Les institutions internationales ont à la suite de la 2ème guerre mondiale créé un corpus de droits reliés à l’essence de la condition humaine qui sont aussi intuitifs que difficiles à systématiser. Cette émergence se trouve à l’origine de la relation étroite entre le droit international et un noyau intangible de valeurs considérées comme universelles, érigé à la lumière de constructions philosophiques et juridiques du concept d’humanité jusqu’au moment où elles sont saisies par le droit international coutumier et conventionnel dans une logique de protection. Cette protection relève, d’un côté, du droit international pénal à partir notamment de l’édification des concepts de crime contre l’humanité et de génocide ayant comme corolaire également la définition du concept de graves violations et, de l’autre côté, du droit international des droits de l’Homme, en ce qu’il s’est occupé de la sauvegarde de l’individu en tant qu’être à la fois singulier et collectif, mais aussi des droits essentiels à la préservation de sa condition humaine. Le problème majeur qui se pose est celui des difficiles interactions entre le droit international et le droit national, combiné à l’héritage des paradigmes du droit international classique, ce qui nous amène à répondre à la question du comportement des États quand le droit international a pour objet la préservation de ce noyau dur des valeurs humaines. Dans la présente thèse, nous cherchons donc à démontrer que la protection tissée notamment sur la base des prohibitions apporte au droit international une position de suprématie liée à son caractère de jus cogens, de manière à imposer des devoirs non seulement aux États mais aussi aux individus.

Because of World War II, international institutions have created a set of rights related to the essence of the human condition that are as intuitive as to systematize. The close relationship between international law and the protection of intangible values of the human community as a whole has its sources from this emergence. Indeed, these values were identified in the light of philosophical and legal constructions about the concept of humanity until the moment when it became protected by the customary and conventional international law. On the one hand, this protection came from the international criminal law and its enlightenment about the conception of crime against humanity and genocide, in a manner that it enabled the identification of the meaning of serious violations. On the other hand, this protection came likewise from international human rights law, in which it took care to safeguard the individual either as a singular and collective human being, as well as of the fundamental rights to the preservation of its human condition. The hardest problem that is presented here is about the difficult interactions between international law and national law. Lorsque des allégations de violations du droit international des droits de l’homme (DIDH) ou du droit international humanitaire (DIH) sont rapportées dans un pays, une meilleure compréhension des faits et de la situation est souvent nécessaire afin que l’Organisation des Nations Unies (ONU) puisse répondre de manière appropriée. A cette fin, les organes de l’ONU y compris l’Assemblée générale, le Conseil de sécurité, le Secrétaire général, le Conseil des droits de l’homme et même le Haut-Commissariat aux droits de l’homme peuvent créer des missions d’établissement des faits. Ces missions sont des organes interétatiques ad hoc créés en réponse à des violations graves et massives DIDH et du DIH. Leurs fonctions principales sont le plus souvent d’établir les faits, de les qualifier en droit et de faire des recommandations pour mettre fin à ces violations et y remédier. Le recours à ces missions, parfois appelées commissions d’enquête, n’a cessé de croître ces vingt dernières années, en particulier lorsque des violations du DIDH et du DIH, pouvant constituer des crimes internationaux, sont alléguées. A cet égard, la théorie de la justice transitionnelle et la doctrine de la responsabilité de protéger ont ouvert de nouvelles perspectives pour l’établissement des faits. Ceci explique que les objectifs et les fonctions des missions d’établissement des faits se sont diversifiés. Cependant, les Etats et une partie de la doctrine remettent en cause le caractère ad hoc du mode de création de ces missions, de leur mandat, et de leurs méthodes de travail. Nous étudierons cette tension entre uniformité et diversité afin de proposer des solutions adaptées permettant de remédier aux problèmes dénoncés par la doctrine et de maximiser l’impact de ces missions sur de la réponse des parties prenantes notamment l’État concerné et l’ONU.

