▼ Parliamentary oversight is neglected area of research in many jurisdictions and there is very limited discussion on the area. The situation in Ethiopia is not exception in this regard and it is totally neglected. Democratic government is characterized by transparency and accountability. The primary responsibility in this regard falls on the shoulder of the parliament. The parliament has the power and the mandate to oversight the executives to ensure their policy and action commensurate with the need of society. By the advent of modern parliaments, the legislative prerogative was the basic right to scrutinize government actions. The legislature, often conceived as the forum of the nation, acts as custodian of the electorate’s trust. As such, it is tasked with ensuring executive accountability through a rigorous parliamentary process that invariably assesses the performance of Cabinet Ministers and their departments. However, nowadays; the lawmakers do not seem to attach the same importance to this activity seeing it as a secondary function. In this thesis the focus is assessing whether parliamentary oversight in Ethiopia (at the federal level) is effective in ensuring
constitutionalism and accountability. To this end, the issue of the possible tools of parliamentary oversight that available to the House of Peoples Representative and the factors affecting parliamentary oversight in Ethiopia also to be dealt. The FDRE constitution empowers the House of Peoples Representative to call and question any government officials including the PM and may take any measures it deems necessary. Likewise, proclamation No.470/2005 and Regulation No.3/2006 also empowers the HPR to oversee the executive’s overall actions and activities. Thus, this research aims at examining whether the existing Ethiopian parliament is effective in discharging its constitutional mandate of overseeing the executive and to what extent oversight ensures
constitutionalism and accountability. The study examines the tools that the House uses in conducting oversight and most importantly factors affecting parliamentary oversight. The study will be conducted by analyzing pertinent laws and with theoretical and practical analysis. Accordingly, the writer argues that the existing Ethiopian parliament is ineffective in conducting effective parliamentary oversight. Thus, objective of oversight which the regulation provides, ensuring
constitutionalism, rule of law and accountability among other things remain in question. At the federal level, (in Ethiopia in general) there are different factors hindering the parliament’s oversight function. Among this factor most importantly the party system (one party domination), lack of understanding of the significance of oversight by the MP, inadequate resources like financial constraint, experts and lack of commitment and the status of legislative- executive relation are among the challenges of parliamentary oversight.

▼ My dissertation explores the theoretical foundations of what I refer to as the Canadian liberal ethos. Taking the British parliamentary revolution of 1688 as pivotal event I examine the development of political liberty in its English incarnations and trace its development as it was expressed in colonial British North America. This dissertation hopes to provide an explanatory analysis the of the liberal ethos that can: (a) contribute to understanding the pre-suppositions of liberty in a liberal democratic order, (b) contribute to an understanding of diversity and competing philosophical principles that informed the settlement of British North America and the institutionalization of the liberal ethos and, (c) consider the role that 1688-89 had on the development of political thought and the exercise of political power in British North America. This dissertation contributes to the growing literature that examines Canadian political foundations and the principles that informed it. By approaching the topic from a British perspective I hope that the theoretical and philosophical currents that emerged in 17th century Britain can be understood as they were applied to colonization of British North America.

▼ Joining in the search for a post-apartheid South
African jurisprudence, this dissertation departs from
transformative
constitutionalism, as formulated by Karl Klare.
Transformative
constitutionalism is a long-term project of bringing
about social change through the interpretation and enactment of the
constitution. Because the project envisions transformation not as
single occurrence but as a continuous process, it requires a legal
culture that is conducive to this change. Legal culture pertains to
the way in which law and legal concepts are approached. The
suggestion is that there is a continuation of a formalistic legal
culture in South Africa, and this continuation of formalism stifles
the transformation envisioned by the South African Constitution and
the project of transformative
constitutionalism. The idea of
continuation emphasises the momentum of legal culture and is
related to institutional inertia. This dissertation links
conservatism, positivism, formalism and other related concepts with
the notion of spectacle as outlined in the work of Njabulo Ndebele
and proposes that South African legal culture is a continuation of
spectacle by looking at approaches to history,
constitutionalism,
democracy and rights. The spectacle, like formalism, prefers the
determinate, values display and emphasises the external - it is an
overt and celebratory mode devoid of thought. Because the spectacle
and the continuation of a legal culture of spectacle stifles
transformative
constitutionalism, the submission is that there
should be a refusal of spectacle in South African legal culture and
a return to the ordinary. The notion of refusal comes from an
article by Karin Van Marle, and links with a critical and slower
approach. Ndebele introduces rediscovery of the ordinary, which is
related to the concept of the everyday. Opposed to the spectacle,
refusal and the ordinary favours contemplation and commemoration.
This leads to a view on approaching history,
constitutionalism,
democracy and rights as refusal of spectacle and rediscovery of the
ordinary. It is an attempt to rethink South Africa’s legal culture
in order to move closer to the aims of transformative
constitutionalism. Following the aesthetic turn in South African
jurisprudence, this dissertation makes use of literary examples to
illustrate the arguments. Ndebele’s The Cry of Winnie Mandela and
Eben Venter’s Horrelpoot introduce the themes of storytelling,
travelling and post-colonialism and aptly expands on the call for a
refusal of spectacle.

