▼ Les formes de la criminalité varient selon la personnalité des auteurs d’infractions mais aussi en fonction de l’évolution des technologies. A ce titre, le développement très rapide de l’internet constitue un facteur susceptible de bouleverser les règles ordinaires du droit et de la procédure pénale en raison des problèmes particuliers que crée cet outil qui peut aisément devenir un moyen de commettre de multiples infractions pénales. En outre, l’internet présente des formes plus variées qu’il n’y paraît au premier abord car, au-delà de sa partie visible aisément accessible, les spécialistes ont mis en lumière l’existence de ce qu’ils appellent le « Deep web » ou « Web profond ».Ce « Deep web » est une partie du web en ligne non référencée par les moteurs de recherche habituels tels que Google ou Yahoo par exemple. Et selon Chris Sherman et Gary Price, dans leur livre The Invisible Web, seuls 3 à 10 % des pages seraient indexés sur internet. Le reste, non accessible pour les internautes ordinaires, constitue le web invisible et il existerait ainsi plus d’un milliard de données « cachées ». Les raisons pour lesquelles certains sites ne sont pas référencés sont diverses. Dans certains cas, les documents sont trop volumineux ou les bases de données sont trop complexes pour que leur contenu soit indexé, mais dans d’autres cas, des individus décident de ne pas référencer leur site afin de « privatiser » l’information puisque seuls ceux connaissant la dénomination du site pourront y accéder. Il s’agit donc de ce qui pourrait être appelé « partie immergée » d’Internet. Mais au delà du web profond, des outils de reconnaissance indétectables par les moteurs de recherches habituels sont apparus, ce sont les darknets. Ils permettent de décrypter les pages invisibles et garantissent un anonymat quasi absolu et surtout un accès au Darkweb, aussi appelé Web sombre. C’est ainsi que ce dernier a hébergé divers types de marchés noirs, de la drogue aux armes en passant par le trafic d’êtres humains. Le Hidden Wiki, sorte de Wikipédia illégal, se charge de référencer ces portes d’entrées sur cette partie d’Internet. De nombreux sites, commerciaux ou non, sont alors créés. A titre d’exemple, le site « Shroomtastic » permet d’apprendre à faire pousser des champignons hallucinogènes, activité illicite. Le site Silkroad, quant à lui, constitue un marché clandestin permettant d’acheter toutes sortes de drogues et il existe d’autres sites permettant de blanchir de l’argent, offrant les services de tueurs à gage, ou permettant d’obtenir de fausses cartes d’identité… En pratique, il est possible d’obtenir nombre de produits ou marchandises illégaux et, pour la livraison, cette couche d’internet possède même sa propre monnaie, le bitcoin. ▼ La criminalité féminine est marginale, atypique et paradoxale dans l'Hérault comme au niveau national. Marginale car la femme ne correspond qu'à un sixième des accusés. L'Hérault ne fait pas exception avec ses quinze pour cent d'accusés de sexe féminin. Atypique par rapport aux crimes supposés féminins. Bien que certains crimes semblent plus spécifiquement féminins car ils sont liés à la maternité et à la conjugalité, la participation des femmes à tous les autres crimes permet de relativiser le concept de criminalité féminine. Dans l'Hérault, bien que relativement absente de la criminalité, la femme est surreprésentée en matière d'infanticide, d'avortement et d'empoisonnement. Toutefois, sa participation aux atteintes contre la propriété (vol) et à certaines atteintes contre les personnes (coups et blessures, etc.) nuance l'existence d'une criminalité spécifiquement féminine. Il en résulte que la criminalité féminine est paradoxale, parce que les « faibles » femmes supposées incapables de commettre des crimes violents (leur rôle social les protégeant) accomplissent cependant les crimes qui comptent parmi les plus atroces. La contradiction réside aussi dans l'indulgence des sanctions réservées aux femmes auteurs de ces crimes. Il est difficile d'admettre que chaque sexe aurait des prédispositions pour commettre tel ou tel crime. La criminalité est davantage le résultat de facteurs criminogènes qui dépendent de circonstances sociologiques, économiques, psychiques et biologiques, communs aux deux sexes.
Women's criminality keeps marginal, atypic, and paradoxical, in the department of Herault as on a national level. « Marginal » because women only squares with five sixths of the accused. Herault is not an exception ,with its fifteen per cent of female accused. « Atypic » in relation to the supposed female crimes..Although some crimes seem more specifically feminine because they are linked with motherhood and conjugal life, the women's contribution to any other crime allow the concept of « women's criminality » to be softened. In Herault,even though the woman is rather absent from criminality, she is over-represented concerning child murder, abortion, or poisoning. However, her contribution to breaches against properties ( robberies), and to people ( assault and battery) moderates the existence of a specific female criminality. So the outcome is that female criminality is « paradoxical » because « weak » women, meant unable to commit violent crimes (their social part protect them from killing), commit the crimes which are ranked among the most abominable. The contradiction consists in the leniency of the punishments against women who have committed such crimes too. It is difficult to admit that each sex would have propensity to such or such a crime. Criminality is more the result of factors which depend on sociological, economical, psychic and biological circumstances, common to both sexs.