To respond appropriately to violations of human rights and humanitarian law, the United Nations requires an in-depth knowledge of the facts alleged and a better understanding of the relevant situation on the ground. To this end, United Nations organs including the General Assembly, the Security Council, the Secretary General, the Human Rights Council and even the Office of the High Commissioner for Human Rights may create fact-finding missions. These missions are collegial ad hoc bodies created in response to human rights and humanitarian law violations that are particularly grave. Their functions generally include establishing the facts, conducting a legal appraisal of facts, and making recommendations for the cessation of violations and for their remedy. In the past twenty years, United Nations organs have increasingly resorted to these missions – often referred to as commissions of inquiry – in particular when violations of international human rights and international humanitarian law may amount to international crimes. Žemės naudojimo valstybine kontrole siekiama užtikrinti, kad valdant ir naudojant žemę būtų laikomasi Lietuvos Respublikos žemės įstatymo bei kitų įstatymų, kurie susiję su žemės naudojimo priežiūra. Siekiant užtikrinti tinkamą žemės naudojimą, susiduriama su įvairiais pažeidimais. Tyrimas atliktas siekiant nustatyti žemės naudojimo valstybinės kontrolės darbų organizavimo problemas, trukdančias pasiekti efektyvų kontrolės vykdymą. Tyrimo objektu pasirinktas žemės naudojimo valstybinės kontrolės vykdymas Alytaus ir Lazdijų rajonuose 2007–2009 m. Tyrimams panaudoti literatūros šaltinių analizės, alternatyvų paieškos, lyginamosios ir vertinamosios analizės ir loginio mąstymo metodai. In order to determine whether the land is used rationally and purposefully, state control of land use is performed. By the state control of land use one strives to ensure that while managing and using land, the land law and other laws of the Republic of Lithuania related to land use care are obeyed. While trying to ensure the appropriate use of land, a lot of different offences can be met. The research was carried out in order to find out the problems of state control of land use which might be the obstacles of effective control implementation. During the research the object selected was the research of land use control procedures Alytus and Lazdijai district in 2007-2009 year. During the research the analysis of literature sources, alternative search, comparative and evaluation analyses and methods of logical thinking were used. In Master Work the use of land and legal acts that regulate state control implementation and control implementation work reports of National Land Service under the Ministry of Agriculture and Alytus, Lazdijai district were analyzed. ▼ The focus of this dissertation is the impact that the Administrative Adjudication of Road Traffic Offences Act 45 of 1998 (AARTO) will have on the employment relationship between employers and employees. AARTO was promulgated in order to, amongst other things; assist with the streamlining of the traffic offence administration and the collection of payable fines for traffic infringements. Very little has been written with regard to the implications of AARTO on the employment relationship. The purpose of this dissertation is to unpack the mechanics of AARTO, and further to provide the writer’s view on its impact, problems and possible solutions, of the employment relationship within the South African Labour law framework. The writer will attempt to reconcile the Labour Relations Act and AARTO insofar as it impacts on the employment relationship, more especially the termination thereof. Writer will set out the provisions of AARTO and the sections pertaining to the allocation of demerit points on an individual driver’s licence. Unfortunately for the sake of completeness the writer will deal with the majority of sections in AARTO to provide a better understanding of the mechanisms envisaged by the Act to bring about the demerit points. It is writer’s view that dealing with the allocation of demerit points in vacuum will not provide the reader with a clear understanding of the impact of AARTO on labour relations. With regards to the actual implications that AARTO will have on the employment relationship writer has taken it upon himself to provide a categorization of employees in the broad sense and thereafter to discuss the impact of AARTO on the different categories of employees. Criminal Justice

