▼ This dissertation explores the transformation of food culture in urban areas of the American South during the first part of the twentieth century. From 1900 to 1964, southern culinary practices became more public and more in line with national trends. The first three decades of the twentieth century marked an important period of change. In southern homes, white, middle-class, urban women formed a commitment to scientific cooking and used its strict rules to construct new racial and class identities within the urban environment. At the same time, newly urban peoples began frequenting a variety of different types of public eating places. Socio-economic, racial, ethnic, and gender diversity within these spaces encouraged the white power structure in southern cities to implement laws to regulate these public spaces. Such regulation included municipal ordinances that restricted eating places based on race and contributing to the development of a system of racial segregation within the region's urban areas. White southerners maintained racial segregation in public eating places through images and everyday rituals that identified the black consumption of food as subordinate to white consumption. At the height of Jim Crow, however, southern consumption culture also cultivated the seeds of segregation's destruction. Segregated black cafes stimulated African American community building and empowerment, both of which served to undermine the strength of segregation. At the same time, as southern food practices became more entwined with national standards, food systems emerged and spread across the South that encouraged more democratized spaces for the consumption of food. The nationalization of southern food culture, the determined efforts of civil rights activists to end segregated eating patterns, and the continued intransigence of white supremacists to maintain racial segregation in food venues encouraged the United States Congress to enact the Civil Rights Act of 1964 which, among other things, required the desegregation of public eating places. ▼ The historic decision of Brown v. Board of Education (1954) declared that separate schools were inherently unequal, yet the U.S. Supreme Court did not specifically make instructions on how school desegregation would occur. Because of this, many school systems planned to delay desegregation for as long as possible. The passage of the Civil Rights Act of 1964 finally gave the federal government the right to withhold funds from schools that refused to desegregate. As it became clear that many schools had not made adequate plans for desegregation, Dr. Michael J. Stolee and his colleague, Dr. Harry Hall, of the University of Miami, saw an opportunity to help schools make integration a reality through the creation of a desegregation assistance program. The South Florida School Desegregation Consulting Center became the first federally-funded desegregation assistance center in the country. Through his work at the center, Stolee became one of the first nationally recognized experts on school desegregation. While many historians have covered topics relating to school desegregation, this paper explores the trajectory of school desegregation through the career of an expert. Stolee initially called for wide-scale busing to achieve desegregation. However, over time, his methods changed to accommodate both the general perceptions regarding busing for desegregation purposes, as well as the attitude toward busing by the Nixon administration. Stolee was one of the first widely-accepted experts on school desegregation and through his work with the South Florida School Desegregation Consulting Center, as an expert witness, and as a court-appointed special master, made a huge impact in the field of school desegregation in both the northern and southern United States. The research comes, when possible, from primary sources found in Stolee’s collection of papers at Old Dominion University in Norfolk, Virginia. Advisors/Committee Members: Littlejohn, Jeffrey L. ▼ With a budget of 2.25 million and 100 employees at its central headquarters in Washington D.C., the U.S. Equal Employment Opportunity Commission (EEOC) opened its doors for operation in May of 1965 to oversee the implementation of Title VII of the 1964 Civil Rights Act. Although the EEOC began with the charge of enforcing federal laws designed to end workforce discrimination based on race, sex, color, religion and national origin, it underwent significant increases in its size and scope. By 2011, the EEOC’s budget had increased to 385.3 million, its workforce grew to 2,577 employees in over 53 field offices, and it had established work-share agreements with 64 Tribal Employment Rights Organizations (TEROs) and 94 Fair Employment Practice Agencies (FEPAs). The scope of the EEOC also expanded to include oversight over federal EEO laws addressing employment discrimination against the elderly, compensation discrimination, disability discrimination, and genetic information discrimination. Today, the EEOC is responsible for coordinating all federal EEO regulations, practices, and policies; interpreting employment discrimination laws and monitoring federal sector employment discrimination program; providing funding and support to FEPAs; and sponsoring