▼ While asylum as a concept has been known since ancient times, persons with a
criminal background have always been treated with suspicion and depending on the time and place would either be granted asylum in a limited form or not at all. When amorphous notions related to asylum began to become crystallized in international treaties during the 20th century, the issue of
criminality, although only pertaining to a very small number of asylum seekers, caused sufficient concern to the drafters of the various instruments to warrant its mentioning in a number of provisions in such agreements. Through the lens of exclusion from refugee status, this study assesses whether refugee
law has remained in step with the international and domestic regulation of
criminal conduct. At the international level, crimes such as genocide, crimes against humanity, war crimes, terrorism and organized crime have become the
subject of international treaties and jurisprudence. These types of crimes, as well as other areas of concern have been increasingly incorporated into domestic
criminal legislation. Since refugee
law is used in the same countries, which have been in the forefront of regulating these new types of
criminal behaviour, refugee decision makers have had to take into account these parallel developments. The purpose of this study is to determine how successful this attempt has been by comparing the legislation and jurisprudence in a number of countries and contrast those with the regulation of similar
criminal conduct outside of refugee
law.

▼ The aim of this explorative study is to establish if psychiatric disorders influence the
criminal capacity of child offenders. A qualitative approach was adopted in the study to develop an in-depth understanding of the issues pertaining to
criminal capacity assessments for child offenders with psychiatric disorders. The risks associated with various psychiatric disorders in relation to childhood
criminality, and the methods that are used to deal with child offenders who suffer from psychiatric disorders, were also explored.
The data collection tool for this study was a semi-structured interview schedule. Telephonic and face-to-face interviews were conducted with child justice and mental health experts from four provinces in South Africa, namely, KwaZulu-Natal, Gauteng, Eastern Cape and Western Cape. These experts included psychiatrists, psychologists, social workers, academic professors of
law, a criminologist and an advocate. Snowball sampling was employed and although this is a pure qualitative study, the open coding, axial coding and selective coding process from the grounded theory was applied to analyse and interpret the data.
The findings from this study indicate that psychiatric disorders are a risk factor associated with the causation of
criminal behaviour. A high prevalence of psychiatric disorders, such as intellectual disability, learning disorder, attention deficit hyperactivity disorder, oppositional defiant disorder and conduct disorder, were generally found in children in conflict with the
law. The influence and consequences of these psychiatric disorders, in conjunction with environmental and societal factors, were found to influence
criminal behaviour and were highlighted as factors that ought to be taken into consideration when determining the
criminal capacity of a child who is in conflict with the
law.
Findings from the study identified that adequate recognition was not granted to the influence of a psychiatric disorder in the assessment of a child‟s
criminal capacity. It was established that, in the
criminal capacity assessment, the emphasis should not be on the psychiatric disorder per se, but on the effect that the disorder and associated symptoms may have on the child‟s ability to distinguish between the wrongfulness of their actions and to act in accordance with this understanding.
Operational challenges and ambiguities identified in the legislative framework pertaining to child offenders with psychiatric disorders were found to negatively influence
criminal capacity assessments for children in conflict with the
law. The lack of services available to child offenders with psychiatric disorders, as well as child offenders without psychiatric disorders, was found to hamper the best interest of the children in conflict with the
law. Lastly, legislative and service recommendations for good practice to deal with child offenders with psychiatric disorder were identified by the experts.

▼ Diante da intensificação do processo de encarceramento feminino verificada na última década e das nefastas consequências que decorrem da prisionalização, a presente pesquisa voltar-se-á para a análise da criminalidade feminina a partir de uma perspectiva de gênero, a fim de identificar as especificidades do comportamento feminino e revelar como o gênero e as relações de poder dele decorrentes estão essencialmente entrelaçados na construção da realidade criminal. Para tanto, será adotada uma abordagem histórica sobre o conceito de gênero e da sua introdução analítica nas ciências jurídicas, a fim de compreender de que forma o paradigma de gênero colabora para a transformação do discurso jurídico. Em seguida, será exposta a trajetória das teorias criminológicas, passando pelos caminhos das teorias demonológicas até as feministas, com a finalidade de investigar as diversas abordagens da criminalidade feminina. Por fim, a partir da análise de processos criminais que tramitaram perante o Superior Tribunal de Justiça e abordaram o crime de tráfico de drogas para dentro dos presídios, serão investigados concretamente os diferentes aspectos que as questões de gênero podem relacionar-se com o fenômeno criminal.
In view of the intensification of female incarceration verified on the past decade and the nefarious consequences that follows the imprisonment, the following research will focus on the analysis of the female criminality from a gender perspective, willing to identify the female behavior specificities and reveal how the gender and the following power relations are essentially associated in the framing of the criminal reality. For this purpose, will be taken a historical approach about the concept of gender and its analytical introduction on the legal sciences, in order to understand how the gender paradigm collaborates for the legal discourse transformation. Afterwards, it will be established the criminological theories path, through the demonological theories up to the feminist theories, to investigate the various approaches about feminine criminality. Finally, from the analysis of processes that were processed before the Superior Tribunal de Justiça and addressed drug dealing into prisons, will be investigated truly the different aspects in with gender issues can relate with the criminal phenomenon.