Each year, approximately one-third of all people admitted to prison in the United States are committed as the result of a revocation of community-based supervision such as probation, parole, or federal supervised release (Carson & Anderson, 2016). Many of these individuals are being incarcerated for technical violations of their supervision - conduct other than the commission of a new crime which is in violation of a condition of supervision. The practice of committing offenders to prison for technical violations of supervision is rather common at the state level. In a 2013 study, for example, Ostermann found that although paroled inmates in New Jersey were less likely than inmates who served their entire prison terms without parole to engage in new criminal conduct following their release, the paroled inmates were just as likely to be returned to prison within three years due to having been charged with technical violations of their supervision. This practice also occurs in the federal criminal justice system, where 70% of the offenders under community-based supervision who are returned to prison each year are recommitted on the strength of technical violations of supervision alone (Administrative Office of the United States Courts, 2017a). A substantial amount of prior work (for example, Apel et al., 2010; Clear, 2007; Petit, Sykes & Western, 2009; Rose & Clear, 1998) has revealed the potentially harmful consequences of imprisonment. Despite this, little research has examined how incarcerating persons for technical violations of supervision compares to widely-available alternative, intermediate sanctions such as home confinement and reentry center placement in terms of ability to prevent the commission of new crimes or continued technical non-compliance. The present study examined these questions, utilizing a sample of offenders in the federal criminal justice system. Propensity score matching was used to construct comparable treatment and control groups, thereby reducing concerns of selection bias. Post-matching analyses suggest the following: 1) the effect of incarcerating offenders for technical violations of supervision is negligible compared to subjecting them to intermediate sanctions with regard to preventing the commission of new crimes; 2) offenders incarcerated for technical violations of supervision are more likely to commit new crimes post-sanction – and sooner – than offenders subjected to intermediate sanctions; 3) offenders imprisoned for technical violations are more likely to engage in subsequent technical violations – and sooner – than offenders subjected to intermediate sanctions; and 4) the greater the intensity of the intermediate sanction (i.e., residential reentry center placement vs. home confinement), the more likely an offender will be charged with a technical violation during service of the sanction. ▼ This thesis seeks to address two related research questions. First, to consider and assess the Irish State’s approach and legal responses to historical practices of illegal adoption – how are such legal responses affected by the gender-neutral conceptualisation and articulation of these practices and the resulting human rights abuses; and secondly, what is the potential of international human rights law in sourcing nuanced or appropriate legal remedies for these abuses. It explores the existence of this gap in terms of legal frameworks and responses nationally and internationally, highlighting the failure to address these violations, before re-conceptualising the articulation of these practices as gender-specific practices that targeted unmarried women and girls. The thesis draws together diverse legal perspectives, from feminist legal theory, transitional justice and international human rights law, and applies them for the first time to the historical practices of illegal adoption in Ireland. It builds on feminist legal theory critiquing the private public dichotomy, to argue for a gender-specific articulation and recognition of these human rights abuses as a form of reproductive violence and gender-discrimination. This enables the transition of these human rights abuses from the private sphere to the public domain, forcing the State to recognise the gendered nature of the abuses and harm suffered. It also draws on the theoretical conceptualisation of time in law to illustrate how law can be used to silence these gendered abuses (e.g. the Statute of Limitations, time-limited payment schemes). The use of time through law in this manner is significant in light of approaching how to remedy the human rights violations caused. Finally, the thesis relies on feminist legal perspectives in both international human rights law and transitional justice to argue for a transformative response to the legal forms of redress, reparations and truth recovery to historical practices of illegal adoption. Tyrimo tikslas yra aptarti vaiko teisių galimus pažeidimus ir prevenciją internetiniuose socialiniuose tinkluose. Magistro darbe analizuojamas vaiko teisių pažeidimų internetiniuose socialiniuose tinkluose prevencijos organizavimas ir įgyvendinimas gimnazijoje, siekiant išsiaiškinti esamą situaciją, kad būtų imtasi konkrečių veiksmų plano. Tyrimas buvo organizuojamas 2012 metų gruodžio 17-21 dienomis. Anketinės apklausos metodu ištirti 170 gimnazijos I ir II klasės mokiniai (iš jų 88 pirmokai ir 82 antrokai) bei 35 pedagogai ir kiti gimnazijos darbuotojai, dirbantys šioje gimnazijoje. Tyrimo rezultatai parodė, jog gimnazistai suvokia internetinių socialinių tinklų grėsmes, dažnai su jomis susiduria pažeisdami savo teises. Šios grėsmės internete juos neramina, o susidūrę su jomis jie linkę apie tai niekam nepasakoti. Research objective is to review violations of children’s rights in online social networks. In MA thesis there is being analysed the prevention management and implementation of violations of children‘s rights in gymnasium having the aim to clarify a present situation in order the efficient action plan to be created. The research was conducted 17-21 December in 