This thesis has for objective to elaborate a scientific study regarding the interpretation and of the application of the condominium convention (horizontal property) that it was carried through in three phases, legal analysis, logical concentration and legal construction, and that is justified for the necessity of bigger legal security on the subject. In the legal analysis, we investigate the similar elements of the horizontal property and justinian codes, distinguishing them and separating them. In the logical concentration, we regroup these same elements, extracting of them general rules, especially regarding the condominium convention. In the legal construction, we determine the essential characteristics that they individualized it, reducing it it a general category, with organized proper types so that it can be seen its fulness. In the two first phases, we made a brought up to date study of the horizontal property, pointing its period of training in Brazil and diverse countries. We verify this new model of property, since its birth until its extinguishing (denomination, legal nature, object, constitution, requirements, specification of condominium, convention, acts, rights and duties of the joint owners and administration of the condominium), beyond studying innumerable similar justinian codes (the principles of right, the autonomy of the will, the legal transaction and its interpretation), the theories that they look to study the right and the rights of neighborhood. How much to the condominium convention demons its concept and its legal nature, we study the legal relationship in the horizontal property and analyze the agreements of the national doctrine and the jurisprudence, with intention to investigate as she has been carried through the interpretation of the diverse situations that occur in the horizontal property, in special concerning the condominium convention. Already in its phase of legal construction, this thesis arrived at the following general results: 1) schematized the condominium convention, how much to its origin; 2) schematized its institucional norms in, of administration, statutory, how much to the penalties and generalities. From them, it arrived at the following specific results: 1) studied the convention how much to its origin and established the criterion of the qualified majority for its validity; 2) classified the institutional norms, struck the criterion of the qualified majority and indicated quorum of 2/3 for the alteration of the convention, denying the existence of stony clause, perfect legal act and acquired right; 3) established the application of principles in the requirement of the management or administration norms: ) how much to the expenditures, it specified them and it concluded for the application of the general criterion of the proportionality; b) how much to the agencies, it classified them in deliberative, executive and advisory, pointing its functions, species, functioning and establishing the application of the criterion of the superiority in the interpretation of the… Advisors/Committee Members: João Batista Lopes.

Poucos assuntos na esfera cível ensejam tantas polêmicas quanto o condomínio edilício. Como fenômeno jurídico e social urbano, o condomínio é amplo. As habitações do presente são e no futuro continuarão a ser em grande parte condomínios edilícios. A presente dissertação tem por finalidade a análise do instituto do condomínio edilício contextualizado no Código Civil Brasileiro de 2002, com amparo da doutrina e jurisprudência pertinentes. A pesquisa é desenvolvida em três partes. Na primeira delas consta o conceito do instituto e a importância prática do seu estudo. Faz-se, ainda, o enquadramento do condomínio edilício como direito real, bem como a relação dos princípios aplicáveis. Distinguem-se as diferentes modalidades de condomínio previstas no Código Civil, dentre as quais situa-se o condomínio edilício. A segunda parte analisa a derrogação ocasionada na Lei n 4.591/64 pela promulgação do Código Civil de 2002 e evidencia-se seu histórico e nomenclatura. A partir daí o trabalho delineia cada um dos tópicos que estruturam o condomínio edilício no Código Civil, a saber, fala das partes que são propriedade exclusiva e das partes que são propriedade comum, da instituição, convenção e regimento interno, dos direitos e deveres dos condôminos, das questões atinentes à garagem, da realização de obras, do seguro obrigatório, do corpo diretivo (síndico, subsíndico, conselho fiscal e empresa administradora), da assembléia geral de condôminos e da extinção do condomínio edilício. Na parte final, dá-se uma visão panorâmica das aplicações heterodoxas do condomínio edilício, tais como as da habitação de interesse social e Estatuto da Cidade, o condomínio de casas, os loteamentos fechados, o apart hotel e a multipropriedade imobiliária

Few subjects in the civil sphere try as many controversies how the condominium. As urban legal and social phenomenon, the condominium is ample. The nowadays habitations are, and will continue to be in the future, most of them, condominiums. The present study has for purpose the analysis of the institute of the condominium contextualized in the Brazilian Civil Code of 2002, with support of the pertinent doctrine and jurisprudence. The research is developed in three parts. The first one consists in the concept of the institute and the practical importance of its study and the framing of the condominium as right in rem, as well as the relation of the applicable principles. The different foreseen modalities of condominium in the Civil Code are distinguished, amongst which the condominium is placed. The second part analyzes the derogation caused in Law n 4.591/64 for the promulgation of the Civil Code of 2002 and proves its description and nomenclature. From then on, the work delineates each of the topics that structuralize the condominium in the Civil Code. The real estate incorporation is an activity of great social and economical repercussion. It allows that through reception of the saving of the buyers of autonomous units to build, to which are added resources of the incorporator and capital obtained by financing by financial institution, is promoted the construction of buildings destined to constitute or to be divided in autonomous units for residential, commercial or mixed use, with ordered occupation of the urban land in the molds of the urban planning of the municipal district and of the environmental regulation promoted by the State. This activity well regulated and exercised allows the development of the real estate market that has great repercussion in the wealth circulation and in the generation of direct and indirect employments. The reception of private resources for the construction of buildings demands however regulation that serves as incentive to the entrepreneurs and checks safety to the buyers that the work will be executed, the joint owned property will be constituted and the autonomous units will be delivered. The presented text analyzes the real estate incorporation in the theoretical field and the practical application of the institute. The principal aspects of the joint owned property are approached, given that the real estate incorporation seeks to obtain as a result its constitution. For this purpose, both in relation to the real estate incorporation as to the joint owned property, themes relative to the concept, historical evolution, foreign legislation, legislative evolution in the Brazilian law, juridical nature and constitution form are appreciate. In relation specifically to the real estate incorporation aspects, it comments the incorporation activity in a wide sense. The contract of real estate incorporation in strict sense, for its time, is analyzed with relationship to: the classification; objective, subjective and formal elements; principal real warranties; its formation, development and extinction. It still analyzes the obligations, duties and rights of the incorporator and of the buyers of the autonomous units, current from the law and of contractual convention; the constitution of the affectation patrimony; the incidence of norms contained in legislative diplomas different from the law of joint owned property and incorporation, especially in the Civil Code, in the Code of Defense of the Consumer and in the Law of Public Registrations. Specific themes relative to the joint owned property constituted by earthy houses and to the places of garages in buildings submitted to the regime of the joint owned property are commented. Finally, the civil responsibility of the incorporator and the builder are examined. It is provided, with that, a wide vision of the legal institute object of the study