▼ La facilité de communication et de télécommunication a pour corollaire l'accroissement de la criminalité et plus particulièrement de la criminalité internationale. On peut se poser la question de savoir si le droit camerounais répond aux exigences de la mondialisation en matière de lutte contre la criminalité internationale. Le constat peut en premier lieu se décliner en un sentiment de satisfaction en ce qui concerne les normes internes de lutte contre la criminalité, qui ont une incidence sur la sphère internationale. Ensuite, il est décevant en ce qui concerne l'intégration des normes d'incrimination des infractions internationales par nature et des modalités de collaboration avec les juridictions pénales internationales, d'où la nécessité de l'amélioration de la législation pénale camerounaise.
The development of communication and telecommunication has as a corollary the increase in crimes and in particular international crimes. The question may there for be raised whether Cameroonian penal law responses to the exigencies of the world in the fight against international criminality. A close examination of the above question reveals that at first sight, it seems satisfactory as regards internal norms for fight against crime, which in certain circumstances have an incident on the international atmosphere. On the other sight, it is not satisfactory because international offences by their nature have been simply ignored in Cameroonian criminal law. The state of Cameroon is not in the mode to cooperate with this jurisdiction. There is the need for reforms to ameliorate the penal legislation of the country.

lydinti. Šio darbo aktualumas ir naujumas pasižymi tuo, kad
moksliškai nusikalstamumas šiame visame regione, 2005 – 2009 m.
laikotarpiu nebuvo nagrinėtas. Tyrimo objektas – nusikalstamumas
Tauragės apskrityje 2005 – 2009 m. Problema – nusikalstamumas – tai
viena seniausių ir svarbiausių problemų pasaulyje. Norint tinkamai
ir efektyviai įgyvendinti kovos su nusikalstamumu priemones būtinas
nuolatinis jo būklės ir kitimo tendencijų stebėjimas bei analizė.
Tyrimo tikslas - išnagrinėti ir pateikti nusikalstamumo būklės
Tauragės apskrityje analizę. Pirmojoje darbo dalyje pateikiama
bendra socialinė, demografinė Tauragės apskrities charakteristika.
Kadangi pagrindiniai nusikalstamumą apibūdinantys rodikliai (būklė,
lygis, dinamika ir struktūra) ne iki galo atskleidžia tokio
sudėtingo reiškinio kaip nusikalstamumas bruožus, norėdami pateikti
gilesnę jo analizę atsižvelgėme į socialines, ekonomines,
kultūrines ir kt. regiono charakteristikas. Antrojoje darbo dalyje
nagrinėjama vyraujančių nusikalstamumo sampratų įvairovė.
Trečiojoje darbo dalyje pateikiama nusikalstamumo, Tauragės
apskrityje, pagrindinių rodiklių analizė. Nagrinėjama bendra
apskrities nusikalstamumo būklė, lygis ir dinamika, atskleidžiama
nusikalstamumo struktūra. Ketvirtojoje darbo dalyje analizuojami
užregistruotų fizinių asmenų, įtariamų (kaltinamų) padarius
nusikalstamas veikas Tauragės apskrityje asmenybės bruožai (t.y.

The theme of criminality is always relevant
and accompanies us. The relevance and the newness of this Thesis is
significant because academically the criminality was not analysed
in this district in 2005 - 2009 period. The object of the research
is criminality in Tauragė district in 2005 - 2009. The problem -
criminality is one of the oldest and the most important problems in
the world. Wanting effectively to realize the means of criminality
fight, it is essential a permanent observation of its condition and
variation tendencies and analysis. The purpose of research is to
explore and give the analysis of criminality condition in Tauragė
district. In the first part of the Thesis is presented a general,
social and demographic characteristic of Tauragė district. Whereas,
the main indicators that describe criminality (condition, level,
dynamics and structure), do not completely reveal the features of
such complicated phenomenon as criminality, therefore, giving the
deeper analysis of this, we considered social, economical and
cultural district characteristics. In the second part of the
Thesis, the variety of dominant criminality conception is examined.
In the third part of the Thesis, the analysis of the main
indicators of criminality in Tauragė district is presented. General
condition of district criminality, the level and dynamics are also