2012. Using the method of questionnaire survey there were interviewed 170 gymnasium‘s first and second graders (out of them 88 first graders and 82 second graders), 35 teachers and other employees who work in this gymnasium. Research outcome showed that gymnasium students realise threats of social networks and face them violating their rights. These threats on the Internet make them feel anxious and while facing them they are tend not to talk to anybody. Students feel quite confident in having knowledge and skills to communicate on the Internet and abilities to ensure safe work online. The analysis of research findings revealed particularities of prevention management in the gymnasium concerning violations of children‘s rights in social networks: impellent prevention activity is not sufficient enough in the gymnasium; the gymnasium community educating students about their safe work online narrow to shallow spreading of information and education; not all teaching staff educate and inform students about their safe work online. ▼ "Ideally, peacekeeping operations demonstrate the concern of the international community in situations of instability or conflict arising between or within states. They are conceived to bring about peace and 'ensure the effective promotion and protection of [human] rights'. As a result, peacekeeping operations as well as peacekeepers are expected to comply with standards of human rights and humanitarian law. With respect to the Economic Community of West African States Cease-Fire Monitoring Group (ECOMOG), its intervention in Liberia, Sierra Leone, Guinea Bissau, and Côte d'Ivoire have been generally welcomed as a response to barbaric and devastating wars in West Africa. However, the observation of ECOMOG missions reveals several instances of violations of human rights and humanitarian law committed by ECOMOG peacekeepers. These violations include attacks against civilians, summary executions, rapes, torture, looting, etc. In other words, the saviours have turned into violators of rights. While these violations have provoked concern and indignation, few measures have been taken to address the problem, hold peacekeepers accountable and prevent abuses in the future. ... This study is divided into five chapters. Chapter one provides, among other, the background of the study, the statement of the research problem and the significance of the study. Chapter two gives an insight into the creation, structure, mechanisms and evolution of ECOMOG as the peacekeeping organ of ECOWAS. Chapter three examines the basis for the applicability of human rights and international humanitarian law to peacekeepers and shows the violations committed by the ECOMOG peacekeepers since 1990. Chapter four analyses the responses to abuses committed by ECOMOG peacekeepers. It discusses the national, regional and universal responses to these abuses. It investigates both prevention and accountability mechanisms existing to address abuses committed by ECOMOG peacekeepers. It also explores some potential accountability and prevention mechanisms. Det finns både nationella och internationella lagar och överenskommelser som ligger till grund för stridskrafters användande. Det finns också politiska styrningar från regering och riksdag om hur verksamhet ska bedrivas i form utav handlingsregler, som ligger till grund för Försvarsmaktens Rules of Engagement. Det finns alltså två dimensioner som Rules of Engagement kan reflektera: en politisk och en legal. Syftet med detta arbete är att synliggöra vilka begränsningar och möjligheter sampelet mellan politiska intressen och rättsliga grunder sätter på den taktiska handlingsfriheten. Frågeställningarna har besvarats utifrån en fallstudie på ubåt 137 grundstöttning utanför Karlskrona. Som teoretiskt verktyg för att möjliggöra analys har begreppet taktisk handlingsfrihet använts. Resultatet av denna uppsats är att den legala dimensionen är från början redan given, förankrade i sedvänja, traktat och internationella överenskommelser. Den politiska dimensionen är däremot rörlig där möjliga handlingsvägar styrs av politiska målsättningar och tillgängliga medel. En politisk medvetenhet i den taktiska tankeprocessen är därför nödvändig.

There are both national and international laws and regulations which is the basis for the use of armed forces. There are also political regulations from both the government and the parliament of how armed forces are used. Laws and political regulations is the foundation for the Swedish Armed Forces Rules of Engagement. There are therefore two dimensions that could reflect Rules of Engagement, one political and one legal. The purpose of this work is to visualize restrictions and possibilities the interaction between the political and legal dimensions could get on the tactical freedom of action. To answer the questions a case study has been done on the submarine 137 incident outside Karlskrona. As a theoretical framework the concept of tactical freedom of action have been used. The result from this essay is that the legal dimension is already given from the beginning, while the political dimension is more mobile, where ways of action depends on political goals and available funds. A political awareness in the tactical process of thinking is therefore necessary.

