law in
constitutional reform in post- independence Kenya.
International law has played a critical role in the nation’s
constitutional review process that culminated in a new constitution
in 2010. It has also determined much of the content of the new
document. This thesis argues that injecting international norms
into the
constitutional order services the emancipation of the
Kenyan legal system. The application of international law and
standards in the Kenyan
constitutional order helps emancipate the
law from the legacy that colonialism left upon the legal system. In
support of this central claim, the thesis first addresses the role
of international law in the design and
reform of the new
constitution and the new judiciary. It disputes concerns about the
‘hegemonic’ or ‘homogenising’ force of international law.
Both the
constitutional and judicial review process, and the
assimilation of international norms into the document, were adapted
in order to respond to the nuanced demands of the Kenyan state. The
thesis then turns its attention to the application of these norms
in the Kenyan courts. It is posited that the domestic judiciary
indigenises and hybridises international norms in a way that
unlocks the counter-hegemonic potential of international
law.

▼ Indonesia in the past was a region long under the colonial rule of Netherland. It was not until the era of president Sukarno that it became an independent country. He established the 1945 constitution on the basis of the Pancasila principles. Indonesia then undertook three temporary constitutions until the presidency of president Soeharto, when the 1945 constitution was finally established as the fundamental law of the country. Vice president B.J.Habibie then succeeded president Soeharto after he was forced to resign under pressure of the financial crisis. A series of
constitutional reforms have been taken since in an attempt to solve the problems created during the authoritarian reign of president Soeharto, and to create a more democratic Indonesia.
Through the review of literature, this thesis reviewed the process and outcomes of the four
constitutional amendments since president Soehartoâs resignation, which includes the
reform of the presidentâs power and term, limitation of the militaryâs involvement in social and political issues, judicial reforms, and the structural as well as functional
reform of the parliament. This thesis analyzed the impact of the four amendments on the democratization of Indonesia, the governmental system, and state reforms, with further analysis of the needs for future
constitutional amendments and democratization.

▼ This thesis examines the feasibility of lay citizen participation in the process of
constitutional reform in Australia. While there have been increasing calls in recent decades for members of the general public to be more deeply involved in debates about
constitutional change, there has been little scholarly inquiry into whether this is achievable. This thesis fills this gap by providing a detailed assessment of how individuals get involved in
constitutional debate, and whether it is feasible for public involvement to become a more central component of Australia's constitutional
reform process. The thesis' theoretical framework is provided by participatory and deliberative democratic theories. Together, these theories provide a rich conception of citizen involvement that emphasises the ideals of broad participation, sound judgment and inclusiveness. The thesis' empirical analysis is structured around discussion of five challenges to participation that emerge from this theoretical literature: citizen willingness, equal participation, citizen competence in developing sound judgment, citizen competence in engaging in quality deliberation, and legitimacy.The thesis approaches these issues through a detailed examination of lay citizen participation in Australian
constitutional debates during the period 19911999. It adopts a mixed methods approach, combining analysis of three main data sources: the 1999 Australian
Constitutional Referendum Study, primary documentary material on the debates of the 1990s, and focus group interviews on perceptions and attitudes towards
constitutional reform. The thesis' central argument is that greater lay citizen participation in the process of
constitutional reform is achievable provided that, in the design of that process, careful attention is paid to a complex set of factors that foster and inhibit it. These factors are identified and discussed throughout the thesis and include the provision of participatory activities that are responsive to diverse personal motivations, the availability of opportunities for small-group deliberation, the tailoring of participation and information to the needs of particular groups, and the use of mechanisms that balance the quantity and quality of participation. The thesis concludes with a discussion of the practical applications of its research findings for future
constitutional reform processes, particularly in relation to exploiting citizen capacities, mitigating inequality, and enhancing legitimacy.

▼ Using a historical institutionalist approach, my study seeks to fill an important gap in the law, politics, and development literature by exploring how conflict states use constitutional reform to foster development and democratic transition, particularly among countries that have emerged from civil war. These include the United States, Spain, and Sri Lanka, which, in each of the past three centuries, have experienced civil wars yet emerged in a more peaceful and stable condition in the decades to follow. Despite their prevalence, there are crucial aspects of civil wars that remain poorly understood. In particular, there is a significant gap in the literature concerning the nature of legal and constitutional change in countries emerging from internal conflict. Reformed constitutions, amendments and legislation may offer meaningful benchmarks by which to assess both “thin” and “thick” conceptions of governance and the rule of law before, during, and after internal conflict. The nature of constitutional change is especially important among post-conflict states given the urgent need for a clear national vision for inclusion, reconciliation, and economic development. It is argued that in order to sustain legal change in post-conflict contexts, countries should adopt an inclusive approach to post-conflict state-building. This would mean reconciling narratives of victimhood; safeguarding autonomy and land rights in devolved regions; ensuring language parity and religious freedom; and protecting human rights; providing for inclusive economic growth. The thesis draws upon fifty semi-structured interviews with American, Spanish, and Sri Lankan historians, lawyers, judges, policy experts, members of civil society, private citizens, diplomats, and MP’s as well as survey data from national and international organizations and government statistics bureaus. It examines American, Spanish, and Sri Lankan statutes, constitutional texts, and case law from before and after their respective civil wars.