▼ The crime of housebreaking with intent to commit a crime was unknown in Roman and Roman-Dutch
law. This crime was treated as an aggravated form of theft. It emanates from the English
law crimes of burglary and housebreaking. Its development was fraught with technicalities due to the fragmentary nature of its elements. However, the South African
law followed its own developmental path even though the English
law authorities contributed to its development by way of authorities. There have been calls for this crime to be abolished or statutorily regulated due to the difficulties or problems caused by some of its elements and due to a lack of overarching rationale for it.
The purpose of this dissertation is to examine the „breaking‟ and „premises‟ requirements of the common-
law crime of housebreaking with intent to commit a crime from South African
law perspective. These two elements have been criticised for causing most difficulties or problems for this crime. The various journal articles, textbooks, relevant case
law and statutory provisions on this topic are considered for this dissertation. After due consideration of all the relevant material, it becomes conspicuous that the South African
law cannot afford not to have this crime as part of our
law; thus the crime cannot be abolished. The dissertation concludes that the crime of housebreaking should remain a common-
law crime as opposed to the proposal to have it becoming a statutory offence.

▼ While section 17 of the Constitution guarantees the right to freedom of assembly, the
violence that often accompanies the exercise of this right culminates in the violation
of the rights of non-protesters to, inter alia, life, dignity, equality and freedom and
security of the person. The crime of public violence is the primary measure in place
for the maintenance of the community’s interest in public peace and order as well as
the protection against the invasion of the rights of other people. Therefore, this
dissertation seeks to lead a debate on the question whether the apparent failure of
the crime of public violence to adequately safeguard the rights of non-protesters
means that the crime falls short of the objectives of section 39(2) of the Constitution
and thus requires to be developed in order to promote the spirit, purport and objects
of the Bill of Rights? If so, how must the development take place in order to meet
these objectives? Addressing the topic for debate invariably leads to an assessment
of the jurisprudential direction the South African courts are likely to take in the
question of developing the crime of public violence as a remedy to the erosion of the
rights of non-protesters during violent protests.

▼ Dolus eventualis is an important aspect of South African
criminal which has undergone certain modifications. One of these modifications was formulated in 1989 in the case of S v Goosen.
Before the decision of Goosen, the principle of
law was that as long as the accused foresaw the occurrence of the unlawful consequence, the manner in which it occurred was irrelevant. Dolus eventualis was said to be present if death was foreseen as a possibility but occurred in a way which was not exactly the same as the way which was anticipated by the accused. The accused did not have to foresee the precise or general way in which death would be brought about; it was enough that death was desired or foreseen.
The Goosen decision formulated the requirement of ‘foresight of the causal sequence’. This requirement is now essential in order to prove the existence of dolus eventualis in consequence crimes. According to the requirement of foresight of the causal sequence, the intention element is not satisfied if the consequence occurs in a way that differs markedly from the way in which the accused foresaw the causal sequence. This requirement differs from the principle followed by the courts in pre-Goosen decisions where foresight of the causal sequence was not necessary and was sometimes considered as irrelevant. All that was required was that the accused foresee the possibility of death occurring as a result of his or her unlawful conduct.
The purpose of this dissertation is to critically analyse the requirement of foresight of the causal sequence by analysing the case of S v Goosen, exploring how commentators received the Goosen rule and investigating how the rule has been applied in practice.
Although, the rule has attracted conflicting academic criticism, none postulate that the decision of Goosen made bad
law. One of the problems of the Goosen rule is that it is not consistently applied in practice. Although this is undesirable, the rule has not been detrimental to the
law and certainly does have a valuable place as it limits liability in common purpose cases, where an unlawful consequence occurs in a manner that the immediate party did not subjectively foresee.

▼ A large body or research provides strong evidence that parents play a significant role in the likelihood that adolescents will refrain from or engage in delinquent behavior. However, a significant omission in this line of inquiry pertains to the stability of parenting practices during adolescence and the implication of changes in parenting for delinquent behavior and factors known to be related to delinquency. The current study sheds light on these issues by making use of data from the National Institute of Child Health and Human Development (NICHD) Study of Early Child Care and Youth Development (SECCYD), a 15-year study that followed a U.S. national sample of families from the birth of a child to the time the child reached the age of fifteen. The findings of this study reveal that there are significant changes in parenting practices during early adolescence and that these changes are related to changes in delinquent behavior. In addition, changes in the quality of parenting are significantly related to changes in adolescent self-control and affiliations with delinquent peers, providing further evidence that changes in parenting having meaningful effects. Lastly, the observed relationship between changes in parenting and changes in delinquency during early adolescence is almost entirely accounted for by changes in self-control and changes in delinquent peer affiliations. Thus, this study contributes to the body of literature on the relationship between parenting and delinquency by providing evidence that parenting practices change over time and that these changes are related to patterns of delinquent behavior during a crucial developmental period in the lives of adolescents.

