▼ The Weather Surveillance Radar 1988 Doppler (WSR-88D) network has been operational for over 30 years and is still the primary observational instrument employed by the National Weather Service (NWS) forecasters to support their critical mission of issuing severe weather warnings and forecasts in the United States. Nevertheless, the WSR-88Ds have exceeded their engineering design lifespan and are projected to reach the end of operational lifetime by 2040. Technological limitations may prevent the WSR-88D to meet demanding functional requirements for future observational needs. The National Oceanic and Atmospheric Administration (NOAA) has started considering radar systems with advanced capabilities for the eventual replacement of the WSR-88D. Unique and flexible capabilities offered by Phased Array Radar (PAR) technology support the required enhanced weather surveillance strategies that are envisioned to improve the weather radar products, making PAR technology an attractive candidate for the next generation of weather radars. If PAR technology is to replace the operational WSR-88D, important decisions must be made regarding the architecture that will be needed to meet the functional requirements. A four-faced planar PAR (4F-PAR) is expected to achieve the requirements set forth by NOAA and the NWS, but deploying and maintaining an operational network of these radars across the U.S. will likely be unaffordable. A more affordable alternative radar system is based on a single-face Rotating PAR (RPAR) architecture, which is capable of exceeding the functionality provided by the WSR-88D network. This dissertation is focused on exploring advanced RPAR scanning techniques in support of meeting future radar functional requirements. A survey of unique RPAR capabilities is conducted to determine which ones could be exploited under an RPAR Concept of Operations (CONOPS). Three capabilities are selected for further investigation: beam agility, digital beamforming, and dwell flexibility. The RPARs beam agility is exploited to minimize the beam smearing that results from the rotation of the antenna system over the collection of samples in the coherent processing interval. The use of digital beamforming is investigated as a possible way to reduce the scan time and/or the variance of estimates. The RPAR's dwell flexibility capability is explored as a possible way to tailor the scan to meteorological observations with the goal of improving data quality. Three advanced RPAR scanning techniques are developed exploiting these capabilities, and their performance in support of meeting the radar functional requirements is quantified. The proposed techniques are implemented on the Advanced Technology Demonstrator (ATD), a dual-polarization RPAR system at the National Severe Storms Laboratory (NSSL) in Norman, OK. Data collection experiments are conducted with the ATD to demonstrate the performance of the proposed techniques for dual-polarization observations. ▼ This dissertation is comprised of three essays that address the question: what specific cognitions lead to the formation of entrepreneurial intentions? Essay 1, "Explaining and Predicting Entrepreneurial Intentions," investigates currently theorized antecedents of entrepreneurial intentions to determine the degree to which they predict entrepreneurial intentions. Findings suggest that proximal cognitions such as feelings, desires, emotions, and attitudes predict intention formation, albeit limited to situations where entrepreneurial behavior is imminent. Additionally, distal cognitions, such as biases, heuristics, scripts and maps, although useful in explaining intentions, are of little predictive value except when predicting the distal intention to become an entrepreneur in those with no entrepreneurial experience. Overall, results indicate that the antecedents used to explain entrepreneurial intentions are of limited predictive value. Essay 2, "The Role of Cognitions in the Formation of an Entrepreneurial Mindset," examines which specific core-level antecedents act to form entrepreneurial mindset and how these cognitions relate to the formation of entrepreneurial intentions. It posits that core-level cognitions related to "the self (entity-schema, possible-self, and self-efficacy) lead to the formation of an entrepreneurial mindset. The essay further posits that entrepreneurial mindset is the principal antecedent to entrepreneurial intentions. This conceptual investigation culminates in the presentation of a general theory of volitional behavior. Essay 3, "An Empirical Evaluation of Entrepreneurial Mindset Using the Theory of Volitional Behavior," tests to what degree entrepreneurial mindset affects the formation of entrepreneurial intentions. Results indicate