▼ The judiciary in Kenya has been progressively viewed as subservient to the executive, an upholder of state power and a poor protector of citizens’ rights. The rejection of the judiciary as an independent and impartial arbiter of disputes was a major contributor to the post-election violence experienced in December 2007 which resulted in anarchy and massive loss of lives and property. This thesis contends that there is a contextually symbiotic link between separation of powers, judicial independence and the rule of law. While focusing on the relationship between the judiciary and the executive, the research highlights the dangers of failure to maintain the appropriate balance of power between the executive, judiciary and the legislature, its ramifications to judicial independence and the rule of law. By analysing secondary data and using Kenya as a case study, this relationship is chronologically traced from the pre-colonial, colonial, independence and post-independence periods. An examination of successive constitutions exposes gaps and weaknesses in constitutional provisions guaranteeing judicial independence. Instances of violation are discussed with examples as confirmation that such protection was minimal, weak and not respected in practice. A high degree of executive intrusion, influence and control was evident inter alia in appointments, removal, funding and administration. Cumulatively, these factors contributed to the erosion of personal and institutional independence leading to drastic loss of confidence. Opportunities in terms of implemented reforms, especially the newly promulgated Constitution of Kenya 2010 are scrutinised. The thesis concludes that even though complete independence from the executive cannot be achieved nor is it desirable, more robust constitutional protection of judicial independence, coupled with a high degree of autonomy can be a strong guardian against violation. New threats are discovered. Further research, constitutional amendments and use of non-legal initiatives are proposed as key for future judicial reform.

This thesis critically assesses the migration of the common law doctrine of precedent to civil law constitutionalism using Colombia and Mexico as case studies. Over the last two decades, constitutional judges have been abandoning the civil law doctrine of jurisprudence constante marked by a persuasive approach to precedent and instead are taking judicial interpretations of the constitution as binding sources as their common law colleagues. Judges are also using common law concepts as the ratio decidendi of a case, and techniques as distinguishing or overruling precedents. Despite the convergence of legal traditions regarding the use of precedent, the civil law is marked by an overproduction of constitutional judgments, a more abstract and textual approach to legal reasoning and longer constitutions. Without a proper reconfiguration of the doctrine of precedent, its use in a new context runs the risk of threatening the right to equality before courts of law solving similar cases differently without a reasonable justification thereby producing incoherence among precedents.
With the aim of reconfiguring the doctrine of precedent according to civil law style of legal reasoning and endemic challenges, this thesis endorses a normative conception of constitutional precedent called Constitutional Reciprocity. This conception is an adaptation of John Rawls' coherentist method of Reflective Equilibrium for the institutional and intersubjective context of constitutional adjudication in the civil law. Inspired by this approach, according to Constitutional Reciprocity, judges ascribe norms to constitutional provisions when solving cases. Thus, judges bear the burden of argumentation in showing that a potential judgment supports and is supported by a set of constitutional provisions and judicially ascribed norms. They need to justify that a particular judgment is more coherent with the relevant pre-existing law than its alternatives. In this way, Constitutional Reciprocity adapts the method of Equilibrium originally proposed in the field of Moral Philosophy, to achieve a reasonable degree of coherence in precedents in the civil law.

reform and strengthening, especially the budget oversight and scrutiny function, are common among parliamentarians. Experience, however, shows that parliamentarians rarely actually enact significant reforms to enhance parliament’s effectiveness. Legislative studies scholarship focuses primarily on explaining why major
reform rarely occurs. This study explains a South African case of major provincial parliamentary strengthening that occurred in a manner and during specific conditions that legislative studies theory suggests would either prohibit
reform or weaken the legislature. The Gauteng Provincial Legislature (GPL) initiated and adopted a full
reform package under the name ‘Programme Evaluation and Budget Analysis’ (PEBA) between 1998 and 2004. This
reform expanded and deepened budget oversight and scrutiny processes in just six years, surpassing various formal
reform efforts in the United Kingdom and Canada over roughly sixty years. This contrast in
reform outcomes is explored at length. The GPL’s reforms also made public participation a formally integral component of budget oversight and scrutiny. PEBA’s development, adoption, and implementation overturn conventional theorizing in the legislative studies field on parliamentary
reform and transformation. This study uses the heuristic case study design and a theoretically eclectic approach in light of the truly paradoxical nature of the GPL’s reforms. After exploring the full scope of the paradox in light of a century’s worth of legislative studies theorizing, the study incorporates elements of the theoretical structure advanced by critical liberalism, federalism studies, and deliberative democratic theory to develop a working hypothesis. Testing the working hypothesis produces refinements that increase confidence in the study’s findings and justify optimism about prospects for parliamentary strengthening. Future research to expand testing of the hypothesis may lay the foundations for a new theory of parliamentary transformation and demonstrates the necessity of being open to developments in parliamentary innovation where it is least expected.

▼ The choice of political institutions is a
critical aspect of a democratic transition. Significant amendments
to the 1945 Constitution have transformed it into a more democratic
framework with extensive separation of powers and checks and
balances. Despite the introduction of the "difficult combination"
of pure presidentialism and multipartism to Indonesia, consensual
patterns of elite behavior should contribute to the further
consolidation of democracy. This study examines
the impact of the first four amendments on executive-legislative
relations and presidential power. The use of the 1945 Constitution
by two authoritarian regimes for four decades gave rise to the
perception that it inevitably created a dominant presidency. Thus
Indonesian political elites set out in 1999 to curtail presidential
power. Paradoxically, by the end of the process three years later
they created a comparatively very powerful president, primarily due
to the introduction of direct election and the narrowing of the
grounds for impeachment. In addition, although the president's
residual powers have been restricted, only slight reductions were
made in her specific powers. This study utilizes
concepts from political economy and political psychology to analyze
the struggle between two broad camps in the constituent assembly
(MPR): conservatives, led by Megawati Soekarnoputri and her
Indonesian Democracy Party-Struggle (PDI-P) and progressives from
most of the other major political parties. The progressives
consistently supported direct election, even though this did not
fit with their self-interest. Their position is explained by their
perceptions of Indonesia's history: in their view, the
parliamentary system was the primary cause of political instability
in the 1950s, and thus they concluded that pure presidentialism was
more appropriate for Indonesia. Following the presidential crisis
of 2001, Megawati and PDI-P reversed their initial position in
opposition to direct election, as a means to strengthen the
presidency and abolish the
constitutional supremacy of the MPR.
This reversal is explained by the "electoral bargaining approach,"
a theory of institutional choice developed based on cases in
Eastern Europe, the former Soviet Union and Latin America. This
approach examines the interests of competing political forces
rooted in their bargaining power and varying degrees of uncertainty
over political outcomes.