▼ The extraordinary breadth of the current home foreclosure crisis has made it a regularly discussed topic across the United States. Few cities can claim they have been unaffected by it as 94 of the nation's 100 largest metropolitan areas experienced an increase in home foreclosures in 2008. Such a rise in home foreclosure has left many curious about consequences that may appear in the wake of the largest crisis of this kind in American history. The purpose of this project is to better understand some of the potential criminal consequences of home foreclosure. In an attempt to answer this question, this study poses two primary research questions. The first: does a change in home foreclosures in a given neighborhood lead to an increase in crime in said neighborhood? And, in an effort to better understand the relationship between home foreclosures and crime, what other variables condition the influence of home foreclosures on crime, if any? Past theory and research suggest social disorganization and disorder theories to be the most appropriate to address this phenomenon. The merits of strain theories are discussed and the concept of suburban insulation is introduced. Finally, this study offers a preliminary look at how home foreclosures are influencing crime in Houston, Texas communities. Home foreclosure, crime, and other demographic data from Houston during the years 2005-2008 were compiled. Results from analyses employing dynamic panel models with an Arellano-Bond estimator indicate that changes in rates of home foreclosure over time do have a significant positive relationship with changes in the rates of total crime. Nonetheless, this influence is substantively minor. Lastly, higher levels of urbanization and economic disadvantage negatively impacted the influence of home foreclosures on crime.

▼ Much scholarly attention has been given to crime trends during recent decades in which the United States and the world experienced a spike in violent crime during the late 1980s into the early-mid 1990s, followed by an unanticipated and unparalleled decline during the mid to late 1990s. These trends have been described in detail by a number of scholars that have offered explanations ranging from record increases in incarceration to the rise and fall of crack cocaine. A lack of consensus regarding the main factors driving these trends has kept researchers interested, and arguably stuck in this period. As a result, we lack an understanding as to what has occurred in the last decade, begging the question, "What has happened since the 1990s?" The purpose of this paper is threefold: First, to determine whether there have been any significant changes in crime across cities in the U.S. since the end of the Great American Crime Decline, as well as to explore what economic, social, and criminal justice factors may be associated with these changes. Secondly, with an eye towards theory, a commonly used variable is reconceptualized and explored in depth. Finally, the existence of a national trend is examined in the context of a large sample of U.S. cities with hopes of guiding future research in the area of crime trends.

▼ While there is a great deal of research addressing the issue of stalking, very little of the work focuses on the law enforcement response to this crime. The current study used case analysis to determine how intimate partner stalking cases reported to a metropolitan police department in southeast Florida were addressed. The study also used survey analysis to test serving Florida law enforcement officers on their knowledge and training in Florida's anti-stalking law. Additionally, respondents were presented with a number of scenarios to classify. Among the relevant findings was the fact that officers use a classification other than stalking in the vast majority of cases. Research additionally revealed that cases not classified as stalking received little or no follow-up. Perhaps most significantly, research revealed the fact that unwanted communication from an offender, the most common form of stalking behavior, was the form of behavior respondents were last likely to classify as stalking.

▼ According to social threat theorists, it is the mere presence of blacks that induces a fear of crime which increases punitive attitudes and leads to the mobilization of social control. Blalock (1967) argued that social control is exerted upon minority populations that are deemed threatening. Recent work on the percent black and fear of crime has transformed this aggregate-level relationship into an individual-level measure of the presences of blacks, specifically, the racial typification of crime. The present study extends Chiricos and colleagues (2004) work on the racial typification of crime by conducting such analyses in Israel where there have historically been high ethnic tensions. The dissertation explores the relationship between the ethnic typification of crime and punitive attitudes by utilizing an Arab sample of respondents from Israel. Results indicate that the main hypothesis under examination was not supported by the regression analyses. The analyses demonstrated that concern for crime was the strongest predictor of punitive attitudes net of other control and demographic variables.

▼ Criminological research has consistently found support for the notion that prior offending is one of the strongest predictors of future offending. However, the discipline has not fully explored the dynamics of this relationship – more specifically, what factors may intensify the effects of prior offending on future offending and what factors may weaken the effects of prior offending on future offending. The present study attempts to address this void by examining the potential moderating effects of various risk and protective factors on this relationship. From a neighborhood disadvantage perspective, the implications here are quite substantial. Existing research has provided support for the idea that residents living in a disadvantaged environment are more likely to engage in deviant behavior. Thus, for those individuals in these disadvantaged areas, it is important to explore what happens following one's initial participation in deviant behavior, and whether certain factors may possibly push an individual deeper into a delinquent or criminal career or on the other hand, protect and guard the individual from further engagement in offending. The results presented here suggest that there are indeed certain risk and protective factors that may amplify or diminish the effects of prior offending on future offending.