outreach and technical assistance. Despite the transformation of the EEOC from a legislative cartel to a fully entrenched institution, scholars have neglected to provide a broad understanding regarding how bureaucracies transform from organizations that handle specific tasks for clients to institutions with size, stability, rules, and value beyond the tasks at hand. To determine whether bureaucracies have the potential to emerge as institutions, this dissertation provides a longitudinal study of the emergence and evolution of the EEOC. Through an examination of multiple variables spanning from 1965 to 2010, the institutionalization of the Commission is examined along five dimensions: adaptability, complexity, professionalization, autonomy, and coherence. Findings reveal that, to emerge as institutions, federal bureaucracies must demonstrate an ability to deal with environmental challenges and age, develop complex hierarchical and functional structures, groom a professionalized staff, articulate interest distinguishable from external forces, and foster consensus around their functional boundaries and procedures used to address disputes that arise within their jurisdictions. ▼ This Dissertation explains the gradual erosion of the Voting Rights Act through an examination of the subterranean political battles that took place within the Justice Department, the courts, Congress, and the States between 1965 and 2013. It then looks to the future of the Voting Rights Act and offers legal and legislative strategies that could rehabilitate the statute’s framework and aims. Its central goal is to reveal like never before the hidden politics of voting policy “retrenchment.” Retrenchment refers to the efforts of opponents to reverse, blunt, or erode a policy commitment. Though scholars have come to view retrenchment as a distinctive political process focused on “blame avoidance,” rather than “credit claiming,” our understanding of this concept is still in its infancy. This Dissertation stretches our knowledge of retrenchment in three distinct ways. First, unlike prior research—which has focused nearly exclusively on conservative opposition to the distribution of benefits under programs stemming from the American welfare state—it ventures into an unexplored realm: that of civil rights generally, and the Voting Rights Act in particular. Second, this Dissertation’s examination of retrenchment efforts in each political arena is far more granular than previous studies. For instance, it drills down to the legal doctrine at issue, and explains how the policy commitments encapsulated in that doctrine were progressively weakened over forty years. Third, this Dissertation is far more rigorous in its investigation of how the political dynamics of one arena can mediate retrenchment efforts in others. Specifically, it employs an original dataset consisting of every case litigated by the Civil Rights Division’s Voting Section to show how Congress, the president, and regulated parties impact retrenchment at the Department of Justice. This Dissertation teaches that retrenchment must be understood as a multi-faceted phenomenon that occurs throughout the government ecosystem. It also instructs that the nature and form of the policy at stake are crucial to determining where retrenchment will predominate. Finally, it suggests that our definition of “retrenchment,” and the typology of methods for accomplishing it, must expand beyond their current boundaries. ▼ Title IX of the Education Amendments of 1972 is a federal law that prohibits sex discrimination in education (The United States Department of Justice, n.d.). Although Title IX was enacted over 45 years ago, college athletic departments remain non-compliant with the law (U.S. Department of Education, Office for Civil Rights, 2016; Women's Law Project, 2014), suggesting a need for research regarding barriers to compliance. A central piece in the Title IX enforcement mechanism is engagement on the part of constituencies who are affected by the law. In effect, the accountability mechanism to ensure Title IX compliance rests with those who are educated about its requirements. Within athletic departments, those constituencies include coaches, administrators, staff members, and athletes. This paper provides an overview of the literature that documents knowledge deficiencies among those constituencies (Staurowsky & Weight, 2013; Weight & Staurowsky, 2014; Staurowsky, Zonder, & Reimer, 2017) as well as the lack of Title IX compliance, proportionality gaps, and ongoing litigations among Division II institutions (U.S. Department of Education, Office for Civil Rights, 2012, 2014, 2015a, 2016; Women's Law Project, 2014, 2017). The purpose of this non-experimental, quantitative, cross-sectional survey research was to examine the levels of knowledge and perceptions among Division II athletic administrators, staff, and coaches regarding Title IX standards at their institution. More specifically, this study sought to gain a more in-depth understanding of overall knowledge and perceptions among Division II participants, as well as, determine if any differences existed between the respondents based on gender, position, and team coached. This study found that, on average, participants' knowledge ranged from 