▼ There is growing evidence that Zimbabwean current youth justice is failing to meet the needs of the young people and their families. Trying to balance the welfare model and the criminal justice model in practice presents problems to a country already engulfed with political and economic problems that has brought the country onto its knees.
This study explores the views or perspectives of youth practitioners regarding the effectiveness of youth justice in Zimbabwe. In order to place this research within the Zimbabwean context the participants are Zimbabwean living in New Zealand who have worked in Zimbabwe or New Zealand with young people in conflict with the law.
The literature review put this study in a broader context by presenting a historical overview of youth legal system in Zimbabwe. The University of Zimbabwe is encouraging the researchers to focus on the topic. Zimbabwean youth legal systems, models, politics, international laws and practice is discussed and analysed in this study. The New Zealand historical legal context is also used to give the Zimbabweans the context in which the models that were suggested to be adapted by Zimbabwe were operating on.
To have a full picture of the problems in the youth justice in Zimbabwe, there was a need for the participants to define the word justice and law as to be able to evaluate whether there is justice in the Zimbabwean youth laws. However the findings indicated that different participants defined the word justice differently. To some, law and justice is one and the same thing but some see justice as independent from law as not all laws are just but because they are the laws have to be followed regardless of their unfairness or immorality. This ambiguity in definition of justice and law is also reflected in the related literature for the study.
The study showed that the context in Zimbabwe changed in terms of social structures, economic status and political climate. But the youth legal system remained the same, therefore resulted in application of non contextual youth justice models that are one shoe fits all and therefore Zimbabwean youth laws and court processes are analysed and discussed from historical to modern perspective with the focus of finding working solutions. The Zimbabwean legal system cannot be discussed without looking at the history of its formation. Zimbabwean law has a parallel system, a
constitutional law and customary law. The foundation of the Zimbabwean
constitutional law is based on the Roman Dutch law which was brought to Zimbabwe from Cape of Good Hope during the time when Zimbabwe was colonised by Britain. This explains why people of Zimbabwe feel distanced from their own legal system.
Constitutional Law is viewed as the law of the state enforced by the state to serve the interest of those in power rather than majority in Zimbabwe.
Therefore reforms are suggested in this study so that the law will meet the needs of the public of Zimbabwe

reform after 1994 was shaped by the relationship between governance and human rights standards; the requirements for both are set out in the Constitution and elaborated on in the Correctional Services Act. Good governance and human rights converge in five dimensions of a
constitutional democracy: legitimacy, transparency, accountability, the rule of law; and resource utilisation. The new
constitutional order established a set of governance and rights requirements for the prison system demanding fundamental
reform. It de-legitimised the existing prison system and thus placed it in a crisis. This required its reinvention to establish a system compatible with
constitutional demands. The thesis investigates whether constitutionalism provided the necessary transformative basis for prison
reform in South Africa after 1994. The Department of Correctional Services (DCS) senior management failed to anticipate this in the period 1990 to 1994. In the five years after 1994 senior management equally failed to initiate a fundamental
reform process. This lack of vision, as well as a number of external factors relating to the state of the public service in the period 1994 to 2000, gave rise to a second crisis: the collapse of order and discipline in the DCS. By the late 1990s the state had lost control of the DCS and its internal workings can be described as a mess – a highly interactive set of problems in causal relationships. In many regards the problems beleaguering the prison system were created in the period 1994 – 1999. The leadership at the time did not recognize that the prison system was in crisis or that the crisis presented an opportunity for fundamental
reform. The new democratic order demanded
constitutional and political imagination, but this failed to materialise. Consequently, the role and function of imprisonment within the criminal justice system has remained fundamentally unchanged and there has not been a critical re-examination of its purpose, save that the criminal justice system has become more punitive. Several investigations (1998-2006) into the DCS found widespread corruption and rights violations. Organised labour understood transformation primarily as the racial transformation of the staff corps and embarked on an organised campaign to seize control of management and key positions. This introduced a culture of lawlessness, enabling widespread corruption. w leadership by 2001 and facing pressure from the national government, the DCS responded to the situation by focusing on corruption and on regaining control of the Department. A number of gains have been made since then, especially after 2004. Regaining control of the Department focused on addressing systemic weaknesses, enforcing the disciplinary code and defining a new employer-employee relationship. This has been a slow process with notable setbacks, but it continues to form part of the Department’s strategic direction. ▼ This thesis is an inquiry into the challenges to the role of civic organisations in political
reform during and after political transitions. The major question this research addresses is: How do institutions and institutional dynamics constrain political
reform during a transition? The thesis examines how demands for
reform by non-governmental organisations in Lebanon and Libya were not translated into concrete political decisions taken by regimes during a transition period. The thesis suggests that the combination of weak states and power-sharing agreements marginalizes civic organisations, and poses institutional constraints on the likelihood of
reform.
The thesis is based on contemporary research on events and
reform trajectories in Lebanon and Libya, with a focus on the demands and strategies employed by activists during periods of transition. Lebanon between 2005 and 2010 and Libya between 2011 and 2013 underwent critical political events but subsequently did not adopt political reforms despite demands by civic organisations in two main areas: the electoral system in Lebanon and the
constitutional process in Libya. A study of these two
reform campaigns reveals deeply entrenched historical patterns and elements of continuity that led to path dependent outcomes during transition. By utilising theory and concepts from the perspective of historical institutionalism, the thesis identifies the factors behind path dependent outcomes in Lebanon and Libya.
I argue that the transitions in Lebanon and Libya were a result of only ‘partially’ critical junctures. The thesis builds on the approach of path dependence by offering insights as to how historically inherited institutional dynamics from the previous regime can cause junctures to be only ‘partially’ critical for the broader political order. The main source of data comes from participant observations, interviews and focus groups with two organisations that tried to advance electoral
reform and
constitutional development.