O objeto da tese de doutorado é a análise da relação entre a defesa da concorrência e a proteção do consumidor, duas políticas públicas que proporcionam benefícios mútuos e devem ser executadas de modo harmônico, havendo substrato normativo e teórico para incluir a preocupação com o bem-estar do consumidor como um dos objetivos da política de defesa da concorrência. No Brasil tal harmonização é uma imposição constitucional, já que a livre concorrência, a repressão ao abuso do poder econômico e a defesa do consumidor são princípios conformadores da ordem econômica. É defendida a utilização de um conceito unificado de consumidor, sendo adotada a teoria finalista, que o define como o destinatário final econômico do bem ou serviço. As duas políticas utilizam diferentes instrumentos e perspectivas na tutela do bem-estar do consumidor, o que fica claro na proteção do direito de escolha. O Código de Defesa do Consumidor oferece a isonomia como remédio para compensar a vulnerabilidade, estabelecendo regras destinadas à uma escolha consciente, sobretudo o direito à informação adequada e veraz. Já as normas de defesa da concorrência resguardam a liberdade preocupando-se em preservar a possibilidade de escolha entre mais de um fornecedor de produtos ou serviços. O exemplo mais contundente dá-se no controle de estruturas: a atuação das autoridades responsáveis pela análise dos atos de concentração é vinculada à preservação do excedente do consumidor e das condições imprescindíveis ao exercício do direito de escolha, sendo vedada a aprovação de fusões que prejudiquem o bemestar do consumidor. No âmbito repressivo a harmonização das duas políticas é intensificada com a colaboração entre as autoridades de defesa da concorrência e de proteção do consumidor para a fiscalização de condutas que configurem, ao mesmo tempo, infrações contra a ordem econômica e práticas abusivas, cuja dupla capitulação não acarreta bis in idem, pois são distintas as esferas jurídicas tuteladas, havendo assim diversidade de fundamentos. É salientada a importância das ações coletivas para reparação de danos causados aos consumidores por infrações contra a ordem econômica e defendida a adoção dos danos multiplicados e a manutenção da destinação dos valores arrecadados por multas a infrações contra a ordem econômica ao Fundo Federal de Direitos Difusos.

The thesis analyzes the relationship between the competition defense and the consumer protection, both public policies that offer mutual benefits and must be carried out in a harmonic way. So, there is a normative and theoretical substratum concerning the consumer welfare as one of the objectives of the antitrust policy. In Brazil such harmonization is imposed by the Constitution, since the free competition, the repression of the abuse of the economic power and the consumer protection are principles that pertain to the constitutional economic order. Med glavne vire proračunskih sredstev spadajo nedvomno davki, katerih pobiranje ureja davčni postopek. Država v davčnem odnosu nasproti posamezniku nastopa oblastno in pri tem mora spoštovati pravice posameznika, ki so ustavno določene. Ustava določa katalog temeljnih človekovih pravic in svoboščin, žal pa te niso kršene le v kazenskih in civilnih zadevah, ampak tudi na področju davčnega prava. Poleg Ustave RS je Slovenija zavezana spoštovati človekove pravice in svoboščine, ki so zapisane v Evropski konvenciji o varovanju človekovih pravic in temeljnih svoboščin. Kršitve in nespoštovanje človekovih pravic in svoboščin presoja Evropsko sodišče za človekove pravice, ki pa ne obravnava le zadev iz kazenskega področja ali iz področja civilnega prava, temveč tudi iz področja davčnega prava. Dejstvo je, da prihaja do kršitev tudi v zvezi z davki, zato bom v magistrskem delu raziskovala davčni postopek v luči človekovih pravic. Najprej bom predstavila Evropsko konvencijo o varovanju človekovih pravic in temeljnih svoboščin in Evropsko sodišče za človekove pravice, nadalje pa se bom osredotočila na ustavne pravice, ki so nemalokrat kršene v davčnem postopku. Za varovanje človekovih pravic in svoboščin je ustanovljen poseben organ in sicer Varuh človekovih pravic, katerega uvedbo predpisuje Ustava RS. Varuh človekovih pravic in svoboščin oziroma ombudsman je najbolj razširjena oblika neformalnega in zunaj sodnega varstva pravic posameznikov v razmerju do državnih organov. Kadar pride do kršitve, daje slovenska zakonodaja zavezancu za davek na voljo različna pravna sredstva, katerih namen je, da se kršitev odpravi in povrne morebitna škoda. Tovrstna pravna sredstva bom opredelila v predzadnjem poglavju, na koncu pa bom predstavila sodno prakso Evropskega sodišča za človekove pravice v zvezi s kršitvami v davčnih postopkih in odločitve sodišča. EKČP zavezuje vsako državo podpisnico, da zagotovi skladnost svoje zakonodaje in ostalih predpisov s konvencijskimi standardi, kar se posledično kaže v prilagoditvah in spremembah v sodni in upravni praksi.