0 to 6 with a mean of 3.04 (SD = 1.64). In addition, this study revealed that the main effect of position was statistically significant; (F(2, 124)=6.99, p<.001), while the main effect of gender on knowledge, and the interaction effect between position and gender on knowledge were not statistically significant (p>.05). Further, it was discovered that the main effect for coach by team gender was not statistically different between groups (p>.05). Regarding perceptions, participants' perceptions were similar when looking at Overall Perceptions, Opportunities for Participation & Scholarship, Benefits and Services, Awareness and Understanding. This study found the main effect of gender and the interaction effect between position and gender was not statistically significant (p<.05) for all categories. In comparison, this research discovered the main effect of position was statistically significant for overall perceptions (F(2, 124)=3.290, p<.05); benefits and services (F(2, 124)=4.111, p<.05); and for awareness and understanding of Title IX issues (F(2, 124)=5.011, p<.50). ▼ Taxation is fundamental for development in South Africa (SA), a developing country with an emerging economy in which taxation is essential to capacitate the government so that it can fulfil its mandate under the Constitution of the Republic of South Africa, 1996 (Constitution). This mandate includes bringing about socio-economic transformation, part of transformative constitutionalism, through progressively realising socio-economic rights. This dissertation examines the way in which tax administration may take place efficiently and effectively with due respect for taxpayers' rights. A clear link is shown between taxation, human rights and the South African government's responsibilities to attain its transformation targets. To facilitate this process, the Constitution creates a legal framework for the imposition of tax and for the equitable distribution of tax revenue among the three spheres of government. For historical, political and other reasons, South Africans generally, as happens elsewhere in the world, lack a strong culture of voluntary tax compliance. Wilful non-payment of tax is antithetical to the values of democracy, ubuntu and the rule of law. Tax non-compliance minimises revenue collected from taxation. This, in turn, hinders the attainment of transformation in all its facets. A pressing need exists for laws that, on the one hand, promote tax morality and, on the other, strengthen the South African Revenue Service (SARS) so that it can effectively administer SA's national tax system (or grid). To this end, the Tax Administration Act 28 of 2011 (TAA) is pivotal. It regulates tax administration, a part of public administration. Under the Constitution, SARS is obliged to execute its functions in a manner respectful of taxpayers' rights and that upholds the Constitution’s values and democratic principles. Consequently, the TAA must strike a fair balance between, on the one hand, protecting taxpayers' rights and, on the other, arming SARS with adequate powers with which it can effectively combat the mischief of tax non-compliance. This dissertation shows that, when viewed through the prism of s 36 of the Bill of Rights (BOR), the powers conferred on SARS by ss 45(1), (2), 63(1) and (4) of the TAA to conduct warrantless inspections and searches, as the case may be, limit taxpayers' rights to, inter alia, privacy. It concludes that, whilst ss 63(1) and (4) ought to pass muster, ss 45(1) and (2) are susceptible to a declaration of invalidity under s 172(1) of the Constitution. O período compreendido entre a renúncia de Jânio Quadros à presidência da República, a eclosão do Movimento da Legalidade em 1961, passando pelo golpe civil-militar de março/abril de 1964 foi marcado por acirrados conflitos entre diferentes grupos sociais no cenário político e social brasileiro. O Partido Trabalhista Brasileiro (PTB) atuou nesse contexto, principalmente na defesa das Reformas de Base e do nacionalismo, fomentando movimentos sociais reformistas que interpelavam ou eram promovidos por camponeses, sindicatos, estudantes e subalternos militares. A partir desse contexto, o presente trabalho visa analisar as recepções e reações dessa crise política junto às lideranças político-partidárias no município de Canoas, na Região Metropolitana de Porto Alegre. Canoas era, naquele momento, uma cidade com significativo contingente de operários entre seus moradores, público-alvo do PTB. A radicalização aqui será entendida como uma forma de luta política. Pretende-se entender como a radicalização foi recebida, apropriada e utilizada pelos setores políticos daquela localidade. A metodologia aqui utilizada é a leitura e análise qualitativa da documentação legislativa da Câmara Municipal de Canoas entre 1961 e 1964. Além da fonte legislativa, serão igualmente empregadas na pesquisa as atas do Diretório Municipal do PTB em Canoas, entre 1962 e 1964; periódicos da época de Canoas, Porto Alegre e Rio de janeiro; publicações que trazem informações, relatos e notícias relacionadas à cidade naquele período histórico e entrevistas realizadas com testemunhos da época. Ainda, será usada a prosopografia como método de análise da elite política local, a partir das fontes já citadas.