▼ What are the causes and consequences of judicial empowerment? What motivates the political decision to delegate authority to independent judiciaries, and what explains the subsequent behavior of these institutions? Going against current trends in comparative judicial politics, this dissertation answers these questions by taking ideas seriously. Dominant accounts of judicial empowerment and behavior associate the emergence of rights protecting judiciaries with the actions of powerful political actors concerned with the protection and promotion of their political self-interests. In contrast, my analysis of Brazil and Colombia links the emergence of such institutions to the actions of groups and individuals who subscribe to the principled belief that courts should focus their efforts on the protection and promotion of
constitutional guarantees. These ideational carriers use their resources to convince institutional designers of the suitability of their proposals, and exert powerful influence over the institutional outcome of
constitutional transitions. These actors also influence the actions of newly empowered courts to the extent that they are able to entrench their ideational allies on the bench during the uncertainty of the transition. These findings contradict the arguments that judicial empowerment is designed to weaken electoral opponents or to insulate the political process from popular pressures, and that judges are rational-strategic actors whose main concern is to protect their institutional integrity.

▼ La réforme constitutionnelle du 23 juillet 2008 a fait du contrôle et de l’évaluation l’un des leviers de revalorisation de la place du Parlement dans les institutions. Elle a donc profondément renouvelé la fonction de contrôle : le champ du contrôle a été étendu dans des proportions jamais égalées, l’information du Parlement a été développée dans de nombreux domaines. Le Constituant a également souhaité donner au contrôle parlementaire une nouvelle dimension en dotant les assemblées d’une compétence en matière d’évaluation des politiques publiques. L’étude montre que l’Assemblée nationale et le Sénat ont interprété différemment leurs nouvelles prérogatives en matière de contrôle et d’évaluation, en fonction de leur culture institutionnelle et de leur degré d’adhésion à la réforme de 2008. De ce fait même, la portée de la réforme constitutionnelle de 2008 s’avère limitée : le Parlement peine à assumer son nouveau rôle d’évaluateur mais s’investi d’avantage dans son rôle de contrôleur. La réforme constitutionnelle de 2008 n’a donc pas substantiellement changé l’équilibre des pouvoirs entre le législatif et l’Exécutif.
The constitutional reform of 23rd July 2018 turned checking the work of government and evaluation into one of the most significant leveraging effect for the role of the Parliament within the institutions. It has deeply renewed the function of control: the capacity of control was extended to a level that had never been reached so far and the information towards the Parliament was expanded to many fields. The role of the Constituent also wished to widen the role of the Parliamentary control by providing the assemblies with new expertise regarding the evaluation of public policies. This study shows that the National Assembly and the Senate had two different understandings of their new prerogatives regarding control and evaluation, according to their institutional cultures and to their level of support to the reform of 2008. Therefore, the impact of the constitutional reform of 2008 turned out to be restricted: the Parliament struggles to fulfill its new role as an evaluator but gets more involved as a controller. Therefore, the Constitutional reform of 2008 hasn’t significantly changed the balance of powers between the legislative and executive branches.

▼ The introduction of the first democratic Constitution and the land
reform programme in South

Africa provided the impetus for the development of a new perception of property. In terms of the
traditional private law perception property rights are reduced to abstract, scientific concepts
which form part of a hierarchical system of rationally and logically related concepts and
definitions, the relationships between which remain largely unaffected by social and political
realities. In this view the
constitutional property clause is interpreted as a guarantee of existing
individual property rights against unwarranted state interference. Proponents of the traditional
private law view argue that this perception of property need not be replaced by a new
constitutional perception of property, because the traditional private law perception is legitimated
by the fact that it developed in an uninterrupted, linear line from Roman law. It is regarded as
flexible enough to adapt to new and different social and political circumstances. However, the
truth is that the development of property rights was disrupted by a number of discontinuities or
fundamental breaks in different periods of its development. It is argued in this thesis that the
introduction of the new
constitutional order in South Africa can be regarded as another of these
discontinuities, and that the strict adherence to the private law perception of property may be
abandoned in favour of a new debate on property where the social and political function of
property is emphasised more strongly.
Land
reform promotes the public interest in that it ensures the equitable use, distribution and
exploitation of property. In most cases the implementation of land
reform necessitates the
limitation of property rights. A conservative judiciary's adherence to the traditional private law
perception of property may lead to a
constitutional conflict between the judiciary (that aims to
afford existing property rights strong
constitutional protection) and the legislature (that aims to
promote the public interest by implementing land
reform). Such a
constitutional conflict can be
avoided if the South African courts adopt an approach in terms of which the social and political
role and function of property in society is recognised.

