool of the architectural policy of the State, the Conseil des bâtiments civils would frame the architectural practice. By controlling access to the most lucrative public command and the most determinant for the reputation of the architect, the standardization of architectural production process that the Conseil des bâtiments civils introduced, was a true "system of civil buildings" whose role was probably even more important than that of the École des Beaux Arts or the Académie in the early nineteenth century.

Trabalho de relatório de Estágio de natureza científica para obtenção do grau de Mestre em Engenharia Civil na Área de Especialização em Edificações

Os procedimentos concursais de obras públicas geram um processo dinâmico, tanto na fase de elaboração dos procedimentos para concurso pelas entidades adjudicantes, como na fase de estudo, orçamento e elaboração da proposta por parte da entidade concorrente. Este trabalho reporta à análise dos requisitos mais relevantes, a considerar no estudo e na elaboração dos procedimentos concursais a fim de proceder à contratação pública e à realização de obras públicas, tanto na ótica da entidade concorrente/executante como na perspetiva da entidade adjudicante/dono de obra. Os procedimentos concursais de obras públicas, em Portugal, regulados por diploma foram analisados desde o reinado de D. Maria II até à atualidade. Neste trabalho é feita uma breve abordagem aos principais diplomas jurídicos, sobre o tema, desde o Decreto de 9 de maio de 1906, Diário do Governo n.º 111 de 18 de maio, até ao Decreto-Lei n.º 18/2008. Diário da República n.º 20, Série I de 2008-01-29. Presentemente, em Portugal, os procedimentos para a contratação pública são regulamentados pelo Código dos Contratos Públicos, aprovado pelo Decreto-Lei n.º 18/2008, de 29 de janeiro e pelas sete alterações que ocorreram desde a sua publicação até julho de 2012. Neste trabalho são analisadas a estrutura do Código dos Contratos Públicos (CCP) e as respetivas alterações ao diploma. No âmbito da elaboração de proposta de uma empreitada de construção civil é apresentado neste Trabalho Final de Mestrado o estudo económico de estruturas de suporte flexíveis. Com este propósito, apresentam-se os dimensionamentos das cortinas de estacas-pranchas metálicas, em consola e monoapoiada. Para o estudo das cortinas foi utilizada a metodologia contemplada no Eurocódigo 7, aplicando os métodos de cálculo clássicos: o método da cortina em consola e o método do apoio livre ou simples. Para o dimensionamento do escoramento metálico aplicaram -se as disposições previstas no Eurocódigo 3. Verificados os cálculos de dimensionamento procedeu-se ao estudo comparativo dos preços unitários das duas soluções estudadas e apresentam-se também as respetivas conclusões.

▼ The government procurement legislation – i.e. the Swedish procurement law, the EC procurement directives and the WTO’s Government Procurement Agreement – applies on public procurement. Such a procurement exists when the contractor meets the conditions stated in the directives that the organ is to be considered as a contracting auhtority. The conditions are supposed to cover the bodies that objectively are thought to take other considerations than economic when purchasing services or products. The definition of contracting authorities has, however, given rise to several interpretation problems when putting the wording into practice. Since it is the contracting authorities themselves that are responsible for their compliance with the law when purchasing, an unclear definition will result in bodies getting a possibility to, to a larger extent, evade the obligation to comply with the procurement legislation. Because of this, it is of great importance that the courts create a unitary interpretation of the definition; a clear definition serves as a means of exerting pressure. The thesis is an investigation of the definition of contracting authority where the primary source of information consists of case law from the European Court of Justice. The purpose is to visualize the underlying philisophy of the regulation with a view to suggest an instrument for determining a body’s status as a contracting authority. Regarding the definition of contracting authority, the thesis discuss three different levels. The first level consists of an examination of the wording according to both the directives and the Swedish law, and then the interpretation of the wording by the European Court of Justice. At the following level, it is set out to illustrate differences between the definition on a national level and an EC level, respectively. Finally, it will be established what legislation technique that seems to have been used when formulating the definition of contracting authority in the directives, and also how the result of this should influence the interpretation of the term.