that individuals who possess an entrepreneurial entity-schema, an entrepreneurial possible-self, and entrepreneurial self-efficacy, on average, tend to form an entrepreneurial mindset. Furthermore, those individuals possessing an entrepreneurial mindset are more likely to form entrepreneurial intentions and ergo, are most likely to undertake entrepreneurial behavior. When taken together, these three essays show that (1) currently theorized antecedents of entrepreneurial intentions, although useful for explaining entrepreneurial intentions, are of limited use in the prediction of intention formation. (2) Core-level cognitions, specifically those relating to "the self, represent a viable means of predicting formation of an entrepreneurial mindset. (3) Entrepreneurial mindset leads to the formation of entrepreneurial intentions, which offer one possible answer to the primary research question, what specific cognitions lead to the formation of entrepreneurial intentions? Se há poucos anos não era possível prever que a indústria das aeronaves não tripuladas (drones) pudesse registar um avanço tecnológico tão assinalável, menos previsível seria o crescimento que esta indústria comportaria no seio da aviação civil. É provável que aumente o número de drones em uso, bem como a variedade de finalidades da sua utilização – inclusive, que esta tecnologia venha a substituir as aeronaves tripuladas em muitas das operações comerciais. No entanto, para que tal seja possível, é necessário responder à pergunta "como irão os drones partilhar o espaço aéreo com dezenas de milhar de aeronaves tripuladas existentes, de forma segura e sustentável?". Nesta dissertação de tese de mestrado é proposto um conjunto de requisitos e limitações operacionais que encontram fundamento ora em regulamentação já existente, ora em propostas de regulamentação ainda em estudo. Ainda que os critérios que devem subjazer à regulamentação nacional que venha a ser definida tenham por base as melhores práticas desenvolvidas em diversos Estados, importa realçar que tais referenciais não estão harmonizados entre si – e que a mera análise dos pressupostos subjacentes à definição dos parâmetros de referência de cada uma das regulamentações exigiria uma investigação autónoma e exaustiva. A presente dissertação toma como válida a regulamentação dos diversos Estados, não cabendo no âmbito desta questionar a sua racionalidade ou legitimidade. A integração total da operação dos drones só será possível com a implementação de um sistema regulamentar baseado no risco da operação, proporcional e progressivo. É este o racional subjacente ao conceito de operação aplicável aos drones – pelo que se propõe um conjunto de regras, requisitos e limitações operacionais que permitem integrar parcialmente a operação de drones em espaço aéreo nacional, nomeadamente a operação que representa um risco inferior ao das aeronaves tripuladas, bem como a operação em linha de vista do operador. Finalmente, importa referir que ao longo desta dissertação foram identificadas diversas linhas de investigação que, apesar de estranhas ao âmbito da presente análise, devem ser merecedoras de uma investigação específica e autónoma.

L'objet principal de notre recherche sera d'essayer d'éclairer l'obscurité relative à la figure du contrat normatif, existante particulièrement en espagne, en élaborant une étude minutieuse et en profondeur qui fait actuellement défaut dans la littérature juridique. de même, il sera aussi bien nécessaire d'analyser si la notion de contrat normatif, telle qu'elle est proposée par la doctrine et jurisprudence espagnole et surtout italienne, peut être transposée au droit français des contrats. et, d'autre part, si la notion française de contrat-cadre correspond à celle, espagnole, de « contrato marco ». pour ce faire, il sera nécessaire d'entamer une étude de ses différences et similitudes au moyen d'une comparaison de l'emploi, par les professionnels du droit de chaque pays, de chacun des termes. finalement il sera envisagé, le cas échéant, l'opportunité d'une éventuelle transposition de la figure du contrat-cadre au droit espagnol à travers celle de « contrato marco », l'intégrant comme équivalente ou application de la figure de contrat normatif.ainsi, une fois notre recherche achevée nous serons en mesure de proposer une définition complète et claire de contrat normatif, de déterminer sa nature juridique, d'obtenir ses principaux caractères, d'en tirer sa portée et, enfin, de rassembler ces principales applications pratiques. et ce, naturellement sans oublier de relever tant l'histoire ou la genèse de cette figure que sa valeur actuelle, en tant que nouvelle forme de négociation, d'autorégulation et de limitation volontaire de la liberté contractuelle.