▼ With the "get-tough" stance of the past three decades shaping the landscape of U.S. penal policy, the rate of female incarceration has increased at a rate higher than that for males since the early 1980s (Pollock, 2002). At the turn of the 21st century, 60% of women admitted to prison, compared to 41% of male offenders, were incarcerated for drug-related offenses (Chesney-Lind, 2002; Pollock, 2002). Given this, an understanding of what causes females to relapse and/or recidivate is critical in the development and implementation of appropriate correctional substance abuse treatment. Interest in the efficacy of correctional substance abuse treatment programming has resurfaced after a period of years in which the doctrine of "nothing works" in offender rehabilitation was accepted. The purpose of the present study was to evaluate the efficacy of substance abuse treatment programs operative for female inmates in the state of Florida released between 1995-2001. Consistent with previous research, the analyses produced mixed findings. Specifically, while institutionally-based programming did not reduce recidivism, community based programming was effective three years post-release from programming. Further evaluation (both process and outcome studies) and investment in treatment resources that can address the specific needs of females and provide a continuum of care are provided as recommendations for future research and practice.

▼ Méconnue du grand public, la criminalité dans le domaine de l'environnement et de la santé publique est pourtant une réalité, qui affecte notre quotidien et hypothèque l'avenir des générations futures. Des simples profiteurs aux groupes criminels, ce type de criminalité est protéiforme, se nourrissant de quatre effets majeurs : le manque d'harmonisation législatif, le taux relativement faible des poursuites pénales, les fortes marges bénéficiaires et une moindre exposition à des risques physiques. En outre, l'utilisation des nouvelles technologies et l’émergence des nouvelles formes d'économie favorisent encore un peu plus l'action néfaste des criminels. Ce faisant, sur les bases d'un droit technique et complexe, magistrats et officiers de police judiciaire s'astreignent à lutter contre cette forme de criminalité, tentent de s’approprier ses codes, d'analyser ses modes opératoires et de se forger aux nouvelles techniques d'enquête. Notre travail met en lumière la réelle conversion des délinquants opportunistes, des membres de réseaux et organisations criminels dans les secteurs de l'environnement et de la santé publique tout en essayant de faciliter l'approche pratique de la police judiciaire.
Unknown to the general public, crime in the field of the environment and public health is a reality, which affects our daily lives and puts the future of future generations at risk. From simple profiteers to criminal organized groups, this is a multifaceted criminality, based on three major effects: the lack of legislative harmonization, the relatively low rate of criminal prosecution, high profit and less exposure to physical risks. Moreover, the use of new technologies and the emergence of new forms of economy further favor the harmful action of criminals. Also, on the basis of a technical and complex law, magistrates and police officers keep fighting against criminals, try to understand their codes, analyze their operating methods and learn new techniques to investigation. Our work highlights the real conversion of opportunistic offenders, members of criminal networks or criminal organizations into the fields of environment and public health, while trying to facilitate a pragmatic approach of the criminal police.

▼ Le XXIe siècle voit la consécration des technologies numériques comme la fin du Moyen Âge a vu celle de l’imprimerie. L’ère numérique ignore désormais toutes les frontières. Elle permet l’accès à la culture et à la connaissance, favorise les échanges entre les personnes. Elle rend possible la constitution d’une économie en ligne et rapproche le citoyen de son administration. Les technologies numériques sont porteuses d’innovation et de croissance, en même temps qu’elles peuvent aider ou accélérer le développement des pays émergents. Mais un certain pessimisme vient tempérer cette approche idéaliste. Tous les progrès génèrent aussi de nouvelles fragilités et vulnérabilités propices aux menaces ou aux risques, car ils aiguisent l’imagination des criminels. La cybercriminalité est désormais une réalité. Elle est d’autant plus dangereuse qu’elle pénètre au sein des familles, là où la délinquance ordinaire n’avait pas accès jusqu’à présent. Dès lors, cette nouvelle forme de criminalité laisse apparaître comme une évidence, l'adaptation du système judiciaire. En effet, face à ces atteintes, il existe bel et bien des lois qui sont d'ores et déjà appliquées à l’Internet. Mais sont-elles réellement efficaces ? Dans le même sens, la coopération interétatique est-elle également suffisante pour lutter efficacement contre la cybercriminalité ? Ainsi, il importe de se demander si dans notre société moderne, le cadre normatif et la coopération institutionnelle tant européenne qu'internationale, sont suffisants et efficaces pour sanctionner les infractions cybercriminelles ?
The twenty-first century sees the consecration of digital technologies just as the end of the Middle-Ages saw the creation of printing.Henceforth, the digital era has no limits. It gives access to culture and knowledge, encourages the exchanges between people.It allows the constitution of an economy online and brings citizens closer to their adminitration. Digital technologies generate innovation and growth, and can help or accelerate the development of the emergent countries as well. But a certain pessimism moderates this idealistic approach.All these advances also generate new fragilities and vulnerabilities propicious to threats or risks, as they stimulate the criminals' imagination.Now , cybercriminality has become reality.It is all the more dangerous as it penetrates within families , where ordinary delinquency didn't exist until now. From now on, this new kind of criminality made it obvious that the judicial system had to be adapted. Indeed , faced with these violations , there are of course laws that are applied here and now to the Internet.But , are they really efficient? In the same way, is the intersate cooperation also sufficient to fight against cybercriminality? So , it is important to wonder whether , in our modern society , the legislative framework and the institutional cooperation , both european and international , are sufficient and efficient to penalize the cybercriminal offences.