▼ This thesis offers a comprehensive view of Thai Buddhist constitutionalism, the fundamental theory on state, governance, and law in Buddhist-majority Thailand. Despite a major modernization reform over a century ago, Buddhism remains a powerful ideology of the Thai state. This thesis discusses also how Buddhist constitutionalism interacts with the modern norms of liberal democratic constitutionalism. It discovers two important features of the Thai legal system regarding religions. First, the constitutional system guarantees religious freedom but not religious equality. Second, state accommodation of a religion leads to a loss of autonomy. Thus, although Buddhism is the dominant religion, it is subject to a heavy monitoring scheme that hinders its freedom to operate. The Thai legal system shows that its understanding of human rights is different from the universal standard. This thesis argues that such arrangements are the result of Buddhist constitutionalism. Looking at various sources of contemporary Buddhism debates, the dissertation considers Buddhism’s hierarchical socio-political structure with the sacred king at the zenith, Buddhist-infused justice system and the emphasis on the Buddhist-style rule of law, as well as a notion of duty over rights. These traditional ideas clash with liberal democratic constitutionalism, which is characterized by an egalitarian political culture, the sanctity of written law, and the respect of rights and liberties. This dissonance brings tensions and conflicts, both within the religion and with other religious minorities. By exposing these difficulties, the thesis clears the way and makes suggestions for new forms of reconciliation in the constitutional field.

▼ Few observers are surprised when a victorious political candidate in the United States claims a mandate from an election. The ritual and rhetoric of mandate claiming, especially by Presidents, are so engrained in modern American politics that one can easily lose sight of the fact that mandate thinking as a major influence is of rather recent vintage and is at odds with the logic of the American constitutional system as envisioned by the Framers. Mandate thinking postulates that the public will is revealed through the ballot box and that certain elections impart a special legitimacy to the victor’s agenda. This assumption contradicts the conception of the deliberate public will that was advanced by the Framers, particularly within the Federalist Papers. This dissertation explores in depth the Framers’ notion of rule through compromise and “the deliberate sense.” The deliberate public will would emerge over time out of the possibly asynchronous input of different constituencies, undergoing a process of gradual, ongoing refinement. The Framers did not see legitimacy as rooted in the momentary majority of a nationalized electorate. The dissertation brings out this constitutionalist idea of legitimacy by comparing it to mandate thinking. The latter is carefully examined in contemporaneous political rhetoric and scholarship on the presidency and political parties, which are viewed against the background of historical and theoretical sources of mandate thinking. As the established party system grew in strength in the 19th century, mandates arose as compelling interpretations of election results. In the 20th and 21st centuries, they have been deployed most effectively by the executive branch. Within American political science, the mandate became a central, if often unstated, tenet of certain schools of thought that advocated the creation of a more "rational" electorate to deepen democracy and enable effective governance at the national level. This dissertation argues that mandate thinking is incompatible with the constitutional scheme of the Framers and indeed with the notion of republican government itself. It indicates that mandate claims, whatever their outward plausibility, constrict the space for genuine political deliberation and encourage the over-extension of the executive branch.

▼ In his influential book A Theory of Justice, John Rawls indicates his approval of an independent judiciary and judicial review for stabilizing a just regime. His later works, particularly Political Liberalism, place increased emphasis upon the Court for bringing about and securing his realistic-utopian vision of a constitutional democracy. This is highlighted by his calling the Court the exemplar of public reason; it is to take the institutional lead in re-founding the U.S. Constitution upon an overlapping consensus on issues of public morality based upon a liberal theory of justice. Democratic theorists have argued that Rawls's version of
constitutionalism is an undemocratic means of protecting democratic principles, to which Rawls responds that the initial role of assertion given to the Court can eventually be replaced by a more passive role once the overlapping consensus is adequately established. I argue that Rawls reverses the traditional understanding of change being a necessary component of continuity. ▼ The overall aim of this thesis is to assess the legitimacy of constitutional laws and bills of rights within the framework of procedural epistemic democracy. The thesis is divided into three sections. In the first section, I discuss the relevance of an epistemic argument for democracy under the circumstances of politics: I provide an account of reasonable disagreement and explain how usual approaches to the authority of decision-making procedures fail to take it seriously. In the second part of the thesis, I provide an account of the epistemic features of democracy and of the requirements of democratic legitimacy. I develop a revised pragmatist argument for democracy which relies on three presumptive aims of decision-making: justice, sustainability and concord. In the third and last section, I first argue for the desirability of
constitutionalism. I then explain why
constitutionalism, as it is usually understood, is incompatible with my procedural epistemic account of democratic legitimacy. In the last chapter, I offer a two-pronged solution to the apparent incompatibility of
constitutionalism and epistemic democracy. I first argue for the appropriateness of political
constitutionalism, as opposed to legal
constitutionalism, in understanding the relationship between rights and democracy. I then provide an account of rights protection and judicial review compatible with epistemic democratic legitimacy. Finally, I use the notion of pragmatic encroachment to explain how constitutional laws can achieve normative supremacy through the increased epistemic credentials of the procedure.

▼ This thesis offers a comprehensive view of Thai Buddhist constitutionalism, the fundamental theory on state, governance, and law in Buddhist-majority Thailand. Despite a major modernization reform over a century ago, Buddhism remains a powerful ideology of the Thai state. This thesis discusses also how Buddhist constitutionalism interacts with the modern norms of liberal democratic constitutionalism. It discovers two important features of the Thai legal system regarding religions. First, the constitutional system guarantees religious freedom but not religious equality. Second, state accommodation of a religion leads to a loss of autonomy. Thus, although Buddhism is the dominant religion, it is subject to a heavy monitoring scheme that hinders its freedom to operate. The Thai legal system shows that its understanding of human rights is different from the universal standard. This thesis argues that such arrangements are the result of Buddhist constitutionalism. Looking at various sources of contemporary Buddhism debates, the dissertation considers Buddhism’s hierarchical socio-political structure with the sacred king at the zenith, Buddhist-infused justice system and the emphasis on the Buddhist-style rule of law, as well as a notion of duty over rights. These traditional ideas clash with liberal democratic constitutionalism, which is characterized by an egalitarian political culture, the sanctity of written law, and the respect of rights and liberties. This dissonance brings tensions and conflicts, both within the religion and with other religious minorities. By exposing these difficulties, the thesis clears the way and makes suggestions for new forms of reconciliation in the constitutional field.