▼ Estudo baseado nos referenciais contidos na obra marxiana nos termos do silogismo do Estado capitalista. Adota-se como base empírica a Constituição Federal brasileira de 1988 e analisa-se o rápido e complexo processo histórico que levou ao desmonte e à desfiguração da Carta Magna. Este processo ocorreu em conseqüência da retirada do texto constitucional de vários dispositivos que indicavam a aplicação de novos direitos sociais fundamentais, direitos estes que lançavam os fundamentos e as condições necessárias para a implementação de um Estado social no Brasil. Examinam-se as razões que levaram a essa derrocada dos direitos sociais, consubstanciada na expulsão do trabalho vivo da Constituição Federal de 1988 e, por conseguinte, na transformação que redefiniu as bases do Estado social brasileiro para a instalação de um Estado neoliberal. Essa mudança da forma do Estado capitalista brasileiro contemporâneo se deu através da Reforma Constitucional e da Reforma do Estado, articulada com a resolução dialética da crise estrutural do capital, afetando, essencialmente, a luta de classes e a nova divisão internacional do trabalho, no contexto situado para além do fordismo e na globalização.
A study based on the references contained in Marxs work, in the terms of syllogism of the capitalist state. As an empirical base, the Brazilian Federal Constitution of 1988 is adopted and an analysis is done of the rapid and complex historical process which led to the dismantling of Magna Charta. This process occurred as a consequence of the removal from the constitutional text of several provisions which indicated the application of new and fundamental social rights, rights which created the foundations and conditions necessary for the implementation of the Welfare State in Brazil. The reasons for this overthrow of rights are examined, consubstantiated in the expulsion of live work in the 1988 Federal Constitution and then in the change that redefined the bases of Brazilian Welfare State to the creation of Neoliberal State. This change in shape of the contemporary Brazilian state took place by the constitutional and state reforms combined with the dialect resolution of crises in the structure of capital from affecting, essentially, the class war and the new international division of work, in the context beyond Fordism and globalization.

francês, devido à sua especificidade, serviu por anos como exemplo
do único sistema no qual o exame de compatibilidade entre normas
infraconstitucionais e o texto da Constituição era realizado pelo
Conselho Constitucional - órgão político - e de maneira preventiva,
ou seja, antes das disposições legislativas entrarem em vigor e
produzirem efeitos. Com o passar do tempo verificou-se na prática,
a perda da supremacia da Constituição da República Francesa de
1958, como resultado da ausência de proteção a direitos e
liberdades constitucionais. Por este motivo, no final dos anos 80
operadores do direito começaram a se mobilizar e a vislumbrar uma
proposta de mudança e reforma. Em 2008 foi aprovada uma Lei
Constitucional, que tem status de Emenda Constitucional, com o
intuito de modernizar as instituições políticas da França. Dentre
as medidas modernizadoras estava incluída a criação da Questão
Prioritária de Constitucionalidade, mecanismo que tem como
principal objetivo conferir aos particulares a prerrogativa de
contestarem a constitucionalidade de uma disposição legislativa que
julguem atentar contra direitos e liberdades garantidos
constitucionalmente. Esta pesquisa analisou os fatores que
antecederam e influenciaram a reforma supracitada, além das
consequências e dos efeitos gerados pela introdução da QPC no
ordenamento jurídico francês.
[en] The French system of constitutional review is
very specific and was used for years as an example of the only
system in which the compatibility exam between laws and the
Constitution was performed by the Constitutional Council - which is
a politic institution - preventively. In other words, this exam
happened before the legal provisions come into force and take
effect. As a result of the lack of protection of the constitutional
rights and freedoms, the French Constitution was gradually losing
its supremacy. That is why jurists during the 80 s started to
discuss a proposal of change and reform. When in 2008, a
constitutional amendment was approved, creating a mechanism which
gave individuals the right to contest the constitutionality of
whichever legal provision they deemed to be violating their
constitutional rights and freedoms. This research examined the
factors that preceded and influenced the reform, and above all the
effects and consequences generated by the Priority Question of
Constitutionality in French Law.

recently undergone revolutionary changes. These changes are
especially evident in relation to guardianship, care and contact.
<p.The parent-child relationship has been revolutionised from
one where the paterfamilias had the right of life or death (ius
vitae necisque) over members of the family who fell under his
power, to one where children have rights and parents have
responsibilities. In Roman law the original power of the
paterfamilias was later limited and duties were placed on the
paterfamilias. In Roman Dutch law parents had not only parental
powers or rights over their children, but also parental duties
which they had to perform. In both Roman law as well as Roman Dutch
law the father of a child born out of wedlock had no parental
authority whatsoever. This meant that such father did not even have
a right of access to his child. Roman Dutch law was received into
South Africa. The South African Children’s Act 38 of 2005 does not
refer to parental power or parental authority, instead the term
“parental responsibilities and rights” is used. Guardianship is
defined similarly in South African law prior to the Children’s Act
as well as in the Children’s Act itself. The Children’s Act
replaces the term “custody” with the term “care”. The Act also
replaces the term “access” with the term “contact”. The definitions
of these terms in the South African Children’s Act are similar to
the definitions found in South African law prior to the Children’s
Act. However, the Children’s Act has revolutionised the concepts of
guardianship, care and contact in a number of ways. Firstly, the
father of a child born out of wedlock acquires automatic parental
responsibility and rights in certain instances. Secondly, the
mother of a child may enter into a parental responsibility and
rights agreement with the father of a child born out of wedlock,
who does not acquire automatic parental responsibility and rights,
or with any other person. Thirdly, any person having an interest in
the care and welfare of the child, this includes the father of a
child born out of wedlock and grandparents, may approach the court
for an order granting them guardianship, care of or contact with a
child. In South African law the best interests of the child
standard has been applied for a number of years in matters
concerning children. The best interests of the child standard is
enshrined in section 28(2) of the South African Constitution, 1996
and in the Children’s Act. The rights of children in South Africa
are protected in the South African Constitution, as well as in the
Children’s Act. The trends evident in the Children’s Act, such as
the emphasis of parental responsibility, and the protection of the
rights of the child, are in line with trends in both international
law (found in international conventions) as well as foreign law
(for example, in the Children’s Acts of Ghana, Uganda, Kenya and
the United Kingdom) and enhances the evolution of children’s
rights.