The period between the renounce of Jânio Quadros to the presidency of the Republic, the outbreak of the Legality Movement in 1961, followed by the civil-military coup,which occurred in March / April 1964 was marked by fierce conflicts among different social groups in the Brazilian political and social scenario. The Brazilian Labor Party (PTB) acted in this context, primarily in defense of the Basis Reform and the Nationalism, encouraging social reform movements that were erupted or promoted by peasants, trade unions, students and military subordinates. In Rio Grande do Sul, under the leadership of Leonel Brizola, a large part of these organizations agglutinated a series of projects and ideas and began to defend them in an increasingly radicalized way, confronting themselves in the political arena with conservative oppositions. ▼ The American refugee resettlement program’s stated goal within the 1980 Refugee Act is to help refugees achieve “economic self-sufficiency... as quickly as possible.”1 The Act is the genesis and primary policy source of the current resettlement system. Through constructing self-sufficiency along economic terms and limiting the reception and placement program to ninety days, the Act creates a definition of economic self-sufficiency attainable for case workers and refugees along this short timeline, effectively defining the program’s main goal to be job placement, rather than career or sustainable employment support.2 This implementation begs the question: What are the effects of this policy goal on the implementation of resettlement in the United States, and how does this impact refugees’ social and economic rights? In what follows, I consider this question, as well as its relevant counterpart: Does the resettlement system facilitate refugees’ integration into American society? To respond, I interrogate the American refugee resettlement system’s ability to protect and fulfill refugees’ economic and social rights in the United States. I define these rights as they are described in the 1967 Protocol to the 1951 Refugee Convention, and the U.S.’s 1980 Refugee Act. Over a period of six months, I engaged case workers and refugees (n=11) in interviews to examine their experiences with the resettlement program, and to ask their thoughts on the “success” of the current resettlement system. By broadly framing success, I created space for interviewees to determine their own indicators, and this demonstrates important limitations of the American resettlement system with implications for the protection of refugees’ rights. All of my interviewees presented structural critiques of the current resettlement system and critiqued its ability to facilitate refugee “self-sufficiency,” which they defined differently than the rather limited definition in the 1980 Refugee Act. This critique also arose often in resettlement literature focused on the American system, and through putting my research and relevant research into conversation together, I assert that the current system fails to adequately protect and fulfill refugees’ economic and social rights in the United States, outlined in the Universal Declaration of Human Rights, the 1951 Refugee Convention and 1967 Protocol, and other international human rights conventions.

En 1948 le Président Harry S Truman signe le "Women’s Armed Services Integration Act". Cette loi est en fait le fait d’armes de Margaret Chase Smith, sénatrice et représentante de l’état du Maine. En 1948, à travers le" Women’s Armed Services Integration Act" Madame Smith met en avant ces milliers de femmes qui, après l’enrôlement obligatoire pour cause de deuxième guerre mondiale, voient en l’armée une nouvelle carrière qui s’ouvre à elles. Seule femme ayant été élue, sous la bannière républicaine, à la Chambre des représentants et au Sénat de son propre chef, Margaret Chase Smith rencontre le sénateur Joseph McCarthy, « grand ordonnateur » des audiences du HUAC dans les années 50, lors d’un dîner informel. Les Américaines s’organisent aussi pour leurs droits, sur le plan syndical les années 50 peuvent bien être la “missing wave” clamée par l’historienne Dorothy Sue Cobble. Cette thèse, ayant pour toile de fond l’étude de cas de deux cents femmes interrogées par le HUAC de McCarthy, met en lumière, de façon significative, les individus et les militantes, femmes réelles qui sont les principales protagonistes des changements historiques, notamment une égalité à travers le Civil Rights Act de 1964. ▼ The response of Southern states to the Fifteenth Amendment’s grant of voting rights to former slaves was nearly a century of self-serving interpretations of the Fifteenth Amendment that resulted in “voter dilution”—the de facto disenfranchisement of Blacks throughout the former Confederacy. This dissertation will examine the relative success or failure of the remedies for vote dilution embodied in the 1965 Voting Rights Act (VRA), in particular the concept of the “majority-minority” congressional district. In 1965, the nascent legislation had as its primary emphasis the elimination of impediments to voting registration, particularly impediments designed to restrict registration by African-Americans. Since the mid-1980s Justice Department policy has recognized that voting registration rates among minorities have risen to levels roughly equivalent to those of whites, but that minority seating in state and federal legislatures has not seen proportionate gains. To correct this perceived imbalance, the Department of Justice has aggressively promoted the VRA enforcement policy known as “majority-minority redistricting.” Majority-minority redistricting refers to the insistence by the Department of Justice that every state, during the decennial redistricting exercises that follow each census, create as many districts as possible which contain a resident population of 50 % or more minorities. After the 2010 census, 25 states had sufficient concentrations of minority residents to form a total of 107 such districts. This policy of “maximization” of the number of majority-minority districts was justified by the Justice Department’s civil rights attorneys by four assumptions that became a primary rationale for VRA enforcement: (1) such districts will increase rates of electoral participation by minorities; (2) minority candidates need minority voters to achieve electoral success because whites vote en bloc and frustrate minority electoral chances; (3) minority candidates will emerge to run in such districts; (4) increased candidate emergence will promote competition for office. Electoral data was compiled and tests were performed that demonstrate that the four