▼ This research thesis is prompted by the North African Revolution of 2011 that toppled President Ben Ali
of Tunisia, Hosni Mubarak of Egypt and Muammar Gaddafi of Libya. Exploring the causes, triggers,
chronologies and consequences of the North African Revolutions as well as evaluating the response of
the African Union to the North Africa Revolutions in general and the Libyan civil war in particular is the
central mission of this thesis. Since diplomacy was the pathway followed by the African Union to resolve
the Libyan civil war, this paper examines the adequacy and efficiency African Union’s diplomacy and
political solutions to the Libyan civil war.
One of the major issues which is extensively discussed in this thesis is the relationship between North
Africa Revolutions and the African Union normative frameworks and instruments governing democracy,
constitutionalism and unconstitutional change of government. Solving the puzzle whether Revolutions
are legitimate rights of the people under the African union normative and policy frameworks is the crux
matter of this paper. The adequacy and potential of the African Peace and Security Architecture to
respond to Revolutions is also inspected.
Concerning the Responses of the African Union to the North Africa Revolution and the Libyan civil war,
this paper contends that, even if the support of the African Union to the Revolutions is unequivocally
clear, its responses however are slow and weak. Moreover, the African Union was also effectively
ignored, marginalized and sidelined by external actors, such as the Western Nations and North Atlantic
Treaty Organization.
On the relationship between the North Africa Revolutions and the African Union normative frameworks
governing democracy,
constitutionalism and unconstitutional change of government, this thesis is of the
opinion that there exists no inherent contradiction between the two. Revolutions are morally required
and legally permissible under various African Union norms and legal instruments.
Finally, by taking some basic lessons from the nature and consequences of the North African Revolutions,
some recommendatory points are forwarded to the African Union and its member states so as to tackle
the causes of future Revolutions in Africa. Besides, due to the failures the African Union political solutions
to the Libyan crises and the resulting foreign military intervention, some proposals are suggested
towards an effective implementation of Article 4(H) of the constitutive act of the African Union which
empowered the Union to intervene in a Member State in respect of grave circumstances, namely war
crimes, genocide and crimes against humanity. Lastly, since the Libyan civil war has exposed not only the
existence of serious rift between the African Union and Western powers, but also the marginalization of
the African Union by the latter, some practical solutions to advance the principle of “African solutions to
African Problems” are provided so as to avoid the marginalization of African Union by external actors on
matters…

▼ China's thirty years of economic development has brought on a number of crippling problems: high inequality, unbalanced development, environmental degradation and so forth. Arguably all of them coincide with China's long-enduring absence of a full-fledged legal system that could balance state power and human rights, in another word, the "rule of law". Looking into reform advancement and regression of China's legal development, this thesis argues that a "rule of law" regime as proposed by Pan Wei would either fail to come into being, or will not do the job, without constitutional and legislative reform. This thesis argues that China's centuries-old civic project is one focusing on building constitutionalism, and a Chinese Socialist Constitutional State conducive to Socialist democracy as proposed in the thesis would better reconcile the needs of the Party and society at this critical juncture, as well as in the long run.

▼ Several problems disquieting the developing world render the post-colonial state unstable, with recurrent, often violent conflict. The seeming incurable vulnerability of the nation-state construct reflects inherent problems in its basic constitutional philosophy for managing diverse identities in the global South. It suggests an incapacity for equality and justice, undermining the moral legitimacy of the colonial-state model. This is illustrated using Central Nigeria or Nigeria’s ‘Middle- Belt’ through numerous identities, largely veiled in non-recognition and misrecognition by the colonial and post-colonial state and its conflicts. The baggage of colonialism stalks the developing world through unjust socio-political orders. Therefore, the post-colonial liberal constitution (using Nigeria’s 1999 Federal Constitution) and mechanisms it imbibes for managing diversity (Consociationalism, Federalism/Federal Character, Human Rights, Citizenship), is exposed to be seriously misconceived epistemically and cartographically. I argue that effective peacebuilding in the global South is impossible without Cognitive Justice, which is 'the equal treatment of different forms of knowledge and knowers, of identities’. I articulate a political constitutional philosophy grounded upon Cognitive Justice as a conception of justice, advancing normative and conceptual frameworks for just post-colonial orders. This provides foundations for a proposed reconceptualisation and restructuring of the institutional and structural make-up of the post-colonial state through a ground-up constitution remaking process, for new orders beyond colonially stipulated delimitations. In search of appropriate constitutional designs, I engage Multiculturalism, National Pluralism and Plurinational State scholarship by Western Political Philosophers and Constitutional Theorists (Kymlicka, Taylor, Tully, Keating, Tierney, Norman, Anderson, and Requejo etc), as they address particularly the UK, Canadian and Spanish cases, as well as Awolowo’s philosophies. I also engage recent plurinational constitutional designs operational in Ecuador and Bolivia, and propose that the latter hold more appropriate conceptual and structural pointers for effective peacebuilding in the troubled, pluralist global South.