Centralizacija javnega naročanja postaja trend po svetu in v Evropi v zadnjih letih, ki je narastel tudi zaradi gospodarske in finančne krize. Oblasti centralizacijo prepoznavajo kot sredstvo za zniževanje javne porabe in hkrati kot sredstvo za večjo učinkovitost in uspešnost javnega naročanja. Naloga obravnava institut centralizacije javnega naročanja z organizacijskega vidika, pri čemer proučuje njen koncept s teoretičnega vidika in analizira njene prednosti in slabosti. Predstavljena so izhodišča v zadnjih evropskih direktivah 2014/24/EU in 2014/25/EU, ki podrobneje urejata posamezna vprašanja v zvezi z že uveljavljenimi tehnikami centraliziranega naročanja v praksi držav članic preko centralnih nabavnih organov, priložnostnega skupnega javnega naročanja in čezmejnega skupnega javnega naročanja. Direktivi ne določata organizacijskih oblik centralizacije, temveč so te prepuščene nacionalnim ureditvam in praksi držav članic. Potekajo preko različnih oblik sodelovanja med naročniki (javno-javnih partnerstev), ki jih lahko razdelimo glede na podlage za nastanek sodelovanja (pogodbene in statusne) ter glede na tipe vključenih naročnikov (horizontalno, vertikalno in kombinirano sodelovanje). Optimalni model centralizacije ne obstaja, ampak lahko govorimo le o iskanju njegove najprimernejše oblike. Naloga analizira obstoječe stanje organizacije centralizacije javnega naročanja v Republiki Sloveniji s podanimi predlogi izboljšav ter predstavlja primerjalno ureditev centralizacije v Veliki Britaniji in Avstriji.

Centralization of public procurement is becoming a trend all around the world and in Europe in recent years, which has also increased because of the economic and financial crisis. The authorities´ centralization identified as a means to reduce public spending and at the same time as a means to increase the effectiveness and efficiency of public procurement. Thesis is addressing the institute of centralization of public procurement of the organizational point of view, while investigating its concept of theoretical point of view and analyse its pros and cons. Presented are the basis in the recent European directives 2014/24/EU and 2014/25/EU that regulate in detail some issues relating to the centralised procurement techniques that the Member States have established already in practice through central purchasing bodies, occasional joint procurement and cross-border joint procurement. The directives does not lay down the organisational forms of centralization, so the national laws and practice of the Member States regulate them. They take place through various forms of cooperation between contracting authorities´ (public-public partnerships), which can be divided according to the basis for the formation of cooperation (contractual and statutory), and depending on types of public authorities´ involved (horizontal, vertical and combined cooperation). L'importance considérable des marchés publics, parmi les activités économiques de l'administration de l'État moderne, a poussé l'Union européenne, pour plusieurs raisons socio-économiques, à établir une réglementation unifiant les règles nationales afférentes afin d'assurer dans l'espace de l'Union une concurrence libre et saine entre les opérateurs économiques intéressés. Pour ce faire, outre les préceptes impérativement édictés par son droit primaire, l'Union a imposé aussi son droit dérivé sur la matière par des directives bien détaillées. Une définition extensive de la notion de marchés publics, encouragée constamment par la jurisprudence de la Cour, une catégorisation des modalités du régime de « passation des marchés publics » et une réglementation européenne procédurale pour la protection des intéressés ont été élaboré. La question s'élève donc sur l'impact de ce droit ainsi établit en la matière par l'Union européenne sur des considérations de base du droit public hellénique. Dans ce cadre d'harmonisation des droits nationaux sur la matière, se trouve l'opération d'insertion du droit de l'Union européenne dans l'ordre juridique hellénique ; insertion effectuée par les autorités normatives nationales, législateur et administration ; tandis que sur le domaine procédural un contrôle juridictionnel s'exerce sur cette réception dans l'ordre juridique national tant par le juge européen que par le juge national. De cette manière on peut esquisser la marge de liberté contractuelle des autorités publiques helléniques à l'aune des exigences du droit de l'Union européenne.