How far are now individuals free to create the most appropriate contractual tool to achieve the satisfaction of their needs and interests? What they have in common figures as diverse as a joint-venture agreement, a franchise agreement or a marriage contract? Is the old general theory of contract adapted to the contractual practice of the XXI century? A deep study of the normative contract in this book provides answers to these and to many other momentous matters of Private Law of Contract. Reconstructed from the detailed analysis of the theory and legal practice, the notion of normative contract as an agreement of cooperative nature could constitute the bridge to a new and inspiring way of conceiving the contract. Not surprisingly, as shown by its main practical manifestations, the contract is often more than just an instrument to organize an exchange of goods and services, a powerful regulatory tool of reality and human behavior. ▼ La première partie de l’étude est consacrée à l’invocation, intra et extra muros, du droit à un procès équitable. Sont analysés ainsi, dans un premier temps, l’applicabilité directe de l’article 6 et la subsidiarité de la Convention par rapport au droit national et de la Cour Européenne des Droits de l’Homme par rapport aux juridictions nationales. Le droit à un procès équitable étant un droit jurisprudentiel, l’étude se focalise, dans un second temps, sur l’invocabilité des arrêts de la Cour Européenne et plus précisément sur l’invocabilité directe de l’arrêt qui constate une violation du droit à un procès équitable dans une affaire mettant en cause l’Etat et l’invocabilité de l’interprétation conforme à l’arrêt qui interprète l’article 6 dans une affaire mettant en cause un Etat tiers. L’introduction dans l’ordre juridique français et hellénique de la possibilité de réexamen de la décision pénale définitive rendue en violation de la Convention a fait naitre un nouveau droit d’accès à la Cour de cassation lequel trouve son terrain de prédilection aux violations de l’article 6 et constitue peut-être le pas le plus important pour le respect du droit à un procès équitable après l’acceptation (par la France et la Grèce) du droit de recours individuel. Quant au faible fondement de l’autorité de la chose interprétée par la Cour Européenne, qui est d’ailleurs un concept d’origine communautaire, cela explique pourquoi un dialogue indirect entre la Cour Européenne et la Cour de cassation est possible sans pour autant changer en rien l’invocabilité de l’interprétation conforme et le fait que l’existence d’un précédent oblige la Cour de cassation à motiver l’interprétation divergente qu’elle a adoptée.La seconde partie de l’étude, qui est plus volumineuse, est consacrée aux garanties de bonne administration de la justice (article 6§1), à la présomption d’innocence (article 6§2), aux droits qui trouvent leur fondement conventionnel dans l’article 6§1 mais leur fondement logique dans la présomption d’innocence et aux droits de la défense (article 6§3). Sont ainsi analysés le droit à un tribunal indépendant, impartial et établi par la loi, le délai raisonnable, le principe de l’égalité des armes, le droit à une procédure contradictoire, le droit de la défense d’avoir la parole en dernier, la publicité de l’audience et du prononcé des jugements et arrêts, l’obligation de motivation des décisions, la présomption d’innocence, dans sa dimension procédurale et personnelle, le « droit au mensonge », le droit de l’accusé de se taire et de ne pas contribuer à son auto-incrimination, son droit d’être informé de la nature et de la cause de l’accusation et de la requalification envisagée des faits, son droit au temps et aux facilités nécessaires à la préparation de la défense, y compris notamment la confidentialité de ses communications avec son avocat et le droit d’accès au dossier, son droit de comparaître en personne au procès, le droit de la défense avec ou sans l’assistance d’un avocat, le droit de l’accusé d’être représenté en son… Advisors/Committee Members: Nourissat, Cyril (thesis director).