▼ Abstract: This dissertation justifies a general republican theory of how and why modern courts and legislatures should pursue constructive dialogues about legal rights. It provides a general theory for why constructive dialogue might realize freedom from domination, an explanation of how republican citizens should reason about rights, and applies the general theory to the “new commonwealth model” of
constitutionalism. In the first chapter it distinguishes between three reasons and corresponding norms of dialogue: interrogative dialogues, which require courts to assess legislative reasons for justifiably violating rights; interruptive dialogues, which require courts to interrupt statutes threatening rights but then defer to legislative replies; and constructive dialogues, which require courts and legislatures to share and take responsibility for the role of specifying indeterminate rights. Only constructive dialogue will realize the equally shared control of the citizenry over the legal functions of modern courts and legislatures. The second chapter explains the theory of rights underpinning the interrogative conception of dialogue, and argues that this conception of rights is at odds with legally finite rights, and also with two basic desiderata necessary for it to connect with justice: relational consistency and normative conclusiveness. The third chapter develops a republican-specificationist theory of practical reasoning about rights, and argues that republican citizens must prioritize the political justice of freedom from the state over patterns of social justice in order for their reasoning to be consistent and conclusive. This recursively reinforces the claims of the first chapter regarding the justification of the norm of constructive dialogue. The final chapter models how the pre-enactment rights review and non-final judicial review of the “new commonwealth model” is dependent on the norm of constructive dialogue. It demonstrates how the Canadian constitutional version of this model is uniquely dependent on a Madisonian form of co-ordinate construction, and vulnerable to interrogative and interruptive dialogues. It also demonstrates how the New Zealand and UK statutory bills of rights constitute their own model with its own form of potential constructive rights dialogue. Constructive rights dialogues between courts and legislatures are justified as part of the republican watchword: audi alteram partem (listen to the other side).

▼ Amidst the global wave of democratization, modernization, and economic engagement during the 1980s and 1990s, the traditional tenets of constitutionalism have proven to be unwieldy dogma for States undergoing periods of rapid transition. In order to retain the administrative capacity to steer – rather than merely adapt to – political and social change, numerous transitioning States have adopted a new paradigm of constitutionalism, namely transitional constitutionalism, characterized by a centralized and streamlined structure of governance. However, in many instances, including Korea’s post-division transitional history, this model has demonstrably undermined fundamental human rights protections. In this thesis, I propose a hybrid constitutional paradigm for unification in Korea (another form of State transition) which seeks to balance the dual objectives of effective governance and human rights protection. I do so by examining and critiquing the core principles of traditional and transitional constitutionalism, outlining the human rights issues that the unified Korea will likely confront in its constitutional trajectory based on an analysis of Korea’s political, social, cultural, and constitutional history, and finally proposing a hybrid model of constitutionalism that utilizes an institutional approach to prevent violations of human rights in the unified Korea while allowing the State to retain governmental efficiency during transition.

▼ The Chartist movement was the mass-movement for constitutional reform in mid-nineteenth-century Britain. Chartism is one of the most written about subjects in modern British history, yet the ideas of the movement remain strangely neglected. This thesis tackles this problem by examining Chartist ideas along a broad front. By examining the political thought of a movement, rather than a select number of highly educated intellectuals, this thesis also makes a statement about how to study popular political ideas. Chapter One locates the foundations of Chartist political thought in the movement’s social and cultural context. It asks what the Chartists read and were able to read, how they viewed knowledge and education, and the religious basis of Chartist intellectualism. Chapter Two turns to Chartist political theory, in particular, the Chartist interpretation of the British constitution. It is shown that Chartists drew on a sophisticated conception of the common law that rooted the British Constitution in natural law. Chapter Three considers Chartism’s economic ideas, which, it is argued, must be understood in relation to their understanding of classical political economy. Chapter Four examiners Chartist natural-right arguments alongside the ideas of non-Chartist radicals. Finally, Chapter Five traces the careers of a number of Chartists and the influence of Chartist ideas in America. It also attempts to take account of what Chartism meant to Americans. By considering these topics, this thesis provides a clearer impression of why ideas were important to the Chartists, what sort of ideas the Chartists held, and the legacies of Chartist ideas for democratic politics later in the century.

▼ From the European Wars of Religion to post-colonial independence struggles, and on to calls for minority rights and freedoms in Tibet, Kurdistan and beyond, liberals have always been moved by the desires of different individuals to live by different mores and systems of government. By offering a liberal theory of federalism that can equip us with both an account of legitimacy and an institutional structure capable of effectively navigating the diversity endemic to human society, this thesis seeks to carry forward the liberal project of doing justice to what John Rawls famously called “the fact of pluralism.” The liberal theory of federalism rests on a minimalist conception of liberalism, which holds that individuals should be free to live as they see fit, provided they do not stop others from living as they see fit. This in turn yields an account of legitimacy according to which any institutional structure whatsoever is legitimate, with the sole proviso that it not stop individuals from living as they see fit. This thesis fashions minimalist liberalism into a direct justification of the defining strengths of federal systems. By constitutionally enshrining constituent unit autonomy, federal systems are able to both protect negative liberty and promote democratic accountability. The liberal theory of federalism does not shy away from acknowledging that there is no guarantee that any given federal system will realise the liberal goal of doing justice to the fact of pluralism. Nonetheless, federalism offers the hope of a more perfect union between institutional structures and how individuals would like to live: As a means of limiting centralised power and giving more political autonomy to sub-state groups, federalism is another constitutional tool for ensuring that, as Benjamin Constant might have put it, the interests of individuals are “united when they are the same, balanced when they are different, but known and felt in all cases.”