▼ This thesis investigates the creation of collective memory by exploring the case of a new government-sponsored Museum of Memory and Human Rights in Chile. The exhibit commemorates human rights violations perpetrated by the State during the country's dictatorship (1973-1990). Being the first government-sponsored memorial of its kind and magnitude, the exhibit speaks to Chile's post-authoritarian democratization efforts and to the multiple challenges still facing memory-making today. Remembering traumatic events, which defy and often threaten a social group's core sense of collectivity, can be a taxing and daring task. Memory-makers or "carrier-groups" that framed this trauma narrative for others to use were faced with difficult questions when attempting to tell a story about controversial and painful events. The way the museum's narrative is framed also carries implications for human rights and for the quality of democratic development today. To better understand this case, the thesis asks (1) how were individual stories transformed into a collective representation?; (2) given that defining memory is often polemical, how is this representation sustained as legitimate?; and (3) what are the implications of this official portrayal of national memory for human rights and democratic development in Chile today? Negotiation and mythification are identified as two processes by which memory-makers transformed individual accounts of the past into a legitimate and single collective representation. My analysis shows the museum chose to focus its narrative on honoring dictatorship victims (of forced disappearance and extrajudicial executions). It does so through a Catholic narrative of salvation, whereby victims are provided a sacred space for reverence. While this myth helps establish a broadly recognized symbolic grave for dictatorship victims, it also depoliticizes and dehistoricizes Chile's authoritarian period. The narrative helps secure the Chilean State as a guarantor of civil and political rights, but of social, economic and cultural rights, which have become prominent in democratization agendas since the 2000s and whose inclusion in the exhibit would allow for a deeper interrogation of the past in light of current social challenges. In recent decades, arbitration of international commercial disputes has increased and is likely to continue to grow. Many businesses prefer arbitration to litigation in court because of its relative promptness, privacy and economy. However, in some instances, arbitration requires the support of national courts to be effective when arbitral awards are not satisfied through voluntary compliance of the parties. The most important convention seeking to regulate enforcement of arbitral awards is the New York Convention. The primary goal of the Convention is to make it easier for parties to recognize and enforce arbitral awards around the world. While requiring contracting countries to recognize and enforce arbitral awards, the New York Convention sets forth enumerated grounds upon which a court may refuse to enforce them. It dictates that recognition or enforcement may be refused only for a restricted number of clearly defined defenses, related to procedural fairness and public policy. Among these defenses, the public policy exception is most frequently invoked and has also become one of the most controversial grounds for refusing to enforce arbitral awards. This paper will examine the international conventions that govern international commercial arbitration, and analyze the problems that arise when parties use the court system to enforce arbitration awards. It will look specifically at whether the public policy defense is so vague that it fails to provide the uniform interpretation and application needed to guide national courts in reviewing the enforceability of an international arbitration award, and will propose helpful modifications. The individual chapters will narrow this focus by providing an overview of the public policy exception, followed by an assessment of existing international arbitration law, both substantive and procedural, followed by a partial inventory of the interpretive variations and case law considering the public policy exception, and ultimately a discussion of applicability and enforceability issues.

The cross-border insolvency of international banks is magnified by the unresolved multi-jurisdictional cross-border conflicts that ensue between jurisdictions. The recent global financial crisis has shown that the big insolvency cases produce adverse consequences worldwide because of significant and complex legal issues.