The significance of public contracts amongst the economic activities of the modern state's administration, has led the European Union- for several socio-economic rationales- to establish a uniform regulatory framework so as to ensure fair and unbridled competition between the economic operators of the different Member States. To this end, in addition to the provisions of primary law, the EU has further enacted secondary legislation in the form of exhaustively detailed directives. In order to achieve the effective application of EU law in several public contracts a broad interpretation of the public contracts concept was developed, persistently encouraged by the Court's case law, and a categorisation of the public procurement types was adopted. Furthermore, European procedural rules were introduced with the aim of safeguarding rights that individuals derive from that law. The question thus is what is the impact of this comprehensive regulatory framework on the Greek public law considerations on the subject. It is in the context of national laws' harmonisation on the matter, that EU law is inserted in the Greek legislation ; this insertion is carried out via national regulatory authorities, the legislator and the administration ; moreover, in the procedural field, both the European and the national judge exercise judicial control over the reception of the EU law in the national legal order. ▼ Řešeným problémem této bakalářské práce je proces zadávání veřejných zakázek, který je prozkoumán z pohledu zákona č. 137/3006 Sb., o veřejných zakázkách, ve znění pozdějších předpisů. Za pomoci poslední novely č. 55/2012 Sb. je vyčleněno do tabulek množství změn, jež zásadně mění pohled na zákon o veřejných zakázkách. Proces zadávání veřejných zakázek je následně analyzován a vyhodnocen prostřednictvím zadávacích dokumentací, ze kterých byla čerpána data o kvalifikačních předpokladech a hodnotících kritérií. Vyhodnocení je provedeno pomocí grafů a tabulek. Výsledkem práce je prokázání významného vlivu novely na celý proces zadávání veřejných zakázek a pokles zadaných veřejných zakázek na stavební práce s ohledem na veřejné zakázky na dodávky a veřejné zakázky na služby. Budoucím doporučením je znovu novelizovat zákon o veřejných zakázkách a snažit se umožnit opětovný nárůst zadaných veřejných zakázek a tím napravit významný negativní dopad novely.; The issue solved in this thesis is the procedure for the award of public contract, which is explored from the perspective of the Act No. 137/3006 Coll., on Public Contracts, as Amended. With the help of latest Amendment No. 55/2012 Coll., number of changes was allocated into the tables. These changes fundamentally modify the view on the Act of Public Contract. Process of the award of public contract is then analyzed and evaluated by the tender dossier, from which the data about qualification requirements and evaluation criteria was drawn. Evaluation is performed using graphs and tables. The result of this thesis is to demonstrate a significant effect of the Amendment on the entire procedure and the decrease of assigned public works contracts with regard to public supply contracts and public service contracts. Future recommendation is to re-amend the Act on Public Contract and try to allow the re-growth of awarded public contracts, and to reclaim significant negative impact of the Amendment. Som en följd av Sveriges medlemskap i EU har offentliga upphandlingar kommit att få allt större betydelse eftersom de nu kan ske inom ett betydligt större geografiskt område än tidigare. En konsekvens av detta är att konkurrensen blivit allt hårdare och nya regler införs i takt med den snabba utvecklingen. Ett av resultaten av den hårda konkurrensen på upphandlingsmarknaden har visat sig vara att en del leverantörer lämnar anbud med onormalt låga priser för att vinna upphandlingskontraktet. Förekomsten av onormalt låga anbud i offentliga upphandlingar medför allvarliga negativa konsekvenser såsom att konkurrensen snedvrids, effektiviteten minskar och kostnaderna ökar. Detta påverkar både den upphandlande enheten, leverantören som bjudit onormalt lågt, de leverantörer som slagits ut samt konsumenterna. Att det saknas ett förbud i upphandlingslagstiftningen mot att anta onormalt låga anbud är därför allvarligt. Syftet med denna framställning är att undersöka innebörden av begreppet onormalt lågt anbud i offentliga upphandlingar, belysa problemet med och konsekvenserna av att lagstiftning och regelverk inte i tillräcklig utsträckning uppmärksammar de risker som kan vara förenade med antagandet av onormalt låga anbud samt försöka finna en lösning på problemet.

As a result of Sweden’s membership of the European Union, public procurement has gained more importance, mainly due to the larger geographic territory available. As a consequence of this, competition has become more aggressive and new rules are being incorporated into Swedish law in step with the fast development. One of the results of the tough competition in the public procurement market is that companies may be forced into potentially unsustainable under-bidding in order to win contracts. The presence of these abnormally low tenders in public procurement may have serious negative consequences such as distortion of competition and reduced efficiency, potentially causing delays and waste of resources in the procurement process. This will affect both the contracting authority, the tenderer that has won on an abnormally low bid, the other unsuccessful tenderers, and the ultimately consumers. The fact that public procurement law does not prohibit authorities from accepting abnormally low tenders is therefore potentially very serious. The main objective of this dissertation is to examine the significance of the concept of abnormally low tender, to illuminate the issues surrounding and consequences of the legislative lack of attention to the risks associated with accepting abnormally low tenders, and finally to propose solutions to these issues.