▼ La tesi di dottorato si propone di esaminare gli sviluppi della legislazione in materia di salute mentale nel contesto del modello sanitario italiano. La salute mentale, e in particolare la condizione giuridica delle persone affette da sofferenza mentale, costituisce un osservatorio privilegiato per analizzare e far emergere, con le risorse che la prospettiva costituzionalistica ci offre, le contraddizioni ancora insite nell’ordinamento, la difficoltà di declinare entro forme di tutela effettiva determinati diritti, ma anche le linee evolutive, nel campo dei diritti civili e sociali, che hanno inteso restituire dignità sociale ai ‘folli’. In tali termini, il percorso di analisi che si è inteso intraprendere è volto a vagliare i tratti frastagliati e complessi del tema della salute mentale attraverso alcuni principi propri del lessico costituzionalistico e le ricadute che hanno caratterizzato il contesto normativo italiano.
This PhD thesis explores the mental health’s legislation and attempts to identify ways of redirecting the Italian model. We can affirm that the constitutional rights constitute guarantees orientated to protecting certain values or fundamental goods to reach a worthy life; being the maximum expression of the dignity it humanizes. In this respect we will raise the first axis of analysis with the relation between mental health and constitutional rights in the strict field of the investigation. Based on personalist model, will be proposed an analysis of the psychiatric deinstitutionalization process carried out in Italy, from the decade of the 80s, after the approval of the Psychiatric Reform. Based on the right to health, it is proposed to speak of “right to have rights” (diritto ad avere diritti), that is to say, the right of mentally ill people to be helped, day after day, in the enterprise to reconquer the own personality, the honor, the privacy, the image and the personal identity. The Mental Health Act, adopted in Italy in 1978, is considered as point of renew and strengthen opportunities, obligations, duties, which may fulfill the purposes set out in the regulatory framework, which has as its foundation and the human recipient and thus the satisfaction of all their needs and rights, so that in this form, is integrated into their life experience, benefit and personal, social and cultural experiences aiming to progress and achievement.

▼ A presente tese tem como objetivo analisar a ascensão de políticos mineiros e paulistas no âmbito da construção do Estado nacional brasileiro entre 1823 e 1834, atentando para dois movimentos simultâneos e interligados. O primeiro diz respeito à criação de esferas de poder em nível provincial em São Paulo e Minas Gerais, em que será privilegiada a atuação dos conselhos provinciais o Conselho da Presidência e o Conselho Geral , sua relação com o Legislativo e Executivo, e seu engajamento na viabilização de um Império sediado Rio de Janeiro. Trata-se de examinar de que maneira a composição dos poderes provinciais inscreveu-se no processo de afirmação de uma monarquia constitucional representativa em meio a outras propostas vigentes de organização do Estado à época. O segundo movimento refere-se à projeção de paulistas e mineiros no cenário político da Corte, seja no Legislativo, a partir de 1826, seja no Executivo, mormente após a Abdicação. Pretende-se, assim, discutir possíveis matizes do chamado projeto liberal moderado, o qual obteve grande respaldo em São Paulo, Minas Gerais e na Corte no período estudado, partindo-se da hipótese de que a atuação de políticos paulistas e mineiros, notadamente no encaminhamento da reforma constitucional que se consubstanciou no Ato Adicional, em 1834, foi permeada por interesses de grupos locais e influenciada pelo debate político ocorrido em nível provincial
The aim of this thesis is to analyze the rise of Minas Gerais and São Paulo politicians in the development of the Brazilian State between 1823 and 1834, considering two simultaneous and interrelated motions. The first concerns the field of power creation at the provincial level in São Paulo and Minas Gerais, in which will be prioritize the performance of provincial councils - the Conselho da Presidência and the Conselho Geral -, their relation to the legislative and executive branches, and their alliance in achieving a Empire entrenched at Rio de Janeiro. The goal is to examine how the organization of provincial powers managed to build the acceptance of constitutional monarchy amid other current proposals for the State organization at the time. The second movement refers to the projection of São Paulo and Minas Gerais in the political background of the Court, both in legislature issues, from 1826, and executives, especially after the Abdicação in 1831. It is intended, therefore, to discuss some peculiarities about the so-called \"Liberal Moderado, which got great sheltering in São Paulo, Minas Gerais and in the Court during the studied period, starting from the hypothesis that the role of São Paulo and Minas Gerais politicians, mainly during the constitutional reform which led to the Additional Act, in 1834, was permeated by concerns of local groups and influenced by political debate occurred at the provincial level