Циљ докторске дисертације је да из обимног тела
права на приватност издвоји оне норме и ставове који су кључни за
праћење права на приватност кроз призму кривичних наука, одређење
квалитета заштите и ограничења права на приватност са
кривичноправног, кривичнопроцесног и криминалистичког аспекта, као
и пружање основе за разумевање његовог могућег развоја у
будућности. Право на приватност представља изузетно обиман, сложен
и динамичан систем, тако да рад тежи да прецизно одреди тачке на
којима се заснивају и из којих су настала скорашња гледишта судске
праксе, као и да представи и одмери аргументе изнете у стручној
правној литератури. Посебну специфичност за остварење циља
дисертације представљала је и анализа Законика о кривичном поступку
који тек треба да почне да се примењује а који је анализиран кроз
одредбе које су везане за право на приватност. Нови Законик о
кривичном поступку објављен је 26.09.2011.г. у «Службеном гласнику»
Републике Србије бр.72/11 али ће са применом отпочети тек
15.јануара 2013 године, изузев у поступцима за кривична дела
организованог криминала или ратних злочина који се воде пред
посебним одељењем надлежног суда, у ком случају се примењује од 15.
јануара 2012. године. Истраживање је извршено анализом извора –
Устава РС, Законика о кривичном поступку, Кривичног законика,
Европске конвенције о људским правима, као и судске праксе
Европског суда за људска права и судова држава чланица европских
заједница, односно Европске уније. Такође, дисертација представља и
анализира мишљења и ставове изнете у релевантној стручној
литератури о предметним питањима. Будући да је анализа досадашњег
развоја права на приватност, његове заштите и ограничења, и
одговарајућих ставова судске праксе била неопходна за испуњење циља
дисертације, била је потребна и примена историјског метода.
Синтетичко посматрање праксе Европског суда за људска права, с
једне стране, и праксе судова држава чланица с друге стране,
условила је и примену упоредног метода.Коришћен је и догматски
(формално-правни или формално-логички) метод којим се утврђује
право значење правне норме, односно врши њено тумачење. Динамичност
посматраног института права на приватност са аспекта кривичних
наука условљена је динамичношћу развоја овог института и са аспекта
других наука (нпр. филозофије) , што је дисертацији поставило
захтев за комбиновање и примену не само метода својствених правној,
већ и другим друштвеним наукама.

▼ This thesis explores the boundaries of low-level public order law, drawing on optimal pathways and standardizations across the four legal systems of England and Wales, Australia, The United States of America and Germany. The aim is to identify the origins of the public order frameworks, explore limits of proscribed behaviour and to determine whether low-level public order laws satisfy the requirement of certainty within the respective jurisdictions. The requisite mental elements are investigated alongside the range of defences available to those accused of such an offence. In order to fully investigate the unique synergies between protest and low-level public order, the study uses a comparative approach to examine the interaction between the low level provisions and constitutionally guaranteed rights to free expression; including an examination of the conceptual analysis of the wider frameworks within which protest and low-level public order operate. As the source of much contemporary protest, the impact of the War on Terror upon the nexus between public order and protest will also be examined in respect all of the jurisdictions. It is argued that the law relating to low-level public order in all jurisdictions is, to some extent, based around “catch all” provisions that criminalize a broad range of behaviour and also allow the police and the courts a wide range of discretion when dealing with such offences. The various solutions in respect of structure, operation and judicial interpretation of the offences will be examined. This will highlight standardizations and also fundamental disparities between the four jurisdictions. Such a comparative investigation is unique. The study draws upon multiple standardizations to model the lower end of criminality across the four diverse legal systems, providing dynamic areas of contrast through an examination of both civil law and common law solutions to the treatment of low-level disorder. The efficacy of both codified and ad hoc arrangements to regulate disorder while guaranteeing the right to protest are also assessed. The thesis contributes to the understanding of the scope and contours of low-level public order law as well as extrapolating optimal solutions from the findings of this study.

This research examined the cultural and structural factors that supported the perpetration of domestic violence in the participants’ marriages. It explored factors that shaped participants’ attitudes towards their own victimisation in their husbands’ homes. An in-depth analysis of the risk factors together with an exploration of obstacles and barriers that deterred women from leaving their abusive marriages was presented. It was found that the participants who exercised limited household decision-making autonomy at home became increasingly vulnerable to abuse and exploitation in their marriages. The findings suggested that a woman indoctrinated with subservient qualities was more likely to accept domestic violence in her marriage. It was further demonstrated that religious beliefs and societal expectations dominated the participants’ thinking about marital sex. Denying sexual access and conflict over reproductive rights were most commonly occurring risk factors in the battered women’s accounts. A woman’s financial dependency and patriarchal child custody laws emerged as the most significant deterrents to leaving an abusive marriage.