assumptions presented by the Department of Justice for the maximization of majority-minority districts must be rejected. What is demonstrated is that these policies waste votes, unintentionally distort electoral outcomes and fail to advance minority electoral opportunity to the extent contemplated by VRA adherents. In addition to the tests on the four assumptions of the Department of Justice, comparative tests were made on electoral results subsequent to redistricting accomplished by either a state legislature or by a non-politician, independent commission. It will be demonstrated that districts formed by commissions, when compared to districts formed by politicians concerned with incumbency and party dominance, show higher rates of voting, more competition for office, higher turnover of seats to new officials and higher rates of minority electability. ▼ The 2016 presidential election was the first such contest since 1964 to take place in the absence of a key enforcement provision of the Voting Rights Act of 1965, namely Section 5 of the Act. Since the Supreme Court controversially suspended implementation of Section 5 in 2013, many states and localities have been transforming the legal and administrative frameworks of their elections, with dramatic implications for voter turnout and access to the franchise, especially for racial and ethnic minorities. The stakes are high: along with the Civil Rights Act of 1964, the Voting Rights Act dismantled the legal foundations of white supremacy in the southern United States, and its vigorous enforcement enfranchised millions of black and poor white voters. Section 5 required that covered jurisdictions obtain prior approval from the federal government for certain changes to its electoral institutions or election administration. In its 2013 decision, the Supreme Court overturned the formula for determining which jurisdictions were covered by Section 5. The coverage formula was originally based on the use of discriminatory “tests or devices,” and voter participation rates in the 1964 presidential election. The formula was renewed four times by Congress, with minor revisions. Overturning this formula in 2013, the Supreme Court in effect suspended the application of Section 5 across 15 states that were covered completely or in part. Chief Justice John Roberts wrote for the majority that it was “irrational for Congress to distinguish between States in such a fundamental way based on 40-year-old data, when today’s statistics tell an entirely different story. And it [was] irrational to base coverage on the use of voting tests 40 years ago, when such tests have been illegal since that time” (Shelby County v. Holder 2013). Do current “statistics tell an entirely different story?” This dissertation examines how Section 5 affected election-related outcomes in a single but important state, North Carolina. North Carolina is a critical case to investigate because it has a distinctive pattern and scope of Section 5 coverage and unusually rich registration and turnout records stretching back decades. The findings are unambiguous. Section 5 had a positive, independent, and statistically significant effect on voter turnout and registration at its outset and also over time, including in the period just before its suspension. These effects were particularly strong among black North Carolinians. Moreover, the data show that suspending Section 5 in 2013 depressed turnout in the 2016 statewide elections in North Carolina, especially for black voters. The dissertation also investigates the mechanisms for the effectiveness of Section 5 coverage in protecting the franchise, including improved registration rates and polling places per 10,000 voting age persons. ▼ The focus of this thesis is on the evolving public discourse surrounding imprisonment in South Africa from the colonial period to the post-apartheid era, and its effects on the human rights of prisoners. Although the punishment of imprisonment has dominated the penal landscape for around 200 years it is clear that, in terms of its stated aims of reducing crime and rehabilitating criminals, it has proven to be an abject failure. The influential philosopher Michel Foucault maintains that the failure of this form of punishment was apparent from the very beginning of its rise to prominence in the Nineteenth Century. It turned out, however, that the very failure of the prison system – its propensity to "create" a class of criminals separated from the rest of society – was useful in the context of developing capitalist industrial societies. As a result, this form of punishment did not wither away, but continued in existence despite repeated crises and widespread public acknowledgement of its failure to reform criminals or to reduce crime. The above may be true of the manner in which imprisonment, as a form of punishment, evolved in France and in the developed world in general, but the question at the heart of this thesis is whether or not Foucault's theory holds true in the South African context. In other words, by carefully tracing the public discourse surrounding imprisonment in South Africa from the colonial to the post-apartheid periods, a primary aim of this thesis is to establish whether the evolution of imprisonment in South Africa follows the same pattern as that outlined by Foucault – a pattern of apparent "failure" from the very start, with regular and repeated, but ultimately futile, attempts at "reform". By showing that this is, in fact, the case – that the South African prison system has been lurching from crisis to crisis since its inception, with the same "solutions" being suggested from one decade to the next – this thesis suggests that the "problem" with imprisonment in this country lies at a structural and ideological level. If this thesis is correct, "reforming" the South African penal system will not be possible without completely rethinking imprisonment as a form of punishment at an ideological level. Precisely what such a rethinking might entail, this thesis leaves open for future scholarship. An important secondary aim of this thesis is to trace the evolution of penal ideology in the South African context. In other words, it sets out to trace the development of the perceptions and ideas which have underpinned the punishment of imprisonment in this country over its history. Starting in the colonial period and focusing in particular on colonial Natal, these ideas may be described as the articulation of the penal theories and assumptions of an industrialised metropolitan political economy – Great Britain – and those of a rural colonial political economy – the Colony of Natal.