▼ This Master’s Thesis contributes to the theoretical approach of ‘economism’ developed by Teivo Teivainen as well as the theoretical discussion on the changing responsibilities of foreign ministries and the influences of modern neoliberal economic principles on foreign policy. The case study of this research is the Ministry of Foreign Affairs of the Republic of Latvia. The aim of the research therefore was to examine if and how economism manifests itself in the responsibilities of the Ministry of Foreign Affairs with regards to Latvia’s external economic relations. This research contributes to the theoretical stances of economism by developing a set of conceptual principles and exercising them on the Ministry of Foreign Affairs. A discourse – containing arguments and principles expressed by interviewed officials and conceptual foreign policy documents – is screened for the presence of these predefined principles of economism. The documents regulating the responsibilities of the Ministry of Foreign Affairs are subjected to a diachronic comparative analysis to identify whether the political influence and responsibilities of the Ministry have diminished over the time and if a constitutionalization of economism has taken place. The analysis reveals a constitutionalization of economism through a gradual reduction of responsibilities and political influences of the Ministry since the beginning of 1990s. The control and political influence that the Ministry had after the collapse of the Soviet Union was reduced, liberalizing economic relations and opening the market. The MFA's responsibilities and influences have been adjusted to the needs and demands of the business sector – the promotion of domestic businesses abroad and the attraction of the foreign investors. The embassies and the MFA add ‘political muscle’ by demonstrating support for the business sector rather than by constraining it. The main responsibilities left for the MFA and embassies are the representation of businesses, occasional assistance for citizens, expert advice to the host state and improving the image of the country. The presence of the principles of economism within the discourse is not unequivocal. The economic rationale does not dominate the discourse of the responsibilities of the MFA. Economic rationale and even boundary creation itself is largely absent from the discourse constituted by the principles within the documents regulating the functioning of the MFA. Even more, the discourse constituted by the principles expressed by the officials in the interviews for this research does not reveal strong dominance of economic rationale either. Present principles show support for apolitism in state affairs and limitations on external sovereignty. At the same time, there are also strong opposing views, especially with regards to the limits of democracy and internal sovereignty. Although the idea of constitutionalism dates back to antiquity, the Constitutionalism in the form conceived today emerged as a political, social, philosophical and cultural movement to question the political domain and for the establishment of documents which consolidate liberal principles, aimed at countering the absolutism and seeking the limitation of Power the division of powers and the guarantee of rights. So, for Constitutionalism the aim lies in the protection that is won in favor of individuals, and the Constitution is the written document on
which the legal system is based and reasoned, freedoms are declared, rights are established and limits of political power are set. The classic or liberal Constitutionalism, thought during the absolutist regime in the eighteenth century with the aim to recognize and make positive the rights of freedom and equality has evolved over the centuries and new rights were incorporated into the Constitutional Charters. Therefore we have new ways of conceiving Constitutionalism: liberal or classical, contemporary or neoconstitutionalism. Latin America, which was subjected to a colonization of exploitation, was forced to accept the determination of the metropolis, also with regard to the legal system and institutions. Thus, the Constitutionalism of Eurocentric and North American origin, by the colonizers imposed, was very distanced from the social, cultural experienced by the peoples of the region. This distance between the abyssal Latin American reality and the constitutional postulates,
determined the rise of social movements, especially peoples of peasant indigenous origin - who had their cultures violently erased - movements that demand the rescue of their own history and recognition of their identities. Thus a constitutional movement appears to meet new social demands, which calls for another conception of the state with emphasis on plurinationality, on interculturalism, on legal pluralism and suggests an ecocentric turn, breaking the traditional anthropocentric logic and presenting the good life philosophy and the constitutionalisation of the rights of nature. The innovations introduced by this new thinking represent the way to a Decolonization Constitutionalism aiming at the emancipation of peoples of peasant indigenous origin and the achievement of a decent life in harmony, respect and balance with nature

Pour ce faire, le développent des conditions de la création l’implémentation progressive du contrôle a posteriori entre le XVIIIème et XXème, a permis la création d’une actio popularis. Le droit constitutionnel français que le droit constitutionnel colombien possèdent de mécanismes processuels dont les composants favorisent et relient la citoyenneté aux processus qui étaient auparavant à l’usage exclusif de ses représentants. Le but de cette étude est donc de réfléchir sur l’origine des fondements de l’incidence du droit du contentieux constitutionnel dans la préservation de la Constitution comme base de l’État.
If we analyze a posteriori constitutional review of legislation in Comparative law, it will show that State preservation can be made from the individual point of view by an action popularis. Therefore, both the French and the Colombian constitutional law whose components have procedural mechanisms foster a new citizenship in processes that were previously in the hands of their representatives. This essay aims to consider the influences of Procedural Constitutional Law in the preservation of the Constitution as the State’s cornerstone.

▼ Este estudo tem por objetivo principal verificar a participação da Justiça Constitucional na concretização dos Direitos Fundamentais. Para tanto, estabeleceu-se como ponto de partida as mudanças trazidas pelos novos ideais discutidas no constitucionalismo contemporâneo. A crescente preocupação com a efetividade dos Direitos Fundamentais e a ampliação do conteúdo material da Constituição impõe uma atuação cada vez mais abrangente da Justiça Constitucional e a necessidade de reformulação da compreensão de sua função interpretativa. Assim, o trabalho divide-se em três etapas distintas. Em um primeiro momento, a abordagem se inicia na análise da relação existente entre o Estado e a Constituição, bem como sua gradativa evolução até a formação do Estado Constitucional e, consequentemente, do constitucionalismo contemporâneo. Em seguida, o estudo propõe a análise do novo‟ Direito Constitucional, abordando as diferentes terminologias que vem sido adotadas para definir o atual momento de mudança de concepção das idéias sobre Constituição e suas consequências trazidas para o Direito na temática da constitucionalização do Direito e na busca pela concretização dos Direitos Fundamentais. Por fim, o estudo se concentra nas atividades da Justiça Constitucional e a identificação da sua relação com o constitucionalismo contemporâneo para fins de concretização dos Direitos Fundamentais
This study aims to evaluate the role of Constitucional Justice in the implementation of Fundamental Rights. To that end, it was established as a starting point the changes brought about by new ideas discussed in contemporary constitutionalism. The increasing concern over the effectiveness of Fundamental Rights and the expansion of the substantive content of the Constitution imposes a more comprehensive role of Constitutional Justice and the need to recast their understanding of the interpretative function. Therefore, this work is divided into three distinct stages. At first, the approach begins on the analysis of the relationship between the State and the Constitution, and its gradual evolution to the formation of constitutional state and thus of contemporary constitutionalism. Then, the study proposes the analysis of the new Constitutional Law, approaching the several terminologies that have been adopted to define the actual moment of changing of the conception of ideas about Constitution and its consequences brought to the Law on the theme of constitutionalization of the law and in seeking the concretization of Fundamental Rights. Finally, the study focuses on the activities of the Constitutional Justice and the identification of its relationship to contemporary constitutionalism in attaining Fundamental Rights