▼ The main objective of this research work is to determine the extent to which foundations and Chambers of Commerce, Industry and Navigation are subject to public procurement rules. Within the range of foundational entities, special attention has been devoted to those of public sector –both at the State as well as at the Autonomous Community level-, healthcare public foundations, “fundaciones en mano común” and those, which we will refer to as “stricto sensu foundations”. The need to draw effective conclusions is going to require a prior in-depth analysis of EU public procurement rules and, namely, of the definition of “contracting authority” contained in article 1.9 of Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004, on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts. In order to achieve a precise conceptual delineation of some terms, which are rather complicated to interpret, such as “needs in the general interest”, “industrial or commercial character”, “management supervision” or “financed, for the most part, by public bodies”, a thorough review of the European Court of Justice jurisprudence has been undertaken. On this basis, the present work proceeds to examine the subjective scope contained in the Spanish Law on Public Sector Contracts, a consolidated text adopted by Royal Decree-Law 3/2011, of 14 November, as well as the different levels of application of public procurement rules, focusing on the maximum level of enforcement – for Public Administration-, the intermediate level – contracting authority, which is not deemed Public Administration-, and the minimum level, applicable to the remaining public sector entities. The proper integration of the bodies regulated in the national Law, in any of the levels of application of the said rules, demands a thorough analysis of the requirements laid down in the different sectoral provisions, as well as an appropriate understanding of the long and complicated article 3 of the above-mentioned Spanish Law on Public Sector Contracts. The resulting difficult interpretation of the said provision, central focus of the subjective scope, arises, inter alia, from the use of the same definition for the delineation of two concepts: the one related to “public sector entity”, contained in the residuary clause, letter h) of article 3.1, and the “contracting authority” concept, referred to in article 3.3., letter b). A detailed examination of the aforementioned article 3, will enable us to accurately establish the level of application to the range of selected foundational entities, being necessary for this purpose, to determine their public or private nature; the type of needs they meet, and the public supervision to which they are subject. ▼ Although various pieces of European secondary law law use the terms "mise en concurrence" ("calling for competition" or "competitive tendering procedure") they provide no definition of the expression "obligation de mise en concurrence" ("obligation to call for competition"). At the very beginning, the author therefore defines what is meant thereby in his thesis, i.e. "a more or less formalized action which a public or a private person has to follow in order to provoke a competition or a contest between potentially interested persons that perform an economic activity, in order to grant an individual advantage to one or several of them". The first part of the work deals with the regime of competitive tendering of the public procurement directives which the Court of Justice has considered "as a whole" to be the "core" of European law on public contracts. First, this part examins the development of the public procurement directives from 1971 on. The author shows that the puzzling evolution of the personal scope of the public procurement directives is guided by the personal scope of European primary law. While considering the remedies directives, the author examines to what extent they introduce requirements beyond the principle of effective judicial protection. While some of their requirements obviously do so, the remedies directives however remain very far from standardizing the means of redress at national level. Due to the member States' judicial autonomy, the compelling force of EU primary law differs from one member State to another. The same applies within the scope of the remedies directives as they let the member States a large degree of autonomy. The author then turns to examine the contribution of the procurement directives 2004/17/CE, 2004/18/CE and 2009/81/CE, their scope of application, as well as the concepts of public works concession and service concession. Various other questions are dealt with in the first part, such as the use of functional interpretation, the power of the European legislator to adopt regulations on public procurement and the impact of the Agreement on Government Procurement (GPA), the Revised GPA and other international agreements. At last the author explores the issue of electronic procurement and the Commission's proposals for replacing the public procurement directives 2004/17/CE and 2004/18/CE and its proposal concerning the award of concession contracts. The second part of of the thesis focuses on primary public procurement law. After having described the origin of the obligation to call for competition under EU primary law which the Court of Justice derives from articles 49 and 56 TFEU as well as from the principles of equal treatment and non-discrimination on the grounds of nationality, the author strives to determine whether this obligation is well-founded. This examination brings to light that the rationale behind the requirement to call for competition under EU primary law is rather fragile.