▼ For the first time in Saudi Arabia's legal history, the
Law Reform of 2001 recognized the practice of
criminal defense and defendants' right to the assistance of an attorney. Since 2001, the right to legal representation has been enforced, and the practice of
criminal defense has been allowed. Nonetheless, the position of the practice of
criminal defense within the Saudi legal system remains unclear both in theory and in practice. This study examines the practice of
criminal defense in Saudi Arabia. It addresses the situation before and after the emergence of defense lawyers. It presents the history of
law practice and the arguments for and against this profession. Equally, it focuses on the defendant's right to legal representation, since it is associated with the practice of
criminal defense. For this purpose, I conducted an empirical study, in which I interviewed judges and lawyers who have been involved in the application of the laws relevant to the practice of
criminal defense. The interviews revealed that the practice of
criminal defense has had a good start and is heading in the right direction. Based on the results, it is obvious that the majority of interviewed judges are of the view that the practice of
criminal defense is in line with Islamic principles of justice. The results also reveal that
criminal defense services are much needed in the Saudi justice system. Since engaging in the practice of
criminal defense in 2001,
criminal defense counsels have made a significant difference in case outcomes and a positive impact on the justice system.

▼ As police forces are information intensive organisations, the use of advanced Information Systems in policing has led to the transformation of the social and the organisational life in forces. Nevertheless, the results of a pilot study conducted after four years of the roll out of mobile Kelvin devices in a medium-sized Constabulary in the UK have revealed officers’ resistance to using the full range of functionalities offered by these devices. The Kelvin devices’ initial training did not accommodate for differences in officers’ IT skills, experiences, roles, work contexts and police culture (ensuring the existence of a good-fit between all these factors). Hence, officers were unable to efficiently appropriate the Kelvin devices’ functionalities in different contexts and to various tasks. Therefore, guided by the data collected from the pilot study, a Fit and Appropriation Model for training (FAMT) is posited. FAMT aims to rectify the causes of officers’ resistance by not only creating a learning environment that bridges the gap in technical knowledge and skills but also enables learners to use their work experiences to link technology features to various tasks and contexts. The impact of using FAMT on the learning process sheds light on the key deteriminants of delivering effective technology training in organisations. The findings of the study delineate fundamental super-user’ characteristics and police culture aspects that can influence the learning process during training. Furthermore, the study highlights the significant role of providing IT support during technology training. This role should not be underestimated by mangers as it impacts profoundly on the effectiveness of female learners’ technology sense-making. Besides, incorporating collaborative training methods into FAMT have enhanced learners’ ability to extend the use of features to different contexts. Therefore, using FAMT has been perceived by officers as an effective training method that facilitates a personalised technology training and extends their knowledge about useful features in their Kelvin devices.

▼ Nesta dissertação de Mestrado é proposto abordar a problemática do Cibercrime. Todas as vantagens que encontramos na Internet facilitam a vida dos cibercriminosos.
Para compreendermos melhor o «mundo do Cibercrime» é importante o estudo dos intuitos e vulnerabilidades dos seus atores, das particularidades deste tipo de crime e as dificuldades que as autoridades sentem no seu combate e que os utilizadores têm em prevenir-se.
Mais é proposto analisar as respostas legislativas nacionais e internacionais que têm vindo a ser dadas a este tipo de criminalidade, como sejam a Convenção sobre o Cibercrime e a nova lei do Cibercrime.
Importa, ainda, discutir a aplicação ou não do Direito Penal do Risco no contexto da criminalidade informática.
Dada a presença constante da Internet na vida de todos os cidadãos é urgente o conhecimento deste fenómeno criminológico, de modo a poder identificar as causas e as possíveis medidas de prevenção e reação.
In this Master's thesis it is aimed to propose an approach to the problem of Cybercrime. All the advantages detected on the Internet generated an easier way of life cybercriminals.
To better understand the "cybercrime world’s” it is important to study the motives and vulnerabilities of its actors, the particularities of this type of crime and the difficulties that authorities have in their fight against it as well as the ones that users have to prevent it.
Additionally is proposed the analyzes of the national and international legislative responses that have been given to this type of crime, such as the Convention on Cybercrime and the New law on Cybercrime.
It also aims to discuss the application or not of the Criminal Law whenever the risk of computer crime context presents itself.
Given the relentless presence of the Internet in the lives of all citizens, there is a pressing criminological knowledge of this phenomenon, in order to pinpoint the causes and conceivable prevention actions and responses.