▼ Emergente a partir do final do século XX, o constitucionalismo popular enquanto campo acadêmico, tem buscado desconstruir a narrativa que legitima a afirmação da supremacia do judicial review estadunidense. Segundo seus expoentes, o melhor desenho envolveria a interpretação política, e não legal, da Constituição. Selecionados os exemplos de Larry Kramer, Mark Tushnet e Jeremy Waldron, o trabalho buscará abordar seus argumentos desde um ponto de vista individual, mas também os elementos que lhes são comuns. Nesse sentido, além da ofensiva à revisão judicial, busca-se identificar os debates que se fazem presentes, e atravessam o campo, tais como a utilidade de um tribunal que traga estabilidade ao sistema político, a ideia de melhor intérprete, a questão contramajoritária e o ideal de autogoverno democrático, em uma sociedade contemporânea atravessada pelo desacordo. Considerados os argumentos, busco chamar a atenção para a parcialidade do pensamento
dominante, cuja recepção se ampara sobre bases problemáticas.
Since the late twentieth century, popular constitutionalism has risen as an academic field that seeks deconstructing the narrative that justifies the affirmation of the supremacy of the American judicial review. According to its supporters, the best design for it would not involve the legal, but the political interpretation of the constitution. Selecting the examples of Larry Kramer, Mark Tushnet and Jeremy Waldron, this work aims at addressing their statements not only as individual points of view, but also considering the elements they have in common. In this sense, besides being an assault on judicial review, this texts focuses on identifying the debates that arise and crisscross the field, such as the usefulness of a court which brings stability to the political system, the idea of best constitutional decision-making, the countermajoritarian difficulty, and the ideal of democratic self-government in a contemporary
society pervaded by disagreement. Taking such issues into consideration, I propose drawing attention to the bias of mainstream constitutional thinking, whose reception lies on problematic bases.

▼ The various independent chiefdoms that make up
present day Malawi had a new constitution imposed over all of them
by the British government without their consent. This new
superimposed constitution was never really embraced by the various
tribal groups. Its tenets were never internalised by the people and
this lack of internalisation has continued to this day. The elite
of the day decided which principles would govern the country.
Successive elite groups in different periods of Malawi’s history
have imposed their brand of
constitutionalism on a hapless people.
They have dutifully put in writing the constitutional principles
without intending to apply them. Malawi is a nation that embraced
constitutionalism with one reason only, that is, to gain acceptance
from its peers in the international community. Throughout its
history from pre-colonial times to the present, the general
population has never been involved in framing the principles which
govern and shape the destiny of the nation. A small group of people
has always decided what the constitution should contain. The
dominant man of the moment (the big man) and his political party
decide what
constitutionalism is to be. They govern the country
through patronage. The president and a small group around him use
state resources to promote their agenda often at the expense of the
constitution they swore to uphold. The political leaders do not
differentiate between resources of the state, the private sector
and their ruling party and they often use them to peddle influence
to promote their programs that are sometimes in violation of the
constitution. When the president “donates” state resources to the
poor communities, he tells them that he used his own money to buy
the item he is donating, for example an ambulance, and nobody dares
to contradict him. Only in financial matters has the nation
demonstrated some marked commitment to the rule of law. The
incentive for the government to comply with the law is much higher
because about 80 percent of its capital budget is financed from
external sources through donations, loans and grants from western
nations. Government tends to take action against public officers
who do not follow constitutionally laid down principles. Its
commitment to the rule of law on social and political governance
issues is not consistent. It appears to pick and choose which
constitutional principles it will adhere to. In conclusion, it is
difficult for Malawi to experience a government that adheres to the
principles of
constitutionalism because its widespread poverty
helps entrench a system of patronage. This system has created a
nation that tolerates serious abuses of its constitution.
Transformative
constitutionalism appears to offer the best hope for
Malawi’s future. The nation needs a judiciary that is more
innovative and bold in interpreting, upholding and enforcing its
own constitutional tenets. Only then will the nation be on a sound
footing to realise the benefits of
constitutionalism for its
people.