▼ O objetivo deste trabalho é verificar os limites de atuação do poder de reforma constitucional, em sua via permanente, no tocante à alteração da discriminação das competências tributárias das pessoas políticas que integram o Estado brasileiro, tendo em vista o recente ciclo de reforma da constituição, que, por meio de um elevado número de emendas, vem, sistematicamente, modificando aquela discriminação, seja pela extinção de tributos, pela criação de outros ou, até mesmo, pela simples alteração de seus arquétipos. A nossa hipótese central baseia-se na premissa de que o poder de tributar do Estado é exercitado por meio de competências tributárias fixadas na Constituição Federal, e que a discriminação dessas competências pode sofrer alterações, desde que respeitados os limites de atuação do poder constituinte derivado. A abordagem do tema funda-se, ainda, numa visão sistêmica do direito positivo e sua forma específica de responder aos estímulos de outros sistemas, que com ele interagem, dentre os quais destacamos o sistema político e o sistema econômico, uma vez que a nossa hipótese está intimamente ligada à tributação, cuja matéria foi exaustivamente tratada pela Constituição Federal. Nesse contexto, analisamos as características da competência tributária e as conseqüências que dela advêm, como, também, as limitações impostas ao exercício do poder de reforma constitucional. Após concluir que somente por meio de uma análise isolada é possível saber se o poder reformador agiu dentro dos limites a ele impostos pelo poder constituinte originário, passamos a considerar, de modo específico, a constitucionalidade da EC n 33/01, que alterou a Constituição Federal (art. 155, 2, IX, a) de forma a permitir aos Estados e ao Distrito Federal a instituição do ICMS também nas hipóteses de importação de bens
This study is aimed at checking the performance limits of the power of constitutional reform in its permanent manner related to the change of the discrimination of tributary competencies which belong to the political people who are part of the Brazilian State. This is due to the fact of the recent reform cycle of the constitution which through a high number of amendments has been systematically changing the discrimination above mentioned by extinguishing taxes, creating new ones, or even just altering their archetypes. Our main hypothesis is based on the premise that the State power for taxation is practiced by means of tax competencies which are set by the Federal Constitution, and also that the discrimination of such competencies may suffer changes since the performance limits of the constituent derived power are respected. recently undergone revolutionary changes. These changes are
especially evident in relation to guardianship, care and contact.
<p.The parent-child relationship has been revolutionised from
one where the paterfamilias had the right of life or death (ius
vitae necisque) over members of the family who fell under his
power, to one where children have rights and parents have
responsibilities. In Roman law the original power of the
paterfamilias was later limited and duties were placed on the
paterfamilias. In Roman Dutch law parents had not only parental
powers or rights over their children, but also parental duties
which they had to perform. In both Roman law as well as Roman Dutch
law the father of a child born out of wedlock had no parental
authority whatsoever. This meant that such father did not even have
a right of access to his child. Roman Dutch law was received into
South Africa. The South African Children’s Act 38 of 2005 does not
refer to parental power or parental authority, instead the term
“parental responsibilities and rights” is used. Guardianship is
defined similarly in South African law prior to the Children’s Act
as well as in the Children’s Act itself. The Children’s Act
replaces the term “custody” with the term “care”. The Act also
replaces the term “access” with the term “contact”. The definitions
of these terms in the South African Children’s Act are similar to
the definitions found in South African law prior to the Children’s
Act. However, the Children’s Act has revolutionised the concepts of
guardianship, care and contact in a number of ways. Firstly, the
father of a child born out of wedlock acquires automatic parental
responsibility and rights in certain instances. Secondly, the
mother of a child may enter into a parental responsibility and
rights agreement with the father of a child born out of wedlock,
who does not acquire automatic parental responsibility and rights,
or with any other person. Thirdly, any person having an interest in
the care and welfare of the child, this includes the father of a
child born out of wedlock and grandparents, may approach the court
for an order granting them guardianship, care of or contact with a
child. In South African law the best interests of the child
standard has been applied for a number of years in matters
concerning children. The best interests of the child standard is
enshrined in section 28(2) of the South African Constitution, 1996
and in the Children’s Act. The rights of children in South Africa
are protected in the South African Constitution, as well as in the
Children’s Act. The trends evident in the Children’s Act, such as
the emphasis of parental responsibility, and the protection of the
rights of the child, are in line with trends in both international
law (found in international conventions) as well as foreign law
(for example, in the Children’s Acts of Ghana, Uganda, Kenya and
the United Kingdom) and enhances the evolution of children’s
rights.

▼ In this thesis I explore the attitudes, arguments, and actions of British political elites in connection with the development of human rights law in Europe and the UK. I do this by examining British input into five key episodes for the development of European supranational rights and their incorporation into domestic legal orders (namely the drafting of the European Convention on Human Rights 1950, the drafting of the European Social Charter 1961, the acceptance of individual petition in 1966, the failed 1970s Bill of Rights debate, the passing of the Human Rights Act 1998, and recent developments such as the UK ‘opt-out’ to the EU Charter of Fundamental Rights, and the emergence of a new ‘British Bill of Rights’ debate). Casting light on British involvement in less examined periods in European rights development, I challenge existing, isolated, explanations for the more focal episodes (such as Simpson’s rational-choice post-colonial thesis for individual petition acceptance, and ideological accounts for New Labour’s post-1997 constitutional reform). Responding to the most recent literature in the area, central to my analysis is the question of how rights progress relates to inter-party conflict. By considering continuities and discontinuities in elite political discussion of rights I argue that while conflict is a significant underlying feature of every major episode of rights progress during the last sixty years, and is less evident in less progressive periods, other factors have had a greater influence over the form, timing, and extent of rights progress. Most significant amongst these is the constitutional ideological development of the Labour party and the critical connection between Labour’s elevation of the Convention within the UK constitutional space and revisionist shifts in party thinking.

▼ This paper examines the changing nature of provincial constitutions in Canada. Provinces are granted the right to have their own constitutions by Sections 58-90 of the Constitution Act, 1867, and various sections of the Constitution Act, 1982. The substance of provincial constitutions includes various Acts of provincial parliaments, long-standing constitutional conventions, unwritten rules and principles and common law. With respect to the practice of responsible government, the provinces have long relied on the traditionally “flexible” nature of their largely unwritten constitutions. Using the case studies of statutes dealing with the executive and legislative branches of government in the provinces of British Columbia, Quebec, and Newfoundland and Labrador, this paper analyzes recent changes in the statutes (and therefore constitutions) of the provinces. The analysis shows that there have been many changes in provincial constitutions on the subject of responsible government. The constitutions increasingly recognize the role of the Premier and cabinets, to the detriment of the traditional roles of Lieutenant Governors and the legislatures. This is in line with general trends in Canada’s provinces toward increased executive dominance. The practice of codifying changes in provincial constitutions is also more in line with how constitutional change happens in the states of comparable federations such as Australia and the United States.