▼ This dissertation explores the place that jus cogens
occupies in contemporary international legal thought and practice.
More specifically it looks at the place that the concept occupies
within the discourse surrounding
constitutionalism in international
law. The question is asked whether it is viable to posit a specific
constitutional structure for international law and whether such
structure can be legitimized by the existence of certain values
that are held in common by the international community. Both
structural and value-based approaches posit a place for norms of
jus cogens as possibly being seen as constitutional norms to some
extent. Jus cogens as a now widely accepted concept in
international law, continues to be the
subject of much contemporary
debate. The nature and function of the concept as proposed by
various authors is looked at and the problematic aspects set out.
Although there is a large amount of literature acknowledging the
existence and importance of jus cogens, this has not been supported
by international judicial practice. It seems that it is the
practical difficulties surrounding the functioning of normative
hierarchy that is the main reason for this. Chapter 1 introduces
the approaches to the
constitutionalism debate that have posited a
legitimate place for norms of jus cogens. It also provides an
introduction to the concept of jus cogens within contemporary
international law. Chapter 2 starts out by defining certain
concepts involved in the discourse surrounding
constitutionalism.
The strands of thought involved in the
constitutionalism debate are
then set out in order to provide the context for the placements of
jus cogens posited by various authors. Chapter 3 looks at the
evolution of the concept of jus cogens and the limited practical
effect that has been given to the concept in international judicial
practice. The main consideration here is the perceived
inapplicability of jus cogens within cases concerning
jurisdictional immunity. It therefore seems that jus cogens is, in
general, limited to application against rules directly
contradicting the substance of the jus cogens norm. Chapter 4
provides a critique of normative hierarchy theory, which is a main
aspect dealt with in much constitutionalist thought. The chapter
shows how the proposed functionality of normative hierarchy theory
is unconvincing as only negative prohibitions can function as jus
cogens under this construction. This further limits the instances
where jus cogens can be seen as effective under constitutional
thought. Chapter 5 concludes that under a strict conception of
normative hierarchy, jus cogens is unlikely to receive much
practical legal effect. This is due to the inapplicability of jus
cogens in procedural matters and the limited number of norms that
can function as jus cogens under normative
hierarchy.

existence and importance of jus cogens, this has not been supported
by international judicial practice. It seems that it is the
practical difficulties surrounding the functioning of normative
hierarchy that is the main reason for this. Chapter 1 introduces
the approaches to the
constitutionalism debate that have posited a
legitimate place for norms of jus cogens. It also provides an
introduction to the concept of jus cogens within contemporary
international law. Chapter 2 starts out by defining certain
concepts involved in the discourse surrounding
constitutionalism.
The strands of thought involved in the
constitutionalism debate are
then set out in order to provide the context for the placements of
jus cogens posited by various authors. Chapter 3 looks at the
evolution of the concept of jus cogens and the limited practical
effect that has been given to the concept in international judicial
practice. The main consideration here is the perceived
inapplicability of jus cogens within cases concerning
jurisdictional immunity. It therefore seems that jus cogens is, in
general, limited to application against rules directly
contradicting the substance of the jus cogens norm. Chapter 4
provides a critique of normative hierarchy theory, which is a main
aspect dealt with in much constitutionalist thought. The chapter
shows how the proposed functionality of normative hierarchy theory
is unconvincing as only negative prohibitions can function as jus
cogens under this construction. This further limits the instances
where jus cogens can be seen as effective under constitutional
thought. Chapter 5 concludes that under a strict conception of
normative hierarchy, jus cogens is unlikely to receive much
practical legal effect. This is due to the inapplicability of jus
cogens in procedural matters and the limited number of norms that
can function as jus cogens under normative hierarchy.

▼ La laïcité et le nationalisme, en tant que principes fondateurs de la République de Turquie, forment son noyau identitaire qui donne à l’ordre constitutionnel sa spécificité. La laïcité, qui a réalisé le principe de séparation de l’État et de la religion, a maintenu la religion sous son contrôle. Le nationalisme construit en réaction au démembrement de l’Empire ottoman a affirmé l’indivisibilité de l’État du point de vue de son territoire et de sa nation. Cette dernière est comprise comme essentiellement turque et musulmane. Les notions de laïcité et de nationalisme, compte tenu de la place et de la valeur qui leur sont reconnues dans l’ordre constitutionnel, irriguent l’ensemble de l’ordre constitutionnel et constituent un étalon de référence. En ce sens, elles sont des principes « structurants » de l’ordre constitutionnel qui entretiennent des rapports ambigus et contradictoires aussi bien avec la religion qu’avec la démocratie.
Nationalism and secularism are the core principles that create the constitutional order forming the Republic of Turkey. Secularism achieves the separation of State and Church, but also establishes the control over religion. Nationalism permitted to preserve the State against the threat of being shattered at the fall of the Ottoman Empire. Since then, it expresses the indivisibility of the State with its territory and nation. At the same time, it maintains religion as part of the national identity, which is also defined as Turkish. Both notions lead to ambiguity and paradoxes which are revealed by democracy. Considering their place and value in the constitutional order, nationalism and secularism can be regarded as structuring principles (“principes structurants”) which give the constitutional order of the Republic of Turkey its particularities.

▼ Malgré la distance entre ces deux mouvements révolutionnaires, est-européens et du monde arabe, le constitutionnalisme a été le moyen immédiat pour sortir du chaos révolutionnaire. Dans ces deux parties du monde, à deux périodes différentes, les peuples révolutionnaires ont choisi d’adopter des Constituons afin d’instaurer des régimes politiques démocratiques.Si le constitutionnalisme a été le dénominateur commun que les peuples révolutionnaires ont utilisé pour instaurer leurs nouveaux régimes politiques qu’ils souhaitent démocratiques, pour autant, la singularité de chaque région et de chaque pays s’est imposée lors de la transition, mais également lors de l’adoption des nouvelles Constitutions. Déjà, il suffit d’observer la situation de la Pologne, de la Roumanie, de l’Égypte et de la Tunisie pour constater que la voie empruntée pour adopter un nouveau régime politique dépend nécessairement du contexte national dans lequel la transition est engagée.Néanmoins, la démocratie ne se décrète pas comme nous avons eu l’occasion de le voir en Europe de l’Est. Les États postcommunistes, notamment la Pologne et la Roumanie, tergiversent encore sur le chemin de la démocratisation. Les États arabes trouveront sur le chemin de la démocratisation certainement les mêmes défis. Quelques années après le « printemps arabe », la Tunisie, et encore davantage l’Égypte, vacillent sur le chemin risqué de la démocratisation.
Despite the distance between these two revolutionary movements: East European and the Arab world, constitutionalism was the immediate way out of the revolutionary chaos. In these two parts of the world, at two different periods, the revolutionary peoples have chosen to adopt Constitutions in order to establish democratic political regimes. While constitutionalism has been the common denominator that revolutionary peoples have used to create their new democratic political regimes, the singularity of each region and country has emerged during the transition of the adoption of the new Constitutions. It is simply enough to observe the situation in Poland, Romania, Egypt and Tunisia to find that the path taken to adopt a new political regime necessarily depends on the national context in which the transition is initiated. Nevertheless, democracy cannot be decreed as we have seen in Eastern Europe. The post-communist states, notably Poland and Romania, are still on the path of democratization and the Arab States will find the same challenges on the road to democratization. A few years after the "Arab spring" occurred, Tunisia and particularly Egypt falter on the risky path of democratization.