▼ On Constate aujourd’hui une avancée significative du processus de démocratisation au Togo et au Zimbabwe grâce à la politique de la conditionnalité démocratique de l’aide européenne au développement et aux sanctions financières édictées contre ces pays. C’est la synergie des forces externes et internes qui a contribué au changement de politique au Togo et au Zimbabwe. La mobilisation de la société civile a également été utile. Cependant, le système politique produit par la politique de la conditionnalité n’est que de façade car les résultats obtenus ne sont pas à la hauteur des attentes. Le bilan est mitigé. Les réformes entreprises au Togo et au Zimbabwe ne sont qu’apparentes. La dépendance de l’aide a engendré la corruption, les dettes, et a sapé les investissements. Tant que des solutions appropriées n’auront pas été trouvées à l’aspiration démocratique des peuples africains en tenant compte de leurs réalités sociales, culturelles, économiques et politiques ; les crises sociopolitiques risquent de perdurer sur le continent. L’Afrique a besoin aujourd’hui d’une institution forte capable de concilier la démocratie et le développement. Elle a aussi besoin de l’indépendance budgétaire et monétaire.
Today there is a significant advance in the democratization process in Togo and Zimbabwe because of the political democratic conditionality for EU development aid and financial sanctions imposed against the country. It is the synergy of internal and external forces that contributed to the change in policy in Togo and Zimbabwe. The mobilization of civil society has been helpful. However, the political system produced by policy conditionality is only façade since the results are not up to what was expected. The results are mixed. The reforms undertaken in Togo and Zimbabwe are only apparent. In addition, aid dependence has fostered corruption, debt, and undermined investment. Unless appropriate solutions can be found to the democratic aspirations of the African peoples, taking into account their social, cultural, economic and political realities; sociopolitical crises are likely to persist on the continent. Africa today needs a strong institution capable of reconciling democracy and development. It also needs fiscal and monetary independence

▼ No movimento de mudanças sociais capitaneados pelo capitalismo global e pelo discurso neoliberal, têm sido promovidas no mundo reformas nos chamados setores de infra-estrutura (antes geralmente geridos de forma direta pelo Estado sob a forma de monopólios) no sentido de se introduzir uma regulação que promova a concorrência. Desses setores a industria do gás natural vem sofrendo reformas institucionais relevantes que procuram retirar-lhe características monopolísticas e permitir, dessa maneira, o aumento dos agentes nesse mercado. Em alguns paises essas transformações na industria do gás natural encontram já seus resultados (EUA e União Européia). O Brasil tem promovido reformas no setor de gás desde a Emenda Constitucional n 09 e a Lei 9.478/97, abrindo as portas do mercado brasileiro de petróleo e gás para os investimentos privados, criando um cenário onde a Petrobrás não está mais sozinha na execução de atividades da cadeia do petróleo e gás natural. Acabou-se, assim, com o monopólio da execução das atividades da industria do petróleo e gás (foi mantido o monopólio da titularidade), passando-se a introduzir nesses setores a intervenção pela regulação, a regulação econômica. Dentre as pautas de regulação importante da indústria do gás natural encontra-se o chamado livre acesso (open access) aos gasodutos de transporte, fazendo-se pensar a regulação do livre acesso à luz da ordem econômica da nossa Constituição e projetar as relações entre Estado e Economia, buscando desenhar o conjunto de regras e princípios que orientam a ação reguladora e fundamentam a possibilidade constitucional do controle de estruturas pelo livre acesso no segmento de transporte de gás natural
In the middle of modern social changes produced by globalization and capitalism, several markets have changed. States have left the direct coordination of these markets (chiefly public utility sector in the form of monopolies), introducing regulation in order to promote competition. These changes have affected natural gas industry by promoting competition as a key factor to the development and the increase of firms in this market. The regulatory reform of natural gas industry ocurred in EUA and Europe Union and it has produced its first results. In Brazilian context, Constitutional Amendment nbr. 09 and Federal Law nbr. 9.478/97 (Petroleum Law) opened the natural gas market to a broad range of private economic agents and they finished the monopoly over the industry before managed by Petrobras. The new regulatory framework of Brazilian natural gas industry has designed competition as a central element to the new form of managment of business and contractual relationships of this industry. Among the regulatory instruments, open access regulation in natural gas pipelines is directed to promote competition. The questions arised about its implementation in Brazilian context are studied in the present work, in which it is discussed the constitutional rules and principles are to be applied to the open access regulation within the theme of statal regulation…

▼ The first part of the thesis is an analysis of the sociological and historical frame and the social evolution in the Ottoman Empire and the new Greek State until the year 1878, when the “Savatiea Epitheorisis” was published. The second part of the thesis is an analysis of the articles of the “Savatiea Epitheorisis” with emphasis on the character of this newspaper as a representative sample of the growing Greek capitalists during the period of the First Constitutional reform in the Ottoman Empire. The modernization of the Greek capitalisis of Constantinople is obvious.
Στο πρώτο μέρος της διατριβής αναλύεται το κοινωνιολογικό και ιστορικό πλαίσιο και η πορεία των κοινωνικών εξελίξεων στην Οθωμανική Αυτοκρατορία και τη μεταπελευθερωτική Ελλάδα ως το έτος σταθμός, 1878 κατά τη διάρκεια του οποίου εκδόθηκε η "Σαββατιαία Επιθεώρησις". Στο δεύτερο μέρος της διατριβής γίνεται ανάλυση περιεχομένου της "Σαββατιαίας Επιθεωρήσεως" με κύριο γνώμονα του χαρακτήρα της ως βασικού εκφραστή της ανερχόμενης ελληνικής αστικής τάξης της Κωνσταντινούπολης κατά την περίοδο της πρώτης Συνταγματικής μεταρρύθμισης της Οθωμανικής Αυτοκρατορίας. Από την επιστημονική έρευνα των δημοσιευμάτων της εφημερίδας γίνεται κατανοητό το επίπεδο του αστικού εκσυγχρονισμού των Ελλήνων της Κωνσταντινούπολης.