Stvaranje Evropske unije bespovratno je narušilo
tradicionalno ustrojstvo drţava, pa i samog meĊunarodnog poretka.
Uspostavljanje strukture koja obuhvata više centara moći u okviru
kojih se (ne)ravnopravno donose odluke od znaĉaja za ţivot graĊana,
uticalo je na slabljenje nacionalnih, a nedovoljnu samostalnost
nadnacionalnog nivoa unutar nje. Stalno pregovaranje i lobiranje na
kojima poĉiva Unija pruţa mogućnost za ostvarivanje ciljeva
pojedinih interesnih grupa i drţava. Koncept demokratije je ovakvim
stanjem najviše izgubio. Pojаm demokrаtije je teško definisаti,
isto koliko je komplikovаno pronаći kriterijume za njeno
identifikovanje a koji su primjenljivi nа sve politiĉke sisteme.
Situаcijа se dodаtno usloţnjаvа kаdа je ove kriterijume neophodno
prepoznati u okviru nedovršenog politiĉkog sistema kаkаv je onаj u
Evropskoj uniji. Problemi u demokrаtskoj legitimizаciji Unije, koji
se jаvljаju uporedo sа uspjesimа u integrаciji, otvаrаju pitаnje
primjenljivosti “stаndаrdnog“ modelа demokrаtije nа ovu tvorevinu.
Prirodа funkcionisаnjа Evropske unije, u kojoj je na snazi
uprаvljаnje nа više nivoа, zаhtijevа prilаgoĊаvаnje demokrаtskih
principа njenom specifiĉnom politiĉkom sistemu. Mada ne postoji
konsenzus meĊu teoretiĉаrima koji su dali doprinos objašnjavanju
pojma demokratije u Evropskoj uniji dа li postoji demokratski
deficit unutar nje, kаo ni koji su nаjbolji uslovi zа rаzvoj
аutentiĉne demokrаtije u EU, moguće je identifikovati brojne
strukturne probleme demokratije u politiĉkom sistemu Evropske
unije. U okviru postojećeg institucionаlnog mehаnizmа Evropske
unije problemi nastaju usljed isprepletenih nаdleţnosti izmeĊu
institucijа i osjetnog jаĉаnjа izvršne u odnosu nа zаkonodаvnu
grаnu vlаsti. Centrаlnu ulogu od institucija imа Sаvjet koji
funkcioniše po principu meĊuvlаdine sаrаdnje. Prаktiĉno nijednа
evropskа politikа ne moţe se usvojiti bez djelovаnjа ove
institucije i uplitаnjа drţаvа ĉlаnicа, što Savjet ĉini glavnim
zakonodavnim tijelom Unije. Evropski parlament, sa druge strane,
iako neposredno izabran, zbog svojih još uvijek ogrаniĉenih
nаdleţnosti, i dаlje je glаvni uzroĉnik demokrаtskog deficitа u
Uniji. Stoga bi talas demokratizacije institucija Unije trebalo da
obuhvati „prelivаnje“ moći sа Sаvjetа nа Evropski pаrlаment i
jаĉаnje meĊuinstitucionаlne sаrаdnje izmeĊu Evropskog pаrlаmentа i
Evropske komisije. Evropskа unijа nemа ureĊenje poput trаdicionаlne
nаcionаlne drţаve. Ne postoji ni demos nа evropskom nivou, te,
stoga, nemа ko dа obezbijedi neophodni legitimitet evropskim
politikama. Iako je nesumnjivo da politike Evropske unije proizvode
velike koristi zа njene grаĊаne, ovа reаlnost, zаjedno sа
rаzvijenim mehаnizmimа konsultovаnjа sа grаĊаnimа, ipаk ne umаnjuje
kljuĉni problem u komunikаciji Unija – graĎani: mаnjаk аdekvаtnog
predstаvljаnjа grаĊаnа, što je zа zаjednicu kojа se u svojim
osnivаĉkim dokumentimа deklаriše kаo predstavniĉka ipak nedostаtаk.

▼ This dissertation demonstrates that inherent Anishinaabe (Ojibwe) citizenship law exists, and can be seen through adoption practices used by Anishinaabe families. For more than 165 years, Indigenous citizenship orders have been targeted by Canadian society through its laws, such as the Indian Act and its pre-cursor legislation. As I argue in this dissertation, however, inherent Anishinaabe citizenship law is based on the authority of Anishinaabe families to discern who belongs. By focusing on adoption narratives carried by thirteen knowledge holders from Fort William First Nation (an Anishinaabe community in Ontario, Canada), the dissertation shows that belonging according to inherent Anishinaabe citizenship law is not dependent on the Indian Act or its status logics. Rather, the knowledge holders demonstrate that, when seen through adoption stories, Anishinaabe citizenship is based on values of full inclusion, accountability to community, non-essentialism, and decentralized decision making. This dissertation contributes to literatures concerned with the resurgence of Indigenous citizenship orders, treaty
constitutionalism, as well as biskaabiiyang and indigenist research methodologies.
